Haram said to his companions ; Stay near to me; for I will go to them. If they i.e. infidels should give me protection; you will be near to me; and if they should kill me; then you should go back to your companions. SahihMuslim-017-001-17985 | It has been reported from Sulaiman Bin Buraida through his father that when the Messenger of Allah ﷺ appointed anyone as leader of an army or detachment he would especially exhort him to fear Allah and to be good to the Muslims who were with him. He would say: Fight in the name of Allah and in the way of Allah. Fight against those who disbelieve in Allah. Make a holy war; do not embezzle the spoils; do not break your pledge; and do not mutilate the dead bodies; do not kill the children. When you meet your enemies who are polytheists; invite them to three courses of action. If they respond to any one of these; you also accept it and withhold yourself from doing them any harm. Invite them to accept Islam; if they respond to you; accept it from them and desist from fighting against them. Then invite them to migrate from their lands to the land of the Muhajireen and inform them that; if they do so; they shall have all the privileges and obligations of the Muhajireen. If they refuse to migrate; tell them that they will have the status of Bedouin Muslims and will be subjected to the Commands of Allah like other Muslims; but they will not get any share from the spoils of war or Fai except when they actually fight with the Muslims against the disbelievers. If they refuse to accept Islam; demand from them the Jizya. If they agree to pay; accept it from them and hold off your hands. If they refuse to pay the tax; seek Allah help and fight them. When you lay siege to a fort and the besieged appeal to you for protection in the name of Allah and His Prophet; do not accord to them the guarantee of Allah and His Prophet; but accord to them your own guarantee and the guarantee of your companions for it is a lesser sin that the security given by you or your companions be disregarded than that the security granted in the name of Allah and His Prophet be violated. When you besiege a fort and the besieged want you to let them out in accordance with Allah Command; do not let them come out in accordance with His Command; but do so at your own command; for you do not know whether or not you will be able to carry out Allah behest with regard to them. | The Chapter on Inviting The Idolaters And Infidels To Islam in HodHood Indexing, Chapter on 2 in Sahih Muslim
SahihMuslim-017-001-18033 | Auf Bin Malik has narrated that a man from the Himyar tribe killed an enemy and wanted to take the booty. Khalid Bin Walid; who was the commander over them; forbade; him. Auf b Malik the narrator came to the Messenger of Allah ﷺ and informed him to this effect. The latter asked Khalid: What prevented you from giving the booty to him? Khalid said: I thought it was too much. He the Holy Prophet said: Hand it over to him. Now when Khalid by Auf; the latter pulled him by his cloak and said by way of chafing him : Hasnt the same thing happened what I reported to you from the Messenger of Allah may peace he upon him ? When the Messenger of Allah ﷺ heard it. he was angry and said : Khalid; dont give him; Khalid; dont give him. Are you going to desert the commanders appointed by roe? Your similitude and theirs is like a person who took camels and sheep for grazing. He grazed them and when it was time for them to have a drink; he brought them to a pool. So they drank from it; drinking away its clear water and leaving the turbid water below So the clear water i. e. the best reward is for you and the turbid water i e. blame is for them. | The Chapter on Live Stock And Gifts in HodHood Indexing, Chapter on 13 in Sahih Muslim
SahihMuslim-017-001-18040 | It is reported by Zuhri that this tradition was narrated to him by Malik Bin Aus who said: Umar Bin AlKhattab sent for me and I came to him when the day had advanced. I found him in his house sitting on his bare bed-stead; reclining on a leather pillow. He said to me : Malik; some people of your tribe have hastened to me with a request for help. I have ordered a little money for them. Take it and distribute it among them. I said: I wish you had ordered somebody else to do this job. He said: Malik; take it and do what you have been told. At this moment his man-servant Yarfa came in and said: Commander of the Faithful; what do you say about Uthman; Abd AlRabman Bin Auf; AlZubair and Saad who have come to seek an audience with you ? He said: Yes; and permitted them. so they entered. Then he Yarfa came again and said: What do you say about Ali and Abbas who are present at the door ? He said: Yes; and permitted them to enter. Abbas said: Commander of the Faithful; decide the dispute between me and this sinful; treacherous; dishonest liar. The people who were present also said: Yes. Commander of the Faithful; do decide the dispute and have mercy on them. Malik Bin Aus said: I could well imagine that they had sent them in advance for this purpose by Ali and Abbas. Umar said: Wait and be patient. I adjure you by Allah by Whose order the heavens and the earth are sustained; dont you know that the Messenger of Allah ﷺ said: We prophets do not have any heirs; what we leave behind is to be given in charity? They said: Yes. Then he turned to Abbas and Ali and said: I adjure you both by Allah by Whose order the heavens and earth are sustained; dont you know that the Messenger of Allah ﷺ said: We do not have any heirs; what we leave