SahihAlBukhari-017-001-1437Narrated Sahl Bin Saad AlSaidi: Uwaimir AlAjlani came to Aasi m Bin Adi and said; If a man found another man with his wife and killed him; would you sentence the husband to death in Qisas; i.e.; equality in punishment ? O Aasi m! Please ask Allah Messenger ﷺ about this matter on my behalf. Aasi m asked the Prophet ﷺ but the Prophet disliked the question and disapproved of it. Aasi m returned and informed Uwaimir that the Prophet disliked that type of question. Uwaimir said; By Allah; I will go personally to the Prophet. Uwaimir came to the Prophet ﷺ when Allah had already revealed Quranic Verses in that respect ; after Aasi m had left the Prophet ﷺ. So the Prophet ﷺ said to Uwaimir; Allah has revealed Quranic Verses regarding you and your wife. The Prophet ﷺ then called for them; and they came and carried out the order of Lian. Then Uwaimir said; O Allah Messenger ﷺ ! Now if I kept her with me; I would be accused of telling a lie. So Uwaimir divorced her although the Prophet ﷺ did not order him to do so. Later on this practice of divorcing became the tradition of couples involved in a case of Lian. The Prophet ﷺ said to the people. Wait for her! If she delivers a red short small child like a Wahra a short red animal. then I will be of the opinion that he Uwaimir has told a lie but if she delivered a black big-eyed one with big buttocks; then I will be of the opinion that he has told the truth about her. Ultimately she gave birth to a child that proved the accusation. SahihAlBukhari-017-001-1614Narrated Ibn Abbas: Lian was mentioned in the presence of the Prophet; Aasi m Bin Adi said a statement about it; and when he left; a man from his tribe came to him complaining that he had seen a man with his wife. Aasi m said; I have been put to trial only because of my statement. So he took the man to the Prophet ﷺ and the man told him about the incident. The man husband was of yellow complexion; thin; and of lank hair; while the man whom he had accused of having been with his wife; was reddish brown with fat thick legs and fat body. The Prophet ﷺ said; O Allah! Reveal the truth. Later on the lady delivered a child resembling the man whom the husband had accused of having been with her. So the Prophet ﷺ made them take the oath of Lian. A man said to Ibn Abbas in the gathering; Was that the same lady about whom the Prophet ﷺ said; If I were to stone any lady for committing illegal sexual intercourse to death without witnesses; I would have stoned that lade to death? So Uwaimir proceeded till he came to Allah Messenger ﷺ who was in the midst of the people and said; O Allah Messenger ﷺ ! If a man finds with his wife another man; should he kill him; whereupon you would kill him in Qisas : or otherwise; what should he do? Allah Messenger ﷺ said; Allah has revealed something concerning the question of you and your wife. Go and bring her here. So they both carried out the judgment of Lian; while I was present among the people as a witness. When both of them had finished; Uwaimir said; O Allah Messenger ﷺ ! If I should now keep my wife with me; then I have told a lie. Then he pronounced his decision to divorce her thrice before Allah Apostle ordered him to do so. SahihAlBukhari-017-001-4027Narrated Abdullah Bin Abu Mulaika: Some silken cloaks with golden buttons were presented to the Prophet. He distributed them amongst his companions and kept one for Makhrama; Bin Nawfal. Later on Makhrama came along with his son AlMiswar Bin Makhrama; and stood up at the gate and said to his son. Call him i.e. the Prophet to me. The Prophet ﷺ heard his voice; took a silken cloak and brought it to him; placing those golden buttons in front of him saying; O Abu AlMiswar! SahihAlBukhari-017-001-4708Narrated Abu Huraira: Allah Messenger ﷺ sent a Sariya of ten men as spies under the leadership of Aasi m Bin Thabit AlAnsari; the grandfather of Aasi m Bin Umar AlKhattab. They proceeded till they reached Hadaa; a place between Usfan; and Mecca; and their news reached a branch of the tribe of Hudhail called Bani Lihyan. About two-hundred men; who were all archers; hurried to follow their tracks till they found the place where they had eaten dates they had brought with them from Medina. They said; These are the dates of Yathrib i.e. Medina ; and continued following their tracks When Aasi m and his companions saw their pursuers; they went up