SahihAlBukhari-017-001-1683 | Narrated Malik Bin Aus: I went and entered upon Umar; his doorman; Yarfa came saying Uthman; Abdulrahman AlZubair and Saad are asking your permission to see you. May I admit them? Umar said; Yes. So he admitted them Then he came again and said; May I admit Ali and Abbas? He said; Yes. Abbas said; O; chief of the believers! Judge between me and this man Ali. Umar said; I beseech you by Allah by Whose permission both the heaven and the earth exist; do you know that Allah Messenger ﷺ said; Our the Apostles property will not be inherited; and whatever we leave after our death is to be spent in charity? And by that Allah Messenger ﷺ meant himself. The group said; No doubt ; he said so. Umar then faced Ali and Abbas and said; Do you both know that Allah Messenger ﷺ said that? They replied; No doubt ; he said so. Umar said; So let me talk to you about this matter. Allah favored His Apostle with something of this Fai i.e. booty won by the Muslims at war without fighting which He did not give to anybody else; Allah said:- And what Allah gave to His Apostle Fai Booty.........to do all things.... 59.6 And so that property was only for Allah Messenger ﷺ. Yet; by Allah; he neither gathered that property for himself nor withheld it from you; but he gave its income to you; and distributed it among you till there remained the present property out of which the Prophet ﷺ used to spend the yearly maintenance for his family; and whatever used to remain; he used to spend it where Allah property is spent i.e. in charity etc.. Allah Messenger ﷺ followed that throughout his life. Now I beseech you by Allah; do you know all that? They said; Yes. Umar then said to Ali and Abbas; I beseech you by Allah; do you know that? Both of them said; Yes. Umar added; And when the Prophet ﷺ died; Abu Bakr said; I am the successor of Allah Messenger ﷺ ; and took charge of that property and managed it in the same way as Allah Messenger ﷺ did. Then I took charge of this property for two years during which I managed it as Allah Messenger ﷺ and Abu Bakr did. Then you both Ali and Abbas came to talk to me; bearing the same claim and presenting the same case. O Abbas! You came to me asking for your share from the property of your nephew; and this man Ali came to me; asking for the share of h is wife from the property of her father. I said; If you both wish; I will give that to you on that condition i.e. that you would follow the way of the Prophet ﷺ and Abu Bakr and as I Umar have done in man aging it. Now both of you seek of me a verdict other than that? Lo! By Allah; by Whose permission both the heaven and the earth exist; I will not give any verdict other than that till the Hour is established. SahihAlBukhari-017-001-1691 | Narrated Huzail Bin Shirahbil: Abu Mousa was asked regarding the inheritance of a daughter; a son daughter; and a sister. He said; The daughter will take one-half and the sister will take one-half. If you go to Ibn Masud; he will tell you the same. Ibn Masud was asked and was told of Abu Mousa verdict. Ibn Masud then said; If I give the same verdict; I would stray and would not be of the rightly-guided. The verdict I will give in this case; will be the same as the Prophet ﷺ did; i.e. one-half is for daughter; and one-sixth for the son daughter; i.e. both shares make two-thirds of the total property; and the rest is for the sister. When Aasi m came back to his family; Uwaimir came to him and said: Aasi m; what did Allah Messenger ﷺ say to you? Aasi m said to Uwaimir: You did not bring something good. Allah Messenger ﷺ did not like this religious verdict that I sought from him. Uwaimir said: By Allah; I will not rest until I have asked him about it. Uwaimir proceeded until he came to Allah Messenger ﷺ as he was sitting amidst people; and said: Messenger of Allah; tell me about a person who found a man with his wife. Should he kill him; and then you would kill him; or how should he act? Thereupon Allah Messenger ﷺ said: Verses have been revealed concerning you and your wife; so go and bring her. Sahl said that they both invoked curses and further said : I was along with people in the company of Allah Messenger ﷺ. And when they had finished; Uwaimir said: Allah Messenger; I shall have told a lie against her if I keep her now. So he divorced her with three pronouncements before Allah Messenger ﷺ had commanded him. SahihMuslim-017-001-21546 | Ubaidullah Bin Abdullah Bin Utba Bin Masud reported that his father wrote to Umar Bin Abdullah b AlArqam AlZuhri that he would go to Subaiah bint AlHirith AlAslamiya Allah be pleased with her and ask her about a verdict from him which Allah Messenger