SahihAlBukhari-017-001-1308 | Narrated Ubada Bin AlSamit: Allah Messenger ﷺ said to us while we were in a gathering; Give me the oath Pledge of allegiance for: 1 Not to join anything in worship along with Allah; 2 Not to steal; 3 Not to commit illegal sexual intercourse; 4 Not to kill your children; 5 Not to accuse an innocent person to spread such an accusation among people ; 6 Not to be disobedient when ordered to do good deeds. The Prophet ﷺ added: Whoever amongst you fulfill his pledge; his reward will be with Allah; and whoever commits any of those sins and receives the legal punishment in this world for that sin; then that punishment will be an expiation for that sin; and whoever commits any of those sins and Allah does not expose him; then it is up to Allah if He wishes He will punish him or if He wishes; He will forgive him. SahihAlBukhari-017-001-1437 | Narrated Sahl Bin Saad AlSaidi: Uwaimir AlAjlani came to Aasi m Bin Adi and said; If a man found another man with his wife and killed him; would you sentence the husband to death in Qisas; i.e.; equality in punishment ? O Aasi m! Please ask Allah Messenger ﷺ about this matter on my behalf. Aasi m asked the Prophet ﷺ but the Prophet disliked the question and disapproved of it. Aasi m returned and informed Uwaimir that the Prophet disliked that type of question. Uwaimir said; By Allah; I will go personally to the Prophet. Uwaimir came to the Prophet ﷺ when Allah had already revealed Quranic Verses in that respect ; after Aasi m had left the Prophet ﷺ. So the Prophet ﷺ said to Uwaimir; Allah has revealed Quranic Verses regarding you and your wife. The Prophet ﷺ then called for them; and they came and carried out the order of Lian. Then Uwaimir said; O Allah Messenger ﷺ ! Now if I kept her with me; I would be accused of telling a lie. So Uwaimir divorced her although the Prophet ﷺ did not order him to do so. Later on this practice of divorcing became the tradition of couples involved in a case of Lian. The Prophet ﷺ said to the people. Wait for her! If she delivers a red short small child like a Wahra a short red animal. then I will be of the opinion that he Uwaimir has told a lie but if she delivered a black big-eyed one with big buttocks; then I will be of the opinion that he has told the truth about her. Ultimately she gave birth to a child that proved the accusation. SahihAlBukhari-017-001-1614 | Narrated Ibn Abbas: Lian was mentioned in the presence of the Prophet; Aasi m Bin Adi said a statement about it; and when he left; a man from his tribe came to him complaining that he had seen a man with his wife. Aasi m said; I have been put to trial only because of my statement. So he took the man to the Prophet ﷺ and the man told him about the incident. The man husband was of yellow complexion; thin; and of lank hair; while the man whom he had accused of having been with his wife; was reddish brown with fat thick legs and fat body. The Prophet ﷺ said; O Allah! Reveal the truth. Later on the lady delivered a child resembling the man whom the husband had accused of having been with her. So the Prophet ﷺ made them take the oath of Lian. A man said to Ibn Abbas in the gathering; Was that the same lady about whom the Prophet ﷺ said; If I were to stone any lady for committing illegal sexual intercourse to death without witnesses; I would have stoned that lade to death? SahihAlBukhari-017-001-3178 | Narrated Saeed Bin Jubair: I asked Ibn Umar; What is the verdict if a man accuses his wife of illegal sexual intercourse? Ibn Umar said; The Prophet ﷺ separated by divorce the couple of Bani AlAjlan; and said; to them ; Allah knows that one of you two is a liar; so will one of you repent? But both of them refused. He again said; Allah knows that one of you two is a liar; so will one of you repent? But both of them refused. So he separated them by divorce. Ayoub ; a sub-narrator said: Amr Bin Dinar said to me; There is something else in this Hadith which you have not mentioned. SahihAlBukhari-017-001-3212 | Narrated Saeed Bin Jubair: I said to Ibn Umar; If a man accuses his wife of illegal sexual intercourse what is the judgment ? SahihAlBukhari-017-001-3698 | Narrated Aisha: A black lady slave of some of the Arabs embraced Islam and she had a hut in the Masjid. When she said the above verse many times; I i.e. Aisha asked her; What was the day of the scarf? She replied; Once the daughter of some of my masters went out and she was wearing a leather scarf round her neck and the leather scarf fell from her and a kite descended and picked it up; mistaking it for a piece of meat. SahihAlBukhari-017-001-4432 | Narrated Aisha: the wife of the Prophet Whenever Allah Messenger ﷺ intended to go on a journey; he would draw lots amongst his wives and would take with him the one upon whom