SahihAlBukhari-017-001-024 | Narrated Kuraib: I was sent to Aisha by Ibn Abbas; AlMiswar Bin Makhrama and Abdulrahman Bin Azhar. They told me to greet her on their behalf and to ask her about the offering of the two rakat after the Asr prayer and to say to her; We were informed that you offer those two rakat and we were told that the Prophet had forbidden offering them. Ibn Abbas said; I along with Umar Bin AlKhattab used to beat the people whenever they offered them. I went to Aisha and told her that message. Aisha said; Go and ask Umm Salamah about them. So I returned and informed them about her statement. They then told me to go to Umm Salamah with the same question with which t sent me to Aisha. Umm Salamah replied; I heard the Prophet ﷺ forbidding them. Later I saw him offering them immediately after he prayed the Asr prayer. He then entered my house at a time when some of the Ansari women from the tribe of Bani Haram were sitting with me; so I sent my slave girl to him having said to her; Stand beside him and tell him that Umm Salamah says to you; O Allah Messenger ﷺ ! I have heard you forbidding the offering of these two rakat after the Asr prayer but I have seen you offering them. If he waves his hand then wait for him. The slave girl did that. The Prophet ﷺ beckoned her with his hand and she waited for him. When he had finished the prayer he said; O daughter of Bani Umaiya! You have asked me about the two rakat after the Asr prayer. The people of the tribe of Abd AlQais came to me and made me busy and I could not offer the two rakat after the Zuhr prayer. SahihAlBukhari-017-001-1174 | Narrated Ibn Umar: A Jew and Jewess were brought to the Prophet ﷺ on a charge of committing an illegal sexual intercourse. The Prophet ﷺ asked the Jews; What do you usually do with them? They said; We blacken their faces and disgrace them. He said; Bring here the Torah and recite it; if you are truthful. They fetched it and came and asked a one-eyed man to recite. He went on reciting till he reached a portion on which he put his hand. The Prophet ﷺ said; Lift up your hand! He lifted his hand up and behold; there appeared the verse of AlRajm stoning of the adulterers to death. Then he said; O Muhammad! They should be stoned to death but we conceal this Divine Law among ourselves. Then the Prophet ﷺ ordered that the two sinners be stoned to death and; and they were stoned to death; and I saw the man protecting the woman from the stones. SahihAlBukhari-017-001-1273 | Narrated Abu Humaid AlSaidi: The Prophet ﷺ appointed a man from the tribe of Bani Asad; called Ibn AlUtabiya to collect the Zakat. When he returned with the money he said to the Prophet ; This is for you and this has been given to me as a gift. The Prophet ﷺ stood up on the pulpit Sufyan said he ascended the pulpit ; and after glorifying and praising Allah; he said; What is wrong with the employee whom we send to collect Zakat from the public that he returns to say; This is for you and that is for me? Why didnt he stay at his father and mother house to see whether he will be given gifts or not? By Him in Whose Hand my life is; whoever takes anything illegally will bring it on the Day of Resurrection by carrying it over his neck: if it is a camel; it will be grunting: if it is a cow; it will be mooing: and if it is a sheep it will be bleating! SahihAlBukhari-017-001-1592 | Narrated Ibn Abbas: I used to teach the Quran to some people of the Muhajirln emigrants ; among whom there was Abdulrahman Bin Auf. While I was in his house at Mina; and he was with Umar Bin AlKhattab during Umar last Hajj; Abdulrahman came to me and said; Would that you had seen the man who came today to the Chief of the Believers Umar ; saying; O Chief of the Believers! What do you think about so-and-so who says; If Umar should die; I will give the pledge of allegiance to such-andsuch person; as by Allah; the pledge of allegiance to Abu Bakr was nothing but a prompt sudden action which got established afterwards. Umar became angry and then said; Allah willing; I will stand before the people tonight and warn them against those people who want to deprive the others of their rights the question of rulership. Abdulrahman said; I said; O Chief of the believers! Do not do that; for the season of Hajj gathers the riff-raff and the rubble; and it will be they who will gather around you when you stand to address the people. And I am afraid that you will get up and say something; and some people will spread your statement and may not say what you have actually said and may not understand its meaning; and may interpret it incorrectly; so you should wait till you reach Medina; as it is the place of emigration and the place of Prophet Traditions; and there you can come in touch with the learned and noble people; and tell them your ideas with confidence; and the learned people will understand your statement and put it in its proper place. On that; Umar said; By Allah! Allah willing; I will do this in the first speech I will deliver before the people in Medina. Ibn Abbas added: We reached Medina by the end of the month of Dhu AlHijja; and when it was Friday; we went quickly to the Masjid as soon as the sun had declined; and I saw Saeed Bin Zaid Bin Amr Bin Nufail sitting at the corner of the pulpit; and I too sat close to him so that my knee was touching his knee; and after a short while Umar Bin AlKhattab came out; and when I saw him coming towards us; I said to Saeed Bin Zaid Bin Amr Bin Nufail Today Umar will say such a thing as he has never said since he was chosen as Caliph. Saeed denied my statement with astonishment and said; What thing do you expect Umar to say the like of which he has never said before? In the meantime; Umar sat on the pulpit and when the