SahihMuslim-017-001-18611 | It is narrated on the authority of Ibn Abbas that some persons amongst the polytheist had committed a large number of murders and had excessively indulged in fornication. Then they came to Muhammad ﷺ and said: Whatever you assert and whatever you call to is indeed good. But if you inform us that there is atonement of our past deeds then we would embrace Islam. Then it was revealed: And those who call not unto another god along with Allah and slay not any soul which Allah has forbidden except in the cause of justice; nor commit fornication; and he who does this shall meet the requital of sin. Multiplied for him shall be the torment on the Day of Resurrection; and he shall therein abide disgraced; except him who repents a believes and does good deeds. SahihMuslim-017-001-19680 | Abu Huraira reported Allah Apostle ﷺ as saying: None spoke in the cradle but only three persons ; Christ son of Mary; the second one the companion of Juraij. Juraij had got constructed a temple and confined himself in that. His mother came to him as he was busy in prayer and she said: Juraij. He said: My Lord; my mother is calling me while I am engaged in my prayer. He continued with the prayer. She returned and she came on the next day and he was busy in prayer; and she said: Juraij. And he said: My Lord; my mother is calling me while I am engaged in prayer; and he continued with the prayer and she went back; and then on the next day she again came and he was busy in prayer and she said: Juraij. And he said: My Lord; my mother is calling me while I am engaged in my prayer; and he continued with the prayer; and she said: My Lord; dont give him death unless he has seen the fate of the prostitutes. The story of Juraij and that of his meditation and prayer gained currency amongst Bani Israil. There was a prostitute who had been a beauty incarnate. She said to the people : If you like I can allure him to evil. She presented herself to him but he paid no heed to her. She came to a shepherd who lived near the temple and she offered herself to him and he had a sexual intercourse with her and so she became pregnant arid when she gave birth to a child she said: This is from Juraij. So they came and asked him to get down and demolished the temple and began to beat him. He said: What is the matter? They said: You have committed fornication with this prostitute and she has given birth to a child from your loins. He said: Where is the child? They brought him the child and he said: just leave me so that I should observe prayer. And he observed prayer and when he finished; he came to the child. He struck his stomach and said: O boy; who is your father? lie said: He is such shepherd. So they turned towards Juraij; kissed him and touched him for seeking blessing and said: We are prepared to construct your temple with gold. He said. No; just rebuild it with mud as it had been; and they did that. Then there was a babe who was sucking his mother that a person dressed in fine garment came riding upon a beast. His mother said: O Allah; make my child like this one. He the babe left sucking and began to see towards him; and said: O Allah; dont make me like him. He then returned to the chest and began to suck the milk of his mother. He Abu Huraira said: I perceived as if I am seeing Allah Messenger ﷺ as he is explaining the scene of his sucking milk with his forefinger in his mouth and sucking that. He Abu Huraira further reported Allah Apostle may be peace upon him as saying: There happened to pass by him a girl who was being beaten and they were saying: You have committed adultery and you have committed theft and she was saying: Allah is enough for me and He is my good Protector; and his mother said: O Allah; dont make my child like her and he left sucking the milk; and looked towards her and said: O Allah; make me like her; and there was a talk between them. She said: O with shaven head; a good-looking person happened to pass by and I said: O Allah; make my child like him; and you said: O Allah; dont make me like him; and they passed by a girl while they were beating her and saying: You committed fornication and you committed theft; and I said: O Allah; dont make my child like her; and you said: O Allah; make me like her. SahihMuslim-017-001-21940 | Abu Dharr reported: I walked with the Messenger of Allah ﷺ on the stony ground of Medina in the afternoon and we were looking at Uhud. The Messenger of Allah way peace by upon him said: Abu Dharr! I said: Messenger of Allah; I am here at thy beck and call. He said: