But if ye are prevented (From completing it), send an offering for sacrifice, such as ye may find, and do not shave your heads until the offering reaches the place of sacrifice. And if any of you is ill, or has an ailment in his scalp, (Necessitating shaving), (He should) in compensation either fast, or feed the poor, or offer sacrifice; and when ye are in peaceful conditions (again), if any one wishes to continue the 'umra on to the hajj, He must make an offering, such as he can afford, but if he cannot afford it, He should fast three days during the hajj and seven days on his return, Making ten days in all. This is for those whose household is not in (the precincts of) the Sacred Mosque. And fear Allah, and know that Allah Is strict in punishment. | |

SahihAlBukhari-017-001-1220 | Narrated Jabir Bin Abdullah: We were in the company of Allah Messenger ﷺ and we assumed the state of Ihram of Hajj and arrived at Mecca on the fourth of Dhu AlHijja. The Prophet ﷺ ordered us to perform the Tawaf around the Kaba and Sai between AlSafa and AlMarwa and use our lhram just for Umra; and finish the state of Ihram unless we had our Hadi with us. None of us had the Hadi with him except the Prophet ﷺ and Talha. Ali came from Yemen and brought the Hadi with him. Ali said; I had assumed the state of Ihram with the same intention as that with which Allah Messenger ﷺ had assumed it. The people said; How can we proceed to Mina and our male organs are dribbling? Allah Messenger ﷺ said; If I had formerly known what I came to know latterly; I would not have brought the Hadi; and had there been no Hadi with me; I would have finished my Ihram. Suraqa bin Malik met the Prophet ﷺ while he was throwing pebbles at the Jamrat AlAqaba; and asked; O Allah Messenger ﷺ ! Is this permitted for us only? The Prophet ﷺ replied. No; it is forever Aisha had arrived at Mecca while she was menstruating; therefore the Prophet ﷺ ordered her to perform all the ceremonies of Hajj except the Tawaf around the Kaba; and not to perform her prayers unless and until she became clean. When they encamped at AlBatha; Aisha said; O Allah Messenger ﷺ ! You are proceeding after performing both Hajj and Umra while I am proceeding with Hajj only? SahihMuslim-017-001-20899 | Usair Bin Jabir reported that when people from Yemen came to help the Muslim army at the time of jihad he asked them: Is there amongst you Uwais Bin Amir? He continued finding him out until he met Uwais. He said: Are you Uwais b.; Amir? He said: Yes. He said: Are you from the tribe of Qaran? He said: Yes. He Hadrat Umar again said: Did you suffer from leprosy and then you were cured from it but for the space of a dirham? He said: Yes. He Umar said: Is your mother living ? He said: Yes. He Umar said: I heard Allah Messenger ﷺ say: There would come to you Uwais Bin Amir with the reinforcement from the people of Yemen. He would be from Qaran; the branch of Murid. He had been suffering from leprosy from which he was cured but for a spot of a dirham. His treatment with his mother would have been excellent. If he were to take an oath in the name of Allah; He would honour that. And if it is possible for you; then do ask him to beg forgiveness for you from your Lord. So he Uwais begged forgiveness for him. Umar said: Where do you intend to go? He said: To Kufa. He Umar said: Let me write a letter for you to its governor; whereupon he Uwais said: I love to live amongst the poor people. When it was the next year; a person from among the elite of Kufa performed Hajj and he met Umar. He asked him about Uwais. He said: I left him in a state with meagre means of sustenance. Thereupon Umar said: I heard Allah Messenger ﷺ as saying: There would come to you Uwais Bin Amir; of Qaran; a branch of the tribe of Murid; along with the reinforcement of the people of Yemen. He had been suffering from leprosy which would have been cured but for the space of a dirham. His treatment with his mother would have been very kind. If he would take an oath in the name of Allah for something He would honour it. Ask him to beg forgiveness for you from Allah in case it is possible for you. So he came to Uwais and said.: Beg forgiveness from Allah for me. He Uwais said: You have just come from a sacred journey Hajj ; you; therefore; ask forgiveness for me. He the person who had performed Hajj said: Ask forgiveness for me from Allah. He Uwais again said: You have