If it is a man that dies, leaving a sister but no child, she shall have half the inheritance: If (such a deceased was) a woman, who left no child, Her brother takes her inheritance: If there are two sisters, they shall have two-thirds of the inheritance (between them): if there are brothers and sisters, (they share), the male having twice the share of the female. Thus doth Allah make clear to you (His law), lest ye err. And Allah hath knowledge of all things. | |

How can you fight these people although Allah Messenger ﷺ said; I have been ordered to fight the people till they say: None has the right to be worshipped but Allah; and whoever said; None has the right to be worshipped but Allah; Allah will save his property and his life from me; unless he does something for which he receives legal punishment justly; and his account will be with Allah? Abu Bakr said; By Allah! I will fight whoever differentiates between prayers and Zakat as Zakat is the right to be taken from property according to Allah Orders. By Allah! If they refused to pay me even a kid they used to pay to Allah Messenger ﷺ ; I would fight with them for withholding it. SahihAlBukhari-017-001-3231 | Narrated Malik Bin Aus Bin AlHadathan: Once I set out to visit Umar bin AlKhattab. While I was sitting there with him his gate-keeper; Yarfa; came and said; Uthman Abdulrahman bin Auf ; AlZubair and Saad bin Abi Waqqas are seeking permission to meet you. Umar said; Yes. So he admitted them and they entered; greeted; and sat down. After a short while Yarfa came again and said to Umar Shall I admit Ali and Abbas? Umar said; Yes. He admitted them and when they entered; they greeted and sat down. Abbas said; O Chief of the Believers! Judge between me and this Ali. The group; Uthman and his companions Sad; O Chief of the Believers! Judge between them and relieve one from the other. Umar said. Wait! I beseech you by Allah; by Whose permission both the Heaven and the Earth stand fast ! Do you know that Allah Messenger ﷺ said. We Apostles do not bequeath anything to our heirs; but whatever we leave is to be given in charity. And by that Allah Messenger ﷺ s meant himself? The group said; He did say so. Umar then turned towards All and Abbas and said. I beseech you both by Allah; do you know that Allah Messenger ﷺ said that? They said; Yes Umar said; Now; let me talk to you about this matter. Allah favored His Apostle with something of this property war booty which He did not give to anybody else. And Allah said:- And what Allah has bestowed on His Apostle as Fai Booty from them for which you made no expedition with either cavalry or camelry... Allah is Able to do all things. 59.6 So this property was especially granted to Allah Messenger ﷺ. But by Allah he neither withheld it from you; nor did he keep it for himself and deprive you of it; but he gave it all to you and distributed it among you till only this remained out of it. And out of this property Allah Messenger ﷺ used to provide his family with their yearly needs; and whatever remained; he would spend where Allah Property the revenues of Zakat used to be spent. Allah Messenger ﷺ kept on acting like this throughout his lifetime. Now I beseech you by Allah; do you know that? They said; Yes. Then Umar said to Ali and Abbas; I beseech you by Allah; do you both know that? They said; Yes. Umar added; When Allah had taken His Apostle unto Him; Abu Bakr said; I am the successor of Allah Messenger ﷺ. So he took charge of that property and did with it the same what Allah Messenger ﷺ used to do; and both of you knew all about it then. Then Umar turned towards Ali and Abbas and said; You both claim that Abu Bakr was so-and-so! But Allah knows that he was honest; sincere; pious and right in that matter. Then Allah caused Abu Bakr to die; and I said; I am the successor of Allah Messenger ﷺ and Abu Bakr. So I kept this property in my possession for the first two years of my rule; and I used to do the same with it as Allah Messenger ﷺ and Abu Bakr used to do. Later both of you Ali and Abbas came to me with the same claim and the same problem. O Abbas! You came to me demanding your share from the inheritance of the son of your brother; and he Ali came to me demanding his wives share from the inheritance of her father. So I said to you; If you wish I will hand over this property to you; on condition that you both promise me before Allah that you will manage it in the same way as Allah Messenger ﷺ and Abu Bakr did; and as I have done since the beginning of my rule; otherwise you should not speak to me about it. So you both said; Hand over this property to us on this condition. And on this condition I handed it over to you. I beseech you by Allah; did I hand it over to them on that condition? The group said; Yes. Umar then faced Ali and Abbas and said; I beseech you both by Allah; did I hand it over to you both on that condition? They both said; Yes. Umar added; Do you want me now to give a decision other than that? By Him with Whose permission order both the Heaven and the Earth stand fast; I will never give any decision other than that till the Hour is established! SahihAlBukhari-017-001-6386 | Narrated Malik Bin Aus AlHadathan AlNasri: That once Umar