SahihMuslim-017-001-22225Abu Bakr he is Abu Bakr Bin Abdulrahman Bin Harith reported: I heard Abu Huraira Allah be pleased with him narrating that he who is overtaken by dawn in a state of seminal emission should not observe fast. I made a mention of it to Abdulrahman Bin Harith i. e. to his father but he denied it. Abdulrahman went and I also went along with him till we came toAisha and Umm Salamah Allah be pleased with both of them and Abdulrahman asked them about it. Both of them said: At times it so happened that the Messenger of Allah ﷺ woke up in the morning in a state of junub but without seminal emission in a dream and observed fast He the narrator said: We then proceeded till we went to Marwan and Abdulrahman made a mention of it to him. Upon this Marwan said: I stress upon you with an oath that you better go to Abu Huraira and refer to him what is said about it. So we came to Abu Huraira and Abu Bakr had been with us throughout and Abdulrahman made a mention of it to him; whereupon Abu Huraira said: Did they the two wives of the Holy Prophet tell you this? He replied: Yes Upon this Abu Huraira said: They have better knowledge. Abu Huraira then attributed that what was said about it to Fadl Bin Abbas and said: I heard it from Fadl and not from the Messenger of Allah ﷺ. Abu Huraira then retracted from what he used to say about it. SahihMuslim-017-001-22690Shaqiq reported: I was sitting in the company of Abdullah and Abu Mousa when Abu Mousa said: 0 Abdulrahman kunya of Abdullah Bin Masud ; what would you like a man to do about the prayer if he experiences a seminal emission or has sexual intercourse but does not find water for a month? Abdullah said: He should not perform tayammum even if he does not find water for a month. Abdullah said: Then what about the verse in Surat Maida: If you do not find water; betake yourself to clean dust? Abdullah said: If they were granted concession on the basis of this verse; there is a possibility that they would perform tayammum with dust on finding water very cold for themselves. Abu Mousa said to Abdullah: You have not heard the words of Ammar: The Messenger of Allah ﷺ sent me on an errand and I had a seminal emission; but could find no water; and rolled myself in dust just as a beast rolls itself. I came to the Messenger of Allah ﷺ then and made a mention of that to him and he the Holy Prophet said: It would have been enough for you to do thus. Then he struck the ground with his hands once and wiped his right hand with the help of his left hand and the exterior of his palms and his face. SahihMuslim-017-001-22692Abd AlRabmin Bin Abza narrated It on the authority of his father that a man came to Umar and said: I am at times affected by seminal emission but find no water. He Umar told him not to say prayer. Ammar then said. Do you remember;0 Commander of the Faithful; when I and you were in a military detachment and we had had a seminal emission and did not find water for taking bath and you did not say prayer; but as for myself I rolled in dust and said prayer; and when it was mentioned before the Apostle ﷺ said: It was enough for you to strike the ground with your hands and then blow the dust and then wipe your face and palms. Umar said: Ammar; fear Allah. He said: If you so like; I would not narrate it. MuwataMalik-017-001-35895Yahya related to me from Malik from Yahya Ibn Said that he heard Said Ibn AlMusayab asking a group of people; What do you think about someone who has intercourse with his wife while he is in ihram? and none of them answered him. Said said; There is a man who has had intercourse with his wife while in ihram who has sent a message to Madina asking about it. Some of them said; They should be kept apart until a future year; and Said Ibn AlMusayab said; They should carry on and complete the hajj which they have spoiled; and then return home when they have finished. If another hajj comes upon them; they must do hajj and sacrifice an animal. They should go into ihram at the same place where they went into ihram for the hajj that they spoiled; and they should keep apart until they have finished their hajj. Malik said; They should both sacrifice an animal. Malik said; about a man who had intercourse with his wife during hajj after he had come down from Arafa but before he had stoned the Jamra; He must sacrifice an animal and do hajj again in another year. If; however; he had intercourse with his wife after he stoned the Jamra; he only has to do an umra and sacrifice an animal and he does not have to do another hajj. Malik said; What spoils a hajj or an umra and makes sacrificing an animal and repeating the hajj necessary is the meeting of the two circumcised parts; even if there is no emission. It is also made necessary by an emission if it is the result of bodily contact. I do not think that a man who remembers something and has an emission owes anything; and if a man were to kiss his wife and no emission were to occur from that; he would only have to sacrifice an animal. A woman in ihram who has intercourse with her husband several times during hajj or umra out of obedience to him only has to do another hajj and sacrifice an animal. That is if her husband has intercourse with her while she is doing hajj.
