  4. He then said Allah the Blessed the Supreme has made your blood your property and your honor as sacred as this day of yours in this town of yours in this month of yours and such protection cannot be slighted except rightfully

Ibn Umar said What are they O Ibn Juraij He said I see that you do not touch except the two Yemenite corners of the Kaba while performing the Tawaf and I see you wearing the Sabtiya shoes and I see you dyeing your hair with Sufra and I see that when you are in Mecca the people assume the state of Ihram on seeing the crescent on the first day of Dh AlHijja while you do not assume the state of Ihram till the Day of Tarwiya th Dhul Hijja
  6. Narrated Ibn Abbas The Prophet cursed effeminate men those men who are in the similitude assume the manners of women and those women who assume the manners of men and he said Turn them out of your houses

Narrated Hafsa the wife of the Prophet I said O Allah Messenger Why have the people finished their Ihram after performing the Umra while you have not finished your lhram after your Umra He said I have done Talbid of my hair and have decorated my Hadis with garlands so I shall not finish my lhram till l have slaughtered my Hadi animal for sacrifice

Narrated Ibn Abbas The people used to consider the performance of Umra in the months of Hajj an evil deed on the earth and they used to call the month of Muharram as Safar and used to say When the wounds over the backs of the camels have healed and the foot marks of the camels have vanished after coming from Hajj then Umra becomes legal for the one who wants to perform Umra
  9. Narrated Abu Huraira Allah s Apostle said Treat women nicely for a women is created from a rib and the most curved portion of the rib is its upper portion so if you should try to straighten it it will break but if you leave it as it is it will remain crooked
  10. So when we arrived at Mecca the Prophet ordered us to change our intentions of the Ihram for Umra and that we could finish our Ihram after performing the Umra and could go to our wives for sexual intercourse
  11. Pilgrims Prevented from Completing the Pilgrimage Whoever said that the Muhsar is not supposed to perform Umra or Hajj in lieu of the prevented one
  12. Narrated Aisha We set out along with Allah Messenger shortly before the appearance of the new moon crescent of the month of Dhi AlHijja and he said to us Whoever wants to assume Ihram for Hajj may do so and whoever wants to assume Ihram for Umra may do so
  13. So when she became clean from her menses and she had performed the Tawaf of the Kaba she said O Allah Messenger You people are returning with both Hajj and Umra and I am returning only with Hajj So he ordered Abdulrahman Bin Abu Bakr to go with her to AlTanim
  14. I used to give the verdict of doing the same till the caliphate of Umar who said If you follow the Holy Book then it orders you to remain in the state of Ihram till you finish from Hajj if you follow the Prophet then he did not finish his Ihram till the Hadi sacrifice had reached its place of slaughtering Hajj AlQiran
  15. When we reached Mecca Allah Messenger said Those who had assumed the lhram for Umra and had not brought the Hadi should finish his lhram and whoever had assumed the Ihram for Umra and brought the Hadi should not finish the Ihram till he has slaughtered his Hadi and whoever had assumed the lhram for Hajj should complete his Hajj
  16. And so in the early morning the Prophet mounted his Mount while in Dh AlHulaifa and set out till they reached Baida where he and his companions recited Talbiya and then they did the ceremony of Taqlid which means to put the colored garlands around the necks of the Budn camels for sacrifice
  17. Those who had their wives with them were permitted to contact them have sexual intercourse and similarly perfume and ordinary clothes were permissible for them

  20. Narrated Imran We performed Hajj AlTamattu in the lifetime of Allah Messenger and then the was revealed regarding Hajj AlTamattu and somebody said what he wished regarding Hajj AlTamattu according his own opinion

And whoever among you has not driven the Hadi with him should perform Tawaf of the Kaba and the Tawaf between Safa and Marwa then cut short his hair and finish his Ihram and should later assume Ihram for Hajj but he must offer a Hadi sacrifice and if anyone cannot afford a Hadi he should fast for three days during the Hajj and seven days when he returns home

After finishing Tawaf of the Kaba he offered a two rakat prayer at Maqam Ibrahim and after finishing the prayer he went to Safa and Marwa and performed seven rounds of Tawaf between them and did not do any deed forbidden because of Ihram till he finished all the ceremonies of his Hajj and sacrificed his Hadi on the day of Nahr th day of Dh AlHijja