What I desire is that Uhud be gold with me and three nights should pass and there is left with me any dinar but one coin which I would keep to pay debt. I love to spend it among the servants of Allah like this and he pointed in front of him; and on his right side and on his left side. We then proceeded on and he said: Abu Dharr. I said: At thy beck and call; Messenger of Allah. He the Holy Prophet said: The rich would be poor on the Day of Resurrection; but he who spent like this and like this and like this; and he pointed as at the first time. We again went on when he said. Abu Dharr; stay where you are till I come back to you. He the Holy Prophet then moved on till he disappeared from my sight He Abu Dharr said: I heard a sound and I heard a noise. I said to myself : The Messenger of Allah ﷺ might have met mishap or an enemy. I wished to follow him but I remembered his command for not departing till he would come back. So I waited for him; and when he came I made a mention of what I heard. He said: it was Gabriel; who came to me and said: He who dies among your Ummah without associating Anything with Allah would enter Paradise. I said: Even if he committed fornication or theft? SahihMuslim-017-001-21941 | Abu Dharr reported: I went out one night and found the Messenger of Allah ﷺ walking all alone. There was no man with him. I thought that he did not like anyone walking along with him. So I began to walk in the light of the moon. He; however turned his attention to me and saw me and said: Who is this? I said: It is Abu Dharr. Let Allah make me as ransom for you. He said: Abu Dharr; come on. He Abu Dharr said: So I walked along with him for some time and he said: The wealthy persons would have little reward on the Day of Resurrection; except upon whom Allah conferred goodness wealth. He dispensed it to his right; left; in front of him and at his back just as the wind diffuses fragrance and did good with it riches. I went along with him for some time when He said: Sit here. And he made me sit at a safe place and there were stones around it; and he said to me: Sit here till I come to you. He went away on the stony ground till I could not see him. He stayed away from me; and he prolonged his stay. Then I heard him as he came back and he was saying: Even if he committed theft and even if he committed fornication. When he came I could not help asking him: Apostle of Allah; let Allah make me ransom for you; whom were you speaking on the stony ground? I heard nobody responding to you. He the Holy Prophet said: It was Gabriel who met me by the side of the stony ground and said: Give glad tidings to your Ummah that he who died without associating ought with Allah would go into Paradise. I said: Gabriel; even if he committed theft and fornication? He said: Yes. I said: Even it he committed theft and fornication? He said: Yes; I again said: Even if he committed theft and fornication? Sad said My brother Utbah enjoined me that when I came to Makkah I should see the son of the slave girl of Zamah and take his possession for that is his son. Abd Bin Zamah said He is my brother; the son of my fathers slave girl having been born on my fathers bed. The Apostle of Allaah ﷺ saw his clear resemblance to Utbah. SunanAbuDawoud-017-001-25719 | Narrated Abu Umamah Ibn Sahl: We were with Uthman when he was besieged in the house. There was an entrance to the house. He who entered it heard the speech of those who were in the Bilat. Uthman then entered it. He came out to us; looking pale. He said: They are threatening to kill me now. We said: Allah will be sufficient for you against them; Commander of the Faithful! He asked: Why kill me? I heard the Messenger of Allah ﷺ say: It is not lawful to kill a man who is a Muslim except for one of the three reasons: Kufr disbelief after accepting Islam; fornication after marriage; or wrongfully killing someone; for which he may be killed. I swear by Allah; I have not committed fornication before or after the coming of Islam; nor did I ever want another religion for me instead of my religion since Allah gave guidance to me; nor have I killed anyone. SunanAbuDawoud-017-001-26615 | Narrated Nuaym Ibn Huzzal: Yazid Ibn Nuaym Ibn Huzzal; on his father authority said: Maiz Ibn Malik was an orphan under the protection of my father. He had illegal sexual intercourse with a slave-girl belonging to a clan. My father said to him: Go to the Messenger of Allah ﷺ and inform him of what you have done; for he may perhaps ask Allah for your forgiveness. His purpose in that was simply a hope that