Was not the covenant of the Book taken from them, that they would not ascribe to Allah anything but the truth? and they study what is in the Book. They Hafsi; and Aisha both went along with him and Allah Messenger ﷺ used to travel on camel when it was night along with Aisha and talked with her. Hafsa said to Aisha: Would you like to ride upon my camel tonight and allow me to ride upon your camel and you would see what you do not generally see and I would see what I do not see generally? She said: Yes. So Aisha rode upon the camel of Hafsa and Hafsa rode upon the camel of Aisha and Allah Messenger ﷺ came near the camel of Aisha. whereas Hafsa had been riding over that. He greeted her and then rode with her until they came down. She Aisha thus missed the company of the Holy Prophet and when they sat down; Aisha felt jealous. She put her foot in the grass and said: O Allah; let the scorpion sting me or the serpent bite me. SahihMuslim-017-001-21757 | Abdullah Bin Abu Mulaika reported: I was sitting by the side of Ibn Umar; and we were waiting for the bier of Umm Aban; daughter of Uthman; and there was also Amr Bin Uthman. In the meanwhile there came Ibn Abbas led by a guide. I conceive that he was informed of the place of Ibn Umar. So he came till he sat by my side. While I was between them Ibn Abbas and Ibn Umar there came the noise of wailing from the house. Upon this Ibn Umar said that is; he pointed out to Amr that he should stand and forbid them; for : I heard the Messenger of Allah ﷺ as saying: The dead is punished because of the lamentation of his family. Abdullah made it general what was said for a particular occasion. Ibn Abbas said: When we were with the Commander of the believers; Umar Bin AlKhattab; we reached Baida; and there was a man under the shadow of the tree. He said to me: Go and inform me who is that person. So I went and found that he was Suhaib. I returned to him and said: You commanded me to find out for you who that was; and he is Suhaib. He Hadrat Umar said: Command him to see us. I said: He has family along with him. He said: That is of no account even if he has family along with him. So he the narrator told him to see the Commander of the believers and his party. When we came to Medina ; it was before long that the Commander of the believers was wounded; and Suhaib came weeping and crying: Alas for the brother; alas for the companion. Upon this Umar said: Didnt you know; or didnt you hear; that the Messenger of Allah ﷺ said: The dead is punished because of the lamentation of his family? Then Abdullah made it general and Umar told it of certain occasions. So I Abdullah Bin Abu Mulaika stood up and went to Aisha and told her what Ibn Umar had said. Upon this she said: I swear by Allah that Allah Messenger ﷺ never said that dead would be punished because of his family lamenting for him. What he said was that Allah would increase the punishment of the unbeliever because of his family lamenting for him. Verily it is Allah Who has caused laughter and weeping. No bearer of a burden will bear another burden. So she entered the house with me. I had an urge for her so I began kissing her. I went to Abu Bakr and mentioned that to him; so he said: Cover what you have done; repent; do not inform any one; and never do it again. So I went to Umar and mentioned that to him. He said: Cover what you have done; repent; do not inform any one; and never do it again. Then I went to the Prophet ﷺ and mentioned it to him. He said: Is this how you take care of the wife of someone who is away fighting in Allah cause? Such that he had wished he had not accepted Islam until that very time; and he thought that he must be one of the people of the Fire. They told her to say: Your wives -and he the narrator said something to the effect that they are urging you to be equitable with regard to the matter of the daughter of Abu Quhafah. She said: So she entered upon the Prophet when he was with Aisha under her cover. She said to him: Your wives have sent me and they are urging you to be equitable with regard to the matter of the daughter of Abu Quhafah. The Prophet said to her: Do you love me? She said: Yes. He said: Then love her. So she went back to them and told them what he said. They said to her: You did not do anything; go back to him. She said: By Allah; I will never go back and speak to him about her again. She was truly the daughter of the Messenger of Allah. So they sent Zainab bint Jahsh. Aisha said: She was somewhat my equal among the wives of the Prophet. She said: Your wives have sent me to urge you to be equitable with regard to the matter of the daughter of Abu Quhafa. Then she swooped on me and abused me; and I started watching the Prophet to see if he would give me permission to respond to her. She insulted me and I started to think that he would not disapprove if I responded to her. So I insulted her and I soon silenced her. Then the Prophet said to her: She is the daughter of Abu Bakr. Aisha said: And I never saw any woman who was better; more generous in giving charity; more keen to uphold the ties of kinship; and more generous in giving of herself in everything by means of which she could draw closer to Allah than Zainab. MuwataMalik-017-001-34803 | Yahya related to me from Malik that Yahya Ibn Said said that Abu Bakr Ibn Muhammad Ibn Amr Ibn Hazm informed him that he had taken a Nabatean who had stolen some iron rings and jailed him in order to cut off his hand. Amra bint