They said: "How could we refuse to fight in the cause of Allah, seeing that we were turned out of our homes and our families?" but when they were commanded to fight, they turned back, except a small band among them. SahihAlBukhari-017-001-185 | Narrated Aisha: Abu Bakr came riding his horse from his dwelling place in AlSunh. He got down from it; entered the Masjid and did not speak with anybody till he came to me and went direct to the Prophet; who was covered with a marked blanket. Abu Bakr uncovered his face. He knelt down and kissed him and then started weeping and said; My father and my mother be sacrificed for you; O Allah Prophet! Allah will not combine two deaths on you. You have died the death which was written for you. Narrated Abu Salama from Ibn Abbas : Abu Bakr came out and Umar ; was addressing the people; and Abu Bakr told him to sit down but Umar refused. Abu Bakr again told him to sit down but Umar again refused. Then Abu Bakr recited the Tashah-hud i.e. none has the right to be worshipped but Allah and Muhammad is Allah Messenger ﷺ and the people attended to Abu Bakr and left Umar. Abu Bakr said; Amma badu; whoever amongst you worshipped Muhammad; then Muhammad is dead; but whoever worshipped Allah; Allah is alive and will never die. SahihAlBukhari-017-001-2422 | Narrated Abu Said: A group of the companions of Allah Messenger ﷺ proceeded on a journey till they dismounted near one of the Arab tribes and requested them to entertain them as their guests; but they the tribe people refused to entertain them. Then the chief of that tribe was bitten by a snake or stung by a scorpion and he was given all sorts of treatment; but all in vain. Some of them said; Will you go to the group those travelers who have dismounted near you and see if one of them has something useful? They came to them and said; O the group! Our leader has been bitten by a snake or stung by a scorpion and we have treated him with everything but nothing benefited him Has anyone of you anything useful? One of them replied; Yes; by Allah; I know how to treat with a Ruqya. But. by Allah; we wanted you to receive us as your guests but you refused. I will not treat your patient with a Ruqya till you fix for us something as wages. Consequently they agreed to give those travellers a flock of sheep. The man went with them the people of the tribe and started spitting on the bite and reciting Surat AlFatiha till the patient was healed and started walking as if he had not been sick. When the tribe people paid them their wages they had agreed upon; some of them the Prophet companions said; Distribute the sheep. But the one who treated with the Ruqya said; Do not do that till we go to Allah Apostle and mention to him what has happened; and see what he will order us. So they came to Allah Messenger ﷺ and mentioned the story to him and he said; How do you know that Surat AlFatiha is a Ruqya? You have done the right thing. SahihAlBukhari-017-001-3095 | Narrated Jabir Bin Abdullah: There was a Jew in Medina who used to lend me money up to the season of plucking dates. Jabir had a piece of land which was on the way to Ruma. That year the land was not promising; so the payment of the debt was delayed one year. The Jew came to me at the time of plucking; but gathered nothing from my land. I asked him to give me one year respite; but he refused. This news reached the Prophet ﷺ whereupon he said to his companions; Let us go and ask the Jew for respite for Jabir. All of them came to me in my garden; and the Prophet ﷺ started speaking to the Jew; but he Jew said; O Abu Qasim! I will not grant him respite. When the Prophet ﷺ saw the Jew attitude; he stood up and walked all around the garden and came again and talked to the Jew; but the Jew refused his request. I got up and brought some ripe fresh dates and put it in front of the Prophet. He ate and then said to me; Where is your hut; O Jabir? I informed him; and he said; Spread out a bed for me in it. I spread out a bed; and he entered and slept. When he woke up; I brought some dates to him again and he ate of it and then got up and talked to the Jew again; but the Jew again refused his request. Then the Prophet ﷺ got up for the second time amidst the palm trees loaded with fresh dates; and said; O Jabir! Pluck dates to repay your debt. The Jew remained with me while I was plucking the dates; till I paid him all his right; yet there remained extra quantity of dates. SahihAlBukhari-017-001-3345 | Narrated Abu AlDarda: While I was sitting with the