For parents, a sixth share of the inheritance to each, if the deceased left children; if no children, and the parents are the (only) heirs, the mother has a third; if the deceased Left brothers (or sisters) the mother has a sixth. (The distribution in all cases ('s) after the payment of legacies and debts. Ye know not whether your parents or your children are nearest to you in benefit. These are settled portions ordained by Allah; and Allah is All-knowing, Al-wise. | |

We have made lawful to thee thy wives to whom thou hast paid their dowers; and those whom thy right hand possesses out of the prisoners of war whom Allah has assigned to thee; and daughters of thy paternal uncles and aunts, and daughters of thy maternal uncles and aunts, who migrated (from Makka) with thee; and any believing woman who dedicates her soul to the Prophet if the Prophet wishes to wed her;- this only for thee, and not for the Believers (at large); We know what We have appointed for them as to their wives and the captives whom their right hands possess;- in order that there should be no difficulty for thee. When the Prophet ﷺ entered Mecca and the time limit passed; the Meccans went to Ali and said; Tell your Friend i.e. the Prophet ﷺ to go out; as the period agreed to has passed. He said; Whoever is put to trial by these daughters and he treats them generously with benevolence then these daughters will act as a shield for him from Hell-Fire. SahihAlBukhari-017-001-6590 | Narrated AlBara: When the Prophet ﷺ went out for the Umra in the month of Dhal-Qada; the people of Mecca did not allow him to enter Mecca till he agreed to conclude a peace treaty with them by virtue of which he would stay in Mecca for three days only in the following year. When the agreement was being written; the Muslims wrote: This is the peace treaty; which Muhammad; Apostle of Allah has concluded. The infidels said to the Prophet ; We do not agree with you on this; for if we knew that you are Apostle of Allah we would not have prevented you for anything i.e. entering Mecca; etc. ; but you are Muhammad; the son of Abdullah. Then he said to Ali; Erase the name of Apostle of Allah. Ali said; No; by Allah; I will never erase you i.e. your name. Then Allah Messenger ﷺ took the writing sheet...and he did not know a better writing..and he wrote or got it the following written! This is the peace treaty which Muhammad; the son of Abdullah; has concluded: Muhammad should not bring arms into Mecca except sheathed swords; and should not take with him any person of the people of Mecca even if such a person wanted to follow him; and if any of his companions wants to stay in Mecca; he should not forbid him. In the next year when the Prophet ﷺ entered Mecca and the allowed period of stay elapsed; the infidels came to Ali and said Tell your companion Muhammad to go out; as the allowed period of his stay has finished. So the Prophet ﷺ departed from Mecca and the daughter of Hamza followed him shouting O Uncle; O Uncle! Ali took her by the hand and said to Fatima; Take the daughter of your uncle. So she made her ride on her horse. When they reached Medina Ali; Zaid and Jafar quarreled about her. Ali said; I took her for she is the daughter of my uncle. Jafar said; She is the daughter of my uncle and her aunt is my wife. Zaid said; She is the daughter of my brother. On that; the Prophet ﷺ gave her to her aunt and said; The aunt is of the same status as the mother. He then said to Ali; You are from me; and I am from you; and said to Jafar; You resemble me in appearance and character; and said to Zaid; You are our brother and our freed slave. SahihAlBukhari-017-001-7071 | Narrated Aisha: When there was said about me what was said which I myself was unaware of; Allah Messenger ﷺ got up and addressed the people. He recited Tashah-hud; and after glorifying and praising Allah as He deserved; he said; To proceed: O people Give me your opinion regarding those people who made a forged story against my wife. By Allah; I do not know anything bad about her. By Allah; they accused her of being with a man about whom I have never known anything bad; and he never entered my house unless I was present there; and whenever I went on a journey; he went with me. Saad Bin Muadh got up and said; O Allah Messenger ﷺ Allow me to chop their heads off. Then a man from the AlKhazraj Saad Bin Ubada to whom the mother of the poet Hassan Bin Thabit was a relative; got up and said to Saad Bin Muadh ; You have told a lie! By Allah; if those persons were from the Aus Tribe; you would not like to chop their heads off. It was probable that some evil would take