Say: Allah directs (thus) about those who leave no descendants or ascendants as heirs. If it is a man that dies, leaving a sister but no child, she shall have half the inheritance: If (such a deceased was) a woman, who left no child, Her brother takes her inheritance: If there are two sisters, they shall have two-thirds of the inheritance (between them): if there are brothers and sisters, (they share), the male having twice the share of the female. Thus doth Allah make clear to you (His law), lest ye err. And Allah hath knowledge of all things.

In what ye leave, their share is a fourth, if ye leave no child; but if ye leave a child, they get an eighth; after payment of legacies and debts. If the man or woman whose inheritance is in question, has left neither ascendants nor descendants, but has left a brother or a sister, each one of the two gets a sixth; but if more than two, they share in a third; after payment of legacies and debts; so that no loss is caused (to any one). Thus is it ordained by Allah; and Allah is All-knowing, Most Forbearing.

And if they carry (life in their wombs), then spend (your substance) on them until they deliver their burden: and if they suckle your (offspring), give them their recompense: and take mutual counsel together, according to what is just and reasonable. And if ye find yourselves in difficulties, let another woman suckle (the child) on the (father's) behalf.

But he shall bear the cost of their food and clothing on equitable terms. No soul shall have a burden laid on it greater than it can bear. No mother shall be Treated unfairly on account of her child. Nor father on account of his child, an heir shall be chargeable in the same way. If they both decide on weaning, by mutual consent, and after due consultation, there is no blame on them. If ye decide on a foster-mother for your offspring, there is no blame on you, provided ye pay (the mother) what ye offered, on equitable terms. But fear Allah and know that Allah sees well what ye do.
Surat Alaaraf Ayah 189Surat Alaaraf0.1637هُوَ الَّذِي خَلَقَكُمْ مِنْ نَفْسٍ وَاحِدَةٍ وَجَعَلَ مِنْهَا زَوْجَهَا لِيَسْكُنَ إِلَيْهَا فَلَمَّا تَغَشَّاهَا حَمَلَتْ حَمْلًا خَفِيفًا فَمَرَّتْ بِهِ فَلَمَّا أَثْقَلَتْ دَعَوَا اللَّهَ رَبَّهُمَا لَئِنْ آتَيْتَنَا صَالِحًا لَنَكُونَنَّ مِنَ الشَّاكِرِينَIt is He Who created you from a single person, and made his mate of like nature, in order that he might dwell with her (in love). When they are united, she bears a light burden and carries it about (unnoticed). When she grows heavy, they both pray to Allah their Lord, (saying): "If Thou givest us a goodly child, we vow we shall (ever) be grateful."

Behold! I am delivered of a female child!"- and Allah knew best what she brought forth- "And no wise is the male Like the female. I have named her Mary, and I commend her and her offspring to Thy protection from the Evil One, the Rejected."
Surat AlAhqaf Ayah 15Surat AlAhqaf0.2963وَوَصَّيْنَا الْإِنْسَانَ بِوَالِدَيْهِ إِحْسَانًا حَمَلَتْهُ أُمُّهُ كُرْهًا وَوَضَعَتْهُ كُرْهًا وَحَمْلُهُ وَفِصَالُهُ ثَلَاثُونَ شَهْرًا حَتَّى إِذَا بَلَغَ أَشُدَّهُ وَبَلَغَ أَرْبَعِينَ سَنَةً قَالَ رَبِّ أَوْزِعْنِي أَنْ أَشْكُرَ نِعْمَتَكَ الَّتِي أَنْعَمْتَ عَلَيَّ وَعَلَى وَالِدَيَّ وَأَنْ أَعْمَلَ صَالِحًا تَرْضَاهُ وَأَصْلِحْ لِي فِي ذُرِّيَّتِي إِنِّي تُبْتُ إِلَيْكَ وَإِنِّي مِنَ الْمُسْلِمِينَWe have enjoined on man kindness to his parents: In pain did his mother bear him, and in pain did she give him birth. The carrying of the (child) to his weaning is (a period of) thirty months. At length, when he reaches the age of full strength and attains forty years, he says, "O my Lord! Grant me that I may be grateful for Thy favour which Thou has bestowed upon me, and upon both my parents, and that I may work righteousness such as Thou mayest approve; and be gracious to me in my issue. Truly have I turned to Thee and truly do I bow (to Thee) in Islam."