Prophet; Abu Bakr came; lifting up one corner of his garment uncovering his knee. The Prophet ﷺ said; Your companion has had a quarrel. Abu Bakr greeted the Prophet ﷺ and said; O Allah Messenger ﷺ ! There was something i.e. quarrel between me and the Son of AlKhattab. I talked to him harshly and then regretted that; and requested him to forgive me; but he refused. This is why I have come to you. The Prophet ﷺ said thrice; O Abu Bakr! May Allah forgive you. SahihAlBukhari-017-001-3517 | Narrated Urwa Bin AlZubair: Aisha; the wife of the Prophet ﷺ told him that there were four types of marriage during Pre-Islamic period of Ignorance. One type was similar to that of the present day i.e. a man used to ask somebody else for the hand of a girl under his guardianship or for his daughter hand; and give her Mahr and then marry her. The second type was that a man would say to his wife after she had become clean from her period. Send for so-and-so and have sexual intercourse with him. Her husband would then keep awy from her and would never sleep with her till she got pregnant from the other man with whom she was sleeping. When her pregnancy became evident; he husband would sleep with her if he wished. Her husband did so i.e. let his wife sleep with some other man so that he might have a child of noble breed. Such marriage was called as AlIstibda. Another type of marriage was that a group of less than ten men would assemble and enter upon a woman; and all of them would have sexual relation with her. If she became pregnant and delivered a child and some days had passed after delivery; she would sent for all of them and none of them would refuse to come; and when they all gathered before her; she would say to them; You all know waht you have done; and now I have given birth to a child. So; it is your child so-and-so! naming whoever she liked; and her child would follow him and he could not refuse to take him. The fourth type of marriage was that many people would enter upon a lady and she would never refuse anyone who came to her. Those were the prostitutes who used to fix flags at their doors as sign; and he who would wished; could have sexual intercourse with them. If anyone of them got pregnant and delivered a child; then all those men would be gathered for her and they would call the Qaif persons skilled in recognizing the likeness of a child to his father to them and would let the child follow the man whom they recognized as his father and she would let him adhere to him and be called his son. The man would not refuse all that. SahihAlBukhari-017-001-3930 | Narrated Abdulrahman Bin Abi Bakr: The companions of Suffa were poor people. The Prophet ﷺ once said; Whoever has food enough for two persons; should take a third one from among them ; and whoever has food enough for four persons; should take a fifth or a sixth or said something similar. Abu Bakr brought three persons while the Prophet ﷺ took ten. And Abu Bakr with his three family member who were I; my father and my mother the sub-narrator is in doubt whether Abdulrahman said; My wife and my servant who was common for both my house and Abu Bakr house. Abu Bakr took his supper with the Prophet ﷺ and stayed there till he offered the Isha prayers. He returned and stayed till Allah Messenger ﷺ took his supper. After a part of the night had passed; he returned to his house. His wife said to him; What has detained you from your guests? He said; Have you served supper to them? She said; They refused to take supper until you come. They i.e. some members of the household presented the meal to them but they refused to eat I went to hide myself and he said; O Ghunthar! He invoked Allah to cause my ears to be cut and he rebuked me. He then said to them : Please eat! and added; I will never eat the meal. By Allah; whenever we took a handful of the meal; the meal grew from underneath more than that handful till everybody ate to his satisfaction; yet the remaining food was more than the original meal. Abu Bakr saw that the food was as much or more than the original amount. He called his wife; O sister of Bani Firas! She said; O pleasure of my eyes. The food has been tripled in quantity. Abu Bakr then started eating thereof and said; It i.e. my oath not to eat was because of Sa all. He took a handful from it; and carried the rest to the Prophet. So that food was with the Prophet ﷺ. There was a treaty between us and some people; and when the period of that treaty had elapsed; he divided US into twelve groups; each being