SahihAlBukhari-017-001-3517Narrated Urwa Bin AlZubair: Aisha; the wife of the Prophet ﷺ told him that there were four types of marriage during Pre-Islamic period of Ignorance. One type was similar to that of the present day i.e. a man used to ask somebody else for the hand of a girl under his guardianship or for his daughter hand; and give her Mahr and then marry her. The second type was that a man would say to his wife after she had become clean from her period. Send for so-and-so and have sexual intercourse with him. Her husband would then keep awy from her and would never sleep with her till she got pregnant from the other man with whom she was sleeping. When her pregnancy became evident; he husband would sleep with her if he wished. Her husband did so i.e. let his wife sleep with some other man so that he might have a child of noble breed. Such marriage was called as AlIstibda. Another type of marriage was that a group of less than ten men would assemble and enter upon a woman; and all of them would have sexual relation with her. If she became pregnant and delivered a child and some days had passed after delivery; she would sent for all of them and none of them would refuse to come; and when they all gathered before her; she would say to them; You all know waht you have done; and now I have given birth to a child. So; it is your child so-and-so! naming whoever she liked; and her child would follow him and he could not refuse to take him. The fourth type of marriage was that many people would enter upon a lady and she would never refuse anyone who came to her. Those were the prostitutes who used to fix flags at their doors as sign; and he who would wished; could have sexual intercourse with them. If anyone of them got pregnant and delivered a child; then all those men would be gathered for her and they would call the Qaif persons skilled in recognizing the likeness of a child to his father to them and would let the child follow the man whom they recognized as his father and she would let him adhere to him and be called his son. The man would not refuse all that. SahihAlBukhari-017-001-5014Narrated Abdullah Bin Umar: I heard Allah Messenger ﷺ saying; Three men from among those who were before you; set out together till they reached a cave at night and entered it. A big rock rolled down the mountain and closed the mouth of the cave. They said to each other ; Nothing could save you from this rock but to invoke Allah by giving reference to the righteous deed which you have done for Allah sake only. So; one of them said; O Allah! I had old parents and I never provided my family wife; children etc. with milk before them. One day; by chance I was delayed; and I came late at night while they had slept. I milked the sheep for them and took the milk to them; but I found them sleeping. I disliked to provide my family with the milk before them. I waited for them and the bowl of milk was in my hand and I kept on waiting for them to get up till the day dawned. Then they got up and drank the milk. O Allah! If I did that for Your Sake only; please relieve us from our critical situation caused by this rock. So; the rock shifted a little but they could not get out. The Prophet ﷺ added; The second man said; O Allah! I had a cousin who was the dearest of all people to me and I wanted to have sexual relations with her but she refused. Later she had a hard time in a famine year and she came to me and I gave her one-hundred-and-twenty Dinars on the condition that she would not resist my desire; and she agreed. When I was about to fulfill my desire; she said: It is illegal for you to outrage my chastity except by legitimate marriage. So; I thought it a sin to have sexual intercourse with her and left her though she was the dearest of all the people to me; and also I left the gold I had given her. O Allah! If I did that for Your Sake only; please relieve us from the present calamity. So; the rock shifted a little more but still they could not get out from there. The Prophet ﷺ added; Then the third man said; O Allah! I employed few laborers and I paid them their wages with the exception of one man who did not take his wages and went away. I invested his wages and I got much property thereby. Then after some time he came and said to me: O Allah slave! Pay me my wages. I said to him: All the camels; cows; sheep and slaves you see; are yours. He said: O Allah slave! Dont mock at me. I said: I am not mocking at you. So; he took all the herd and drove them away and left nothing. O Allah! If I did that for Your Sake only; please relieve us from the present suffering. Hadrat Ali refrained from striking his neck. SahihMuslim-017-001-20731Anas reported that the son of Abu Talba who was born of Umm Sulaim died. She Umm Sulaim said to the members of her family: Do not narrate to Abu Talha about his son until I narrate it to him. Abu Talha came home ; she presented to him the supper. He took it and drank water. She then embellished herself which she did not do before. He Abu Talha had a sexual intercourse with her and when she saw that he was satisfied after sexual intercourse with her; she said: Abu Talha ; if some people borrow something from another family and then the members of the family ask for its return; would they resist its return? He said: No. She said: I inform you about the death of your son. He was annoyed; and said: You did not inform me until I had a sexual intercourse with you and you later on gave me information about my son. He went to Allah