So in the year of Conquest of Mecca; Saad took him and said. This is my brother son whom my brother has asked me to take into my custody. Abd Bin Zama got up before him and said; He is my brother and the son of the slave girl of my father; and was born on my father bed. So they both submitted their case before Allah Apostle. Saad said; O Allah Messenger ﷺ ! This boy is the son of my brother and he entrusted him to me. Abd Bin Zama said; This boy is my brother and the son of the slave girl of my father; and was born on the bed of my father. Allah Messenger ﷺ said; The boy is for you; O Abd Bin Zama! Then Allah Apostle further said; The child is for the owner of the bed; and the stone is for the adulterer; He then said to Sauda bint Zama; Veil screen yourself before him; when he saw the child resemblance to Utba. SahihAlBukhari-017-001-1437Narrated Sahl Bin Saad AlSaidi: Uwaimir AlAjlani came to Aasi m Bin Adi and said; If a man found another man with his wife and killed him; would you sentence the husband to death in Qisas; i.e.; equality in punishment ? O Aasi m! Please ask Allah Messenger ﷺ about this matter on my behalf. Aasi m asked the Prophet ﷺ but the Prophet disliked the question and disapproved of it. Aasi m returned and informed Uwaimir that the Prophet disliked that type of question. Uwaimir said; By Allah; I will go personally to the Prophet. Uwaimir came to the Prophet ﷺ when Allah had already revealed Quranic Verses in that respect ; after Aasi m had left the Prophet ﷺ. So the Prophet ﷺ said to Uwaimir; Allah has revealed Quranic Verses regarding you and your wife. The Prophet ﷺ then called for them; and they came and carried out the order of Lian. Then Uwaimir said; O Allah Messenger ﷺ ! Now if I kept her with me; I would be accused of telling a lie. So Uwaimir divorced her although the Prophet ﷺ did not order him to do so. Later on this practice of divorcing became the tradition of couples involved in a case of Lian. The Prophet ﷺ said to the people. Wait for her! If she delivers a red short small child like a Wahra a short red animal. then I will be of the opinion that he Uwaimir has told a lie but if she delivered a black big-eyed one with big buttocks; then I will be of the opinion that he has told the truth about her. Ultimately she gave birth to a child that proved the accusation. So both of them sought the judgment of the Prophet David who judged that the boy should be given to the older lady. Allah Messenger ﷺ returned the messenger and told him to convey his greetings to her; and say; Whatever Allah takes; is for Him and whatever He gives is for Him; and everything with Him has a limited fixed term in this world : so she should be patient and hope for Allah reward. Then she again sent for him swearing that he should come; so The Prophet ﷺ got up; and so did we. When he sat there at the house of his daughter ; the child was brought to him; and he took him into his lap while the child breath was disturbed in his chest. SahihAlBukhari-017-001-292Narrated Ibn Shihab: The funeral prayer should be offered for every child even if he were the son of a prostitute as he was born with a true faith of Islam i.e. to worship none but Allah Alone. If his parents are Muslims; particularly the father; even if his mother were a non-Muslim; and if he after the delivery cries even once before his death i.e. born alive then the funeral prayer must be offered. And if the child does not cry after his delivery i.e. born dead then his funeral prayer should not be offered; and he will be considered as a miscarriage. Abu Huraira; narrated that the Prophet ﷺ said; Every child is born with a true faith i.e. to worship none but Allah Alone but his parents convert him to Judaism or to Christianity or to Magainism; as an animal delivers a perfect baby animal. SahihAlBukhari-017-001-3176Narrated Ibn Juraij: Ibn Shihab informed me of Lian and the tradition related to it; referring to the narration of Sahl Bin Sad; the brother of Bani Saidi He said; An Ansari man came to Allah Messenger ﷺ and said; O Allah Apostle! If a man saw another man with his wife; should he kill him; or what should he do? So Allah revealed concerning his affair what is mentioned in the Holy Quran about the affair of those involved in a case of Lian. The Prophet ﷺ said; Allah has given His verdict regarding you and your wife. So they carried out Lian in the Masjid while I was present there. When they had finished; the man said; O Allah Messenger ﷺ ! If I should now keep her with me as a wife then I have told a lie about her. Then he divorced her thrice before Allah Messenger ﷺ ordered him; when they had finished the Lian process. So he divorced her in front of the Prophet ﷺ. Ibn Shihab added; After their case; it became a tradition that a couple involved in a case of Lian should be separated by divorce. That lady was pregnant then; and later on her son was called by his mother name. The tradition concerning their inheritance was that she would be his heir and he would inherit of her property the share Allah had prescribed for him. Ibn Shihab said that Sahl Bin Saad AsSaidi said that the Prophet ﷺ said in the above narration ; If that lady delivers a small red child like a lizard; then the lady has spoken the truth and the man was a liar; but if she delivers a child with black eyes and huge lips; then her husband has spoken the truth. They then went to Sulaiman Bin Dawud may there be peace upon both of them and told them the story. He said: Bring me a knife so that I may cut him the child into two parts for you. The younger one said: No; it cant be; may Allah have mercy upon you; he the child belongs to her the elder. So he gave a decision in favour of the younger one. Abu Huraira said: If ever I heard of the word AlSikin at all; it was that day. SahihMuslim-017-001-17384Sulaiman Bin Buraida reported on the authority of his father that Ma; iz Bin Malik came to Allah Apostle ﷺ and said to him: Messenger of Allah; purify me; whereupon he said: Woe be upon you; go back; ask forgiveness of Allah and turn to Him in repentance. He the narrator said that he went back not far; then