My son was a laborer working for this person; and he committed illegal sexual intercourse with his wife; and the people told me that my son should be stoned to death; but I offered one-hundred sheep and a slave girl as a ransom for him. Then I asked the religious learned people; and they told me that my son should be flogged with one-hundred stripes and be exiled for one year. The Prophet ﷺ said; By Him in Whose Hand my soul is; I will judge you according to Allah Laws. The sheep and the slave girl will be returned to you and your son will be flogged one-hundred stripes and be exiled for one year. And you; O Unais! Go to the wife of this man and if she confesses ; stone her to death. So Unais went in the morning and stoned her to death after she had confessed. No doubt; the people are talking much about AlWalid. Uthman said; Did you receive your knowledge directly from Allah Messenger ﷺ ? I said; No; but his knowledge did reach me and it reached even to a virgin in her seclusion. Uthman said; And then Allah sent Muhammad with the Truth and I was amongst those who followed Allah and His Apostle and I believed in what ever he i.e. the Prophet was sent with; and participated in two migrations; as you have said; and I enjoyed the company of Allah Messenger ﷺ and gave the pledge of allegiance him. By Allah! I never disobeyed him; nor did I cheat him till Allah took him unto Him. Then I treated Abu Bakr and then Umar similarly and then I was made Caliph. So; dont I have rights similar to theirs? I said; Yes. He said; Then what are these talks reaching me from you people? Now; concerning what you mentioned about the question of AlWalid; Allah willing; I shall deal with him according to what is right. Then he called Ali and ordered him to flog him; and Ali flogged him i.e. AlWalid eighty lashes. The people were speaking against the latter for what he had done. Ubaidullah said; So I kept waiting for Uthman; and when he went out for the prayer; I said to him; I have got something to say to you as a piece of advice. Uthman said; O man! I seek Refuge with Allah from you. So I went away. When I finished my prayer; I sat with AlMiswar and Ibn Abu Yaghutb and talked to both of them of what I had said to Uthman and what he had said to me. They said; You have done your duty. So while I was sitting with them. Uthman Messenger came to me. They said; Allah has put you to trial. I set out and when I reached Uthman; he said; What is your advice which you mentioned a while ago? I recited Tashahhud and added; Allah has sent Muhammad and has revealed the Holy Book i.e. Quran to him. You O Uthman! were amongst those who responded to the call of Allah and His Apostle and had faith in him. And you took part in the first two migrations to Ethiopia and to Medina ; and you enjoyed the company of Allah Messenger ﷺ and learned his traditions and advice. Now the people are talking much about AlWalid Bin Uqba and so it is your duty to impose on him the legal punishment. Uthman then said to me; O my nephew! Did you ever meet Allah Messenger ﷺ ? I said; No; but his knowledge has reached me as it has reached the virgin in her seclusion. Uthman then recited Tashahhud and said; No doubt; Allah has sent Muhammad with the Truth and has revealed to him His Holy Book i.e. Quran and I was amongst those who responded to the call of Allah and His Apostle and I had faith in Muhammad Mission; and I had performed the first two migrations as you have said; and I enjoyed the company of Allah Messenger ﷺ and gave the pledge of allegiance to him. By Allah; I never disobeyed him and never cheated him till Allah caused him to die. Then Allah made Abu Bakr Caliph; and by Allah; I was never disobedient to him; nor did I cheat him. Then Umar became Caliph; and by Allah; I was never disobedient to him; nor did I cheat him. Then I became Caliph. Have I not then the same rights over you as they had over me? I replied in the affirmative. Uthman further said; The what are these talks which are reaching me from you? As for what you ha mentioned about AlWalid Bin Uqb; Allah willing; I shall give him the leg; punishment justly. Then Uthman ordered that AlWalid be flogged fort lashes. If she commits adultery again; she should again be punished by flogging; but hurl no reproach upon her. If she commits fornication for the third time and it becomes clear; then he should sell her; even if only for a rope of hair. SunanAlNasai-017-001-12275		It was narrated from Amr Bin Shuaib; from his father; that his grandfather Abdullah Bin Amr; that a man from Muzainah came to the Messenger of Allah and said: O Messenger of Allah; what do you think about a sheep stolen from the pasture? He said: The thief must pay double and be punished. There is no cutting off of the hand for stealing livestock; except what which has been put in the pen; if its value is equal to that of a shield; in which case the thiefs hand is to be cut off. If its value is not equal to that of a shield; then he should pay a penalty of twice its value and be flogged as a punishment. He said: O Messenger of Allah! What do you think about fruit on the tree? He said: The thief must pay double and be punished. There is no cutting off of the hand for stealing fruit on the tree; except for that