SahihMuslim-017-001-24192 | Muawiya Bin AlHakam said: While I was praying with the Messenger of Allah ﷺ ; a man in the company sneezed. I said: Allah have mercy on you! The people stared at me with disapproving looks; so I said: Woe be upon me; why is it that you stare at me? They began to strike their hands on their thighs; and when I saw them urging me to observe silence I became angry but I said nothing. When the Messenger of Allah ﷺ had said the prayer and I declare that neither before him nor after him have I seen a leader who gave better instruction than he for whom I would give my father and mother as ransom. I swear that he did not scold; beat or revile me but said: Talking to persons is not fitting during the prayer; for it consists of glorifying Allah; declaring his Greatness. and recitation of the Quran or words to that effect. I said: Messenger of Allah. I was till recently a pagan; but Allah has brought Islam to us; among us there are men who have recourse to Kahins. He said; Do not have recourse to them. I said. There are men who take omens. That is something which they find in their breasts; but let it not turn their way from freedom of action. I said: Among us there are men who draw lines. He said: There was a prophet who drew lines; so if they do it as they did; that is allowable. I had a maid-servant who tended goats by the side of Uhud and Jawaniya. One day I happened to pass that way and found that a wolf had carried a goat from her flock. I am after all a man from the posterity of Adam. I felt sorry as they human beings feel sorry. So I slapped her. I came to the Messenger of Allah ﷺ and felt this act of mine as something grievous I said: Messenger of Allah; should I not grant her freedom? He the Holy Prophet said: Bring her to me. So I brought her to him. He said to her: Where is Allah? She said: He is in the heaven. He said: Who am I? She said: Thou art the Messenger of Allah. He said: Grant her freedom; she is a believing woman. | The Chapter on Lost And Found And Holly Matters in HodHood Indexing, Chapter on 7 in Sahih Muslim | |
SahihMuslim-017-001-24337 | Abu Huraira reported: The poor amongst the emigrants came to the Messenger of Allah ﷺ and said: The possessors of great wealth have obtained the highest ranks and the lasting bliss. He the Holy Prophet said: How is that? They said: They pray as we pray; and they observe fast as we observe fast; and they give charity but we do not give charity; and they set slaves free but we do not set slaves free. Upon this the Messenger of Allah ﷺ said: Shall I not teach you something by which you will catch upon those who have preceded you; and get ahead of those who come after you; only those who do as you do being more excellent than you? They said: Yes; Messenger of Allah. He the Holy Prophet said: Extol Allah; declare His Greatness; and Praise Him thirty-three times after every prayer. Abu Salih said: The poor amongst the emigrants returned to the Messenger of Allah may peace upon him saying: Our brethren; the possessors; of property have heard what we have done and they did the same. So the Messenger of Allah ﷺ said: This is Allah Grace which He gives to whom He wishes. Sumay reported: I made a mention of this hadith to some members of my family and one of them said: You have forgotten; he the Holy Prophet had said like this : Extol Allah thirty-three time; praise Allah thirty-three times and declare His Greatness thirty-three times. And said If a man finds a man along with wife and declares about her adultery you will flog him. Or if he kills you; you will kill him or if keeps silence he will keep silence in anger. I swear by Allaah; I shall ask the Apostle of Allaah ﷺ about it. On the next day he came to the Apostle of Allaah ﷺ and said If a man finds a man along with wife and declares about her adultery you will flog him. Or if he kills you; you will kill him or if keeps silence he will keep silence in anger. He said O Allaah; disclose. He kept on praying until the verses regarding invoking curses lian came down As for those who accuse their wives but have no witnesses except themselves. So; the man was first involved in this trial among the people. He and his wife came to the Apostle of Allaah ﷺ. They invoked curses on each other. The man bore witness before Allaah four times that the thing he said was indeed true. He then invoked curse of Allaah on him for the fifth time if he was a liar. The Messenger of Allah ﷺ said: Woe to you: Do you know what you are saying? Then the Messenger of Allah ﷺ declared