the lot fell. During a Ghazwa of his; he drew lots amongst us and the lot fell upon me; and I proceeded with him after Allah had decreed the use of the veil by women. I was carried in a Howdah on the camel and dismounted while still in it. When Allah Messenger ﷺ was through with his Ghazwa and returned home; and we approached the city of Medina; Allah Messenger ﷺ ordered us to proceed at night. When the order of setting off was given; I walked till I was past the army to answer the call of nature. After finishing I returned to the camp to depart with the others and suddenly realized that my necklace over my chest was missing. So; I returned to look for it and was delayed because of that. The people who used to carry me on the camel; came to my Howdah and put it on the back of the camel; thinking that I was in it; as; at that time; women were light in weight; and thin and lean; and did not use to eat much. So; those people did not feel the difference in the heaviness of the Howdah while lifting it; and they put it over the camel. At that time I was a young lady. They set the camel moving and proceeded on. I found my necklace after the army had gone; and came to their camp to find nobody. So; I went to the place where I used to stay; thinking that they would discover my absence and come back in my search. While in that state; I felt sleepy and slept. Safwan Bin Muattal AlSulami AlDhakwani was behind the army and reached my abode in the morning. When he saw a sleeping person; he came to me; and he used to see me before veiling. So; I got up when I heard him saying; Inna lil-lah-wa inn a ilaihi rajiun We are for Allah; and we will return to Him. He made his camel knell down. He got down from his camel; and put his leg on the front legs of the camel and then I rode and sat over it. Safwan set out walking; leading the camel by the rope till we reached the army who had halted to take rest at midday. Then whoever was meant for destruction; fell into destruction; some people accused me falsely and the leader of the false accusers was Abdullah Bin Ubai Bin Salul. After that we returned to Medina; and I became ill for one month while the people were spreading the forged statements of the false accusers. I was feeling during my ailment as if I were not receiving the usual kindness from the Prophet ﷺ which I used to receive from him when I got sick. But he would come; greet and say; How is that girl ? I did not know anything of what was going on till I recovered from my ailment and went out with Um Mistah to the Manasi where we used to answer the call of nature; and we used not to go to answer the call of nature except from night to night and that was before we had lavatories near to our houses. And this habit of ours was similar to the habit of the old Arabs in the open country or away from houses. So. I and Um Mistah bint Ruhm went out walking. Um Mistah stumbled because of her long dress and on that she said; Let Mistah be ruined. I said; You are saying a bad word. Why are you abusing a man who took part in the battle of Badr? She said; O Hanata you there didnt you hear what they said? Then she told me the rumors of the false accusers. My sickness was aggravated; and when I returned home; Allah Messenger ﷺ came to me; and after greeting he said; How is that girl ? I requested him to allow me to go to my parents. I wanted then to be sure of the news through them I Allah Messenger ﷺ allowed me; and I went to my parents and asked my mother; What are the people talking about? She said; O my daughter! Dont worry much about this matter. By Allah; never is there a charming woman loved by her husband who has other wives; but the women would forge false news about her. I said; Glorified be Allah! Are the people really taking of this matter? That night I kept on weeping and could not sleep till morning. In the morning Allah Messenger ﷺ called Ali Bin Abu Talib and Usama Bin Zaid when he saw the Divine Inspiration delayed; to consul them about divorcing his wife i.e. Aisha. Usama Bin Zaid said what he knew of the good reputation of his wives and added; O Allah Messenger ﷺ ! Keep you wife; for; by Allah; we know nothing about her but good. Ali Bin Abu Talib said; O Allah Messenger ﷺ ! Allah has no imposed restrictions on you; and there are many women other than she; yet you may ask the woman-servant who will tell you the truth. On that Allah Messenger ﷺ called Buraira and said; O Burair. Did you ever see anything which roused your suspicions about her? Buraira said; No; by Allah Who has sent you with the Truth; I have never seen in her anything faulty except that she is a girl of immature age; who sometimes sleeps and leaves the dough for the goats to eat. On that day Allah Messenger ﷺ ascended the pulpit and requested that somebody support