just come from the sacred journey; so you ask forgiveness for me. Uwais further said: Did you meet Umar? He said: Yes. He Uwais then begged forgiveness for him from Allah. So the people came to know about the status of religious piety of Uwais. He went away from that place. Then the Messenger of Allah ﷺ said: Who has the sacrificial animal with him; he should put on Ihram for Hajj along with Umra. and should not put it off till he has completed them both Hajj and Umra. She said: When I came to Mecca. I was having menses; I neither circumambulated the House; nor ran between AlSafa and AlMarwa. SahihMuslim-017-001-22828 | Aisha; the wife of the Messenger of Allah ﷺ ; said: We went out with the Messenger of Allah ﷺ during the year of the Farewell Pilgrimage. There were some amongst us who had put on IHram for Umra and there were some who had put on Ihram for Hajj. We proceeded on till we came to Mecca. The Messenger of Allah ﷺ said: He who put on Ihram for Umra but did not bring the sacrificial animal with him should put it off. and he who put on Ihram for Umra and he who had brought the sacrificial animal with him should not put it off until he had slaughtered the animal; and he who put on lhram for Hajj should complete it. The Messenger of Allah ﷺ came to me while I was weeping. He said: What makes you weep? I said: Would that I had not come for Pilgrimage this year. He the Holy Prophet said: What has happened to you? You have perhaps entered the period of menses. I said: Yes. He said: This is what has been ordained for the daughters of Adam. Do what a pilgrim does except that you should not circumambulate the House; till you are purified of the menses. She Aisha said: When I came to Mecca; the Messenger of Allah ﷺ said to his companions: Make this Ihram the Ihram for Umra. So the people put off Ihram except those who had sacrificial animals with them. She Aisha said: The Apostle of Allah ﷺ had the sacrificial animal with him; and so had Abu Bakr; Umar and other persons of means. They those who had put off Ihram again put on Ihram for Hajj when they marched towards Mina ; and it was the 8th of Dhu AlHijja. She Aisha said: When it was the day of sacrifice 10th of Dhu AlHijja ; I was purified; and the Messenger of Allah ﷺ commanded me and I did the circumambulation of Ifada. She said that the flesh of cow was sent to us. I said: What is it? They said: The Messenger of Allah ﷺ has offered a cow as sacrifice on behalf of his wives. When it was the night at Hasba; I said: Messenger of Allah; people are coming back from Hajj and Umra; where as I am coming back from Hajj alone. She Aisha reported: He the Holy Prophet commanded Abdulrahman Bin Abu Bakr to mount me upon his camel behind him. SahihMuslim-017-001-22839 | Aisha Allah be pleased with her reported: We proceeded with the Messenger of Allah ﷺ putting on the Ihram for Hajj during the months of Hajj and the night of Hajj till we encamped at Sarif. He the Holy Prophet went to his Companions and said: He who has no sacrificial animal with him; in his case I wish that he should perform Umra with this Ihram ; and he who has the sacrificial animal with him should not do it. So some of them performed Hajj whereas others who had no sacrificial animals with them did not do Hajj; but performed only Umra. The Messenger of Allah ﷺ had a sacrificial animal with him and those too who could afford it performed Hajj. The Messenger of Allah ﷺ came to me i. e. Aisha while I was weeping; and he said: What makes you weep? I said: I heard your talk with Companions about Umra. He said: What has happened to you? I said: I do not observe prayer due to the monthly period ; whereupon he said: It would not harm you; you should perform during this time the rituals of Hajj which you can do outside the House. Maybe Allah will compensate you for this. You are one among the daughters of Adam and Allah has ordained for you as He has ordained for them. So I proceeded on with the rituals of Hajj till we came to Mina. I washed myself and then circumambulated the House; and the Messenger of Allah ﷺ encamped at Muhassab and called; Abdulrahman Bin Abu Bakr. and said: Take out your sister from the precincts of the Kaba in order to put on Ihram for Umra and circumambulate the House. and I shall wait for you here. She said: So I went out and put on Ihram and then circumambulated the House; and ran between AlSafa and AlMarwa; and