If the deceased belonged to a people at war with you, and he was a believer, the freeing of a believing slave (Is enough). If he belonged to a people with whom ye have treaty of Mutual alliance, compensation should be paid to his family, and a believing slave be freed. For those who find this beyond their means, (is prescribed) a fast for two months running: by way of repentance to Allah: for Allah hath all knowledge and all wisdom. | |

The Prophet ﷺ distributed it among AlAqra Bin HAbis AlHanzali who belonged to Bani Mujashi; Uyaina Bin Badr AlFazari; Alqama Bin Ulatha AlAmiri; who belonged to the Bani Kilab tribe and Zaid AlKhail AlTai who belonged to Bani Nabhan. So the Quraish and the Ansar became angry and said; He gives to the chiefs of Najd and leaves us! The Prophet ﷺ said; I just wanted to attract and unite their hearts make them firm in Islam. Then there came a man with sunken eyes; bulging forehead; thick beard; fat raised cheeks; and clean-shaven head; and said; O Muhammad! Be afraid of Allah! The Prophet ﷺ said; Who would obey Allah if I disobeyed Him? Allah. He trusts me over the people of the earth; but you do not trust me? A man from the people present then ; who; I think; was Khalid Bin AlWalid; asked for permission to kill him; but the Prophet ﷺ prevented him. When the man went away; the Prophet said; Out of the offspring of this man; there will be people who will recite the Quran but it will not go beyond their throats; and they will go out of Islam as an arrow goes out through the game; and they will kill the Muslims and leave the idolators. SahihAlBukhari-017-001-1785 | Narrated Abu Huraira: While we were in the Masjid; Allah Messenger ﷺ came out to us and said; Let us proceed to the Jews. So we went along with him till we reached Bait AlMidras a place where the Torah used to be recited and all the Jews of the town used to gather. The Prophet ﷺ stood up and addressed them; O Assembly of Jews! Embrace Islam and you will be safe! The Jews replied; O Aba AlQasim! You have conveyed Allah message to us. The Prophet ﷺ said; That is what I want from you. He repeated his first statement for the second time; and they said; You have conveyed Allah message; O Aba AlQasim. Then he said it for the third time and added; You should Know that the earth belongs to Allah and His Apostle; and I want to exile you fro;;; this land; so whoever among you owns some property; can sell it; otherwise you should know that the Earth belongs to Allah and His Apostle. SahihAlBukhari-017-001-2001 | Narrated Abu Rafi: The Prophet ﷺ said; The neighbor has more right to be taken care of by his neighbor than anyone else. Some men said; If one wants to buy a house for 20;000 Dirhams then there is no harm to play a trick to deprive somebody of preemption by buying it just on paper with 20;000 Dirhams but paying to the seller only 9;999 Dirhams in cash and then agree with the seller to pay only one Dinar in cash for the rest of the price i.e. 10;001 Dirhams. If the preemptor offers 20;000 Dirhams for the house; he can buy it otherwise he has no right to buy it by this trick he got out of preemption. If the house proves to belong to somebody else other than the seller; the buyer should take back from the seller what he has paid; i.e.; 9;999 Dirhams and one Dinar; because if the house proves to belong to somebody else; so the whole bargain deal is unlawful. If the buyer finds a defect in the house and it does not belong to somebody other than the seller; the buyer may return it and receive 20;000 Dirhams instead of 9999 Dirham plus one Dinar which he actually paid. SahihAlBukhari-017-001-3336 | Narrated AlBara: Abu Bakr bought a camel saddle from Azib for thirteen Dirhams. Abu Bakr said to Azib; Tell AlBara to carry the saddle for me. Azib said; No; unless you relate to me what happened to you and Allah Messenger ﷺ when you left Mecca while the pagans were in search of you. Abu Bakr said; We left Mecca and we traveled continuously for that night and the following day till it was midday. I looked around searching for shade to take as shelter; and suddenly I came across a rock; and found a little shade there. So I cleaned the place and spread a bed for the Prophet ﷺ in the shade and said to him; Lie down; O Allah Messenger ﷺ. So the Prophet ﷺ lay down and I went out; looking around to see if there was any person pursuing us. Suddenly I saw a shepherd driving his sheep towards the rock; seeking what we had already sought from it. I asked him; To whom do you belong; O boy? He said; I belong to a