him in punishing Abdullah Bin Ubai Bin Salul. Allah Apostle said; Who will support me to punish that person Abdullah Bin Ubai Bin Salul who has hurt me by slandering the reputation of my family? By Allah; I know nothing about my family but good; and they have accused a person about whom I know nothing except good; and he never entered my house except in my company. Saad Bin Muadh got up and said; O Allah Messenger ﷺ ! by Allah; I will relieve you from him. If that man is from the tribe of the Aus; then we will chop his head off; and if he is from our brothers; the Khazraj; then order us; and we will fulfill your order. On that Saad Bin Ubada; the chief of the Khazraj and before this incident; he had been a pious man; got up; motivated by his zeal for his tribe and said; By Allah; you have told a lie; you cannot kill him; and you will never be able to kill him. On that Usaid Bin AlHadir got up and said to Saad Bin Ubada ; By Allah! you are a liar. By Allah; we will kill him; and you are a hypocrite; defending the hypocrites. On this the two tribes of Aus and Khazraj got excited and were about to fight each other; while Allah Messenger ﷺ was standing on the pulpit. He got down and quieted them till they became silent and he kept quiet. On that day I kept on weeping so much so that neither did my tears stop; nor could I sleep. In the morning my parents were with me and I had wept for two nights and a day; till I thought my liver would burst from weeping. While they were sitting with me and I was weeping; an Ansari woman asked my permission to enter; and I allowed her to come in. She sat down and started weeping with me. While we were in this state; Allah Messenger ﷺ came and sat down and he had never sat with me since the day they forged the accusation. No revelation regarding my case came to him for a month. He recited Tashah-hud i.e. None has the right to be worshipped but Allah and Muhammad is His Apostle and then said; O Aisha! I have been informed such-and-such about you; if you are innocent; then Allah will soon reveal your innocence; and if you have committed a sin; then repent to Allah and ask Him to forgive you; for when a person confesses his sin and asks Allah for forgiveness; Allah accepts his repentance. When Allah Messenger ﷺ finished his speech my tears ceased completely and there remained not even a single drop of it. I requested my father to reply to Allah Messenger ﷺ on my behalf. My father said; By Allah; I do not know what to say to Allah Messenger ﷺ. I said to my mother; Talk to Allah Messenger ﷺ on my behalf. She said; By Allah; I do not know what to say to Allah Apostle. I was a young girl and did not have much knowledge of the Quran. I said. I know; by Allah; that you have listened to what people are saying and that has been planted in your minds and you have taken it as a truth. Now; if I told you that I am innocent and Allah knows that I am innocent; you would not believe me and if I confessed to you falsely that I am guilty; and Allah knows that I am innocent you would believe me. By Allah; I dont compare my situation with you except to the situation of Joseph father i.e. Jacob who said; So for me patience is most fitting against that which you assert and it is Allah Alone whose help can be sought. Then I turned to the other side of my bed hoping that Allah would prove my innocence. By Allah I never thought that Allah would reveal Divine Inspiration in my case; as I considered myself too inferior to be talked of in the Holy Quran. I had hoped that Allah Messenger ﷺ might have a dream in which Allah would prove my innocence. By Allah; Allah Apostle had not got up and nobody had left the house before the Divine Inspiration came to Allah Apostle. So; there overtook him the same state which used to overtake him; when he used to have; on being inspired divinely. He was sweating so much so that the drops of the sweat were dropping like pearls though it was a cold wintry day. When that state of Allah Messenger ﷺ was over; he was smiling and the first word he said; Aisha! Thank Allah; for Allah has declared your innocence. My mother told me to go to Allah Messenger ﷺ. I replied; By Allah I will not go to him and will not thank but Allah. So Allah revealed: Verily! They who spread the slander are a gang among you... 24.11 When Allah gave the declaration of my Innocence; Abu Bakr; who used to provide for Mistah Bin Uthatha for he was his relative; said; By Allah; I will never provide Mistah with anything because of what he said about Aisha. But Allah later revealed: - And let not those who are good and wealthy among you swear not to help their kinsmen; those in need and those who left their homes in Allah Cause. Let them forgive and overlook. Do you not wish that Allah should forgive you? Verily! Allah is Oft-forgiving; Most Merciful. 