then we came to the Messenger of Allah ﷺ and he was in his house in the middle of the night. He said: Getting out completely from the state of lhram; so we put off Ihram ; and we turned to our wives and applied perfume and put on our clothes. and we were at a four night distance from Arafa. And we again put on Ihram on the day of Tarwiya 8th of Dhu AlHijja. The Messenger of Allah ﷺ came to Aisha Allah be pleased with her and found her weeping; and said: What is the matter with you? She said: The matter is that I have entered in the monthly period; and the people had put off lhram; but I did not and I did not circumambulate the House; and the people are going for Hajj now but I cant go ; whereupon he said: It is the matter which Allah has ordained for the daughters of Adam; so now take a bath and put on Ihram for Hajj. SahihMuslim-017-001-22856 | Jabir Bin Abdullah reported that Aisha Allah be pleased with her entered into the state of Ihram separately for Umra while the Prophet ﷺ was performing Hajj. The rest of the hadith is the same; but with this addition: The Messenger of Allah ﷺ was a person of gentle disposition; so when she AIsha wished for a thing; he accepted it provided it did not contravene the teachings of Islam. So he in pursuance of her desire for a separate lhram for Umra sent her with Abdulrahman Bin Abu Bakr and she put on Ihram for Umra at AlTanim. He said: I saw a young man and a young woman; and they were not safe from Shaitan. A man came to him and said; O Messenger of Allah! I performed Tawaf AlIfadah before shaving. He said: Shave; and there is no harm - or: Clip and there is no harm He said: Someone else came and said: O Messenger of Allah! I did the sacrifice before stoning. He replied: I am aware of it more than the people. The Messenger of Allah ﷺ performed only one hajj. Hence the people differed among themselves. The Messenger of Allah ﷺ came out from Medina with the intention of performing hajj. When he offered two rakahs of prayer in the Masjid at Dh AlHulayfah; he made it obligatory by wearing it. At the same meeting; he raised his voice in the talbiyah for hajj; when he finished his two rakahs. Some people heard it and I retained it from him. He then rode on the camel ; and when it the camel stood up; with him on its back; he raised his voice in the talbiyah and some people heard it at that moment. This is because the people were coming in groups; so they heard him raising his voice calling the talbiyah when his camel stood up with him on its back; and they thought that the Messenger of Allah ﷺ had raised his voice in the talbiyah when his camel stood up with him on its back. The Messenger of Allah ﷺ proceeded further; when he ascended the height of AlBayda he raised his voice in the talbiyah. Some people heard it at that moment. They thought that he had raised his voice in the talbiyah when he ascended the height of AlBayda. I swear by Allah; he raised his voice in the talbiyah at the place where he prayed; and he raised his voice in the talbiyah when his camel stood up with him on its back; and he raised his voice in the talbiyah when he ascended the height of AlBayda. When we performed Hajj; the Messenger of Allah SWAS sent me along with Abdulrahman Bin Abu Bakr to AlTanim and I performed Umrah. He said; this is Umrah in place of the one you had missed. She said those who had raised their voices in talbiyah for Umrah put off Ihram after circumambulating the House the Kabah and after running between AlSafa and AlMarwa. He asked; why are your weeping; Aishah? I replied; I menstruated. Would that I had not come out for performing Hajj. He said : Glory be to Allah; this is a thing prescribed by Allah on the daughters of Adam. He said perform all the rites of Hajj but do not go round the House the Kabah. SunanAbuDawoud-017-001-25450 | Jabir said We went out along with the Messenger of Allah ﷺ raising our voices in talbiyah for Hakk alone Ifrad while Aisha raised her voice in talbiyah for an Umrah. When she reached Sarif; she menstruated. When we came to Makkah we circumambulated the Kabah and ran between AlSafa and AlMarwah. The Messenger of Allah ﷺ then commanded us that those who had not brought sacrificial animals withthem should put off their ihram after Umrah. We asked Which acts are lawful and which not ? He replied All acts are lawful that are permissible usually. We had therefore intercourse with