which has been stored properly if its value is equal to that of a shield; in which case the thiefs hand is not equal to that of a shield; then he should pay a penalty of twice its value and be flogged as a punishment. He said: I will pass the same judgment concerning her as the Messenger of Allah did. If she let you do that; I will flog you; but if she did not let you do that; I will stone you to death. The Prophet ﷺ said: She will get the dower; for you made her vagina lawful for you. The child will be your slave. When she has begotten a child ; flog her according to the version of AlHasan. The version of Ibn AbusSari has: You people; flog her; or said: inflict hard punishment on him.Abu Dawud said: This tradition has been transmitted by Qatadah from Saad Bin Yazid on the authority of Ibn AlMusayab in a similar way. This tradition has been narrated by Yahya Bin Abi Kathir from Yazid Bin Nuaim from Saeed Bin AlMusayab; and Ata AlKhurasani narrated it from Saeed Bin AlMusayab ; they all narrated this tradition from the Prophet ﷺ omitting the link of the Companion i.e. a mursal tradition. The version of Yahya Bin Abi Kathir has: Basrah Bin Aktham married a woman. The agreed version has: He made the child his servant. SunanAbuDawoud-017-001-25092		Abdullah bin Masud said We were in the Masjid on the night of a Friday; suddenly a man from the Ansar entered the Masjid. And said If a man finds a man along with wife and declares about her adultery you will flog him. Or if he kills you; you will kill him or if keeps silence he will keep silence in anger. I swear by Allaah; I shall ask the Apostle of Allaah ﷺ about it. On the next day he came to the Apostle of Allaah ﷺ and said If a man finds a man along with wife and declares about her adultery you will flog him. Or if he kills you; you will kill him or if keeps silence he will keep silence in anger. He said O Allaah; disclose. He kept on praying until the verses regarding invoking curses lian came down As for those who accuse their wives but have no witnesses except themselves. So; the man was first involved in this trial among the people. He and his wife came to the Apostle of Allaah ﷺ. They invoked curses on each other. The man bore witness before Allaah four times that the thing he said was indeed true. He then invoked curse of Allaah on him for the fifth time if he was a liar. She then wanted to invoke curses of Allaah on him. The Prophet ﷺ said Do not do that. Bust she refused and did so i.e.; invoked curses. When they returned he said Perhaps she will give birth to a black child with curly hair. SunanAbuDawoud-017-001-25114		Rabah said: My people married me to a Roman slave-girl of theirs. I had intercourse with her; and she gave birth to a black male child like me. I named it Abdullah. I again had intercourse with her; and she gave birth to a black male child like me. I named it Ubaydullah. Then a Roman slave of my people; called Yuhannah; incited her; and spoke to her in his own unintelligible language. She gave birth to a son like a chameleon red. I asked her: What is this? She replied: This belongs to Yuhannah. We then brought the case to Uthman for a decision. I think Mahdi said these words. He inquired from both of them; and they acknowledged the facts. He then said to them: Do you agree that I take the decision about you; which the Messenger of Allah ﷺ had taken? The Messenger of Allah ﷺ decided that the child was to attributed to the one on whose bed it was born. And I think he said: He flogged her and flogged him; for they were slaves. Allah then mentioned man after woman and combined them in another verse : If two men among you are guilty of lewdness; punish them both. If they repent and amend; leave them alone. SunanAbuDawoud-017-001-26634		Narrated Jabir Ibn Abdullah: A man committed fornication with a woman. So the Messenger of Allah ﷺ ordered regarding him and the prescribed punishment of flogging was inflicted on him. He was then informed that he was married. So he commanded regarding him and he was stoned to death.Abu Dawud said: This tradition has been transmitted by Muhammad Bin Bakr AlBarsani from Ibn Juraij as a statement of Jabir; and Abu Aasi m has transmitted it from Ibn Juraid similar to that of Ibn Wahb. He did not mention the Prophet ﷺ. But he said: A man committed fornication; but did not know that he was married ; so he was flogged. It was then known that he was married; so he was stoned to death. The matter was brought to AlNuman Ibn Bashir who was the Governor of Kufah. He said: I shall decide between you in accordance with the decision of the Messenger of Allah ﷺ. If she made her lawful for you; I shall flog you one hundred lashes. If she did not make her lawful for you; I shall stone you to death. So they found that she had made her lawful for him. He; therefore; flogged him one hundred lashes.Qatadah said: I wrote to Habib Bin Salim; so he wrote this tradition to me. Abu Dawud said: And there is a similar tradition of Umar Ibn Abu Salamah; from his father; on the authority of Abu Huraira; from the Prophet ﷺ : If he drinks wine; flog him if he does it so again; a fourth time; kill him.Abu Dawud said: And there is similar tradition of Suhail from Abu Salih on the authority of Abu Huraira; from the