The Book of Blood Money in Muwata Malik Key Points
- Malik said The generally agreed on way of doing things among us concerning making an advance for slaves cattle or goods is that when all of what is to be sold is described and an advance is made for them for a date and the date falls due the buyer does not sell any of that to the person from whom he has purchased it for more than the price which he advanced for it before he has taken full possession of what he has advanced for . MuwataMalik-017-001-35103 Category:The Book of Blood Money in Muwata Malik
- If the buyer gives the seller dinars or dirhams and he profits with them then when the goods come to the buyer and he does not take them into his possession but sells them back to their owner for more than what he advanced for them the outcome is that what he has advanced has returned to him and has been increased for him . MuwataMalik-017-001-35103 Category:The Book of Blood Money in Muwata Malik
- Malik said If someone advances gold or silver for described animals or goods which are to be delivered before a named date and the date arrives or it is before or after the date there is no harm in the buyer selling those goods to the seller for other goods to be taken immediately and not delayed no matter how extensive the amount of those goods is except in the case of food because it is not halal to sell it before he has full possession of it . MuwataMalik-017-001-35103 Category:The Book of Blood Money in Muwata Malik
- It was not to be done because if he postponed paying the ten it would be on credit and if he paid the ten he would buy with it what was worth fifteen dinars on credit . MuwataMalik-017-001-35106 Category:The Book of Blood Money in Muwata Malik
- Malik spoke about a man saying to another I will either buy these fifteen sa of ajwa dates from you or these ten sa of sayhani dates or I will buy these fifteen sa of inferior wheat or these ten sa of Syrian wheat for a dinar and one of them is obliged to me . MuwataMalik-017-001-35107 Category:The Book of Blood Money in Muwata Malik
- That was because he obliged him ten sa of sayhani and left them and took fifteen sa of ajwa or he was obliged fifteen sa of inferior wheat and left them and took ten sa of Syrian wheat . MuwataMalik-017-001-35107 Category:The Book of Blood Money in Muwata Malik
- If it has that its price is such and such and if it has this its price is such and such . MuwataMalik-017-001-35108 Category:The Book of Blood Money in Muwata Malik
- Malik said As for a man who buys goods from a man and he concludes the sale and then the buyer regrets and asks to have the price reduced and the seller refuses and says Sell it and I will compensate you for any loss . MuwataMalik-017-001-35108 Category:The Book of Blood Money in Muwata Malik
- What made it different was that it was a common practice and it was what people were familiar with and what people had done in the past and it was still among the permitted transactions and trading of people in which they saw no harm because in the sale of bundles with a list of contents without undoing them an uncertain transaction was not intended and it did not resemble mulamasa . MuwataMalik-017-001-35108 Category:The Book of Blood Money in Muwata Malik
- He took them to a city to sell murabaha or sold them where he purchased them according to the exchange rate of the day on which he sold them . MuwataMalik-017-001-35110 Category:The Book of Blood Money in Muwata Malik
- If he wishes he gives the salesman the value of the goods on the day he took them and if he wishes he gives the price for which he bought them according to the reckoning of what profit he gives him as far as it goes unless that is less than the price for which he bought them for he should not give the owner of the goods a loss from the price for which he bought them because he was satisfied with that . MuwataMalik-017-001-35110 Category:The Book of Blood Money in Muwata Malik
- To us that is like someone who delays repaying his debt after it is due to his creditor and his creditor increases his debt . MuwataMalik-017-001-35114 Category:The Book of Blood Money in Muwata Malik
- Malik said One should not buy a debt owed by a man whether present or absent without the confirmation of the one who owes the debt nor should one buy a debt owed to a man by a dead person even if one knows what the deceased man has left . MuwataMalik-017-001-35118 Category:The Book of Blood Money in Muwata Malik
- Malik said The way of doing things among us is that there is no harm in partnership transferring responsibility to an agent and revocation when dealing with food and other things whether or not possession was taken when the transaction is with cash and there is no profit loss or deferment of price in it . MuwataMalik-017-001-35118 Category:The Book of Blood Money in Muwata Malik