it might be a way of escape for him. So he went to him and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. He the Prophet turned away from him; so he came back and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. He again turned away from him; so he came back and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. When he uttered it four times; the Messenger of Allah ﷺ said: You have said it four times. With whom did you commit it? He replied: With so and so. He asked: Did you lie down with her? He replied: Yes. He asked: Had your skin been in contact with hers? He replied. Yes. He asked: Did you have intercourse with her? He said: Yes. So he the Prophet gave orders that he should be stoned to death. He was then taken out to the Harrah; and while he was being stoned he felt the effect of the stones and could not bear it and fled. But Abdullah Ibn Unays encountered him when those who had been stoning him could not catch up with him. He threw the bone of a camel foreleg at him; which hit him and killed him. They then went to the Prophet ﷺ and reported it to him. He said: Why did you not leave him alone. SunanAbuDawoud-017-001-26636 | Narrated Imran Ibn Husayn: A woman belonging to the tribe of Juhaynah according to the version of Aban came to the Prophet ﷺ and said that she had committed fornication and that she was pregnant. The Messenger of Allah ﷺ called her guardian. Then the Messenger of Allah ﷺ said to him: Be good to her; and when she bears a child; bring her to me. When she gave birth to the child; he brought her to him. The Prophet ﷺ gave orders regarding her; and her clothes were tied to her. He then commanded regarding her and she was stoned to death. He commanded the people to pray and they prayed over her. Thereupon Umar said: Are you praying over her; Messenger of Allah; when she has committed fornication? He said: By Him in Whose hand my soul is; she has repented to such an extent that if it were divided among the seventy people of Medina; it would have been enough for them all. The Prophet ﷺ adjured him and asked: What is the punishment for a fornication in your Divine Book? He replied: Stoning. But fornication spread among our people of rank; so we disliked that a person of rank should be left alone and the punishment be inflicted on one who is lower in rank than him. SunanAbuDawoud-017-001-26644 | Narrated AlBara Ibn Azib: The people passed by the Messenger of Allah ﷺ with a Jew who was blackened with charcoal and who was being flogged. He called them and said: Is this the prescribed punishment for a fornicator? They said: Yes. He then called on a learned man among them and asked him: I adjure you by Allah Who revealed the Torah to Moses; do you find this prescribed punishment for a fornicator in your divine Book? He said: By Allah; no. If you had not adjured me about this; I should not have informed you. We find stoning to be prescribed punishment for a fornicator in our Divine Book. But it fornication became frequent in our people of rank; so when we seized a person of rank; we left him alone; and when we seized a weak person; we inflicted the prescribed punishment on him. So we said: Come; let us agree on something which may be enforced equally on people of higher and lower rank. So we agreed to blacken the face of a criminal with charcoal; and flog him; and we abandoned stoning. The Messenger of Allah ﷺ then said: O Allah; I am the first to give life to Thy command which they have killed. So he commanded regarding him the Jew and he was stoned to death. SunanAbuDawoud-017-001-26646 | Narrated Abu Huraira: This is Mamar version which is more accurate. A man and a woman of the Jews committed fornication. Some of them said to the others: Let us go to this Prophet; for he has been sent with an easy law. If he gives a judgment lighter than stoning; we shall accept it; and argue about it with Allah; saying: It is a judgment of one of your prophets. So they came to the Prophet ﷺ who was sitting in the Masjid among his companions. They said: AbulQasim; what do you think about a man and a woman who committed fornication? He did not speak to them a word till he went to their school. He stood at the gate and said: I adjure you by Allah Who revealed the Torah to Moses; what punishment do you find in the Torah for a person who commits fornication; if he is married? They said: He shall be blackened with charcoal; taken round a donkey among the people; and flogged. A young man among them kept silent. When the Prophet ﷺ emphatically adjured him; he said: By Allah; since