Narrated Ubaid Ibn Juraij I asked Abdullah Bin Umar O Abu Abdulrahman I saw you doing four things which I never saw being done by anyone of you companions Abdullah Bin Umar said What are those O Ibn Juraij I said I never saw you touching any corner of the Kaba except these two facing south Yemen and I saw you wearing shoes made of tanned leather and dyeing your hair with Hinna a kind of red dye

  26. Ablutions Wudu Washing the feet when one is wearing the shoes and it is not sufficient for one to pass a wet hand over the shoes but one should take off the shoes and wash one feet

Those who had assumed the lhram for Umra performed the Tawaf around the Kaba and between Safa and Marwa and then finished their Ihram and on their return from Mina they performed another Tawaf around the Kaba and between Safa and Marwa but those who combined their Hajj and Umra performed only one Tawaf between Safa and Marwa for both
  30. Narrated Ibn Umar During Hajjat AlWada the Prophet and some of his companions got their heads shaved while some of his companions got their head hair cut short

Narrated Humaid Bin Abdulrahman Abu Huraira said that Abu Bakr sent him during the Hajj in which Abu Bakr was made the chief of the pilgrims by Allah Messenger before the year of Hajjat AlWada in a group of announcers to announce before the people No pagan shall perform the Hajj after this year and none shall perform the Tawaf around the Kaba in a naked state

Amr Bin Dinar narrated from Amr Bin Abdulah Bin Safwan that Yazid Bin Shaiban said Ibn Mirba AlAnsari came to us while we were standing at our places Amr Bin Sinar said a place that Amr Bin Abdullah indicated was far and he said I am a messenger whom the Messenger of Allah sent to you to say Stay with your Hajj rites for indeed you are following a legacy left by Ibrahim
  35. She asked So how should I say it He said Say Labbaik labbaika mahilli minal Ard haithu tahbisuni I respond to Your call O Allah I respond to Your call I will exit Ihram any where on the earth where You prevent me
  36. So Ali Bin AlMadini narrated from Yahya Bin Saeed AlQattan Muhammad Bin Yusuf was a very reliable narrator of Hadith and AlSaib Bin Yazid was his grandfather and Muhammad Bin Yusuf would say AlSaib Bin Yazid narrated to me and he is my grandfather from my mother side

It was narrated from AlFadl Bin Abbas that He was riding behind the Messenger of Allah SAW on the morning of the Day of Sacrifice when a woman from Khatham came to him and said O Messenger of Allah the command of Allah the Mighty and Sublime to His slaves to perform Hajj has come while my father is an old man and cannot ride unless he is tied crossways on a mount can I perform Hajj on his behalf He said Yes perform Hajj on his behalf for if he owed a debt you would pay it off for him

It was narrated from Abdullah Bin Umar that a man stood up in the Masjid and said O Messenger of Allah from where do you command us to enter Ihram The Messenger of Allah Said The people of AlMadinah should enter Ihram from Dh AlHulaifah the people of AlAshsham should enter Ihram from AlJuhfah the people of Najd should enter Ihram from Qarn
  40. It was narrated from Anas Bin Malik that the Messenger of Allah prayed Zuhr in AlBaida then he rode up the mountain of AlBaida and began the Talbiyah for Hajj and Umrah when he had prayed Zuhr Daif AlBaida Sahih Darussalam
  41. It was narrated that Ibn Abbas said I heard the Prophet delivering a khutbah and he said Pants are allowed for one who cannot find an Izar and Khuffs for one who cannot find sandals to wear in Ihram

