But if any is unable to do so, he should feed sixty indigent ones, this, that ye may show your faith in Allah and His Messenger. Those are limits (set by) Allah. For those who reject (Him), there is a grievous Penalty.
And complete the Hajj or 'umra in the service of Allah. But if ye are prevented (From completing it), send an offering for sacrifice, such as ye may find, and do not shave your heads until the offering reaches the place of sacrifice. And if any of you is ill, or has an ailment in his scalp, (Necessitating shaving), (He should) in compensation either fast, or feed the poor, or offer sacrifice; and when ye are in peaceful conditions (again), if any one wishes to continue the 'umra on to the hajj, He must make an offering, such as he can afford, but if he cannot afford it, He should fast three days during the hajj and seven days on his return, Making ten days in all. This is for those whose household is not in (the precincts of) the Sacred Mosque. And fear Allah, and know that Allah Is strict in punishment.
O ye who believe! Kill not game while in the sacred precincts or in pilgrim garb. If any of you doth so intentionally, the compensation is an offering, brought to the Ka'ba, of a domestic animal equivalent to the one he killed, as adjudged by two just men among you; or by way of atonement, the feeding of the indigent; or its equivalent in fasts: that he may taste of the penalty of his deed. Allah forgives what is past: for repetition Allah will exact from him the penalty. For Allah is Exalted, and Lord of Retribution.

Permitted to you, on the night of the fasts, is the approach to your wives. They are your garments and ye are their garments. Allah knoweth what ye used to do secretly among yourselves; but He turned to you and forgave you; so now associate with them, and seek what Allah Hath ordained for you, and eat and drink, until the white thread of dawn appear to you distinct from its black thread; then complete your fast Till the night appears; but do not associate with your wives while ye are in retreat in the mosques. Those are Limits (set by) Allah: Approach not nigh thereto. Thus doth Allah make clear His Signs to men: that they may learn self-restraint.
Say: "O People of the Book! ye have no ground to stand upon unless ye stand fast by the Law, the Gospel, and all the revelation that has come to you from your Lord." It is the revelation that cometh to thee from thy Lord, that increaseth in most of them their obstinate rebellion and blasphemy. But sorrow thou not over (these) people without Faith.
Never should a believer kill a believer; but (If it so happens) by mistake, (Compensation is due): If one (so) kills a believer, it is ordained that he should free a believing slave, and pay compensation to the deceased's family, unless they remit it freely. If the deceased belonged to a people at war with you, and he was a believer, the freeing of a believing slave (Is enough). If he belonged to a people with whom ye have treaty of Mutual alliance, compensation should be paid to his family, and a believing slave be freed. For those who find this beyond their means, (is prescribed) a fast for two months running: by way of repentance to Allah: for Allah hath all knowledge and all wisdom.
Allah will not call you to account for what is futile in your oaths, but He will call you to account for your deliberate oaths: for expiation, feed ten indigent persons, on a scale of the average for the food of your families; or clothe them; or give a slave his freedom. If that is beyond your means, fast for three days. That is the expiation for the oaths ye have sworn. But keep to your oaths. Thus doth Allah make clear to you His signs, that ye may be grateful.
If only they had stood fast by the Law, the Gospel, and all the revelation that was sent to them from their Lord, they would have enjoyed happiness from every side. So every one of you who is present (at his home) during that month should spend it in fasting, but if any one is ill, or on a journey, the prescribed period (Should be made up) by days later. For those who can do it (With hardship), is a ransom, the feeding of one that is indigent. But he that will give more, of his own free will, - it is better for him. And it is better for you that ye fast, if ye only knew.
What! have We given them a Book before this, to which they are holding fast?