callmakers for the prayer had finished their call; Umar stood up; and having glorified and praised Allah as He deserved; he said; Now then; I am going to tell you something which Allah has written for me to say. I do not know; perhaps it portends my death; so whoever understands and remembers it; must narrate it to the others wherever his mount takes him; but if somebody is afraid that he does not understand it; then it is unlawful for him to tell lies about me. Allah sent Muhammad with the Truth and revealed the Holy Book to him; and among what Allah revealed; was the Verse of the Rajam the stoning of married person male & female who commits illegal sexual intercourse; and we did recite this Verse and understood and memorized it. Allah Messenger ﷺ did carry out the punishment of stoning and so did we after him. I am afraid that after a long time has passed; somebody will say; By Allah; we do not find the Verse of the Rajam in Allah Book; and thus they will go astray by leaving an obligation which Allah has revealed. And the punishment of the Rajam is to be inflicted to any married person male & female ; who commits illegal sexual intercourse; if the required evidence is available or there is conception or confession. And then we used to recite among the Verses in Allah Book: O people! Do not claim to be the offspring of other than your fathers; as it is disbelief unthankfulness on your part that you claim to be the offspring of other than your real father. Then Allah Messenger ﷺ said; Do not praise me excessively as Jesus; son of Marry was praised; but call me Allah Slave and His Apostles. O people! I have been informed that a speaker amongst you says; By Allah; if Umar should die; I will give the pledge of allegiance to such-and-such person. One should not deceive oneself by saying that the pledge of allegiance given to Abu Bakr was given suddenly and it was successful. No doubt; it was like that; but Allah saved the people from its evil; and there is none among you who has the qualities of Abu Bakr. Remember that whoever gives the pledge of allegiance to anybody among you without consulting the other Muslims; neither that person; nor the person to whom the pledge of allegiance was given; are to be supported; lest they both should be killed. And no doubt after the death of the Prophet ﷺ we were informed that the Ansar disagreed with us and gathered in the shed of Bani Sada. Ali and AlZubair and whoever was with them; opposed us; while the emigrants gathered with Abu Bakr. I said to Abu Bakr; Let go to these Ansari brothers of ours. So we set out seeking them; and when we approached them; two pious men of theirs met us and informed us of the final decision of the Ansar; and said; O group of Muhajirin emigrants ! Where are you going? We replied; We are going to these Ansari brothers of ours. They said to us; You shouldnt go near them. Carry out whatever we have already decided. I said; By Allah; we will go to them. And so we proceeded until we reached them at the shed of Bani Sada. Behold! There was a man sitting amongst them and wrapped in something. I asked; Who is that man? They said; He is Saad Bin Ubada. I asked; What is wrong with him? They said; He is sick. After we sat for a while; the Ansar speaker said; None has the right to be worshipped but Allah; and praising Allah as He deserved; he added; To proceed; we are Allah Ansar helpers and the majority of the Muslim army; while you; the emigrants; are a small group and some people among you came with the intention of preventing us from practicing this matter of caliphate and depriving us of it. When the speaker had finished; I intended to speak as I had prepared a speech which I liked and which I wanted to deliver in the presence of Abu Bakr; and I used to avoid provoking him. So; when I wanted to speak; Abu Bakr said; Wait a while. I disliked to make him angry. So Abu Bakr himself gave a speech; and he was wiser and more patient than I. By Allah; he never missed a sentence that I liked in my own prepared speech; but he said the like of it or better than it spontaneously. After a pause he said; O Ansar! You deserve all the qualities that you have attributed to yourselves; but this question of Caliphate is only for the Quraish as they are the best of the Arabs as regards descent and home; and I am pleased to suggest that you choose either of these two men; so take the oath of allegiance to either of them as you wish. And then Abu Bakr held my hand and Abu Ubaida Bin AlJarrah hand who was sitting amongst us. I hated nothing of what he had said except that proposal; for by Allah; I would rather have my neck chopped off as expiator for a sin than become the ruler of a nation; one of whose members is Abu Bakr; unless at the time of my death my own-self suggests something I dont feel at present. And then one of the Ansar said; I am the pillar on which the camel with a skin disease eczema rubs itself to satisfy the itching i.e.; I am a noble ; and I am as a high class palm tree! O Quraish. There should be one ruler from us and one from you. Then there was a hue and cry among the gathering and their voices rose so that I was afraid there might be great disagreement; so I said; O Abu Bakr! Hold your hand out. He held his hand out and I pledged allegiance to him; and then all the emigrants gave the Pledge of allegiance and so did the Ansar afterwards. And so we became victorious over Saad Bin Ubada whom AlAnsar wanted to make a ruler. One of the Ansar said; You have killed Saad Bin Ubada. I replied; Allah has killed Saad Bin Ubada. Umar added; By Allah; apart from the great tragedy that had happened to us i.e. the death of the Prophet ; there was no greater problem than the allegiance pledged to Abu Bakr because we were afraid