came and said: Allah Messenger; purify me. whereupon Allah Messenger ﷺ said: Woe be upon you; go back and ask forgiveness of Allah and turn to Him in repentance. He the narrator said that he went back not far; when he came and said: Allah Messenger; purify me. Allah Apostle ﷺ said as he had said before. When it was the fourth time; Allah Messenger may; ﷺ said: From what am I to purify you? He said: From adultery; Allah Messenger ﷺ asked if he had been mad. He was informed that he was not mad. He said: Has he drunk wine? A person stood up and smelt his breath but noticed no smell of wine. Thereupon Allah Messenger ﷺ said: Have you committed adultery? He said: Yes. He made pronouncement about him and he was stoned to death. The people had been divided into two groups about him Maiz. One of them said: He has been undone for his sins had encompassed him; whereas another said: There is no repentance more excellent than the repentance of Maiz; for he came to Allah Apostle ﷺ and placing his hand in his in the Holy Prophets hand said: Kill me with stones. This controversy about Maiz remained for two or three days. Then came Allah Messenger ﷺ to them his Companions as they were sitting. He greeted them with salutation and then sat down and said: Ask forgiveness for Maiz Bin Malik. They said: May Allah forgive Maiz Bin Malik. Thereupon Allah Messenger ﷺ said: He Maiz has made such a repentance that if that were to be divided among a people; it would have been enough for all of them. He the narrator said: Then a woman of Ghamid; a branch of Azd; came to him and said: Messenger of of Allah; purify me; whereupon he said: Woe be upon you; go back and beg forgiveness from Allah and turn to Him in repentance. She said: I find that you intend to send me back as you sent back Maiz. Bin Malik. He the Holy; Prophet said: What has happened to you? She said that she had become pregnant as a result of fornication. He the Holy Prophet said: Is it you who has done that ? She said: Yes. He the Holy Prophet said to her: You will not be punished until you deliver what is there in your womb. One of the Ansar became responsible for her until she was delivered of the child. He that Ansari came to Allah Apostle ﷺ and said the woman of Ghamid has given birth to a child. He the Holy Prophet said: In that case we shall not stone her and so leave her infant with none to suckle him. One of the Ansar got up and said: Allah Apostle; let the responsibility of his suckling be upon me. SahihMuslim-017-001-17385Abdullah Bin Buraida reported on the authority of his father that Maiz Bin Malik AlAslami came to Allah Messenger ﷺ and said: Allah Messenger; I have wronged myself; I have committed adultery and I earnestly desire that you should purify me. He turned him away. On the following day; he Maiz again came to him and said: Allah Messenger; I have committed adultery. Allah Messenger ﷺ turned him away for the second time; and sent him to his people saying: Do you know if there is anything wrong with his mind. They denied of any such thing in him and said: We do not know him but as a wise good man among us; so far as we can judge. He Maiz came for the third time; and he the Holy Prophet sent him as he had done before. He asked about him and they informed him that there was nothing wrong with him or with his mind. When it was the fourth time; a ditch was dug for him and he the Holy Prophet pronounced judg- ment about him and he wis stoned. He the narrator said: There came to him the Holy Prophet a woman from Ghamid and said: Allah Messenger; I have committed adultery; so purify me. He the Holy Prophet turned her away. On the following day she said: Allah Messenger; Why do you turn me away? Perhaps; you turn me away as you turned away Maiz. By Allah; I have become pregnant. He said: Well; if you insist upon it; then go away until you give birth to the child. When she was delivered she came with the child wrapped in a rag and said: Here is the child whom I have given birth to. He said: Go away and suckle him until you wean him. When she had weaned him; she came to him the Holy Prophet with the child who was holding a piece of bread in his hand. She said: Allah Apostle; here is he as I have weaned him and he eats food. He the Holy Prophet entrusted the child to one of the Muslims and then pronounced punishment. And she was put in a ditch up to her chest and he commanded people and they stoned her. Khalid b Walid came forward with a stone which he flung at her head and there spurted blood on the face of Khalid and so he abused her. Allah Apostle ﷺ heard his Khalids curse that he had huried upon her. Thereupon he the Holy Prophet said: Khalid; be gentle. By Him in Whose Hand is my life; she has made such a repentance that even if a wrongful tax-collector were to repent; he would have been forgiven. SahihMuslim-017-001-19679Abu Huraira reported that Juraij was one who was devoted to prayer in the temple. His mother came to him. Humaid said that Abu Rafi demonstrated before us like the demonstration made by Abu Huraira to whom Allah Messenger ﷺ had demonstrated as his mother called him placing her palms upon the eyebrows and lifting her head for calling him and said: Juraij; it is your mother; so talk to her. She found him at that time absorbed in prayer; so he said to himself : O Lord; my mother is calling me whereas I am absorbed in my prayer. He opted for prayer. She his mother went back; then came again for the second time and said: O Juraij; it is your mother calling you ; so talk to me. He said: O Allah. there is my mother also and my prayer; and he opted for prayer. She said: O Allah; this Juraij is my son. I pray to talk to him but he refuses to talk to me. O Allah; dont bring death to him unless he has seen the prostitutes; and had she invoked the curse upon him from the heart of her heart he would have been involved in some turmoil. There was a shepherd living near by his temple the temple where Juraij was engaged in prayer. It so happened that a woman of that village came there and that shepherd committed fornication with her and she became pregnant and gave birth to a