24.22 After that Abu Bakr said; Yes ! By Allah! I like that Allah should forgive me; and resumed helping Mistah whom he used to help before. Allah Messenger ﷺ also asked Zainab bint Jahsh i.e. the Prophet wife about me saying; What do you know and what did you see? She replied; O Allah Messenger ﷺ ! I refrain to claim hearing or seeing what I have not heard or seen. By Allah; I know nothing except goodness about Aisha. SahihAlBukhari-017-001-6074 | Narrated Ubada Bin AlSamit: who took part in the battle of Badr and was a Naqib a person heading a group of six persons ; on the night of AlAqaba pledge: Allah Apostle said while a group of his companions were around him; Swear allegiance to me for: 1. Not to join anything in worship along with Allah. 2. Not to steal. 3. Not to commit illegal sexual intercourse. 4. Not to kill your children. 5. Not to accuse an innocent person to spread such an accusation among people. 6. Not to be disobedient when ordered to do good deed. The Prophet ﷺ added: Whoever among you fulfills his pledge will be rewarded by Allah. And whoever indulges in any one of them except the ascription of partners to Allah and gets the punishment in this world; that punishment will be an expiation for that sin. SahihAlBukhari-017-001-7061 | Narrated Ibn Abbas: Hilal Bin Umaiya accused his wife of committing illegal sexual intercourse with Sharik Bin Sahma and filed the case before the Prophet. The Prophet ﷺ said to Hilal ; Either you bring forth a proof four witnesses or you will receive the legal punishment lashes on your back. Hilal said; O Allah Apostle! If anyone of us saw a man over his wife; would he go to seek after witnesses? The Prophet ﷺ kept on saying; Either you bring forth the witnesses or you will receive the legal punishment lashes on your back. Hilal then said; By Him Who sent you with the Truth; I am telling the truth and Allah will reveal to you what will save my back from legal punishment. Then Gabriel came down and revealed to him:- As for those who accuse their wives... 24.6-9 The Prophet ﷺ recited it till he reached:... her accuser is telling the truth. Then the Prophet ﷺ left and sent for the woman; and Hilal went and brought her and then took the oaths confirming the claim. The Prophet ﷺ was saying; Allah knows that one of you is a liar; so will any of you repent? Then the woman got up and took the oaths and when she was going to take the fifth one; the people stopped her and said; It the fifth oath will definitely bring Allah curse on you if you are guilty. So she hesitated and recoiled from taking the oath so much that we thought that she would withdraw her denial. But then she said; I will not dishonor my family all through these days; and carried on the process of taking oaths. The Prophet ﷺ then said; Watch her; if she delivers a black-eyed child with big hips and fat shins then it is Sharik Bin Sahma child. Later she delivered a child of that description. SahihAlBukhari-017-001-927 | Narrated Aisha: There was a black slave girl belonging to an Arab tribe and they manumitted her but she remained with them. The slave girl said; Once one of their girls of that tribe came out wearing a red leather scarf decorated with precious stones. It fell from her or she placed it somewhere. A kite passed by that place; saw it Lying there and mistaking it for a piece of meat; flew away with it. Those people searched for it but they did not find it. So they accused me of stealing it and started searching me and even searched my private parts. The slave girl further said; By Allah! while I was standing in that state with those people; the same kite passed by them and dropped the red scarf and it fell amongst them. I told them; This is what you accused me of and I was innocent and now this is it. Aisha added: That slave girl came to Allah Messenger ﷺ and embraced Islam. She had a tent or a small room with a low roof in the Masjid. SahihMuslim-017-001-21198 | Saeed b Jubair reported: I was asked about the invokers of curses during the reign of mousab Bin AlZubair whether they could separate themselves by this process. He said: I did not understand what to say. So I went to the house of Ibn Umar Allah be pleased with them in Mecca. I said to his servant: Seek permission for Me. He said that he Ibn Umar had been taking rest. He Ibn Umar heard my voice. and said: Are you Ibn Jubair? I said: Yes. Hesaid: Come in. By Allah; it must be some great need which has brought you here at this Hour. So I got in and found him lying on a blanket reclining against a pillow stuffed with fibres of date-palm. I said: O AbuAbd AlRahman; should there be separation between the invokers of curses? He said: Hallowed be Allah; yes; The first one who asked about it was so and so. he said: Messenger