He said: "Is it not possible, if ye were commanded to fight, that that ye will not fight?" They said: "How could we refuse to fight in the cause of Allah, seeing that we were turned out of our homes and our families?" but when they were commanded to fight, they turned back, except a small band among them. But Allah Has full knowledge of those who do wrong.

Said the disciples, "We are Allah's helpers!" then a portion of the Children of Israel believed, and a portion disbelieved: But We gave power to those who believed, against their enemies, and they became the ones that prevailed.

There is not a good deed which ye do, but Allah is well-acquainted therewith.

Let not Satan seduce you, in the same manner as He got your parents out of the Garden, stripping them of their raiment, to expose their shame: for he and his tribe watch you from a position where ye cannot see them: We made the evil ones friends (only) to those without faith.

SahihAlBukhari-017-001-1139Narrated Abu Said: The Prophet ﷺ mentioned a man from the people of the past or those who preceded you. The Prophet ﷺ said a sentence meaning: Allah had given him wealth and children. When his death approached; he said to his sons; What kind of father have I been to you? They replied; You have been a good father. He told them that he had not presented any good deed before Allah; and if Allah should get hold of him He would punish him. So look! he added; When I die; burn me; and when I turn into coal; crush me; and when there comes a windy day; scatter my ashes in the wind. The Prophet ﷺ added; Then by Allah; he took a firm promise from his children to do so; and they did so. They burnt him after his death and threw his ashes on a windy day. Then Allah commanded to his ashes. Be; and behold! He became a man standing! Allah said; O My slave! What made you do what you did? He replied; For fear of You. Allah Messenger ﷺ said; Gather on such-and-such a day at suchand- such a place. They gathered and Allah Messenger ﷺ came to them and taught them of what Allah had taught him. He then said; No woman among you who has lost her three children died but that they will screen her from the Fire. A woman among them said; O Allah Messenger ﷺ ! If she lost two children? She repeated her question twice; whereupon the Prophet ﷺ said; Even two; even two; even two! SahihAlBukhari-017-001-1678Narrated Samura Bin Jundub: Allah Messenger ﷺ very often used to ask his companions; Did anyone of you see a dream? So dreams would be narrated to him by those whom Allah wished to tell. One morning the Prophet ﷺ said; Last night two persons came to me in a dream and woke me up and said to me; Proceed! I set out with them and we came across a man lying down; and behold; another man was standing over his head; holding a big rock. Behold; he was throwing the rock at the man head; injuring it. The rock rolled away and the thrower followed it and took it back. By the time he reached the man; his head returned to the normal state. The thrower then did the same as he had done before. I said to my two companions; Subhan Allah! Who are these two persons? They said; Proceed! So we proceeded and came to a man lying flat on his back and another man standing over his head with an iron hook; and behold; he would put the hook in one side of the man mouth and tear off that side of his face to the back of the neck and similarly tear his nose from front to back and his eye from front to back. Then he turned to the other side of the man face and did just as he had done with the other side. He hardly completed this side when the other side returned to its normal state. Then he returned to it to repeat what he had done before. I said to my two companions; Subhan Allah! Who are these two persons? They said to me; Proceed! So we proceeded and came across something like a Tannur a kind of baking oven; a pit usually clay-lined for baking bread. I think the Prophet ﷺ said; In that oven there was much noise and voices. The Prophet ﷺ added; We looked into it and found naked men and women; and behold; a flame of fire was reaching to them from underneath; and when it reached them; they cried loudly. I asked them; Who are these? They said to me; Proceed! And so we proceeded and came across a river. I think he said;.... red like blood. The Prophet ﷺ added; And behold; in the river there was a man swimming; and on the bank there was a man who had collected many stones. Behold; while the other man was swimming; he went near him. The former opened his mouth and the latter on the bank threw a stone into his mouth whereupon he went swimming again. He returned and every time the performance was repeated. I asked my two companions; Who are these two persons? They replied; Proceed! Proceed! And we proceeded till we came to a man with a repulsive appearance; the most repulsive appearance; you ever saw a man having! Beside him there was a fire and he was kindling it and running around it. I asked my companions; Who is this man ? They said to me; Proceed! Proceed! So we proceeded till we reached a garden of deep green dense vegetation; having all sorts of spring colors. In the midst of the garden there was a very tall man and I could hardly see his head because of his great height; and around him there were children in such a large