The sign by which these people will be recognized will be a man whose one hand or breast will be like the breast of a woman or like a moving piece of flesh. These people will appear when there will be differences among the people Muslims. Abu Saeed added: I testify that I heard this from the Prophet ﷺ and also testify that Ali killed those people while I was with him. The man with the description given by the Prophet ﷺ was brought to Ali. When the question was asked for the third time; he said: One who goes out for Jihad is like a person who keeps fasts; stands in prayer constantly ; obeying Allah behests contained in the verses of the Quran ; and does not exhibit any lassitude in fasting and prayer until the Mujahid returns from Jihad in the way of Allah; the Exalted. The Chapter on Communication And Asking Questions Related To What Is Forbidden in HodHood Indexing, Chapter on 29 in Sahih Muslim

He said: What will you mortgage? He said: What do you want? He said: Pledge me your women. He said: You are the most handsome of the Arabs; should we pledge our women to you? So when he came down and he was holding his cloak under his arm; they said to him: We sense from you a very fine smell. He said: Yes; I have with me a mistress who is the most scented of the women of Arabia. He said: Allow me to smell the scent on your head. He said: Yes; you may smell. So he caught it and smelt. He the Holy Prophet remarked: He told the truth. He the bedouin said: Who created the heaven? He the Holy Prophet replied: Allah. He the bedouin again said: Who created the earth? He the Holy Prophet replied: Allah. He the bedouin again said: Who raised these mountains and who created in them whatever is created there? He the Holy Prophet replied: Allah. He said: Messenger of Allah; do justice. Upon this the Messenger of Allah ﷺ said: Woe be upon thee! Who would do justice; if I do not do justice? You would be unsuccessful and incurring a loss; if I do not do justice. Upon this Umar Bin AlKhattab Allah be pleased with him said: Messenger of Allah; permit me to strike off his neck. The Messenger of Allah ﷺ said: Leave him; for he has friends who would outwardly look to be so religious and pious that everyone among you would consider his prayer insignificant as compared with their prayer; and his fast as compared with their fasts. They would recite the Quran but it would not go beyond their collar-bones. They would pass through the teachings of Islam so hurriedly just as the arrow passes through the prey. He would look at its Iron head; but would not find anything ticking there. He would then see at the lowest end; but would not find anything sticking there. He would then see at its grip but would not find anything sticking to it. He would then see at its feathers and he would find nothing sticking to them as the arrow would pass so quickly that nothing would stick to it neither excrement nor blood. They would be recognised by the presence of a black man among them whose upper arms would be like a woman breast; or like a piece of meat as it quivers; and they would come forth at the time when there is dissension among the people. Abu Said said: I testify to the fact that I heard it from the Messenger of Allah ﷺ ; and I testify to the fact that Ali Bin Abu Talib fought against them and I was with him. They would recite the Quran thinking that it supports them; whereas it is an evidence against them. Their prayer does not get beyond their collar bone; they would swerve through Islam just as the arrow passes through the prey. If the squadron which is to encounter them were to know what great boon has been assured to them by their Messenger ﷺ they would completely rely upon this deed alone and cease to do other good deeds ; and their that of the Khawarij distinctive mark is that there would be among them a person whose wrist would be without the arm; and the end of his wrist would be fleshy like the nipple of the breast on which there would be white hair. You would be marching towards Muawiya and the people of Syria and you would leave them behind among your children and your property to do harm. By Allah; I believe that these are the people against whom you have been commanded to fight and get reward for they have shed forbidden blood; and raided the animals of the people. So go forth in the name of Allah to fight against them. Salama Bin Kuhail mentioned that Zaid Bin Wahb made me alight at every stage; till we crossed a bridge. Abdullah Bin Wahb AlRasibi was at the head of the Khawarij when we encountered them. He Abdullah said to his army: Throw the spears and draw out your swords from their sheaths; for I fear that they would attack you as they attacked you on the day of Harura. They went back and threw their spears and drew out their swords; and people fought against them with spears and they were killed one after another. Only two persons were killed among the people among the army led by Ali on that day. Ali Allah be pleased with him said: Find out from among them the dead bodies of the Khawarij the