man from Quraish. He named the man and I recognized him. I asked him; Is there any milk with your sheep? He said; Yes. I said; Will you then milk some for us? He said; Yes. Then I asked him to tie the legs of one of the sheep and clean its udder; and then ordered him to clean his hands from dust. Then the shepherd cleaned his hands by striking his hands against one another. After doing so; he milked a small amount of milk. I used to keep for Allah Messenger ﷺ a leather water-container; the mouth of which was covered with a piece of cloth. I poured water on the milk container till its lower part was cold. So we went out at night and travelled throughout the night and the following day till it was noon; then we perceived a rock and went towards it; and there was some shade under it. I went out to guard him and all of a sudden I saw a shepherd coming with his sheep looking for the same; the shade of the rock as we did; I asked him; O boy; to whom do you belong? He said; Yes; we travelled the whole night and also the next day till midday. when nobody could be seen on the way because of the severe heat. Then there appeared a long rock having shade beneath it; and the sunshine had not come to it yet. So we dismounted there and I levelled a place and covered it with an animal hide or dry grass for the Prophet ﷺ to sleep on for a while. I then said; Sleep; O Allah Messenger ﷺ ; and I will guard you. So he slept and I went out to guard him. Suddenly I saw a shepherd coming with his sheep to that rock with the same intention we had when we came to it. I asked him. To whom do you belong; O boy? He replied; I belong to a man from Medina or Mecca. I said; Do your sheep have milk? He said; Yes. I said; Will you milk for us? He said; Yes. He caught hold of a sheep and I asked him to clean its teat from dust; hairs and dirt. The sub-narrator said that he saw AlBara striking one of his hands with the other; demonstrating how the shepherd removed the dust. The shepherd milked a little milk in a wooden container and I had a leather container which I carried for the Prophet ﷺ to drink and perform the ablution from. I went to the Prophet; hating to wake him up; but when I reached there; the Prophet ﷺ had already awakened; so I poured water over the middle part of the milk container; till the milk was cold. Then I said; Drink; O Allah Messenger ﷺ ! He drank till I was pleased. Then he asked; Has the time for our departure come? I said; Yes. So we departed after midday. Suraqa Bin Malik followed us and I said; We have been discovered; O Allah Messenger ﷺ ! He said; Dont grieve for Allah is with us. The Prophet ﷺ invoked evil on him i.e. Suraqa and so the legs of his horse sank into the earth up to its belly. The subnarrator; Zuhair is not sure whether Abu Bakr said; It sank into solid earth. Suraqa said; I see that you have invoked evil on me. Please invoke good on me; and by Allah; I will cause those who are seeking after you to return. The Prophet ﷺ invoked good on him and he was saved. Then; whenever he met somebody on the way; he would say; I have looked for him here in vain. So he caused whomever he met to return. SahihMuslim-017-001-18031 | Abu Qatada reported: We accompanied the Messenger of Allah my ﷺ on an expedition in the year of the Battle of Hunain. When we encountered the enemy; some of the Muslims turned back in fear. I saw that a man from the polytheists overpowered one of the Muslims. I turned round and attacked him from behind giving a blow between his neck and shoulder. He turned towards me and grappled with me in such a way that I began to see death staring me in the face. Then death overtook him and left me alone. I joined Umar Bin AlKhattab who was saying: What has happened to the people that they are retreating ? I said: It is the Decree of Allah. Then the people returned. The battle ended in a victory for the Muslims and the Messenger of Allah ﷺ sat down to distribute the spoils of war. He said: One who has killed an enemy and can bring evidence to prove it will get his belongings. So I stood up and said: Who will give evidence for me? Then I sat down. Then he the Holy Prophet said like this. I stood up again and said: Who will bear witness for me? He the Holy Prophet made the same observation the third time; and I stood up once again. Now the Messenger of Allah ﷺ said: What has happened to you; O Abu Qatada? Then I related the whole story; to him. At this; one of the people said: He has told the truth. Messenger of Allah 1 The belongings of the enemy killed by him are with