SahihAlBukhari-017-001-1174 | Narrated Ibn Umar: A Jew and Jewess were brought to the Prophet ﷺ on a charge of committing an illegal sexual intercourse. The Prophet ﷺ asked the Jews; What do you usually do with them? They said; We blacken their faces and disgrace them. He said; Bring here the Torah and recite it; if you are truthful. They fetched it and came and asked a one-eyed man to recite. He went on reciting till he reached a portion on which he put his hand. The Prophet ﷺ said; Lift up your hand! He lifted his hand up and behold; there appeared the verse of AlRajm stoning of the adulterers to death. Then he said; O Muhammad! They should be stoned to death but we conceal this Divine Law among ourselves. Then the Prophet ﷺ ordered that the two sinners be stoned to death and; and they were stoned to death; and I saw the man protecting the woman from the stones. SahihAlBukhari-017-001-1208 | Narrated Abu Huraira: While we were with Allah Messenger ﷺ a bedouin got up and said; O Allah Messenger ﷺ ! Settle my case according to Allah Book Laws. Then his opponent got up and said; O Allah Messenger ﷺ ! He has said the truth! Settle his case according to Allah Book Laws. and allow me to speak; He said; My son was a laborer for this man and he committed illegal sexual intercourse with his wife. The people told me that my son should be stoned to death but I ransomed him with one-hundred sheep and a slave girl. Then I asked the religious learned people and they told me that his wife should be stoned to death and my son should receive one-hundred lashes and be sentenced to one year of exile. The Prophet ﷺ said; By Him in Whose Hands my life is; I will judge between you according to Allah Book Laws : As for the slave girl and the sheep; they are to be returned; and as for your son; he shall receive onehundred lashes and will be exiled for one year. The Torah was brought; and then one of the Jews put his hand over the Divine Verse of the Rajam stoning to death and started reading what preceded and what followed it. On that; Ibn Salam said to the Jew; Lift up your hand. Behold! The Divine Verse of the Rajam was under his hand. Then I asked the religious learned people about It ; and they told me that my son should he flogged one-hundred stripes and should be exiled for one year; and only the wife of this man should be stoned to death Allah Messenger ﷺ said; By Him in Whose Hand my soul is; I will judge you according to Allah Laws: O man; as for your sheep and slave girl; they are to be returned to you. SahihAlBukhari-017-001-1614 | Narrated Ibn Abbas: Lian was mentioned in the presence of the Prophet; Aasi m Bin Adi said a statement about it; and when he left; a man from his tribe came to him complaining that he had seen a man with his wife. Aasi m said; I have been put to trial only because of my statement. So he took the man to the Prophet ﷺ and the man told him about the incident. The man husband was of yellow complexion; thin; and of lank hair; while the man whom he had accused of having been with his wife; was reddish brown with fat thick legs and fat body. The Prophet ﷺ said; O Allah! Reveal the truth. Later on the lady delivered a child resembling the man whom the husband had accused of having been with her. So the Prophet ﷺ made them take the oath of Lian. A man said to Ibn Abbas in the gathering; Was that the same lady about whom the Prophet ﷺ said; If I were to stone any lady for committing illegal sexual intercourse to death without witnesses; I would have stoned that lade to death? SahihMuslim-017-001-17384 | Sulaiman Bin Buraida reported on the authority of his father that Ma; iz Bin Malik came to Allah Apostle ﷺ and said to him: Messenger of Allah; purify me; whereupon he said: Woe be upon you; go back; ask forgiveness of Allah and turn to Him in repentance. He the narrator said that he went back not far; then came and said: Allah Messenger; purify me. whereupon Allah Messenger ﷺ said: Woe be upon you; go back and ask forgiveness of Allah and turn to Him in repentance. He the narrator said that he went back not far; when he came and said: Allah Messenger; purify me. Allah Apostle ﷺ said as he had said before. When it was the fourth time; Allah Messenger may; ﷺ said: From what am I to purify you? He said: From adultery; Allah Messenger ﷺ asked if he had been mad. He was informed that he was not mad. He said: Has he drunk wine? A person stood up and smelt his breath but noticed no smell of wine. Thereupon Allah Messenger ﷺ said: Have you committed adultery? He said: Yes. He made pronouncement about him and he was stoned to death. The people had been divided into two groups about him Maiz. One of them said: He has been undone for his sins had encompassed him; whereas another said: There is no repentance more excellent than the repentance of Maiz; for he came to Allah Apostle ﷺ and placing his hand in his in the Holy Prophets hand said: Kill me with stones. This controversy about Maiz remained for two or three days. Then came Allah Messenger ﷺ to them his Companions as they were sitting. He greeted them with salutation and then sat down and said: Ask forgiveness for Maiz Bin Malik. They said: May Allah forgive Maiz Bin Malik. Thereupon Allah Messenger ﷺ said: He Maiz has made such a repentance that if that were to