headed by a man. This wealth is like green sweet i.e. fruit ; and if one takes it without greed; then one is blessed in it; and if one takes it with greediness; then one is not blessed in it; and will be like the one who eats without satisfaction. SahihAlBukhari-017-001-4115 | Narrated Urwa: Aisha said; Buraira came to me and said; My people masters have written the contract for my emancipation for nine Awaq of gold to be paid in yearly installments; one Uqiya per year; so help me. Buraira went to her masters and told them about it; but they refused the offer and she returned from them while Allah Messenger ﷺ s was sitting. She said; I presented the offer to them; but they refused unless the Wala would be for them. Then he asked them to give him his spear but they refused; so he took it himself; attacked the onager; and killed it. I little knew of it; so I came back with a heavy heart on account of the refusal of Allah Messenger ﷺ ; and the fear that Allah Messenger ﷺ might have some feelings against me. I returned to my friends and informed them about what Allah Messenger ﷺ had said. I had hardly stayed for a little that I heard Bilal calling: Abdullah Bin Qais. I responded to his call. He said: Hasten to Allah Messenger ﷺ ; he is calling you; When I came to the Prophet ﷺ he said: Take this pair; this pair; and this pair i. e. six camels which he had bought from Sad ; and take them to y; our friends and say: Verily Allah or he said: Verily Allah Messenger ﷺ has provided you with these animals. So ride upon them. Abu Mousa said: I went along with them to my friends and said: Verily Allah messenger ﷺ has provided you with these animals for riding; but by Allah; I shall not leave you until some of you go along with me to him who had heard the talk of Allah Messenger ﷺ then I asked him for you; and his refusal for the first time; and then his granting them to me subsequently; so you should not think that I narrated to you something which he did not say. They said to me: By Allah; in our opinion you are certainly truthful; and we would do as you like. SahihMuslim-017-001-17985 | It has been reported from Sulaiman Bin Buraida through his father that when the Messenger of Allah ﷺ appointed anyone as leader of an army or detachment he would especially exhort him to fear Allah and to be good to the Muslims who were with him. He would say: Fight in the name of Allah and in the way of Allah. Fight against those who disbelieve in Allah. Make a holy war; do not embezzle the spoils; do not break your pledge; and do not mutilate the dead bodies; do not kill the children. When you meet your enemies who are polytheists; invite them to three courses of action. If they respond to any one of these; you also accept it and withhold yourself from doing them any harm. Invite them to accept Islam; if they respond to you; accept it from them and desist from fighting against them. Then invite them to migrate from their lands to the land of the Muhajireen and inform them that; if they do so; they shall have all the privileges and obligations of the Muhajireen. If they refuse to migrate; tell them that they will have the status of Bedouin Muslims and will be subjected to the Commands of Allah like other Muslims; but they will not get any share from the spoils of war or Fai except when they actually fight with the Muslims against the disbelievers. If they refuse to accept Islam; demand from them the Jizya. If they agree to pay; accept it from them and hold off your hands. If they refuse to pay the tax; seek Allah help and fight them. When you lay siege to a fort and the besieged appeal to you for protection in the name of Allah and His Prophet; do not accord to them the guarantee of Allah and His Prophet; but accord to them your own guarantee and the guarantee of your companions for it is a lesser sin that the security given by you or your companions be disregarded than that the security granted in the name of Allah and His Prophet be violated. SahihMuslim-017-001-18043 | It is narrated on the authority of Urwa Bin AlZubair who narrated from Aisha that she informed him that Fatima; daughter of the Messenger of Allah ﷺ ; sent someone to Abu Bakr to demand from him her share of the legacy left by the Messenger of Allah ﷺ from what Allah had bestowed upon him at Medina and Fadak and what was left from one-filth of the income annually received from Khaibar. Abu Bakr said: The Messenger of Allah ﷺ said: We prophets do not have any heirs; what we leave behind is to be given in charity. The