behind is to be given in charity? They too said: Yes. Then Umar said: Allah; the Glorious and Exalted; had done to His Messenger ﷺ a special favour that He has not done to anyone else except him. He quoted the Quranic verse: What Allah has bestowed upon His Apostle from the properties of the people of township is for Allah and His Messenger. The narrator said: I do not know whether he also recited the previous verse or not. Umar continued: The Messenger of Allah ﷺ distrbuted among you the properties abandoned by Banu Nadir. By Allah; he never preferred himself over you and never appropriated anything to your exclusion. After a fair distribution in this way this property was left over. The Messenger of Allah ﷺ would meet from its income his annual expenditure; and what remained would be deposited in the Bait AlMal. Continuing further he said: I adjure you by Allah by Whose order the heavens and the earth are sustained. Do you know this? They said: Yes. Then he adjured Abbas and All as he had adjured the other persons and asked: Do you both know this? They said: Yes. He said: When the Messenger of Allah ﷺ passed away; Abu Bakr said: I am the successor of the Messenger of Allah ﷺ. Both of you came to demand your shares from the property left behind by the Messenger of Allah. Referring to Hadrat Abbas ; he said: You demanded your share from the property of your nephew; and he referring to Ali demanded a share on behalf of his wife from the property of her father. Abu Bakr Allah be pleased with him said: The Messenger of Allah ﷺ had said: We do not have any heirs; what we leave behind is to be given in charity. So both of you thought him to be a liar; sinful; treacherous and dishonest. And Allah knows that he was true; virtuous; well-guided and a follower of truth. When Abu Bakr passed away and I have become the successor of the Messenger of Allah ﷺ and Abu Bakr Allah be pleased with him ; you thought me to be a liar; sinful; treacherous and dishonest. And Allah knows that I am true; virtuous; well-guided and a follower of truth. I became the guardian of this property. Then you as well as he came to me. Both of you have come and your purpose is identical. You said: Entrust the property to us. I said: If you wish that I should entrust it to you; it will be on the condition that both of you will undertake to abide by a pledge made with Allah that you will use it in the same way as the Messenger of Allah ﷺ used it. So both of you got it. He said: Wasnt it like this? They said: Yes. He said: Then you have again come to me with the request that I should adjudge between you. No; by Allah. I will not give any other judgment except this until the arrival of the Doomsday. If you are unable to hold the property on this condition; return it to me. | The Chapter on Contracts And Disputes Management in HodHood Indexing, Chapter on 15 in Sahih Muslim
SahihMuslim-017-001-18088 | It has been narrated on the authority of Abdullah Bin Rabah who said: We came to Muawiya Bin Abu Sufyan as a deputation and Abu Huraira was among us. Each of us would prepare food for his companions turn by turn for a day. Accordingly when it was my turn I said: Abu Huraira; it is my turn today. So they came to my place. The food was not yet ready; so I said to Abu Huraira: I wish you could narrate to us a tradition from the Messenger of Allah ﷺ until the food was ready. Complying with my request Abu Huraira said: We were with the Messenger of Allah ﷺ on the day of the Conquest of Mecca. He appointed Khalid Bin Walid as commander of the right flank; AlZubair as commander of the left flank; and Abu Ubaida as commander of the foot-soldiers who were to advance to the interior of the valley. He then said: Abu Huraira; call the Ansar to me. So I called out to them and they came hurriedly. He said: O ye Assembly of the Ansaar; do you see the ruffians of the Quraish? They said: Yes. He said: See; when you meet them tomorrow; wipe them out. He hinted at this with his hand; placing his right hand on his left and said: You will meet us at AlSafa. Abu Huraira continued : Whoever was seen by them that day was put to death. The Messenger of Allah ﷺ ascended the mount of AlSafa. The Ansar also came there and surrounded the mount. Then came Abu Sufyan and said: Messenger ot Allah; the Quraish have perished. No member of the Quraish tribe will survive this day. The Messenger of Allah ﷺ said: Who enters the house of Abu Safyin will be safe; who lays down arms will be safe; who locks his door will be safe. some of the Ansar said: After all the man has been swayed by tenderness towards his family and love for his city. At this; Divine inspiration descended upon the Messenger of Allah ﷺ. He said: You were saying that the man has been swayed by tenderness towards his family and love for his city. Do you know what my name is? I am Muhammad; the bondman of God and His Messenger. He repeated this thrice. I left my native place for the take of Allah and joined you. So I will live with you and die with you. Now the Ansar said: By God; we said that only out of our greed for Allah and His Messenger. Direct us to an act which we should ourselves perform and invite those who live beside us. Upon this the Prophet remarked: I command you to do four things and prohibit you against four acts. The four deeds which you are commanded to do are : Faith in Allah; and then he explained it for them and said: Testifying the fact. that there is no god but Allah; that Muhammad is the messenger of Allah; performance of prayer; payment of Zakat; that