number as I have never seen. I said to my companions; Who is this? They replied; Proceed! Proceed! So we proceeded till we came to a majestic huge garden; greater and better than I have ever seen! My two companions said to me; Go up and I went up. The Prophet ﷺ added; So we ascended till we reached a city built of gold and silver bricks and we went to its gate and asked the gatekeeper to open the gate; and it was opened and we entered the city and found in it; men with one side of their bodies as handsome as the handsomest person you have ever seen; and the other side as ugly as the ugliest person you have ever seen. My two companions ordered those men to throw themselves into the river. Behold; there was a river flowing across the city ; and its water was like milk in whiteness. Those men went and threw themselves in it and then returned to us after the ugliness of their bodies had disappeared and they became in the best shape. The Prophet ﷺ further added; My two companions angels said to me; This place is the Eden Paradise; and that is your place. I raised up my sight; and behold; there I saw a palace like a white cloud! My two companions said to me; That palace is your place. I said to them; May Allah bless you both! Let me enter it. They replied; As for now; you will not enter it; but you shall enter it one day. I said to them; I have seen many wonders tonight. What does all that mean which I have seen? They replied; We will inform you: As for the first man you came upon whose head was being injured with the rock; he is the symbol of the one who studies the Quran and then neither recites it nor acts on its orders; and sleeps; neglecting the enjoined prayers. As for the man you came upon whose sides of mouth; nostrils and eyes were torn off from front to back; he is the symbol of the man who goes out of his house in the morning and tells so many lies that it spreads all over the world. And those naked men and women whom you saw in a construction resembling an oven; they are the adulterers and the adulteresses. And the man whom you saw swimming in the river and given a stone to swallow; is the eater of usury Riba. And the bad looking man whom you saw near the fire kindling it and going round it; is Malik; the gatekeeper of Hell. And the tall man whom you saw in the garden; is Abraham and the children around him are those children who die with AlFitra the Islamic Faith. The narrator added: Some Muslims asked the Prophet; O Allah Messenger ﷺ ! What about the children of pagans? The Prophet ﷺ replied; And also the children of pagans. He said; But he i.e. your father has not stored any good deeds with Allah for the Hereafter : if he should face Allah; Allah will punish him. So listen; O my children ; when I die; burn my body till I become mere coal and then grind it into powder; and when there is a stormy wind; throw me my ashes in it. So he took a firm promise from his children to follow his instructions. And by Allah they his sons did accordingly fulfilled their promise. Then Allah said; Be and behold! That man was standing there! Allah then said. O my slave! What made you do what you did? That man said; Fear of You. SahihAlBukhari-017-001-2494Narrated Ibn Umar: Allah Messenger ﷺ said; While three persons were traveling; they were overtaken by rain and they took shelter in a cave in a mountain. A big rock fell from the mountain over the mouth of the cave and blocked it. They said to each other. Think of such good righteous deeds which; you did for Allah sake only; and invoke Allah by giving reference to those deeds so that Allah may relieve you from your difficulty. one of them said; O Allah! I had my parents who were very old and I had small children for whose sake I used to work as a shepherd. When I returned to them at night and milked the sheep ; I used to start giving the milk to my parents first before giving to my children. And one day I went far away in search of a grazing place for my sheep ; and didnt return home till late at night and found that my parents had slept. I milked my livestock as usual and brought the milk vessel and stood at their heads; and I disliked to wake them up from their sleep; and I also disliked to give the milk to my children before my parents though my children were crying from hunger at my feet. So this state of mine and theirs continued till the day dawned. O Allah! If you considered that I had done that only for seeking Your pleasure; then please let there be an opening through which we can see the sky. So Allah made for them an opening through which they could see the sky. Then the second person said; O Allah! I had a cousin whom I loved as much as a passionate man love a woman. I tried to seduce her but she refused till I paid her one-hundred Dinars So I worked hard till I collected one hundred Dinars and went to her with that But when I sat in between her legs to have sexual intercourse with her ; she said; O Allah slave! Be afraid of Allah ! Do not deflower me except legally by marriage contract. So I left her O Allah! If you considered that I had done that only for seeking Your pleasure then please let the rock move a little to have a wider opening. So Allah shifted that rock to make the opening wider for them. And the last third person said O Allah ! I employed a laborer for