Whoever does not have a Jadi with him let him exit Ihram and make it Umrah Ali may Allah be eased with him came from Yemen with a Hadi and the Messenger of Allah brought a Hadi from AlMadinah Fatimah had put on a dyed garment and applied kohl to her eyes and he Ali said I went to the Prophet to complain about that and find out whether she could do that I said O Messenger of Allah Fatima had put on a dyed garment and applied kohl to her eyes and she said the Messenger of Allah told me to do that
  43. It was narrated from Mujahid and others from a man from the people of AlIraq who was called Shaqiq Bin Salmah Abu Wail that there was a man from Banu Taghlib who was called AlSubai Bin Mabad who had been a Christian then became of Muslim
  44. It was narrated that Anas said I heard the Messenger of Allah Labbaika Umratan wa Hajjan maan Iabbaika Umratan wa Hajjan maan Here I am O Allah for Umrah and Hajj together here I am O Allah for Umrah and Hajj together Qiran Sahih Darussalam
  45. When the Messenger of Allah came to Makkah he said to the people Whoever among you has brought a Hadi nothing is permissible for him that became forbidden when he entered Ihram until he has finished his Hajj Whoever did not find a Hadi let him fast for three days during the Hajj and for seven when he returns to his family the Messenger of Allah performed Tawaf when he came to Makkah and touched the corner where the Black Stone is first of all then he walked rapidly during the first three of the seven circles and walked daring the last four
  46. He said Then circumambulate the House and perform Sa between AlSafa and AlMarwah then exit Ihram so I circumambulated the House and performed Sa i between AlSafa and AlMarwah then went to a woman of my people and she combed and washed my hair I used to issue Fatwas to the people based on that during the Khilafah of Abu Bakr and Umar
  47. I narrated the Hadith of Ikrimah to him and he narrated to me from Ibn Abbas that Dubaah Bint AlZubair Bin Abd AlMuttalib came to the Prophet and said O Messenger of Allah I want to perform Hajj so what should I say He said Say Labbaik Labbaika wa mahilli min Alardihayth tahbisuni Here I am O Allah Here I am and I shall exit Ihram at any place where You decree that I cannot proceed
  48. On the night of AlHasbab the twelfth night of Dh AlHajjah I said O Messenger of Allah the people are going back having done Umrah and Hajj But I am going back having done only Hajj
  49. He heard that we were saying when there are only five days between us and Arafat he commands us to exit Ihram and we will go out to Mina with our male members dripping with semen because of recent intimacy with our wives the Prophet stood up and addressed us saying I have heard what you said
  50. It was narrated that Ib Abbas said When the pilgrim has stoned hthe Jamrat everything becomes permissible for him except intimacy with women It was said And perfume he said I saw the Messenger of Allah smelling strongly of musk is it not a perfume What Is Permissible For The Muhrim After He Finishes Stoning the Jimar
  51. Safwan Bin Yala reported on the authority of his father who said A person came to the Messenger of Allah as he was staying at Jirana and I the narrator father was at that time in the apostle company and the person was donning a cloak having the marks of perfume on it and he said I am in a state of Ihram for the sake of Umra and it this cloak is upon me and I am perfumed
  52. Aisha Allah be pleased with her reported I used to perfume the Messenger of Allah with a perfume containing musk before entering upon the state of Ihram and on the day of sacrifice th of Dh AlHijja and at the conclusion of Ihram before circumambulating the House for Tawaf i Ifada
  53. Thereupon the Mes senger of Allah said Bathe him with water mixed with the leaves of lote tree and shroud him In his two pieces of cloth and cover neither his head nor his face for he would be raised on the Day of Resurrection pronouncing Talbiya