our wives; used perfumes; put on our clothes. There remained only four days to perform Hajj at Arafat. We then raised our voice in talbiyah wearing Ihram for Hajj on the eighth of Dhu AlHijja. The Messenger of Allah ﷺ entered upon Aisha and found her weeping. He said What is the matter with you? My problem is that I have menstruated; while the people have put on their ihram but I have not done so; nor did I go round the House the Kabah. Now the people are proceeding for Hajj. He said This is a thing destined by Allah to the daughters of Adam. Take a bath; then raise your voice in talbiyah for Hajj i.e; wear ihram for Hajj. She took a abtah and performed all the rites of the Hajj lit. she stayed at all those places where the pilgrims stay. O brother; I am eager to wage war in the cause of Allah i.e. jihad ; and I find that both hajj and umrah are due from me. How can I combine them? He said: Combine them and sacrifice the animal made easily available for you. I; therefore; raised my voice in talbiyah for both of them i.e. umrah and hajj. SunanAbuDawoud-017-001-25470 | Abdullah Bin Umar said At the Farewell Pilgrimage the Apostle of Allaah ﷺ put on ihram first for Umrah and afterwards for Hajj and drove the sacrificial animals along with him from Dhu AlHulaifa. The Apostle of Allaah ﷺ first raised his voice in talbiyah for Umrah and afterwards he did so for Hajj; and the people along with the Apostle of Allaah ﷺ did it first for Umrah and afterwards for Hajj. Some of the people had brought sacrificial animals and others had not; so when the Apostle of Allaah ﷺ came to Makkah ; he said to the people. Those of you who have brought sacrificial animals must not treat as lawful anything which has become unlawful for you till you complete your Hajj; but those of you who have not brought sacrificial animals should go round the House Kabah and run between AlSafa and AlMarwah; clip their hair; put off ihram; and afterwards raise their voice in talbiyah for Hajj and bring sacrificial animals. Those who cannot get sacrificial animals should fast three days during Hajj and seven days when they return to their families. The Apostle of Allaah ﷺ then performed circumambulation when he came to Makkah first touching the corner then running during three circuits out of seven and walking during four and when he had finished his circumambulation of the House Kabah he prayed two rakahs at Maqam Ibrahim; then giving the salutation and departing he went to AlSafa and ran seven times between AlSafa and AlMarwah. After that he did not treat anything as lawful which had become unlawful for him till he had completed his Hajj; sacrificed his animals on the day of sacrifice; went quickly and performed the circumambulation of the House the Kabah ; after which all that had been unlawful became lawful for him. Then he travelled quickly and used to arrive in Makka before the others who set out for hajj. He went bankrupt and his situation was put before Umar Ibn AlKhattab; who said; O People! AlUsayfi; AlUsayfi of the Juhayna; was satisfied with his deen and his trust because it was said of him that he arrived before the others on hajj. He used to incur debts which he was not careful to repay; so all of his property has been eaten up by it. Whoever has a debt against him; let him come to us tomorrow and we will divide his property between his creditors. Beware of debts! MuwataMalik-017-001-35393 | Yahya related to me from Malik that Yahya Ibn Said said; I vowed to walk; but I was struck by a pain in the kidney; so I rode until I came to Makka. I questioned Ata Ibn Abi Rabah and others; and they said; You must sacrifice an animal. When I came to Madina I questioned the ulama there; and they ordered me to walk again from the place from which I was unable to go on. So I walked. Yahya said that he had heard Malik say; What is done among us regarding someone who makes a vow to walk to the House of Allah; and then cannot do it and so rides; is that he must return and walk from the place from which he was unable to go on. If he cannot walk; he should walk what he can and then ride; and he must sacrifice a camel; a cow; or a sheep if that is all that he can find. Malik; when asked about a man who said to another; I will carry you to the House of Allah; answered; If he intended to carry him on his shoulder; by that he meant hardship and exhaustion to himself; and he does not have