- Malik said The new partner takes the price from the original partner and the original partner demands from the seller the whole price unless the original partner stipulated on the new partner during the sale and before the transaction with the seller was completed that the seller was responsible to him . MuwataMalik-017-001-35118 Category:The Book of Blood Money in Muwata Malik
- Malik related to me from Yahya Ibn Said from Abu Bakr Ibn Muhammad Ibn Amr Ibn Hazm from Umar Ibn Abdal Aziz from Abu Bakr Ibn Abdulrahman Ibn AlHarith Ibn Hisham from Abu Hurayra that the Messenger of Allah may Allah bless him and grant him peace said If anyone goes bankrupt and a man finds his own property intact with him he is more entitled to it than anyone else . MuwataMalik-017-001-35119 Category:The Book of Blood Money in Muwata Malik
- Malik spoke about some one who bought spun wool or a plot of land and then did some work on it like building a house on the plot of land or weaving the spun wool into cloth . MuwataMalik-017-001-35120 Category:The Book of Blood Money in Muwata Malik
- Malik said As for goods which have been sold and which the buyer does not improve but those goods sell well and have gone up in price so their owner wants them and the creditors also want to seize them then the creditors choose between giving the owner of the goods the price for which he sold them and not giving him any loss and surrendering his goods to him . MuwataMalik-017-001-35121 Category:The Book of Blood Money in Muwata Malik
- Malik said There is no harm in a person who has borrowed gold silver food or animals taking to the person who lent it something better than what he lent when that is not a stipulation between them nor a custom . MuwataMalik-017-001-35122 Category:The Book of Blood Money in Muwata Malik
- A free loan which you lend by which you desire the pleasure of your companion so you have the pleasure of your companion and a free loan which you lend by which you take what is impure by what is pure and that is usury . MuwataMalik-017-001-35123 Category:The Book of Blood Money in Muwata Malik
- Malik related to me from Abuz Zinad from AlAraj from Abu Hurayra that the Messenger of Allah may Allah bless him and grant him peace said Do not go out to meet the caravans for trade do not bid against each other outbidding in order to raise the price and a townsman must not buy on behalf of a man of the desert and do not tie up the udders of camels and sheep so that they appear to have a lot of milk for a person who buys them after that has two recourses open to him after he milks them . MuwataMalik-017-001-35127 Category:The Book of Blood Money in Muwata Malik
- Malik said The explanation of the words of the Messenger of Allah may Allah bless him and grant him peace according to what we think and Allah knows best do not bid against each other is that it is forbidden for a man to offer a price over the price of his brother when the seller has inclined to the bargainer and made conditions about the weight of the gold and he has declared himself not liable for faults and such things by which it is recognised that the seller wants to make a transaction with the bargainer . MuwataMalik-017-001-35127 Category:The Book of Blood Money in Muwata Malik
- Malik related to me from Yahya Ibn Said that he heard Muhammad Ibn AlMunkadir say Allah loves his slave who is generous when he sells and generous when he buys generous when he repays and generous when he is repaid . MuwataMalik-017-001-35129 Category:The Book of Blood Money in Muwata Malik
- Malik said about a man who bought camels or sheep or dry goods or slaves or any goods without measuring precisely There is no buying without measuring precisely in anything which can be counted . MuwataMalik-017-001-35130 Category:The Book of Blood Money in Muwata Malik
- Malik said about a man who gave a man goods to sell for him and set their price saying If you sell them for this price as I have ordered you to do you will have a dinar or something which he has specified which they are both satisfied with if you do not sell them you will have nothing There is no harm in that when he names a price to sell them at and names a known fee . MuwataMalik-017-001-35130 Category:The Book of Blood Money in Muwata Malik

She was searching for her son who had been killed in the battle Some of the Companions of the Prophet ﷺ said to her: You have come here asking for your son while veiling your face? She said: If I am afflicted with the loss of my son; I shall not suffer the loss of my modesty. The Messenger of Allah ﷺ said: You will get the reward of two martyrs for your son. She asked: Why is that so; Messenger of Allah? He replied: Because the people of the Book have killed him. SunanAbuDawoud-017-001-29535

