SunanAlTermithi-017-001-10055 | Narrated Saeed Bin Jubair: I was asked about those who were involved in the case of Lian and if they are to be separated; during the leadership of mousab Bin AlZubair. I did not know what to say. So I went to the house of Abdullah Bin Umar and I sought permission to enter. I was told he was taking a nap; but he heard me taking and he said: Is it Ibn Jubair? Enter. You would not have come except for a need. He said: So I entered and found him laying on a saddlecloth from his mount. I said: O Abu Abdulrahman Are those involved in Lian separated? He said: Glorious is Allah! Yes. The first who asked about hat was so-and-so the son of so-and-so. He came to the Prophet ﷺ and said O Messenger of Allah! If one of us saw his wife committing adultery; what should he do? If he were to say anything; his statement would be a horrible matter; and if he were to remain silent; his silence about the matter would be horrible. He said: So the Prophet ﷺ remained silent and did not answer him. Afterwards he came to the Prophet ﷺ and said: The one who asked you about it has been tried by it. So Allah revealed these Ayat from Surat AlNur: And those who accuse their wives and have no witnesses except themselves; let the testimony of one of them be four testimonies by Allah 24:6-10 - until the end of those Ayat. He said: So he called for the man and recited the Ayat to him and admonished him; reminded him; and he told him: Indeed the punishment of the world is less than the punishment of the Hereafter. So he said: Nay! By the One Who sent you with the Truth! I did not lie about her. Then he ﷺ did the same with the woman; admonishing her and reminding her and he told her: Indeed the punishment of the world is less than the punishment of the Hereafter. She said: Nay! By the One Who sent you with the Truth! He is not telling the truth. He said: So he started with the man: He testified four times; by Allah that he is one of the truthful; and the fifth time that the curse of Allah be upon him if he was one of the liars. Then the same with the woman: She testified four times by Allah; that he was one of the liars; and the fifth time that the wrath of Allah be upon her if he was one of the truthful. SunanAlTermithi-017-001-9936 | Narrated Ibn Abbas: from Tamim AlDari; regarding this Ayah: O you who believe! When death approaches any of you then take the testimony 5:106. He said: The people are innocent of it; other than myself and Adi Bin Badda. We were Christians who used to frequent AlSham before Islam. They went to AlSham for their business; and they were approached by a freed slave of Banu Sahm; who was called Budail Bin Abi Maryam; with some trade. He had a bowl they wanted made of silver; but he wanted a great deal for it. Then he became ill; and willed it to them; and he commissioned them to deliver what was left to his family. Tamim said: When he died; we took that bowl and we sold it for one-thousand Dirham. Then Adi Bin Badda and I divided it. When we went to his family to give them what was with us; they searched for the bowl and asked about it. We said: He did not leave behind other than this; nor did he give us other than this. Tamim said: When I accepted Islam; after the Messenger of Allah ﷺ had arrived in AlMadinah; I felt guilty about that; so I went to his family; and informed them about what had happened. I gave them fifty-thousand Dirham and told them my companion had the same. They took him to the Messenger of Allah ﷺ but he asked them for their proof; which they did not have; so he ordered them; to have him to take an oath in accordance with whatever the people of his religion revered; so he took the oath. Then Allah revealed: O you who believe! When death approaches any of you then take the testimony... up to His saying: Or else they would fear that oaths will be admitted after their oaths 5:106. SunanAlNasai-017-001-13187 | It was narrated from Umarah Bin Khuzaimah that his paternal uncle; who was one of the companions of the Prophet told him; that: the Prophet bought a horse from a Bedouin and asked him to follow him; so that he could pay him for the horse. The Prophet hastened but the Bedouin was slow. Men started to talk to the Bedouin and make offers for the horse; and they did not realize that the Prophet had bought it; until some of them offered more than the Prophet had bought it for. Then the Bedouin called out to the Prophet and said; Are you going to buy this horse or shall I sell it? The Prophet stood up when he heard him calling and said: Have I not bought it from you? He said: No; by Allah; I have not sold it to you; and the Prophet said I bought it from you. The people started to gaiter around the Prophet and the Bedouion as they were talking; and the Bedouin started to say: Bring a witness who will testify that you bought it. Khuzaimah Bin habit said: I bear witness that you bought it The Prophet turned to Khunzimah and said: Why are you bearing witness? SunanAbuDawoud-017-001-28230 | Ibn Abbas said: The deputation of Abd AlQais came to Messenger of Allah ﷺ and said: This is the tribe of Rabiah; and the infidels of Mudar are between us and you. We are able to come to you only in the sacred month. So give a decisive command which we may follow ourselves and to which we call those at home behind us. MuwataMalik-017-001-34931 | Yahya said that he heard Malik say; The way of doing things generally agreed upon in our community in the case of a man who dies and has sons and one of them claims; My father confirmed that so-and- so was his son; is that the relationship is not established by the testimony of one man; and the confirmation of the one who confirmed it is only permitted as regards his own share in the division of his father property. The one testified for is only given his due from the share of the testifier. Malik said; An example of this is that a man dies leaving two sons; and 600 dinars. Each of them takes 300 dinars. Then one of them testifies that his deceased father confirmed that so-and-so was his son. The one who testifies is obliged to give 100 dinars to the one thus connected. This is half of the inheritance of the one thought to be related; had he been related. If the other confirms him; he takes the other 100 and so he completes his right and his relationship is established. His position is similar to that of a woman who confirms a debt against her father or her husband and the other heirs deny it. She must pay to the person whose debt she confirms; the amount according to her share of the full debt; had it been confirmed against all the heirs. If the woman inherits an eighth; she pays the creditor an eighth of his debt. If a daughter inherits a half; she pays the creditor half of his debt. Whichever women confirm him; pay him according to this. Malik said; If a man testimony is in agreement with what the woman testified to; that so- and-so had a debt against his father; the creditor is made to take an oath with one witness and he is given all his due. This is not the position with women because a man testimony is allowed and the creditor must take an oath with the testimony of his witness; and take all his due. If he does not take an oath; he only takes from the inheritance of the one who confirmed him according to his share of the debt; because he confirmed his right and the other heirs denied it. MuwataMalik-017-001-34978 | Malik related to me that he heard Rabia Ibn Abi Abdulrahman and others mention that AlFurafisa Ibn Umar AlHanafi had a mukatab who offered to pay him all of his kitaba that he owed. AlFurafisa refused to accept it and the mukatab went to Marwan Ibn AlHakam who was the amir of Madina and brought up the matter. Marwan summoned AlFurafisa and told him to accept. He refused. Marwan then ordered that the payment be taken from the mukatab and placed in the treasury. He said to the mukatab Go; you are free. When AlFurafisa saw that; he took the money. Malik said; What is done among us when a mukatab pays all the instalments he owes before their term; is that it is permitted to him. The master cannot refuse him that. That is because payment removes every condition from the mukatab as well as service and travel. The setting free of a man is not complete while he has any remaining slavery; and neither would his inviolability as a free man be complete and his testimony permitted and inheritance obliged and such things in that situation. His master must not make any stipulation of service on him after he has been set free. Malik said that it was permitted for a mukatab who became extremely ill and wanted to pay his master all his instalments because his heirs who were free would then inherit from him and he had no children with him in his kitaba; to do so; because by that he completed his inviolability as a free man; his testimony was permitted; and his admission of what he owed of debts to people was permitted. His bequest was permitted as well.
