Some people said; If one; by a trick; marries on the basis of Shighar; the marriage is valid but its condition is illegal. The same scholar said regarding AlMuta; The marriage is invalid and its condition is illegal. She kept standing for a long period during which period the Prophet ﷺ looked at her carefully. When she stayed for a Long period; a man said to the Prophet ﷺ If you are not in need of her; then marry her to me. The Prophet ﷺ said; Have you got anything to give her as Mahr ? The man said; No. The Prophet said; Go to your house and search for something. The man went and came back to say; By Allah; I could not find anything. The Prophet ﷺ said; Go again and search for something; even if it be an iron ring. He went again and came back saying; No; by Allah; I could not get even an iron ring. The man had only an Izar and had no Rida upper garment. He said; I will give her my Izar as Mahr. On that the Prophet ﷺ said; Your Izar? If she wears it; nothing of it will remain on you; and if you wear it nothing of it will be on her The man went Aasi de and sat down When the Prophet ﷺ saw him leaving after a while ; he called back and asked. How much Quran do you know by heart ? He said; I know such and such Suras; naming some Suras. SahihAlBukhari-017-001-3456Narrated Urwa: that he asked Aisha about the Statement of Allah: If you fear that you shall not be able to deal justly with the orphan girls; then marry other women of your choice; two or three or four; but if you fear that you shall not be able to deal justly with them ; then only one; or the captives that your right hands possess. This Verse refers to the orphan girl who is under the guardianship of her guardian who likes her beauty and wealth and wishes to marry her and curtails her Mahr. Such guardians have been forbidden to marry them unless they do justice by giving them their full Mahr; and they have been ordered to marry other than them. The people asked for the verdict of Allah Messenger ﷺ after that; so Allah revealed: They ask your instruction concerning the women... whom you desire to marry. 4.127 So Allah revealed to them that if the orphan girl had beauty and wealth; they desired to marry her and for her family status. They can only marry them if they give them their full Mahr. And if they had no desire to marry them because of their lack of wealth and beauty; they would leave them and marry other women. So; as they used to leave them; when they had no interest; in them; they were forbidden to marry them when they had such interest; unless they treated them justly and gave them their full Mahr Apostle said; If at all there is evil omen; it is in the horse; the woman and the house. a lady is to be warded off. In what connection was this Verse revealed : If you fear that you shall not be able to deal justly with orphan girls to the end of the verse that your right hands possess? 4.3 Aisha said; O my nephew! It was about the female orphan under the protection of her guardian who was interested in her beauty and wealth and wanted to marry her with a little or reduced Mahr. So such guardians were forbidden to marry female orphans unless they deal with them justly and give their full Mahr; and they were ordered to marry women other than them.Aisha added; Later the people asked Allah Messenger ﷺ ; for instructions; and then Allah revealed: They ask your instruction concerning the women... SahihAlBukhari-017-001-4080Narrated AlZuhri: Urwa Bin AlZubair said that he asked Aisha about the meaning of the Quranic Verse:- And if you fear that you will not deal fairly with the orphan girls then marry other women of your choice. 4.2-3 Aisha said; It is about a female orphan under the guardianship of her guardian who is inclined towards her because of her beauty and wealth; and likes to marry her with a Mahr less than what is given to women of her standard. So they i.e. guardians were forbidden to marry the orphans unless they paid them a full appropriate Mahr otherwise they were ordered to marry other women instead of them. Later on the people asked Allah Messenger ﷺ about it. So Allah revealed the following Verse:- They ask your instruction O Muhammad! regarding women. Say: Allah instructs you regarding them... 4.127 and in this Verse Allah indicated that if the orphan girl was beautiful and wealthy; her guardian would have the desire to marry her without giving her an appropriate Mahr equal to what her peers could get; but if she was undesirable for lack of beauty or wealth; then he would not marry her; but seek to marry some other woman instead of her. SahihAlBukhari-017-001-4118Narrated AlZuhri: Urwa said; Aisha told me that Allah Messenger ﷺ used to examine the women emigrants. We have been told also that when Allah revealed the order that the Muslims should return to the pagans what they had spent on their wives who emigrated after embracing Islam and that the Muslims should not keep unbelieving women as their wives; Umar divorced two of his wives; Qariba; the daughter of Abu Umayah and the daughter of Jarwal AlKhuzai. Later on Muawiya married Qariba and Abu Jahm married the other. When the pagans refused to pay what the Muslims had spent on their wives; Allah revealed: And if any of your wives have gone from you to the unbelievers and you have an accession by the coming over of a woman from the other side then pay to those whose wives have gone the equivalent of what they had spent on their Mahr. 60.11 So; Allah ordered that the Muslim whose wife has gone; should be given; as a compensation of the Mahr he had given to his wife; from the Mahr of the wives of the pagans who had emigrated deserting their husbands. We do not know any of the women emigrants who deserted Islam after embracing it. We have also been told that Abu Basir Bin Aasi d AlThaqafi came to the Prophet ﷺ as a Muslim emigrant during the truce. SahihAlBukhari-017-001-4947Narrated Urwa Bin AlZubair: That he had asked Aisha about the meaning of the Statement of Allah: If you fear that you shall not Be able to deal justly With the orphan girls; then Marry Other women of your choice Two or three or four. 4.3 She said; O my nephew! This is about the orphan girl who lives with her guardian and shares his property. Her wealth and beauty may tempt him to marry her without giving her an adequate Mahr bridal-money which might have been given by another suitor. So; such guardians were forbidden to marry such orphan girls unless they treated them justly and gave them the most suitable Mahr; otherwise they were ordered to marry any other woman. Aisha further said; After that verse the people again asked the Prophet about the marriage with orphan girls ; so Allah revealed the following verses:- They ask your instruction Concerning the women. Say: Allah Instructs you about them And about what is Recited unto you In the Book; concerning The orphan girls to whom You give not the prescribed portions and yet whom you Desire to marry... 