SahihAlBukhari-017-001-024 | Narrated Kuraib: I was sent to Aisha by Ibn Abbas; AlMiswar Bin Makhrama and Abdulrahman Bin Azhar. They told me to greet her on their behalf and to ask her about the offering of the two rakat after the Asr prayer and to say to her; We were informed that you offer those two rakat and we were told that the Prophet had forbidden offering them. Ibn Abbas said; I along with Umar Bin AlKhattab used to beat the people whenever they offered them. I went to Aisha and told her that message. Aisha said; Go and ask Umm Salamah about them. So I returned and informed them about her statement. They then told me to go to Umm Salamah with the same question with which t sent me to Aisha. Umm Salamah replied; I heard the Prophet ﷺ forbidding them. Later I saw him offering them immediately after he prayed the Asr prayer. He then entered my house at a time when some of the Ansari women from the tribe of Bani Haram were sitting with me; so I sent my slave girl to him having said to her; Stand beside him and tell him that Umm Salamah says to you; O Allah Messenger ﷺ ! I have heard you forbidding the offering of these two rakat after the Asr prayer but I have seen you offering them. If he waves his hand then wait for him. The slave girl did that. The Prophet ﷺ beckoned her with his hand and she waited for him. When he had finished the prayer he said; O daughter of Bani Umaiya! You have asked me about the two rakat after the Asr prayer. The people of the tribe of Abd AlQais came to me and made me busy and I could not offer the two rakat after the Zuhr prayer. SahihAlBukhari-017-001-1186 | Narrated Zahdam: There were good relations and brotherhood between this tribe of Jurm and the Ashariyin. Once; while we were sitting with Abu Mousa AlAshari; there was brought to him a meal which contained chicken meat; and there was sitting beside him; a man from the tribe of Bani Taim Allah who looked like one of the Mawali. Abu Mousa invited the man to eat but the man said; I have seen chicken eating some dirty things; and I have taken an oath not to eat chicken. Abu Mousa said to him; Come along; let me tell you something in this regard. Once I went to the Prophet ﷺ with a few men from Ashariyin and we asked him for mounts. The Prophet ﷺ said; By Allah; I will not mount you on anything; besides I do not have anything to mount you on. Then a few camels from the war booty were brought to the Prophet; and he asked about us; saying; Where are the group of Ashariyin? So he ordered for five fat camels to be given to us and then we set out. We said; What have we done? Allah Messenger ﷺ took an oath that he would not give us anything to ride and that he had nothing for us to ride; yet he provided us with mounts. We made Allah Messenger ﷺ forget his oath! By Allah; we will never be successful. So we returned to him and reminded him of his oath. He said; I have not provided you with the mount; but Allah has done so. The Prophet ﷺ said; Welcome; O the delegate; and welcome! O people! Neither you will have any disgrace nor will you regret. They said; O Allah Apostle! Between you and us there are the infidels of the tribe of Mudar; so please order us to do something good religious deeds that by acting on them we may enter Paradise; and that we may inform our people whom we have left behind; about it. They also asked the Prophet about drinks. He forbade them from four things and ordered them to do four things. He ordered them to believe in Allah; and asked them; Do you know what is meant by belief in Allah? They said; Allah and His Apostle know best. SahihAlBukhari-017-001-2409 | Narrated Abu Saeed AlKhudri: Some of the companions of the Prophet ﷺ came across a tribe amongst the tribes of the Arabs; and that tribe did not entertain them. While they were in that state; the chief of that tribe was bitten by a snake or stung by a scorpion. They said; to the companions of the Prophet ﷺ ; Have you got any medicine with you or anybody who can treat with Ruqya? The Prophet companions said; You refuse to entertain us; so we will not treat your chief unless you pay us for it. So they agreed to pay them a flock of sheep. SahihAlBukhari-017-001-2422 | Narrated Abu Said: A group of the companions of Allah Messenger ﷺ proceeded on a journey till they dismounted near one of the Arab tribes and requested them to entertain them as their guests; but they the tribe people refused to entertain them. Then the chief of that tribe was bitten by a snake or stung by a scorpion and he was given all sorts of treatment; but all in vain. Some of them said; Will you go to the group those travelers who have dismounted near you and see if one of them has something useful? They came to them and said; O the group! Our leader has