Prophet ﷺ : It they drink a fourth time; kill them. And there is similar tradition of Ibn Abi Num on the authority of Ibn Umar from Prophet ﷺ. There is also similar tradition of Abdullah Bin Amr from the Prophet ﷺ ; and from Sharid from the Prophet ﷺ. And in the tradition of AlJadli from Muawiyah; the Prophet ﷺ said: If he does so again third or fourth time; kill him. SunanAbuDawoud-017-001-26681		Narrated Qabisah Ibn Dhuwayb: The Prophet ﷺ said: If anyone drinks wine; flog him; if he repeats it; flog him; and if he repeats it; flog him. If he does it again a third or a fourth time; kill him. A man who had drunk wine was brought to him and he gave him lashes. He was again brought to him; and he flogged him. He was again brought to him and he flogged him. He was again brought to him and he flogged him. The punishment of killing for drinking was repealed; and a concession was allowed.Sufyan said: AlZuhri transmitted this tradition when Mansur Bin AlMutamir amd Mukhawal Bin Rashid were present with him. He said to them: Take this tradition as a present to the people of Iraq.Abu Dawud said: This tradition has been transmitted by AlSharid Bin Suwaid; Sharahbil Bin Aws; Abdullah Bin Amr; Abdullah Bin Umar; Abu Ghutaif AlKindi; and Abu Salamah Bin Abdulrahman from Abu Huraira. He said; I have found the smell of wine on so-and-so; and he claimed that it was the drink of boiled fruit juice; and I am inquiring about what he has drunk. If it intoxicates; I will flog him. MuwataMalik-017-001-34780		Malik related to me from Ibn Shihab from Ubaydullah Ibn Abdullah Ibn Utba Ibn Masud from Abu Huraira and Zayd Ibn Khalid AlJuhani that the Messenger of Allah; may Allah bless him and grant him peace; was asked about a slave-girl who committed fornication and was not muhsana. He said; If she commits fornication; then flog her. If she commits fornication again; then flog her; and if she commits fornication again; then sell her; if only for a rope. Abuz-Zinad said; I asked Abdullah Ibn Amir Ibn Rabia about that. He said; I saw Umar Ibn AlKhattab; Uthman Ibn Affan; the Khalifs; and so on; and I did not see any of them flog a slave more than forty lashes for slander. MuwataMalik-017-001-34785		Malik related to me from Zurayq Ibn Hakim AlAyli that a man called Misbah asked his son for help and he thought him unnecessarily slow. When the son came; his father said to him; O fornicator. Zurayq said; So the son asked me to help him against the father. When I wanted to flog him; his son said; By Allah; if you flog him; I will acknowledge that I have committed fornication. When he said that; the situation was confused for me; so I wrote about it to Umar Ibn Abd AlAziz who was the governor at that time; and I mentioned it to him. Umar wrote me to permit his pardon. Zurayq said; I wrote to Umar Ibn Abd AlAziz also; What do you think about a man who is slandered or his parents are slandered and both or only one of them are dead? He said; Umar wrote to me; If he forgives; his pardon is permitted for himself. If his parents are slandered and one or both of them are dead; take the judgement of the Book of Allah for it unless he wants to veil it. Yahya said; I heard Malik say; That is because the slandered man might fear that if that is unveiled about him; a clear proof might be established. MuwataMalik-017-001-34786		Malik related to me from Hisham Ibn Urwa that his father said that there was only one hadd against a man who slandered a group of people. Malik said; If they are on separate occasions there is still only one hadd against him. Malik related to me from Ab AlRijal Muhammad Ibn Abdulrahman Ibn Haritha Ibn AlNuman AlAnsari; then from the Banun-Najar from his mother Amra bint Abdulrahman that two men cursed each other in the time of Umar Ibn AlKhattab. One of them said to the other; By Allah; my father is not an adulterer and my mother is not an adulteress. Umar Ibn AlKhattab asked advice about that. One person said; He has praised his father and mother. Another said; His father and mother have praise other than this. We think that he is to be flogged with the hadd. So Umar flogged him with the hadd of eighty lashes. Malik said; There is no hadd in our view except for slander; denial or insinuation; in which one sees that the speaker intends by that denial or slander. Then the hadd is completely imposed on the one who said it. Malik said; What is done in our community when a man denies that another man is from his father; is that he deserves the hadd. MuwataMalik-017-001-34903		Yahya said from Malik that he heard from Sulayman Ibn Yasar and others that when they were asked whether the testimony of a man flogged for a hadd crime was permitted; they said; Yes; when repentance tawba appears from him. Malik related to me that he heard Ibn Shihab being asked about that and he said the like of what Sulayman Ibn Yasar said. Malik said; That is what is done in our community. It is by the word of Allah; the Blessed; the Exalted; And those who accuse women who are muhsan; and then do not bring four witnesses; flog them with eighty lashes; and do not accept any testimony of theirs ever. They indeed are evil-doers; save those who turn in tawba after that and make amends. Allah is Forgiving; Merciful. Surat 24 ayat 4.