place between the Aus and the Khazraj in the Masjid; and I was unaware of all that. In the evening of that day; I went out for some of my needs i.e. to relieve myself ; and Um Mistah was accompanying me. On our return; Um Mistah stumbled and said; Let Mistah. be ruined I said to her; O mother Why do you abuse your Son On that Um Mistah became silent for a while; and stumbling again; she said; Let Mistah be ruined I said to her; Why do you abuse your son? She stumbled for the third time and said; Let Mistah be ruined whereupon I rebuked her for that. She said; By Allah; I do not abuse him except because of you. I asked her; Concerning what of my affairs? So she disclosed the whole story to me. I said; Has this really happened? She replied; Yes; by Allah. I returned to my house; astonished and distressed that I did not know for what purpose I had gone out. Then I became sick fever and said to Allah Messenger ﷺ Send me to my father house. So he sent a slave with me; and when I entered the house; I found Um Rum-an my mother downstairs while my father Abu Bakr was reciting something upstairs. My mother asked; What has brought you; O my daughter? I informed her and mentioned to her the whole story; but she did not feel it as I did. She said; O my daughter! Take it easy; for there is never a charming lady loved by her husband who has other wives but that they feel jealous of her and speak badly of her. But she did not feel the news as I did. I asked her ; Does my father know about it? She said; yes I asked; Does Allah Messenger ﷺ know about it too? She said; Yes; Allah Messenger ﷺ does too. So the tears filled my eyes and I wept. Abu Bakr; who was reading upstairs heard my voice and came down and asked my mother; What is the matter with her? She said; She has heard what has been said about her as regards the story of Allfk. On that Abu Bakr wept and said; I beseech you by Allah; O my daughter; to go back to your home. I went back to my home and Allah Messenger ﷺ had come to my house and asked my maid-servant about me my character. The maid-servant said; By Allah; I do not know of any defect in her character except that she sleeps and let the sheep enter her house and eat her dough. On that; some of the Prophet companions spoke harshly to her and said; Tell the truth to Allah Messenger ﷺ. Finally they told her of the affair of the slander. She said; Subhan Allah! By Allah; I know nothing against her except what goldsmith knows about a piece of pure gold. Then this news reached the man who was accused; and he said; Subhan Allah! By Allah; I have never uncovered the private parts of any woman. Later that man was martyred in Allah Cause. Next morning my parents came to pay me a visit and they stayed with me till Allah Messenger ﷺ came to me after he had offered the Asr prayer. He came to me while my parents were sitting around me on my right and my left. He praised and glorified Allah and said; Now then O Aisha! If you have committed a bad deed or you have wronged yourself ; then repent to Allah as Allah accepts the repentance from his slaves. An AlAnsari woman had come and was sitting near the gate. I said to the Prophet. Isnt it improper that you speak in such a way in the presence of this lady? Allah Apostle then gave a piece of advice and I turned to my father and requested him to answer him on my behalf. My father said; What should I say? Then I turned to my mother and asked her to answer him. She said; What should I say? When my parents did not give a reply to the Prophet; I said; I testify that none has the right to be worshipped except Allah; and that Muhammad is His Apostle! And after praising and glorifying Allah as He deserves; I said; Now then; by Allah; if I were to tell you that I have not done this evil action and Allah is a witness that I am telling the truth; that would not be of any use to me on your part because you people have spoken about it and your hearts have absorbed it; and if I were to tell you that I have done this sin and Allah knows that I have not done it; then you will say; She has confessed herself guilty. By Allah; I do not see a suitable example for me and you but the example of I tried to remember Jacob name but couldnt Joseph father when he said; So for me Patience is most fitting against that which you assert. It is Allah alone whose help can be sought. At that very hour the Divine Inspiration came to Allah Messenger ﷺ and we remained silent. Then the Inspiration was over and I noticed the signs of happiness on his face while he was removing the sweat from his forehead and saying; Have the good tidings O Aisha! Allah has revealed