Have we no intercessors now to intercede on our behalf? Or could we be sent back? then should we behave differently from our behaviour in the past." In fact they will have lost their souls, and the things they invented will leave them in the lurch. | |

Thou didst say to one who had received the grace of Allah and thy favour: "Retain thou (in wedlock) thy wife, and fear Allah." But thou didst hide in thy heart that which Allah was about to make manifest: thou didst fear the people, but it is more fitting that thou shouldst fear Allah. Then when Zaid had dissolved (his marriage) with her, with the necessary (formality), We joined her in marriage to thee: in order that (in future) there may be no difficulty to the Believers in (the matter of) marriage with the wives of their adopted sons, when the latter have dissolved with the necessary (formality) (their marriage) with them. SahihAlBukhari-017-001-1356 | Narrated Hudhaifa: Allah Messenger ﷺ related to us; two prophetic narrations one of which I have seen fulfilled and I am waiting for the fulfillment of the other. The Prophet ﷺ told us that the virtue of honesty descended in the roots of men hearts from Allah and then they learned it from the Quran and then they learned it from the Sunna the Prophet traditions. The Prophet ﷺ further told us how that honesty will be taken away: He said: Man will go to sleep during which honesty will be taken away from his heart and only its trace will remain in his heart like the trace of a dark spot; then man will go to sleep; during which honesty will decrease further still; so that its trace will resemble the trace of blister as when an ember is dropped on one foot which would make it swell; and one would see it swollen but there would be nothing inside. People would be carrying out their trade but hardly will there be a trustworthy person. It will be said; in such-and-such tribe there is an honest man; and later it will be said about some man; What a wise; polite and strong man he is! Though he will not have faith equal even to a mustard seed in his heart. The Prophet told one of his Companions to look after him. During one battle the Prophet got some prisoners as spoils of war; and he distributed them; giving him that Bedouin a share. His Companions gave him what had been allocated to him. He had been looking after some livestock for them; and when he came they gave him his share. He said: What is this? They said: A share that the Prophet has allocated to you. He took it and brought it to the Prophet and said: What is this? He said: I allocated it to your. He said: It is not for this that I follwed you. Rather I followed you so that I might be shot her - and he pointed to his throat - with an arrow and die and enter Paradise. He said: If you are sincere toward Allah; Allah will fulfill your wish. Shortly after that they got up to fight the enemy; then he was brought to the Prophet; he had pointed to. The Prophet said: Is it him? They said: yes. He said: He was sincere toward Allah and Allah fulfilled his wish. Then the Prophet shrouded him in his own cloak and out him in front of him and offered the funeral prayer for him. So I followed it. Suddenly I saw a man; who had a thin garment on riding his small mule. He had a piece of cloth on his head to protect himself from the sun. I asked: Who is this important man? People said: This is Anas Ibn Malik. When the bier was placed; Anas stood and led the funeral prayer over him while I was just behind him; and there was no obstruction between me and him. He stood near his head; and uttered four takbirs Allah is Most Great. He neither lengthened the prayer nor hurried it. He then went to sit down. They said: Abu Hamzah; here is the bier of an Ansari woman. They brought her near him and there was a green cupola-shaped structure over her bier. He stood opposite her hips and led the funeral prayer over her as he had led it over the man. He then sat down. AlAla Ibn Ziyad asked: Abu Hamzah; did the Messenger of Allah ﷺ say the funeral prayer over the dead as you have done; uttering four takbirs Allah is Most Great over her; and standing opposite the head of a man and the hips of a woman? He replied: Yes. He asked: Abu Hamzah; did you fight with the Messenger of Allah? He replied: Yes. I fought with him in the battle of Hunayn. The polytheists came out and invaded us so severely that we saw our horses behind our backs. Among the people i.e. the unbelievers there was a man who was attacking us; and striking and wounding us with his sword. Allah then defeated them. They were then brought and began to take the oath of allegiance to him for Islam. A man from among the companions of the Prophet ﷺ said: I make a vow to myself that if Allah brings the man who was striking us with his sword that day; I shall behead him. The Messenger of Allah ﷺ kept silent and the man was brought as a captive. When he saw the Messenger of Allah ﷺ ; he said: Messenger of Allah; I have repented to Allah. The Messenger of Allah ﷺ stopped for a while receiving his oath of allegiance; so that the other man might fulfil his vow. But the man began to wait for the order of the Messenger of Allah ﷺ for his murder. He was afraid of the Messenger of Allah ﷺ to kill him. When the Messenger of Allah ﷺ saw that he did not do anything; he received his oath of allegiance. The man said: Messenger of Allah; what about my vow? He said: I stopped receiving his oath of allegiance today so that you might fulfil your vow. He said: Messenger of Allah; why did you not give any signal to me? The Prophet ﷺ said: It is not worthy of a Prophet to give a signal. Abu Ghalib said: I asked the people about Anas standing opposite the hips of a woman. They told me that this practice was due to the fact that in the days of the Prophet there were no cupola-shaped structures over the biers of women. MuwataMalik-017-001-34824 | Malik related to me that he had heard that Abdullah Ibn Umar was asked whether a slave could be bought on the specific condition that it was to