be divided among a people; it would have been enough for all of them. He the narrator said: Then a woman of Ghamid; a branch of Azd; came to him and said: Messenger of of Allah; purify me; whereupon he said: Woe be upon you; go back and beg forgiveness from Allah and turn to Him in repentance. She said: I find that you intend to send me back as you sent back Maiz. Bin Malik. He the Holy; Prophet said: What has happened to you? She said that she had become pregnant as a result of fornication. He the Holy Prophet said: Is it you who has done that ? She said: Yes. He the Holy Prophet said to her: You will not be punished until you deliver what is there in your womb. One of the Ansar became responsible for her until she was delivered of the child. He that Ansari came to Allah Apostle ﷺ and said the woman of Ghamid has given birth to a child. He the Holy Prophet said: In that case we shall not stone her and so leave her infant with none to suckle him. One of the Ansar got up and said: Allah Apostle; let the responsibility of his suckling be upon me. SahihMuslim-017-001-17385 | Abdullah Bin Buraida reported on the authority of his father that Maiz Bin Malik AlAslami came to Allah Messenger ﷺ and said: Allah Messenger; I have wronged myself; I have committed adultery and I earnestly desire that you should purify me. He turned him away. On the following day; he Maiz again came to him and said: Allah Messenger; I have committed adultery. Allah Messenger ﷺ turned him away for the second time; and sent him to his people saying: Do you know if there is anything wrong with his mind. They denied of any such thing in him and said: We do not know him but as a wise good man among us; so far as we can judge. He Maiz came for the third time; and he the Holy Prophet sent him as he had done before. He asked about him and they informed him that there was nothing wrong with him or with his mind. When it was the fourth time; a ditch was dug for him and he the Holy Prophet pronounced judg- ment about him and he wis stoned. He the narrator said: There came to him the Holy Prophet a woman from Ghamid and said: Allah Messenger; I have committed adultery; so purify me. He the Holy Prophet turned her away. On the following day she said: Allah Messenger; Why do you turn me away? Perhaps; you turn me away as you turned away Maiz. By Allah; I have become pregnant. He said: Well; if you insist upon it; then go away until you give birth to the child. When she was delivered she came with the child wrapped in a rag and said: Here is the child whom I have given birth to. He said: Go away and suckle him until you wean him. When she had weaned him; she came to him the Holy Prophet with the child who was holding a piece of bread in his hand. She said: Allah Apostle; here is he as I have weaned him and he eats food. He the Holy Prophet entrusted the child to one of the Muslims and then pronounced punishment. And she was put in a ditch up to her chest and he commanded people and they stoned her. Khalid b Walid came forward with a stone which he flung at her head and there spurted blood on the face of Khalid and so he abused her. Allah Apostle ﷺ heard his Khalids curse that he had huried upon her. Thereupon he the Holy Prophet said: Khalid; be gentle. By Him in Whose Hand is my life; she has made such a repentance that even if a wrongful tax-collector were to repent; he would have been forgiven. SahihMuslim-017-001-17388 | Abu Huraira and Zaid b Khalid AlJuhani reported that one of the desert tribes came to Allah Messenger ﷺ and said: Messenger of Allah; I beg of you in the name of Allah that you pronounce judgment about me according to the Book of Allah. The second claimant who was wiser than him said: Well; decide amongst us according to the Book of Allah; but permit me to say something. Thereupon Allah Messenger may peace be upon ham said: Say. He said: My son was a servant in the house of this person and he committed adultery with his wife. I was informed that my son deserved stoning to death as punishment for this offence. I gave one hundred goats and a slave girl as ransom for this. I asked the scholars if this could serve as an expiation for this offence. They informed me that my son deserved one hundred lathes and exile for one year. and this woman deserved stoning as she was married. Thereupon Allah Messenger may peace he upon him said: By Him in Whose Hand is my life. I will decide between you according to the Book of Allah. The slave-girl and the goats should be given back; and your son is to be punished with one hundred lashes and exile for one year. SahihMuslim-017-001-17390 | Abdullah Bin Umar reported that a Jew and a Jewess were brought to Allah Messenger ﷺ who had committed adultery. Allah Messenger ﷺ came to the Jews and said: What do you find in Torah for one who commits adultery? They said: We darken their faces and make them ride on the donkey with their faces turned to the opposite direction and their backs touching each other ; and then they are taken round the city. He said: Bring Torah if you are truthful. They brought it and recited it until when they came to the verse pertaining to stoning; the person who was reading placed his hand on the verse pertaining to stoning; and read only that which was between his hands and what was