of Allah; tell me If one of us finds his wife committing adultery: what should he do? If he talks; that is something great; and if he keeps quiet that is also something great which he cannot afford to do. Allah Prophet ﷺ kept quiet or some time. After some time he that very person came to him Allah Messenger and said: I have been involved in that very cage about which I had asked you Allah the Exalted and Majestic then revealed these verses of Surah Nur: Those who accuse their wives verse 6 ; and he the Holy Prophet recited them to him and admonished him; and exhorted him and informed him that the torment of the world is less painful than the torment of the Hereafter. He said: No; by Him Who sent you with Truth; I did not tell a lie against her. He the Holy Prophet then called her the wife of that person who had accused her and admonished her; and exhorted her; and informed her that the torment of this world is less painful than the torment of the Hereafter. She said: No; by Him Who sent thee with Truth; he is a liar. it was the man who started the swearing of oath and he swore in the name of Allah four times that he was among the truthful. and at the fifth turn he said: Let there be curse of Allah upon him if he were among the liars. Then the woman was called and she swore four times in the name of Allah that he her husband was among the liars; and at the fifth time she said : Let there be curse upon her if he were among the truthful. SunanAlNasai-017-001-14969 | It was narrated that Anas Bin Malik said: The first Lian in Islam was when Hilal Bin Umayah accused Sharik Bin AlSahma of committing adultery with his wife. He came to the Prophet and told him about that. The Prophet said: Bring four witnesses; otherwise you will feel the Hadd punishment on your back. And he repeated that several times. Hilal said to him: By Allah; O Messenger of Allah! Allah; the Mighty and Sublime; knows that I am telling the truth; and Allah; the Mighty and Sublime; will certainly reveal to you that which will spare my back from the whip. While they were like that; the Verse of Lian was revealed to him: As to those who accuse their wives. He called Hilal and he bore witness four times by Allah that he was telling the truth; and the fifth time he invoked the curse of Allah upon him if he were lying. Then he called the woman and she bore witness four times by Allah that he was lying. When it came to the fourth or fifth time; the Messenger of Allah said: Stop her; for it will inevitably bring the punishment of Allah upon the liar. She hesitated until we thought that she was going to confess; then she said: I will not dishonor my people today. Then she went ahead with the oath. The Messenger of Allah said: Wait and see. If she produces a child who is white; with straight hair and Qadiya eyes; then he belongs to Hilal Bin Umayah; but if she produces a child who is dark with curly hair; of average size and with narrow calves; then he belongs to Sharik Bin AlSahma. She produced a child who was dark with curly hair; of average size and with narrow calves. SunanAbuDawoud-017-001-25095 | Ibn Abbas said Hilal Bin Umayah was one of the three persons whose repentance was accepted by Allaah. One night he returned from his land and found a man along with his wife. He witnessed with his eyes and heard with his ears. He did not threaten him till the morning. Next day he went to the Apostle of Allaah ﷺ in the morning and said Apostle of Allaah ﷺ I came to my wife in the night and found a man along with her. I saw with my own eyes and heard with my own ears. The Apostle of Allaah ﷺ disliked what he described and he took it seriously. There upon the following Quranic verse came down And those who make charges against their spouses but have no witnesses except themselves; let the testimony of one of them.... When the Apostle of Allaah ﷺ came to himself after the revelation ended he said Glad tidings to you Hilal; Allaah the exalted has made ease and a way out for you. Hilal said I expected that from my Lord. The Apostle of Allaah ﷺ said Send for her. She then came. The Apostle of Allaah ﷺ recited the verses to them and he reminded them and told them that the punishment in the next world was more severe than that in n this world. Hilal said I swear by Allah I spoke the truth against her. She said He told a lie. The Apostle of Allaah ﷺ said Apply the method of invoking curses on one another. Hilal was told Bear witness. So he bore witness before Allaah four times that he spoke the truth. When he was about to utter the fifth time he was told Hilal fear Allah; for the punishment in this world is easier than that in the next world and this is the deciding one; that will surely cause punishment to you. He said I swear by Allaah. Allah will not punish me for this