SahihMuslim-017-001-17985 | It has been reported from Sulaiman Bin Buraida through his father that when the Messenger of Allah ﷺ appointed anyone as leader of an army or detachment he would especially exhort him to fear Allah and to be good to the Muslims who were with him. He would say: Fight in the name of Allah and in the way of Allah. Fight against those who disbelieve in Allah. Make a holy war; do not embezzle the spoils; do not break your pledge; and do not mutilate the dead bodies; do not kill the children. When you meet your enemies who are polytheists; invite them to three courses of action. If they respond to any one of these; you also accept it and withhold yourself from doing them any harm. Invite them to accept Islam; if they respond to you; accept it from them and desist from fighting against them. Then invite them to migrate from their lands to the land of the Muhajireen and inform them that; if they do so; they shall have all the privileges and obligations of the Muhajireen. If they refuse to migrate; tell them that they will have the status of Bedouin Muslims and will be subjected to the Commands of Allah like other Muslims; but they will not get any share from the spoils of war or Fai except when they actually fight with the Muslims against the disbelievers. If they refuse to accept Islam; demand from them the Jizya. If they agree to pay; accept it from them and hold off your hands. If they refuse to pay the tax; seek Allah help and fight them. When you lay siege to a fort and the besieged appeal to you for protection in the name of Allah and His Prophet; do not accord to them the guarantee of Allah and His Prophet; but accord to them your own guarantee and the guarantee of your companions for it is a lesser sin that the security given by you or your companions be disregarded than that the security granted in the name of Allah and His Prophet be violated. SahihMuslim-017-001-20873 | Abu Burda reported on the authority of his father: We offered the sunset prayer along with Allah Apostle ﷺ. We then said: If we sit along with Allah Messenger and observe night prayer with him it would be very good; so we sat down and he came to us and said: You are still sitting here. I said: Allah Messenger; we observed evening prayer with you; then we said: Let us sit down and observe night prayer along with you; whereupon he said: You have done well or you have done right. He then lifted his head towards the sky and it often happened that as he lifted his head towards the sky; he said: The stars are a source of security for the sky and when the stars disappear there comes to the sky; i. e. it meets the same fate as it has been promised it would plunge into darkness. SunanAbuDawoud-017-001-29338 | Narrated Sakhr Ibn AlAyla AlAhmasi: The Messenger of Allah ﷺ raided Thaqif. When Sakhr heard this; he proceeded on his horse along with some horsemen to support the Prophet ﷺ. He found the Prophet of Allah ﷺ had returned and he did not conquer Taif. On that day Sakhr made a covenant with Allah and had His protection that he would not depart from that fortress until they the inhabitants surrendered to the command of the Messenger of Allah ﷺ. He did not leave them until they had surrendered to the command of the Messenger of Allah ﷺ. Sakhr then wrote to him: To proceed: Thaqif have surrendered to your command; Messenger of Allah; and I am on my way to them. They have horses with them. The Messenger of Allah ﷺ then ordered prayers to be offered in congregation. He then prayed for Ahmas ten times: O Allah; send blessings the horses and the men of Ahmas. The people came and Mughirah Ibn Shubah said to him: Prophet of Allah; Sakhr took my paternal aunt while she embraced Islam like other Muslims. He called him and said: Sakhr; when people embrace Islam; they have security of their blood and property. Give back to Mughirah his paternal aunt. So he returned his aunt to him and asked the Prophet of Allah ﷺ : What about Banu Sulaym who have run away for fear of Islam and left that water? He said: Prophet of Allah; allow me and my people to settle there. He said: Yes. So he allowed him to settle there. Banu Sulaym then embraced Islam; and they came to Sakhr. They asked him to return their water to them. But he refused. So they came to the Prophet ﷺ and said: Prophet of Allah; we embraced Islam and came to Sakhr so that he might return our water to us. But he has refused. He the Prophet then came to him and said: When people embrace Islam; they secure their properties and blood. Return to the people their water. He said: Yes; Prophet of Allah. MuwataMalik-017-001-34693 | Yahya related to me from Malik from Yahya Ibn Said from Abdulrahman Ibn AlQasim that Aslam; the mawla of Umar Ibn AlKhattab informed him that he had visited Abdullah Ibn Ayash AlMakhzumi. He saw that he had some nabidh with him and he was at that moment on the way to Makka. Aslam said to him; Umar Ibn AlKhattab loves this drink. Abdullah Ibn Ayash therefore carried a great drinking bowl and