child. It was said to her: Whose child is this? She said: He is the child of one who is living in this temple. So there came persons with hatchets and spades. They called Juraij. He was absorbed in prayer and he did not talk to them and they were about to demolish that temple that he saw them and then came to them and they said: Ask her this woman what she says. He smiled and then touched the head of the child and said: Who is your father? He the child said: My father is the shepherd of the sheep; and when they heard this; they said: We are prepared to rebuild with gold and silver what we have demolished from your temple. Juraij had got constructed a temple and confined himself in that. His mother came to him as he was busy in prayer and she said: Juraij. He said: My Lord; my mother is calling me while I am engaged in my prayer. He continued with the prayer. She returned and she came on the next day and he was busy in prayer; and she said: Juraij. And he said: My Lord; my mother is calling me while I am engaged in prayer; and he continued with the prayer and she went back; and then on the next day she again came and he was busy in prayer and she said: Juraij. And he said: My Lord; my mother is calling me while I am engaged in my prayer; and he continued with the prayer; and she said: My Lord; dont give him death unless he has seen the fate of the prostitutes. The story of Juraij and that of his meditation and prayer gained currency amongst Bani Israil. There was a prostitute who had been a beauty incarnate. She said to the people : If you like I can allure him to evil. She presented herself to him but he paid no heed to her. She came to a shepherd who lived near the temple and she offered herself to him and he had a sexual intercourse with her and so she became pregnant arid when she gave birth to a child she said: This is from Juraij. So they came and asked him to get down and demolished the temple and began to beat him. He said: What is the matter? They said: You have committed fornication with this prostitute and she has given birth to a child from your loins. He said: Where is the child? They brought him the child and he said: just leave me so that I should observe prayer. And he observed prayer and when he finished; he came to the child. He struck his stomach and said: O boy; who is your father? lie said: He is such shepherd. So they turned towards Juraij; kissed him and touched him for seeking blessing and said: We are prepared to construct your temple with gold. He said. No; just rebuild it with mud as it had been; and they did that. Then there was a babe who was sucking his mother that a person dressed in fine garment came riding upon a beast. His mother said: O Allah; make my child like this one. He the babe left sucking and began to see towards him; and said: O Allah; dont make me like him. He then returned to the chest and began to suck the milk of his mother. He Abu Huraira said: I perceived as if I am seeing Allah Messenger ﷺ as he is explaining the scene of his sucking milk with his forefinger in his mouth and sucking that. He Abu Huraira further reported Allah Apostle may be peace upon him as saying: There happened to pass by him a girl who was being beaten and they were saying: You have committed adultery and you have committed theft and she was saying: Allah is enough for me and He is my good Protector; and his mother said: O Allah; dont make my child like her and he left sucking the milk; and looked towards her and said: O Allah; make me like her; and there was a talk between them. She said: O with shaven head; a good-looking person happened to pass by and I said: O Allah; make my child like him; and you said: O Allah; dont make me like him; and they passed by a girl while they were beating her and saying: You committed fornication and you committed theft; and I said: O Allah; dont make my child like her; and you said: O Allah; make me like her. She served him the evening meal and he took it. He then came to her and had sexual intercourse with her and when it was all over she said: Make arrangements for the burial of the child. He came to the Prophet and told him about that. The Prophet said: Bring four witnesses; otherwise you will feel the Hadd punishment on your back. And he repeated that several times. Hilal said to him: By Allah; O Messenger of Allah! Allah; the Mighty and Sublime; knows that I am telling the truth; and Allah; the Mighty and Sublime; will certainly reveal to you that which will spare my back from the whip. While they were like that; the Verse of Lian was revealed to him: As to those who accuse their wives. He called Hilal and he bore witness four times by Allah that he was telling the truth; and the fifth time he invoked the curse of Allah upon him if he were lying. Then he called the woman and she bore witness four times by Allah that he was lying. When it came to the fourth or fifth time; the Messenger of Allah said: Stop her; for it will inevitably bring the punishment of Allah upon the liar. She hesitated until we thought that she was going to confess; then she said: I will not dishonor my people today. Then she went ahead with the oath. The Messenger of Allah said: Wait and see. If she produces a child who is white; with straight hair and Qadiya eyes; then he belongs to Hilal Bin Umayah; but if she produces a child who is dark with curly hair; of average size and with narrow calves; then he belongs to Sharik Bin AlSahma. The Prophet ﷺ said Produce evidence or you must receive punishment on your back. He said Apostle of Allaah ﷺ when one of us sees a man having intercourse with his wife should he go and seek evidence? But the Prophet ﷺ merely said You must produce evidence or you must receive punishment on your back. Hilal then said By Him Who sent you with the Truth; I am speaking Truly. May Allaah send down something which will free my back from punishment. Then the following Quranic verses were revealed And those who make charges against their spouses but have no witnesses except themselves reciting till he reached one of those who speak the truth. The Prophet ﷺ then returned and sent for