you pay Khums one-fifth of the booty fallen to your lot; and I prohibit you to use round gourd; wine jars; wooden pots or skins for wine. They replied that they belonged to the tribe of Rabia. He the Holy Prophet welcomed the people or the delegation which were neither humiliated nor put to shame. They the members of the delegation said: Messenger of Allah; we come to you from a far-off distance and there lives between you and us a tribe of the unbelievers of Mudar and; therefore; it is not possible for us to come to you except in the sacred months. Thus direct us to a clear command; about which we should inform people beside us and by which we may enter heaven. He the Holy Prophet replied: I command you to do four deeds and forbid you to do four acts ; and added: I direct you to affirm belief in Allah alone; and then asked them: Do you know what belief in Allah really implies? They said: Allah and His Messenger know best. The Prophet said: It implies testimony to the fact that there is no god but Allah; and that Muhammad is the messenger of Allah; establishment of prayer; payment of Zakat; fast of Ramadan; that you pay one-fifth of the booty fallen to your lot and I forbid you to use gourd; wine jar; or a receptacle for wine. Then there came after them their successors who said whatever they did not practise; and practised whatever they were not commanded to do. He who strove against them with his hand was a believer: he who strove against them with his tongue was a believer; and he who strove against them with his heart was a believer and beyond that there is no faith even to the extent of a mustard seed. I have created My servants as one having a natural inclination to the worship of Allah but it is Satan who turns them away from the right religion and he makes unlawful what has been declared lawful for them and he commands them to ascribe partnership with Re; although he has no justification for that. And verily; Allah looked towards the people of the world and He showed hatred for the Arabs and the non-Arabs; but with the exception of some remnants from the People of the Book. And He further said: I have sent thee the Holy Prophet in order to put you to test and put those to test through you. And I sent the Book to you which cannot be washed away by water; so that you may recite it while in the state of wakefulness or sleep. Verily; Allah commanded me to burn kill the Quraish. I said: My Lord; they would break my head like the tearing of bread; and Allah said: You turn them out as they turned you out; you fight against them and We shall help you in this; you should spend and you would be conferred upon. You send an army and I would send an army five times greater than that. Fight against those who disobey you along with those who obey you. The inmates of Paradise are three: One who wields authority and is just and fair; one who Is truthful and has been endowed with power to do good deeds. He stood at the gate and said: I adjure you by Allah Who revealed the Torah to Moses; what punishment do you find in the Torah for a person who commits fornication; if he is married? They said: He shall be blackened with charcoal; taken round a donkey among the people; and flogged. A young man among them kept silent. When the Prophet ﷺ emphatically adjured him; he said: By Allah; since you have adjured us we inform you that we find stoning in the Torah is the punishment for fornication. The Prophet ﷺ said: So when did you lessen the severity of Allah command? He said: A relative of one of our kings had committed fornication; but his stoning was suspended. Then a man of a family of common people committed fornication. He was to have been stoned; but his people intervened and said: Our man shall not be stoned until you bring your man and stone him. So they made a compromise on this punishment between them. The Prophet ﷺ said: So I decide in accordance with what the Torah says. He then commanded regarding them and they were stoned to death. AlZuhri said: We have been informed that this verse was revealed about them: It was We Who revealed the Law to Moses : therein was guidance and light. By its standard have been judged the Jews; by the Prophet who bowed as in Islam to Allah will. | The Chapter on Fornication And Adultery In Jewish Law in HodHood Indexing, Chapter on The stoning of the two jews in Sunan Abu Dawoud

MuwataMalik-017-001-34722 | Yahya related to me from Malik from Wahb Ibn Kaysan that Jabir Ibn Abdullah said; The Messenger of Allah; may Allah bless him and grant him peace; sent a delegation to the coast. Abu Ubayda Ibn AlJarrah was in command of them. There were 300 people and I was among them. We went out until we had gone part of the way and our provisions were finished. Abu Ubayda ordered that the provisions of the army be gathered up and they amounted to two containers of dates. He used to give us a little provision from it each day until it was finished; and we used to have only a single date each. I said; What use is one date? He said; We will certainly feel its loss when they are finished. Jabir continued; Then we reached the sea and there was a fish like a small mountain. The army ate from it for eighteen nights. Then Abu Ubayda ordered two ribs from it to be set up. Then he commanded that a camel be ridden underneath them and it did not touch them. | The Chapter on Throwing And Satan Knots in HodHood Indexing, The Book of Purity in Muwata Malik
