Later on the people asked Allah Messenger ﷺ about it. So Allah revealed the following Verse:- They ask your instruction O Muhammad! regarding women. Say: Allah instructs you regarding them... 4.127 and in this Verse Allah indicated that if the orphan girl was beautiful and wealthy; her guardian would have the desire to marry her without giving her an appropriate Mahr equal to what her peers could get; but if she was undesirable for lack of beauty or wealth; then he would not marry her; but seek to marry some other woman instead of her. SahihAlBukhari-017-001-4947 | Narrated Urwa Bin AlZubair: That he had asked Aisha about the meaning of the Statement of Allah: If you fear that you shall not Be able to deal justly With the orphan girls; then Marry Other women of your choice Two or three or four. 4.3 She said; O my nephew! This is about the orphan girl who lives with her guardian and shares his property. Her wealth and beauty may tempt him to marry her without giving her an adequate Mahr bridal-money which might have been given by another suitor. So; such guardians were forbidden to marry such orphan girls unless they treated them justly and gave them the most suitable Mahr; otherwise they were ordered to marry any other woman. Aisha further said; After that verse the people again asked the Prophet about the marriage with orphan girls ; so Allah revealed the following verses:- They ask your instruction Concerning the women. Ibn Abbas said: If I had not the fear of committing sin for concealing the knowledge I would not have written to him. Najda wrote to him saying after praising the Almighty and invoking blessings on the Prophet : Tell me whether the Messenger of Allah ﷺ took women to participate with him in Jihad; if he did ; whether he allotted them a regular share from the booty; whether he killed the children of the enemy in the war ; how long an orphan would be entitled to consideration as such; and for whom the Khums fifth part of the booty was booty. Ibn Abbas wrote to him: You have written asking me whether the Messenger of Allah ﷺ took women with him to participate in Jihad. He did take them to the battle and sometimes he fought along with them. They would treat the wounded and were given a reward from the booty; but he did not assign any regular share for them. And the Messenger of Allah ﷺ did not kill the children of the enemy; so you should not kill the children. Also you have written to me asking me when the orphanhood of an orphan comes to an end. By my life; if a man has become bearded but is still incapable of getting his due from others or fulfilling his obligation towards them; he is yet an orphan to be treated as such ; but when he can look after his interests like grown-up people; he is no longer an orphan. And you have written to me inquiring about Khums as to whom it is meant for. He said to Yazid: Write to him. If he were not likely to fall into folly; I would not have written to him. Write: You have written asking about the woman and the slave whether they would get a share of the booty if they participated in Jihad. You should know that there is nothing of the sort for them except that they will be given a prize. And you have written asking me about the killing of the enemy children in war. You should understand that the Messenger of Allah may peare be upon him did not kill them. and thou shouldst not kill them unless thou knew what the companion of Moses i. e. Khadir knew about the boy he had killed. And you have written asking me about the orphan as to when the period of his orphanhood comes to an end; so that the sobriquet of orphan is dropped from him. In this regard; you should know that the sobriquet orphan will not be dropped from him until he attains maturity of body and mind. SahihMuslim-017-001-18152 | It has been narrated on the anthority of Yazid Bin Hurmuz who said: Najda wrote to Ibn Abbas. I was sitting in the company of Ibn Abbas when he read his letter and wrote its reply. Ibn Abbas said: Were it not for preventing him from falling into wickedness. I would not have replied to his letter; may he never be joyful. He wrote in reply to him referring to the share of the close relatives of the Holy Prophet from the booty whom God has mentioned. I have to tell you that we thought we were the close relatives of the Messenger of Allah ﷺ ; but our people have refused to recognise us as such. You have asked about the orphan as to when his orphanhood comes to an end. I have to say that when he reaches the age of marriage; attains maturity of mind; and his property is returned to him; then he is no longer an orphan. You have inquired whether the Messenger of Allah may peace be upo him used to kill anyone from the children of the polytheists in the war. You should know that the Messenger of Allah ﷺ used not to kill any one of their children; and you too should not kill any one of them; except when you knew about them what Khadir had known about the boy whom he killed. And you have inquired whether there is a fixed share of the booty for women and slaves when they participate in a battle. SahihMuslim-017-001-19795 | Anas Bin Malik reported that there was an orphan girl with Umm Sulaim who was the mother of Anas. Allah Messenger ﷺ saw that orphan girl and said: O; it is you; you have grown young. May you not advance in years! That slave-girl returned to Umm Sulaim weeping. Umm Sulaim said: O daughter; what is the matter with you? She said: Allah Apostle ﷺ has invoked curse upon me that I should not grow in age and thus I would never grow in age; or she said; in my length of life. Umm Sulaim went out wrapping her head-dress hurriedly until she met Allah Messenger ﷺ. He said to her: Umm Sulaim; what is the matter with you? She said: Allah Apostle; you invoked curse upon my orphan girl. He said: Umm Sulaim; what is that? She said: She the orphan