- Narrated Sahl Ibn AlHanzaliyah: On the day of Hunayn we travelled with the Messenger of Allah ﷺ and we journeyed for a long time until the evening came. I attended the prayer along with the Messenger of Allah ﷺ. A horseman came and said: Messenger of Allah; I went before you and climbed a certain mountain where saw Hawazin all together with their women; cattle; and sheep; having gathered at Hunayn. The Messenger of Allah ﷺ smiled and said: That will be the booty of the Muslims tomorrow if Allah wills. He then asked: Who will be on guard tonight? Anas Ibn Abu Marthad AlGhanawi said: I shall ; Messenger of Allah. He said: Then mount your horse. He then mounted his horse; and came to the Messenger of Allah ﷺ. The Messenger of Allah said to him: Go forward to this ravine till you get to the top of it. We should not be exposed to danger from your side. In the morning the Apostle of of Allah ﷺ came out to his place of prayer; and offered two rakahs. He then said: Have you seen any sign of your horseman? They said: We have not; Messenger of Allah. The announcement of the time for prayer was then made; and while the Messenger of Allah ﷺ was saying the prayer; he began to glance towards the ravine. When he finished his prayer and uttered salutation; he said: Cheer up; for your horseman has come. We therefore began to look between the trees in the ravine; and sure enough he had come. He stood beside the Messenger of Allah ﷺ ; saluted him and said: I continued till I reached the top of this ravine where the Messenger of Allah ﷺ commanded me; and in the morning I looked down into both ravines but saw no one. The Messenger of Allah ﷺ asked him: Did you dismount during the night? He replied: No; except to pray or to relieve myself. The Messenger of Allah ﷺ said: You have ensured your entry to Paradise. No blame will be attached to you supposing you do not work after it. SunanAbuDawoud-017-001-29548
- Narrated Abu Ayoub : Abu Imran said: We went out on an expedition from Medina with the intention of attacking Constantinople. Abdulrahman Ibn Khalid Ibn AlWalid was the leader of the company. The Romans were just keeping their backs to the walls of the city. A man suddenly attacked the enemy. Thereupon the people said: Stop! Stop! There is no god but Allah. He is putting himself into danger. Abu Ayoub said: This verse was revealed about us; the group of the Ansar the Helpers. When Allah helped His Prophet ﷺ and gave Islam dominance; we said i.e. thought : Come on! Let us stay in our property and improve it. Thereupon Allah; the Exalted; revealed; And spend of your substance in the cause of Allah; and make not your hands contribute to your destruction. To put oneself into danger means that we stay in our property and commit ourselves to its improvement; and abandon fighting i.e. jihad. Abu Imran said: Abu Ayoub continued to strive in the cause of Allah until he died and was buried in Constantinople. SunanAbuDawoud-017-001-29559

Do not kill a decrepit old man; or a young infant; or a child; or a woman; do not be dishonest about booty; but collect your spoils; do right and act well; for Allah loves those who do well. SunanAbuDawoud-017-001-29661
- Awuf Bin malik AlAshjaI said I went out with Zaid Bin Harith in the battle of Mutah. For the reinforcement of the Muslim army a man from the people of Yemen accompanied me. He had only his sword with him. A man from the Muslims slaughtered a Camel. The man for the reinforcement asked him for a part of its skin which he gave him. He made it like the shape of a shield. We went on and met the Byzantine armies. There was a man among them on a reddish horse with a golden saddle and golden weapons. This Byzantinian soldiers began to attack the Muslims desperately. The man for reinforcement sat behind a rock for attacking him. He hamstrung his horse and overpowered him and then killed him. He took his horse and weapons. When Allah; Most High; bestowed victory on the Muslims. Khalid Bin AlWalid sent for him and took his spoils. Awuf said I came to him and said Khalid; do you know that the Apostle of Allaah ﷺ had decided to give spoils to the killer? He said Yes; I thought it abundant. I said You should return it to him; or I shall tell you about it before the Apostle of Allaah ﷺ. But he refused to return it. Awuf said We then assembled with the Apostle of Allaah ﷺ. I told him the story of the man of reinforcement and what Khalid had done. The Apostle of Allaah ﷺ said Khalid; what made you do the work you have done? He said Apostle of Allaah ﷺ ; I considered it to be abundant. The Apostle of Allaah ﷺ said Khalid; return it to him what you have taken from him. Awuf said I said to him here you are; Khalid. Did I not keep my word? The Apostle of Allaah ﷺ said What is that? I then informed him. He said The Apostle of Allaah ﷺ became angry and said Khalid; do not return it to him. Are you going to leave my commanders? You may take from them what is best for you and eave to them what is worst. SunanAbuDawoud-017-001-29766