maimed. They searched but did not find him. Ali Allah be pleased with him then himself stood up and walked till he came to the people who had been killed one after another. He Ali said: Search them to the last; and then Ali companions found him the dead body of the maimed near the earth. He Ali then pronounced Allahu Akbar Allah is the Greatest and then said; Allah told the Truth and His Messenger ﷺ conveyed it. Then there stood before him Abida Salmani who said: Commander of the Believers; by Allah; besides Whom there is no god but He; tell me whether you heard this hadith from the Messenger of Allah ﷺ. SunanAlTermithi-017-001-10176Salamah Bin Sakhr AlAnsari said: I was a man who had an issue with intercourse with a women that none other than me had. When the month of Ramadan entered; I pronounced Zihar upon my wife to last until the end of Ramadan; fearing that I might have an encounter with her during the night; and I would continue doing that until daylight came upon me; and I would not be able to stop. One night while she was serving me; something of her became exposed for me; so I rushed myself upon her. When the morning came I went to my people to inform them about what happened to me. I said: Accompany me to the Messenger of Allah to inform him about my case. They said: No by Allah! We shall not do that; we feat that something will be revealed about us in the Quran; or the Messenger of Allah might say something about us; the disgrace of which will remain upon us. But you do and do whatever you want. He said: So I left and I went to the Messenger of Allah; and informed him of my case. He said: You are the one who did that? I said: I am the one. He said: You are the one who did that? I said: I am the one. He said: You are the one who did that? I said: I am the one; it is before you; so give me Allahs judgment; for I shall be patient with that. He said: Free a slave. He said: I struck the sides of my neck with me hands; and said: No by the One Who sent you with the Truth! I possess nothing besides it. He said: Then fast for two months I said: O Messenger of Allah! Did this occur to me other than when I was fasting? He said: Then feed sixty poor people. I said: By the One Who sent you with the Truth! We have spent these nights of ours hungry without an evening meal. He said: Go to the one with the charity from Banu Ruzaiq; tell him to give it to you; then feed a Wasq of it; on your behalf; to sixty poor people. Then help yourself and your dependants with the remainder of it. He said: I returned to my people and said: I found dejection and bad ideas with you; and I found liberalness and blessing with the Messenger of Allah. Then he said the third time: The example of the Mujahid in the path of Allah is like the one who fasts and stands in prayer and does not slacken from Prayer; nor fasting; until the Mujahid in the cause of Allah returns. There are narrations on this topic from AlShifa; Abdullah Bin Hubshi; Abu Mousa; Abu Saeed; Umm Malik AlBahziyah; and Anas. This Hadith is aHassan Sahih. SunanAlTermithi-017-001-11023Ibn Abbas narrated that : the Prophet said: Jibril ﷺ led me in Prayer twice at the House. So he prayed Zuhr the first time when the shadow was similar to the length of the strap a sandal. Then he prayed Asr when everything was similar to the length of its shadow. Then he prayed Maghrib when the sun had set and the fasting person breaks fast. Then he prayed Isha when the twilight had vanished. Then he prayed Fajr when Fajr dawn began; and when eating is prohibited for the fasting person. The second time he prayed Zuhr when the shadow of everything was similar to the length of it; at the time of Asr the day before. Then he prayed Asr when the shadow of everything was about twice as long as it. Then he prayed Maghrib at the same time as he did the first time. Then he prayed Isha; the later one; when a third of the night had gone. Then he prayed Subh when the land glowed. Then Jibril turned towards me and said: O Muhammad! He said: When you perform Prayer; then say: Subhan Allah thirty-three times; and: AlHamdulillah thirty-three times; and: Allahu Akbar thirty-four times; and La ilaha illallah ten times. I found him in the house of my sister Zainab bint Jahsh. I said; O Messenger of Allah! I suffer from a case of severe and excessive blood flow. So what do you order me to do for it; and does this prevent me from fasting and performing Prayer? He said: Tie a cotton rag around yourself and the bIood will go away. I said; It is more than that. He said: Make it tight. I said; It is more than that. He said: Then use a cloth to bind it. I said; it is more than that. It flows too much. So the Prophet said: I will order you to do one of two things; which ever of them you do; it will be acceptable for you. You should know which of them you are able to do. Then he said: This is only a blow from Shaitan. Menstruate for six or seven days; which Allah knows; then perform Ghusl. When you see that you have become pure and clean; then perform Prayer for twenty-three or