Aisha Allah be pleased with her reported that Allah Messenger went into the house of Dubaa Bint Zubair and said to her Did you intend to perform Hajj She said By Allah I intend to do so but I often remain ill whereupon he the Holy Prophet said to her Perform Hajj but with condition and say O Allah I shall be free from Ihram where you detain me
  55. but now how should I perform the Hajj Thereupon he said Undo your hair and comb them and desist from performing Umra and put on Ihram for Hajj She Aisha said When I had completed my Hajj he commanded Abdulrahman Bin Abu Bakr to carry me behind him on boneback in order to enable me to resume the rituals of Umra from Tanim the place where I abandoned its rituals
  56. When it was the night at Hasba and Allah enabled us to complete our Hajj he the Holy Prophet sent with me Abdulrahman Bin Abu Bakr and he mounted me behind him on his camel and took me to Tanim and I put on Ihram for Umra and thus Allah enabled us to complete our Hajj and Umra and we were required to observe neither sacrifice nor alms nor fasting
  57. Aisha Allah be pleased with her said Some among us put on Ihram for Hajj alone Hajj Mufrad some of us for Hajj and Umra together Qiran and some of us for Tamattal first for Umra and after completing it for Hajj
  58. Aisha Allah be pleased with her reported We went with the Messenger of Allah and we did not see but that he intended to perform Hajj only but when we reached Mecca we circumambulated the House and the Messenger of Allah commanded that he who did not have with him a sacrificial animal should put off Ihram
  59. When it was the night of Hasba she said Messenger of Allah people are coming back after having performed both Hajj andUmra whereas I am coming back only with Hajj whereupon he said Did you not circumambulate the Kaba that very night we entered Mecca She Aisha said No whereupon he said Go along with your brother to Tanim and put on the Ihram for Umra and it is at such and such a place that you can meet us
  60. Aisha said The Messenger of Allah was going upwards to the side of Mecca whereas I was coming down from it or I was going upward whereas he was coming down
  61. Jabir Allah be pleased with him said We in the state of lhram came with the Messenger of Allah for Hajj Mufrad with the aim of Hajj only and Aisha set out for Umra and when we reached Sarif she Hadrat Aisha entered in the state of monthly period we proceeded on till we reached Mecca and circumambulated the Kaba and ran between a AlSafa and AlMarwa and the Messenger of Allah commanded that one who amongst us had no sacrificial animal with him should put off Ihram
  62. In the meantime the Messenger of Allah stood amongst us and said You are well aware that I am the most God fearing most truthful and most pious amongst you
  63. He the Holy Prophet said For what purpose have you entered into the state of Ihram whether you entered into the state purely for Hajj and Umra jointly or Hajj and Umra separately He said For the purpose for which the Messenger of Allah had entered
  64. and continued giving religious verdict according to this practice till during the Caliphate of Umar Allah be pleased with him when a person said to him Abu Musa or Abdullah Bin Qais exercise restraint in delivering some religious verdict of yours for you do not know what has been introduced after you by the Commander of the Believers in the rites of Hajj
  65. He Abu Musa met him Hadrat Umar subsequently and asked him about it whereupon Umar said I know that Allah Apostle May peace be upon him and also his Companions did that observed Tamattu but I do not approve that the married persons should have intercourse with their wives under the shade of the trees and then set out for Hajj with water trickling down from their heads
  66. Said Bin AlMusayab reported that Ali and Uthman Allah be pleased with them met at Usfan and Uthman used to forbid people from performing Tamattu and Umra during the period of Hajj whereupon Ali said What is your opinion about a matter which the Messenger of Allah did but you forbid it Thereupon Uthman said You leave us alone whereupon he Ali said I cannot leave you alone
  67. So when Allah Messenger came to Mecca he said to the people He who amongst you has brought sacrificial animals along with him must not treat as lawful anything which has become unlawful for him till he has completed the Hajj and he who amongst you has not brought the sacrificial animals should circumambulate the House and run between AlSafa and AlMarwa and clip his hair and put off the Ihram and then again put on the Ihram for Hajj and offer sacrifice of animals
  68. And then when he had finished the circumambulation of the House he observed two rakahs of prayer at the Station of Ibrahim and then pronounced Salaam for concluding the rakahs and departed and came to AlSafa and ran seven times between AlSafa and AlMarwa
  69. Umar at the time when Hajjaj came to fight against Ibn Zubair There would be no harm if you do not proceed for Hajj this year for we fear that there would be fight among people which would cause obstruction between you and the House whereupon he said If there would be obstruction between me and that Kaba I would do as Allah Messenger did
  70. That person Iraqi then met me and he asked me and I narrated to him the reply of Urwa whereupon he the Iraqi said Tell him Urwa that a person had informed him that Allah Messenger had done that and why is it that Asma and Zubair have done like this He Muhammad Bin Abdulrahman said I went to him and made a mention of that to him whereupon he Urwa said Who is he the Iraqi I said I do not know whereupon he said What is the matter that he does not come to me himself and ask me I suppose he is an Iraqi