to do that. Let him walk by foot and make sacrifice. If he did not intend anything; let him do hajj and ride; and take the man on hajj with him. That is because he said; I will carry you to the house of Allah. If the man refuses to do hajj with him; then there is nothing against him; and what is demanded of him is cancelled. Yahya said that Malik was asked whether it was enough for a man who had made a vow that he would walk to the House of Allah a certain large number of times; or who had forbidden himself from talking to his father and brother; if he did not fulfil a certain vow; and he had taken upon himself; by the oath; something which he was incapable of fulfilling in his lifetime; even though he were to try every year; to fulfil only one or a smaller number of vows by Allah? Malik said; The only satisfaction for that that I know is fulfilling what he has obliged himself to do. When they had done say it was finished. If they vowed to walk in the hajj; they walked until they came to Makka; then they walked until they had finished all the rites. MuwataMalik-017-001-35535 | Yahya said that he heard Malik say; Someone who eats or drinks out of neglect or forgetfulness during a voluntary fast does not have to repeat his fast; but he should continue fasting for the rest of the day in which he eats or drinks while voluntarily fasting; and not stop fasting. Someone to whom something unexpected happens which causes him to break his fast while he is fasting voluntarily does not have to repeat his fast if he has broken it for a reason; and not simply because he decided to break his fast. Just as I do not think that someone has to repeat a voluntary prayer if he has had to stop it because of some discharge which he could prevent and which meant that he had to repeat his Ablution. Malik said; Once a man has begun doing any of the right actions Alamal AlSaliha such as the prayer; the fast and the hajj; or similar right actions of a voluntary nature; he should not stop until he has completed it according to what the sunna for that action is. If he says the takbir he should not stop until he has prayed two rakas. If he is fasting he should not break his fast until he has completed that day fast. If he goes into ihram he should not return until he has completed his hajj; and if he begins doing tawaf he should not stop doing so until he has gone around the Kaba seven times. He should not stop doing any of these actions once he has started them until he has completed them; except if something happens such as illness or some other matter by which a man is excused. This is because Allah; the Blessed and Exalted; says in His Book; And eat and drink until the white thread becomes clear to you from the black thread of dawn; and then complete the fast until night-time; Surat 2 ayat 187 ; and so he must complete his fast as Allah has said. Allah; the Exalted; also says; And complete the hajj and the umra for Allah; and so if a man were to go into ihram for a voluntary hajj having done his one obligatory hajj on a previous occasion ; he could not then stop doing his hajj having once begun it and leave ihram while in the middle of his hajj. Anyone that begins a voluntary act must complete it once he has begun doing it; just as an obligatory act must be completed. MuwataMalik-017-001-35772 | Yahya related to me from Malik; from Jafar Ibn Muhammad; from his father; that AlMiqdad Ibn AlAswad once went to see AIi Ibn Abi Talibat AlSuqya; where he was feeding some young camels of his with a mash of meal and leaves; and he said to him; This man Uthman Ibn Affan is telling people that they cannot do hajj and umra together. AlMiqdad said; Ali Ibn Abi Talib went off with bits of meal and leaves on his forearms - and I shall never forget the sight of the meal and the leaves on his arms - and went to see Uthman Ibn Affan and asked him; Are you saying then that people cannot do hajj and umra together? Uthman replied; That is my opinion. Whereupon AIi got angry and went out saying; I am at your service; O Allah; I am at your service for a hajj and an umra together. Malik said; Our position here in Madina is that someone who does hajj and umra together should not remove any of his hair; nor should he come out of ihram in any way until he has sacrificed an animal; if he has one. This is what Abdullah Ibn Umar did when he said; If I am blocked from the House we shall do what