For parents, a sixth share of the inheritance to each, if the deceased left children; if no children, and the parents are the (only) heirs, the mother has a third; if the deceased Left brothers (or sisters) the mother has a sixth. (The distribution in all cases ('s) after the payment of legacies and debts. Ye know not whether your parents or your children are nearest to you in benefit. These are settled portions ordained by Allah; and Allah is All-knowing, Al-wise.

The Prophet ﷺ said; Woe to you ! Who would be just if I were not? Umar Bin AlKhattab said; Allow me to cut off his neck ! The Prophet ﷺ said; Leave him; for he has companions; and if you compare your prayers with their prayers and your fasting with theirs; you will look down upon your prayers and fasting; in comparison to theirs. Yet they will go out of the religion as an arrow darts through the game body in which case; if the Qudhadh of the arrow is examined; nothing will be found on it; and when its Nasl is examined; nothing will be found on it; and then its Nadiyi is examined; nothing will be found on it. The arrow has been too fast to be smeared by dung and blood. The sign by which these people will be recognized will be a man whose one hand or breast will be like the breast of a woman or like a moving piece of flesh. These people will appear when there will be differences among the people Muslims. Abu Saeed added: I testify that I heard this from the Prophet ﷺ and also testify that Ali killed those people while I was with him. The man with the description given by the Prophet ﷺ was brought to Ali. So; Abu Talha distributed it amongst his relatives; amongst whom were Ubai and Hassan. When Hassan sold his share of that garden to Muawiya; he was asked; How do you see Abu Talha Sadaqa? He replied; Who should not I sell a Sa of date for Sa of money ? SahihAlBukhari-017-001-4086Narrated Anas Bin Malik: Abu Talha had the greatest wealth of date-palms amongst the Ansar in Medina; and he prized above all his wealth his garden Bairuha; which was situated opposite the Masjid of the Prophet ﷺ. The Prophet used to enter It and drink from its fresh water. When the following Divine Verse came:- By no means shall you attain piety until you spend of what you love; 3.92 Abu Talha got up saying. O Allah Messenger ﷺ ! Allah says; You will not attain piety until you spend of what you love; and I prize above AlI my wealth; Bairuha which I want to give in charity for Allah Sake; hoping for its reward from Allah. So you can use it as Allah directs you. On that the Prophet ﷺ said; Bravo! It is a profitable or perishable property. Ibn Maslama is not sure as to which word is right; i.e. profitable or perishable. I have heard what you have said; and I recommend that you distribute this amongst your relatives. On that Abu Talha said; O Allah Messenger ﷺ ! I will do as you have suggested. SahihAlBukhari-017-001-4941Narrated Abaya Bin Rafaa Bin Raft Bin Khadij: My grandfather said; We were in the company of the Prophet ﷺ at Dhu AlHulaifa. The people felt hungry and captured some camels and sheep as booty. The Prophet ﷺ was behind the people. They hurried and slaughtered the animals and put their meat in pots and started cooking it. When the Prophet came he ordered the pots to be upset and then he distributed the animals of the booty ; regarding ten sheep as equal to one camel. One of the camels fled and the people ran after it till they were exhausted. At that time there were few horses. A man threw an arrow at the camel; and Allah stopped the camel with it. The Prophet ﷺ said; Some of these animals are like wild animals; so if you lose control over one of these animals; treat it in this way i.e. shoot it with an arrow. Before distributing them among the soldiers my grandfather said; We may meet the enemies in the future and have no knives; can we slaughter the animals with reeds? The Prophet ﷺ said; Use whatever causes blood to flow; and eat the animals if the name of Allah has been mentioned on slaughtering them. SahihAlBukhari-017-001-6653Narrated Marwan and AlMiswar Bin Makhrama: When the delegate of Hawazin came to Allah Messenger ﷺ declaring their conversion to Islam and asked him to return their properties and captives; Allah Messenger ﷺ got up and said to them; There Is involved in this matter; the people whom you see with me; and the most beloved talk to me; is the true one. So choose one of two alternatives: Either the captives or the properties. I have been waiting for you i.e. have not distributed the booty. Allah Messenger ﷺ had delayed the distribution of their booty over ten nights after his return from Taif. So when they came to know that Allah Messenger ﷺ was not going to return to them but one of the two; they said; We prefer to have our captives. So Allah Messenger ﷺ got up amongst the Muslims; and praising Allah as He deserved; said; To proceed! Your brothers have come to you with repentance and I see it logical to return their captives. So; whoever of you likes to do that as a favor then he can do it. And whoever of you likes to stick to his share till we give him from the very first booty which Allah will give us; then he can do so. The people said; We do that i.e. return the captives willingly as a favor; O Allah Messenger ﷺ ! Allah Messenger ﷺ said; We do not know which of you have agreed to it and which have not; so go back and let your chiefs forward us your decision. They went back and their chief spoke to them; and they i.e. the chiefs returned