wages equal to a Faraq a certain measure: of rice; and when he had finished his job he demanded his wages; but when I presented his due to him; he gave it up and refused to take it. Then I kept on sowing that rice for him several times till managed to buy with the price of the yield; some cows and their shepherd Later on the laborer came to me an said. O Allah slave! Be afraid o Allah; and do not be unjust to me an give me my due. I said to him. Go and take those cows and their shepherd. So he took them and went away. So; O Allah! If You considered that I had done that for seeking Your pleasure; then please remove the remaining part of the rock. SahihAlBukhari-017-001-5072Narrated Abdullah Bin Umar: The Prophet ﷺ said; While three men were walking; It started raining and they took shelter refuge in a cave in a mountain. A big rock rolled down from the mountain and closed the mouth of the cave. They said to each other; Think of good deeds which you did for Allah sake only; and invoke Allah by giving reference to those deeds so that He may remove this rock from you. One of them said; O Allah! I had old parents and small children and I used to graze the sheep for them. On my return to them in the evening; I used to milk the sheep and start providing my parents first of all before my children. One day I was delayed and came late at night and found my parents sleeping. I milked the sheep as usual and stood by their heads. I hated to wake them up and disliked to give milk to my children before them; although my children were weeping because of hunger at my feet till the day dawned. O Allah! If I did this for Your sake only; kindly remove the rock so that we could see the sky through it. So; Allah removed the rock a little and they saw the sky. The second man said; O Allah! I was in love with a cousin of mine like the deepest love a man may have for a woman. I wanted to outrage her chastity but she refused unless I gave her one hundred Dinars. So; I struggled to collect that amount. And when I sat between her legs; she said; O Allah slave! Be afraid of Allah and do not deflower me except rightfully by marriage. So; I got up. O Allah! If I did it for Your sake only; please remove the rock. The rock shifted a little more. Then the third man said; O Allah! I employed a laborer for a Faraq of rice and when he finished his job and demanded his right; I presented it to him; but he refused to take it. If You regard that I did it for Your sake; then please remove this rock so that we may see the sky. So; the rock was moved a bit. The second said; O Allah! You know that I was in love with a cousin of mine; like the deepest love a man may have for a woman; and she told me that I would not get my desire fulfilled unless I paid her one-hundred Dinars gold pieces. So; I struggled for it till I gathered the desired amount; and when I sat in between her legs; she told me to be afraid of Allah; and asked me not to deflower her except rightfully by marriage. So; I got up and left her. O Allah! If You regard that I did if for Your sake; kindly remove this rock. So; two-thirds of the rock was removed. Then the third man said; O Allah! No doubt You know that once I employed a worker for one Faraq three Sas of millet; and when I wanted to pay him; he refused to take it; so I sowed it and from its yield I bought cows and a shepherd. After a time that man came and demanded his money. I said to him: Go to those cows and the shepherd and take them for they are for you. He asked me whether I was joking with him. I told him that I was not joking with him; and all that belonged to him. O Allah! If You regard that I did it sincerely for Your sake; then please remove the rock. Today you ordered people to give alms and I had an ornament and intended to give it as alms; but Ibn Masud said that he and his children deserved it more than anybody else. SahihMuslim-017-001-18148It has been narrated on the authority of Yazid Bin Hurmuz that Najda wrote to Ibn Abbas inquiring of him five things. Ibn Abbas said: If I had not the fear of committing sin for concealing the knowledge I would not have written to him. Najda wrote to him saying after praising the Almighty and invoking blessings on the Prophet : Tell me whether the Messenger of Allah ﷺ took women to participate with him in Jihad; if he did ; whether he allotted them a regular share from the booty; whether he killed the children of the enemy in the war ; how long an orphan would be entitled to consideration as such; and for whom the Khums fifth part of the booty was booty. Ibn Abbas wrote to him: You have written asking me whether the Messenger of Allah ﷺ took women with him to participate in Jihad. He did take them to the battle and sometimes he fought along with them. They would treat the wounded and were given a reward from the booty; but he did not assign any regular share for them. And the Messenger of Allah ﷺ did not kill the children of the enemy; so you should not kill the children. Also you have written to me asking me when the orphanhood of an orphan comes to an end. By my life; if a man has become bearded but is still incapable of getting his due from others or fulfilling his obligation towards them; he is yet an orphan to be treated as such ; but when he can look after his interests like grown-up