we did when we were with the Messenger of Allah; may Allah bless him and grant him peace. He then turned to his companions and said; It is the same either way. I call you to witness that I have decided in favour of hajj and umra together. MuwataMalik-017-001-35783 | Yahya related to me from Malik; from Hisham Ibn Urwa; that Abdullah Ibn AlZubair stayed in Makka for nine years. He would go into ihram for hajj at the beginning of Dhu AlHijja; and Urwa Ibn AlZubayr; who was with him; would do likewise. Yahya said that Malik said; The people of Makka and whoever else is living there besides them should go into ihram for hajj if they are in Makka; and anyone that is living in the centre of Makka and is not one of the people of Makka should not leave the Haram. Yahya said that Malik said; Someone who goes into ihram for hajj in Makka should delay tawaf of the House and the say between Safa and Marwa until he has come back from Mina; which is what Abdullah Ibn Umar used to do. Malik was asked what the people of Madina; or anybody else; should do about tawaf if they went into ihram in Makka at the beginning of Dhu AlHijja; and he said; They should delay the obligatory tawaf; which is the one they combine with the say between Safa and Marwa; but they can do whatever other tawaf they want to; and they should pray two rakas every time they complete seven tawafs; which is what the companions of the Messenger of Allah; may Allah bless him and grant him peace; did when they had gone into ihram to do hajj. They delayed the tawaf of the House and the say between Safa and Marwa until they had come back from Mina. Abdullah Ibn Umar also did this; going into ihram for hajj in Makka at the beginning of Dhu AlHijja; and then delaying tawaf of theHouse and the say between Safa and Marwa until he had come back from Mina. MuwataMalik-017-001-35786 | Yahya related to me from Malik; from Yahya Ibn Said; from Muhammad Ibn Ibrahim Ibn AlHarith AlTaymi; that Rabia Ibn Abdullah Ibn AlHudayr once saw a man in a state of ihram in Iraq. So he asked people about him and they said; He has given directions for his sacrificial animal to be garlanded; and it is for that reason that he has put on ihram. Rabia said; I then met Abdullah Ibn AlZubair and so I mentioned this to him and he said; By the Lord of the Kaba; an innovation. Malik was asked about some one who set out with his own sacrificial animal and marked it and garlanded it at Dh AlHulayfa; but did not go into ihram until he had reached AlJuhfa;and hesaid; I do not like that; and whoever does so has not acted properly. He should only garland his sacrificial animal; or mark it; when he goes into ihram; unless it is someone who does not intend to do hajj; in which case he sends it off and stays with his family. Malik was asked if somone who was not in ihram could set out with a sacrificial animal; and he said; Yes. There is no harm in that. MuwataMalik-017-001-35795 | Yahya related to me from Malik; from Abdullah Ibn Dinar; that Abdullah Ibn Umar used to say; Anyone that does umra in the months of hajj; that is; in Shawal; Dh AlQada; or in Dhu AlHijja before the hajj; and then stays in Makka until the time for hajj; is doing tamattu if he then does hajj. He must sacrifice whatever animal it is easy for him to obtain; and if he cannot find one then he must fast three days during hajj and seven days when he returns. Malik said; This is only the case if he stays until the hajj and does hajj in that same year. Malik said that if someone who was from Makka but had stopped living there and gone to live elsewhere; came back to do umra in the months of the hajj and then stayed in Makka to begin hajj there; he was doing tamattu; and had to offer up a sacrificial animal; or fast if he could not find one. He was not the same as the people of Makka. Malik was asked whether someone who was not from Makka and entered Makka to do umra in the months of hajj with the intention of staying on to begin his hajj there was doing tamattu or not; and he said; Yes; he is doing tamattu; and he is not the same as the people of Makka; even if he has the intention of staying there. This is because he has entered Makka; and is not one of its people; and making a sacrifice or fasting is incumbent on anyone who is not from Makka; and; although he intends to stay; he does not know what possibilities might arise later. Sacrificing an animal is only