Abdulrahman sent a girl mawla to him called Umaya. Abu Bakr said that she had come to him while he was among the people and said that his aunt Amra sent word to him saying; Son of my brother! You have taken a Nabatean for something insignificant which was mentioned to me. Do you want to cut off his hand? He had said; Yes. She said; Amra says to you not to cut off the hand except for a quarter of a dinar and upwards. Abu Bakr added; So I let the Nabatean go. Malik said; The generally agreed on way of doing things among us about the confession of slaves is that if a slave confesses something against himself; the hadd and punishment for it is inflicted on his body. His confession is accepted from him and one does not suspect that he would inflict something on himself. Malik said; As for the one of them who confesses to a matter which will incur damages agains this master; his confession is not accepted against his master. Malik said; One does not cut off the hand of a hireling or a man who is with some people to serve them; if he robs them; because his state is not the state of a thief. His state is the state of a treacherous one. The treacherous one does not have his hand cut off. Malik said about a person who borrows something and then denies it; His hand is not cut off. He is like a man who owes a debt to another man and denies it. He does not have his hand cut off for what he has denied. Malik said; The generally agreed-on way of dealing among us; with the thief who is found in a house and has gathered up goods and has not taken them out; is that his hand is not cut off. That is like the man who places wine before him to drink it and does not do it. The hadd is not imposed on him. That is like a man who sits with a woman and desires to have haram intercourse with her and does not do it and he does not reach her. There is no hadd against that either. MuwataMalik-017-001-34846 | Malik related to me that the generally agreed on way of doing things amongst the community about an accident is that there is no blood-money until the victim is better. If a man bone; either a hand; or a foot; or another part of his body; is broken accidentally and it heals and becomes sound and returns to its form; there is no blood-money for it. If the limb is impaired or there is a scar on it; there is blood-money for it according to the extent that it is impaired. Malik said; If that part of the body has a specific blood-money mentioned by the Prophet; may Allah bless him and grant him peace; it is according to what the Prophet; may Allah bless him and grant him peace; specified. If it is part of what does not have a specific blood-money for it mentioned by the Prophet; may Allah bless him and grant him peace; and if there is no previous sunna about it or specific blood-money; one uses ijtihad about it. Malik said; There is no blood-money for an accidental bodily injury when the wound heals and returns to its form. If there is any scar or mark in that; ijtihad is used about it except for the belly-wound. There is a third of the blood-money of a life for it. Malik said; There is no blood-money for the wound which splinters a bone in the body; and it is like the wound to the body which lays bare the bone. Malik said; The generally agreed on way of doing things in our community is that when the doctor performs a circumcision and cuts off the glans; he must pay the full blood-money. MuwataMalik-017-001-34858 | Malik related to me; Ibn Shihab did not think and nor do I; that there is a generally agreed on way of doing things regarding a piercing wound in any of the organs or limbs of the body; but I think that there is ijtihad in the case. The imam uses ijtihad in it; and there is no generally agreed on way of doing things in our community about it. Malik said; What is done in our community about the wound to the brain and the wound which splinters the bone; and the wound that bares the bone is that they apply only to the head and face. Whatever of that occurs in the body only has ijtihad in it. MuwataMalik-017-001-35133 | Malik related to me from Yahya Ibn Said that he heard Muhammad Ibn AlMunkadir say; Allah loves his slave who is generous when he sells; and generous when he buys; generous when he repays; and generous when he is repaid. Malik said about a man who bought camels or sheep or dry goods or slaves or any goods without measuring precisely; There is no buying without measuring precisely in anything which can be counted. Malik said about a man who gave a man goods to sell for him and set their price saying; If you sell them for this price as I have ordered you to do; you will have a dinar or something which he has specified; which they are both satisfied with ; if you do not sell them; you will have nothing; There is no harm in that when he names a price to sell them at and names a known fee. If he sells the goods; he takes the fee; and if he does not sell them; he has nothing. Malik said; This is like saying to another man; If you capture my runaway slave or bring my stray camel; you will have such-and-such. This is from the category of reward; and not from the category of giving a wage. Had it been from the category of giving a wage; it would not be good. Malik said; As for a man who is given goods and told that if he sells them he will have a named percentage for every dinar; that is not good because whenever he is a dinar less than the price of the goods; he decreases the due which was named for him.