them and they came to him. Hilal Bin Umayah stood up and testified and the Prophet ﷺ was saying Allaah knows that one of you is lying. Will one of you repent? Then the woman got up and testified; but when she was about to do it a fifth time saying that Allaahs anger be upon her if he was one of those who spoke the truth; they said to her this is the deciding one. Ibn Abbas said She then hesitated and drew back so that we thought the she would withdraw what she said Look and see whether she gives birth to a child with eyes looking as if they have antimony in them; wide buttocks and fat legs; if she did. Sharik Bin Sahma will be its father. She then gave birth to a child of a similar description. The Prophet ﷺ thereupon said If it were not for what has already been stated in Allaahs book I would have dealt severely with her.Abu Dawud said This tradition has been transmitted by the people of Medina alone. One night he returned from his land and found a man along with his wife. He witnessed with his eyes and heard with his ears. He did not threaten him till the morning. Next day he went to the Apostle of Allaah ﷺ in the morning and said Apostle of Allaah ﷺ I came to my wife in the night and found a man along with her. I saw with my own eyes and heard with my own ears. The Apostle of Allaah ﷺ disliked what he described and he took it seriously. There upon the following Quranic verse came down And those who make charges against their spouses but have no witnesses except themselves; let the testimony of one of them.... When the Apostle of Allaah ﷺ came to himself after the revelation ended he said Glad tidings to you Hilal; Allaah the exalted has made ease and a way out for you. Hilal said I expected that from my Lord. The Apostle of Allaah ﷺ said Send for her. She then came. The Apostle of Allaah ﷺ recited the verses to them and he reminded them and told them that the punishment in the next world was more severe than that in n this world. Hilal said I swear by Allah I spoke the truth against her. She said He told a lie. The Apostle of Allaah ﷺ said Apply the method of invoking curses on one another. Hilal was told Bear witness. So he bore witness before Allaah four times that he spoke the truth. When he was about to utter the fifth time he was told Hilal fear Allah; for the punishment in this world is easier than that in the next world and this is the deciding one; that will surely cause punishment to you. He said I swear by Allaah. Allah will not punish me for this act ; as He did not cause me to be flogged for this act. So he bore witness a fifth time invoking the curse of Allah on him if he was of those who tell a lie. Then the people said to her; Testify. So she gave testimony before Allaah that he was a liar. When she was going to testify the fifth time she was told Fear Allah; for the punishment in this world is easier than that in the next world. This is the deciding one that will surely cause punishment to you. She hesitated for a moment. And then said By Allah; I will not disgrace my people. So she testified a fifth time invoking the curse of Allah on her if he spoke the truth. Apostle of Allaah ﷺ separated them from each other and decided that the child will not be attributed to its father. Neither she nor her child will be accused of adultery. He who accuses her or her child will be liable to punishment. He also decided that there will be no dwelling and maintenance for her from the husband as they were separated without divorce and death. He then said If she gives birth to a child with reddish hair; light buttocks; wide belly and light shins he will be the child of Hilal. If she bears a dusky child with curly hair; fat limbs; fat shins and fat buttocks he will be the child of the one who was accused of adultery. She gave birth to a child with curly hair; fat limbs; fat shins and fat buttocks. The Apostle of Allaah ﷺ said Had there been no oaths; I would have dealt with her severely.Ikrimah said Later on he became the chief of the tribe of Mudar. SunanAbuDawoud-017-001-25111Aisha wife of the Prophet ﷺ said Marriage in pre Islamic times was of four kinds. One of them was the marriage contracted by the people today. A man asked another man to marry his relative sister or daughter to him. He fixed the dower and married her to him. Another kind of marriage was that a man asked his wife when she became pure from menstruation to send fro so and so and have sexual intercourse with him. Her husband kept himself aloof and did not have intercourse with her till It became apparent that she was pregnant from the man who had intercourse with her. When it was manifest that she was pregnant; her husband approached her if he liked. This marriage was called istibda to utilize man for intercourse for a noble birth. A third kind of marriage was that a group of people less than ten in number entered upon a woman and had intercourse with her. When she conceived gave birth to a child and a number of days passed after her delivery; she sent for them. No one of them could refuse to attend and they gathered before her. She said to them You have realized your affair. I have now given birth to a child. And this is your son. O so and so. She called the name of anyone of them she liked and the child was attributed to him. A fourth kind of marriage was that many people gathered together and entered upon a woman who did not prevent anyone who came to her. They were prostitutes. They hoisted flags at their doors which served as a sign for the one who intended to enter upon them. When she became pregnant and delivered the child ; they got together before her and called for the experts of tracing relationship from physical features. They attributed the child to whom they considered and it was given to him. The child was called his son and he could not deny. So; Umar Bin Abdullah wrote in reply to Abdullah Bin Utbah informing him what she told him. She told that she was under i.e.; the wife of Sad Bin Khawlah who belonged to Banu Amir Bin Luway. He was one of those who participated in the battle of Badr. He died at the Farwell Pilgrimage while she was pregnant. Soon