household of the Messenger of Allah ﷺ will live on the income from these properties; but; by Allah; I will not change the charity of the Messenger of Allah ﷺ from the condition in which it was in his own time. I will do the same with it as the Messenger of Allah may peace be upun him himself used to do. So Abu Bakr refused to hand over anything from it to Fatima who got angry with Abu Bakr for this reason. She forsook him and did not talk to him until the end of her life. She lived for six months after the death of the Messenger of Allah ﷺ. When she died; her husband. Ali Bin Abu Talib; buried her at night. He did not inform Abu Bakr about her death and offered the funeral prayer over her himself. During the lifetime of Fatima; All received special regard from the people. After she had died; he felt estrangement in the faces of the people towards him. So he sought to make peace with Abu Bakr and offer his allegiance to him. He had not yet owed allegiance to him as Caliph during these months. He sent a person to Abu Bakr requesting him to visit him unaccompanied by anyone disapproving the presence of Umar. Umar said to Abu Bakr: BY Allah; you will not visit them alone. Abu Bakr said: What will they do to me? By Allah; I will visit them. And he did pay them a visit alone. All recited Tashahhud as it is done in the beginning of a religious sermon ; then said: We recognise your moral excellence and what Allah has bestowed upon you. We do not envy the favour i. e. the Catiphate which Allah nas conferred upon you; but you have done it assumed the position of Caliph alone without consulting us ; and we thought we had a right to be consulted on account of our kinship with the Messenger of Allah ﷺ. He continued to talk to Abu Bakr in this vein until the latter eyes welled up with tears. Then Abd Bakr spoke and said: By Allah; in Whose Hand is my life; the kinship of the Messenger of Allah ﷺ is dearer to me than the kinship of my own people. As regards the dispute that has arisen between you and me about these properties; I have not deviated from the right course and I have not given up doing about them what the Messenger of Allah ﷺ used to do. So Ali said to Abu Bakr: This aftetnoon is fixed for swearing allegiance to you. So when Abu Bakr had finished his Zuhr prayer; he ascended the pulpit and recited Tashahhud; and described the status of Ali; his delay in swearing allegiance and the excuse which lie had offered to him for this delay. After this he asked for God forgiveness. Then Ali Bin Abu Talib recited the Tashahhud. extolled the merits of Abu Bakr and said that his action was nott prompted by any jealousy of Abu Bakr on his part or his refusal to accept the high position which Allah had conferred upon him; adding: But we were of the opinion that we should have a share in the government; but the matter had been decided without taking us into confidence; and this displeased us. Hence the delay in offering allegiance. The Muslims were pleased with this explanation and they said: You have done the right thing. SahihMuslim-017-001-20903 | Abu Nawfal reported: I saw the dead body of Abdullah Bin AlZubair hanging on the road of Medina leading to Mecca. The Quraish passed by it and other people too; that Abdullah Bin Umar happened to pass by it. He stood up there and said: May there be peace upon you; Abu Khubaib the Kunya of Hadrat Abdullah Bin AlZubair ; may there be peace upon you Abu Khubaib; may there be peace upon you; Abu Khubaib! By Allah; I used to forbid you from this; by Allah; I used to forbid you from this; by Allah I used to forbid you from this. By Allah; so far as I know; you had been very much devoted to fasting and prayer and you had been paying very much care to cementing the ties of blood. By Allah; the group to which you belong are labelled as a wicked person is indeed a fine group. Then Abdullah Bin Umar went away. The stand Abdullah Bin Umar took in regard to the inhuman treatment meted out to Abdullah Bin AlZubair and his words in that connection were conveyed to AlHajjaj Bin Yousif and as a consequence of that he the body of Abdullah Bin AlZubair was brought down from the stump the scaffold by which it was hanging and thrown into the graves of the Jews. He AlHajjaj sent his messenger to Asma bint Abu Bakr; Abdullah mother. But she refused to come. He again sent the messenger to her with the message that she must come; otherwise he would bring her forcibly catching hold of her hair. But she again refused and said: By Allah; I will