been bitten by a snake or stung by a scorpion and we have treated him with everything but nothing benefited him Has anyone of you anything useful? One of them replied; Yes; by Allah; I know how to treat with a Ruqya. But. by Allah; we wanted you to receive us as your guests but you refused. I will not treat your patient with a Ruqya till you fix for us something as wages. Consequently they agreed to give those travellers a flock of sheep. The man went with them the people of the tribe and started spitting on the bite and reciting Surat AlFatiha till the patient was healed and started walking as if he had not been sick. When the tribe people paid them their wages they had agreed upon; some of them the Prophet companions said; Distribute the sheep. But the one who treated with the Ruqya said; Do not do that till we go to Allah Apostle and mention to him what has happened; and see what he will order us. So they came to Allah Messenger ﷺ and mentioned the story to him and he said; How do you know that Surat AlFatiha is a Ruqya? You have done the right thing. SahihMuslim-017-001-18406 | Abu Jamra reported: I was an interpreter between Ibn Abbas and the people; that a woman happened to come there and asked about nabidh or the pitcher of wine. He replied: A delegation of the people of Abd AlQais came to the Messenger of Allah ﷺ. He the Holy Prophet asked the delegation or the people of the delegation about their identity. They replied that they belonged to the tribe of Rabia. He the Holy Prophet welcomed the people or the delegation which were neither humiliated nor put to shame. They the members of the delegation said: Messenger of Allah; we come to you from a far-off distance and there lives between you and us a tribe of the unbelievers of Mudar and; therefore; it is not possible for us to come to you except in the sacred months. Thus direct us to a clear command; about which we should inform people beside us and by which we may enter heaven. He the Holy Prophet replied: I command you to do four deeds and forbid you to do four acts ; and added: I direct you to affirm belief in Allah alone; and then asked them: Do you know what belief in Allah really implies? They said: Allah and His Messenger know best. The Prophet said: It implies testimony to the fact that there is no god but Allah; and that Muhammad is the messenger of Allah; establishment of prayer; payment of Zakat; fast of Ramadan; that you pay one-fifth of the booty fallen to your lot and I forbid you to use gourd; wine jar; or a receptacle for wine. SahihMuslim-017-001-18408 | It is reported on the authority of Qatada that one among the delegates of the Abd AlQais tribe narrated this tradition to him. Saeed said that Qatada had mentioned the name of Abu Nadra on the authority of Abu Saeed Khudri who narrated this tradition: That people from the- tribe of Abd AlQais came to the Messenger of Allah ﷺ and said: Messenger of Allah; we belong to the tribe of Rabia and there live between you and us the unbelievers of the Mudar tribe and we find it impossible to come to you except in the sacred months; direct us to a deed which we must communicate to those who have been left behind us and by doing which we may enter heaven. Upon this the Messenger of Allah ﷺ said: I enjoin upon you four things and forbid you to do four things : worship Allah and associate none with Him; establish prayer; pay Zakat; and observe the fast of Ramadan; and pay the fifth part out of the booty. And I prohibit you from four things : dry gourds; green-coloured jars; hollowed stumps of palm-trees; and receptacles. They the members of the delegation said: Do you know what Alnaqir is? He replied: Yes; it is a stump which you hollow out and in which you throw small dates. Saeed said: He the Holy Prophet used the word tamar dates. The Prophet then added : Then you sprinkle water over it and when its ebullition subsides; you drink it and you are so intoxicated that one amongst you; or one amongst them the other members of your tribe; who were not present there strikes his cousin with the sword. He the narrator said: There was a man amongst us who had sustained injury on this very account due to intoxication ; and he told that he tried to conceal it out of shame from the Messenger of Allah ﷺ. I; however; inquired from the Messenger of Allah it we discard those utensils which you have forbidden us to use ; then what type of vessels should be used for drink? He the Holy Prophet replied: In the waterskin the mouths of which are tied with a string. They again said: Prophet of Allah; our land abounds in rats and water-skins cannot remain preserved. At that moment the Ansari spared him; but I attacked him with my spear and killed him. SahihMuslim-017-001-18600 | It is