twenty-four nights and their days. Perform Prayer and fast; and that will be acceptable for you. So do this if you can just as other women who menstruate and become pure during their periods of menstruation and purity. If not; and you are able to delay Zuhr and hasten Asr then perform Ghusl when you have become pure; and pray Zuhr and Asr together. Then delay Maghrib and hasten Isha; then perform Ghusl and combine the two prayers. So do this if you are able. Then perform Ghusl with the dawn and pray. Do this; and fast if you are able to do so. When the month of Ramadan came; I feared lest I should have intercourse with my wife; and this evil should remain with me till the morning. So I made my wife like my mother back to me till the end of Ramadan. But one night when she was waiting upon me; something of her was revealed. Suddenly I jumped upon her. When the morning came I went to my people and informed them about this matter. I said: Go along with me to the Messenger of Allah ﷺ. They said: No; by Allah. So I went to the Prophet ﷺ and informed him of the matter. He said: Have you really committed it; Salamah? I said: I committed it twice; Messenger of Allah. I am content with the Commandment of Allah; the Exalted; so take a decision about me according to what Allah has shown you. He said: Free a slave. I said: By Him Who sent you with truth; I do not possess a neck other than this: and I struck the surface of my neck. He said: Then fast two consecutive months. I said: Whatever I suffered is due to fasting. He said: Feed sixty poor people with a wasq of dates. I said: By Him Who sent you with truth; we passed the night hungry; there was no food in our house. He said: Then go to the collector of sadaqah of Banu Zurayq; he must give it to you. Then feed sixty poor people with a wasq of dates; and you and your family eat the remaining dates. The people; as it were; could not understand. Which of the people of Medina are present here? Stand for your brethren; and teach them; for they do not know. The Messenger of Allah ﷺ prescribed this sadaqah as one sa of dried dates or barley; or half a sa of wheat payable by every freeman or slave; male or female; young or old. When Ali came to Basrah ; he found that price had come down. He said: Allah has given prosperity to you; so give one sa of everything as sadaqah. I heard the Messenger of Allah ﷺ say: there will appear from among my community people who recite the Quran; and your recitation has no comparison with their recitation; and your prayer has no comparison with their prayer; and your fasts have no comparison with their fasts. They will recite the Quran thinking that it is beneficial for them; while it is harmful for them. Their prayer will not pass their collar-bones. They will swerve from Islam as an arrow goes through the animal shot at. If the army that is approaching them knows what reward has been decided for them at the tongue of their Prophet ﷺ ; they would leave other good activities. The sign of that is that among them there will be a man who has an upper arm; but not hand; on his upper arm there will be something like the nipple of a female breast; having white hair thereon. Will you go to Muawiyah and the people of Syria; and leave them behind among your children and property? I swear by Allah; I hope these are the same people; for they shed the blood unlawfully; and attacked the cattle of the people so go on in the name of Allah. Salamah Bin Kuhail said: Zaid Bin Wahb then informed me of all the halting places one by one; saying : Until we passed a bridge. When we fought with each other; Abdullah Bin Wahb AlRasibi; who was the leader of the Khawarij; said to them: Throw away the lances and pull out the swords from their sheaths; for I am afraid they will adjure you as they had adjured on the day of Harura. So they threw away their lances and pulled out their swords; and the people pierced them with their lances. They were killed lying one on the other. On that day only two persons of the partisans of Ali were afflicted. Ali said: Search for the man with the crippled hand. But they could not find him. Then Ali got up himself and went to the people who had been killed and were lying on one another. He said: Take them out. They found him just near the ground. So he shouted: Allah is Most Great! He said: Allah spoke the truth; and His Apostle has conveyed. Ubaidat AlSalmani stood up to him; saying: Commander of the Faithful! Have you heard it from the Messenger of Allah ﷺ ? It has prevented me from praying and fasting. He said: I suggest that you should use cotton; for it absorbs the blood. She replied: It is too copious for that. He said: Then take a cloth. She replied: It is too copious for that; for my blood keeps flowing. The Messenger of Allah ﷺ said: I shall give you two commands; whichever of them you follow; that will be sufficient for you without the other; but you know best whether you are strong enough to follow both of them. He added: This is a stroke of the Devil; so observe your menses for six or seven days; Allah