be used to fulfil the obligation of freeing a slave; and he said; No. Malik said; That is the best of what I have heard on the obligation of freeing slaves. Someone who has to set a slave free because of an obligation on him; may not buy one on the condition that he sets it free because if he does that; whatever he buys is not completely a slave because he has reduced its price by the condition he has made of setting it free. Malik added; There is no harm; however; in someone buying a person expressly to set him free. Malik said; The best of what I have heard on the obligation of freeing slaves is that it is not permitted to free a christian or a jew to fulfil it; and one does not free a mukatab or a mudabbar or an umm walad or a slave to be freed after a certain number of years; or a blind person. There is no harm in freeing a christian; jew; or magian voluntarily; because Allah; the Blessed; the Exalted; said in His Book; either as a favour then or by ransom; Surat 47 ayat 4 The favour is setting free. Malik said; As for obligations of freeing slaves which Allah has mentioned in the Book; one only frees a mumin slave for them. Malik said; It is like that in feeding poor people for kaffara. MuwataMalik-017-001-35393 | Yahya related to me from Malik that Yahya Ibn Said said; I vowed to walk; but I was struck by a pain in the kidney; so I rode until I came to Makka. I questioned Ata Ibn Abi Rabah and others; and they said; You must sacrifice an animal. When I came to Madina I questioned the ulama there; and they ordered me to walk again from the place from which I was unable to go on. So I walked. Yahya said that he had heard Malik say; What is done among us regarding someone who makes a vow to walk to the House of Allah; and then cannot do it and so rides; is that he must return and walk from the place from which he was unable to go on. If he cannot walk; he should walk what he can and then ride; and he must sacrifice a camel; a cow; or a sheep if that is all that he can find. Malik; when asked about a man who said to another; I will carry you to the House of Allah; answered; If he intended to carry him on his shoulder; by that he meant hardship and exhaustion to himself; and he does not have to do that. Let him walk by foot and make sacrifice. If he did not intend anything; let him do hajj and ride; and take the man on hajj with him. That is because he said; I will carry you to the house of Allah. If the man refuses to do hajj with him; then there is nothing against him; and what is demanded of him is cancelled. Yahya said that Malik was asked whether it was enough for a man who had made a vow that he would walk to the House of Allah a certain large number of times; or who had forbidden himself from talking to his father and brother; if he did not fulfil a certain vow; and he had taken upon himself; by the oath; something which he was incapable of fulfilling in his lifetime; even though he were to try every year; to fulfil only one or a smaller number of vows by Allah? Malik said; The only satisfaction for that that I know is fulfilling what he has obliged himself to do. MuwataMalik-017-001-35400 | Yahya related to me from Malik from Suhayl Ibn Abi Salih from his father from Abu Huraira that the Messenger of Allah; may Allah bless him and grant him peace; said; Whoever makes an oath and then sees that something else would be better than it; should do kaffara for his oath and do what is better. Yahya said that he heard Malik say; Anyone who says that he has a vow but does not mention the name of Allah; is still obliged to make the kaffara for an oath if he breaks it. Malik said; Emphasis is when a man swears one thing several times; repeating the oath in his speech time after time. For instance; the statement; By Allah; I will not decrease it from such-and-such; sworn three times or more. The kaffara of that is like the kaffara of one oath. If a man swears; I will not eat this food or wear these clothes or enter this house; that is all in one oath; and he is only obliged to do one kaffara. It is the same for a man who says to his wife; You are divorced if I clothe you in this garment or let you go to the Masjid; and it is one entire statement in the normal pattern of speech. If he breaks any of that oath; divorce is necessary; and there is no breaking of oath after that in whatever he does. There is only one oath to be broken in that. Malik said; What we do about a woman who makes a vow without her husband permission is that she is allowed to do so and she must fulfill it; if it only concerns her own person and will not harm her husband. MuwataMalik-017-001-35524 | Yahya related to me from Malik that he had heard that Said Ibn AlMusayab was asked whether a man who had vowed to fast a month could fast voluntarily; and Said said; He should fulfil his vow before he does any voluntary fasting. Malik said; I have heard the same thing from Sulayman Ibn Yasar. Malik said; If someone dies with an unfulfilled vow to free a slave or to fast or to give sadaqa or to give away a camel; and makes a bequest that his vow should be fulfilled from his estate; then the sadaqa or the gift of the camel are taken from one third of his estate. Preference is given to it over other bequests; except things of a similar nature; because by his vow it has become incumbent on him; and this is not the case with something he donates voluntarily. They vows and voluntary donations are settled from a limited one-third of his estate; and not from the whole of it; since if the dying man were free to dispose of all of his estate; he might delay settling what had become incumbent on him i.e. his vows ; so that when death came and the estate passed into the hands of his heirs; he would have bequeathed such things i.e. his vows that were not claimed by anyone like debts. If that i.e. to dispose freely of his property were allowed him; he would delay these things i.e. his vows until when he was near death; he would designate them and they might take up all of his estate.
