When ye release their property to them, take witnesses in their presence: But all-sufficient is Allah in taking account.

They can only marry them if they give them their full Mahr. And if they had no desire to marry them because of their lack of wealth and beauty; they would leave them and marry other women. So; as they used to leave them; when they had no interest; in them; they were forbidden to marry them when they had such interest; unless they treated them justly and gave them their full Mahr Apostle said; If at all there is evil omen; it is in the horse; the woman and the house. a lady is to be warded off. SahihAlBukhari-017-001-4080Narrated AlZuhri: Urwa Bin AlZubair said that he asked Aisha about the meaning of the Quranic Verse:- And if you fear that you will not deal fairly with the orphan girls then marry other women of your choice. 4.2-3 Aisha said; It is about a female orphan under the guardianship of her guardian who is inclined towards her because of her beauty and wealth; and likes to marry her with a Mahr less than what is given to women of her standard. So they i.e. guardians were forbidden to marry the orphans unless they paid them a full appropriate Mahr otherwise they were ordered to marry other women instead of them. Later on the people asked Allah Messenger ﷺ about it. So Allah revealed the following Verse:- They ask your instruction O Muhammad! regarding women. Say: Allah instructs you regarding them... 4.127 and in this Verse Allah indicated that if the orphan girl was beautiful and wealthy; her guardian would have the desire to marry her without giving her an appropriate Mahr equal to what her peers could get; but if she was undesirable for lack of beauty or wealth; then he would not marry her; but seek to marry some other woman instead of her. Yunis said: Ruzaiq Bin Hukaim wrote to Ibn Shihab while I was with him at Wadi AlQura saying; Shall I lead the Jumua prayer? Ruzaiq was working on the land i.e. farming and there was a group of Sudanese people and some others with him; Ruzaiq was then the Governor of Aila. Aisha further said; After that verse the people again asked the Prophet about the marriage with orphan girls ; so Allah revealed the following verses:- They ask your instruction Concerning the women. Say: Allah Instructs you about them And about what is Recited unto you In the Book; concerning The orphan girls to whom You give not the prescribed portions and yet whom you Desire to marry... 4.127 What is meant by Allah Saying:- And about what is Recited unto you is the former verse which goes:- If you fear that you shall not Be able to deal justly With the orphan girls; then Marry other women of your choice. 4.3 Aisha said; Allah saying in the other verse:-Yet whom you desire to marry 4.127 means the desire of the guardian to marry an orphan girl under his supervision when she has not much property or beauty in which case he should treat her justly. So such guardians were forbidden to do that unless they did justice to their female wards and gave them the highest Mahr their peers might get. They were ordered by Allah; to marry women of their choice other than those orphan girls. Aisha added; The people asked Allah Messenger ﷺ his instructions after the revelation of this Divine Verse whereupon Allah revealed: They ask your instruction regarding women 4.127 Aisha further said; And the Statement of Allah: And yet whom you desire to marry. 4.127 as anyone of you refrains from marrying an orphan girl under his guardianship when she is lacking in property and beauty. A man is a guardian over the members of his family and shal be questioned about them as to how he looked after their physical and moral well-being. A woman is a guardian over the household of her husband and his children and shall be questioned about them as to how she managed the household and brought up the children. A slave is a guardian over the property of his master and shall be questioned about it as to how he safeguarded his trust. SunanAlNasai-017-001-14459It was narrated from Umm Salamah; that when her Iddah had ended; Abu Bakr sent word to her proposing marriage to her; but she did not marry him. Then the Messenger of Allah sent Umar Bin AlKhattab with a proposal of marriage. She said: Tell the Messenger of Allah that I am a jealous woman and that I have sons; and none of my guardians are present. He went to the Messenger of Allah and told him that. He said: Go back to her and tell her: As for your saying that you are a jealous woman; I will pray to Allah for you to take away your jealousy. As for your saying that you have sons; your sons will be taken care of. And as for your saying that none of your guardians are present; none of your guardians; present or absent; would object to that. SunanAbuDawoud-017-001-24907Ibn Shihab said Urwah Bin AlZubair asked Aisha ; wife of the Prophet ﷺ about the Quranic verse And if ye fear that ye will not deal fairly by the orphans; marry of the women; who seem good to you. She said O my nephew; this means the female orphan who is under the protection of her guardian and she holds a share in his property and her property and beauty attracts him; so her guardian intends to marry her without doing justice to her in respect of her dower and he gives her the same amount of dower as others give her. They i.e.; the guardians were prohibited to marry them except that they do justice to them and pay them their maximum customary dower and they were asked to marry women other than them i.e.; the orphans who seem good to them. Urwah reported that Aisha said The people then consulted the Apostle of Allaah ﷺ about women after revelation of this verse. Thereupon Allaah the Exalted sent down the verse They consult thee concerning women. Say Allaah giveth you decree concerning them and the scripture which hath been recited unto you giveth decree concerning female orphans unto whom you give not that which is ordained for them though you desire to marry them. She said The mention made by Allaah about the Scripture recited to them refers to the former verse in which Allaah has said And if ye fear that ye will not deal fairly by the orphans; marry of the women; who seem good to you. Aisha said The pronouncement of Allaah ; the Exalted in the latter verse though you desire to marry them means the disinterest of one of you in marrying a female orphan who was under his protection; but she said little property and beauty. So they were prohibited to marry them for their interest in the property and beauty of the female orphans due to their disinterest in themselves except that they do justice to them. MuwataMalik-017-001-35313Yahya related to me from Malik from Yahya Ibn Said that Said Ibn AlMusayab had said that Umar Ibn AlKhattab said; If a man marries a woman who is insane; or has leprosy or white leprosy; without being told of her condition by her guardian; and he has sexual relations with her; she keeps her bride-price in its entirety. Her husband has damages against her guardian. Malik said; The husband has damages against her guardian when the guardian is her father; brother; or one who is deemed to have knowledge of her condition.