alone knows which it should be; then wash. And when you see that you are purified and quite clean; pray during twenty-three or twenty-four days and nights and fast; for that will be enough for you; and do so every month; just as women menstruate and are purified at the time of their menstruation and their purification. But if you are strong enough to delay the noon Zuhr prayer and advance the afternoon Asr prayer; to wash; and then combine the noon and the afternoon prayer; to delay the sunset prayer and advance the night prayer; to wash; and then combine the two prayers; do so: and to wash at dawn; do so: and fast if you are able to do so if possible. The Messenger of Allah ﷺ said: Of the two commands this is more to my liking.1Abu Dawud said: Amr Bin Thabit narrated from Ibn Aqil: Hamnah said: Of the two commands this is the one which is more to my liking.2 In this version these words were not quoted as the statement of the Prophet ﷺ ; it gives it as a statement of Hamnah.Abu Dawud said: Amr Bin Thabit was a Rafidi. This has been said by Yahya Bin Main.Abu Dawud said: I heard Ahmad Bin Hanbal say: I am doubtful about the tradition transmitted by Ibn Aqil. The Chapter on Menstruation And Fasting in HodHood Indexing, Chapter on When The Menstruation Starts She Should Leave The Prayer in Sunan Abu Dawoud
SunanAbuDawoud-017-001-27370Narrated Abdullah Ibn Abbas: The Messenger of Allah ﷺ said: Gabriel ﷺ led me in prayer at the House i.e. the Kabah. He prayed the noon prayer with me when the sun had passed the meridian to the extent of the thong of a sandal; he prayed the afternoon prayer with me when the shadow of everything was as long as itself; he prayed the sunset prayer with me when one who is fasting breaks the fast; he prayed the night prayer with me when the twilight had ended; and he prayed the dawn prayer with me when food and drink become forbidden to one who is keeping the fast. On the following day he prayed the noon prayer with me when his shadow was as long as himself; he prayed the afternoon prayer with me when his shadow was twice as long as himself; he prayed the sunset prayer at the time when one who is fasting breaks the fast; he prayed the night prayer with me when about the third of the night had passed; and he prayed the dawn prayer with me when there was a fair amount of light. Then turning to me he said: Muhammad; this is the time observed by the prophets before you; and the time is anywhere between two times. The Chapter on Prayers And Ablution in HodHood Indexing, Chapter on The Times Of AlSalat in Sunan Abu Dawoud
SunanAbuDawoud-017-001-27483Ibn Abi Laila said: Prayer passed through three stages. And out people narrated to us that Messenger of Allah ﷺ said; it is to my liking that the prayer of Muslims or believers should be united i.e.; in congregation ; so much so that I intended to send people to the houses to announce the time of prayer; and I also resolved that I should order people to stand at the tops of the forts and announce the time of the prayer for Muslims; and they struck the bell or were about to strike the bell to announce the time for prayer. Then came a person from among the Ansar who said: Messenger of Allah; when I returned from you; as I saw your anxiety. I saw in sleep a person with two green clothes on him; he stood on the Masjid and called people to prayer. He then sat down for a short while and stood up and pronounced in a like manner; except that he added: The time for prayer has come. If the people did not call me a liar ; and according to the version of Ibn AlMuthanna; if you did not call me a liar. I would say that I was awake; I was awake; I was not asleep. The Messenger of Allah ﷺ said: According to the version of Ibn AlMuthanna; Allah has shown you a good dream. But the version of Amr does not have the words: Allah has shown you a good dream. Then ask Bilal to pronounce the ADHAN to call to the prayer. Umar in the meantime said: I also had a dream like the one he had. But as he informed earlier. I was ashamed to inform. Our people have narrated to us: when a person came to the Masjid during the prayer in congregation ; he would ask about the RAKAHS of prayer ; and he would be informed about the number of RAKAHS already performed. They would stand in prayer along with the Messenger of Allah ﷺ : some in standing position; others bowing; some sitting and some praying along with the Messenger of Allah ﷺ Ibn AlMuthanna reported from Amr from Hussain Bin Abi Laila; saying ; Until Muadh came. Shubah said ; I heard it from Hussain who said : I shall follow the position in the prayer in which I find him the prophet... you should do in a similar way.Abu Dawud said: I then turned to the tradition reported by Amr Bin Marzuq he said; then Maadh came and they the people hinted at him. Shubah said; I heard it from hussain who said: Muadh then said; I shall follow the position in the prayer when I join it in which I find him the prophet. He then said: Muadh has prayer when I join it in which I find him the prophet. He then said: MUadh has introduced for you a SUNNAH a model behaviour ; so you should do in a like manner. He said; our people have narrated to us; when the Messenger of Allah ﷺ came to Madina; he commanded them the people to keep fast for three days. Thereafter the Quranic verses with regard to the fasts during Ramadan were revealed. But they were people who were not accustomed to keep fast ; hence the keeping of the fasts was hard for them; so those who could not keep fast would feed an indigent; then the month. The concession was granted to the patient and the traveler; all were commanded to keep fast. The Chapter on Prayers And Bowing in HodHood Indexing, Chapter on How The Adhan Is Performed in Sunan Abu Dawoud