narrated on the authority of Jabir that Tufail son of Amr AlDausi came to the Apostle ﷺ and said: Do you need strong; fortified protection? The tribe of Daus had a fort in the pre-Islamic days. The Apostle ﷺ declined this offer; since it the privilege of protecting the Holy Prophet had already been reserved for the Ansar. When the Apostle ﷺ migrated to Medina; Tufail son of Amr also migrated to that place; and there also migrated along with him a man of his tribe. But the climate of Medina did not suit him; and he fell sick. He felt very uneasy. So he took hold of an iron head of an arrow and cut his finger-joints. The blood streamed forth from his hands; till he died. Tufail son of Amr saw him in a dream. His state was good and he saw him with his hands wrapped. He Tufail said to him: What treatment did your Allah accord to you? He replied. Allah granted me pardon for my migration to the Apostle ﷺ : He Tufail again said: What is this that I see you wrapping up your hands? He replied: I was told by Allah : We would not set right anything of yours which you damaged yourself. Tufail narrated this dream to the Messenger of Allah ﷺ. SahihMuslim-017-001-20768 | Abdullah Bin Samit reported that Abu Dharr said: We set out from our tribe Ghafir who look upon the prohibited months as permissible months. I and my brother Unais and our mother stayed with our maternal uncle who treated us well. The men of his tribe fell jealous and they said: When you are anay from your house; Unais commits adultery with your wife. Our -naternal uncle came and he accused us of the sin which was conveyed to him. I said: You have undone the good you did to us. We cannot stay with you after this. We came to our camels and loaded our luggage. Our maternal uncle began to weep covering himself with a piece of cloth. We proceeded on until we encamped by the side of Mecca. Unais cast lot on the camels we had and an equal number above that. They both went to a Kahin and he made Unais win and Unais came with our camels and an equal number along with them. He Abu Dharr said: My nephew; I used to observe prayer three years before my meeting with Allah Messenger ﷺ. I said: For whom did you say prayer? He said: For Allah. I said: To which direction did you turn your face for observing prayer ? He said: I used to turn my face as Allah has directed me to turn my face. I used to observe the night prayer at the time of the end of night and I fell down in prostration like the mantle until the sun rose over me. Unais said: I have a work in Mecca; so you better stay here. Unais went until he came to Mecca and he came to me late. I said: What did you do? He said: I met a person in Mecca who is on your religion and he claims that verily it is Allah Who has sent him. I said: What do the people say about him? He said: They say that he is a poet or a Kahin or a magician. Unais who was himself one of the poets said. I have heard the words of a Kahin but his words in no way resemble his words. And 1 also compared his words to the verses of poets but such words cannot be uttered by any poet. By Allah; he is truthful and they are liars. Then I said: you stay here; until I go; so that I should see him. He said: I came to Mecca and I selected an insignificant person from amongst them and said to him: Where is he whom you call AlSabi? He pointed out towards me saying: He is Sabi. Thereupon the people of the valley attacked me with sods and bows until I fell down unconscious. I stood up after havin. regained my consciousness and I found as if I was a red idol. I came to Zamzarn and washed blood from me and drank water from it and listen; O son of my brother; I stayed there for thirty nights or days and there was no food for me but the water of Zamzarn. And I became so bulky that there appeared wrinkles upon my stomach; and I did not feel any hunger in my stomach. It was during this time that the people of Mecca slept in the moonlit night and none was there to eircumambulate the House but only two women who had been invoking the name of Isafa; and Naila the two idols. They came to me while in their circuit and I said: Marry one with the other; but they did not dissuade from their invoking. They came to me and I said to them: Insert wood in the idols private parts. I said this to them in such plain words as I could not express in metaphorical terms. These women went away crying and saying: Had there been one amongst our people he would have taught a lesson to you for the obscene words used for our idols before us. These women met Allah Messenger ﷺ and Abu Bakr who had also been coming down the hill. He asked them: What has happened to you? They said: There is Sabi; who has hidden himself between the Kaba and its curtain. He said: What did