a high place and the infidels circled them. The infidels said to them; Come down and surrender; and we promise and guarantee you that we will not kill any one of you Aasi m Bin Thabit; the leader of the Sariya said; By Allah! I will not come down to be under the protection of infidels. O Allah! Convey our news to Your Prophet. Then the infidels threw arrows at them till they martyred Aasi m along with six other men; and three men came down accepting their promise and convention; and they were Khubaib AlAnsari and Ibn Dathina and another man So; when the infidels captured them; they undid the strings of their bows and tied them. Then the third of the captives said; This is the first betrayal. By Allah! I will not go with you. No doubt these; namely the martyred; have set a good example to us. So; they dragged him and tried to compel him to accompany them; but as he refused; they killed him. They took Khubaid and Ibn Dathina with them and sold them as slaves in Mecca and all that took place after the battle of Badr. Khubaib was bought by the sons of AlHarith Bin Amir Bin Nawfal Bin Abd Manaf. It was Khubaib who had killed AlHarith Bin Amir on the day of the battle of Badr. So; Khubaib remained a prisoner with those people. Narrated AlZuhri: Ubaidullah Bin Eyad said that the daughter of AlHarith had told him; When those people gathered to kill Khubaib he borrowed a razor from me to shave his pubes and I gave it to him. Then he took a son of mine while I was unaware when he came upon him. I saw him placing my son on his thigh and the razor was in his hand. I got scared so much that Khubaib noticed the agitation on my face and said; Are you afraid that I will kill him? No; I will never do so. By Allah; I never saw a prisoner better than Khubaib. By Allah; one day I saw him eating of a bunch of grapes in his hand while he was chained in irons; and there was no fruit at that time in Mecca. The daughter of AlHarith used to say; It was a boon Allah bestowed upon Khubaib. When they took him out of the Sanctuary of Mecca to kill him outside its boundaries; Khubaib requested them to let him offer two rakat prayer. They allowed him and he offered Two rakat and then said; Hadnt I been afraid that you would think that I was afraid of being killed ; I would have prolonged the prayer. O Allah; kill them all with no exception. He then recited the poetic verse :- I being martyred as a Muslim; Do not mind how I am killed in Allah Cause; For my killing is for Allah Sake; And if Allah wishes; He will bless the amputated parts of a torn body Then the son of AlHarith killed him. So; it was Khubaib who set the tradition for any Muslim sentenced to death in captivity; to offer a two-rakat prayer before being killed. Allah fulfilled the invocation of Aasi m Bin Thabit on that very day on which he was martyred. The Prophet ﷺ informed his companions of their news and what had happened to them. Later on when some infidels from Quraish were informed that Aasi m had been killed; they sent some people to fetch a part of his body i.e. his head by which he would be recognized. That was because Aasi m had killed one of their chiefs on the day of the battle of Badr. SahihAlBukhari-017-001-6344Narrated Abu Huraira: Allah Messenger ﷺ sent out ten spies under the command of Aasi m Bin Thabit AlAnsari; the grand-father of Aasi m Bin Umar AlKhattab. When they reached a place called AlHadah between Usfan and Mecca; their presence was made known to a sub-tribe of Hudhail called Banu Lihyan. So they sent about one hundred archers after them. The archers traced the footsteps of the Muslims till they found the traces of dates which they had eaten at one of their camping places. The archers said; These dates are of Yathrib i.e. Medina ; and went on tracing the Muslims footsteps. When Aasi m and his companions became aware of them; they took refuge in a high place. But the enemy encircled them and said; Come down and surrender. We give you a solemn promise and covenant that we will not kill anyone of you. Aasi m Bin Thabit said; O people! As for myself; I will never get down to be under the protection of an infidel. O Allah! Inform your Prophet about us. So the archers threw their arrows at them and martyred Aasi m. Three of them came down and surrendered to them; accepting their promise and covenant and they were Khubaib; Zaid Bin AlDathina and another man. When the