to Allah Messenger ﷺ and informed him that all of them had agreed to give up their captives with pleasure; and had given their permission i.e. that the captives be returned to their people. SahihAlBukhari-017-001-6868Narrated Anas Bin Malik: Out of all the Ansar; living in Medina; Abu Talha had the largest number of date palm trees gardens; and the most beloved of his property to him was Bairuha garden which was standing opposite the Masjid of the Prophet. Allah Messenger ﷺ used to enter it and drink of its good water. When the Verse:-By no means shall you attain righteousness unless you spend in charity of that which you love. 3.92 Abu Talha got up and said; O Allah Messenger ﷺ ; Allah says:-By no means shall you attain righteousness unless you spend in charity of that which you love. 3.92 and the most beloved of my property to me is the Bairuha garden; so I give it as a charitable gift in Allah Cause and hope to receive good out of it; and to have it stored for me with Allah. So; O Allah Messenger ﷺ ! Dispose it of i.e. utilize it in the way Allah orders you to dispose it of. Allah Messenger ﷺ said; Bravo! That is a fruitful property! That is a fruitful property! I have heard what you have said and I think that you should distribute that garden amongst your relatives. SahihMuslim-017-001-20647mousab Bin Saad reported on the authority of his father that many verses of the Quran had been revealed in connection with him. His mother Umm Saad had taken oath that she would never talk with him until he abandoned his faith and she neither ate nor drank and said: Allah has commanded you to treat well your parents and I am your mother and I command you to do this. She passed three days in this state until she fainted because of extreme hunger and at that time her son whose name was Umara stood up and served her drink and she began to curse Saad that Allah; the Exalted and Glorions; revealed these verses of the Holy Quran: And We have enjoined upon a person goodness to his parents but if they contend with thee to associate others with Me of which you have no knowledge; then obey them not xxix. 8 ; Treat thein with customary good in this world xxxi. 15. He also reported that there fell to the lot of Allah Messenger ﷺ huge spoils of war and there was one sword in them. I picked that up and came to Allah Messenger ﷺ and said: Bestow this sword upon me as my share in the spoils of war and you know my state. Thereupon he said: Return it to the place from where you picked it up. I went back until I decided to throw it in a store but my soul repulsed me so I came back and asked him to give that sword to me. He said in a loud voice to return it to the place from where I had picked it up. It was on this occasion that this verse was revealed: They asked about the spoils of war viii. 1. He further said: I once fell ill and sent a message to Allah Apostle ﷺ. He visited me and I said to him: Permit me to distribute in charity my property as much as I like. He did not agree. I said: Permit me to distribute half of it. He did not agree. I said: Permit me to distribute the third part; whereupon he kept quiet and it was after this that the distribution of one property in charity to the extent of one-third was held valid. He further said: I came to a group of persons of the Ansir and Muhajirin and they said: Come; so that we may serve you wine; and it was before the use of wine had been prohibited. I went to them in a garden and there had been with them the roasted head of a camel and a small water-skin containing wine. I ate and drank along with them and there came under discussion the Ansr Helpers and Muhajirin immigrants. I said: The immigrants are better than the Ansar; that a person picked up a portion of the head of the camel and struck me with it that my nose was injured. SahihMuslim-017-001-22067Miswar Bin Makhrama reported that the Messenger of Allah ﷺ distributed some cloaks but did not bestow one upon Makhrama. SunanAlTermithi-017-001-9042Narrated Abdullah Bin Masud: that the Messenger of Allah ﷺ said: No one should convey to me anything regarding any of my Companions; for I love that I should go out to them while my breast is at peace. Abdullah said: The Messenger of Allah ﷺ was brought some wealth; so the Prophet ﷺ distributed it. Then I came across two men that were sitting saying: By Allah! Muhammad ﷺ did not intend the Face of Allah in his distribution; nor the abode of the Hereafter. So I spread this when I heard them; and I went to the Messenger of Allah ﷺ and I informed him. They said: O Messenger of Allah; you distributed it to our brothers; Banu AlMuttalib Bin Abd Manaf; and you did not give us anything; and our relationship to you in the same as theirs. The Messenger of Allah said to them: I see that Hashim and AlMuttalib are the same. SunanAlNasai-017-001-14272It was narrated from Amr Bin Shuaib; from his father; that his grandfather said: We were with the Messenger of Allah when the delegation of Hawazin came to him and said: O Muhammad! We are one of the Arab tribes and a calamity has befallen us of which you are well aware. Do us a favor; may Allah bless you. He said: Choose between your wealth or your women and children. They said: You have given us a choice between our families and our wealth; we choose our women and children. The Messenger of Allah said: As for that which was allocated to myself and to Banu Abd AlMuttalib; it is yours. When I have prayed Zuhr; stand up and say: We seek the help of the