he say to you? They said: He uttered such words before us as we cannot express. Allah Messenger ﷺ came and he kissed the Black Stone and circumambulated the House along with his Companion and then observed prayer; and when he had finished his prayer; Abu Dharr said: I was the first to greet him with the salutation of peace and uttered these words in this way; Allah Messen- ger; may there be peace upon you; whereupon he said: It may be upon you too and the mercy of Allah. He then said: Who are you? I said: From the tribe of Ghifar. He leaned his hand and placed his finger on his forehead and I said to myself: Perhaps he has not liked it that I belong to the tribe of Ghifar. I attempted to catch hold of his hand but his friend who knew about him more than I dissuaded me f rom doing so. He then lifted his head and said: Since how long have you been here? I said: I have been here for the last thirty nights or days. He said: Who has been feeding you? I said: There has been no food for me but the water of Zamzam. I have grown so bulky that there appear wrinkles upon my stomach and I do not feel any hunger. He said: It is blessed water and it also serves as food. Thereupon Abu Bakr said: Allah Messenger; let me serve as a host to him for tonight; and then Allah Messenger ﷺ proceeded forth and so did Abu Bakr and I went along with them. Abu Bakr opened the door and then he brought for us the raisins of Taif and that was the first food which I ate there. Then I stayed as long as I had to stay. I then came to Allah Messenaer ﷺ and he said: I have been shown the land abound- ing in trees and I think it cannot be but that of Yathrib that is the old name of Medina. You are a preacher to your people on my behalf. I hope Allah would benefit them through you and He would reward you. I came to Unais and he said: What have you done? I said: I have done that I have embraced Islam and I have testified to the prophethood of Allah Messenger. He said: I have no aversion for your religion and I also embrace Islam and testify to the prophethood of Muhammad. Then both of us came to our mother and she said: I have no aversion for your religion and I also embrace Islam and testify to the prophethood of Muhammad. We then loaded our camels and came to our tribe Ghifir and half of the tribe embraced Islam and their chief was Aimi Bin Rahada Ghifirl and he was their leader and hall of the tribe said: We will embrace Islam when Allah Messenger may p;. ace be upon him would come to Medina; and when Allah Messenger ﷺ came to Medina the remaining half also embraced Islam. Then a tribe Aslam came to the Prophet ﷺ and said: Allah Messenger; we also embrace Islam like our brothers who have embraced Islam. And they also embraced Islam. SunanAlTermithi-017-001-9773 | Abdullah Bin Amr narrated: The Messenger of Allah s.a.w came out to us with two books in hand. And he said:Do you know what these two books are? We said: No; O Messenger of Allah ! Unless you inform us. He said about the one that was in his right hand: This is a book from the Lord of the worlds; in it are the names of the people of Paradise; and the name of their fathers and their tribes. Then there is a summary at the end of them; there being no addition to them nor deduction from them forever. Then he said about the one that was in his left: This is a book from the Lord of the worlds; in it are the names of the people of Fire; and the name of their fathers and their tribes. Then there is a summary at the end of them; there being no addition to them nor deduction from them forever. The companions said: So why work O Messenger of Allah! Since the matter is already decided and over ? O brother; I am eager to wage war in the cause of Allah i.e. jihad ; and I find that both hajj and umrah are due from me. How can I combine them? He said: Combine them and sacrifice the animal made easily available for you. I; therefore; raised my voice in talbiyah for both of them i.e. umrah and hajj. When I reached AlUdhayb; Salman Ibn Rabiah and Zayd Ibn Suhan met me while I was raising my voice in talbiyah for both of them. One of them said to the other: This man does not have any more understanding than his camel. Thereupon it was as if a mountain fell on me. I came to Umar Ibn AlKhattab may Allah be pleased with him and said to him: Commander of the Faithful; I was a Christian Bedouin; and I have embraced Islam. SunanAbuDawoud-017-001-25738 | Sahl Bin Abi Hathmah and some senior men of the tribe told that Abdullah Bin Abi Sahl and Muhayasah came to Khaibar on account of the calamity i.e. famine that befall them. Muhayasah came and told the Abdullah Bin Sahl had been killed and thrown in a well or stream. He hen came to the Jews and said: I swear by Allah; you have killed