SahihMuslim-017-001-17386 | Imran Bin Hosain reported that a woman from Juhaina came to Allah Apostle ﷺ and she had become pregnant because of adultery. She said: Allah Apostle; I have done something for which prescribed punishment must be imposed upon me; so impose that. Allah Apostle ﷺ called her master and said: Treat her well; and when she delivers bring her to me. He did accordingly. Then Allah Apostle ﷺ pronounced judgment about her and her clothes were tied around her and then he commanded and she was stoned to death. He then prayed over her dead body. Thereupon Umar said to him: Allah Apostle; you offer prayer for her; whereas she had committed adultery! Thereupon he said: She has made such a repentance that if it were to be divided among seventy men of Medina; it would be enough. A person came there and said: Allah Messenger; I have committed an offence which deserves the imposition of hadd upon me; so impose it upon me. Allah Messenger ﷺ kept silent. He repeated it and said: Allah Messenger; I have committed an offence which deserves the imposition of hadd upon me; so impose it upon me. He the Holy Prophet kept silent; and it was at this time that Iqama was pronounced for prayer and the prayer was observed. And when Allah Apostle ﷺ had concluded the payer that person followed Allah Messenger ﷺ. Abu Umama said: I too followed Allah Messenger ﷺ after he had concluded the prayer; so that I should know what answer he would give to that person. That person remained attached to Allah Messenger ﷺ and said: Allah Messenger; I have committed an offence which deserves imposition of hadd upon me; so impose it upon me. Abu Umama reported that Allah Messenger ﷺ said to him: Didnt you see that as you got out of the house; you performed ablution perfectly well. He said: Allah Messenger; of course. I did it. He again said to him: Then you observed prayer along with us. He said: Allah Messenger; yes; it is so. Thereupon Allah Messenger ﷺ said to him: Verily; Allah has exempted you from the imposition of hadd; or he said. SunanAbuDawoud-017-001-26847 | Narrated Anas Ibn Malik: Sahl Ibn Abu Umamah said that he and his father Abu Umamah visited Anas Ibn Malik at Medina during the time rule of Umar Ibn Abd AlAziz when he Anas Ibn Malik was the governor of Medina. He was praying a very short prayer as if it were the prayer of a traveller or near it. When he gave a greeting; my father said: May Allah have mercy on you! Tell me about this prayer: Is it obligatory or supererogatory? He said: It is obligatory; it is the prayer performed by the Messenger of Allah ﷺ. I did not make a mistake except in one thing that I forgot. He said: The Messenger of Allah ﷺ used to say: Do not impose austerities on yourselves so that austerities will be imposed on you; for people have imposed austerities on themselves and Allah imposed austerities on them. Their survivors are to be found in cells and monasteries. Then he quoted: Monasticism; they invented it; we did not prescribe it for them. Next day he went out in the morning and said: will you not go out for a ride; so that you may see something and take a lesson from it? He said: Yes. Then all of them rode away and reached a land whose inhabitants had perished; passed away and died. The roofs of the town had fallen in. He asked: Do you know this land? I said: Who acquainted me with it and its inhabitants? Anas said: This is the land of the people whom oppression and envy destroyed. Envy extinguishes the light of good deeds; and oppression confirms or falsifies it. MuwataMalik-017-001-34779 | Malik related to me from Nafi that Safiya bint Abi Ubayd informed him that a man who had had intercourse with a virgin slave- girl and made her pregnant was brought to Abu Bakr AlSiddiq. He confessed to fornication; and he was not muhsan. Abu Bakr gave the order and he was flogged with the hadd punishment. Then he was banished to Fadak; thirty miles from Madina. Malik spoke about a person who confessed to fornication and then retracted it and said; I didnt do it. I said that for such-and-such a reason; and he mentioned the reason. Malik said; That is accepted from him and the hadd is not imposed on him. That is because the hadd is what is for Allah; and it is only applied by one of two means; either by a clear proof which establishes guilt or by a confession which is persisted in so that the hadd is imposed. If someone persists in his confession; the hadd is imposed on him. MuwataMalik-017-001-34814 | Malik said; A master who frees a slave of his and settles his emancipation so that his testimony is permitted; his inviolability complete; and his right to inherit confirmed; cannot impose stipulations on him like what he imposes on a slave about property or service; nor get him to do anything of slavery; because the Messenger of Allah; may Allah bless him and grant him peace; said; If a man frees his share of a slave and has enough money to cover the full price of the slave justly evaluated for him; he must give his partners their shares so the slave is completely free. MuwataMalik-017-001-35594 | Yahya related to me from Malik that he had heard that Umar Ibn Abd AlAziz wrote to his governors telling them to relieve any people who payed the jizya from paying the jizya if they became muslims. Malik said; The sunna is that there is no jizya due from women or children of people of the Book; and that jizya is only taken from men who have reached puberty. The people of dhimma and the magians do not have to pay any zakat on their palms or their vines or their crops or their livestock. This is because zakat is imposed on the muslims to purify them and to be given back to their poor; whereas jizya is imposed on the people of the Book to humble them. As long as they are in the country they have agreed to live in; they do not have to pay anything on their property except the jizya. If; however; they trade in muslim countries; coming and going in them; a tenth is taken from what they invest in such trade. This is because jizya is only imposed on them on conditions; which they have agreed on; namely that they will remain in their own countries; and that war will be waged for them on any enemy of theirs; and that if they then leave that land to go anywhere else to do business they will haveto pay a tenth. Whoever among them does business with the people of Egypt; and then goes to Syria; and then does business with the people of Syria and then goes to Iraq and does business with them and then goes on to Madina; or Yemen; or other similar places; has to pay a tenth. People of the Book and magians do not have to pay any zakat on any of their property; livestock; produce or crops. The sunna still continues like that. They remain in the deen they were in; and they continue to do what they used to do. If in any one year they frequently come and go in muslim countries then they have to pay a tenth every time they do so; since that is outside what they have agreed upon; and not one of the conditions stipulated for them.