people; he is no longer an orphan. And you have written to me inquiring about Khums as to whom it is meant for. SahihMuslim-017-001-18150It has been narrated on the authority of Yazid Bin Hurmuz who said: Najda Bin Amir AlHaruri wrote to Ibn Abbas asking him about the slave and the woman as to whether they would get a share from the booty it they participated in Jihad ; about the killing of enemy children in war ; about the orphan as to when his orphanhood comes to an end; about kinsmen of the Holy Prophet as to who they are. He said to Yazid: Write to him. If he were not likely to fall into folly; I would not have written to him. Write: You have written asking about the woman and the slave whether they would get a share of the booty if they participated in Jihad. You should know that there is nothing of the sort for them except that they will be given a prize. And you have written asking me about the killing of the enemy children in war. You should understand that the Messenger of Allah may peare be upon him did not kill them. and thou shouldst not kill them unless thou knew what the companion of Moses i. e. Khadir knew about the boy he had killed. And you have written asking me about the orphan as to when the period of his orphanhood comes to an end; so that the sobriquet of orphan is dropped from him. In this regard; you should know that the sobriquet orphan will not be dropped from him until he attains maturity of body and mind. And you have written asking me about the close relatives of the Holy Prophet as to who they are. SahihMuslim-017-001-18152It has been narrated on the anthority of Yazid Bin Hurmuz who said: Najda wrote to Ibn Abbas. I was sitting in the company of Ibn Abbas when he read his letter and wrote its reply. Ibn Abbas said: Were it not for preventing him from falling into wickedness. I would not have replied to his letter; may he never be joyful. He wrote in reply to him referring to the share of the close relatives of the Holy Prophet from the booty whom God has mentioned. I have to tell you that we thought we were the close relatives of the Messenger of Allah ﷺ ; but our people have refused to recognise us as such. You have asked about the orphan as to when his orphanhood comes to an end. I have to say that when he reaches the age of marriage; attains maturity of mind; and his property is returned to him; then he is no longer an orphan. You have inquired whether the Messenger of Allah may peace be upo him used to kill anyone from the children of the polytheists in the war. You should know that the Messenger of Allah ﷺ used not to kill any one of their children; and you too should not kill any one of them; except when you knew about them what Khadir had known about the boy whom he killed. And you have inquired whether there is a fixed share of the booty for women and slaves when they participate in a battle. SahihMuslim-017-001-19296Abdullah Bin Umar reported that Allah Messenger ﷺ said: Three persons set out on a journey. They were overtaken by rain and they had to find protection in a mountain cave where at its mouth there fell a rock of that mountain and thus blocked them altogether. One of them said to the others: Look to your good deeds that you performed for the sake of Allah and then supplicate Allah; the Exalted; that He might rescue you from this trouble. One of them said: 0 Allah; I had my parents who were old and my wife and my small children also. I tended the flock and when I came back to them in the evening; I milked them the sheep; goats; cows; etc. and first served that milk to my parents. One day I was obliged to go out to a distant place in search of fodder and I could not come back before evening and found them the parents asleep. I milked the animals as I used to milk and brought milk to them and stood by their heads avoiding to disturb them from sleep and I did not deem it advisable to serve milk to my children before serving them. My children wept near my feet. I remained there in that very state and my parents too until it was morning. And 0 Allah if Thou art aware that I did this in order to seek Thine pleasure; grant us riddance from this trouble. The rock slipped a bit that they could see the sky. The second one said: 0 Allah; I had a female cousin whom I loved more than the men love the women. I wanted to have sexual intercourse with her; she refused but on the condition of getting one hundred dinirs. It was with very great difficulty that I could collect one hundred dinirs and then paid them to her and when I was going to have a sexual intercourse with her; that she said: Servant of Allah; fear Allah and do not break the seal of chastity but by lawful means. I got up. 0 Allah; if Thou art aware that I did this in order to seek Thine pleasure; rid us from this trouble. The situation was somewhat eased for them. The third one said: Allah; I employed a workman for a measure of rice. After he had finished his work I gave him his dues in the form of a measure of rice; but he did not accept them. I used these rice as seeds; and that gave a bumper crop and I became rich enough to have cows and flocks in my possession. He came to me and said: Fear Allah; and commit no crueltv upon me in regard to my dues. I said to him: Takeaway this flock of cows and sheep. He said: Fear