Allah confirmed that through His Divine Revelation: Verily! Those who purchase a little gain at the cost of Allah covenant and their oaths... they will have a painful punishment. 3.77 AlAshath Bin Qais came to us and asked; What is Abu Abdulrahman i.e. Abdullah telling you? We told him what he was narrating to us. He said; He was telling the truth; this Divine Verse was revealed in connection with me. There was a dispute between me and another man about something and the case was filed before Allah Messenger ﷺ who said; Produce your two witnesses or else the defendant is to take an oath. I said; The defendant will surely take a false oath caring for nothing. The Prophet ﷺ said; Whoever takes a false oath in order to grab others property; then Allah will be angry with him when he will meet Him. Then Allah revealed its confirmation. SunanAbuDawoud-017-001-26847 | Narrated Anas Ibn Malik: Sahl Ibn Abu Umamah said that he and his father Abu Umamah visited Anas Ibn Malik at Medina during the time rule of Umar Ibn Abd AlAziz when he Anas Ibn Malik was the governor of Medina. He was praying a very short prayer as if it were the prayer of a traveller or near it. When he gave a greeting; my father said: May Allah have mercy on you! Tell me about this prayer: Is it obligatory or supererogatory? He said: It is obligatory; it is the prayer performed by the Messenger of Allah ﷺ. I did not make a mistake except in one thing that I forgot. He said: The Messenger of Allah ﷺ used to say: Do not impose austerities on yourselves so that austerities will be imposed on you; for people have imposed austerities on themselves and Allah imposed austerities on them. Their survivors are to be found in cells and monasteries. Then he quoted: Monasticism; they invented it; we did not prescribe it for them. Next day he went out in the morning and said: will you not go out for a ride; so that you may see something and take a lesson from it? He said: Yes. Then all of them rode away and reached a land whose inhabitants had perished; passed away and died. The roofs of the town had fallen in. He asked: Do you know this land? I said: Who acquainted me with it and its inhabitants? Anas said: This is the land of the people whom oppression and envy destroyed. SunanAbuDawoud-017-001-29279 | Abdullah Bin Umar reported that Umar said When Khaibar was conquered; the Jews asked the Apostle of Allaah ﷺ to confirm that they would do all the cultivation and have half the produce. The Apostle of Allaah ﷺ said I shall confirm you on that condition as long as we wish. So they were confirmed on that condition. The dates from half the produce of Khaibar were divided into a number of portions. The Apostle of Allaah ﷺ would take the fifth. The Apostle of Allaah ﷺ used to contribute from the fifth one hundred wasqs of dates and twenty wasqs of wheat to each of his wives. When Umar intended to expel the Jews from Khaibar he sent a message to the wives of the Prophet ﷺ and said to them If any of you wishes that I divide the palm trees for her by their assessment that amounts one hundred wasqs of dates and to her belongs their root; their land and their water and likewise twenty wasqs from the produce of the cultivated land by assessment; I shall do that. MuwataMalik-017-001-34547 | Malik related to me from Rabia Ibn Abi Abdulrahman from another of the ulama of that time that Abu Mousa AlAshari came and asked permission from Umar Ibn AlKhattab to enter. He asked permission three times; and then went away Umar Ibn AlKhattab sent after him and said; What wrong with you? Why didnt you come in? Abu Mousa said; I heard the Messenger of Allah; may Allah bless him and grant him peace; say; Ask permission to enter three times. If you are given permission; then enter. If not; go away. Umar said; Who can confirm this? If you do not bring me someone to confirm it; I will do such-and-such to you. Abu Mousa went out until he came to an assembly in the Masjid which was called the Majlis AlAnsar. He said; I told Umar Ibn AlKhattab that I heard the Messenger of Allah; may Allah bless him and grant him peace; say; Ask permission three times. If you are given permission; then enter. If not; go away. Umar said; If you do not bring me someone who can confirm it; I will do such- and-such to you. If any of you have heard that; let him come with me. They said to Abu Said AlKhudri; Go with him. Abu Said was the youngest of them. He went with him and told Umar Ibn AlKhattab about that. MuwataMalik-017-001-34813 | Malik said; The generally agreed-on way of doing things among us in the case of slave whose master makes a bequest to free part of him - a third; a fourth; a half; or any share after his death; is that only the portion of him is freed that his master has named. This is because the freeing of that portion is only obliged to take place after the death of the master because the master has the option to withdraw the bequest as long as he lives. When the slave is freed from his master; the master is a testator and the testator only has access to free what he can take from his property; being the third of the property he is allowed to bequeath; and the rest of