your innocence. At that time I was extremely angry. My parents said to me. Get up and go to him. I said; By Allah; I will not do it and will not thank him nor thank either of you; but I will thank Allah Who has revealed my innocence. You have heard this story but neither did not deny it nor change it to defend me ; Aisha used to say: But as regards Zainab bint Jahsh; the Prophet wife ; Allah protected her because of her piety; so she did not say anything except good about me ; but her sister; Hamna; was ruined among those who were ruined. Those who used to speak evil about me were Mistah; Hassan Bin Thabit; and the hypocrite; Abdullah Bin Ubai; who used to spread that news and tempt others to speak of it; and it was he and Hamna who had the greater share therein. Abu Bakr took an oath that he would never do any favor to Mistah at all. Then Allah revealed the Divine Verse: Let not those among you who are good and wealthy i.e. Abu Bakr swear not to give any sort of help to their kinsmen; and those in need; i.e. Mistah...Do you not love that Allah should forgive you? And Allah is Oft-Forgiving; Most Merciful. 24.22 On that; Abu Bakr said; Yes; by Allah; O our Lord! We wish that You should forgive us. SahihAlBukhari-017-001-7224 | Narrated Ibn Abbas: For the whole year I had the desire to ask Umar Bin AlKhattab regarding the explanation of a Verse in Surat AlTahrim but I could not ask him because I respected him very much. When he went to perform the Hajj; I too went along with him. On our return; while we were still on the way home. Umar went Aasi de to answer the call of nature by the Arak trees. I waited till he finished and then I proceeded with him and asked him. O chief of the Believers! Who were the two wives of the Prophet ﷺ who aided one another against him? He said; They were Hafsa and Aisha. Then I said to him; By Allah; I wanted to ask you about this a year ago; but I could not do so owing to my respect for you. Umar said; Do not refrain from asking me. If you think that I have knowledge about a certain matter ; ask me; and if I know something about it ; I will tell you. Then Umar added; By Allah; in the Pre-lslamic Period of Ignorance we did not pay attention to women until Allah revealed regarding them what He revealed regarding them and assigned for them what He has assigned. Once while I was thinking over a certain matter; my wife said; I recommend that you do so-and-so. I said to her; What have you got to do with the is matter? Why do you poke your nose in a matter which I want to see fulfilled.? She said; How strange you are; O son of AlKhattab! You dont want to be argued with whereas your daughter; Hafsa surely; argues with Allah Messenger ﷺ so much that he remains angry for a full day! Umar then reported; how he at once put on his outer garment and went to Hafsa and said to her; O my daughter! Do you argue with Allah Messenger ﷺ so that he remains angry the whole day? H. afsa said; By Allah; we argue with him. Umar said; Know that I warn you of Allah punishment and the anger of Allah Messenger ﷺ... O my daughter! Dont be betrayed by the one who is proud of her beauty because of the love of Allah Messenger ﷺ for her i.e. Aisha. Umar addled; Then I went out to Umm Salamah house who was one of my relatives; and I talked to her. She said; O son of AlKhattab! It is rather astonishing that you interfere in everything; you even want to interfere between Allah Apostle and his wives! By Allah; by her talk she influenced me so much that I lost some of my anger. I left her and went home. At that time I had a friend from the Ansar who used to bring news from the Prophet in case of my absence; and I used to bring him the news if he was absent. In those days we were afraid of one of the kings of Ghassan tribe. We heard that he intended to move and attack us; so fear filled our hearts because of that. One day my Ansari friend unexpectedly knocked at my door; and said; Open Open! I said; Has the king of Ghassan come? He said; No; but something worse; Allah Messenger ﷺ has isolated himself from his wives. I said; Let the nose of Aisha and Hafsa be stuck to dust i.e. humiliated ! Then I put on my clothes and went to Allah Messenger ﷺ residence; and behold; he was staying in an upper room of his to which he ascended by a ladder; and a black slave of Allah Messenger ﷺ was sitting on the first step. I said to him; Say to the Prophet ﷺ Umar Bin AlKhattab is here. Then the Prophet ﷺ admitted me and I narrated the story to Allah Messenger ﷺ. When I reached the story of Umm Salamah ; Allah Messenger ﷺ smiled while he was lying on a mat made of palm tree leaves with