archers got hold of them; they untied the strings of the arrow bows and tied their captives with them. The third man said; This is the first proof of treachery! By Allah; I will not go with you for I follow the example of these. He meant the martyred companions. The archers dragged him and struggled with him till they martyred him. Then Khubaib and Zaid Bin AlDathina were taken away by them and later on they sold them as slaves in Mecca after the event of the Badr battle. The sons of AlHarit Bin Amr Bin Nawfal bought Khubaib for he was a person who had killed their father AlHari Bin Amr on the day of the battle of Badr. Khubaib remained imprisoned by them till they decided unanimously to kill him. One day Khubaib borrowed from a daughter of AlHarith; a razor for shaving his pubic hair; and she lent it to him. By chance; while she was inattentive; a little son of hers went to him i.e. Khubaib and she saw that Khubaib had seated him on his thigh while the razor was in his hand. She was so much terrified that Khubaib noticed her fear and said; Are you afraid that I will kill him? Never would I do such a thing. Later on while narrating the story she said; By Allah; I had never seen a better captive than Khubaib. By Allah; one day I saw him eating from a bunch of grapes in his hand while he was fettered with iron chains and at that time there was no fruit in Mecca. She used to say; It was food Allah had provided Khubaib with. When they took him to AlHil out of Mecca sanctuary to martyr him; Khubaib requested them. Allow me to offer a two-rakat prayer. They allowed him and he prayed two rakat and then said; By Allah! Had I not been afraid that you would think I was worried; I would have prayed more. Then he invoked evil upon them saying; O Allah! Count them and kill them one by one; and do not leave anyone of them Then he recited: As I am martyred as a Muslim; I do not care in what way I receive my death for Allah Sake; for this is for the Cause of Allah. If He wishes; He will bless the cut limbs of my body. Then Abu Sarva; Ubqa Bin AlHarith went up to him and killed him. It was Khubaib who set the tradition of praying for any Muslim to be martyred in captivity before he is executed. The Prophet ﷺ told his companions of what had happened to those ten spies on the same day they were martyred. Some Quraish people; being informed of Aasi m Bin Thabit death; sent some messengers to bring a part of his body so that his death might be known for certain; for he had previously killed one of their leaders in the battle of Badr. SahihAlBukhari-017-001-6434Narrated Abu Huraira: The Prophet ﷺ sent a Sariya of spies and appointed Aasi m Bin Thabit; the grandfather of Aasi m Bin Umar Bin AlKhattab; as their leader. So they set out; and when they reached a place between Usfan and Mecca; they were mentioned to one of the branch tribes of Bani Hudhail called Lihyan. So; about one-hundred archers followed their traces till they i.e. the archers came to a journey station where they i.e. Aasi m and his companions had encamped and found stones of dates they had brought as journey food from Medina. The archers said; These are the dates of Medina; and followed their traces till they took them over. When Aasi m and his companions were not able to go ahead; they went up a high place; and their pursuers encircled them and said; You have a covenant and a promise that if you come down to us; we will not kill anyone of you. Aasi m said; As for me; I will never come down on the security of an infidel. O Allah! Inform Your Prophet about us. So they fought with them till they killed Aasi m along with seven of his companions with arrows; and there remained Khubaib; Zaid and another man to whom they gave a promise and a covenant. So when the infidels gave them the covenant and promise; they came down. When they captured them; they opened the strings of their arrow bows and tied them with it. The third man who was with them said; This is the first breach in the covenant; and refused to accompany them. They dragged him and tried to make him accompany them; but he refused; and they killed him. Then they proceeded on taking Khubaib and Zaid till they sold them in Mecca. The sons of AlHarith Bin Amr Bin Nawfal bought Khubaib. It was Khubaib who had killed AlHarith Bin Amr on the day of Badr. Khubaib stayed with them for a while as a captive till they decided unanimously