Thus (are ye commanded): but if it had been Allah's Will, He could certainly have exacted retribution from them (Himself); but (He lets you fight) in order to test you, some with others. But those who are slain in the Way of Allah, - He will never let their deeds be lost. | |

SahihAlBukhari-017-001-4993 | Narrated Saeed Bin Jubair: Ibn Abbas said; In the verse: To every one We have appointed Muwaliya Muwaliya means ones heirs 4.33. And regarding the verse And those with whom your right hands have made a pledge. Ibn Abbas said; When the emigrants came to the Prophet ﷺ in Medina; the emigrant would inherit the Ansari while the latter relatives would not inherit him because of the bond of brotherhood which the Prophet established between them i.e. the emigrants and the Ansar. When the verse: And to everyone We have appointed heirs 4.33 was revealed; it canceled the bond the pledge of brotherhood regarding inheritance. When the Emigrants came to Medina; an Emigrant used to be the heir of an Ansari with the exclusion of the latter relatives; and that was because of the bond of brotherhood which the Prophet ﷺ had established between them i.e. the Emigrants and the Ansar. SunanAlNasai-017-001-14593 | It was narrated from Humaid AlTawil that he heard Anas say: The Messenger of Allah established the bond of brotherhood between some of the Quraish and some of the Ansar; and he established the bond of brotherhood between Saad Bin AlRabi and Abdulrahman Bin Awuf. Saad said to him: I have wealth; which I will share equally between you and me. And I have two wives; so look and see which one you like better; and I will divorce her; and when her Iddah is over you can marry her. He said: May Allah bless your family and your wealth for you. Show me -i.e.; where the market is. And he did not come back until he brought some ghee; and cottage cheese that he had left over. He said: The Messenger of Allah saw traces of yellow perfume on me and he said: What is this for? I said: I have married a woman from among the Ansar. MuwataMalik-017-001-34817 | Malik related to me that he heard Ibn Shihab say; The precedent of the sunna is that when a slave is freed; his property follows him. Malik said; One thing which makes clear that the property of a slave follows him when he is freed is that when the contract mukatab is written for his freedom; his property follows him even if he did not stipulate it. That is because the bond of kitaba is the bond of wala when it is complete. The property of a slave and a mukatab is not treated in the same way as any children they may have. Their children are only treated in the same way as their own slaves; not in the same way as their property. This is because the sunna; in which there is no dispute; is that when a slave is freed; his property follows him and his children do not follow him; and when a mukatab writes the contract for his freedom; his property follows him and his children do not follow him. Malik said; One thing which makes that clear is that when a slave or a mukatab are bankrupt; their property is taken but the mothers of their children and their children are not taken because they are not their property. Malik said; Another thing which makes it clear is that when a slave is sold and the person who buys him stipulates the inclusions of his property; his children are not included in his property.