nothing between him and the mat. Underneath his head there was a leather pillow stuffed with palm fibres; and leaves of a saut tree were piled at his feet; and above his head hung a few water skins. On seeing the marks of the mat imprinted on his side; I wept. He said. Why are you weeping? I replied; O Allah Messenger ﷺ ! Caesar and Khosrau are leading the life i.e. Luxurious life while you; Allah Messenger ﷺ though you are; is living in destitute. The Prophet ﷺ then replied. As he came back and we were on the way he stepped Aasi de towards an Arak tree to ease himself. I waited for him until he was free. I then walked along with him and said: Commander of the Faithful; who are the two among the wives of Allah Messenger ﷺ who backed up one another in their demand for extra money ? He said: They were Hafsa and Aisha Allah be pleased with them. I said to him: It is for one year that I intended to ask you about this matter but I could not date so on account of the awe for you. He said: Dont do that. If you think that I have any knowledge; do ask me about that. And if I were to know that; I would inform you. He the narrator stated that Umar had said: By Allah; during the days of ignorance we had no regard for women until Allah the Exalt- ed revealed about them what He has revealed; and appointed turn for them what he appointed. He said: It so happened that I was thinking about some matter that my wife said: I wish you had done that and that. I said to her: It does not concern you and you should not feel disturbed in a matter which I intend to do. She said to me: How strange is it that you; O son of AlKhattab; do not like anyone to retort upon you; whereas your daughter retorts upon Allah Messenger may peace be upou him until he spends the day in vexation. Umar said: I took hold of my cloak; then came out of my house until I visited Hafsa and said to her: O daughter; I heard that you retort upon Allah Messenger ﷺ until he spends the day in vexation; whereupon Hafsa said: By Allah; we do retort upon him. I said: You should bear in mind; my daughter; that I warn you against the punishment of Allah and the wrath of His Messenger ﷺ. You may not be misled by one whose beauty has fascinated her; and the love of Allah Messenger ﷺ for her. I Umar then visited Umm Salamah because of my relationship with her and I talked to her. Umm Salamah said to me: Umar Bin AlKhattab; how strange is it that you meddle with every matter so much so that you are anxious to interfere between Allah Messenger ﷺ and his wives; and this perturbed me so much that I refrained from saying what I had to say; so I came out of her apartment; and I had a friend from the Anar. When I had been absent from the company of the Holy Prophet he used to bring me the news and when he had been absent I used to bring him the news; and at that time we dreaded a king of Ghassan. It was mentioned to us that he intended to attack us; and our minds were haunted by him. My friend; the Ansari; came to me; and he knocked at the door and said: Open it; open it. I said: Has the Ghassani come? He said: The matter is more serious than that. The Messenger of Allah ﷺ has separated himself from his wives. I said: Let the nose of Hafsa and Aisha be besmeared with dust. I then took hold of my cloth and went out until I came and found Allah Messenger ﷺ in his attic to which he climbed by means of a ladder made of date-palm; and the servant of Allah Messenger ﷺ who was black had been sitting at the end of the ladder. I said: This is Umar. So permission was granted to me. I narrated this news to Allah Messenger ﷺ and as I narrated the news concerning Umm Salamah; Allah Messenger ﷺ smiled. He was lying on the mat and there was nothing between him and that mat ; and under his head there was a pillow made of leather and it was stuffed with plam fibres and at his feet were lying a heap of sant tree acacia niloctica; meant for dyeing and near his head there was hanging a hide. And I saw the marks of the maton the side of Allah Messenger ﷺ ; and so I wept. He said: What makes you weep? I said: Messenger of Allah; the Khusrau and the Ceasars spendd their lives in the midst of luxuries ; whereas you being Allah Messenger are leading your life in this poverty. Ali Bin Abu Talib said: Dont do that; by Allah he the Holy Prophet would not do that would not accept your request. Rabia Bin Harith turned to him and said: By Allah; you are not doing so but out of jealousy that you nurse against us By Allah; you became the son-in-law of the Messenger of Allah ﷺ but we felt no jealousy against you for this great privilege of yours. Ali then said: Send them if you like. They set out and Ali lay on the bed. When the Messenger of Allah ﷺ offered the noon prayer. we went ahead of him to his apartment and stood near it till he came out. He took hold of our ears out of love and affection and then said: Give out what you have kept in your hearts. He then entered the apartment and we also went in and he the Holy Prophet was on that day in the house of Zainab Bin jahsh. We urged each of us to speak. Then one of us thus spoke: Messenger of Allah; you are the best of humanity and the best to cement the ties of blood-relations. We have reached the-marriageable age. We have come to you so that you may appoint us as collectors of these sadaqat. and we would pay you just as thin people other collectors pay you; and get our share as others get it. He the Holy Prophet kept silence for a long time till we wished that we should speak with him again ; and Zainab pointied to us from behind the curtain not to talk any more. He the Holy Prophet said; It does not become the family of Muhammad to accept sadaqat for they are the impurities of people. You call to me Mahmiya and he was in charge of khums; i. e; of the one-fifth part that goes to the treasury out of the spoils of war ; and Nawfal Bin Harith Bin Abd AlMuttalib. They both came to him; and he the Holy Prophet said to Mahmiya: Marry your daughter to this young man i. e. Fadl Bin Abbas ; and he married her to him And he said to Nawfal Bin Harith: Marry your daughter to this young man i e. SunanAbuDawoud-017-001-24900 | Aisha wife of the Prophet ﷺ and Umm Salamah said Abu Hudaifah Bin Utbah Bin Rabiah Bin Abd Shams adopted Salim as his son and married him to his niece Hind; daughter of AlWalid Bin Utbah Bin Rabiah. He Salim was the freed slave of a woman from the Ansar the Helpers as the Apostle of Allaah ﷺ adopted Zaid as his son. In pre Islamic days when anyone adopted a man as his son; the people called him by his name and he was given a share from his inheritance. Allaah; the Exalted; revealed about this matter Call them by the name of their fathers; that is juster in the sight of Allaah. And if ye know not their fathers; then they are your brethren in the faith and your clients. They were then called by their names of their fathers. A man; whose father was not known; remained under the protection of someone and considered brother in faith. Sahlah daughter of Suhail Bin Amr AlQuraishi then came and said Apostle of Allaah ﷺ ; we used to consider Salim our son. He dwelled with me and Abu Hudhaifah in the same house; and he saw me in the short clothes; but Allaah the Exalted; has revealed about them what you know; then what is your opinion about him? The Prophet ﷺ said give him your breast feed. She gave him five breast feeds. He then became like her foster son. Hence; Aisha may Allaah be pleased with her used to ask the daughters of her sisters and the daughters of her brethren to give him breast feed five times; whom Aisha wanted to see and who wanted to visit her. Though he might be of age; he then visited her. But Umm Salamah and all other wives of the Prophet ﷺ refused to allow anyone to visit them on the basis of such breast feeding unless one was given breast feed during infancy. Messenger of Allah; you are the kindest of the people and the most skilled in matchmaking. Our fathers have nothing with which to pay our dower. So appoint us collector of sadaqah zakat ; Messenger of Allah; and we shall give you what the other collectors give you; and we shall have the benefit accruing from it. Ali came to us while we were in this condition. He said: The Messenger of Allah ﷺ said: No; I swear by Allah; he will not appoint any of you collector of sadaqah zakat. Rabiah said to him: This is your condition; you have gained your relationship with the Messenger of Allah ﷺ by marriage; but we did not grudge you that. Ali then put his cloak on the earth and lay on it. He then said: I am the father ofHassan the chief. AbdulMuttalib said: So I and AlFadl went towards the door of the apartment of the Prophet ﷺ. We found that the noon prayer in congregation had already started. So we prayed along with the people. He caught my ear and the ear of AlFadl. He then said: Reveal what you conceal in your hearts. He then entered and permitted me and AlFadl to enter. Yahya said that he heard Malik say; The generally agreed-on way of doing things in our community in the case of someone who gives his son a gift or grants him a gift which is not sadaqa is that he can take it back as long as the child does not start a debt; which people claim from him; and which they trust him for on the