the slave is not free because the man property has gone out of his hands. How can the rest of the slave which belongs to other people be free when they did not initiate the setting free and did not confirm it and they do not have the wala established for them? Only the deceased could do that. He was the one who freed him and the one for whom the wala was confirmed. That is not to be borne by another property unless he bequeaths within the third of his property what remains of a lave to be freed. That is a request against his partners and inheritors and the partners must not refuse the slave that when it is within the third of the dead man property because there is no harm in that to the inheritors. Malik said; If a man frees a third of his slave while he is critically ill; he must complete the emancipation so all of him is free from him; if it is within the third of his property that he has access to; because he is not treated in the same way as a man who frees a third of a slave after his death; because had the one who freed a third of his slave after his death lived; he could have cancelled it and the slave being set free would be of no effect. The master who made the freeing of the third of the slave irrevocable in his illness; would still have to free all of him if he lived. If he died; the slave would be set free within the third of the bequest. MuwataMalik-017-001-34907 | Malik related to me that he heard that Abu Salama Ibn Abdulrahman and Sulayman Ibn Yasar were both asked; Does one pronounce judgement on the basis of an oath with one witness? They both said; Yes. Malik said; The precedent of the sunna in judging by an oath with one witness is that if the plaintiff takes an oath with his witness; he is confirmed in his right. If he draws back and refuses to take an oath; the defendant is made to take an oath. If he takes an oath; the claim against him is dropped. If he refuses to take an oath; the claim is confirmed against him. Malik said; This procedure pertains to property cases in particular. It does not occur in any of the hadd-punishments; nor in marriage; divorce; freeing slaves; theft or slander. If some one says; Freeing slaves comes under property; he has erred. It is not as he said. Had it been as he said; a slave could take an oath with one witness; if he could find one; that his master had freed him. However; when a slave lays claim to a piece of property; he can take an oath with one witness and demand his right as the freeman demands his right. Malik said; The sunna with us is that when a slave brings somebody who witnesses that he has been set free; his master is made to take an oath that he has not freed him; and the slave claim is dropped. Malik said; The sunna about divorce is also like that with us. When a woman brings somebody who witnesses that her husband has divorced her; the husband is made to take an oath that he has not divorced her. If he takes the oath; the divorce does not proceed. Malik said; There is only one sunna of bringing a witness in cases of divorce and freeing a slave. The right to make an oath only belongs to the husband of the woman; and the master of the slave. Freeing is a hadd matter; and the testimony of women is not permitted in it because when a slave is freed; his inviolability is affirmed and the hadd punishments are applied for and against him. If he commits fornication and he is a muhsan; he is stoned. If he kills a slave; he is killed for it. Inheritance is established for him; between him and whoever inherits from him. If somebody disputes this; arguing that if a man frees his slave and then a man comes to demand from the master of the slave payment of a debt; and a man and two women testify to his right; that establishes the right against the master of the slave so that his freeing him is cancelled if he only has the slave as property; inferring by this case that the testimony of women is permitted in cases of setting free. The case is not as he suggests i.e. it is a case of property not freeing. It is like a man who frees his slave; and then the claimant of a debt comes to the master and takes an oath with one witness; demanding his right. By that; the freeing of the slave would be cancelled. Or else a man comes who has frequent dealings and transactions with the master of the slave. He claims that he is owed money by the master of the slave. Someone says to the master of the slave; Take an oath that you dont owe what he claims. If he draws back and refuses to take an oath; the one making the claim takes an oath and his right against the master of the slave is confirmed. That would cancel the freeing of the slave if it is confirmed that property is owed by the master. Malik said; It is the same case with a man who marries a slave-girl and then the master of the slave-girl comes to the man who has married her and claims; You and so-and-so have bought my slave-girl from me for such an amount of dinars. The husband of the slave-girl denies that. The master of the slave-girl brings a man and two women and they testify to what he has said. The sale is confirmed and his claim is considered true. So the slave-girl is haram for