- Malik said The generally agreed on way of doing things among us about a child of a slave by a free woman while the father of the slave is free is that the grandfather the father of the slave attracts the wala of his son s free children by a free woman
- Malik said that if a slave asked his master s permission to free a slave of his and his master gave permission the wala of the freed slave went to the master of his master and his wala did not return to the master who had set him free even if he were to become free himself
- Malik said The practice with usconcerning a free woman whose husband dies is that she does an iddaof four months and ten days and she does not marry if she doubts herperiod until she is free of any doubt or if she fears that she ispregnant
- A quack By Allah Yahya said that he heard Maliksay If someone makes use of a slave without permission of itsmaster in anything important to him whose like has a fee he isliable for what befalls the slave if anything befalls him
- Malik related to me from Ibn Shihab from Said ibn al Musayyabthat Uthman ibn Affan said If someone gives something to his smallchild who is not old enough to look after it himself and in orderthat his gift might be permitted he makes the gift public and has itwitnessed the gift is permitted even if the father keeps charge ofit
- He said That is not good even if it isonly one dirham unless he stipulates that half the profit is his andhalf the profit is the agent s or a third or a fourth or whatever
- Yahya said that Malik said The generally agreed on way of doingthings among us about an investor who pays qirad money to an agent tobuy goods and the agent then sells the goods for a price to be paidlater and has a profit in the transaction then the agent dies beforehe has received payment is that if his heirs want to take that money they have their father s stipulated portion from the profit
- Malik said If a mukatab dies and leaves moreproperty than what remains to be paid of his kitaba and he haschildren who were born during the time of his kitaba or whose kitabahas been written as well they inherit any property that remains afterthe kitaba has been paid
- Malik said The best of what is said about a man who buys themukatab of a man is that if the man wrote the slave s kitaba fordinars or dirhams he does not sell him unless it is for merchandisewhich is paid immediately and not deferred because if it is deferred it would be a debt for a debt
- That is because it islike the severance of a partner and a partner can only make asettlement for a partner of the one who is mukatab with the permissionof his partners because what is sold of him does not give him completerights as a free man and his property is barred from him and bybuying part of himself it is feared that he will become incapable ofcompleting payment because of what he had to spend
- Malik said that ifa mukatab died and left an umm walad and small children by her or bysomeone else and they could not work and it was feared that they wouldbe unable to fulfil their kitaba the umm walad of the father was soldif her price would pay all the kitaba for them whether or not she wastheir mother
- Malik said When aman reduces the kitaba of his mukatab by one thousand dirhams at hisdeath from a kitaba of ten thousand dirhams and he does not stipulatewhether it is from the beginning or the end of his kitaba eachinstalment is reduced for him by one tenth
- That thousand which is from thebeginning of the kitaba is converted into its portion of the priceaccording to its proximity to the term and its precedence and then thethousand which follows the first thousand is according to itsprecedence also until it comes to its end and every thousand is paidaccording to its place in advancing and deferring the term becausewhat is deferred of that is less in respect of its price
- Malik said about a man who said inhis will My slave so and so is free and write a kitaba for so and so that the setting free had priority over the kitaba
- Yahya related to me from Malik that he had heard the people ofknowledge say that when a man hit game and something else might havecontributed to death like water or an untrained dog that game wasnot to be eaten unless it was beyond doubt that it was the arrow ofthe hunter that had killed it by reaching a vital organ so that itdid not have any life after that
- Yahyasaid that Malik was asked whether it was enough for a man who had madea vow that he would walk to the House of Allah a certain large number of times or who had forbidden himself from talking to hisfather and brother if he did not fulfil a certain vow and he hadtaken upon himself by the oath something which he was incapable offulfilling in his lifetime even though he were to try every year tofulfil only one or a smaller number of vows by Allah Malik said The only satisfaction for that that I know is fulfilling what he hasobliged himself to do