you have adjured us we inform you that we find stoning in the Torah is the punishment for fornication. The Prophet ﷺ said: So when did you lessen the severity of Allah command? He said: A relative of one of our kings had committed fornication; but his stoning was suspended. Then a man of a family of common people committed fornication. He was to have been stoned; but his people intervened and said: Our man shall not be stoned until you bring your man and stone him. So they made a compromise on this punishment between them. The Prophet ﷺ said: So I decide in accordance with what the Torah says. He then commanded regarding them and they were stoned to death. AlZuhri said: We have been informed that this verse was revealed about them: It was We Who revealed the Law to Moses : therein was guidance and light. SunanAbuDawoud-017-001-26647 | Abu Huraira said: A man and a woman of the Jews who were married committed fornication at the time when the Messenger of Allah ﷺ came to Medina. Stoning was a prescribed punishment for them in accordance with the Torah; but they abandoned it and followed tajbiyah; meaning; the man was beaten a hundred times with a rope painted with tar and was seated on a donkey with his face towards the tail of the donkey. Their rabbis then assembled and sent some people to the Messenger of Allah ﷺ. They said to them: Ask him about the prescribed punishment for fornication. The transmitter then mentioned the rest of the tradition. They version adds: They were not the followers of his religion; and he the prophet was to pronounce judgment between them. MuwataMalik-017-001-34779 | Malik related to me from Nafi that Safiya bint Abi Ubayd informed him that a man who had had intercourse with a virgin slave- girl and made her pregnant was brought to Abu Bakr AlSiddiq. He confessed to fornication; and he was not muhsan. Abu Bakr gave the order and he was flogged with the hadd punishment. Then he was banished to Fadak; thirty miles from Madina. Malik spoke about a person who confessed to fornication and then retracted it and said; I didnt do it. I said that for such-and-such a reason; and he mentioned the reason. Malik said; That is accepted from him and the hadd is not imposed on him. That is because the hadd is what is for Allah; and it is only applied by one of two means; either by a clear proof which establishes guilt or by a confession which is persisted in so that the hadd is imposed. If someone persists in his confession; the hadd is imposed on him. He said; If she commits fornication; then flog her. If she commits fornication again; then flog her; and if she commits fornication again; then sell her; if only for a rope. MuwataMalik-017-001-34785 | Malik related to me from Zurayq Ibn Hakim AlAyli that a man called Misbah asked his son for help and he thought him unnecessarily slow. When the son came; his father said to him; O fornicator. Zurayq said; So the son asked me to help him against the father. When I wanted to flog him; his son said; By Allah; if you flog him; I will acknowledge that I have committed fornication. When he said that; the situation was confused for me; so I wrote about it to Umar Ibn Abd AlAziz who was the governor at that time; and I mentioned it to him. Umar wrote me to permit his pardon. Zurayq said; I wrote to Umar Ibn Abd AlAziz also; What do you think about a man who is slandered or his parents are slandered and both or only one of them are dead? He said; Umar wrote to me; If he forgives; his pardon is permitted for himself. If his parents are slandered and one or both of them are dead; take the judgement of the Book of Allah for it unless he wants to veil it. Yahya said; I heard Malik say; That is because the slandered man might fear that if that is unveiled about him; a clear proof might be established. MuwataMalik-017-001-35335 | Yahya related to me from Malik from Yahya Ibn Said that Said Ibn AlMusayab said; The slave girl is not married when there is a free woman who is a wife unless the free woman wishes it. If the free woman complies; she has two-thirds of the division of time. Malik said; A free man must not marry a slave-girl when he can afford to marry a free-woman; and he should not marry a slave-girl when he cannot afford a free woman unless he fears fornication. That is because Allah; may he be Blessed and Exalted; says in His Book; If you are not affluent enough to marry believing women; who are muhsanat; take slave-girls who are believing women that your right hands own. Surat 4 ayat 24 He says; That is for those of you who fear Alanat.