ﷺ gave her when she had asked that from him in regard to the termination of Idda at the birth of a child Umar Bin Abdullah wrote to Abdullah Bin Utba informing him that Subaiah had told him that she had been married to Saad Bin Khaula and he belonged to the tribe of Amir Bin Luay; and was one of those who participated in the Battle of Badr; and he died in the Farewell Pilgrimage and she had been in the family way at that time. And much time had not elapsed that she gave birth to a child after his death and when she was free from the effects of childbirth she embellished herself for those who had to give proposals of marriage. Abd AlSunabil Bin Bakak from Banu Abd AlDar came to her and said: What is this that I see you embellished; perhaps you are inclined to marry; By Allah; you cannot marry unless four months and ten days of Idda are passed. When he said that. I dressed myself; and as it was evening I came to Allah Messenger ﷺ and asked him about it; and he gave me a religious verdict that I was allowed to marry when I had given birth to a child and asked me to marry if I so liked. SahihMuslim-017-001-21595 | Urwa Bin Zabair reported that Abdullah Bin AlZubair Allah be pleased with him stood up and delivered an address in Mecca saying: Allah has made blind the hearts of some people as He has deprived them of eyesight that they give religious verdict in favour of temporary marriage; while he was alluding to a person Ibn Abbas. Ibn Abbas called him and said: You are an uncouth person; devoid of sense. By my life; Muta was practised during the lifetime of the leader of the pious he meant Allah Messenger; ﷺ ; and Ibn AlZubair said to him: just do it yourselves; and by Allah; if you do that I will stone you with your stones. Ibn Shihab said. Khalid Bin Muhajir Bin Saifullah informed me: While I was sitting in the company of a person; a person came to him and he asked for a religious verdict about Muta and he permitted him to do it. Ibn Abu Amrah AlAnsari Allah be pleased with him said to him: Be gentle. It was permitted in- the early days of Islam; for one who was driven to it under the stress of necessity just as the eating of carrion and the blood and flesh of swine and then Allah intensified the commands of His religion and prohibited it altogether. Ibn Shihab reported: Rabi Bin Sabra told me that his father Sabra said: I contracted temporary marriage with a woman of Banu Amir for two cloaks during the lifetime of Allah Messenger ﷺ ; then he forbade us to do Muta. SahihMuslim-017-001-22874 | Abu Mousa Allah be pleased with him said: I came to the Messenger of Allah ﷺ as he was encamping at Batha. He said to me: Did you intend to perform Hajj? I said: Yes. He again said: With what intention have you entered into the state of Ihram for Ifrad; Qiran or Tamattu. I said: I pronounced Talbiya I have entered into the state of Ihram with that very aim with which the Messenger of Allah ﷺ is pronouncing Talbiya. He the Holy Prophet said; You have done well. Then circumambulate the House and run between AlSafa and AlMarwa and put off Ihram as you have not brought the sacrificial animals along with you. So I circumambulated the House; and ran between AlSafa and AlMarwa and then came to a woman of the tribe of Qais and she rid my head of the lice. I again put on Ihram for Hajj. and continued giving religious verdict according to this practice till during the Caliphate of Umar Allah be pleased with him when a person said to him: Abu Mousa; or Abdullah Bin Qais; exercise restraint in delivering some religious verdict of yours; for you do not know what has been introduced after you by the Commander of the Believers in the rites of Hajj. Thereupon he said: 0 people; whom we gave the religious verdict concerning putting off Ihram they should wait; for the Commander of the Believers is about to come to you; and you should follow him. Umar Allah be pleased with him then came and I made a mention of it to him. whereupon he said: If we abide by the Book of Allah we find the Book of Allah has commanded us to complete the. And it was during the Hajj season that a person came to me and said: You perhaps do not know what the Commander of the Believers has introduced in the rites of Hajj. I said: 0 people; those whom we have given religious verdict about a certain thing should wait; for the Commander of the Believers is about to arrive among you; so follow him. When the Commander of the Believers arrived; I said: What is this that you have introduced in the rites of Hajj ? -where upon he said: If we abide by the Book of Allah we find that there Allah; Exalted and Majestic; has said: Complete Hajj and Umra for Allah.