brought it to Umar Ibn AlKhattab and placed it before him. Umar brought it near to him and then raised his head. Umar said; This drink is good; so he drank some of it and then passed it to a man on his right. When Abdullah turned to go; Umar Ibn AlKhattab called him and asked; Are you the person who says that Makka is better than Madina? Abdullah said; I said that it was the Haram of Allah; and His place of security; and His House was in it. Umar said; I am not saying anything about the House of Allah or His Haram. Then Umar repeated Are you the person who says that Makka is better than Madina? He replied; I said that it was the Haram of Allah and His place of security; and His House was in it. Umar said; I am not saying anything about the House of Allah and His Haram. MuwataMalik-017-001-34914 | Yahya said; Malik related to us from Ibn Shihab from Saeed Ibn AlMusayab that the Messenger of Allah; may Allah bless him and grant him peace; said; The pledge given as security is not forfeited. Malik said; The explanation of that according to what we think - and Allah knows best - is that a man gives a pledge to somebody in security for something. The pledge is superior to that for which he pawned it. The pledger says to the pawn-broker; I will bring you your due; after such-and-such a time. If not; the pledge is yours for what it was pawned for. Malik said; This transaction is not good and it is not halal. This is what was forbidden. If the owner brings what he pledged it for after the period; it is his. MuwataMalik-017-001-34918 | Yahya said that he heard Malik speak about someone who pledged goods as security for a loan; and they perished with the broker. The one who took out the loan confirmed its specification. They agreed on the amount of the loan; but challenged each other about the value of the pledge; the pledger saying that it had been worth twenty dinars; whilst the broker said that it had been worth only ten; and that the amount loaned on security was twenty dinars. Malik said; It is said to the one in whose hand the pledge is; describe it. If he describes it he is made to take an oath on it and then the people of experience evaluate that description. If the value is more than what was loaned on security for it; it is said to the broker; Return the rest of his due to the pledger. If the value is less than what was loaned on security for it; the broker takes the rest of his due from the pledger. If the value is the exact amount of the loan; the pledge is compensated for by the loan. Yahya said that he heard Malik say; What is done in our community about two men who have a dispute about an amount of money loaned on the security of a pledge - the pledger claiming that he pledged it for ten dinars and the broker insisting that he took the pledge as security for twenty dinars; and the pledge is clearly in the possession of the broker - is that the broker is made to take an oath when the value of the pledge is fully known. If the value of the pledge is exactly what he swore that he had loaned on security for it; the broker takes the pledge as his right. He is more entitled to take precedence with an oath since he has possession of the pledge. If the owner of the pledge wants to give him the amount which he swore that he was owed; he can take the pledge back. If the pledge is worth less than the twenty dinars he loaned; then it is said to the pledger; Either you give him what he has sworn to and take your pledge back; or you swear to what you said you pledged it for. If the pledger takes the oath; then what the broker has increased over the value of the pledge will become invalid. If the pledger does not take an oath; he must pay what the broker swore to. Malik said; If a pledge given on security for a loan perishes; and both parties deny each other rights; with the broker who is owed the loan saying that he gave twenty dinars; and the pledger who owes the loan saying that he was given only ten; and with the broker who is owed the loan saying the pledge was worth ten dinars; and the broker who owes the loan saying it was worth twenty; then the broker who is owed the loan is asked to describe the pledge. If he describes it; he must take an oath on its description. Then people with experience of it evaluate that description. If the value of the pledge is estimated to be more than what the broker claims it was; he takes an oath as to what he claimed; and the pledger is given what is over from the value of the pledge. If its value is less than what the broker claims of it; he is made to take an oath as to what he claims is his. Then he demands settlement according to the actual value of the pledge. The one who owes the loan is then made to take an oath on the extra amount which remains owing against him to the claimant after the price of the pledge is reached. That is because the broker becomes a claimant against the pledger. If he takes an oath; the rest of what the broker swore to of what he claimed above the value of the pledge is invalidated.