SunanAbuDawoud-017-001-27484Narrated Muadh Ibn Jabal: Prayer passed through three stages and fasting also passed through three stages. The narrator Nasr reported the rest of the tradition completely. The narrator; Ibn AlMuthanna; narrated the story of saying prayer facing in the direction of Jerusalem. He said: The third stage is that the Messenger of Allah ﷺ came to Medina and prayed; i.e. facing Jerusalem; for thirteen months. Then Allah; the Exalted; revealed the verse: We have seen thee turning thy face to Heaven for guidance; O Muhammad. And now verily We shall make thee turn in prayer toward a qiblah which is dear to thee. So turn thy face toward the Inviolable Place of Worship; and ye O Muslims ; wherever ye may be; turn your face when ye pray toward it ii.144. And Allah; the Reverend and the Majestic; turned them towards the Kabah. He the narrator completed his tradition. The narrator; Nasr; mentioned the name of the person who had the dream; saying: And Abdullah Ibn Zayd; a man from the Ansar; came. The same version reads: And he turned his face towards the qiblah and said: Allah is most great; Allah is most great; I testify that there is no god but Allah; I testify that there is no god but Allah; I testify that Muhammad is the Messenger of Allah; I testify that Muhammad is the Messenger of Allah; come to prayer he pronounced it twice ; come to salvation he pronounced it twice ; Allah is Most Great; Allah is most great. He then paused for a while; and then got up and pronounced in a similar way; except that after the phrase Come to salvation he added. The time for prayer has come; the time for prayer has come. The Messenger of Allah ﷺ said: Teach it to Bilal; then pronounce the adhan call to prayer with the same words. As regards fasting; he said: The Messenger of Allah ﷺ used to fast for three days every month; and would fast on the tenth of Muharram. Then Allah; the Exalted; revealed the verse:.......Fasting was prescribed for those before you; that ye may ward off evil......and for those who can afford it there is a ransom: the feeding of a man in need ii.183-84. If someone wished to keep the fast; he would keep the fast; if someone wished to abandon the fast; he would feed an indigent every day; it would do for him. But this was changed. Allah; the Exalted; revealed: The month of Ramadan in which was revealed the Quran.......... let him fast the same number of other days ii.185. Hence the fast was prescribed for the one who was present in the month of Ramadan and the traveller was required to atone for them ; feeding the indigent was prescribed for the old man and woman who were unable to fast. The narrator; Nasr; further reported : The companion Sirmah; came after finishing his day work......and he narrated the rest of the tradition. The Chapter on Adhan And Iqama And Fasting in HodHood Indexing, Chapter on How The Adhan Is Performed in Sunan Abu Dawoud

A man betrayed himself and had intercourse with his wife after he had offered the night prayer; and he did not break his fast. MuwataMalik-017-001-34247Yahya related to me from Malik from Yahya Ibn Said from Muhammad Ibn Ibrahim Ibn AlHarith AlTaymi from Abu Salama Ibn Abd ar Rahman that Abu Said said that he had heard the Messenger of Allah; may Allah bless him and grant him peace; say; A group of people will appear among you whose prayer; fasting and deeds will make you think little of your own prayer; fasting and deeds. They will recite the Quran; but it wil not get past their throats; and they will pass through the deen like an arrow passes through game. MuwataMalik-017-001-34367Yahya related to me from Malik from Ibn Shihab that Abu Ubayd; the mawla of Ibn Azhar said; I was present at an id with Umar Ibn AlKhattab. He prayed; and then after he had prayed he gave a khutba to the people and said; The Messenger of Allah; may Allah bless him and grant him peace; forbade fasting on these two days - the day you break your fast after Ramadan ; and the day you eat from your sacrifice after Hajj. Abu Ubaydcontinued; Then I was present at an id with Uthman Ibn Affan. He came and prayed; and when he had finished he gave a khutba and said; Two ids have been joined together for you on this day of yours. If any of the people of AlAliya the hills outlying Madina want to wait for the jumua they can do so; and if any of them