him. They said: We swear by Allah; we have not killed him. He then proceeded and came to his tribe and mentioned this to them. Then he; his brother Huwayasah; who was older to him; and Abdulrahman Bin Sahl came forward to the Prophet. Muhayasah began to speak. It was he who was at Khaibar. The Messenger of Allah ﷺ then said to him: Let the eldest speak ; let the eldest speak ; meaning age. So Huwayasah spoke; and after him Muhayasah spoke. The Messenger of Allah ﷺ then said: They should either pay the bloodwit for you friend or they should be prepared for war. So the Messenger of Allah ﷺ wrote to them about it. They wrote in reply : We swear by Allah; we have not killed him. The Messenger of Allah ﷺ then said to Huwayasah; Muhayasah and Abdulrahman Will you take an oath and thus have the claim to the blood of your friend ? I swear by Allah; if order people to come but from a certain gate of the Masjid; and they come out from another gate; their blood and their properties will be lawful for me. I swear by Allah; if I seize the tribe of Rabiah for the tribe of Mudar; it is lawful for me from Allah. Who will apologies to me for the slave of Hudhail i.e. Abdullah Bin Masud who thinks that his reading of the Quran is from Allah. I swear by Allah; it is a rhymed prose of the Bedouins. SunanAbuDawoud-017-001-26075 | Narrated Thawban: The Messenger of Allah ﷺ as saying: Allah; the Exalted; folded for me the earth; or he said the narrator is doubtful : My Lord folded for me the earth; so much so that I saw its easts and wests i.e. the extremities. The kingdom of my community will reach as far as the earth was floded for me. The two treasures; the red and the white; were bestowed on me. I prayed to my Lord that He may not destroy my community by prevailing famine; and not give their control to an enemy who annihilates then en masse except from among themselves. My Lord said to me: Muhammad; If I make a decision; it is not withdrawn ; and I shall not destroy them by prevailing famine; and I shall not give their control to an enemy; except from among themselves; who exterminates them en masse; even if they are stormed from all sides of the earth ; only a section of them will destroy another section; and a section will captive another section. I am afraid about my community of those leaders who will lead astray. When the sword is used among my people; it will not be withdrawn from them till the Day of Resurrection; and the Last Hour will not come before the tribes of my people attach themselves to the polytheists and tribes of my people worship idols. SunanAbuDawoud-017-001-26616 | Narrated Jabir Ibn Abdullah: Muhammad Ibn Ishaq said: I mentioned the story of Maiz Ibn Malik to Aasi m Ibn Umar Ibn Qatadah. He said to me:Hassan Ibn Muhammad Ibn Ali Ibn Abu Talib said to me: Some men of the tribe of Aslam whom I do not blame and whom you like have transmitted to me the saying of the Messenger of Allah ﷺ : Why did you not leave him alone? He said: But I did not understand this tradition. So I went to Jabir Ibn Abdullah and said to him : Some men of the tribe of Aslam narrate that the Messenger of Allah ﷺ said when they mentioned to him the anxiety of Maiz when the stones hurt him: Why did you not leave him alone? But I do not know this tradition. He said: My cousin; I know this tradition more than the people. I was one of those who had stoned the man. When we came out with him; stoned him and he felt the effect of the stones; he cried: O people! return me to the Messenger of Allah ﷺ. My people killed me and deceived me; they told me that the Messenger of Allah ﷺ would not kill me. We did not keep away from him till we killed him. When we returned to the Messenger of Allah ﷺ we informed him of it. He said: Why did you not leave him alone and bring him to me? and he said this so that the Messenger of Allah ﷺ might ascertain it from him. But he did not say this to abandon the prescribed punishment. MuwataMalik-017-001-34837 | Malik related to me from Abdullah Ibn Abi Bakr Ibn Hazm that his father told him that he was sitting with Aban Ibn Uthman; and an argument was brought to him between some people from the Juhayna tribe and some people from the Banu AlHarith Ibn AlKhazraj. A woman of the Juhayna tribe was married to a man from the Banu AlHarith Ibn AlKhazraj; called Ibrahim Ibn Kulayb. She died and left property and mawali; and her son and husband inherited them from her. Then her son died and his heirs said; We have the wala of the mawali. Her son obtained them. Those of the Juhayna said; It is not like that. They are the mawali of our female associate. When her child died; we have their wala and we inherit them. MuwataMalik-017-001-34849 | Yahya related to me from Malik that he heard Ibn