SahihAlBukhari-017-001-1269 | Narrated Abu Qatada: Allah Messenger ﷺ said on the Day of the battle of Hunain; Whoever has killed an infidel and has a proof or a witness for it; then the salb arms and belongings of that deceased will be for him. I stood up to seek a witness to testify that I had killed an infidel but I could not find any witness and then sat down. Then I thought that I should mention the case to Allah Messenger ﷺ I and when I did so a man from those who were sitting with him said; The arms of the killed person he has mentioned; are with me; so please satisfy him on my behalf. Abu Bakr said; No; he will not give the arms to a bird of Quraish and deprive one of Allah lions of it who fights for the cause of Allah and His Apostle. Allah Messenger ﷺ I stood up and gave it to me; and I bought a garden with its price; and that was my first property which I owned through the war booty. The people of Hijaz said; A judge should not pass a judgment according to his knowledge; whether he was a witness at the time he was the judge or before that And if a litigant gives a confession in favor of his opponent in the court; in the opinion of some scholars; the judge should not pass a judgment against him till the latter calls two witnesses to witness his confession. And some people of Iraq said; A judge can pass a judgement according to what he hears or witnesses the litigant confession in the court itself; but if the confession takes place outside the court; he should not pass the judgment unless two witnesses witness the confession. Some of them said; A judge can pass a judgement depending on his knowledge of the case as he is trust-worthy; and that a witness is Required just to reveal the truth. The judge knowledge is more than the witness. Some said; A judge can judge according to his knowledge only in cases involving property; but in other cases he cannot. SahihMuslim-017-001-17388 | Abu Huraira and Zaid b Khalid AlJuhani reported that one of the desert tribes came to Allah Messenger ﷺ and said: Messenger of Allah; I beg of you in the name of Allah that you pronounce judgment about me according to the Book of Allah. The second claimant who was wiser than him said: Well; decide amongst us according to the Book of Allah; but permit me to say something. Thereupon Allah Messenger may peace be upon ham said: Say. He said: My son was a servant in the house of this person and he committed adultery with his wife. I was informed that my son deserved stoning to death as punishment for this offence. I gave one hundred goats and a slave girl as ransom for this. I asked the scholars if this could serve as an expiation for this offence. They informed me that my son deserved one hundred lathes and exile for one year. and this woman deserved stoning as she was married. Thereupon Allah Messenger may peace he upon him said: By Him in Whose Hand is my life. I will decide between you according to the Book of Allah. The slave-girl and the goats should be given back; and your son is to be punished with one hundred lashes and exile for one year. And; O Unais Bin Zuhaq AlAslami ; go to this woman in the morning; and if she makes a confession; then stone her. He the narrator said: He went to her in the morning and she made a confession. SunanAbuDawoud-017-001-25829 | Sufyan said according to one chain ; and Abu AlSalit said according to another chain : A man wrote to Umar Bin Abd AlAziz asking him about Divine decree. He wrote to him: To begin with; I enjoin upon you to fear Allah; to be moderate in obeying His Command; to follow the sunnah practice of His Prophet ﷺ and to abandon the novelties which the innovators introduced after his Sunnah has been established and they were saved from its trouble i.e. novelty or innovation ; so stick to Sunnah; for it is for you; if Allah chooses; a protection ; then you should know that any innovation which the people introduced was refuted long before it on the basis of some authority or there was some lesson in it; for the Sunnah was introduced by the people who were conscious of the error; slip; foolishness; and extremism in case of the sunnah was opposed. So accept for yourself what the people in the past had accepted for themselves; for they had complete knowledge of whatever they were informed; and by penetrating insight they forbade to do prohibited acts ; they had more strength than us to disclose the matters of religion ; and they were far better than us by virtue of their merits. If right guidance is what you are following; then you outstriped them to it. And if you say whatever the novelty occurred after them was introduced by those who followed the way other then theirs and disliked them. It is they who actually outstripped; and talked about it sufficiently; and gave a satisfactory explanation for it. Below them there