that if we left the people; they might give the Pledge of allegiance after us to one of their men; in which case we would have given them our consent for something against our real wish; or would have opposed them and caused great trouble. Allah Messenger ﷺ would interpret them as Allah wished. I was a young man and used to stay in the Masjid before my wedlock. I said to myself; If there were any good in myself; I too would see what these people see. So when I went to bed one night; I said; O Allah! If you see any good in me; show me a good dream. So while I was in that state; there came to me in a dream two angels. In the hand of each of them; there was a mace of iron; and both of them were taking me to Hell; and I was between them; invoking Allah; O Allah! I seek refuge with You from Hell. Then I saw myself being confronted by another angel holding a mace of iron in his hand. He said to me; Do not be afraid; you will be an excellent man if you only pray more often. So they took me till they stopped me at the edge of Hell; and behold; it was built inside like a well and it had side posts like those of a well; and beside each post there was an angel carrying an iron mace. I saw therein many people hanging upside down with iron chains; and I recognized therein some men from the Quraish. Then the angels took me to the right side. This injustice destroyed those before you that when any one of high rank committed theft among them; they spared him; and when any weak one among them committed theft; they inflicted the prescribed punishment upon him. By Him in Whose Hand is my life; even if Fatima daughter of Muhammad were to commit theft; I would have cut off her hand. He made pronouncement about him and he was stoned to death. The people had been divided into two groups about him Maiz. One of them said: He has been undone for his sins had encompassed him; whereas another said: There is no repentance more excellent than the repentance of Maiz; for he came to Allah Apostle ﷺ and placing his hand in his in the Holy Prophets hand said: Kill me with stones. This controversy about Maiz remained for two or three days. Then came Allah Messenger ﷺ to them his Companions as they were sitting. He greeted them with salutation and then sat down and said: Ask forgiveness for Maiz Bin Malik. They said: May Allah forgive Maiz Bin Malik. Thereupon Allah Messenger ﷺ said: He Maiz has made such a repentance that if that were to be divided among a people; it would have been enough for all of them. He the narrator said: Then a woman of Ghamid; a branch of Azd; came to him and said: Messenger of of Allah; purify me; whereupon he said: Woe be upon you; go back and beg forgiveness from Allah and turn to Him in repentance. She said: I find that you intend to send me back as you sent back Maiz. Bin Malik. He the Holy; Prophet said: What has happened to you? She said that she had become pregnant as a result of fornication. He the Holy Prophet said: Is it you who has done that ? She said: Yes. He the Holy Prophet said to her: You will not be punished until you deliver what is there in your womb. One of the Ansar became responsible for her until she was delivered of the child. He that Ansari came to Allah Apostle ﷺ and said the woman of Ghamid has given birth to a child. He the Holy Prophet said: In that case we shall not stone her and so leave her infant with none to suckle him. One of the Ansar got up and said: Allah Apostle; let the responsibility of his suckling be upon me. SahihMuslim-017-001-17390 | Abdullah Bin Umar reported that a Jew and a Jewess were brought to Allah Messenger ﷺ who had committed adultery. They said: We darken their faces and make them ride on the donkey with their faces turned to the opposite direction and their backs touching each other ; and then they are taken round the city. He said: Bring Torah if you are truthful. They brought it and recited it until when they came to the verse pertaining to stoning; the person who was reading placed his hand on the verse pertaining to stoning; and read only that which was between his hands and what was subsequent to that. Abdullah Bin Salim who was at that time with the Messenger of Allah ﷺ said: Command him the reciter to lift his hand. He lifted it and there was; underneath that; the verse pertaining to stoning. SahihMuslim-017-001-17486 | Abdullah Bin Abbas reported that Khalid Bin Walid who is called the Sword of Allah had informed him that he visited Maimuna; the wife of Allah Apostle ﷺ ; in the company of Allah Messenger ﷺ ; and she was the sister of his mother that of Khalid and that of Ibn Abbas; and he found with her a roasted lizard which her sister Hufaida the daughter of AlHarith had brought from Najd; and she presented that lizard to Allah Messenger ﷺ. It was rare that some food was presented to the Prophet ﷺ and it was not mentioned or named. While Allah Messenger ﷺ was about to stretch forth his hand towards the lizard; a woman from amongst the women present there informed the Messenger of Allah ﷺ what they had presented to him. They said: Messenger of Allah; it is a lizard. Allah Messenger ﷺ withdrew his hand; whereupon Khalid Bin Walid said: Messenger of Allah; is a lizard forbidden? There opon he said: No; but it is not found in the land of my people; and I feel that I have no liking for it. SahihMuslim-017-001-17703 | It has been reported on the authority of Abu Mousa who said: I went to the Prophet ﷺ and with me were two men from the Ashari tribe. One of them was on my right hand and the other on my left. Both of them made a request for a position of authority while the Prophet ﷺ was brushing his teeth with a tooth-stick. He said to me : Abu Mousa or Abdullah Bin Qais ; what do you say about the request they have made ? I said: By God Who sent thee on thy mission with truth; they did not disclose to me what they had in their minds; and I did not know that they would ask for a position. The narrator says while recalling this hadith : I visualise as if I were looking at the miswak of the Prophet ﷺ between his lips. He the Holy Prophet said: We shall not or shall never appoint to the public offices in our State those who with to have them; but you may go; Abu Mousa or Abdullah Bin Qais to take up your assignment. He sent him to Yemen as governor. then he sent Muadh Bin jabal in his wake to help him in the discharge of duties. When Muadh reached the camp of Abu Mousa; the latter received him and said: Please get yourself down; and he spread for him a mattress; while there was a man bound hand and foot as a prisoner. Muadh said: Who is this? Abu Mousa said: He was a Jew. He embraced Islam. Then he reverted to his false religion and became a Jew. Muadh said: I wont sit until he is killed according to the decree of Allah and His Apostle ﷺ in this case. Abu Mousa said: Be seated. It will be done. He said: I wont sit unless he is killed in accordance with the decree of Allah and His Apostle ﷺ. He repeated these words thrice. Then Abu Mousa ordered him to be killed and he was kilied. Then the two talked of standing in prayer at night. One of them; i. e. SahihMuslim-017-001-17759 | It has been narrated on the authority of Abdulrahman Bin Abd Rabb AlKaba who said: I entered the Masjid when Abdullah Bin Amr Bin AlAs was sitting in the shade of the Kaba and the people had gathered around him. I betook myself to them and sat near him. Now Abdullah said: I accompanied the Messenger of Allah ﷺ on a journey. We halted at a place. Some of us began to set right their tents; others began to compete with one another in shooting; and others began to graze their beasts; when an announcer of the Messenger of Allah ﷺ announced that the people should gather together for prayer; so we gathered around the Messenger of Allah ﷺ. He said: It was the duty of every Prophet that has gone before me to guide his followers to what he knew was good for them and warn them against what he knew was bad for them; but this Umma of yours has its days of peace and security in the beginning of its career; and in the last phase of its existence it will be afflicted with trials and with things disagreeable to you. In this phase of the Umma ; there will be tremendous trials one after the other; each making the previous one dwindle into insignificance. When they would be afflicted with a trial; the believer would say: This is going to bring about my destruction. When at the trial is over; they would be afflicted with another trial; and the believer would say: This surely is going to be my end. Whoever wishes to be delivered from the fire and enter the garden should die with faith in Allah and the Last Day and should treat the people as he wishes to be treated by them. He who swears allegiance to a Caliph should give him the piedge of his hand and the sincerity of his heart i. e. submit to him both outwardly as well as inwardly. He should obey him to the best of his capacity. It another man comes forward as a claimant to Caliphate ; disputing his authority; they the Muslims should behead the latter. The narrator says: I came close to him Abdullah Bin Amr Bin AlAs and said to him: Can you say on oath that you heard it from the Messenger of Allah ﷺ ? He said to his followers: One who has married a woman and wants to consummate to his marriage but has not yet done so; another who has built a house but has not yet erected its roof; and another who has bought goats and pregnantshe-camels and is waiting for their offspring-will not accommpany me. I wished I were between stronger persons. One of them made a sign to me and. said: Uncle; do you recognise Abu Jahl? 1 said: Yes. What do you want to do with him; O my nephew? He said: I have been told that he abuses the Messenger of Allah ﷺ. By Allah; in Whose Hand is my life; if I see him I will grapple with him and will not leave him until one of us who is destined to die earlier is killed. The narrator said: I wondered at this. Then the other made a sign to me and said similar words. Soon after I saw Abu Jahl. He was moving about among men. I said to the two boys: Dont you see? He is the man you were inquiring about. As soon as they heard this ; they dashed towards him; struck him with their swords until he was killed. Then they returned to the Messenger of Allah ﷺ and informed him to this effect. He asked: Which of you has killed him? Each one of them said: I have killed him. He said: Have you wiped your swords? They said: No. He examined their swords and said: Both of you have killed him. He then decided that the belongings of Abu Jahl he handed over to Muadh Bin Amr Bin AlJamuh. Verily the earthquake of the hour is a terrible thing... up to His saying: but Allah torment is severe 21:1 & 2. When his Companions heard that; they hastened to catch up with him; since they knew that he had something to say. He ﷺ said: Do you know what Day this is? That is the Day when Adam will be called. His Lord will call him and say: O Adam; send forth those who are to be sent to the Fire. He will say: O Lord! How many are to be sent to the Fire? He will say: From every one-thousand there are nine-hundred and ninety-nine for the Fire and one for Paradise. So the people despaired as if they would not smile again. He replied: Yes; a piece of cloth; a part of which we wear and a part of which we spread on the ground ; and a wooden bowl from which we drink water. He said: Bring them to me. He then brought these articles to him and he the Prophet took them in his hands and asked: Who will buy these? A man said: I