Shihab say; The precedent of the sunna when a man injures a woman is that he must pay the blood- money for that injury and there is no retaliation against him. Malik said; That is an accidental injury; when a man strikes a woman and hits with a blow what he did not intend; for instance; if he struck her with a whip and cut her eye open and the like of that. Malik said about a woman who has a husband and children who are not from her paternal relatives or her people; that since he is from another tribe; there is no blood-money against her husband for her criminal action; nor any against her children if they are not from her people; nor any against her maternal brothers when they are not from her paternal relations or her people. These are entitled to her inheritance but only the paternal relations have paid blood-money from since the time of the Messenger of Allah; may Allah bless him and grant him peace. Until today it is like that with the mawla of a woman. MuwataMalik-017-001-34872 | Malik said that Ibn Shihab said; The precedent of the sunna in the intentional murder is that when the relatives of the murdered person relinquish retaliation; the blood-money is owed by the murderer from his own property unless the tribe helps him with it willingly. Malik said; What is done in our community is that the blood- money is not obliged against the tribe until it has reached a third of the full amount and upwards. Whatever reaches a third is against the tribe; and whatever is below a third; is against the property of the one who did the injury. Malik said; The way of doing things about which there is no dispute among us; in the case of someone who has the blood-money accepted from him in intentional murder or in any injury in which there is retaliation; is that that blood-money is not due from the tribe unless they wish it. The blood-money for that is from the property of the murderer or the injurer if he has property. If he does not have any property; it is a debt against him; and none of it is owed by the tribe unless they wish. Malik said; The tribe does not pay blood-money to anyone who injures himself; intentionally or accidentally. This is the opinion of the people of fiqh in our community. I have not heard that anyone has made the tribe liable for any blood-money incurred by intentional acts. Part of what is well-known of that is that Allah; the Blessed; and the Exalted; said in His Book; Whoever has something pardoned him by his brother; should follow it with what is accepted and pay it with good will Surat 2 ayat 178 The commentary on that - in our view - and Allah knows best; is that whoever gives his brother something of the blood- money; should follow it with what is accepted and pay him with good will. Malik spoke about a child who had no property and a woman who had no property. He said; When one of them causes an injury below a third of the blood-money; it is taken on behalf of the child and woman from their personal property; if they have property from which it may be taken. If not; the injury which each of them has caused is a debt against them. The tribe does not have to pay any of it and the father of a child is not liable for the blood-money of an injury caused by the child and he is not responsible for it. Malik said; The way of doing things in our community about which there is no dispute; is that when a slave is killed; the value for him is that of the day on which he was killed. The tribe of the murderer is not liable for any of the value of the slave; great or small. That is the responsibility of the one who struck him from his own personal property as far as it covers. If the value of the slave is the blood- money or more; that is against him in his property. MuwataMalik-017-001-34877 | Yahya related to me from Malik from Ibn Shihab from Said Ibn AlMusayab and Abu Salama Ibn Abdulrahman from Abu Huraira that the Messenger of Allah; may Allah bless him and grant him peace; said; The wound of an animal is of no account and no compensation is due for it. The well is of no account and no compensation is due for it. The mine is of no account and no compensation is due for it and a fifth is due for buried treasures. Alkanz: see Book 17. Malik said; Everyone leading an animal by the halter; driving it; and riding it is responsible for what the animal strikes unless the animal kicks out without anything being done to it to make it kick out. Umar Ibn AlKhattab imposed the blood-money on a person who was exercising his horse. Malik said; It is more fitting that a person leading an animal by the halter; driving it; or riding it incur a loss than a person who is exercising his horse. See hadith 4 of this book. Malik said; What is done in our community about a person who