For such, their portion appointed must reach them from the Book (of decrees): until, when our messengers (of death) arrive and take their souls, they say: "Where are the things that ye used to invoke besides Allah?" They will reply, "They have left us in the lurch," And they will bear witness against themselves, that they had rejected Allah. | |

SahihAlBukhari-017-001-1269 | Narrated Abu Qatada: Allah Messenger ﷺ said on the Day of the battle of Hunain; Whoever has killed an infidel and has a proof or a witness for it; then the salb arms and belongings of that deceased will be for him. I stood up to seek a witness to testify that I had killed an infidel but I could not find any witness and then sat down. Then I thought that I should mention the case to Allah Messenger ﷺ I and when I did so a man from those who were sitting with him said; The arms of the killed person he has mentioned; are with me; so please satisfy him on my behalf. Abu Bakr said; No; he will not give the arms to a bird of Quraish and deprive one of Allah lions of it who fights for the cause of Allah and His Apostle. Allah Messenger ﷺ I stood up and gave it to me; and I bought a garden with its price; and that was my first property which I owned through the war booty. The people of Hijaz said; A judge should not pass a judgment according to his knowledge; whether he was a witness at the time he was the judge or before that And if a litigant gives a confession in favor of his opponent in the court; in the opinion of some scholars; the judge should not pass a judgment against him till the latter calls two witnesses to witness his confession. And some people of Iraq said; A judge can pass a judgement according to what he hears or witnesses the litigant confession in the court itself; but if the confession takes place outside the court; he should not pass the judgment unless two witnesses witness the confession. Some of them said; A judge can pass a judgement depending on his knowledge of the case as he is trust-worthy; and that a witness is Required just to reveal the truth. The judge knowledge is more than the witness. Some said; A judge can judge according to his knowledge only in cases involving property; but in other cases he cannot. Thereupon Allah Messenger ﷺ said: Show regard for the greatness of the old; or he said: Let the eldest begin speaking. Then they Huwayisa and Muhayisa spoke about the matter of their companion murder of their cousin; Abdullah Bin Sahl. Thereupon Allah Messenger ﷺ said: Let fifty persons among you take oath for levelling the charge of murder against a person amongst them; and he would be surrendered to you. SahihMuslim-017-001-19224 | Abdullah Bin Umar reported: Umar Bin AlKhattab went along with Allah Messenger ﷺ in the company of some persons to Ibn Sayad that he found him playing with children near the battlement of Bani Maghala and Ibn Sayad was at that time just at the threshold of adolescence and he did not perceive the presence of Holy Prophet until Allah Messenger ﷺ struck his back with his hands. Allah Messenger ﷺ said: Ibn Sayad; dont you bear witness that I am the messenger of Allah? Ibn Sayad looked toward him and he said: I bear witness to the fact that you the messenger of the unlettered. Ibn Sayad said to the Allah Messenger ﷺ : Do you bear witness to the fact that I am the messenger of Allah? Allah Messenger ﷺ rejected this and said: I affirm my faith in Allah and in His messengers. Then Allah Messenger ﷺ said to him: What do you see? Ibn Sayad said: It is a Dukh. Thereupon Allah Messenger ﷺ said: May you be disgraced and dishonoured; you would not not be able to go beyond your rank. Umar Bin AlKhattab said: Allah Messenger; permit me that I should strike his neck. Thereupon Allah Messenger ﷺ said: If he is the same Dajjal who would appear near the Last Hour; you would not be able to overpower him; and if he is not that there is no good for you to kill him. Abdullah Bin Umar further narrated that after some time Allah Messenger ﷺ and Ubay Bin Kaab went towards the palm trees where Ibn Sayad was. When Allah Messenger ﷺ went near the tree he hid himself behind a tree with the intention of hearing something from Ibn sayad before Ibn Sayad could see him; but Allah Messenger ﷺ saw him on a bed with a blanket around him from which a murmuring sound was being heard and Ibn Sayad mother saw Allah Messenger ﷺ behind the trunk of the palm tree. She said to Ibn Sayad: Saf that being his name ; here is Muhammad. Thereupon Ibn Sayad jumped up murmuring and Allah Messenger ﷺ said: If she had left him alone he would have made things clear. Abdullah Bin Umar told that Allah Messenger ﷺ stood up amongst the people and lauded Allah as He deserved; then he made a mention of the Dajjal and said: I warn you of him and there is no Prophet who has not warned his people against the Dajjal. Even Noah warned against him but I am going to tell you a thing which no Prophet told his people. You must know that he the Dajjal is one-eyed and Allah; the Exalted and Glorious; is not one-eyed. He