shall buy them for one dirham. He said twice or thrice: Who will offer more than one dirham? A man said: I shall buy them for two dirhams. He gave these to him and took the two dirhams and; giving them to the Ansari; he said: Buy food with one of them and hand it to your family; and buy an axe and bring it to me. He then brought it to him. The Messenger of Allah ﷺ fixed a handle on it with his own hands and said: Go; gather firewood and sell it; and do not let me see you for a fortnight. The man went away and gathered firewood and sold it. When he had earned ten dirhams; he came to him and bought a garment with some of them and food with the others. The Messenger of Allah ﷺ then said: This is better for you than that begging should come as a spot on your face on the Day of Judgment. Aisha said: The Messenger of Allah ﷺ ; when the rim of the sun appeared; sat down on the pulpit; and having pronounced the greatness of Allah and expressed His praise; he said: You have complained of drought in your homes; and of the delay in receiving rain at the beginning of its season. Allah has ordered you to supplicate Him has and promised that He will answer your prayer. Then he said: Praise be to Allah; the Lord of the Universe; the Compassionate; the Merciful; the Master of the Day of Judgment. There is no god but Allah Who does what He wishes. O Allah; Thou art Allah; there is no deity but Thou; the Rich; while we are the poor. Send down the rain upon us and make what Thou sendest down a strength and satisfaction for a time. He then raised his hands; and kept raising them till the whiteness under his armpits was visible. He then turned his back to the people and inverted or turned round his cloak while keeping his hands aloft. He then faced the people; descended and prayed two rakahs. Allah then produced a cloud; and the storm of thunder and lightning came on. Then the rain fell by Allah permission; and before he reached his Masjid streams were flowing. Abdullah Bin Abbas then sent him Abdullah Bin Hunain to Abu Ayoub AlAnsari. SunanAbuDawoud-017-001-25570 | Jafar Bin Muhammad reported on the authority of his father We entered upon Jabir Bin Abd Allaah. When we reached him; he asked about the people who had come to visit him. When my turn came I said I am Muhammad Bin Ali Bin Hussain. He patted my head with his hand and undid my upper then lower buttons. He then placed his hand between my nipples and in those days I was a young boy. He then said welcome to you my nephew; ask what you like. I questioned him he was blind. The time of prayer came and he stood wrapped in a mantle. Whenever he placed it on his shoulders its ends fell due to its shortness. He led us in prayer while his mantle was placed on a rack by his side. I said tell me about the Hajj of the Apostle of Allaah ﷺ.He signed with his hand and folded his fingers indicating nine. He then said Apostle of Allaah ﷺ remained nine years at Madeenah during which he did not perform Hajj; then made a public announcement in the tenth year to the effect that the Apostle of Allaah ﷺ was about to go to perform Hajj. A large number of people came to Madeenah everyone desiring to follow him and act like him. The Apostle of Allaah ﷺ went out and we too went out with him till we reached Dhu AlHulaifa. Asma daughter of Umais gave birth to Muhammad Bin Abi Bakr. She sent message to Apostle of Allaah ﷺ asking him What should I do?He replied take a bath; bandage your private parts with a cloth and put on ihram. The Apostle of Allaah ﷺ then prayed in the masjid and mounted AlQaswa and his she Camel stood erect with him on its back. Jabir said I saw a large number of people on mounts and on foot in front of him and a similar number on his right side and a similar number on his left side and a similar number behind him. The Apostle of Allaah ﷺ was among us; the Quran was being revealed to him and he knew its interpretation. Whatever he did; we did it. The Apostle of Allaah ﷺ then raised his voice declaring Allaahs unity and saying Labbaik I am at thy service ; O Allaah; labbaik; labbaik; Thou hast no partner praise and grace are Thine and the Dominion. Thou hast no partner. The people too raised their voices in talbiyah which they used to utter. But the Apostle of Allaah ﷺ did not forbid them anything. The Apostle of Allaah ﷺ continued his talbiyah. Jabir said We did not express our intention of performing anything but Hajj; being unaware of Umrah at that season ; but when we came with him to the House the Kabah ; he touched the corner and made seven circuits walking quickly with pride in three of them and walking ordinarily in four. Then going forward to the station of Abraham he recited And take the station of Abraham as a place of prayer. While praying two rakahs he kept the station between him and the House. The narrator said My father said that Ibn Nufail and Uthman said I do not know that he Jabir narrated it from anyone except the Prophet ﷺ. The narrator Sulaiman said I do not know but he Jabir said The Apostle of Allaah ﷺ used to recite in the two rakahs Say; He is Allaah; one and Say O infidels. He then returned to the House the kabah and touched the corner after which he went out by the gate to AlSafa. When he reached near AlSafa he recited AlSafa and AlMarwah are among the indications of Allaah and he added We begin with what Allaah began with. He then began with AlSafa and mounting it till he could see the House the Kabah he declared the greatness of Allaah and proclaimed his Unity. He then said there is no god but Allaah alone; Who alone has fulfilled His promise; helped His servant and routed the confederates. He then made supplication in the course of that saying such words three times. He then descended and walked towards AlMarwah and