Messenger ﷺ and informed him what had happened. Thereupon Allah Messenger ﷺ said: May Allah bless both of you in the night spent by you! He the narrator said: She became pregnant. Allah Messenger may peace he upon him was in the course of a journey and she was along with him and when Allah Messenger ﷺ came back to Medina from the journey he did not enter his house during the night. When the people came near Medina; she felt the pangs of delivery. He Abu Talha remained with her and Allah Messenger ﷺ proceeded on. Abu Talha said: O Lord; you know that I love to go along with Allah Messenger when he goes out and enter along with him when he enters and I have been detained as Thou seest. Umm Sulaim said: Abu Talha ; I do not feel so much pain as I was feeling formerly; so better proceed on. So we proceeded on and she felt the pangs of delivery as they reached Medina and a child was born and my mother said to me: Anas; none should suckle him until you go to Allah Messenger ﷺ tomorrow morning. And when it was morning I carried him the child and went along with him to Allah Messenger may peace beupon him. He said: I saw that he had in his hand the instrument for the cauterisation of the camels. When he saw me. he said: This is; perhaps; what Umm Sulaim has given birth to. I said: Yes. He laid down that instrument on the ground. I brought that child to him and placed it in his lap and Allah Messenger ﷺ asked Ajwa dates of Medina to be brought and softened them in his month. When these had become palatable he placed them in the mouth of that child. The child began to taste them. Then Allah Messenger ﷺ said: See what love the Ansar have for dates. SahihMuslim-017-001-21481Ibn Umar Allah be pleased with them reported that he divorced his wife during the period of menses. Umar Allah be; pleased with him asked Allah Apostle ﷺ ; and he commanded him Abdullah Bin Umar to have her back and then allow her respite until she enters the period of the second menses; and then allow her respite until she is purified; then divorce her finally before touching her having a sexual intercourse with her ; for that is the prescribed period which Allah commanded to be kept in view for divorcing the women. SunanAbuDawoud-017-001-26489A man from Banu Amir said: I embraced Islam and my ignorance of the religion made me anxious to learn the essentials. I came to Abu Dharr. Abu Dharr said: The climate of Medina did not suit me. The Messenger of Allah ﷺ ordered me to have a few camels and goats. He said to me: Drink their milk. The narrator Hammad said : I doubt whether he the Prophet said: their urine. Abu Dharr said: I was away from the watering place and I had my family with me. I would have sexual defilement and pray without purification. I came to the Messenger of Allah ﷺ at noon. He was resting in the shade of the Masjid along with a group of Companions. He the Prophet said: Abu Dharr. I said: Yes; I am ruined; Messenger of Allah. He said: What ruined you ? I said: I was away from the watering place and I had family with me. I used to be sexually defiled and pray without purification. He commanded to bring water for me. Then a black slave-girl brought a vessel of water that was shaking as the vessel was not full. I concealed myself behind a camel and took bath and them came to the Prophet. The Messenger of Allah ﷺ said: Abu Dharr; clean earth is a means of ablution; even if you do not find water for ten years. When you find water; you should make it touch your skin.Abu Dawud said: This is transmitted by Hammad Bin Zaid from Ayoub. This version does not mention the words their urine. This is not correct. He adjured them and said: How do you think about the matter if these two persons bear witness to the effect that they have seen his sexual organ in her female organ penetrated like a collyrium stick when enclosed in its case; they will be stoned to death. He asked: What is there which prevents you from stoning them: They replied : Our rule has gone; so we disapproved of killing. The Messenger of Allah ﷺ then called four witnesses. They brought four witnesses. Who testified that they had seen his sexual organ penetrated in her female organ like a collyrium stick when enclosed in its case. MuwataMalik-017-001-35900Yahya related to me from Malik that he had heard Rabia Ibn Abi Abdulrahman saying the same about that as what Ikrama related from Ibn Abbas. Malik said; That is what I like most out of what I have heard about the matter. Malik was asked about a man who forgot the tawaf Alifada until he had left Makka and returned to his community and he said; I think that he should go back and do the tawaf Alifada; as long as he has not had sexual relations with women. If; however; he has had sexual relations with women; then he should not only return and do the tawaf Alifada; but he should also do an umra and sacrifice an animal. MuwataMalik-017-001-36184Yahya related to me from Malik from Hisham Ibn Urwa that his father said; A woman who bleeds as if menstruating only has to do one ghusl; and then after that she does Ablution for each prayer. Yahya said that Malik said; The position with us is that when a woman who bleeds as if menstruating starts to do the prayer again; her husband can have sexual intercourse with her. Similarly; if a woman who has given birth sees blood after she has reached the fullest extent that bleeding normally restrains women; her husband can have sexual intercourse with her and she is in the same position as a woman who bleeds as if menstruating.