said: I sought permission yesterday from Umar Bin AlKhattab three times but he did not permit me; so I came back; then I went to him today and visited him and informed him that I had come to him yesterday and greeted him thrice; then came back; whereupon he said: Yes; we did hear you but be were at that time busy; but why did you not seek permission further and you must have never gone back until you were permitted to do so. He said: I sought permission in the manner that I heard Allah Messenger ﷺ having said in connection With the seeking of permission for entering the house of a stranger. Thereupon he Hadrat Umar said: By Allah; I shall torture your back and your stomach unless you bring one who may bear witness to what you state. SunanAlNasai-017-001-11333 | Abd AlAziz Bin Abd AlMalik Bin Abu Mahdhurah narrated that Abdullah Bin Muhairiz - who was an orphan under the care of Abu Mahdhurah until he prepared him to go to AlSham - informed him: he said: I said to Abu Mahdhurah: I am going to AlSham and I am afraid that I will be asked about how you say the Adhan.He told me that Abu Mahdhurah said to him; I went out with a group of people and we were somewhere on the road to Hunain when the Messenger of Allah ﷺ was coming back from Hunain. The Messenger of Allah met us somewhere on the road and the Muadhdhin of the Messenger of Allah called the Adhan for prayer in the presence of the Messenger of Allah. We heard the voice of the Muadhdhin and we were careless about it the Adhan ; so we started yelling; immitating and mocking it. The Messenger of Allah ﷺ heard us; so he sent some people who brought us to stand infront of him. He said; Who is the one whose voice I heard so loud? The people all pointed to me; and they were telling the truth. He sent them all away; but kept me there and said to me: Stand up and call the Adhan for the Prayer. I stood up and the Messenger of Allah taught me the Adhan himself. We heard them calling the Adhan for the prayer and we started to repeat the Adhan; mocking them. The Messenger of Allah said; I heard among these people the Adhan of one who has a beautiful voice. He sent for us; and we recited the Adhan one by one; and I was the last of them. When I said the Adhan; he said: Come here. So he set out with her slave girl; and every time he entered a door; she locked it behind him; until he reached a beautiful woman who has with her a boy and a vessel of wine. SunanAlNasai-017-001-13187 | It was narrated from Umarah Bin Khuzaimah that his paternal uncle; who was one of the companions of the Prophet told him; that: the Prophet bought a horse from a Bedouin and asked him to follow him; so that he could pay him for the horse. The Prophet hastened but the Bedouin was slow. Men started to talk to the Bedouin and make offers for the horse; and they did not realize that the Prophet had bought it; until some of them offered more than the Prophet had bought it for. Then the Bedouin called out to the Prophet and said; Are you going to buy this horse or shall I sell it? The Prophet stood up when he heard him calling and said: Have I not bought it from you? He said: No; by Allah; I have not sold it to you; and the Prophet said I bought it from you. The people started to gaiter around the Prophet and the Bedouion as they were talking; and the Bedouin started to say: Bring a witness who will testify that you bought it. Then cease prayer; for at that time the Hell-fire is heated up and doors of Hell are opened. When the sun declines; pray as much as you like; for the prayer is witnessed till you pray the afternoon prayer; then cease prayer till the sun sets; for it sets between the horns of the Devil; and at that time the infidels offer prayer for it. He narrated a lengthy tradition. Abbas said: Abu Salam narrated this tradition in a similar manner from Abu Umamah. I swear by Allaah; I shall ask the Apostle of Allaah ﷺ about it. On the next day he came to the Apostle of Allaah ﷺ and said If a man finds a man along with wife and declares about her adultery you will flog him. He kept on praying until the verses regarding invoking curses lian came down As for those who accuse their wives but have no witnesses except themselves. The man bore witness before Allaah four times that the thing he said was indeed true. He then invoked curse of Allaah on him for the fifth time if he was a liar. She then wanted to invoke curses of Allaah on him. The Prophet ﷺ said Do not do that. Bust she refused and did so i.e.; invoked curses. SunanAbuDawoud-017-001-25095 | Ibn Abbas said Hilal Bin Umayah was one of the three persons whose repentance was accepted by Allaah. One night he returned from his land and found a man along with his wife. He witnessed with his eyes and heard with his ears. He did not threaten him till the morning. Next day he went to the Apostle of Allaah ﷺ in the morning and said Apostle of Allaah ﷺ I came to my wife in the night and found a man along with her. I saw with my own eyes and heard with my own ears. The Apostle of Allaah ﷺ disliked what he described and