not come to you until you send one to me who would drag me by pulling my hair. Thereupon he said: Bring me my shoes. He put on his shoes and walked on quickly swollen with vanity and pride until he came to her and said: How do you find what I have done with the enemy of Allah? She said: I find that you wronged him in this world; whereas he has spoiled your next life. It has been conveyed to me that you used to call him Abdullah Bin AlZubair as the son of one having two belts. By Allah; I am indeed a woman of two belts. One is that with the help of which I used to suspend high the food of Allah Messenger ﷺ and that of Abu Bakr making it out of the reach of animals and; so far as the second belt is concerned; that is the belt which no woman can dispense with. Verily Allah Messenger ﷺ told us that in Thaqif; there would be born a great liar and great murderer. The liar we have seen; and as far as the murderer is concerned; I do not find anyone else besides you. SahihMuslim-017-001-21146 | Abdulrahman Bin Abd Bakr reported: There came to our house some guests. It was a common practice with my father to go and talk to Allah Messenger ﷺ during the night. While going he said: Abdulrahman entertain the guests. When it was evening we served the food to them; but they refused saying: So long as the owner of the house does not come and join us; we would not take the meal. I said to them: He Abd Bakr is a stern person; and if you would not do that if you do not take the food. I fear; I may be harmed by him; but they refused. As he my father came; the first thing he asked was: Have you served the guests? They the peopleof the household said: We have not served them sofar. He said: Did I not command Abdulrahman to do this ? He Abdulrahman said: I slunk away and kept myself away by that time. He again said: O stupid fellow; I ask you on oath that In case you hear my voice you come to me. I came and said: By Allah; there is no fault of mine. These are your guests; you may ask them. I provided them with food but they refused to eat until you came. He said to them: Why is it that you did not accept our food? By Allah; I shall not even take food tonight as you have not taken. They said: By Allah; we would not take until you join us. Thereupon he Abu Bakr said: I have never seen a more unfortunate night than this. Woe be to thee! that you do not accept from us food prepared for you. He again said: What I did first that is the taking of vow for not eating the food was prompted by the Satan. Bring the food. The food was brought; and he ate by reciting the name of Allah and they also ate; and when it was morning he came to Allah Apostle ﷺ and said: Allah Messenger; their oath that of the guests came to be true; but mine was not true; and after that he informed him of the whole incident. Abdullah Bin Khatl was caught while he was clinging to the covers of Kabah. Saeed Bin Huraith and Ammar Bin Yasir both rushed toward him; but Saeed; who was the younger of the two; got there before Ammar; and he killed him. Miqyas Bin Subabah was caught by the people in the marketplace; and they killed him. Ikrimah traveled by sea; and he was caught in a storm. The crew of the ship said: Turn sincerely toward Allah; for your false gods cannot help you at all in this situation. Ikrimah said: By Allah; if nothing came to save me at sea except sincerity toward Allah then nothing else will save me on land. O Allah; I promise You that if You save me from this predicament I will go to Muhammad SAWSYMOBOL and put my hand in his; and I am sure that I will find him generous and forgiving. So he came; and accepted Islam. Abdullah bin Sad Bin Abi Sarh hid in the house of Uthman Bin Affan; and when the Messenger of Allah SAWSYMOBOL called the people to give their Oath of Allegiance; he brought him; and made him stand before the Prophet SAWSYMOBOL. He Uthman said: O Messenger of Allah! Accept the allegiance of Abdullah. He raised his head and looked at him three times; refusing his allegiance each time; then he accepted his allegiance after three times. Then he turned to his Companions and said: Was there not any sensible man among you who would get up when he saw me refusing to give him my hand and kill him? SunanAbuDawoud-017-001-28632 | Narrated Zubayb Ibn Thalabah AlAnbari: The Messenger of Allah ﷺ sent an army to Banu AlAnbar. They captured them at Rukbah in the suburbs of AlTaif and drove them to the Holy Prophet ﷺ. I rode hurriedly to the Holy Prophet ﷺ and said: Peace be on you; Messenger of