Allah and do not make a fun of me. I said: I am not making a fun of you. You take the cows and the flocks. So he took them. 0 Allah; if Thou art aware that I did it for Thine pleasure; case the situation for us. Thereupon he said: I say that when we are in the company of Allah Messenger ﷺ we ponder over Hell-Fire and Paradise as if we are seeing them with our very eyes and when we are away from Allah Messenger ﷺ we attend to our wives; our children; our business; most of these things pertaining to After-life slip out of our minds. AlAbbas Bin Mirdas said: As for myself and Banu Sulaim; then no we will not give it up. Banu Sulaim stood up and said: You lied; whatever was allocated to us; it is for the Messenger of Allah. The Messenger of Allah said: O people; give their women and children back to them. Whoever gives back anything of these spoils of war; he will have six camels from the spoils of war that Allah grants us next. Then he mounted his riding-animal and the people surrounded him; saying: Distribute our spoils of war among us. They made him go back toward a tree on which his Rida upper-wrap got caught. He said: O people! Give me back my Rida. By Allah! If there were cattle as many in number as the trees of Tihamah I would distribute them among you; then you would not find me a miser; a coward or a liar. Then he went to a camel and took a hair from its hump between two of his fingers and said: Look! I do not have any of the spoils of war. All I have is the Khums; and the Khums will be given back to you. A man stood up holding a ball of yarn made from goat hair and said: O Messenger of Allah; I took this to fix my camel-saddle. He said: What was allocated to myself and to Banu Abd AlMuttalib is for you. He said: Is this so important? I dont need it! And he threw it down. He said: O people! The conditions which were confirmed for her are confirmed for them. The death of their mother does not harm them. If the one who made her mudabbara dies; they are free if their value is less than one third of his total property. Malik said; For every mother by birth as opposed to mother by suckling; her children are in her position. If she is free and she gives birth after she is free; her children are free. If she is a mudabbara or mukataba; or freed after a number of years in service; or part of her is free or pledged or she is an umm walad; each of her children are in the same position as their mother. They are set free when she is set free and they are slaves when she is a slave. Malik said about the mudabbara given a tadbir while she was pregnant; Her children are in her position. That is also the position of a man who frees his slave- girl while she is pregnant and does not know that she is pregnant. Malik said; The sunna about such women is that their children follow them and are set free by their being set free. Malik said; It is the same as if a man had bought a slave-girl while she was pregnant. The slave-girl and what is in her womb belong to the one who bought her whether or not the buyer stipulates that. Malik continued; It is not halal for the seller to make an exception about what is in her womb because that is an uncertain transaction. It reduces her price and he does not know if that will reach him or not. That is as if one sold the foetus in the womb of the mother. That is not halal because it is an uncertain transaction. Malik said about the mukatab or mudabbar who bought a slave- girl and had intercourse with her and she became pregnant by him and gives birth; The children of both of them by a slave-girl are in his position. They are set free when he is set free and they are slaves when he is a slave. MuwataMalik-017-001-34817Malik related to me that he heard Ibn Shihab say; The precedent of the sunna is that when a slave is freed; his property follows him. Malik said; One thing which makes clear that the property of a slave follows him when he is freed is that when the contract mukatab is written for his freedom; his property follows him even if he did not stipulate it. That is because the bond of kitaba is the bond of wala when it is complete. The property of a slave and a mukatab is not treated in the same way as any children they may have. Their children are only treated in the same way as their own slaves; not in the same way as their property. This is because the sunna; in which there is no dispute; is that when a slave is freed; his property follows him and his children do not follow him; and when a mukatab writes the contract for his freedom; his property follows him and his children do not follow him. Malik said; One thing which makes that clear is that when a slave or a mukatab are bankrupt; their property is taken but the mothers of their children and their children are not taken because they are not their property. MuwataMalik-017-001-34849Yahya related to me from Malik that he heard Ibn Shihab say; The precedent of the sunna when a man injures a woman is that he must pay the blood- money for that injury and there is no retaliation against him. Malik said; That is an accidental injury; when a man strikes a woman and hits with a blow what he did not intend; for instance; if he struck her with a whip and cut her eye open and the like of that. Malik said about a woman who has a husband and children