Bin AlKhattab called him and while he was sitting with him; his gatekeeper; Yarfa came and said; Will you admit Uthman; Abdulrahman Bin Auf; AlZubair and Saad bin Abi Waqqas who are waiting for your permission? Umar said; Yes; let them come in. After a while; Yarfa- came again and said; Will you admit Ali and Abbas who are asking your permission? Umar said; Yes. So; when the two entered; Abbas said; O chief of the believers! Judge between me and this i.e. Ali. Both of them had a dispute regarding the property of Bani AlNadir which Allah had given to His Apostle as Fai i.e. booty gained without fighting ; Ali and Abbas started reproaching each other. The present people i.e. Uthman and his companions said; O chief of the believers! Give your verdict in their case and relieve each from the other. Umar said; Wait I beseech you; by Allah; by Whose Permission both the heaven and the earth stand fast! Do you know that Allah Messenger ﷺ said; We Prophets our properties are not to be inherited; and whatever we leave; is to be spent in charity; and he said it about himself? They i.e. Uthman and his company said; He did say it. Umar then turned towards Ali and Abbas and said; I beseech you both; by Allah! Do you know that Allah Messenger ﷺ said this? They replied in the affirmative. He said; Now I am talking to you about this matter. Allah the Glorified favored His Apostle with something of this Fai i.e. booty won without fighting which He did not give to anybody else. Allah said:- And what Allah gave to His Apostle Fai Booty from them-For which you made no expedition With either Calvary or camelry. But Allah gives power to His Apostles Over whomsoever He will And Allah is able to do all things. 59.6 So this property was especially granted to Allah Messenger ﷺ. But by Allah; the Prophet ﷺ neither took it all for himself only; nor deprived you of it; but he gave it to all of you and distributed it amongst you till only this remained out of it. And from this Allah Messenger ﷺ used to spend the yearly maintenance for his family; and whatever used to remain; he used to spend it where Allah Property is spent i.e. in charity ; Allah Messenger ﷺ kept on acting like that during all his life; Then he died; and Abu Bakr said; I am the successor of Allah Messenger ﷺ. So he i.e. Abu Bakr took charge of this property and disposed of it in the same manner as Allah Messenger ﷺ used to do; and all of you at that time knew all about it. Then Umar turned towards Ali and Abbas and said; You both remember that Abu Bakr disposed of it in the way you have described and Allah knows that; in that matter; he was sincere; pious; rightly guided and the follower of the right. Then Allah caused Abu Bakr to die and I said; I am the successor of Allah Messenger ﷺ and Abu Bakr. So I kept this property in my possession for the first two years of my rule i.e. Caliphate and I used to dispose of it in the same wa as Allah Messenger ﷺ and Abu Bakr used to do; and Allah knows that I have been sincere; pious; rightly guided an the follower of the right in this matte Later on both of you i.e. Ali and Abbas came to me; and the claim of you both was one and the same; O Abbas! You also came to me. So I told you both that Allah Messenger ﷺ said; Our property is not inherited; but whatever we leave is to be given in charity. Then when I thought that I should better hand over this property to you both or the condition that you will promise and pledge before Allah that you will dispose it off in the same way as Allah Messenger ﷺ and Abu Bakr did and as I have done since the beginning of my caliphate or else you should not speak to me about it. So; both of you said to me; Hand it over to us on this condition. And on this condition I handed it over to you. Do you want me now to give a decision other than that decision ? By Allah; with Whose Permission both the sky and the earth stand fast; I will never give any decision other than that decision till the Last Hour is established. But if you are unable to manage it i.e. that property ; then return it to me; and I will manage on your behalf. The sub-narrator said; I told Urwa Bin AlZubair of this Hadith and he said; Malik Bin Aus has told the truth I heard Aisha; the wife of the Prophet ﷺ saying; The wives of the Prophet ﷺ sent Uthman to Abu Bakr demanding from him their 1/8 of the Fai which Allah had granted to his Apostle. But I used to oppose them and say to them: Will you not fear Allah? Dont you know that the Prophet used to say: Our property is not inherited; but whatever we leave is to be given in charity? The Prophet ﷺ mentioned that regarding himself. He added: The family of Muhammad can take their sustenance from this property. So the wives of the Prophet ﷺ stopped demanding it when I told them of that. So; this property of Sadaqa was in the hands of Ali who withheld it from Abbas and overpowered him. SahihMuslim-017-001-18059 | It has been narrated on the authority of Abu Saeed AlKhudri who said: The people of Quraidha surrendered accepting the decision of Saad Bin Muadh about them. Accordingly; the Messenger of Allah ﷺ sent for Saad who came to him riding a donkey. When he approached the Masjid; the Messenger of Allah ﷺ said to the Ansar: Stand up to receive your chieftain. Then he said to Sad : These people have surrendered accepting your decision. He Sad said: You will kill their fighters and capture their women and children. Hearing this ; the Propbot may peace he tpon him said: You have adjudged by the command of God. The narrator is reported to have said: Perhaps he said: You have adjuged by the decision of a king. The people continued to visit him for a month or visited him many times the narrator was not sure. He said: In this matter I hold the opinion that she should receive the type of dower given to women of her class with no diminution or excess; observe the waiting period iddah and have her share of inheritance. If it is erroneous; that is from me and from Satan. Allah and His Apostle are free from its responsibility. Some people from Ashja got up; among them were AlJarrah and Abu Sinan. SunanAbuDawoud-017-001-25114 | Rabah said: My people married me to a Roman slave-girl of theirs. I had intercourse with her; and she gave birth to a black male child like me. I named it Abdullah. I again had intercourse with her; and she gave birth to a black male child like me. I named it Ubaydullah. Then a Roman slave of my people; called Yuhannah; incited her; and spoke to her in his own unintelligible language. She gave birth to a son like a chameleon red. I asked her: What is this? She replied: This belongs to Yuhannah. We then brought the case to Uthman for a decision. I think Mahdi said these words. He inquired from both of them; and they acknowledged the facts. SunanAbuDawoud-017-001-26550 | Abu Burdah said on the authority of Abu Mousa : I went to the Prophet ﷺ while two men who were Ash arIs were with me. One of them was on my right and the other on my left side. Bothe of them asked him for employment. The prophet ﷺ was silent. He asked : What do you say Abu Mousa; or Abdullah Bin Qais Abu Mousas name ? I replied: By him who has sent you with truth; they did not inform me of what they had in their hearts; and I did not know that they would ask for an employment. He said : I have the scene before my eyes that he had his toothstick below his lip which receded. He the prophet said: We will never or will not put in charge of our work anyone who asks for it. But go; ye; Abu Mousa; or Abdullah Bin Qais. He then sent him as a Governor of the Yemen; After him he sent Muadh Bin Jabal. When Muadh came to him; he said: come down ; and he put a cushion for him. He saw that a man was chained with him. He asked : What is this? He replied: He was a Jew and he accepted Islam. He then converted to his religion; an evil religion. He said: I will not sit until he is killed according to the decision of Allah and his Apostle ﷺ. He said: Yes; be seated. He said: I will not sit until he is killed according to the decision of Allah and his Apostle ﷺ. He said it three times. He then commanded for it and he was killed. Both of them then discussed the question of prayer and vigilance at night. They came to AlNuman and said: You have set them free without beating and investigation. AlNuman said: What do you want? You want me to beat them. If your goods are found with them; then it is all right; otherwise; I shall take retaliation from your back as I have taken from their backs. They asked: Is this your decision? SunanAbuDawoud-017-001-28702 | Narrated AbulWadi: We fought one of our battle; and encamped at a certain place. One of our companions sold a horse for a slave. After that they remained there for the rest of day and night. When the next morning came; they prepared themselves for departure. The buyer of the horse began to saddle it; but the seller was ashamed of the transaction. He went to the man buyer and asked him to annul the transaction. The man refused to hand it over the horse to him. He said: Abu Barzah; the companion of the Prophet ﷺ ; is to decide between me and you. They went to Abu Barzah in the corner of the army. They related this story to him. He said: Do you agree that I make a decision between you on the basis of the decision of the Messenger of Allah ﷺ ? The Messenger of Allah ﷺ said: Both parties in a business transaction have an option right to annul it so long as they have not separated. SunanAbuDawoud-017-001-28938 | Narrated Amr Bin Suhaib: On his father authority; said that his grandfather reported: Rabab Ibn Hudhayfah married a woman and three sons were born to him from her. Their mother then died. They inherited her houses and had the right of inheritance of her freed slaves. Amr Ibn AlAs was the agnate of her sons. He sent them to Syria where they died. Amr Ibn AlAs then came. A freed slave of hers died and left some property. Her brothers disputed with him and brought the case to Umar Ibn AlKhattab. Umar reported the Messenger of Allah ﷺ as saying: Whatever property a son or a father receives as an heir will go to his agnates; whoever they may be. He then wrote a document for him; witnessed by Abdulrahman Ibn Awuf ; Zayd Ibn Thabit and one other person. When AbdulMalik became caliph; they presented the case to Hisham Ibn Ismail or Ismail Ibn Hisham the narrator is doubtful. He sent them to Abd AlMalik who said: This is the decision which I have already seen.