when his feet came down into the bottom of the valley; he ran; and when he began to ascend he walked till he reached AlMarwah. He did at AlMarwah as he had done at AlSafa and when he came to AlMarwah for the last time; he said If I had known before what I have come to know afterwards regarding this matter of mine; I would not have brought sacrificial animals but made it an Umrah; so if any of you has no sacrificial animals; he may take off ihram and treat it as an Umrah. All the people then took off ihram and clipped their hair except the Prophet ﷺ and those who had brought sacrificial animals. Suraqah bin Malik Bin Jusham then got up and asked Apostle of Allaah ﷺ does this apply to the present year or does it apply for ever? The Apostle of Allaah ﷺ interwined his fingers and said The Umarh has been incorporated in Hajj. Adding No; but forever and ever. Ali came from Yemen with the sacrificial animals of the Apostle of Allaah ﷺ and found Fathima among one of those who had taken off their ihram. She said put on colored clothes and stained her eyes with collyrium. Ali disliked this action of her and asked Who commanded you for this? She said My father. Jabir said Ali said at Iraq I went to Apostle of Allaah ﷺ to complain against Fathima for what she had done and to ask the opinion of Apostle of Allaah ﷺ about which she mentioned to me. I informed him that I disliked her action and that thereupon she said to me My father commanded me to do this. He said She spoke the truth; she spoke the truth. What did you say when you put on ihram for Hajj? I said O Allaah; I put on ihram for the same purpose for which Apostle of Allaah ﷺ has put it on. He said I have sacrificial animals with me; so do not take off ihram. He Jabir said The total of those sacrificial animals brought by Ali from Yemen and of those brought by the Prophet ﷺ from Madeenah was one hundred. Then all the people except the Prophet ﷺ and those who had with them the sacrificial animals took off ihram and clipped their hair. When the 8th of Dhu AlHijja Yaum AlTarwiyah came; they went towards Mina having pit on ihram for Hajj and the Apostle of Allaah ﷺ rode and prayed at Mina the noon; afternoon; sunset; night and dawn prayers. After that he waited a little till the sun rose and gave orders for a tent of hair to be set up at Namrah. The Apostle of Allaah ﷺ then sent out and the Quraish did not doubt that he would halt at AlMash ar AlHaram at AlMuzdalifah; as the Quraish used to do in the pre Islamic period but he passed on till he came to Arafat and found that the tent had been setup at Namrah. There he dismounted and when the sun had passed the meridian he ordered AlQaswa to be brought and when it was saddled for him; he went down to the bottom of the valley and addressed the people saying Your lives and your property must be respected by one another like the sacredness of this day of yours in the month of yours in this town of yours. Lo! Everything pertaining to the pre Islamic period has been put under my feet and claims for blood vengeance belonging to the pre Islamic period have been abolished. The first of those murdered among us whose blood vengeance I permit is the blood vengeance of ours according to the version of the narrator Uthman; the blood vengeance of the son of Rabiah and according to the version of the narrator Sulaiman the blood vengeance of the son of Rabiah Bin AlHarith Bin Abd AlMuttalib. Some scholars said he was suckled among Banu Sad i.e.; he was brought up among Bani Sad and then killed by Hudhail. The usury of the pre Islamic period is abolished and the first of usury I abolish is our usury; the usury of Abbas Bin Abd AlMuttalib for it is all abolished. Fear Allaah regarding women for you have got them under Allahs security and have the right to intercourse with them by Allaahs word. It is a duty from you on them not to allow anyone whom you dislike to lie on your beds but if they do beat them; but not severely. You are responsible for providing them with food and clothing in a fitting manner. I have left among you something by which if you hold to it you will never again go astray; that is Allaahs Book. You will be asked about me; so what will you say? They replied We testify that you have conveyed and fulfilled the message and given counsel. Then raising his forefinger towards the sky and pointing it at the people; he said O Allaah! Be witness; O Allaah! Be witness; O Allaah! Be witness! Bilal then uttered the call to prayer and the iqamah and he prayed the noon prayer; he then uttered the iqamah and he prayed the afternoon prayer; engaging in no prayer between the two. He then mounted his she Camel AlQaswa and came to the place of standing ; making his she Camel AlQaswa turn its back to the rocks and having the path taken by those who went on foot in front of him and he faced the qiblah. He remained standing till sunset when the yellow light had somewhat gone and the disc of the sun had disappeared. He took Usamah up behind him and picked the reins of AlQaswa severely so much so that its head was touching the front part of the saddle. Pointing with is right hand he was saying Calmness; O People! Calmness; O people. Whenever he came over a mound of sand he let loose its reins a little so that it could ascend. He then came to AlMuzdalifah where he combined the sunset and night prayers; with one adhan and two iqamahs. The narrator Uthamn said He did not offer supererogatory prayers between them. The narrators are then agreed upon the version He then lay down till dawn and prayed the dawn prayer when the morning light was clear. The narrator Sulaiman said with one adhan and one iqamah. The narrators are then agreed upon the version He then mounted AlQaswa and came to AlMashar AlHaram and