When ye deal with each other, in transactions involving future obligations in a fixed period of time, reduce them to writing Let a scribe write down faithfully as between the parties: let not the scribe refuse to write: as Allah Has taught him, so let him write. Let him who incurs the liability dictate, but let him fear His Lord Allah, and not diminish aught of what he owes. If they party liable is mentally deficient, or weak, or unable Himself to dictate, Let his guardian dictate faithfully, and get two witnesses, out of your own men, and if there are not two men, then a man and two women, such as ye choose, for witnesses, so that if one of them errs, the other can remind her. The witnesses should not refuse when they are called on (For evidence). Disdain not to reduce to writing (your contract) for a future period, whether it be small or big: it is juster in the sight of Allah, More suitable as evidence, and more convenient to prevent doubts among yourselves but if it be a transaction which ye carry out on the spot among yourselves, there is no blame on you if ye reduce it not to writing. But take witness whenever ye make a commercial contract; and let neither scribe nor witness suffer harm. If ye do (such harm), it would be wickedness in you. So fear Allah; For it is Good that teaches you. And Allah is well acquainted with all things. If ye are on a journey, and cannot find a scribe, a pledge with possession (may serve the purpose). And if one of you deposits a thing on trust with another, let the trustee (faithfully) discharge his trust, and let him Fear his Lord conceal not evidence; for whoever conceals it, - his heart is tainted with sin. SahihAlBukhari-017-001-4822 | Narrated Urwa: That Aisha told him that Buraira came to seek her help in her writing of emancipation for a certain sum and that time she had not paid anything of it. Aisha said to her; Go back to your masters; and if they agree that I will pay the amount of your writing of emancipation and get your Wala; I will do so. Buraira informed her masters of that but they refused and said; If she i.e. Aisha is seeking Allah reward; then she can do so; but your Wala will be for us. Aisha mentioned that to Allah Apostle who said to her; Buy and manumit her; as the Wala is for the liberator. SahihAlBukhari-017-001-6170 | Narrated Ubaidullah Bin Abdullah: Ibn Abbas said; When the ailment of the Prophet ﷺ became worse; he said; Bring for me writing paper and I will write for you a statement after which you will not go astray. But Umar said; The Prophet is seriously ill; and we have got Allah Book with us and that is sufficient for us. But the companions of the Prophet ﷺ differed about this and there was a hue and cry. On that the Prophet ﷺ said to them; Go away and leave me alone. It is not right that you should quarrel in front of me. Ibn Abbas came out saying; It was most unfortunate a great disaster that Allah Messenger ﷺ was prevented from writing that statement for them because of their disagreement and noise. Note: It is apparent from this Hadith that Ibn Abbas had witnessed the event and came out saying this statement. SahihMuslim-017-001-19418 | Abdullah Bin Masud reported that Allah Messenger ﷺ who is the most truthful of the human beings and his being truthful is a fact said: Verily your creation is on this wise. The constituents of one of you are collected for forty days in his mother womb in the form of blood; after which it becomes a clot of blood in another period of forty days. Then it becomes a lump of flesh and forty days later Allah sends His angel to it with instructions concerning four things; so the angel writes down his livelihood; his death; his deeds; his fortune and misfortune. SunanAlTermithi-017-001-9963 | Narrated Ibn Abbas: I said to Uthman Bin Affan: What was your reasoning with AlAnfal - while it is from the Muthani Surah with less than one-hundred Ayat ; and Baraah while it is from the Miin Surah with about one-hundred Ayat ; then you put them together; without writing the line Bismillahir-Rahmanir-Rahim between them; and you placed them with the seven long Surah - why did you do that? So Uthman said: A long time might pass upon the Messenger of Allah ﷺ without anything being revealed to him; and then sometimes a Surah with numerous Ayat might be revealed. So when something was revealed; he would call for someone who could write; and say: Put these Ayat in the Surah which mentions this and that in it. When an Ayah was revealed; he would say: Put this Ayah in the Surah which mentions this and that in it. Now AlAnfal was among the first of those revealed in AlMadinah; and Baraah among the last of those revealed of the Quran; and its narrations those of Baraah resembled its narrations those of AlAnfal ; so we thought that it was part of it. Then the Messenger of Allah ﷺ died; and it was not made clear to us whether it was part of it. SunanAbuDawoud-017-001-25682 | Abu Huraira said When Allah; the Exalted; granted the conquest of Makkah to his Apostle; the Prophet ﷺ stood among them the people and praised Allaah and extolled Him. He then said; Verily Allaah stopped the Elephant from Makkah; and gave His Apostle and the believers sway upon it and it has been made lawful for me only for one hour on one day then it will remain sacred till the Day of Resurrection. Its trees are not to be cut; its game is not to be molested and the things dropped there are to be picked up only by one who publicly announces it. Abbas or AlAbbas suggested Apostle of Allaah ﷺ except the rush idhkir for it is useful for our graves and our houses. The Apostle of Allaah ﷺ said Except the rush. Abu Dawud said Ibn AlMusaffa added on the authority of AlWalid Abu Shah a man from the people of the Yemen stood and said Give me in writing; Apostle of Allaah ﷺ. MuwataMalik-017-001-34885 | Malik related to me from Nafi from Abdullah Ibn Umar that the Messenger of Allah; may Allah bless him and grant him peace; said; It is the duty of a muslim man who has something to be given as a bequest not to spend two nights without writing a will about it. Malik said; The generally agreed-on way of doing things in our community is that when the testator writes something in health or illness as a bequest; and it has freeing slaves or things other than that in it; he can alter it in any way he chooses; until he is on his deathbed. If he prefers to abandon a bequest or change it; he can do so unless he has made a slave mudabbar to be freed after his death. If he has made him mudabbar; there is no way to change what he has made mudabbar. He is allowed to change his testament because the Messenger of Allah; may Allah bless him and grant him peace; said; It is the duty of a muslim man who has something to be given as a bequest not to spend two nights without writing a will about it. Malik explained; Had the testator not been able to change his will nor what was mentioned in it about freeing slaves; each testator might withhold making bequests from his property; whether in freeing slaves or other than it. A man gives a bequest in his health and in his travelling. i.e. he does not wait till his death bed.