Messenger of Allah in dealing with the believers; or the Muslims; with regard to our women and children. So when they prayed Zuhr; they stood up and said that. The Messenger of Allah said: As for that which was allocated to myself and to Banu Abd AlMuttalib; it is yours. The Muhajirun said: That which was allocated to us is for the Messenger of Allah. The Ansar said: That which was allocated to us is for the Messenger of Allah. AlAqra Bin Habis said: As for myself and Banu Tamim; then no we will not give it up. Uyaynah Bin Housn said: As for myself and Banu Fazarah; then no we will not give it up. AlAbbas Bin Mirdas said: As for myself and Banu Sulaim; then no we will not give it up. Banu Sulaim stood up and said: You lied; whatever was allocated to us; it is for the Messenger of Allah. The Messenger of Allah said: O people; give their women and children back to them. Whoever gives back anything of these spoils of war; he will have six camels from the spoils of war that Allah grants us next. Then he mounted his riding-animal and the people surrounded him; saying: Distribute our spoils of war among us. They made him go back toward a tree on which his Rida upper-wrap got caught. He said: O people! Give me back my Rida. By Allah! If there were cattle as many in number as the trees of Tihamah I would distribute them among you; then you would not find me a miser; a coward or a liar. Then he went to a camel and took a hair from its hump between two of his fingers and said: Look! I do not have any of the spoils of war. All I have is the Khums; and the Khums will be given back to you. A man stood up holding a ball of yarn made from goat hair and said: O Messenger of Allah; I took this to fix my camel-saddle. He said: What was allocated to myself and to Banu Abd AlMuttalib is for you. He said: Is this so important? I dont need it! And he threw it down. He said: O people! MuwataMalik-017-001-35426Yahya related to me from Malik that it reached him that a slave of Abdullah Ibn Umar escaped and one of his horses wandered off; and the idol worshippers seized them. Then the Muslims recaptured them; and they were returned to Abdullah Ibn Umar; before the division of the spoils took place. I heard Malik say about muslim property that had been seized by the enemy; If it is noticed before the distribution; then it is returned to itsowner. Whatever has already been distributed is not returned to anyone. Malik; when asked about a man whose young male slave was taken by the idol worshippers and then the Muslims re-captured him; said; The owner is more entitled to him without having to pay his price or value or having to incur any loss before the distribution takes place. If the distribution has already taken place then I think that the slave belongs to his master for his price if the master wants him back. Regarding an umm walad of a Muslim man who has been taken by the idol worshippers and then recaptured by the Muslims and allotted in the distribution of spoils and then recognised by her master after the distribution; Malik said; She is not to be enslaved. I think that the Imam should pay a ransom for her for her master. If he does not do it; then her master must pay a ransom for her and not leave her. I do not think that she should be made a slave by whoever takes her and intercourse with her is not halal. She is in the position of a free woman because her master would be required to pay compensation if she injured somebody and so she is in the same position as a wife. He must not leave the mother of his son to be enslaved nor may intercourse with her be made halal. Malik was asked about a man who went to enemy territory to pay ransom or to trade; and he bought a free man or a slave; or they were given to him. He said; As for the free man; the price he buys him for is a debt against the man and he is not made a slave. If the captive is given to him freely; he is free and owes nothing unless the man gave something in recompense for him. That is a debt against the free man; the same as if a ransom had been paid for him. As for a slave; his former master can choose to take him back and pay his price to the man who bought him or he can choose to leave him; as he wishes. If he was given to the man; the former master is more entitled to him; and he owes nothing for him unless the man gave something for him in recompense. MuwataMalik-017-001-35431Yahya related to me from Malik from Abdulrahman Ibn Said from Amr Ibn Shuayb that when the Messenger of Allah; may Allah bless him and grant him peace; came back from Hunayn heading for AlJiirrana; the people crowded around so much to question him that his camel backed into a tree; which became entangled in his cloak and pulled it off his back. The Messenger of Allah; may Allah bless him and grant him peace; said; Return my cloak to me. Are you afraid that I will not distribute among you what Allah has given you as spoils. By He in whose hand my self is! Had Allah given you spoils equal to the number of acacia trees on the plain of Tihama; I would have distributed it among you. You will not find me to be miserly; cowardly; or a liar. Then the Messenger of Allah; may Allah bless him and grant him peace; got down and stood among the people; and said; Hand over even the needle and thread; for stealing from the spoils is disgrace; fire; ignominy on the Day of Rising for people who do it. Then he took a bit of camel fluff or something from the ground and said; By He in whose hand my self is!