act ; as He did not cause me to be flogged for this act. So he bore witness a fifth time invoking the curse of Allah on him if he was of those who tell a lie. Then the people said to her; Testify. So she gave testimony before Allaah that he was a liar. When she was going to testify the fifth time she was told Fear Allah; for the punishment in this world is easier than that in the next world. This is the deciding one that will surely cause punishment to you. She hesitated for a moment. And then said By Allah; I will not disgrace my people. So she testified a fifth time invoking the curse of Allah on her if he spoke the truth. Apostle of Allaah ﷺ separated them from each other and decided that the child will not be attributed to its father. Neither she nor her child will be accused of adultery. He who accuses her or her child will be liable to punishment. He also decided that there will be no dwelling and maintenance for her from the husband as they were separated without divorce and death. He then said If she gives birth to a child with reddish hair; light buttocks; wide belly and light shins he will be the child of Hilal. If she bears a dusky child with curly hair; fat limbs; fat shins and fat buttocks he will be the child of the one who was accused of adultery. She gave birth to a child with curly hair; fat limbs; fat shins and fat buttocks. The Apostle of Allaah ﷺ said Had there been no oaths; I would have dealt with her severely.Ikrimah said Later on he became the chief of the tribe of Mudar. MuwataMalik-017-001-35223 | Yahya related to me from Malik from Nafic from Abdullah Ibn Umar that a man cursed his wife in the time of the Messenger of Allah; may Allah bless him and grant him peace; and disowned her child. The Messenger of Allah; may Allah bless him and grant him peace; separated them and gave the child to the woman. Malik said; Allah the Blessed; the Exalted; said; The testimony of men who accuse their wives but do not have any witnesses except themselves is to testify by Allah four times that he is being truthful; and a fifth time; that the curse of Allah will be upon him; if he should be a liar. She will avoid punishment if she testifies by Allah four times that he is a liar; and a fifth time; that the wrath of Allah shall be upon her; if he should be telling the truth. Surat 24 ayat 6. Malik said; The sunna with us is that those who curse each other are never to be remarried. If the man calls himself a liar; i.e. takes back his accusation ; he is flogged with the hadd-punishment; and the child is given to him; and his wife can never return to him. There is no doubt or dispute about this sunna among us. Malik said; If a man separates from his wife by an irrevocable divorce by which he cannot return to her; and then he denies the paternity of the child she is carrying; whilst she claims that he is the father; and it is possible by the timing; that he be so; he must curse her; and the child is not recognised as his. Malik said; That is what is done among us; and it is what I have heard from the people of knowledge. Malik said that a man who accused his wife after he had divorced her trebly while she was pregnant; and he had at first accepted being the father but then claimed that he had seen her committing adultery before he separated from her; was flogged with the hadd-punishment; and did not curse her. If he denied the paternity of her child after he had divorced her trebly; and he had not previously accepted it; then he cursed her. Malik said; This is what I have heard. Malik said; The slave is in the same position as the free man as regards making accusations and invoking mutual curses lian. He acts in the lian as the free man acts although there is no hadd applied for slandering a female-slave. Malik said; The muslim slave-girl and the christian and jewish free woman also do lian when a free muslim marries one of them and has intercourse with her. That is because Allah - may He be blessed and Exalted; said in His Book; As for those who accuse their wives; and they are their wives. This is what is done among us. Malik said that a man who did the lian with his wife; and then stopped and called himself a liar after one or two oaths and he had not cursed himself in the fifth one; had to be flogged with the hadd-punishment; but they did not have to be separated. Malik said that if a man divorced his wife and then after three months the woman said; I am pregnant; and he denied paternity; then he had to do lian. Malik said that the husband of a female slave who pronounced the lian on her and then bought her; was not to have intercourse with her; even if he owned her. The sunna which had been handed down about a couple who mutually cursed each other in the lian was that they were never to return to each other.