Allah; and the mercy of Allah and His blessings. Your contingent came to us and arrested us; but we had already embraced Islam and cut the sides of the ears of our cattle. When Banu AlAnbar arrived; the Holy Prophet ﷺ said to me: Have you any evidence that you had embraced Islam before you were captured today? I said: Yes. He said: Who is your witness? I said: Samurah; a man from Banu AlAnbar; and another man whom he named. The man testified but Samurah refused to testify. The Holy Prophet ﷺ said: He Samurah has refused to testify for you; so take an oath with your other witness. I said: Yes. He then dictated an oath to me and I swore to the effect that we had embraced Islam on a certain day; and that we had cut the sides of the ears of the cattle. SunanAbuDawoud-017-001-28663 | Narrated Abu Said AlKhudri : Some of the Companions of Prophet ﷺ went on a journey. They encamped with a clan of the Arabs and sought hospitality from them; but they refused to provide them with any hospitality. The chief of the clan was stung by a scorpion or bitten by a snake. They gave him all sorts of treatment; but nothing gave him relied. One of them said: Would that you had gone to those people who encamped with you ; some of them might have something which could give you relief to your companion. So they went and one of them said: Our chief has been stung by a scorpion or bitten by a snake. We administered all sorts of medicine but nothing gave him relief. Has any of you anything; i.e. charm; which gives healing to our companion. One of those people said: I shall apply charm; we sought hospitality from you; but you refused to entertain us. I am not going to apply charm until you give me some wages. So they offered them a number of sheep. He then came to and recited Faithat AlKitab and spat until he was cured as if he were set free from a bond. Thereafter they made payment of the wages as agreed by them. SunanAbuDawoud-017-001-29243 | Narrated Umar Ibn Abd AlAziz: AlMughirah Ibn Shubah said: Umar Ibn Abd AlAziz gathered the family of Marwan when he was made caliph; and he said: Fadak belonged to the Messenger of Allah ﷺ ; and he made contributions from it; showing repeated kindness to the poor of the Banu Hashim from it; and supplying from it the cost of marriage for those who were unmarried. Fatimah asked him to give it to her; but he refused. That is how matters stood during the lifetime of the Messenger of Allah ﷺ till he passed on i.e. died. When Abu Bakr was made ruler he administered it as the Prophet ﷺ had done in his lifetime till he passed on. SunanAbuDawoud-017-001-29338 | Narrated Sakhr Ibn AlAyla AlAhmasi: The Messenger of Allah ﷺ raided Thaqif. When Sakhr heard this; he proceeded on his horse along with some horsemen to support the Prophet ﷺ. He found the Prophet of Allah ﷺ had returned and he did not conquer Taif. On that day Sakhr made a covenant with Allah and had His protection that he would not depart from that fortress until they the inhabitants surrendered to the command of the Messenger of Allah ﷺ. He did not leave them until they had surrendered to the command of the Messenger of Allah ﷺ. Sakhr then wrote to him: To proceed: Thaqif have surrendered to your command; Messenger of Allah; and I am on my way to them. They have horses with them. The Messenger of Allah ﷺ then ordered prayers to be offered in congregation. He then prayed for Ahmas ten times: O Allah; send blessings the horses and the men of Ahmas. The people came and Mughirah Ibn Shubah said to him: Prophet of Allah; Sakhr took my paternal aunt while she embraced Islam like other Muslims. He called him and said: Sakhr; when people embrace Islam; they have security of their blood and property. Give back to Mughirah his paternal aunt. So he returned his aunt to him and asked the Prophet of Allah ﷺ : What about Banu Sulaym who have run away for fear of Islam and left that water? He said: Prophet of Allah; allow me and my people to settle there. He said: Yes. So he allowed him to settle there. Banu Sulaym then embraced Islam; and they came to Sakhr. They asked him to return their water to them. But he refused. So they came to the Prophet ﷺ and said: Prophet of Allah; we embraced Islam and came to Sakhr so that he might return our water to us. But he has refused. He the Prophet then came to him and said: When people embrace Islam; they secure their properties and blood. Return to the people their water. He said: Yes; Prophet of Allah. SunanAbuDawoud-017-001-29659 | Sulaiman Bin Buraidah reported