he took it seriously. There upon the following Quranic verse came down And those who make charges against their spouses but have no witnesses except themselves; let the testimony of one of them.... When the Apostle of Allaah ﷺ came to himself after the revelation ended he said Glad tidings to you Hilal; Allaah the exalted has made ease and a way out for you. Hilal said I expected that from my Lord. The Apostle of Allaah ﷺ said Send for her. She then came. The Apostle of Allaah ﷺ recited the verses to them and he reminded them and told them that the punishment in the next world was more severe than that in n this world. Hilal said I swear by Allah I spoke the truth against her. She said He told a lie. The Apostle of Allaah ﷺ said Apply the method of invoking curses on one another. Hilal was told Bear witness. So he bore witness before Allaah four times that he spoke the truth. When he was about to utter the fifth time he was told Hilal fear Allah; for the punishment in this world is easier than that in the next world and this is the deciding one; that will surely cause punishment to you. He said I swear by Allaah. Allah will not punish me for this act ; as He did not cause me to be flogged for this act. So he bore witness a fifth time invoking the curse of Allah on him if he was of those who tell a lie. Then the people said to her; Testify. So she gave testimony before Allaah that he was a liar. When she was going to testify the fifth time she was told Fear Allah; for the punishment in this world is easier than that in the next world. This is the deciding one that will surely cause punishment to you. She hesitated for a moment. And then said By Allah; I will not disgrace my people. So she testified a fifth time invoking the curse of Allah on her if he spoke the truth. Apostle of Allaah ﷺ separated them from each other and decided that the child will not be attributed to its father. Neither she nor her child will be accused of adultery. He who accuses her or her child will be liable to punishment. He also decided that there will be no dwelling and maintenance for her from the husband as they were separated without divorce and death. He then said If she gives birth to a child with reddish hair; light buttocks; wide belly and light shins he will be the child of Hilal. If she bears a dusky child with curly hair; fat limbs; fat shins and fat buttocks he will be the child of the one who was accused of adultery. She gave birth to a child with curly hair; fat limbs; fat shins and fat buttocks. SunanAbuDawoud-017-001-26325 | Uqbah Bin Amir said: We served ourselves in the company of Messenger of Allah ﷺ. We tended our camels by turn. One day I had my turn to tend the camels; and I drove them in the afternoon. I found the Messenger of Allah ﷺ addressing the people. I heard him say: Anyone amongst you who performs ablution; and does it well; then he stands and offers two rakahs of prayer; concentrating on it with his heart and body; Paradise will be his lot by all means. I said: Ha-ha! How fine it is! A man in front of me said: The action mentioned by the Prophet earlier; O Uqbah; is finer that this one. I looked at him and found him to be Umar Bin AlKhattab. I asked him: What is that; O Abu Hafs? He replied: He the Prophet had said before you came: If any one of you performs ablution; and does it well; and when he finishes the ablution; he utters the words : I bear witness that there is no deity except Allah; He has no associate; and I bear witness that Muhammad is His Servant and His Messenger; all the eight doors of Paradise will be opened for him; he may enter through any of them. This version has: The people said to Saad Ibn Ubadah: Abu Thabit; the prescribed punishments have been revealed: if you find a man with your wife; what will you do? He said: I shall strike them with a sword so much that they become silent i.e. die. Should I go and gather four witnesses? Until that time the need would be fulfilled. The Messenger of Allah ﷺ walked quickly and the Bedouin walked slowly. The people stopped the Bedouin and began to bargain with him for the horse as and they did not know that the Prophet ﷺ had bought it. The Bedouin called the Messenger of Allah ﷺ saying: If you want this horse; then buy it ; otherwise I shall sell it. The Prophet ﷺ stopped when he heard the call of the Bedouin; and said: Have I not bought it from you? The Bedouin said: I swear by Allah; I have not sold it to you. The Prophet ﷺ said: Yes; I have bought it from you. The Bedouin began to say: Bring a witness. Khuzaymah Ibn Thabit then said: I bear witness that you have bought it. The Prophet ﷺ turned to Khuzaymah and said: On what grounds do you bear witness? He said: By considering you trustworthy; Messenger of Allah ﷺ ! I rode hurriedly to the Holy Prophet ﷺ and said: Peace be on you; Messenger of Allah; and the mercy of Allah and His blessings. Your contingent came to us and arrested us; but we had already embraced Islam and cut the sides of the ears of our cattle. When Banu AlAnbar arrived; the Holy Prophet ﷺ said