ascended it. The narrators Uthaman and Sulaiman said He faced the qiblah praised Allaah; declared His greatness; His uniqueness. Uthamn added in his version and His Unity and kept standing till the day was very clear. The Apostle of Allaah ﷺ then went quickly before the sun rose ; taking AlFadl Bin Abbas behind him. He was a man having beautiful hair; white and handsome color. When the Apostle of Allaah ﷺ went quickly; the women in the howdas also began to pass him quickly. AlFadl began to look at them. The Apostle of Allaah ﷺ placed his hand on the face of AlFadl ; but Alfadl turned his face towards the other side. The Apostle of Allaah ﷺ also turned away his hand to the other side. AlFadl also turned his face to the other side looking at them till he came to the Valley of Muhassir. He urged the Camel a little and following a middle road which comes out at the greatest jamrah; he came to the jamrah which is beside the tree and he threw seven small pebbles at this jamrah saying Allah is most great each time he threw a pebble like bean seeds. He threw them from the bottom of the valley. The Apostle of Allaah ﷺ then went to the place of the sacrifice and sacrificed sixty three Camels with his own hand. He then commanded Ali who sacrificed the remainder and he shared him and his sacrificial animals. After that he ordered that a piece of flesh from each Camel should be put in a pot and when it was cooked the two of them ate some of it and drank some of its broth. The narrator Sulaiman said the he mounted afterwards the Apostle of Allaah ﷺ went quickly to the House the Kabah and prayed the noon prayer at Makkah. He came to Banu Abd AlMuttalib who were supplying water at Zamzam and said draw water Banu Abd AlMuttalib were it not that people would take from you the right to draw water; I would draw it along with you. A group of his companions also ate with him. The Messenger of Allah ﷺ then said: Take your hands away from the food. The Messenger of Allah ﷺ then sent someone to the Jewess and he called her. He said to her: Have you poisoned this sheep? The Jewess replied: Who has informed you? He said: This foreleg which I have in my hand has informed me. She said: Yes. She sent a figured cloak with the two mawlas which was sewn up in a piece of green cloth. Amra continued; The slave took it and unstitched it and took out the cloak. In its place; he put some felt or skin and sewed it up again. When the mawla girls came to Madina; they gave it to his people. When they opened it; they found felt in it and did not find the cloak. They spoke to the two women and they spoke to Aisha; the wife of the Prophet; may Allah bless him and grant him peace; or they wrote to her and suspected the slave. The slave was asked about it and confessed. Aisha; the wife of the Prophet; may Allah bless him and grant him peace; gave the order and his hand was cut off. Aisha said; A thief hand is cut off for a quarter of a dinar and upwards. Malik said; The limit I prefer above which cutting off the hand is obliged is three dirhams; whether the exchange is high or low. That is because the Messenger of Allah; may Allah bless him and grant him peace; cut off the hand of a thief for a shield whose value was three dirhams; and Uthman Ibn Affan cut off the hand of a thief for a citron which was estimated at three dirhams. Umar Ibn Abd AlAziz wrote to contradict my letter; You wrote to me that you have heard that when the runaway slave steals; his hand is not cut off. Allah; the Blessed; the Exalted; says in His Book; The thief; male and female; cut off the hands of both; as a recompense for what they have earned; and an exemplary punishment from Allah. MuwataMalik-017-001-34798 | Yahya related to me from Malik from Abdulrahman Ibn AlQasim from his father that a man from Yemen who had his hand and foot cut off came and went before Abu Bakr AlSiddiq and complained to him that the governor of the Yemen had wronged him; and the man used to pray part of the night. Abu Bakr said; By your father; your night is not the night of a thief. Then they missed a necklace of Asma bint Umays; the wife of Abu Bakr AlSiddiq. The man came to go around with them looking for it. He said; O Allah! You are responsible for the one who invaded the people of this good house by night! They found the jewelry with a goldsmith. He claimed that the maimed man had brought it to him. The maimed man confessed or it was testified against him. Abu Bakr AlSiddiq ordered that his left hand be cut off. Abu Bakr said; By Allah! His dua against himself is more serious; as far as I am concerned; than his theft. Yahya said that Malik said; What is done among us about the person who steals several times and is then called to reckoning; is that only his hand is cut off for all he stole when the hadd has not been applied againsthim. MuwataMalik-017-001-34799 | Yahya related to me from Malik that Abuz-Zinad informed him that a governor of Umar Ibn Abd AlAziz took some people in battle and had not killed any of them. He wanted to cut off their hands or kill them; so he wrote to Umar Ibn Abd AlAziz about that Umar Ibn Abd AlAziz wrote to him; Better to take less than that. Yahya said that he heard Malik say; What is done among us about a person who steals the goods of people which are placed under guard in the markets; and their owners put them in their containers and store them together is that if anyone steals any of that from where it is kept; and its value reaches that for which cutting off the hand is obliged; his hand must be cut off; whether or not the owner of the goods is with his goods and whether it is night or day. Malik said about some one who stole something for which cutting off the hand was obliged and then what he stole was found with him and