  71. Why dont they ask him to testify it And none amongst those who had passed away commenced the rituals of Hajj but by circumambulating the Kaba on their first arrival and they did not put off Ihram without completing the Hajj and I saw my mother and my aunt commencing their Hajj with the circumambulation of the House and they did not put off Ihram
  72. So they intercalated the month of Muharram for Safar and said When the backs of their camels would become all right and traces if the pilgrims would be effaced from the paths and the month of Safar would be over then Umra would be permissible for one who wants to perform it
  73. I said It concerns the time after staying at Arafat whereupon he said Ibn Abbas Allah be pleased with them had stated that the place of sacrifice is the Ancient House it way be after staying at Arafat or before staying there
  74. Anas Allah be pleased with him reported that Ali Allah be pleased with him came from the Yemen and the Apostle said With what intention have you put on Ihram He said I have put on Ibram in accordance with the intention with which Allah Apostle has put on Ibram whereupon he the Holy Prophet said Had there not been the sacrificial animals with me I would have put off Ihram after performing Umra
  75. Abdullah Bin Yazid AlKhatmi reported on the authority of Abu Ayub Allah be pleased with him that he prayed the sunset and Isha prayers together at Muzdalifa in the company of Allah Messenger on the occasion of the Farewell Pilgrimage
  76. Then another man came and said Messenger of Allah I thought that such and such rite should precede such and such rite and then another man came and said Messenger of Allah I had thought that such and such was before such and such and such and such is the sequence of the three rites viz
  77. Amra daughter of Abdulrahman reported that Ibn Ziyad had written to Aisha Allah be pleased with him that Abdullah Bin Abbas Allah be pleased with them bad said that he who sent a sacrificial animal to Mecca for him was forbidden what is forbidden for a pilgrim in the state of Ihram until the animal is sacrificed I have myself sent my sacrificial animal to Mecca so write to me your opinion
  78. This hadith is narrated from Aisha on the authority of Ibn Shihab with the same chain of transmitters and the words are Safiyah Bint Huyay the wife of Allah Apostle entered the period of menses at the occasion of the Farewell Pilgrimage after she had performed Tawaf Ifada in the state of cleanliness the rest of the hadith is the same
  79. He asked What are they Ibn Jurayj He replied I saw you touching only the two Yamani corners and I saw you wearing shoes having no hair I saw you dyeing in yellow colour and I saw you wearing ihram on the eighth of Dh AlHijjah whereas the people had worn ihram when they sighted the moon
  80. We asked Which acts are lawful and which not He replied All acts are lawful that are permissible usually
  81. Those of you who have brought sacrificial animals must not treat as lawful anything which has become unlawful for you till you complete your Hajj but those of you who have not brought sacrificial animals should go round the House Kabah and run between AlSafa and AlMarwah clip their hair put off ihram and afterwards raise their voice in talbiyah for Hajj and bring sacrificial animals
  82. The Apostle of Allaah then performed circumambulation when he came to Makkah first touching the corner then running during three circuits out of seven and walking during four and when he had finished his circumambulation of the House Kabah he prayed two rakahs at Maqam Ibrahim then giving the salutation and departing he went to AlSafa and ran seven times between AlSafa and AlMarwah
  83. After that he did not treat anything as lawful which had become unlawful for him till he had completed his Hajj sacrificed his animals on the day of sacrifice went quickly and performed the circumambulation of the House the Kabah after which all that had been unlawful became lawful for him
  84. The people used to add the words dha Almaarij the Possessor of ladders and similar other words to talbiyah while the Prophet heard them utter these words but he did not say anything to them
  85. He then began to beat him while the Messenger of Allah was smiling and saying Look at this man who is in the sacred state putting on ihram what is he doing Ibn AbuRizmah said The Messenger of Allah spoke nothing except the words Look at this man who is in the sacred state wearing ihram what is he doing He was smiling when he uttered these words
  86. Nubaih Bin Wahb brother of Banu Abd AlDar said Umar Bin Ubaid Allah sent someone to Aban Bin Uthman Bin Affan asking him to participate in the marriage ceremony
  87. Aban refused and said I heard my father Uthman Bin Affan narrating a tradition from the Apostle of Allaah as saying A pilgrim may not marry and give someone in marriage in the sacred state while wearing ihram
  88. Narrated Abu Hurairah Abu Bakr sent me among those who proclaim at Mina that no polytheist should perform Hajj after this year and no naked person should go round the House the Kabah and that the day of greater Hajj is the day of sacrifice and the greater Hajj is the Hajj
  89. The tradition mentioned above has also been transmitted by Jabir Bin Samurah through a different chain of narrators
  90. Narrated AbuUmamah The Messenger of Allah said If anyone goes out from his house after performing ablution for saying the prescribed prayer in congregation in the mosque his reward will be like that of one who goes for hajj pilgrimage after wearing ihram robe worn by the hajj pilgrims
  91. Narrated Umm Salamah The Prophet as saying If anyone has sacrificial animal and intends to sacrifice it and he sights the new moon of Dh AlHajjah he must not take any of his hair and nails until he sacrificesAbu Dawud said The name of Amr Bin Muslim in the chain narrated by Malik and Muhammad Bin Amr is disputed