girl states you have cursed her saying that she might not grow in age or grow in life. Allah Messenger ﷺ smiled and then said: Umm Sulaim; dont you know that I have made this term with my Lord. SunanAlNasai-017-001-13818 | It was narrated that Mujahid said: The Khumus that is for Allah and His Messenger was for the Prophet and His relatives; they did not take anything from the Sadaqah. The Prophet was allocated one-fifth of the Khumus; his relatives were allocated one-fifth of the Khumus; the same was allocated to orphans; the poor and they wayfarers. Da if Abu Abdulrahman AlNasi said: Allah; the Majestic is he and Praised; said: And know that whatever of spoils of war that you may gain; verily; one-fifth of it is assigned to Allah; and to the Messenger; and to the near relatives of the Messenger Muhammad ; and also the orphans; AlMasakin the Poor and the wayfarer. His; the Mighty and Sublime; saying to Allah starts the speech since everything is of Allah; the Mighty and Sublime; saying to Allah starts the speech since everything is of Allah; the Mighty and Sublime. And perhaps He only oened His speech about the Fay and the Khumus; mentioning Himself; because that is the noblest of earnings. And He did not attribute Sadaqah to Himself; the Mighty and Sublime; because that is the dirt of people. And Allah knows best.It was said that something should be taken form the spoils of war and placed inside the Kabah; and this is the share that is for Allah; the Mighty and Sublime. The share of the Messenger is to be given to the imam to buy horses and weapons; and to give to whomever he thinks will benefit the people of Islam; and to the people of Hadith; Knowledge; Fiqh and the Quran. The share that is for near relatives should be given to Banu Hashim and Banu AlMuttablib; rich and poor alike; or it was said that it should be given to the poor among them and not to the rich; such as orphans and wayfarers. This is the view that is more appropriate in my view; and Allah knows best. And the young and the old; male and female; are equal in that; because Allah; the mighty and sublime; has allocated it to them and the Messenger of Allah distributed it among them; and there is nothing in the Hadith to indicate that he preferred some of them over others. And there is no scholarly dispute; as far as we know; to suggest that if a man bequeaths one-third of his wealth to such a tribe; to be distributed out among them equally; that it should be done otherwise; unless the giver stipulated otherwise. And Allah is the source of strength. And there is a share for the orphans among the Muslims; and a share for the poor among the Muslims; and a share for the wayfarers among the Muslims. No one should be given both a share for the poor and a share for the wayfarer; it is to be said to him: Take whichever of them you want. And the other four-fifths are to be divided by the imam among those adult Muslims who were present in the battle. She said: O son of my sister; this refers to a female orphan who is in the care of her guardian; and her wealth is joined to his; and he is attracted to her wealth and her beauty. So her guardian wants to marry her without being fair with regard to her dowry; and without giving her what someone else would give her. So they were forbidden to marry them unless they were fair to them and gave them the highest possible dowry that is customarily given; and they were commanded to marry other women of their choice. Urwah said: Aisha said: Then later on; Allah; the Mighty and Sublime; revealed concerning them: They ask your legal instruction concerning women; say: Allah instructs you about them; and about what is recited unto you in the Book concerning the orphan girls whom you give not the prescribed portions and yet whom you desire to marry. Aisha said: What Allah; Most High; mentioned here that is recited in the Book is the first Verse in which it says: And if you fear that you shall not be able to deal justly with orphan girls then marry other women of your choice. Aisha said: What is referred to in the other Verse -and yet whom you desire to marry- is the desire of one of you not to marry orphan girl who is under his care if she is lacking in wealth and beauty. She said O my nephew; this means the female orphan who is under the protection of her guardian and she holds a share in his property and her property and beauty attracts him; so her guardian intends to marry her without doing justice to her in respect of her dower and he gives her the same amount of dower as others give her. They i.e.; the guardians were prohibited to marry them except that they do justice to them and pay them their maximum customary dower and they were asked to marry women other than them i.e.; the orphans who seem good to them. Urwah reported that Aisha said The people then consulted the Apostle of Allaah ﷺ about women after revelation of this verse. Thereupon Allaah the Exalted sent down the verse They consult thee concerning women. Say Allaah giveth you decree concerning them and the scripture which hath been recited unto you giveth decree concerning female orphans unto whom you give not that which is ordained for them though you desire to marry them. She said The mention made by Allaah about the Scripture recited to them refers to the former verse in which Allaah has said And if ye fear that ye will not deal fairly by the orphans; marry of the women; who seem good to you. Aisha said The pronouncement of Allaah ; the Exalted in the latter verse though you desire to marry them means the disinterest of one of you in marrying a female orphan who was under his protection; but she said little property and beauty. So they were prohibited to marry them for their interest in the property and beauty of the female orphans due to their disinterest in themselves except that they do justice to them.