4.127 What is meant by Allah Saying:- And about what is Recited unto you is the former verse which goes:- If you fear that you shall not Be able to deal justly With the orphan girls; then Marry other women of your choice. 4.3 Aisha said; Allah saying in the other verse:-Yet whom you desire to marry 4.127 means the desire of the guardian to marry an orphan girl under his supervision when she has not much property or beauty in which case he should treat her justly. Aisha added; The people asked Allah Messenger ﷺ his instructions after the revelation of this Divine Verse whereupon Allah revealed: They ask your instruction regarding women 4.127 Aisha further said; And the Statement of Allah: And yet whom you desire to marry. 4.127 as anyone of you refrains from marrying an orphan girl under his guardianship when she is lacking in property and beauty. SahihAlBukhari-017-001-862Narrated Abd AlAziz: Anas said; When Allah Messenger ﷺ invaded Khaibar; we offered the Fajr prayer there early in the morning when it was still dark. The Prophet ﷺ rode and Abu Talha rode too and I was riding behind Abu Talha. The Prophet ﷺ passed through the lane of Khaibar quickly and my knee was touching the thigh of the Prophet ﷺ. He uncovered his thigh and I saw the whiteness of the thigh of the Prophet. When he entered the town; he said; Allahu Akbar! Khaibar is ruined. Whenever we approach near a hostile nation to fight then evil will be the morning of those who have been warned. He repeated this thrice. The people came out for their jobs and some of them said; Muhammad has come. Some of our companions added; With his army. We conquered Khaibar; took the captives; and the booty was collected. Dihya came and said; O Allah Prophet! Give me a slave girl from the captives. The Prophet said; Go and take any slave girl. He took Safiya bint Huyai. A man came to the Prophet ﷺ and said; O Allah Messenger ﷺ s! You gave Safiya bint Huyai to Dihya and she is the chief mistress of the tribes of Quraidha and AlNadir and she befits none but you. So the Prophet ﷺ said; Bring him along with her. So Dihya came with her and when the Prophet ﷺ saw her; he said to Dihya; Take any slave girl other than her from the captives. Anas added: The Prophet ﷺ then manumitted her and married her. Thabit asked Anas; O Abu Hamza! What did the Prophet ﷺ pay her as Mahr ? He said; Her self was her Mahr for he manumitted her and then married her. Anas added; While on the way; Um Sulaim dressed her for marriage ceremony and at night she sent her as a bride to the Prophet ﷺ. So the Prophet was a bridegroom and he said; Whoever has anything food should bring it. He spread out a leather sheet for the food and some brought dates and others cooking butter. I think he Anas mentioned AlSawaq. So they prepared a dish of Hais a kind of meal. SahihMuslim-017-001-22117Abd AlMuttalib Bin Rabia Bin AlHarith reported that Rabia Bin AlHarith and Abbas Bin Abd AlMuttalib gathered together and said: By Allah; if we had sent these two young boys i. e. I and Fadl Bin Abbas to the Messenger of Allah ﷺ and they had spoken to him; he would have appointed them as the collectors of these sadaqat; and they would collect them and pay to the Holy Prophet as other people collectors paid and would get a share as other people got it. As they were talking about it there came Ali Bin Abu Talib and stood before them; and they made a mention of it to him. Ali Bin Abu Talib said: Dont do that; by Allah he the Holy Prophet would not do that would not accept your request. Rabia Bin Harith turned to him and said: By Allah; you are not doing so but out of jealousy that you nurse against us By Allah; you became the son-in-law of the Messenger of Allah ﷺ but we felt no jealousy against you for this great privilege of yours. Ali then said: Send them if you like. They set out and Ali lay on the bed. When the Messenger of Allah ﷺ offered the noon prayer. we went ahead of him to his apartment and stood near it till he came out. He took hold of our ears out of love and affection and then said: Give out what you have kept in your hearts. He then entered the apartment and we also went in and he the Holy Prophet was on that day in the house of Zainab Bin jahsh. We urged each of us to speak. Then one of us thus spoke: Messenger of Allah; you are the best of humanity and the best to cement the ties of blood-relations. We have reached the-marriageable age. We have come to you so that you may appoint us as collectors of these sadaqat. and we would pay you just as thin people other collectors pay you; and get our share as others get it. He the Holy Prophet kept silence for a long time till we wished that we should speak with him again ; and Zainab pointied to us from behind the curtain not to talk any more. He the Holy Prophet said; It does not become the family of Muhammad to accept sadaqat for they are the impurities of people. You call to me Mahmiya and he was in charge of khums; i. e; of the one-fifth part that goes to the treasury out of the spoils of war ; and Nawfal Bin Harith Bin Abd AlMuttalib. They both came to him; and he the Holy Prophet said to Mahmiya: Marry your daughter to this young man i. e. Fadl Bin Abbas ; and he married her to him And he said to Nawfal Bin Harith: Marry your daughter to this young man i e. Ibn Masud said: She should have a Mahr like that of women like her; no less and no more; she has to observe the Iddah; and she is entitled to inherit.