Allahs glory and he continued declaring His glory till the effect of that was apparent in the faces of his Companions. He then said: Woe to you: Allah is not to be sought as intercessor with anyone. Allahs state is greater than that. Woe to you! Do you know how great Allah is? His throne is above the heavens thus indicating with his fingers like a dome over him ; and it groans on account of Him as a saddle does because of the rider Ibn Bashshar said in his version: Allah is above the throne; and the throne is above the heavens. He then mentioned the rest of the tradition. Abd AlAla; Ibn AlMuthana and Ibn Bashshar transmitted it from Yaqub Bin Utbah and Jubair Bin Muhammad Bin Jubair from his father on the authority of his grandfather.Abu Dawud said: This tradition with the chain of Ahmad Bin Saad is sound. It has been approved by the body of traditionists ; which includes Yahya Bin Main and Ali Bin AlMadani; and a group has transmitted it from Ibn Ishaq; as Ahmad also said. The man of Banu Asad said: He was a live coal which Allah has extinguished. AlMiqdam said: Today I shall continue to make you angry and make you hear what you dislike. MuwataMalik-017-001-35187 | Yahya related to me from Malik from Yahya Ibn Said from Abu Bakr Ibn Hazm thatUmar Ibn Abd AlAziz had asked him what people said about the irrevocable divorce; and Abu Bakr had replied that Aban Ibn Uthman had clarified that it was declared only once. Umar Ibn Abd AlAziz said; Even if divorce had to be declared a thousand times; theirrevocable would use them all up. MuwataMalik-017-001-35205 | Yahya related to me from Malik that he had heard that Marwan Ibn AlHakam decided about a man who had made a vow to abstain from intercourse with his wife; that when four months had passed; it was a divorce and he could return to her as long as she was in her idda. Malik added; That was also the opinion of Ibn Shihab. Malik said that if a man made a vow to abstain from intercourse with his wife and at the end of four months he declared his intent to continue to abstain; he was divorced. He could go back to his wife; but if he did not have intercourse with her before the end of her idda; he had no access to her and he could not go back to her unless he had an excuse - illness; imprisonment; or a similar excuse. His return to her maintained her as his wife. If her idda passed and then he married her after that and did not have intercourse with her until four months had passed and he declared his intent to continue to abstain; divorce was applied to him by the first vow. If four months passed; and he had not returned to her; he had no idda against her nor access because he had married her and then divorced her before touching her. Malik said that a man who made a vow to abstain from intercourse with his wife and continued to abstain after four months and so divorced her; but then returned and did not touch her and four months were completed before her idda was completed; did not have to declare his intent and divorce did not befall him. If he had intercourse with her before the end of her idda; he was entitled to her. If her idda passed before he had intercourse with her; he had no access to her. This is what Malik preferred of what he had heard on the subject. Malik said that if a man made a vow to abstain from intercourse with his wife and then divorced her; and the four months of the vow were completed before completion of the idda of the divorce; it counted as two pronouncements of divorce. If he declared his intention to continue to abstain and the idda of the divorce finished before the four months the vow of abstention was not a divorce. That was because the four months had passed and she was not his on that day. Malik said; If someone makes a vow not to have intercourse with his wife for a day or a month and then waits until more than four months have passed; it is not ila. Ila only applies to someone who vows more than four months. As for the one who vows not to have intercourse with his wife for four months or less than that; I do not think that it is ila because when the term enters into it at which it stops; he comes out of his oath and he does not have to declare his intention. Malik said; If someone vows to his wife not to have intercourse with her until her child has been weaned; that is not ila. I have heard that Ali Ibn Abi Talib was asked about that and he did not think that it was ila. | The Chapter on Wives And Relationship Sexual Intercourse in HodHood Indexing, The Book of Marriage in Muwata Malik |