incumbent on some one who does umra in the months of hajj; and then stays in Makka and then does hajj. A person not from Makka who moves to Makka and establishes his home there and does umra in the months of the hajj and then begins his hajj there is not doing tamattu. He does not have to sacrifice an animal nor does he have to fast. He is in the same position as the people of Makka if he is one of those who are living there. Malik was asked whether a man from Makka who had gone to live in another town or had been on a journey and then returned to Makka with the intention of staying there; regardless of whether he had a family there or not; and entered it to do umra in the months of the hajj; and then began his hajj there; beginning his umra at the miqat of the Prophet; may Allah bless him and grant him peace; or at a place nearer than that; was doing tamattu or not? MuwataMalik-017-001-35838 | Yahya related to me from Malik from Yahya Ibn Said from Sulayman Ibn Yasar that Said Ibn Huzaba AlMakhzumi was thrown off his mount while he was in ihram on the road to Makka. He asked after the person in charge of the relay station where he was injured and he found Abdullah Ibn Umar; Abdullah Ibn AlZubair and Marwan Ibn AlHakam there. He told them what had happened to him and all of them said that he should take whatever medicine he had to take and pay compensation for it. Then; when he got better again; he should do umra and come out of his ihram; after which he had to do hajj another year and to offer whatever sacrificial animal he was able to in the future. Malik said; This is what we do here in Madina if someone is detained by something other than an enemy. And when Abu Ayoub AlAnsari and Habbar Ibn AlAswad came to the day of the sacrifice and had missed the hajj; Umar Ibn AlKhattab told them to come out of ihram by doing umra and then to go home free of ihram and do hajj some time in the future and to sacrifice an animal; or; if they could not find one; to fast three days during the hajj and seven days after they had returned to their families. Malik said; Anyone who is detained from doing hajj after he has gone into ihram; whether by illness or otherwise; or by an error in calculating the month or because the new moon is concealed from him is in the same position as some one who is hindered from doing the hajj and must do the same as he does. Yahya said that Malik was asked about the situation of someone from Makka who went into ihram for hajj and then broke a bone or had severe stomach pain; or of a woman who was in labour; and he said; Someone to whom this happens is in the same situation as one who is hindered from doing the hajj; and he must do the same as people from outlying regions do when they are hindered from doing the hajj. Malik said; about someone who arrived in the months of the hajj with the intention of doing umra; and completed his umra and went into ihram in Makka to do hajj; and then broke a bone or something else happened to him which stopped him from being present at Arafa with everybody else; I think that he should stay where he is until he is better and then go outside the area of the Haram; and then return to Makka and do tawaf of the House and say between Safa and Marwa; and then leave ihram. He must then do hajj again another year and offer a sacrificial animal. Malik said; about someone who left ihram in Makka; and then did tawaf of the House and say between Safa and Marwa; and then fell ill and was unable to be present with everybody at Arafa; If the hajj passes someone by he should; if he can; go out of the area of the Haram and then come back in again to do umra and do tawaf of the House and say between Safa and Marwa; because he had not intended his initial tawaf to be for an umra; and so for this reason he does it again. He must do the next hajj and offer a sacrificial animal. If he is not one of the people of Makka; and something happens to him which stops him from doing the hajj; but he does tawaf of the House and say between Safa and Marwa; he should come out of ihram by doing an umra and then do tawaf of the House a second time; and say between Safa and Marwa; because his initial tawaf and say were intended for the hajj. It is fitting that tawaf of the House be the last of his contract; as long as nothing prevents him; and if something prevents him; or an obstacle arises; then Allah has completed his hajj.