to me: Have you any evidence that you had embraced Islam before you were captured today? I said: Yes. He said: Who is your witness? I said: Samurah; a man from Banu AlAnbar; and another man whom he named. The man testified but Samurah refused to testify. The Holy Prophet ﷺ said: He Samurah has refused to testify for you; so take an oath with your other witness. I said: Yes. He then dictated an oath to me and I swore to the effect that we had embraced Islam on a certain day; and that we had cut the sides of the ears of the cattle. SunanAbuDawoud-017-001-29385 | Narrated Abdullah Ibn Umar: Husayn Ibn AlHarith AlJadli from the tribe of Jadilah Qays said: The governor of Mecca delivered a speech and said: The Messenger of Allah ﷺ took a pledge from us that we should perform the rites of hajj after sighting the moon. If we do not sight it and two reliable persons bear witness; we should perform the rites of hajj on the basis of their witness. I then asked AlHusayn Ibn AlHarith: Who was the governor of Mecca? He replied: I do not know. He then met me later on and told me: He was AlHarith Ibn Hatib; brother of Muhammad Ibn Hatib. MuwataMalik-017-001-34887 | Malik related to me from Yahya Ibn Said from Abu Bakr Ibn Hazm that a boy from Ghassan was dying in Madina while his heir was in Syria. That was mentioned to Umar Ibn AlKhattab. It was said to him; So-and-so is dying. Shall he make a bequest? He said; Let him make a bequest. Yahya Ibn Said said that Abu Bakr had said; He was a boy of ten or twelve years. Yahya said; He willed the well of Jusham; and his people sold it for 30;000 dirhams. Yahya said that he heard Malik say; The generally agreed-on way of doing things in our community is that a simpleton; an idiot; or a lunatic who recovers at times; can make wills if they have enough of their wits about them to recognise what they will. MuwataMalik-017-001-34907 | Malik related to me that he heard that Abu Salama Ibn Abdulrahman and Sulayman Ibn Yasar were both asked; Does one pronounce judgement on the basis of an oath with one witness? They both said; Yes. Malik said; The precedent of the sunna in judging by an oath with one witness is that if the plaintiff takes an oath with his witness; he is confirmed in his right. If he draws back and refuses to take an oath; the defendant is made to take an oath. If he takes an oath; the claim against him is dropped. If he refuses to take an oath; the claim is confirmed against him. Malik said; This procedure pertains to property cases in particular. It does not occur in any of the hadd-punishments; nor in marriage; divorce; freeing slaves; theft or slander. If some one says; Freeing slaves comes under property; he has erred. It is not as he said. Had it been as he said; a slave could take an oath with one witness; if he could find one; that his master had freed him. However; when a slave lays claim to a piece of property; he can take an oath with one witness and demand his right as the freeman demands his right. Malik said; The sunna with us is that when a slave brings somebody who witnesses that he has been set free; his master is made to take an oath that he has not freed him; and the slave claim is dropped. Malik said; The sunna about divorce is also like that with us. When a woman brings somebody who witnesses that her husband has divorced her; the husband is made to take an oath that he has not divorced her. If he takes the oath; the divorce does not proceed. Malik said; There is only one sunna of bringing a witness in cases of divorce and freeing a slave. The right to make an oath only belongs to the husband of the woman; and the master of the slave. Freeing is a hadd matter; and the testimony of women is not permitted in it because when a slave is freed; his inviolability is affirmed and the hadd punishments are applied for and against him. If he commits fornication and he is a muhsan; he is stoned. If he kills a slave; he is killed for it. Inheritance is established for him; between him and whoever inherits from him. If somebody disputes this; arguing that if a man frees his slave and then a man comes to demand from the master of the slave payment of a debt; and a man and two women testify to his right; that establishes the right against the master of the slave so that his freeing him is cancelled if he only has the slave as property; inferring by this case that the testimony of women is permitted in cases of setting free. The case is not as he suggests i.e. it is a case of property not freeing. It is like a man who frees his slave; and then the claimant of a debt comes to the master and takes an oath with one witness; demanding his right. By that; the freeing of the slave would be cancelled. Or else a man comes who has frequent dealings and transactions with the master of the slave. He claims that he is owed money by the master of the slave. Someone says to the master of the slave; Take an oath that you dont owe what he claims. If he draws back and refuses to take an oath; the one making the claim takes an oath and his right against