  93. Narrated Abdullah Ibn Abbas Yazid Ibn Hurmuz said that when Najdah AlHaruri performed hajj during the rule of Ibn az Zubayr he sent someone to Ibn Abbas to ask him about the portion of the relatives in the fifth

Abd Allah Bin Umar said When the Apostle of Allaah returned from an expedition Hajj or Umrah on every rising piece of ground he would say three times Allaah is Most Great and he would say There is no god bt Allaah alone who has no partner to Whom the dominion belongs to Whom praise is due and Who is Omnipotent serving prostrating ourselves before our Lord and expressing praise
  95. Jumai Bin Umair AlTaimi said I went out with my paternal aunt and maternal aunt and we entered upon Aisha We asked her What did the Messenger of Allah do when he had the bath to cleanse himself from sexual impurity She said He used to pour water on his hand three times then he would put them in the vessel and wash his face three times then he would pour water over his body then he would get up and perform prayer
  96. Amr Bin Shuaib narrated that His father said Muawiyah stood up to deliver a sermon and said Where are your scholars Where are your scholars For I heard the Messenger of Allah say The Hour will not begin until a group of my Ummah will prevail over the people and they will not care who lets them down and who supports them
  97. Whatever it states is permissible we will take as permissible and whatever it states is forbidden we will take as forbidden
  98. It was narrated that Abdullah said The Messenger of Allah said No one will enter Paradise who has even a mustard seed weight of arrogance in his heart and no one will enter Hell who has even a mustard seed weight of faith in his heart
  99. It was narrated that Abdullah said The Messenger of Allah said I have no need of the friendship of any Khalil close friend but if I were to have taken anyone as a close friend I would have taken Abu Bakr as a close friend but your companion is the close friend of Allah One of the narrators Waki said by the phrase your companion he was referring to himself
  100. It was narrated that Abdulrahman Bin Abu laila said Abu Laila used to travel with Ali and he used to wear summer clothes in winter and winter clothes in summer
  101. Malik related to me that he heard that Urwa ibn az Zubayr andSulayman ibn Yasar when asked whether the sons of a man who had akitaba written for himself and his children and then died worked forthe kitaba of their father or were slaves said They work for thekitaba of their father and they have no reduction at all for the deathof their father
  102. Malik spoke about a mukatab who died and left property which was notenough to pay his kitaba and he also left a child with him in hiskitaba and an umm walad and the umm walad wanted to work for them
  103. Whoever of you kills itintentionally there shall be repayment the like of what he has slain from livestock as shall be judged by two men of justice among you asacrificial animal which will reach the Kaba or food for poor people or the equivalent of that in fasting Sura ayat and a sheep isone of the animals which is judged to be acceptable as a sacrifice
  104. How indeed could anyone be in doubt aboutthe matter A sheep is the kaffara for anything which does not reachthe extent of something for which a camel or a cow would be thekaffara and the kaffara for something which does not reach the extentof something for which a sheep would be the kaffara is fasting orfeeding poor people
  105. Sura ayat Jidal arguing during the hajj refers towhen the Quraysh used to stand near the mashar al haram at Quzah inMuzdalifa while the Arabs and others would stand at Arafa and theywould argue about who was the more correct
  106. Yahya related to me from Malik from Nafj from Salim andUbaydullah two sons of Abdullah ibn Umar that their father Abdullahibn Umar used to send his family and children from Muzdalifa to Minaahead of him so that they could pray subh at Mina and throw the stonesbefore everyone else arrived
  107. Yahya related to me from Malik from Hisham ibn Urwa that hisfather said I was sitting with Usama ibn Zayd when some one askedhim How did the Messenger of Allah may Allah bless him and granthim peace travel when he went from Arafa to Muzdalifa during thefarewell hajj and he replied He went at a medium pace but when hefound a gap in the crowds he speeded up