who are not from her paternal relatives or her people; that since he is from another tribe; there is no blood-money against her husband for her criminal action; nor any against her children if they are not from her people; nor any against her maternal brothers when they are not from her paternal relations or her people. These are entitled to her inheritance but only the paternal relations have paid blood-money from since the time of the Messenger of Allah; may Allah bless him and grant him peace. MuwataMalik-017-001-34977Malik related to me that he heard that Urwa Ibn AlZubair and Sulayman Ibn Yasar when asked whether the sons of a man; who had a kitaba written for himself and his children and then died; worked for the kitaba of their father or were slaves; said; They work for the kitaba of their father and they have no reduction at all for the death of their father. Malik said; If they are small and unable to work; one does not wait for them to grow up and they are slaves of their father master unless the mukatab has left what will pay their instalments for them until they can work. If there is enough to pay for them in what he has left; that is paid for on their behalf and they are left in their condition until they can work; and then if they pay; they are free. If they cannot do it; they are slaves. Malik spoke about a mukatab who died and left property which was not enough to pay his kitaba; and he also left a child with him in his kitaba and an umm walad; and the umm walad wanted to work for them. He said; The money is paid to her if she is trustworthy with it and strong enough to work. If she is not strong enough to work and not trustworthy with property; she is not given any of it and she and the children of the mukatab revert to being slaves of the master of the mukatab. MuwataMalik-017-001-34979Malik related to me that he had heard that Said Ibn AlMusayab was asked about a mukatab who was shared between two men. One of them freed his portion and then the mukatab died and left a lot of money. Said replied; The one who kept his kitaba is paid what remains due to him; and then they divide what is left between them both equally. Malik said; When a mukatab who fulfils his kitaba and becomes free dies; he is inherited from by the people who wrote his kitaba and their children and paternal relations - whoever is most deserving. He said; This is also for whoever is set free when he dies after being set free - his inheritance is for the nearest people to him of children or paternal relations who inherit by means of the wala. Malik said; Brothers; written together in the same kitaba; are in the same position as children to each other when none of them have children written in the kitaba or born in the kitaba. When one of them dies and leaves property; he pays for them all that is against them of their kitaba and sets them free. MuwataMalik-017-001-34981Malik said; When a mukatab sets his own slaves free; it is only permitted for a mukatab to set his own slaves free with the consent of his master. If his master gives his consent and the mukatab sets his slave free; his wala goes to the mukatab. If the mukatab then dies before he has been set free himself; the wala of the freed slave goes to the master of the mukatab. If the freed one dies before the mukatab has been set free; the master of the mukatab inherits from him. Malik said; It is like that also when a mukatab gives his slave a kitaba and his mukatab is set free before he is himself. The wala goes to the master of the mukatab as long as he is not free. If this one who wrote the kitaba is set free; then the wala of his mukatab who was freed before him reverts to him. If the first mukatab dies before he pays; or he cannot pay his kitaba and he has free children; they do not inherit the wala of their father mukatab because the wala has not been established for their father and he does not have the wala until he is free. Malik spoke about a mukatab who was shared between two men and one of them forewent what the mukatab owed him and the other insisted on his due. Then the mukatab died and left property. Malik said; The one who did not abandon any of what he was owed; is paid in full. Then the property is divided between them both just as if a slave had died because what the first one did was not setting him free. He only abandoned a debt that was owed to him. Malik said; One clarification of that is that when a man dies and leaves a mukatab and he also leaves male and female children and one of the children frees his portion of the mukatab; that does not establish any of the wala for him. Had it been a true setting free; the wala would have been established for whichever men and women freed him. Malik said; Another clarification of that is that if one of them freed his portion and then the mukatab could not pay; the value of what was left of the mukatab would be altered because of the one who freed his portion. Had it been a true setting-free; his estimated value would have been taken from the property of the one who set free until he had been set completely free as the Messenger of Allah; may Allah bless him and grant him peace; said; Whoever frees his share in a slave and has money to cover the full price of the slave; justly evaluated for him; gives his partners