If the guardian is well-off, Let him claim no remuneration, but if he is poor, let him have for himself what is just and reasonable. When ye release their property to them, take witnesses in their presence: But all-sufficient is Allah in taking account.

SahihMuslim-017-001-17759		It has been narrated on the authority of Abdulrahman Bin Abd Rabb AlKaba who said: I entered the Masjid when Abdullah Bin Amr Bin AlAs was sitting in the shade of the Kaba and the people had gathered around him. I betook myself to them and sat near him. Now Abdullah said: I accompanied the Messenger of Allah ﷺ on a journey. We halted at a place. Some of us began to set right their tents; others began to compete with one another in shooting; and others began to graze their beasts; when an announcer of the Messenger of Allah ﷺ announced that the people should gather together for prayer; so we gathered around the Messenger of Allah ﷺ. He said: It was the duty of every Prophet that has gone before me to guide his followers to what he knew was good for them and warn them against what he knew was bad for them; but this Umma of yours has its days of peace and security in the beginning of its career; and in the last phase of its existence it will be afflicted with trials and with things disagreeable to you. In this phase of the Umma ; there will be tremendous trials one after the other; each making the previous one dwindle into insignificance. When they would be afflicted with a trial; the believer would say: This is going to bring about my destruction. When at the trial is over; they would be afflicted with another trial; and the believer would say: This surely is going to be my end. Whoever wishes to be delivered from the fire and enter the garden should die with faith in Allah and the Last Day and should treat the people as he wishes to be treated by them. He who swears allegiance to a Caliph should give him the piedge of his hand and the sincerity of his heart i. e. submit to him both outwardly as well as inwardly. He should obey him to the best of his capacity. It another man comes forward as a claimant to Caliphate ; disputing his authority; they the Muslims should behead the latter. The narrator says: I came close to him Abdullah Bin Amr Bin AlAs and said to him: Can you say on oath that you heard it from the Messenger of Allah ﷺ ? He pointed with his hands to his ears and his heart and said: My ears heard it and my mind retained it. I said to him: This cousin of yours; Muawiya; orders us to unjustly consume our wealth among ourselves and to kill one another; while Allah says: O ye who believe; do not consume your wealth among yourselves unjustly; unless it be trade based on mutual agreement; and do not kill yourselves. Verily; God is Merciful to you iv. 29. The narrator says that hearing this Abdullah Bin Amr Bin AlAs kept quiet for a while and then said: Obey him in so far as he is obedient to God; and diqobey him in matters involving disobedience to God. He the Holy Prophet replied: Associating anything with Allah; magic; killing of one whom God has declared inviolate without a just cause; consuming the property of an orphan; and consuming of usury; turning back when the army advances; and slandering chaste women who are believers; but unwary. SahihMuslim-017-001-21207		Abdullah reported: We were on the night of Friday staying in the Masjid when a person from the Ansar came there and said: If a person finds hiswoman along with a man; and he speaks about it; you would lash him; and if he kills; you will kill him; and if he keeps quiet he shall have to consume anger. By Allah; I will definitely ask about him from Allah Mescenger ﷺ. On the following day he came to Allah Messenger ﷺ and asked him thus: If a man were to find with his wife a man and if he were to talk about it; you would lash him; and if he killed; you would kill him; and if he were to keep quiet. he would consume anger; whereupon he the Holy Prophet said: Allah; solve this problem ; and he began to supplicate before Him ; and then the verses pertaining to lian were revealed: Those who accuse their wives and have no witnesses except themselves xxiv. 6. The person was then put to test according to these verses in the presence of the people. There came he and his wife in the presence of Allah Messenger ﷺ ; and they invoked curses in order to testify their claim. The man swore four times in the name of Allah that he was one of the truthful and then invoked curse for the fifth time saying: Let there be curse of Allah upon him if he were among the liars. Then she began to invoke curse. Allah Messenger ﷺ said to her: just wait and curse after considering over it ; but she refused and invoked curse and when she turned away; he Allah Apostle said: It seems that this woman shall give birth to a curly-haired black child; And so she did gave birth to a curly-haired black child. MuwataMalik-017-001-34921		Yahya said that he heard Malik say; What is done in our community about someone who consumed an animal without the permission of its owner; is that he must pay its price on the day he consumed it. He is not obliged to replace it with a similar animal nor does he compensate the owner with any kind of animal. He must pay its price on the day it was consumed; and giving the value is more equitable in compensation for animals and goods. Yahya said that he heard Malik say about someone who consumes some food without the permission of its owner; He returns to the owner a like weight of the same kind of food. Food is in the position of gold and silver. Gold and silver are returned with gold and silver. The animal is not in the position of gold in that. What distinguishes between them is the sunna and the behaviour which is in force. Yahya said that he heard Malik say; If a man is entrusted with some wealth and then trades with it for himself and makes a profit; the profit is his because he is responsible for the property until he returns it to its owner.