Yahya related to me from Malik that he had heard that theMessenger of Allah may Allah bless him and grant him peace said onceat Mina This place where I have just sacrificed and the whole ofMina is a place of sacrifice and he said once during umra Thisplace of sacrifice meaning Marwa and all the pathways of Makka andits roads are a place of sacrifice

Yahya related to me from Malik from Hisham ibn Urwa from hisfather that the Messenger of Allah may Allah bless him and grant himpeace prayed four raka prayers with only two rakas when at Mina andthat Abu Bakr prayed them at Mina with only two rakas and that Umaribn al Khattab prayed them at Mina with only two rakas and thatUthman prayed them at Mina with only two rakas for half of hiskhalifate and then later completed them
  110. Malik was askedwhether the people of Makka should pray two rakas at Arafa or four and whether the amir of the hajj if he was a Makkan should praydhuhr and asr with four rakas or two and also how the people of Makkawho were living at Mina should pray and he said The people ofMakka should pray only two rakas at Arafa and Mina for as long as theystay there and should shorten the prayer until they return to Makka
  111. Yahya related to me from Malik from Yahya ibn Said that he hadheard that on the day after the day of sacrifice Umar ibn al Khattabwent out a little after the sun had risen and said the takbir andeveryone repeated it after him
  112. The first time is when the imam and everyone with himsays the takbir after the dhuhr prayer on the day of sacrifice andthe last is when the imam and everyone with him says the takbir aftersubh on the last of the days of tashriq after which he stops sayingthe takbir
  113. Malik said The explanation of the hadithwhere the Messenger of Allah may Allah bless him and grant him peace allowed the camel herders to delay the stoning of the jamras is inour view and Allah knows best that they threw stones on the day ofsacrifice and then threw again two days later which was the firstpossible day for leaving and this throwing was for the day which hadpassed
  114. They then threw again for the day itself because it is onlypossible for someone to make up for something which is obligatory forhim and when something obligatory passes someone by without himdoing it he must necessarily make it up afterwards and notbeforehand
  115. So in the case of the camel herders if it seemedappropriate for them to leave that day they would have done all thatthey were supposed to do and if they were to stay until the followingday they would throw stones with everybody else on the second andlast day for leaving and then leave
  116. Yahya related to me from Malik from Abu z Zubayr that Umar ibnal Khattab gave the judgement of a ram for a hyena a female goat fora gazelle a she goat less than one year old for a rabbit and a fourmonth old kid for a jerboa
  117. Birds from the eagle family eagles or falcons or vulturescount as game for which a price is paid just as a price is paid forany game which a person in ihram kills
  118. Yahya related to me from Malik from Humayd bin Qays from MujahidAbu l Hajjaj from Ibn Abi Layla from Kab ibn Ujra that the Messengerof Allah may Allah bless him and grant him peace said to him Perhaps your pests are troubling you He replied that indeed theywere and the Messenger of Allah may Allah bless him and grant himpeace said Shave your head and fast three days or feed six poor menor sacrifice a sheep
  119. Yahya related to me from Malik from Nafi from Abdullah ibn Umarthat when the Messenger of Allah may Allah bless him and grant himpeace returned from a military expedition or a hajj or an umra heused to say three takbirs on every elevated part of the land and thenhe used to say There is no god but Allah alone without partner
  120. Muhaqala was buying unharvested wheat inexchange for threshed wheat and renting land in exchange for wheat
  121. The explanation of muzabana is thatit is buying something whose number weight and measure is not knownwith something whose number weight or measure is known for instance if a man has a stack of food whose measure is not known either ofwheat dates or whatever food or the man has goods of wheat datekernels herbs safflower cotton flax silk and does not know itsmeasure or weight or number and then a buyer approaches him andproposes that he weigh or measure or count the goods but before hedoes he specifies a certain weight or measure or number andguarantees to pay the price for that amount agreeing that whateverfalls short of that amount is a loss against him and whatever is inexcess of that amount is a gain for him
  122. Itwas also the same case for a man to say to a man who had fodderleaves date kernels cotton flax herbs or safflower I will buythese leaves from you in exchange for such and such a sa indicatingleaves which are pounded like his leaves