after his death she gave birth to a child. When she was purified from her bleeding after child birth she adorned herself for seekers in marriage. Then Abu AlSanabil Bin Bakah a man from Banu Abd AlDar entered upon her and said to her What is the matter seeing you adorned; perhaps you are seeking marriage? MuwataMalik-017-001-34745Yahya said that Malik said; When the relatives of the deceased accept the blood-money then it is inherited according to the Book of Allah. Daughters of the dead man inherit and so do sisters; and whichever women would inherit from him ordinarily. If the women do not take all his inheritance; then what remains goes to the agnatic relations who most deserve to inherit from him in conjunction with the women. Malik said; When one of the heirs of a man killed by mistake attempts to take his due from the blood-money while his companions are absent; he may not do that; and he has no right to any of the blood-money; however large or small; unless the qasama has been completed by him. If he swears fifty oaths then he has the right to his portion of the blood-money. That is because the blood-money is not established as due without there being fifty oaths; and the blood- money is not established as due unless the responsibility for the blood is established. If any one of the heirs comes after that he swears a number of the oaths commensurate with his fraction of the inheritance and takes his right until all the heirs exact their complete right. If a maternal uncle comes he has one sixth and must swear one sixth of the fifty oaths. So whoever swears may take his due from the blood-money and whoever abstains annuls his right. If one of the heirs is absent or is a child who has not reached puberty; those who are present swear fifty oaths and if the one who was absent comes after that or the child reaches puberty; they swear. and they swear according to their due of the blood-money and according to their shares of inheritance from it. When the slave-girl becomes pregnant; her value is estimated and he gives his partners their shares of the price and the slave-girl is his. That is what is done among us. Malik said about a man who made his slave-girl halal to a man that if the one for whom she was made halal had intercourse with her; her value was estimated on the day he had intercourse with her and he owed that to her owner whether or not she conceived. The hadd was averted from him by that. If she conceived the child was connected to him. MuwataMalik-017-001-34835Malik related to me that he had heard that Said Ibn AlMusayab was asked who had the wala of the children whom a slave had by a free woman. Said said; If their father dies and he is a slave who was not set free; their wala belongs to the mawali of their mother. Malik said; That is like the child of a woman who is a mawla who has been divorced by lian; the child is attached to the mawali of his mother and they are his mawali. If he dies; they inherit from him. If he commits a crime; they pay the blood-money for him. If his father acknowledges him; he is given a kinship to him and his wala goes to the mawali of his father. They are his heirs; they pay his blood-money and his father is punished with the hadd-punishment. Malik said; It is like that with a free-born woman divorced by lian. If her husband who curses her by lian does not acknowledge her child; the child is dealt with in the same way except that the rest of his inheritance after the inheritance of his mother and his brothers from his mother goes to all the muslims as long as he was not given kinship to his father. The child of the lian is attached to the patronage of the mawali of his mother until his father acknowledges him because he does not have a lineage or paternal relations. If his lineage is confirmed; it goes to his paternal relations. Malik said; The generally agreed-on way of doing things among us about a child of a slave by a free woman; while the father of the slave is free; is that the grandfather the father of the slave ; attracts the wala of his son free children by a free woman. They leave their inheritance to him as long as their father is a slave. If the father becomes free; the wala returns to his mawali. If he dies and he is still a slave; the inheritance and the wala go to the grandfather. If the slave has two free sons; and one of them dies while the father is still a slave; the grandfather; the father of the father; attracts the wala and the inheritance. Malik spoke about a slave-girl who was set free while she was pregnant and her husband was a slave and then her husband became free before she gave birth; or after she gave birth. He said; The wala of what is in her womb goes to the person who set the mother free because slavery touched the child before the mother was set free. It is not treated in the same way as a child conceived by its mother after she has been set free because the wala of such a child; is attracted by the father when he is set free. Muawiya wrote to him; Tie him up and do not inflict any retaliation on him. There is no retaliation against a madman. Malik said about an adult and a child when they murder a man together; The adult is killed and the child pays half the full blood-money. Malik said; It is like that with a freeman and a slave when they murder a slave. MuwataMalik-017-001-34845Yahya related to me from Malik that Ibn Shihab; Sulayman Ibn Yasar; and Rabia Ibn Abi Abdulrahman said; The blood-money of manslaughter is twenty yearlings; twenty two-year-olds; twenty male two-year-olds; twenty four-year-olds; and twenty five-year-olds. Malik said; The generally agreed on way with us is that there is no retaliation against children. Their intention is accidental. The hudud are not obliged for them if they have not yet reached puberty. If a child kills someone it is only accidentally. Had a child and an adult killed a free man accidentally; each of them pays half the full blood-money. Malik said; A person who kills someone accidentally pays blood-money with his property and there is no retaliation against him. That money is like anything else from the dead man