want to return; I have given them permission. Abu Ubayd continued; Then I was present at an id with AIi Ibn Abi Talib at the time when Uthman was being detained. MuwataMalik-017-001-34381Yahya related to me from Malik that he heard that a beggar asked Aisha; the wife of the Prophet; may Allah bless him and grant him peace; for something while she was fasting and there was only a loaf of bread in her house. She said to her female mawla; Give it to him. The mawla protested; You will not have anything to break your fast with. Aisha repeated; Give it to him; so she did so. MuwataMalik-017-001-35211ahya related to me from Malik that he asked Ibn Shihab about the dhihar of a slave. He said; It is like the dhihar of a free man. Malik said; He meant that the same conditions were applied in both cases. Malik said; The dhihar of the slave is incumbent on him; and the fasting of the slave in the dhihar is two months. Malik said that there was no ila for a slave who pronounced a dhihar from his wife. That was because if he were to fast the kaffara for pronouncing a dhihar; the divorce of the ila would come to him before he had finished the fast. The Chapter on Wives And Relationship Pronouncing Dhiar in HodHood Indexing, The Book of Marriage in Muwata Malik

The Messenger asked; What wrong with him? The people said; He has vowed not to speak or to seek shade from the sun or to sit and to fast. The Messenger of Allah; may Allah bless him and grant him peace; said; Go and tell him to speak; seek shade; and sit; but let him complete his fast. Malik said; I have not heard that the Messenger of Allah; may Allah bless him and grant him peace; ordered the man in question to do any kaffara. The Messenger of Allah; may Allah bless him and grant him peace; only ordered him to complete that in which there was obedience to Allah and to abandon that in which there was disobedience to Allah. The Chapter on Peace And Evil in HodHood Indexing, The Book of Jihad in Muwata Malik

MuwataMalik-017-001-35465Yahya related to me from Malik that he had heard that AlQasim Ibn Muhammad and Nafi; the mawla of Abdullah Ibn Umar said; You cannot do itikaf unless you are fasting; because of what Allah; the Blessed and Exalted; says in His Book; And eat and drink until the white thread becomes clear to you from the black thread of dawn; then complete the fast until night-time; and do not have intercourse with them while you are doing itikaf in Masjids; Surat 2 ayat 187. Allah only mentions itikaf together with fasting. Malik said; That is what we go by here. The Chapter on Ramadan And Fasting Beginning Of The Month Of Ramdan in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35469Malik was asked whether someone who went into a Masjid to do itikaf for the last ten days of Ramadan and stayed there for a day or two but then became ill and left the Masjid; had to do itikaf for the number of days that were left from the ten; or not; and if he did have to do so; then what month should he do it in; and he replied; He should make up whatever he has to do of the itikaf when he recovers; whether in Ramadan or otherwise. I have heard that the Messenger of Allah; may Allah bless him and grant him peace; once wanted to do itikaf in Ramadan; but then came back without having done so; and then when Ramadan had gone; he did itikaf for ten days in Shawal. Some one who does itikaf voluntarily in Ramadan and some one who has to do itikaf are in the same position regarding what is halal for them and what is haram. I have not heard that the Messenger of Allah; may Allah bless him and grant him peace; ever did itikaf other than voluntarily. Malik said; that if a woman did itikaf and then menstruated during her itikaf; she went back to her house; and; when she was pure again she returned to the Masjid; at whatever time it was that she became pure. She then continued her itikaf from where she left off. This was the same situation as with a woman who had to fast two consecutive months; and who menstruated and then became pure. She then continued the fast from where she had left off and did not delay doing so.The Chapter on Ramadan And Fasting And Deeds in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35471Malik said; There is no harm in someone who is in itikaf entering into a marriage contract as long as there is no physical relationship. A woman in itikaf may also be betrothed as long as there is no physical relationship. What is haram for someone in itikaf in relation to his womenfolk during the day is haram for him during the night. Yahya said that Ziyad said that Malik said; It is not halal for a man to have intercourse with his wife while he is in itikaf; nor for him to take pleasure in her by kissing her; or whatever. However; I have not heard anyone disapproving of a man; or woman; in itikaf getting married as long as there is no physical relationship. Marriage is not disapproved of for someone fasting. There is; however; a distinction between the marriage of someone in itikaf and that of someone who is muhrim; in that some