subsequent to that. Abdullah Bin Salim who was at that time with the Messenger of Allah ﷺ said: Command him the reciter to lift his hand. He lifted it and there was; underneath that; the verse pertaining to stoning. SahihMuslim-017-001-17393 | AlBara Bin Azib reported: There happened to pass by Allah Apostle ﷺ a Jew blackened and lashed. Allah Apostle ﷺ called them the Jews and said: Is this the punishment that you find in your Book Torah as a prescribed punishment for adultery? They said: Yes. He the Holy Prophet called one of the scholars amongst them and said: I ask you in the name of Allah Who sent down the Torah on Moses if that is the prescribed punishment for adultery that you find in your Book. He said: No. Had you not asked me in the name of Allah; I would not have given you this information. We find stoning to death as punishment prescribed in the Torah. But this crime became quite common amongst our aristocratic class. So when we caught hold of any rich person indulging in this offence we spared him; but when we caught hold of a helpless person we imposed the prescribed punishment upon him. We then said: Let us argree on a punishment which we can inflict both upon the rich and the poor. So We decided to blacken the face with coal and flog as a substitute punishment for stoning. Thereupon Allah Messenger ﷺ said: O Allah; I am the first to revive Thy command when they had made it dead. He then commanded and he the offender was stoned to death. Allah; the Majestic and Glorious; sent down this verse : O Messenger; the behaviour of those who vie with one another in denying the truth should not grieve you... up to is vouchsafed unto you; accept it v. 41 2176 It was said by the Jews : Go to Muhammad; it he commands you to blacken the face and award flogging as punishment for adultery ; then accept it; but it he gives verdict for stoning; then avoid it. It was then that Allah; the Majestic and Great; sent down these verses : And they who do not judge in accordance with what Allah has revealed are; indeed; deniers of the truth v. 44 ; And they who do not judge in accordance with what Allah has revealed-they; they indeed are the wrongdoers v. 45 ; And they who do not judge in accordance with what God has revealed-they are the iniquitous v. 47. Besides this; I grazed the camel; made arrangements for providing it with water and patched up the leather bucket and kneaded the flour. But I was not proficient in baking the bread; so my female neighbours used to bake bread for me and they were sincere women. He called me and said to the camel to sit down so that he should make cite ride behind hirn. I told my husband: I felt shy and remembered your jealousy; whereupon he said: By Allah. the carrying of the stone dates upon your bead is more severe a burden than riding with him. SahihMuslim-017-001-20474 | Abdullah reported that Allah Messenger may peace be upol him got fashioned a signet ring of gold but he kept its stone on the inner side of his palm as he wore it; so the people following his example got fashioned such rings. Then one day as he sat on the pulpit he pulled it away saying: I wore this ring and kept its stone towards the inner side. SunanAlNasai-017-001-11563 | It was narrated that Anas Bin Malik said: When the Messenger of Allah ﷺ came to AlMadinah; he alighted in the upper part of AlMadinah among the tribe called Banu Amr Bin Awuf and he stayed with them for fourteen nights. Then he sent for the chiefs of Banu AlNajjar; and they came with their swords by their sides. It is as if I can see the Messenger of Allah ﷺ on his camel with Abu Bakr riding behind him on the same camel and the chiefs of Banu AlNajjar around him; until he dismounted in the courtyard of Abu Ayoub. The Prophet ﷺ used to offer the prayer wherever he was when the time for prayer came; and he would pray even in sheepfolds. Then he ordered that the Masjid be built. He sent for the chiefs of Banu AlNajjar; and when they came; he said: O Banu AlNajjar; name me a price for this grove of yours. They said: By Allah; we will not ask for its price except from Allah. Anas said: In that grove there were graves of idolators; ruins and date-palm trees. The Messenger of Allah ﷺ ordered that the graves of the idolators be dug up; the ruins be leveled and the date-palm trees be cut down. The trunks of the trees were arranged so as to form the walls facing the Qiblah. The stone pillars were built at the sides of its gate. They started to move the stones; reciting some lines of verse; and the Messenger of Allah ﷺ was with them when they were saying: O Allah! There is no good except the good of the Hereafter. He said: My son was a laborer serving this man; and he committed Zina with his wife. My father said to him: Go to the Messenger of Allah ﷺ and inform him of what you have done; for he may perhaps ask Allah for your forgiveness. His purpose in that was simply a hope that it might be a way of escape for him. So he went to him and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. He the Prophet turned away from him; so he came back and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. He again turned away from him; so he came back and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. When he uttered it four times; the Messenger of Allah ﷺ said: You have said it four times. With whom did you commit it? He replied: With so and so. He asked: Did you lie down with her? He replied: Yes. He asked: Had your skin been in contact with hers? He replied. Yes. He was then taken out to the Harrah; and while he was being stoned he felt the effect of the stones and could not bear it and fled. When we came out with him; stoned him and he felt the effect of the stones; he cried: O people! return me to the Messenger of Allah ﷺ. My people killed me and deceived me; they told me that the Messenger of Allah ﷺ would not kill me. We did not keep away from him till we killed him. When we returned to the Messenger of Allah ﷺ we informed him of it. He then turned towards her and asked: Who is the father of this child with you? The young man said: I am his father; Messenger of Allah! The Messenger of Allah ﷺ then looked at some of those who were around him and asked them about him. They said: We only know good about him. The Prophet ﷺ said to him: Are you married? He said: Yes. So he gave orders regarding him and he was stoned to death. He the narrator said: We took him out; dug a pit for him and put him in it. We then threw stones at him until he died. A man then came asking about the man who was stoned. We brought him to the Prophet ﷺ and said: This man has come asking about the wicked man. The Messenger of Allah ﷺ said: He is more agreeable than the fragrance of musk in the eyes of Allah. The man was his father. We then helped him in washing; shrouding and burying him. The Messenger of Allah; may Allah bless him and grant him peace; asked them; What do you find in the Torah about stoning? They said; We make their wrong action known and flog them. Abdullah Ibn Salam said; You have lied! It has stoning for it; so bring the Torah. They spread it out and one of them placed his hand over the ayat of stoning. Then he read what was before it and what was after it. Abdullah Ibn Salam told him to lift his hand. He lifted his hand and there was the ayat of stoning. They said; He has spoken the truth; Muhammad. The ayat of stoning is in it. So the Messenger of Allah; may Allah bless him and grant him peace; gave the order and they were stoned. Abdullah Ibn Umar added; I saw the man leaning over the woman to protect her from the stones. One of them said; Messenger of Allah! Judge between us by the Book of Allah! The other said; and he was the wiser of the two; Yes; Messenger of Allah. Judge between us by the Book of Allah and give me permission to speak. He said; Speak. He said; My son was hired by this person and he committed fornication with his wife. He told me that my son deserved stoning; and I ransomed him for one hundred sheep and a slave-girl. Then I asked the people of knowledge and they told me that my son deserved to be flogged with one hundred lashes and exiled for a year; and they informed me that the woman deserved to be stoned. Then he raised his hands to the sky and said; O Allah! I have become old and my strength has weakened. My flock is scattered. Obligations have been placed upon you. You have been left with a clear way unless you lead people astray right and left. Said said; There is a man who has had intercourse with his wife while in ihram who has sent a message to Madina asking about it. Some of them said; They should be kept apart until a future year; and Said Ibn AlMusayab said; They should carry on and complete the hajj which they have spoiled; and then return home when they have finished. If another hajj comes upon them; they must do hajj and sacrifice an animal. They should go into ihram at the same place where they went into ihram for the hajj that they spoiled; and they should keep apart until they have finished their hajj. Malik said; They should both sacrifice an animal. Malik said; about a man who had intercourse with his wife during hajj after he had come down from Arafa but before he had stoned the Jamra; He must sacrifice an animal and do hajj again in another year. If; however; he had intercourse with his wife after he stoned the Jamra; he only has to do an umra and sacrifice an animal and he does not have to do another hajj. Malik said; What spoils a hajj or an umra and makes sacrificing an animal and repeating the hajj necessary is the meeting of the two circumcised parts; even if there is no emission. It is also made necessary by an emission if it is the result of bodily contact. I do not think that a man who remembers something and has an emission owes anything; and if a man were to kiss his wife and no emission were to occur from that; he would only have to sacrifice an animal. A woman in ihram who has intercourse with her husband several times during hajj or umra out of obedience to him only has to do another hajj and sacrifice an animal. That is if her husband has intercourse with her while she is doing hajj. Abdullah Ibn Umar told them both to stone the jamra at the time they arrived and he did not think that they owed anything. Yahya said that Malik was asked about some one who forgot to stone one of the jamras on one of the days of Mina until it was evening and he said; He should throw the stones at whatever time of day or night he remembers; just as he would pray the prayer if he forgot it and then remembered it at any time of day or night.