property and his debt is paid with it and he is allowed to make a bequest from it. If he has a total property of which the blood-money is a third and then the blood-money is relinquished; that is permitted to him. MuwataMalik-017-001-34872Malik said that Ibn Shihab said; The precedent of the sunna in the intentional murder is that when the relatives of the murdered person relinquish retaliation; the blood-money is owed by the murderer from his own property unless the tribe helps him with it willingly. Malik said; What is done in our community is that the blood- money is not obliged against the tribe until it has reached a third of the full amount and upwards. Whatever reaches a third is against the tribe; and whatever is below a third; is against the property of the one who did the injury. Malik said; The way of doing things about which there is no dispute among us; in the case of someone who has the blood-money accepted from him in intentional murder or in any injury in which there is retaliation; is that that blood-money is not due from the tribe unless they wish it. The blood-money for that is from the property of the murderer or the injurer if he has property. If he does not have any property; it is a debt against him; and none of it is owed by the tribe unless they wish. Malik said; The tribe does not pay blood-money to anyone who injures himself; intentionally or accidentally. This is the opinion of the people of fiqh in our community. I have not heard that anyone has made the tribe liable for any blood-money incurred by intentional acts. Part of what is well-known of that is that Allah; the Blessed; and the Exalted; said in His Book; Whoever has something pardoned him by his brother; should follow it with what is accepted and pay it with good will Surat 2 ayat 178 The commentary on that - in our view - and Allah knows best; is that whoever gives his brother something of the blood- money; should follow it with what is accepted and pay him with good will. Malik spoke about a child who had no property and a woman who had no property. He said; When one of them causes an injury below a third of the blood-money; it is taken on behalf of the child and woman from their personal property; if they have property from which it may be taken. If not; the injury which each of them has caused is a debt against them. The tribe does not have to pay any of it and the father of a child is not liable for the blood-money of an injury caused by the child and he is not responsible for it. Malik said; The way of doing things in our community about which there is no dispute; is that when a slave is killed; the value for him is that of the day on which he was killed. The tribe of the murderer is not liable for any of the value of the slave; great or small. That is the responsibility of the one who struck him from his own personal property as far as it covers. If the value of the slave is the blood- money or more; that is against him in his property. He took him by the arm and placed him before him on his mount. The grandmother of the child saw him and argued with Umar about the child so they went to Abu Bakr AlSiddiq. Umar said; My son. The woman said; My son. Abu Bakr said; Do not interfere between a child and its mother. Umar did not repeat his words. Man deeds make him holy. I have heard that you were put up as a doctor to treat and cure people. If you are innocent; then may you have delight! If you are a quack; then beware lest you kill a man and enter the Fire! When Abud-Darda judged between two men; and they turned from him to go; he would look at them and say; Come back to me; and tell me your story again. A quack! By Allah! Yahya said that he heard Malik say; If someone makes use of a slave; without permission of its master; in anything important to him; whose like has a fee; he is liable for what befalls the slave if anything befalls him. If the slave is safe and his master asks for his wage for what he has done; that is the master right. This is what is done in our community. Yahya said that he heard Malik say about a slave who is part free and part enslaved; His property is suspended in his hand and he cannot begin anything with it. He eats from it and clothes himself in an approved fashion. If he dies; his property belongs to the one to whom he is in slavery. Malik said; What is done in our community is that if a man gives his small child some gold or silver and then dies and he has it in his own keeping; the child has none of it unless the father set it Aasi de in coin or placed it with a man to keep for the son. However; if a man receives a slave-girl as a pledge and she is pregnant or she becomes pregnant after his taking her as a pledge; her child is included with her. A distinction is made between the fruit and the child of the slave-girl. The Messenger of Allah; may Allah bless him and grant him peace; said; If someone sells a palm which has been pollinated; the fruit belongs to the seller unless the buyer stipulates its inclusion. The undisputed way of doing things in our community is that if a man sells a slave-girl or an animal with a foetus in its womb; the foetus belongs to the buyer; whether or not the buyer stipulates it. The palm is not like the animal. Fruit is not like the foetus in its mother womb. Part of what clarifies that is also that it is the usage of people to have a man pawn the fruit of the palm apart from the palm. Sunayn took him to Umar Ibn AlKhattab. He asked; What has induced you to take this person? He answered; I found him lost; so I took him. Umar advisor said to him; Amir AlMuminin! He is a man who does good. Umar inquired of him; Is it so? He replied; Yes. Umar Ibn AlKhattab said; Go; he is free; and you have his wala inheritance; and we will provide for him. MuwataMalik-017-001-34928Malik related to me from Yazid Ibn Abdullah Ibn AlHadi from Muhammad Ibn Ibrahim Ibn AlHarith AlTaymi from Sulayman Ibn Yasar from Abdullah Ibn Abi Umaya that a woman husband died; and she did the idda of four months and ten days. Then she married when she was free to marry. She stayed with her husband for four and a half