strength of the gift his father has given him. The father cannot take back anything from the gift after debts are started against it. Malik said; The woman who is the furthest relation of the deceased of those who were named in this book; does not inherit anything by her kinship; and women do not inherit anything apart from those that are named in the Quran. MuwataMalik-017-001-35157 | Yahya related to me from Malik from Rabia Ibn Abi Abdulrahman from more than one of the people of knowledge of that time; that those who were killed on the Day of the Camel; the Day of Siffin; the Day of AlHarra; and the Day of Qudayd did not inherit from each other. None of them inherited anything from his companion unless it was known that he had been killed before his companion. Malik said; That is the way of doing things about which there is no dispute; and which none of the people of knowledge in our city doubt. The procedure with two mutual heirs who are drowned; or killed in another way; when it is not known which of them died first is the same - neither of them inherits anything from his companion. Their inheritance goes to whoever remains of their heirs. They are inherited from by the living. Malik said; No one should inherit from anyone else when there is doubt; and one should only inherit from the other when there is certainty of knowledge and witnesses. That is because a man and his mawla whom his father has freed might die at the same time. The sons of the free man could say; Our father inherited from the mawla. They should not inherit from the mawla without knowledge or testimony that he died first. The living people most entitled to his wala inherit from him. Malik said; Another example is two full brothers who die. One of them has children and the other does not. They have a half-brother by their father. It is not known which of them died first; so the inheritance of the childless one goes to his half-brother by the father. The children of the full-brother get nothing. Malik said; Another example is when a paternal aunt and the son of her brother die; or else the daughter of the brother and her paternal uncle. It is not known which of them died first. MuwataMalik-017-001-35328 | Yahya related to me from Malik from more than one source that when Abdullah Ibn Masud was in Kufa; he was asked for an opinion about marrying the mother after marrying the daughter when the marriage with the daughter had not been consummated. He permitted it. When Ibn Masud came to Madina; he asked about it and was told that it was not as he had said; and that this condition referred to foster-mothers. Ibn Masud returnedto Kufa;and he had just reached his dwelling when the man who had asked him for the opinion came to visit and he ordered him to separate from his wife. Malik said that if a man married the mother of a woman who was his wife and he had sexual relations with the mother then his wife was haram for him; and he had to separate from both of them. They were both haram to him forever; if he had had sexual relations with the mother. If he had not had relations with the mcther; his wife was not haram for him; and he separated from the mother. Malik explained further about the man who married a woman; and then married her mother and cohabited with her; The mother will never be halal for him; and she is not halal for his father or his son; and any daughters of hers are not halal for him and so his wife is haram for him. Malik said; Fornication however; does not make any of that haram because Allah; the Blessed; the Exalted; mentioned the mothers of your wives; as one whom marriage made haram; and he didnt mention the making haram by fornication. Every marriage in a halal manner in which a man cohabits with his wife; is a halal marriage. MuwataMalik-017-001-35329 | Malik said that a man who had committed fornication with a woman and the hadd-punishment had been applied to him for it; could marry that woman daughter and his son could marry the woman herself if he wished. That was because he had haram relations with her; and the relations Allah had made haram were from the relations made in a halal manner or in a manner resembling marriage. Allah; the Blessed; the Exalted; said; Do not marry the women your fathers have married. Surat 4 ayat 21 Malik said; If a man were to marry a woman in her idda-period in a halal marriage and have relations with her; it would be haram for his son to marry the woman. That is because the father married her in a halal manner; and the hadd-punishment would not have been applied to him. Any child who was born to him would be attached to him as the father.