on the authority of his father. When the Apostle of Allaah ﷺ appointed a Commander over an Army or a detachment; he instructed him to fear Allaah himself and consider the welfare of the Muslims who were with him. He then said When you meet the polytheists who are your enemy; summon them tone of three things and accept whichever of them they are willing to agree to; and refrain from them. Summon them to Islam and if they agree; accept it from them and refrain from them. Then summon them to leave their territory and transfer to the abode of the Emigrants and tell them that if they do so; they will have the same rights and responsibilities as the Emigrants; but if they refuse and choose their own abode; tell them that they will be like the desert Arabs who are Muslims subject to Allaahs jurisdiction which applies to the believers; but will have no spoil or booty unless they strive with the Muslims. If they refuse demand jizyah poll tax from them; if they agree accept it from them and refrain from them. But if they refuse; seek Alaahs help and fight with them. When you invade the fortress and they its people offer to capitulate and have the matter referred to Allaahs jurisdiction; do not grant this; for you do not know whether or not you will hit on Allaahs jurisdiction regarding them. They refused and stopped themselves from doing it. He said to the others; Will you take an oath? They refused; so Umar Ibn AlKhattab gave a judgement that the Banu Sad had to pay half the full blood-money. MuwataMalik-017-001-34890 | Yahya said that he heard Malik say; This ayat is abrogated. It is the word of Allah; the Blessed; the Exalted; If he leaves goods; the testament is for parents and kinsmen. What came down about the division of the fixed shares of inheritance in the Book of Allah; the Mighty; the Exalted; abrogated it. Yahya said that he heard Malik say; The established sunna with us; in which there is no dispute; is that it is not permitted for a testator to make a bequest in addition to the fixed share in favour of an heir; unless the other heirs permit him. If some of them permit him and others refuse; he is allowed to diminish the share of those who have given their permission. Those who refuse take their full share from the inheritance. Yahya said that he heard Malik speak about an invalid who made a bequest and asked his heirs to give him permission to make a bequest when he was so ill that he only had command of a third of his property; and they gave him permission to leave some of his heirs more than his third. Malik said; They cannot revoke that. Had they been permitted to do so; every heir would have done that; and then; when the testator died; they would take that for themselves and prevent him from bequeathing his third and what was permitted to him with respect to his property. Malik said; If he asks permission of his heirs to grant a bequest to an heir while he is well and they give him permission; that is not binding on them. The heirs can rescind that if they wish. That is because when a man is well; he is entitled to all his property and can do what he wishes with it. If he wishes; he can spend all of it. He can spend it and give sadaqa with it or give it to whomever he likes. His asking permission of his heirs is permitted for the heirs; when they give him permission when authority over all his property is closed off from him and nothing outside of the third is permitted to him; and when they are more entitled to the two-thirds of his property than he is himself. That is when their permission becomes relevant. If he asks one of the heirs to give his inheritance to him when he is dying; and the heir agrees and then the dying man does not dispose of it at all; it is returned to the one who gave it unless the deceased said to him; So-and-so - one of his heirs - is weak; and I would like you to give him your inheritance. So he gives it to him. That is permitted when the deceased specified it for him. Malik said; When a man gives the dying man free use of his share of the inheritance; and the dying man distributes some of it and some remains; it is returned to the giver; after the man has died. Yahya said that he heard Malik speak about someone who made a bequest and mentioned that he had given one of his heirs something which he had not taken possession of; so the heirs refused to permit that. MuwataMalik-017-001-34941 | Malik related to me from Amr Ibn Yahya AlMazini from his father that AlDahhak Ibn Khalifa watered his irrigation ditch from a