  123. Yahya related to me from Malik from Humayd ibn Qays al Makki thatMujahid said I was with Abdullah ibn Umar and an artisan came to himand said Abu Abd ar Rahman I fashion gold and then sell what Ihave made for more than its weight
  124. Malik said The way of doing things among us concerning someonewho makes an advance for foodstuffs at a known rate until a stateddate and the date arrives and he finds that there is not enough ofwhat he was sold with the seller to fulfill his order and so herevokes the sale is that he must only take back the silver gold orprice which he paid exactly
  125. That was because when the food was made ready for the buyer bythe seller the buyer deferred his due from the seller in order thathe might revoke the sale for him
  126. Whatever makes a sale halal makes it halal andwhatever makes a sale haram makes it haram
  127. If he paid in advance for red raisins there is noharm if he takes black ones when it happens after the agreed deliverydate and when the measure of what he takes is like the measure ofwhat he paid for in advance
  128. There is no harm in a man buying food for a fraction of adirham on credit and then he gives a dirham and takes goods with whatremains of his dirham because he gave the fraction he owed as silver and took goods to make up the rest of his dirham
  129. Yahya related to me from Malik from Da ud ibn al Husayn that heheard Said ibn alMusayyab say Part of the gambling of the people ofJahiliya was bartering live animals for slaughtered meat for instanceone live sheep for two slaughtered sheep
  130. If both sorts resemble each other but their namesare different like lead and black lead brass and yellow brass Idisapprove of taking two of one sort for one of the other on delayedterms
  131. Malik said The way ofdoing things among us with what is measured or weighed of things whichare not eaten or drunk like safflower date stones fodder leaves indigo dye and the like of that is that there is no harm in barteringall those sort of things two for one hand to hand
  132. Yahya related to me that Malik said The generally agreed onway of doing things among us about a man buying cloth in one city andthen taking it to another city to sell as a murabaha is that he isnot reckoned to have the wage of an agent or any allowance forironing folding straightening expenses or the rent of a house
  133. So if he sells the draperygoods without clarifying the things we named as not getting profit and if the drapery has already gone the transport is to be reckoned but no profit is given
  134. Malik said If aman sells goods worth one hundred dinars for one hundred and ten andhe hears after that they are worth ninety dinars and the goods havegone the seller has a choice
  135. If he wishes he gives thesalesman the value of the goods on the day he took them and if hewishes he gives the price for which he bought them according to thereckoning of what profit he gives him as far as it goes unless thatis less than the price for which he bought them for he should notgive the owner of the goods a loss from the price for which he boughtthem because he was satisfied with that
  136. Malik said about a manwho gave a man goods to sell for him and set their price saying Ifyou sell them for this price as I have ordered you to do you willhave a dinar or something which he has specified which they are bothsatisfied with if you do not sell them you will have nothing There is no harm in that when he names a price to sell them at andnames a known fee
  137. Malik said As for a man who is given goods and told that if hesells them he will have a named percentage for every dinar that isnot good because whenever he is a dinar less than the price of thegoods he decreases the due which was named for him
  138. Yahya related to me from Malik from Abdullah ibn Abd ar Rahmanibn Mamar al Ansari from Abu Yunus the mawla of A isha from A ishathat she overheard a man standing at the door saying to the Messengerof Allah may Allah bless him and grant him peace Messenger ofAllah I get up in the morning junub in a state of major ritualimpurity and want to fast and the Messenger of Allah may Allahbless him and grant him peace said I too get up in the morningjunub and want to fast so I do ghusl and fast
  139. Yahya related to me from Malik from Sumayy the mawla of Abu Bakribn Abd ar Rahman from Abu Bakr ibn Abd ar Rahman from one of thecompanions of the Messenger of Allah that the Messenger of Allah mayAllah bless him and grant him peace ordered everyone to break thefast on the journey he made in the year of the conquest saying Bestrong for your enemy while the Messenger of Allah may Allah blesshim and grant him peace kept on fasting