her husband and they have to separate; even though the testimony of women is not accepted in divorce. Malik said; It is also the same case with a man who accuses a free man; so the hadd falls on him. A man and two women come and testify that the one accused is a slave. That would remove the hadd from the accused after it had befallen him; even though the testimony of women is not accepted in accusations involving hadd punishments. Malik said; Another similar case in which judgement appears to go against the precedent of the sunna is that two women testify that a child is born alive and so it is necessary for him to inherit if a situation arises where he is entitled to inherit; and the child property goes to those who inherit from him; if he dies; and it is not necessary that the two women witnesses should be accompanied by a man or an oath even though it may involve vast properties of gold; silver; live-stock; gardens and slaves and other properties. However; had two women testified to one dirham or more or less than that in a property case; their testimony would not affect anything and would not be permitted unless there was a witness or an oath with them. Malik said; There are people who say that an oath is not acceptable with only one witness and they argue by the word of Allah the Blessed; the Exalted; and His word is the Truth; And call in to witness two witnesses; men; or if the two be not men; then one man and two women; such witnesses as you approve of. Surat 2 ayat 282. Such people argue that if he does not bring one man and two women; he has no claim and he is not allowed to take an oath with one witness. Malik said; Part of the proof against those who argue this; is to reply to them; Do you think that if a man claimed property from a man; the one claimed from would not swear that the claim was false? If he swears; the claim against him is dropped. If he refuses to take an oath; the claimant is made to take an oath that his claim is true; and his right against his companion is established. There is no dispute about this with any of the people nor in any country. By what does he take this? In what place in the Book of Allah does he find it? So if he confirms this; let him confirm the oath with one witness; even if it is not in the Book of Allah; the Mighty; the Majestic! It is enough that this is the precedent of the sunna. However; man wants to recognise the proper course of action and the location of the proof. MuwataMalik-017-001-34931 | Yahya said that he heard Malik say; The way of doing things generally agreed upon in our community in the case of a man who dies and has sons and one of them claims; My father confirmed that so-and- so was his son; is that the relationship is not established by the testimony of one man; and the confirmation of the one who confirmed it is only permitted as regards his own share in the division of his father property. The one testified for is only given his due from the share of the testifier. Malik said; An example of this is that a man dies leaving two sons; and 600 dinars. Each of them takes 300 dinars. Then one of them testifies that his deceased father confirmed that so-and-so was his son. The one who testifies is obliged to give 100 dinars to the one thus connected. This is half of the inheritance of the one thought to be related; had he been related. If the other confirms him; he takes the other 100 and so he completes his right and his relationship is established. His position is similar to that of a woman who confirms a debt against her father or her husband and the other heirs deny it. She must pay to the person whose debt she confirms; the amount according to her share of the full debt; had it been confirmed against all the heirs. If the woman inherits an eighth; she pays the creditor an eighth of his debt. If a daughter inherits a half; she pays the creditor half of his debt. Whichever women confirm him; pay him according to this. Malik said; If a man testimony is in agreement with what the woman testified to; that so- and-so had a debt against his father; the creditor is made to take an oath with one witness and he is given all his due. This is not the position with women because a man testimony is allowed and the creditor must take an oath with the testimony of his witness; and take all his due. If he does not take an oath; he only takes from the inheritance of the one who confirmed him according to his share of the debt; because he confirmed his right and the other heirs denied it. MuwataMalik-017-001-35148 | Yahya related to me from Malik from Muhammad Ibn Abi Bakr Ibn Muhammad Ibn Amribn Hazm that Abdar-Rahman Ibn Hanthala AlZurqi was informed by a mawla of Quraysh;who used to be known as Ibn Mursi; that he was sitting with Umar Ibn AlKhattab; and when they had prayed dhuhr; he said; Yarfa! Bring that letter! a letter which he had written about the paternal aunt. We asked about her and asked for information about her. Yarfa brought it to him. He called for a small vessel or a drinking-bowl in which there was water. He erased the letter in it. Then he said; Had Allah approved of you as an heir; we would have confirmed you.