large source of water. He wanted to have it pass through the land of Muhammad Ibn Maslama; and Muhammad refused. AlDahhak said to him; Why do you prevent me? It will benefit you. You can drink from it first and last and it will not harm you. Muhammed refused so AlDahhak spoke about it to Umar Ibn AlKhattab; and Umar Ibn AlKhattab summoned Muhammad Ibn Maslama and ordered him to clear the way. Muhammad said; No. Umar said; Why do you prevent your brother from what will benefit him and is also useful for you? You will take water from it first and last and it will not harm you. Muhammad said; No; by Allah! Umar said; By Allah; he will pass it through; even if it is over your belly! MuwataMalik-017-001-34954 | Yahya said that he heard Malik say; What is done in our community about some one who gives a gift not intending a reward is that he calls witnesses to it. It is affirmed for the one to whom it has been given unless the giver dies before the one to whom it was given receives the gift. He said; If the giver wants to keep the gift after he has had it witnessed; he cannot. If the recipient claims it from him; he takes it. Malik said; If some one gives a gift and then withdraws it and the recipient brings a witness to testify for him that he was given the gift; be it goods; gold; silver or animals; the recipient is made to take an oath. If he refuses; the giver is made to take an oath. If he also refuses to take an oath; he gives to the recipient what he claims from him if he has at least one witness. If he does not have a witness; he has nothing. Malik said; If someone gives a gift not expecting anything in return and then the recipient dies; the heirs are in his place. If the giver dies before the recipient has received his gift; the recipient has nothing. That is because he was given a gift which he did not take possession of. MuwataMalik-017-001-34978 | Malik related to me that he heard Rabia Ibn Abi Abdulrahman and others mention that AlFurafisa Ibn Umar AlHanafi had a mukatab who offered to pay him all of his kitaba that he owed. AlFurafisa refused to accept it and the mukatab went to Marwan Ibn AlHakam who was the amir of Madina and brought up the matter. Marwan summoned AlFurafisa and told him to accept. He refused. Marwan then ordered that the payment be taken from the mukatab and placed in the treasury. He said to the mukatab Go; you are free. When AlFurafisa saw that; he took the money. Malik said; What is done among us when a mukatab pays all the instalments he owes before their term; is that it is permitted to him. The master cannot refuse him that. That is because payment removes every condition from the mukatab as well as service and travel. The setting free of a man is not complete while he has any remaining slavery; and neither would his inviolability as a free man be complete and his testimony permitted and inheritance obliged and such things in that situation. His master must not make any stipulation of service on him after he has been set free. Malik said that it was permitted for a mukatab who became extremely ill and wanted to pay his master all his instalments because his heirs who were free would then inherit from him and he had no children with him in his kitaba; to do so; because by that he completed his inviolability as a free man; his testimony was permitted; and his admission of what he owed of debts to people was permitted. MuwataMalik-017-001-35010 | Yahya said that Malik spoke about an investor who gave qirad money to a man; and then the man sought a loan from the investor or the investor borrowed money from the agent; or the investor left goods with the agent to sell for him; or the investor gave the agent dinars to buy goods with. Malik said; There is no harm if the investor leaves his goods with him knowing that if the agent did not have his money and he had asked a similar thing of him; he would have still done it because of the brotherhood between them or because it would have been no bother to him and that had the agent refused that; he would not have removed his capital from him. Or if the agent had borrowed from the investor or carried his goods for him and he knew that if the investor had not had his capital with him; he would have still done the same for him; and had he refused that to him; he would not have returned his capital to him. If that is true between both of them and it is in the way of a favour between them and it is not a condition in the terms of the qirad; it is permitted and there is no harm in it.