me. Persuade him to forgo his right in my favour. Objecting to this proposal Abu Bakr said: BY Allah; this will not happen. So the Messenger of Allah may peace he upon him said: He Abu Bakr has told the truth; and so give the belongings to him Abu Qatada. So he gave them to me. I sold the armour which was a part of my share of the booty and bought with the sale proceeds a garden in the street of Banu Salama. This was the first property I acquired after embracing Islam. SunanAlNasai-017-001-14969 | It was narrated that Anas Bin Malik said: The first Lian in Islam was when Hilal Bin Umayah accused Sharik Bin AlSahma of committing adultery with his wife. He came to the Prophet and told him about that. The Prophet said: Bring four witnesses; otherwise you will feel the Hadd punishment on your back. And he repeated that several times. Hilal said to him: By Allah; O Messenger of Allah! Allah; the Mighty and Sublime; knows that I am telling the truth; and Allah; the Mighty and Sublime; will certainly reveal to you that which will spare my back from the whip. While they were like that; the Verse of Lian was revealed to him: As to those who accuse their wives. He called Hilal and he bore witness four times by Allah that he was telling the truth; and the fifth time he invoked the curse of Allah upon him if he were lying. Then he called the woman and she bore witness four times by Allah that he was lying. When it came to the fourth or fifth time; the Messenger of Allah said: Stop her; for it will inevitably bring the punishment of Allah upon the liar. She hesitated until we thought that she was going to confess; then she said: I will not dishonor my people today. Then she went ahead with the oath. The Messenger of Allah said: Wait and see. If she produces a child who is white; with straight hair and Qadiya eyes; then he belongs to Hilal Bin Umayah; but if she produces a child who is dark with curly hair; of average size and with narrow calves; then he belongs to Sharik Bin AlSahma. SunanAbuDawoud-017-001-25720 | Narrated Ziyad Ibn Saad Ibn Dumayrah AlSulami: On the authority of his father Sad and his grandfather Dumayrah according to Mousa version who were present in the battle of Hunayn with the Messenger of Allah ﷺ : After the advent of Islam; Muhallam Ibn Jaththamah AlLaythi killed a man of Ashja. That was the first blood-money decided by the Messenger of Allah ﷺ for payment. Uyaynah spoke about the killing of AlAshjai; for he belonged to Ghatafan; and AlAqra Ibn Habis spoke on behalf of Muhallam; for he belonged to Khunduf. The voices rose high; and the dispute and noise grew. So the Messenger of Allah ﷺ said: Do you not accept blood-money; Uyaynah? Uyaynah then said: No; I swear by Allah; until I cause his women to suffer the same fighting and grief as he caused my women to suffer. Again the voices rose high; and the dispute and noise grew. The Messenger of Allah ﷺ said: Do you not accept the blood-money Uyaynah? Uyaynah gave the same reply as before; and a man of Banu Layth called Mukaytil stood up. He had a weapon and a skin shield in his hand. He said: I do not find in the beginning of Islam any illustration for what he has done except the one that some sheep came on; and those in the front were shot; hence those in the rear ran away. The other example is that make a law today and change it. The Messenger of Allah ﷺ said: Fifty camels here immediately and fifty when we return to Medina. This happened during some of his journeys. Muawiyah said to AlMiqdam: Do you know that AlHasan Ibn Ali has died? AlMiqdam recited the Quranic verse We belong to Allah and to Him we shall return. A man asked him: Do you think it a calamity? He replied: Why should I not consider it a calamity when it is a fact that the Messenger of Allah ﷺ used to take him on his lap; saying: This belongs to me and Husayn belongs to Ali? The man of Banu Asad said: He was a live coal which Allah has extinguished. AlMiqdam said: Today I shall continue to make you angry and make you hear what you dislike. He then said: Muawiyah; if I speak the truth; declare me true; and if I tell a lie; declare me false. He said: Do so. He said: I adjure you by Allah; did you hear the Messenger of Allah ﷺ forbidding use to wear gold? He replied: Yes. He said: I adjure you by Allah; do you know that the Messenger of Allah ﷺ prohibited the wearing of the skins of beasts of prey and riding on them? He said: Yes. He said: I swear by Allah; I saw all this in your house; O Muawiyah. Muawiyah said: I know that I cannot be saved from you; O