SahihAlBukhari-017-001-2402 | Narrated Abdullah Bin Abbas: Umar Bin AlKhattab departed for Sham and when he reached Sargh; the commanders of the Muslim army; Abu Ubaida Bin AlJarrah and his companions met him and told him that an epidemic had broken out in Sham. Umar said; Call for me the early emigrants. So Umar called them; consulted them and informed them that an epidemic had broken out in Sham. Those people differed in their opinions. Some of them said; We have come out for a purpose and we do not think that it is proper to give it up; while others said to Umar ; You have along with you. other people and the companions of Allah Messenger ﷺ so do not advise that we take them to this epidemic. Umar said to them; Leave me now. Then he said; Call the Ansar for me. I called them and he consulted them and they followed the way of the emigrants and differed as they did. He then said to them; Leave me now; and added; Call for me the old people of Quraish who emigrated in the year of the Conquest of Mecca. I called them and they gave a unanimous opinion saying; We advise that you should return with the people and do not take them to that place of epidemic. So Umar made an announcement; I will ride back to Medina in the morning; so you should do the same. Abu Ubaida Bin AlJarrah said to Umar ; Are you running away from what Allah had ordained? Umar said; Would that someone else had said such a thing; O Abu Ubaida! Yes; we are running from what Allah had ordained to what Allah has ordained. Dont you agree that if you had camels that went down a valley having two places; one green and the other dry; you would graze them on the green one only if Allah had ordained that; and you would graze them on the dry one only if Allah had ordained that? At that time Abdulrahman Bin Auf; who had been absent because of some job; came and said; I have some knowledge about this. I have heard Allah Messenger ﷺ saying; If you hear about it an outbreak of plague in a land; do not go to it; but if plague breaks out in a country where you are staying; do not run away from it. SahihMuslim-017-001-21298 | Saeed Bin AlMusayib said that Allah Messenger ﷺ forbade the transaction of Af Muzabana and Muhaqala. Muzabana means that fresh dates on the trees should be sold against dry dates. Muhaqala implies that the wheat in the ear should be sold against the wheat and getting the land on rent for the wheat produced in it. He the narrator said that the Prophet ﷺ had aid: Do not sell fresh fruits on the trees until their good condition becomes manifest; and do not sell fresh dates on the trees against dry dates. All of you are sinners except whom I have pardoned; so whoever among you knows that I am the One able to forgive; and seeks My forgiveness; I shall forgive him; without concern for Me and it will not affect Me. If the first of you and the last of you; the living among you and the dead among you; the fresh among you and the dry among you were to gather together to help the heart with the most Taqwa among My slaves; that would not add a mosquito wing to My sovereignty. If the first of you and the last of you; the living among you and the dead among you; the fresh among you and the dry among you were to gather together to help the worst heart of My slaves; that would not diminish a mosquito wing to My sovereignty. ll forgive him; without concern for Me and it will not affect Me. If the first of you and the last of you; the living among you and the dead among you; the fresh among you and the dry among you were to gather together upon one plateau; and each person among them were to ask for his utmost desire; and I were to give each what he asked for; that would not diminish from My sovereignty; except as if one of you were to pass by an ocean and dip a needle into it and then remove it. MuwataMalik-017-001-35059 | Malik said; The generally agreed on way of doing things among us is that some one who buys some fruit; fresh or dry; should not resell it until he gets full possession of it. He should not barter things of the same type; except hand to hand. Whatever can be made into dry fruit to be stored and eaten; should not be bartered for its own kind; except hand to hand; like for like; when it is the same kind of fruit. In the case of two different kinds of fruit; there is no harm in bartering two of one kind for one of another; hand to hand on the spot. It is not good to set delayed terms. As for produce which is not dried and stored but is eaten fresh like water melon; cucumber; melon; carrots; citron; medlars; pomegranates; and soon; which when dried no longer counts as fruit; and is not a thing which is stored up as is fruit; I think that it is quite proper to barter such things two for one of the same variety hand to hand.