he returned it to its owner; His hand is cut off. Malik said; If someon says; How can his hand be cut off when the goods have been taken from him and returned to their owner?; it is because he is in the same position as the wine drinker when the smell of the wine is found on his breath and he is not drunk. He is flogged with the hadd. The hadd is imposed for drinking wine even if it does not make the man intoxicated. That is because he drank it to become intoxicated. It is the same as that with cutting off the hand of the thief for theft when it is taken from him; even if he has not profited from it and it was returned to its owner. When he stole it; he stole it to take it away. Malik said that if some people came to a house and robbed it together; and then they left with a sack or box or a board or basket or the like of that which they carried together; and when they took it out of its guarded place; they carried it together; and the price of what they took reached that for which cutting off the hand was obliged; and that was three dirhams and upwards; each of them had his hand cut off. If each of them takes out something by himself; whoever of them takes out something whose value reaches three dirhams and upwards must have his hand cut off. If any of them takes out something whose value does not reach three dirhams; he does not have his hand cut off. Yahya said that Malik said; What is done among us is that when a man house is locked and he is the only one living in it; cutting off the hand is not obliged against the one who steals something from it until he takes it out of the house completely. That is because all of the house is a place of custody. If someone other than him lives in the house and each of them locks his door; and it is a place of custody for each of them; whoever steals anything from the apartments of that house must have his hand cut off when he leaves the apartment and goes into the main house. He has removed it from its place of custody to another place and he must have his hand cut off. Malik said; What is done in our community about a slave who steals from the property of his master is that if he is not in service and among those trusted in the house and he enters secretly and steals from his master something that for which cutting off the hand is obliged; his hand is not cut off. It is like that with a slave-girl when she steals from her master property. Her hand is not cut off. Malik then spoke about a slave who was not in service and not one of those trusted in the house; and he entered secretly and stole from the property of his master wife that for which cutting off the hand was obliged. He said; His hand is cut off. It is like that with the wife slave-girl when she does not serve her or her husband nor is she trusted in the house and she enters secretly and steals from her mistress property that for which cutting off the hand is obliged. Her hand is not cut off. It is like that with the wife slave-girl who is not in her service and is not trusted in the house and she enters secretly and steals from the property of her mistress husband something for which cutting off the hand is obliged. Her hand is cut off. It is like that with the man who steals from his wife goods or the wife who steals from her husband goods something for which cutting off the hand is obliged. If the thing which one of them steals from his spouse property is in a room other than the room which they both lock for themselves; or it is in a place of custody in a room other than the room which they are in; whichever of them steals something for which cutting off the hand is obliged; their hand should be cut off. Malik spoke about a small child and a foreigner who does not speak clearly. He said; If they are robbed of something from its place of custody or from under a lock; the one who stole it has his hand cut off. If the property is outside of its place of custody or locked room when it is stolen ; the one who robbed them does not have his hand cut off. It is then in the position of sheep stolen from the mountain and uncut fruit hanging on the trees Malik said; What is done among us about a person who robs graves is that if what he takes from the grave reaches what cutting off the hand is obliged for; his hand is cut off. That is because the grave is a place of custody for what is in it just as houses are a place of custody for what is in them. MuwataMalik-017-001-34800 | Yahya related to me from Malik from Yahya Ibn Said from Muhammad Ibn Yahya Ibn Habban that a slave stole a small palm from a man garden and planted it in the garden of his master. The owner of the palm went out looking for the palm and found it. He asked for help against the slave from Marwan Ibn AlHakam. Marwan jailed the slave and wanted to cut off his hand. The master of the slave rushed off to Rafi Ibn Khadij and asked him about it. Rafi informed him that he heard the Messenger of Allah; may Allah bless him and grant him peace; say; The hand is not cut off for fruit or palm pith. The man said; Marwan Ibn AlHakam has taken a slave of mine and wants to cut off his hand. I would like you to go with me to him so you can tell him what you heard from the Messenger of Allah; may Allah bless him and grant him peace. So; Rafi went with him to Marwan Ibn AlHakam. He said; Did you arrest a slave for this? He said; Yes. He said; What will you do with him? He said; I want to cut off his hand. Rafi said to him; I heard the Messenger of Allah; may Allah bless him and grant him peace; say; The hand is not cut off for dates or palm pith. He has stolen. Umar said to him; What did he steal? He said; He stole a mirror belonging to my wife. Its value was sixty dirhams. Umar said; Let him go. His hand is not to be cut off.