Miqdam. Khalid said: Muawiyah then ordered to give him what he did not order to give to his two companions; and gave a stipend of two hundred dirhams to his son. AlMiqdam then divided it among his companions; and the man of Banu Asad did not give anything to anyone from the property he received. When Muawiyah was informed about it; he said: AlMiqdam is a generous man; he has an open hand for generosity. MuwataMalik-017-001-34915 | Yahya said; I heard Malik say that if a man pledges his garden for a stated period and the fruits of that garden are ready before the end of that period; the fruits are not included in the pledge with the real estate; unless it is stipulated by the pledger in his pledge. However; if a man receives a slave-girl as a pledge and she is pregnant or she becomes pregnant after his taking her as a pledge; her child is included with her. A distinction is made between the fruit and the child of the slave-girl. The Messenger of Allah; may Allah bless him and grant him peace; said; If someone sells a palm which has been pollinated; the fruit belongs to the seller unless the buyer stipulates its inclusion. The undisputed way of doing things in our community is that if a man sells a slave-girl or an animal with a foetus in its womb; the foetus belongs to the buyer; whether or not the buyer stipulates it. The palm is not like the animal. Fruit is not like the foetus in its mother womb. Part of what clarifies that is also that it is the usage of people to have a man pawn the fruit of the palm apart from the palm. But if they themselves are dying; they say; It belongs to my son; I gave it to him. MuwataMalik-017-001-35033 | Yahya related to me from Malik from Nafi from Abdullah Ibn Umar that Umar Ibn AlKhattab said; If a slave who has wealth is sold; that wealth belongs to the seller unless the buyer stipulates its inclusion. Malik said; The generally agreed upon way of doing things among us is that if the buyer stipulates the inclusion of the slave property whether it be cash; debts; or goods of known or unknown value; then they belong to the buyer; even if the slave possesses more than that for which he was purchased; whether he was bought for cash; as payment for a debt; or in exchange for goods. This is possible because a master is not asked to pay zakat on his slave property. If a slave has a slave-girl; it is halal for him to have intercourse with her by his right of possession. If a slave is freed or put under contract kitaba to purchase his freedom; then his property goes with him. MuwataMalik-017-001-35338 | Yahya related to me from Malik that he had asked Ibn Shihab about a man who had a slave-girl as a wife; and then he bought her; and divorced her once. He said; She is halal for him by the possession of the right hand as long as he does not make his divorce irrevocable. If he irrevocably divorces her; she is not halal for him by the possession of the right hand until she has married another husband. Malik said that if a man rnarried a female slave and then she had a child by him; and then he bought her; she was not an umm walad for him because of the child born to him while she belonged to another; until she had had a child by him while she was in his possession after he had purchased her. As for the people of force who use force; if one of them surrenders; his land and property belong to the Muslims because the people of force are overcome in their towns; and it becomes booty for the Muslims. Pure actions belong to Allah. Peace be on the Prophet and the mercy of Allah and His blessings. Peace be on us and on the slaves of Allah who are salihun. I testify that there is no god except Allah. I testify that Muhammad is the Messenger of Allah. Bismillah; AlTahiyatu lillah; AlSalawatu lillah; AlZakiyatu lillah. AlSalamu alan-nabiyi wa rahmatullahi wa barakatuhu. AlSalamu alayna wa ala ibadillahis-salihin. Shahidtu an la ilaha illallah. Shahidtu anna Muhammad AlRasulullah. He used to say this after the first two rakas and he would make supplication with whatever seemed fit to him when the tashahhud was completed. When he sat at the end of the prayer; he did the tashahhud in a similar manner; except that after the tashahhud he made supplication with whatever seemed fit to him. When he had completed the tashahhud and intended to say the taslim; he said; Peace be on the Prophet and His mercy and blessings. Peace be upon us and on the slaves of Allah who are salihun. Alsalamu alan-nabiyi wa rahmatullahi wa barakatuhu. AlSalamu alayna wa ala ibadillahissalihin.