months; then gave birth to a fully developed child. Her husband went to Umar Ibn AlKhattab and mentioned that to him; so Umar called some of the old women of the Aljahiliya and asked them about that. One of the women said; I will tell you what happened with this woman. When her husband died; she was pregnant by him; but then the blood flowed from her because of his death and the child became dry in her womb. When her new husband had intercourse with her and the water reached the child; the child moved in the womb and grew. Umar Ibn AlKhattab believed her and separated them until she had completed her idda. Two men came and each of them claimed a woman child. Umar Ibn AlKhattab summoned a person who scrutinized features and he looked at them. The scrutinizer said; They both share in him. Umar Ibn AlKhattab hit him with a whip. Then he summoned the woman; and said; Tell me your tale. She said; It was this one indicating one of the two men who used to come to me while I was with my people camels. He did not leave me until he thought and I thought that I was pregnant. Then he left me; and blood flowed from me; and this other one took his place. I do not know from which of them the child is. The scrutinizer said; Allah is greater. If she was a free woman by origin; she inherited her due and the siblings by the mother inherited their due; and the rest went to the Muslims. MuwataMalik-017-001-35223Yahya related to me from Malik from Nafic from Abdullah Ibn Umar that a man cursed his wife in the time of the Messenger of Allah; may Allah bless him and grant him peace; and disowned her child. The Messenger of Allah; may Allah bless him and grant him peace; separated them and gave the child to the woman. Malik said; Allah the Blessed; the Exalted; said; The testimony of men who accuse their wives but do not have any witnesses except themselves is to testify by Allah four times that he is being truthful; and a fifth time; that the curse of Allah will be upon him; if he should be a liar. She will avoid punishment if she testifies by Allah four times that he is a liar; and a fifth time; that the wrath of Allah shall be upon her; if he should be telling the truth. Surat 24 ayat 6. Malik said; The sunna with us is that those who curse each other are never to be remarried. If the man calls himself a liar; i.e. takes back his accusation ; he is flogged with the hadd-punishment; and the child is given to him; and his wife can never return to him. There is no doubt or dispute about this sunna among us. Malik said; If a man separates from his wife by an irrevocable divorce by which he cannot return to her; and then he denies the paternity of the child she is carrying; whilst she claims that he is the father; and it is possible by the timing; that he be so; he must curse her; and the child is not recognised as his. Malik said; That is what is done among us; and it is what I have heard from the people of knowledge. Malik said that a man who accused his wife after he had divorced her trebly while she was pregnant; and he had at first accepted being the father but then claimed that he had seen her committing adultery before he separated from her; was flogged with the hadd-punishment; and did not curse her. If he denied the paternity of her child after he had divorced her trebly; and he had not previously accepted it; then he cursed her. Malik said; This is what I have heard. Malik said; The slave is in the same position as the free man as regards making accusations and invoking mutual curses lian. He acts in the lian as the free man acts although there is no hadd applied for slandering a female-slave. Malik said; The muslim slave-girl and the christian and jewish free woman also do lian when a free muslim marries one of them and has intercourse with her. That is because Allah - may He be blessed and Exalted; said in His Book; As for those who accuse their wives; and they are their wives. This is what is done among us. Malik said that a man who did the lian with his wife; and then stopped and called himself a liar after one or two oaths and he had not cursed himself in the fifth one; had to be flogged with the hadd-punishment; but they did not have to be separated. Malik said that if a man divorced his wife and then after three months the woman said; I am pregnant; and he denied paternity; then he had to do lian. Malik said that the husband of a female slave who pronounced the lian on her and then bought her; was not to have intercourse with her; even if he owned her. The sunna which had been handed down about a couple who mutually cursed each other in the lian was that they were never to return to each other. MuwataMalik-017-001-35224Yahya related to me from Malik that he had heard that Urwa Ibn AlZubair said that if the child of the woman against whom lian had been pronounced or the child of fornication; died; his mother inherited from him her right in the Book of Allah the Exalted; and his maternal half-brothers had their rights. The rest was inherited by the owners of his mother wala if she was a freed slave. If she was an ordinary free woman; she inherited her right; his maternal brothers inherited their rights; and the rest went to the Muslims. He said; She is halal for him by the possession of the right hand as long as he does not make his divorce irrevocable. If he irrevocably divorces her; she is not halal for him by the possession of the right hand until she has married another husband. Malik said that if a man rnarried a female slave and then she had a child by him; and then he bought her; she was not an umm walad for him because of the child born to him while she belonged to another; until she had had a child by him while she was in his possession after he had purchased her. MuwataMalik-017-001-35537Yahya related to me from Malik that he had heard that Abdullah Ibn Umar was asked about what a pregnant woman should do if the fast became difficult for her and she feared for her child; and he said; She should break the fast and feed a poor man one mudd of wheat in place of every day; using the mudd of the Prophet; may Allah bless him and grant him peace.