to kill him. At that time Khubaib borrowed a razor from one of the daughters of AlHarith to shave his pubic hair. She gave it to him. She said later on; I was heedless of a little baby of mine; who moved towards Khubaib; and when it reached him; he put it on his thigh. When I saw it; I got scared so much that Khubaib noticed my distress while he was carrying the razor in his hand. He said Are you afraid that I will kill it? Allah willing; I will never do that; Later on she used to say; I have never seen a captive better than Khubaib Once I saw him eating from a bunch of grapes although at that time no fruits were available at Mecca; and he was fettered with iron chains; and in fact; it was nothing but food bestowed upon him by Allah. So they took him out of the Sanctuary of Mecca to kill him. He said; Allow me to offer a two-rakat prayer. Then he went to them and said; Had I not been afraid that you would think I was afraid of death; I would have prayed for a longer time. So it was Khubaib who first set the tradition of praying two rakat before being executed. He then said; O Allah! Count them one by one; and added; When I am being martyred as a Muslim; I do not care in what way I receive my death for Allah Sake; because this death is in Allah Cause. If He wishes; He will bless the cut limbs. Then Uqba Bin AlHarith got up and martyred him. The narrator added: The Quraish infidels sent some people to Aasi m in order to bring a part of his body so that his death might be known for certain; for Aasi m had killed one of their chiefs on the day of Badr. SahihAlBukhari-017-001-6660Narrated Abu Uthman: I heard from Sad; the first man who has thrown an arrow in Allah Cause; and from Abu Bakra who jumped over the wall of the Taif Fort along with a few persons and came to the Prophet. They both said; We heard the Prophet ﷺ saying; If somebody claims to be the son of somebody other than his father knowingly; he will be denied Paradise i.e. he will not enter Paradise. Narrated Mamar from Aasi m from Abu AlAliya or Abu Uthman AlNahdi who said. I heard Saad and Abu Bakra narrating from the Prophet. Aasi m said; I said to him ; Very trustworthy persons have narrated to you. Aasi m then went to the Prophet ﷺ and said; O Allah Messenger ﷺ ! And asked him that question but Allah Messenger ﷺ disliked the question; When Uwaimir asked Aasi m about the Prophet answer Aasi m replied that Allah Messenger ﷺ disliked such questions and considered it shameful. Uwaimir then said; By Allah; I will not give up asking unless I ask Allah Messenger ﷺ about it. Uwaimir came to the Prophet and said; O Allah Messenger ﷺ ! A man has found another man with his wife! Should he kill him whereupon you would kill him the husband; in Qisas or what should he do? Allah Messenger ﷺ said; Allah has revealed regarding you and your wife case in the Quran So Allah Messenger ﷺ ordered them to perform the measures of Mulaana according to what Allah had mentioned in His Book. So Uwaimir did Mulaana with her and said; O Allah Messenger ﷺ ! If I kept her I would oppress her. So Uwaimir divorced her and so divorce became a tradition after them for those who happened to be involved in a case of Mulaana. Allah Messenger ﷺ then said; Look! If she Uwaimir wife delivers a black child with deep black large eyes; big hips and fat legs; then I will be of the opinion that Uwaimir has spoken the truth; but if she delivers a red child looking like a Wahra then we will consider that Uwaimir has told a lie against her. So Aasi m asked Allah Messenger ﷺ and he did not like this question and he disapproved of it so much thatAsim felt aggrieved at what he had heard from Allah Messenger ﷺ. When Aasi m came back to his family; Uwaimir came to him and said: Aasi m; what did Allah Messenger ﷺ say to you? Aasi m said to Uwaimir: You did not bring something good. Allah Messenger ﷺ did not like this religious verdict that I sought from him. Uwaimir said: By Allah; I will not rest until I have asked him about it. Uwaimir proceeded until he came to Allah Messenger ﷺ as he was sitting amidst people; and said: Messenger of Allah; tell me about a person who found a man with his wife. Should he kill him; and then you would kill him; or how should he act? Thereupon Allah Messenger ﷺ said: Verses have been revealed concerning you and your wife; so go and bring her. Sahl said that they both invoked curses and