- Narrated Abdullah Ibn Abbas: The Messenger of Allah ﷺ said on the day of Badr: He who does such-and-such; will have such-and such. The young men came forward and the old men remained standing near the banners; and they did not move from there. When Allah bestowed victory on them; the old men said: We were support for you. If you had been defeated; you would have returned to us. Do not take this booty alone and we remain deprived of it. The young men refused to give ; and said: The Messenger of Allah ﷺ has given it to us. Then Allah sent down: They ask thee concerning things taken as spoils of war; Say: Such spoils are at the disposal of Allah and the Apostle......Just as they Lord ordered thee out of thy house in truth; even though a party among the believers disliked it. This proved good for them. Similarly obey me. I know the consequence of this better than you. SunanAbuDawoud-017-001-29784
- Narrated Abdullah Ibn Umar: The Messenger of Allah ﷺ went out on the day of Badr along with three hundred and fifteen men. The Messenger of Allah ﷺ said: O Allah; they are on foot; provide mount for them; O Allah ; they are naked; clothe them; O Allah; they are hungry; provide food for them. Allah then bestowed victory on them. They returned when they were clothed. There was no man of them but he returned with one or two camels; they were clothed and ate to their fill. SunanAbuDawoud-017-001-29794
- Narrated Anas Ibn Malik: The Prophet ﷺ said: Three things are the roots of faith: to refrain from killing a person who utters; There is no god but Allah and not to declare him unbeliever whatever sin he commits; and not to excommunicate him from Islam for his any action; and jihad will be performed continuously since the day Allah sent me as a prophet until the day the last member of my community will fight with the Dajjal Antichrist. The tyranny of any tyrant and the justice of any just ruler will not invalidate it. One must have faith in Divine decree. SunanAbuDawoud-017-001-29579

They afterwards kept close together when they encamped to such an extent that it used to be said that if a cloth were spread over them; it would cover them all. SunanAbuDawoud-017-001-29675

Mousa said: Rizq Ibn Saeed Ibn Abdulrahman reported from Abu Hazim on the authority of Sahl Ibn Saad from the Prophet ﷺ as saying: And while it is raining. SunanAbuDawoud-017-001-29587

Should I kill him; Apostle of Allaah ﷺ after he uttered it the credo of Islam ? The Apostle of Allaah ﷺ said Do not kill him. I said Apostle of Allaah ﷺ ; he cut off my hand. - Khabbab said We came to the Apostle of Allaah ﷺ while he was reclining on an outer garment in the shade of the Kabah. Complaining to him we said Do you not ask Allaah for help for us? And do you not pray to Allaah for us? He sat aright turning red in his face and said A man before you i.e.; in ancient times was caught and a pit was dug for him in the earth and then a saw was brought placed on his head and it was broken into two pieces but that did not turn him away from his religion. They were combed in iron combs in flesh and sinews above the bones. Even that did not turn them away from their religion. I swear by Allaah; Allaah will accomplish this affair until a rider will travel between Sana and Hadramaut and he will not fear anyone except Allaah; Most High nor will he fear the attack of a wolf on his sheep; but you are making haste. SunanAbuDawoud-017-001-29696
- Salamh bin AlAkwa said I went on an expedition with the Apostle of Allaah ﷺ against Hawazin and while we were having a meal in the forenoon and most of our people were on foot and some of us were weak; a man came on a red Camel. He took out a rope from the lion of the Camel and tied his Camel with it and began to take meal with the people. A man of the tribe of Aslam followed him on a brown she Camel which was best of those of the people. I hastened out and I found him while the head of the she Camel was near the paddock of the she Camel. I then went ahead till I reached near the paddock of the Camel. I then went ahead till I caught the Camels nose string. I made it kneel. When it placed its knee on the ground; I drew my sword and struck the man on his head and it fell down. I then brought the Camel leading it with its equipment on it. The Apostle of Allaah ﷺ came forward facing me and asked Who killed the man? They the people said Salamah Bin Akwa. And while they were in Wadi AlQura and Midam was unsaddling a Camel belonging to the Apostle of Allaah ﷺ he was struck by a random arrow which killed him. The people said Congratulations to him; he will go to paradise. But the Apostle of Allaah ﷺ said Not at all. - Abu Huraira reported the Apostle of Allaah ﷺ as saying There are Camels which belong to devils and there are houses which belong to devils. As for the Camels of the devils; I have seen them. One of you goes out with his side Camels which he has fattened neither riding any of them nor giving a lift to a tired brother when he meets. As regard the houses of the devils; I have not seen them.