is no place for exhaustiveness; and above them there is no place for elaborating things. Some people shortened the matter more than they had done; and thus they turned away from them ; and some people raised the matter more than they had done; and thus they exaggerated. They were on right guidance between that. You have written to me asking about confession of Divine decree; you have indeed approached a person who is well informed of it; with the will of Allah. I know what whatever novelty people have brought in; and whatever innovation people have introduced are not more manifest and more established than confession of Divine decree. The ignorant people i.e. the Arabs before Islam in pre-Islamic times have mentioned it ; they talked about it in their speeches and in their poetry. They would console themselves for what they lost; and Islam then strengthened it i.e. belief in Divine decree. The Messenger of Allah ﷺ did not mention it in one or two traditions; but the Muslims heard it from him; and they talked of it from him; and they talked of it during his lifetime and after his death. They did so out of belief and submission to their Lord and thinking themselves weak. There is nothing which is not surrounded by His knowledge; and not counted by His register and not destined by His decree. Despite that; it has been strongly mentioned in His Book: from it they have derived it; and from it they have and so ? they also read in it what you read; and they knew its interpretation of which you are ignorant. After that they said: All this is by writing and decreeing. Distress has been written down; and what has been destined will occur ; what Allah wills will surely happen; and what He does not will will not happen. We have no power to harm or benefit ourselves. MuwataMalik-017-001-34779 | Malik related to me from Nafi that Safiya bint Abi Ubayd informed him that a man who had had intercourse with a virgin slave- girl and made her pregnant was brought to Abu Bakr AlSiddiq. He confessed to fornication; and he was not muhsan. Abu Bakr gave the order and he was flogged with the hadd punishment. Then he was banished to Fadak; thirty miles from Madina. Malik spoke about a person who confessed to fornication and then retracted it and said; I didnt do it. I said that for such-and-such a reason; and he mentioned the reason. Malik said; That is accepted from him and the hadd is not imposed on him. That is because the hadd is what is for Allah; and it is only applied by one of two means; either by a clear proof which establishes guilt or by a confession which is persisted in so that the hadd is imposed. If someone persists in his confession; the hadd is imposed on him. MuwataMalik-017-001-34803 | Yahya related to me from Malik that Yahya Ibn Said said that Abu Bakr Ibn Muhammad Ibn Amr Ibn Hazm informed him that he had taken a Nabatean who had stolen some iron rings and jailed him in order to cut off his hand. Amra bint Abdulrahman sent a girl mawla to him called Umaya. Abu Bakr said that she had come to him while he was among the people and said that his aunt Amra sent word to him saying; Son of my brother! You have taken a Nabatean for something insignificant which was mentioned to me. Do you want to cut off his hand? He had said; Yes. She said; Amra says to you not to cut off the hand except for a quarter of a dinar and upwards. Abu Bakr added; So I let the Nabatean go. Malik said; The generally agreed on way of doing things among us about the confession of slaves is that if a slave confesses something against himself; the hadd and punishment for it is inflicted on his body. His confession is accepted from him and one does not suspect that he would inflict something on himself. Malik said; As for the one of them who confesses to a matter which will incur damages agains this master; his confession is not accepted against his master. Malik said; One does not cut off the hand of a hireling or a man who is with some people to serve them; if he robs them; because his state is not the state of a thief. His state is the state of a treacherous one. The treacherous one does not have his hand cut off. Malik said about a person who borrows something and then denies it; His hand is not cut off. He is like a man who owes a debt to another man and denies it. He does not have his hand cut off for what he has denied. Malik said; The generally agreed-on way of dealing among us; with the thief who is found in a house and has gathered up goods and has not taken them out; is that his hand is not cut off. That is like the man who places wine before him to drink it and does not do it. The hadd is not imposed on him. That is like a man who sits with a woman and desires to have haram intercourse with her and does not do it and he does not reach her. There is no hadd against that either.