further said : I was along with people in the company of Allah Messenger ﷺ. And when they had finished; Uwaimir said: Allah Messenger; I shall have told a lie against her if I keep her now. So he divorced her with three pronouncements before Allah Messenger ﷺ had commanded him. He said: By Allah; I have not become a hypocrite; and I will go to the Prophet ﷺ and tell him about that ; So he went to the Prophet and said: 0 Messenger of Allah ﷺ ; Muadh prays with you; then he comes to lead us in prayer. You delayed the prayer; and he prayed with you then he came back to lead us in prayer; and he started to recite Shut AlBaqarah. When Aasi m went back to his people; Uwaimir came to him and said: O Aasi m; what did the Messenger of Allah say to you? Aasi m said: You have not brought me any good. The Messenger of Allah disapproved of the question you asked. Uwaimir said: By Allah; I will go and ask the Messenger of Allah. So he went to the Messenger of Allah and found him in the midst of the people. He said: O Messenger of Allah; what do you think if a man finds another man with his wife -should he kill him; and be killed in retaliation or what should he do? The Messenger of Allah said: Something has been revealed concerning you and your wife; so go and bring her here. Sahl said: So they engaged in the procedure of Lian; and I was among the people in the presence of the Messenger of Allah. When Uwaimir finished he said: I would have been telling lies about her; O Messenger of Allah; if I keep her. He took him to the Messenger of Allah and told him of the situation in which he found his wife. That man was pale and slim with straight hair; and the one whom he claimed to have found with his wife was dark and well-built. The Messenger of Allah said: O Allah; make it clear to me. Then she gave birth to a child who resembled the one whom her husband said he had found with her. So the Messenger of Allah conducted the procedure of Lian between them. A man in the gathering said to Ibn Abbas: Was she the one of whom the Messenger of Allah said: If I were to have stoned anyone without evidence I would have stoned this one? When Aasi m returned to his family Uwaimr came to him and asked Aasi m What did the Apostle of Allaah ﷺ say to you? Aasi m replied You did not do good to me. The Apostle of Allaah ﷺ disliked the question that I asked him. Thereupon Uwaimir said I swear by Allaah; I shall not leave until I ask him about it. So; Uwaimir came to the Apostle of Allaah ﷺ while he was sitting in the midst of the people. He said Apostle of Allaah ﷺ tell me about a man who finds a man along with his wife. When they overpowered them; they untied their bow strings and tied them with them. The third person said This is the first treachery. I swear by Allaah; I shall not accompany you. In them my companions is an example for me. They pulled him; but he refused to accompany them; so they killed him. Khubaib remained their captive until they agreed to kill him. He asked for a razor to shave his pubes. When they brought him outside to kill him. Khubaib said to them Let me offer two rakahs of prayer. He then said I swear by Allaah; if you did not think that I did this out of fear. He took him by the arm and placed him before him on his mount. The grandmother of the child saw him and argued with Umar about the child so they went to Abu Bakr AlSiddiq. Umar said; My son. The woman said; My son. Abu Bakr said; Do not interfere between a child and its mother. Umar did not repeat his words. I will not stop until I ask him about it! Uwaymir stood up and went to the Messenger of Allah; may Allah bless him and grant him peace; in the middle of the people and said; Messenger of Allah! What do you think a man who finds another man with his wife should do? Should he kill him and then be killed himself; or what should he do? The Messenger of Allah; may Allah bless him and grant him peace; said; Something has been sent down about you and your wife; so go and bring her. Sahl continued; They mutually cursed one another in the presence of the Messenger; may Allah bless him and grant him peace; and I was present with the people. When they finished cursing each other; Uwaymir said; I shall have lied about her; Messenger of Allah; if I keep her; and pronounced the divorce three times before the Messenger of Allah; may Allah bless him and grant him peace; ordered him to do it.