one who is muhrim can eat; drink; visit the sick and attend funerals; but cannot put on perfume; whilst a man or woman in itikaf can put on oil and perfume and groom their hair; but cannot attend funerals or pray over the dead or visit the sick. Thus their situations with regard to marriage are different. This is the sunna as it has come down to us regarding marriage for those who are muhrim; doing itikaf; or fasting. The Chapter on Ramadan And Fasting And Kabah in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35480Yahya related to me from Malik from Nafi from Abdullah Ibn Umar that the Messenger of Allah; may Allah bless him and grant him peace; once mentioned Ramadan and said; Do not begin the fast until you see the new moon; and do not break the fast at the end of Ramadan until you see it. MuwataMalik-017-001-35483Yahya related to me from Malik that he had heard that once in the time of Uthman Ibn Affan the new moon had been seen in the afternoon and Uthman did not break his fast until evening had come and the sun had set. Yahya said that he had heard Malik say that some one who sees the new moon of Ramadan when he is on his own should start the fast and not break it if he knows that that day is part of Ramadan. He added; Some one who sees the new moon of Shawal when he is on his own does not break the fast; because people suspect the reliability of someone among them who breaks the fast. Such people should say; when they sight the new moon; We have seen the new moon. Whoever sees the new moon of Shawal during the day should not break his fast but should continue fasting for the rest of that day. This is because it is really the new moon of the night that is coming. Yahya said that he heard Malik say; If people are fasting on the day of Fitr thinking that it is still Ramadan and then definite evidence comes to them that the new moon of Ramadan had been seen one day before they began to fast and that they are now into the thirty- first day; then they should break the fast on that day at whatever time the news comes to them. MuwataMalik-017-001-35491Yahya related to me from Malik from Sumay; the mawla of Abu Bakr Ibn Abdulrahman Ibn AlHarith Ibn Hisham that he heard Abu Bakr Ibn Abdulrahman Ibn AlHarith Ibn Hisham say; My father and I were with Marwan Ibn AlHakam at the time when he was amir of Madina; and someone mentioned to him that Abu Huraira used to say; If someone begins the morning junub; he has broken the fast for that day. Marwan said; I swear to you; Abdar-Rahman; you must go to the two umm Almuminin; Aisha and Umm Salamah; and ask them about it. Abdulrahman went to visit Aisha and I accompanied him. He greeted her and then said; Umm Almuminin; we were with Marwan Ibn AlHakam and someone mentioned to him that Abu Huraira used to say that if some one had begun the morning junub; he had broken the fast for that day. Aisha said; It is not as Abu Huraira says Abdulrahman Do you dislike what the Messenger of Allah; may Allah bless him and grant him peace; used to do?; and Abdulrahman said; No; by Allah. Aisha said; I bear witness that the Messenger of Allah; may Allah bless him and grant him peace; used to get up in the morning junub from intercourse; not a dream; and would then fast for that day. He continued; Then we went and visited Umm Salamah; and Abdulrahman asked her about the same matter and she said the same as Aisha had said. Then we went off until we came to Marwan Ibn AlHakam Abdulrahman told him what they had both said and Marwan said; I swear to you; Abu Muhammad; you must use the mount which is at the door; and go to Abu Huraira; who is on his land at AlAqiq; and tell him this. MuwataMalik-017-001-35493Yahya related to me from Malik from Zayd Ibn Aslam from Ata Ibn Yasar that a certain man kissed his wife while he was fasting in Ramadan. She went in and saw Umm Salamah; the wife of the Prophet; may Allah bless him and grant him peace; and mentioned the matter to her; and Umm Salamah told her that the Messenger of Allah; may Allah bless him and grant him peace; used to kiss while he was fasting. So she went back and told her husband that; but it only made him find fault all the more and he said; We are not like the Messenger of Allah; may Allah bless him and grant him peace. Allah makes permissible for the Messenger of Allah; may Allah bless him and grant him peace; whatever He wishes. His wife then went back to Umm Salamah and found the Messenger of Allah; may Allah bless him and grant him peace; with her. The Messenger of Allah; may Allah bless him and grant him peace; said; What the matter with this woman?; and Umm Salamah told him. The Messenger of Allah; may Allah bless him and grant him peace; said; Didnt you tell her that I do that myself? and she said; I told her; and she went to her husband and told him; but it only made him find fault all the more and say; We are not like the Messenger of Allah; may Allah bless him and grant him peace. Allah makes permissible for His Messenger; may Allah bless him and grant him peace; whatever He wishes.