MuwataMalik-017-001-34813 | Malik said; The generally agreed-on way of doing things among us in the case of slave whose master makes a bequest to free part of him - a third; a fourth; a half; or any share after his death; is that only the portion of him is freed that his master has named. This is because the freeing of that portion is only obliged to take place after the death of the master because the master has the option to withdraw the bequest as long as he lives. When the slave is freed from his master; the master is a testator and the testator only has access to free what he can take from his property; being the third of the property he is allowed to bequeath; and the rest of the slave is not free because the man property has gone out of his hands. How can the rest of the slave which belongs to other people be free when they did not initiate the setting free and did not confirm it and they do not have the wala established for them? Only the deceased could do that. He was the one who freed him and the one for whom the wala was confirmed. That is not to be borne by another property unless he bequeaths within the third of his property what remains of a lave to be freed. That is a request against his partners and inheritors and the partners must not refuse the slave that when it is within the third of the dead man property because there is no harm in that to the inheritors. Malik said; If a man frees a third of his slave while he is critically ill; he must complete the emancipation so all of him is free from him; if it is within the third of his property that he has access to; because he is not treated in the same way as a man who frees a third of a slave after his death; because had the one who freed a third of his slave after his death lived; he could have cancelled it and the slave being set free would be of no effect. The master who made the freeing of the third of the slave irrevocable in his illness; would still have to free all of him if he lived. If he died; the slave would be set free within the third of the bequest. That is because the command of the deceased is permissible in his third as the command of the healthy is permissible in all his property. | The Chapter on Slave As A Property in HodHood Indexing, The Book of Speech in Muwata Malik
MuwataMalik-017-001-36166 | Yahya related to me from Malik from Abd arRahman Ibn AlQasim from his father that Aisha umm Almuminin said; We went out on a journey with the Messenger of Allah; may Allah bless him and grant him peace; and; when we came to Bayda or Dhat AlJaysh; a necklace of mine broke. The Messenger of Allah; may Allah bless him and grant him peace; stopped to look for it and the people stopped with him. There was no water nearby and the people were not carrying any with them; so they came to Abu Bakr AlSiddiq and said; Dont you see what Aisha has done? She has made the Messenger of Allah; may Allah bless him and grant him peace; and the people stop when there is no water nearby and they are not carrying any with them. Aisha continued; Abu Bakr came and the Messenger of Allah; may Allah bless him and grant him peace; had fallen asleep with his head on my thigh. Abu Bakr said; You have made the Messenger of Allah; may Allah bless him and grant him peace; and the people stop when there is no water nearby and they are not carrying any with them She continued; Abu Bakr remonstrated with me and said whatever Allah willed him to say; and began to poke me in the waist. The only thing that stopped me from moving was that the Messenger of Allah; may Allah bless him and grant him peace; had his head on my thigh. The Messenger of Allah; may Allah bless him and grant him peace; slept until morning found him with no water. Allah; the Blessed and Exalted; sent down the ayat of tayammum and so they did tayammum. Usayd Ibn Hudayr said; This is not the first baraka from you; O family of Abu Bakr. Aisha added; We roused the camel I had been on and found the necklace under it. Malik was asked whether a man who did tayammum for one prayer should do tayammum when the time of the next prayer came or whether the first tayammum was enough. He said; No; he does tayammum for every prayer; because he has to look for water for every prayer. If he looks for it and does not find it then he does tayammum. Malik was asked whether a man who did tayammum could lead others in prayer if they were in Ablution. He said; I prefer that someone else should lead them. However; I see no harm in it if he does lead them in prayer. Yahya said that Malik said that a man who did tayammum because he could not find any water; and then stood and said the takbir and entered into the prayer; and then someone came with some water; did not stop his prayer but completed it with tayammum and did Ablution for future prayers. Yahya said that Malik said; Whoever rises for prayer and does not find water and so does what Allah has ordered him to do of tayammum has obeyed Allah. Someone who does find water is neither purer than him nor more perfect in prayer; because both have been commanded and each does as Allah has commanded. What Allah has commanded as far as Ablution is concerned is for the one who finds water; and tayammum is for the one who does not find water before he enters into the prayer. Malik said that a man who was in a state of major ritual impurity could do tayammum and read his portion of Quran and do voluntary prayers as long as he did not find any water. This applied only to circumstances in which it was allowable to pray with tayammum. | The Chapter on Peace And Ablution in HodHood Indexing, The Book of The Quran in Muwata Malik |