their shares. If not; he frees of him what he frees. See Book 37 hadith 1. He said; Another clarification of that is that part of the sunna of the muslims in which there is no dispute; is that whoever frees his share of a mukatab; the mukatab is not set fully free using his property. Had he been truly set free; the wala would have been his alone rather than his partners. Part of what will clarify that also is that part of the sunna of the muslims is that the wala belongs to whoever writes the contract of kitaba. The women who inherit from the master of the mukatab do not have any of the wala of the mukatab. MuwataMalik-017-001-35135Yahya related to me from Malik; The generally agreed upon way of doing things among us and what I have seen the people of knowledge doing in our city about the fixed shares of inheritance of children from the mother or father when one or other of them dies is that if they leave male and female children; the male takes the portion of two females. If there are only females; and there are more than two; they get two thirds of what is left between them. If there is only one; she gets a half. If someone shares with the children; who has a fixed share and there are males among them; the reckoner begins with the ones with fixed shares. What remains after that is divided among the children according to their inheritance. When there are no children; grandchildren through sons have the same position as children; so that grandsons are like sons and grand-daughters are like daughters. They inherit as they inherit and they overshadow as they overshadow. If there are both children and grandchildren through sons; and there is a male among the children; then the grandchildren through sons do not share in the inheritance with him. If there is no surviving male among the children; and there are two or more daughters; the granddaughters through a son do not share in the inheritance with them unless there is a male who is in the same position as them in relation to the deceased; or further than them. His presence gives access to whatever is left over; if any; to whoever is in his position and whoever is above him of the granddaughters through sons. If something is left over; they divide it among them; and the male takes the portion of two females. If nothing is left over; they have nothing. If the only descendant is a daughter; she takes half; and if there are one or more grand-daughters through a son who are in the same position to the deceased; they share a sixth. If there is a male in the same position as the granddaughters through a son in relation to the deceased; they have no share and no sixth. If there is a surplus after the allotting of shares to the people with fixed shares; the surplus goes to the male and whoever is in his position and whoever is above him of the female descendants through sons. The male has the share of two females. The one who is more distant in relationship than grandchildren through sons has nothing. If there is no surplus; they have nothing. That is because Allah; the Blessed; the Exalted; said in His Book; Allah charges you about your children that the male has the like of the portion of two females. The inheritance of a wife from a husband who does not leave children or grandchildren through sons is a quarter. If he leaves children or grandchildren through sons; male or female; the wife has an eighth after bequests and debts. That is because Allah; the Blessed; the Exalted! said in His Book; You have a half of what your wives leave if they have no children. If they have children; you have a fourth of what they leave after bequests and debts. They have a fourth of what you leave if you have no children. MuwataMalik-017-001-35137Malik said; The generally agreed on way of doing things among us about which there is no dispute and what I have seen the people of knowledge in our city doing is that when a father inherits from a son or a daughter and the deceased leaves children; or grandchildren through a son; the father has a fixed share of one sixth. If the deceased does leave any children or male grandchildren through a son; the apportioning begins with those with whom the father shares in the fixed shares. They are given their fixed shares. If a sixth or more is left over; the sixth and what is above it is given to the father; and if there is less than a sixth left; the father is given his sixth as a fixed share; i.e. the other shares are adjusted. The inheritance of a mother from her child; if her son or daughter dies and leaves children or male or female grandchildren through a son; or leaves two or more full or half siblings is a sixth. If the deceased does not leave any children or grandchildren through a son; or two or more siblings; the mother has a whole third except in two cases. One of them is if a man dies and leaves a wife and both parents. The wife has a fourth; the mother a third of what remains; which is a fourth of the capital. The other is if a wife dies and leaves a husband and both parents. The husband gets half; and the mother a third of what remains; which is a sixth of the capital. That is because Allah; the Blessed; the Exalted; says in His Book; His two parents each have a sixth of what he leaves if he has children. If he does not have children; and his