digs a well on a road or ties up an animal or does the like of that on a road used by muslims; is that since what he has done is included in that which he is not permitted to do in such a place; he is liable for whatever injury or other thing arises from that action. The blood-money of that which is less than a third of the full blood- money is owed from his own personal property. Whatever reaches a third or more; is owed by his tribe. Any such things that he does which he is permitted to do on the muslims road are something for which he has no liability or loss. Part of that is a hole which a man digs to collect rain; and the beast from which the man alights for some need and leaves standing on the road. There is no penalty against anyone for this. Malik spoke about a man who went down a well; and another man followed behind him; and the lower one pulled the higher one and they fell into the well and both died He said; The tribe of the one who pulled him in is responsible for the blood-money. Malik spoke about a child whom a man ordered to go down into a well or to climb a palm tree and he died as a result. He said; The one who ordered him is liable for whatever befalls him; be it death or something else. Malik said; The way of doing things in our community about which there is no dispute is that women and children are not obliged to pay blood-money together with the tribe in the blood-moneys which the tribe must pay. The blood-money is only obligatory for a man who has reached puberty. Malik said that the tribe could bind themselves to the blood-money of mawali if they wished. If they refused; they were people of the diwan or were cut off from their people. In the time of the Messenger of Allah; may Allah bless him and grant him peace; people paid the blood-money to each other as well as in the time of Abu Bakr AlSiddiq before there was a diwan. The diwan was in the time of Umar Ibn AlKhattab. No one other than one people and the ones holding the wala paid blood- money for one because the wala was not transferable and because the Prophet; may Allah bless him and grant him peace; said; The wala belongs to the one who sets free. Malik said; The wala is an established relationship. Malik said; What is done in our community about animals that are injured is that the person who causes the injury pays whatever of their value has been diminished. Malik said about a man condemned to death and one of the other hudud befell him; He is not punished for it. That is because the killing overrides all of that; except for slander. The slander remains hanging over the one to whom it was said because it will be said to him; Why do you not flog the one who slandered you? I think that the condemned man is flogged with the hadd before he is killed; and then he is killed. I do not think that any retaliation is inflicted on him for any injury except killing because killing overrides all of that. Malik said; What is done in our community is that when a murdered person is found among the main body of a people in a village or other place; the house or place of the nearest people to him is not responsible. That is because the murdered person can be slain and then cast at the door of some people to shame them by it. No one is responsible for the like of that. Malik said about a group of people who fight with each other and when the fight is broken up; a man is found dead or wounded; and it is not known who did it; The best of what is heard about that is that there is blood-money for him; and the blood-money is against the people who argued with him. MuwataMalik-017-001-34946 | Malik related to me from Hisham Ibn Urwa from his father from Yahya Ibn Abdulrahman Ibn Hatib that some slaves of Hatib stole a camel belonging to a man from the Muzayna tribe and they slaughtered it. The case was brought before Umar Ibn AlKhattab; and Umar ordered Kathir Ibn AlSalt to cut off their hands. Then Umar said to Habib; I think you must be starving them; and he added; By Allah! I will make you pay such a fine that it will be heavy for you. He enquired of the man from the Muzayna tribe; What was the price of your camel? The Muzayni said; By Allah; I refused to sell her for 400 dirhams. Umar said; Give him 800 dirhams. Yahya said that he heard Malik say; Doubling the price is not the behaviour of our community. Malik said about a man saying to his wife; You are divorced; and every woman I marry is divorced; or that all his property would be sadaqa if he did not do such-and-such; and he broke his oath: As for his wives; it is divorce as he said; and as for his statement; Every woman I marry is divorced; if he did not name a specific woman; tribe; or land; or such; it is not binding on him and he can marry as he wishes.
