Then he sent for the chiefs of Bani AlNajjar; and they came; carrying their swords. As if I am just now looking at Allah Messenger ﷺ on his camel with Abu Bakr riding behind him on the same camel and the chiefs of Bani AlNajjar around him till he dismounted in the courtyard of Abu Ayoub home. The Prophet ﷺ used to offer the prayer wherever the prayer was due; and he would pray even in sheepfolds. Then he ordered that the Masjid be built. He sent for the chiefs of Banu AlNajjar; and when they came; he said; O Banu AlNajjar! Suggest to me the price of this garden of yours. They replied No! By Allah; we do not demand its price except from Allah. In that garden there were the following things that I will tell you: Graves of pagans; unleveled land with holes and pits etc.; and date-palm trees. Allah Messenger ﷺ ordered that the graves of the pagans be dug up and; the unleveled land be leveled and the date-palm trees be cut down. The trunks of the trees were arranged so as to form the wall facing the Qibla. The Stone pillars were built at the sides of its gate. The companions of the Prophet ﷺ were carrying the stones and reciting some lyrics; and Allah Messenger ﷺ.. was with them and they were saying; O Allah! Then he sent for Bani AlNajjar and they came armed with their swords. As if I am looking just now as the Prophet ﷺ was sitting over his Rahila Mount with Abu Bakr riding behind him and all Banu AlNajjar around him till he dismounted at the courtyard of Abu Ayoub house. The Prophet ﷺ loved to pray wherever the time for the prayer was due even at sheep-folds. Later on he ordered that a Masjid should be built and sent for some people of Bani AlNajjar and said; O Banu AlNajjar! Suggest to me the price of this walled piece of land of yours. They replied; No! By Allah! We do not demand its price except from Allah. Anas added: There were graves of pagans in it and some of it was unleveled and there were some date-palm trees in it. The Prophet ﷺ ordered that the graves of the pagans be dug out and the unleveled land be level led and the date-palm trees be cut down. So all that was done. They aligned these cut date-palm trees towards the Qibla of the Masjid as a wall and they also built two stone side-walls of the Masjid. His companions brought the stones while reciting some poetic verses. The Prophet ﷺ was with them and he kept on saying; There is no goodness except that of the Hereafter; O Allah! But Umar added to it; he built as it was built during the lifetime of the Messenger of Allah ﷺ with bricks and branches; and he changed its pillars. Mujahid said: Its pillars were made of wood. Uthman changed it altogether with increasing addition. He built its walls with decorated stone and lime. And he built the pillars with decorated stone and its roof with teak. Mujahid said: Its roof was made of teak. MuwataMalik-017-001-35034 | Yahya related to me from Malik from Abdullah Ibn Abi Bakr Ibn Muhammad Ibn Amr Ibn Hazm that Aban Ibn Uthman and Hisham Ibn Ismail used to mention in their khutbas built-in liability agreements in the sale of slaves; to cover both a three day period and a similar clause covering a year. Malik explained; The defects a lave or slave-girl are found to have from the time they are bought until the end of the three days are the responsibility of the seller. The year agreement is to cover insanity; leprosy; and loss of limbs due to disease. After a year; the seller is free from any liability. Malik said;An inheritor or someone else who sells a slave or slave-girl without any such built-in guarantee is not responsible for any fault in the slave and there is no liability agreement held against him unless he was aware of a fault and concealed it. If he was aware of a fault; the lack of guarantee does not protect him. The purchase is returned.