parents inherit from him; his mother has a third. If he has siblings; the mother has a sixth. Surat 4 ayat 11. MuwataMalik-017-001-35147Yahya related to me from Malik from Zayd Ibn Aslam that Umar Ibn AlKhattab asked the Messenger of Allah; may Allah bless him and grant him peace; about someone who died without parents or offspring; and the Messenger of Allah; may Allah bless him and grant him peace; said to him; The ayat which was sent down in the summer at the end of the Surat AlNisa Surat 4 is enoughfor you. Malik said; The generally agreed on way of doing things among us; in which there is no dispute; and which I saw the people of knowledge in our city doing; is that the person who leaves neither parent or offspring can be of two types. As for the kind described in the ayat which was sent down at the beginning of the Surat AlNisa in which Allah; the Blessed; the Exalted! said; If a man or a woman has no direct heir; but has a brother or a sister by the mother; each of the two has a sixth. If there are more than that; they share equally in a third. Surat 4 ayat 12 This heirless one does not have heirs among his mother siblings since there are no children or parents. As for the other kind described in the ayat which comes at the end of the Surat AlNisa; Allah; the Blessed; the Exalted; said in it; They will ask you for a decision. Say; Allah gives you a decision about the indirect heirs. If a man perishes having no children; but he has a sister; she shall receive a half of what he leaves; and he is her heir if she has no children. If there are two sisters; they shall receive two-thirds of what he leaves. If there are brothers and sisters; the male shall receive the portion of two females. Allah makes clear to you that you might not go astray. Allah has knowledge of everything Surat 4 ayat 176. Malik said; If this person without direct heirs parents or children has siblings by the father; they inherit with the grandfather from the person without direct heirs. The grandfather inherits with the siblings because he is more entitled to the inheritance than them. That is because he inherits a sixth with the male children of the deceased when the siblings do not inherit anything with the male children of the deceased. How can he not be like one of them when he takes a sixth with the children of the deceased? How can he not take a third with the siblings while the brother sons take a third with them? The grandfather is the one who overshadows the half-siblings by the mother and keeps them from inheriting. He is more entitled to what they have because they are omitted for his sake. If the grandfather did not take that third; the half-siblings by the mother would take it and would take what does not return to the half-siblings by the father. MuwataMalik-017-001-35157Yahya related to me from Malik from Rabia Ibn Abi Abdulrahman from more than one of the people of knowledge of that time; that those who were killed on the Day of the Camel; the Day of Siffin; the Day of AlHarra; and the Day of Qudayd did not inherit from each other. None of them inherited anything from his companion unless it was known that he had been killed before his companion. Malik said; That is the way of doing things about which there is no dispute; and which none of the people of knowledge in our city doubt. The procedure with two mutual heirs who are drowned; or killed in another way; when it is not known which of them died first is the same - neither of them inherits anything from his companion. Their inheritance goes to whoever remains of their heirs. They are inherited from by the living. Malik said; No one should inherit from anyone else when there is doubt; and one should only inherit from the other when there is certainty of knowledge and witnesses. That is because a man and his mawla whom his father has freed might die at the same time. The sons of the free man could say; Our father inherited from the mawla. They should not inherit from the mawla without knowledge or testimony that he died first. The living people most entitled to his wala inherit from him. Malik said; Another example is two full brothers who die. One of them has children and the other does not. They have a half-brother by their father. It is not known which of them died first; so the inheritance of the childless one goes to his half-brother by the father. The children of the full-brother get nothing. Malik said; Another example is when a paternal aunt and the son of her brother die; or else the daughter of the brother and her paternal uncle. It is not known which of them died first. MuwataMalik-017-001-35165Yahya related to me from Malik from Hisham Ibn Urwa that his father; Urwa Ibn AlZubair made an aqiqa for his male and female children of a sheep each. Malik said; What we do about the aqiqa is that if someone makes an aqiqa for his children; he gives a sheep for both male and female. The aqiqa is not obligatory but it is desirable to do it; and people continue to come to us about it. If someone makes an aqiqa for his children; the same rules apply as with all sacrificial animals - one-eyed; emaciated; injured; or sick animals must not be used; and neither the meat or the skin is to be sold. The bones are broken and the family eat the meat and give some of it away as sadaqa.