the master of the slave is confirmed. That would cancel the freeing of the slave if it is confirmed that property is owed by the master. Malik said; It is the same case with a man who marries a slave-girl and then the master of the slave-girl comes to the man who has married her and claims; You and so-and-so have bought my slave-girl from me for such an amount of dinars. The husband of the slave-girl denies that. The master of the slave-girl brings a man and two women and they testify to what he has said. The sale is confirmed and his claim is considered true. So the slave-girl is haram for her husband and they have to separate; even though the testimony of women is not accepted in divorce. Malik said; It is also the same case with a man who accuses a free man; so the hadd falls on him. A man and two women come and testify that the one accused is a slave. That would remove the hadd from the accused after it had befallen him; even though the testimony of women is not accepted in accusations involving hadd punishments. Malik said; Another similar case in which judgement appears to go against the precedent of the sunna is that two women testify that a child is born alive and so it is necessary for him to inherit if a situation arises where he is entitled to inherit; and the child property goes to those who inherit from him; if he dies; and it is not necessary that the two women witnesses should be accompanied by a man or an oath even though it may involve vast properties of gold; silver; live-stock; gardens and slaves and other properties. However; had two women testified to one dirham or more or less than that in a property case; their testimony would not affect anything and would not be permitted unless there was a witness or an oath with them. Malik said; There are people who say that an oath is not acceptable with only one witness and they argue by the word of Allah the Blessed; the Exalted; and His word is the Truth; And call in to witness two witnesses; men; or if the two be not men; then one man and two women; such witnesses as you approve of. Surat 2 ayat 282. Such people argue that if he does not bring one man and two women; he has no claim and he is not allowed to take an oath with one witness. Malik said; Part of the proof against those who argue this; is to reply to them; Do you think that if a man claimed property from a man; the one claimed from would not swear that the claim was false? If he swears; the claim against him is dropped. If he refuses to take an oath; the claimant is made to take an oath that his claim is true; and his right against his companion is established. There is no dispute about this with any of the people nor in any country. By what does he take this? In what place in the Book of Allah does he find it? So if he confirms this; let him confirm the oath with one witness; even if it is not in the Book of Allah; the Mighty; the Majestic! It is enough that this is the precedent of the sunna. However; man wants to recognise the proper course of action and the location of the proof. MuwataMalik-017-001-34908 | Yahya said that Malik spoke about a man who died and had a debt owing to him and there was one witness; and some people had a debt against him and they had only one witness; and his heirs refused to take an oath on their rights with their witness. He said; The creditors take an oath and take their rights. If there is anything left over; the heirs do not take any of it. That is because the oaths were offered to them before and they abandoned them; unless they say; We did not know that our companion had extra; and it is known that they only abandoned the oaths because of that. It is only permitted between them if they testify before they leave the scene of the incident and have been deceived or instructed. MuwataMalik-017-001-34954 | Yahya said that he heard Malik say; What is done in our community about some one who gives a gift not intending a reward is that he calls witnesses to it. It is affirmed for the one to whom it has been given unless the giver dies before the one to whom it was given receives the gift. He said; If the giver wants to keep the gift after he has had it witnessed; he cannot. If the recipient claims it from him; he takes it. Malik said; If some one gives a gift and then withdraws it and the recipient brings a witness to testify for him that he was given the gift; be it goods; gold; silver or animals; the recipient is made to take an oath. If he refuses; the giver is made to take an oath. If he also refuses to take an oath; he gives to the recipient what he claims from him if he has at least one witness. If he does not have a witness; he has nothing. Malik said; If someone gives a gift not expecting anything in return and then the recipient dies; the heirs are in his place. If the giver dies before the recipient has received his gift; the recipient has nothing. That is because he was given a gift which he did not take possession of. If the giver wants to keep it; and he has called witnesses to the gift; he cannot do that.
