SahihAlBukhari-017-001-1137 | Narrated Abu Huraira: Allah Messenger ﷺ said; A man who never did any good deed; said that if he died; his family should burn him and throw half the ashes of his burnt body in the earth and the other half in the sea; for by Allah; if Allah should get hold of him; He would inflict such punishment on him as He would not inflict on anybody among the people. But Allah ordered the sea to collect what was in it of his ashes and similarly ordered the earth to collect what was in it of his ashes. Then Allah said to the recreated man ; Why did you do so? The man replied; For being afraid of You; and You know it very well. So Allah forgave him. | The Chapter on Funerals And Torture In The Grave in HodHood Indexing, Chapter on They want to change Allahs Words in Sahih AlBukhari
SahihAlBukhari-017-001-1587 | Narrated Anas Bin Malik: While I was with the Prophet ﷺ a man came and said; O Allah Messenger ﷺ ! I have committed a legally punishable sin; please inflict the legal punishment on me. The Prophet ﷺ did not ask him what he had done. Then the time for the prayer became due and the man offered prayer along with the Prophet ﷺ ; and when the Prophet ﷺ had finished his prayer; the man again got up and said; O Allah Messenger ﷺ ! I have committed a legally punishable sin; please inflict the punishment on me according to Allah Laws. The Prophet ﷺ said; Havent you prayed with us? He said; Yes. The Prophet ﷺ said; Allah has forgiven your sin. or said;....your legally punishable sin. | The Chapter on Fornication And Adultery Punishment And Forgiveness in HodHood Indexing, Chapter on If a person confesses but does not specify the sin can the ruler screen it for him in Sahih AlBukhari
SahihAlBukhari-017-001-6867 | Narrated Ibn Abbas: Abu Sufyan narrated to me personally; saying; I set out during the Truce that had been concluded between me and Allah Messenger ﷺ. While I was in Sham; a letter sent by the Prophet ﷺ was brought to Heraclius. Dihya AlKalbi had brought and given it to the governor of Busra; and the latter forwarded it to Heraclius. Heraclius said; Is there anyone from the people of this man who claims to be a prophet? The people replied; Yes. So I along with some of Quraishi men were called and we entered upon Heraclius; and we were seated in front of him. Then he said; Who amongst you is the nearest relative to the man who claims to be a prophet? So they made me sit in front of him and made my companions sit behind me. Then he called upon his translator and said to him. Tell them i.e. Abu Sufyan companions that I am going to ask him i.e. Abu Sufyan regarding that man who claims to be a prophet. So; if he tell me a lie; they should contradict him instantly. By Allah; had I not been afraid that my companions would consider me a liar; I would have told lies. Heraclius then said to his translator; Ask him: What is his i.e. the Prophets family status amongst you? I said; He belongs to a noble family amongst us. Heraclius said; Was any of his ancestors a king? I said; No. He said; Did you ever accuse him of telling lies before his saying what he has said? I said; No. He said; Do the nobles follow him or the poor people? I said; It is the poor who followed him. He said; Is the number of his follower increasing or decreasing? I said; The are increasing. He said; Does anyone renounce his religion i.e. Islam after embracing it; being displeased with it? I said; No. He said; Did you fight with him? I replied; Yes. He said; How was your fighting with him? I said; The fighting between us was undecided and victory was shared by him and us by turns. He inflicts casualties upon us and we inflict casualties upon him. He said; Did he ever betray? I said; No; but now we are away from him in this truce and we do not know what he will do in it Abu Sufyan added; By Allah; I was not able to insert in my speech a word against him except that. Heraclius said; Did anybody else amongst you ever claimed the same i.e. Islam before him? I said; No. Then Heraclius told his translator to tell me i.e. Abu Sufyan ; I asked you about his family status amongst you; and you told me that he comes from a noble family amongst you Verily; all Apostles come from the noblest family among their people. Then I asked you whether any of his ancestors was a king; and you denied that. Thereupon I thought that had one of his fore-fathers been a king; I would have said that he i.e. Muhammad was seeking to rule the kingdom of his fore-fathers. Then I asked you regarding his followers; whether they were the noble or the poor among the people; and you said that they were only the poor who follow him. In fact; such are the followers of the Apostles. Then I asked you whether you have ever accused him of telling lies before saying what he said; and your reply was in the negative. Therefore; I took for granted that a man who did not tell a lie about others; could ever tell a lie about Allah. Then I asked you whether anyone of his followers had renounced his religion i.e. Islam after embracing it; being displeased with it; and you denied that. And such is Faith when it mixes with the cheerfulness of the hearts. Then I asked you whether his followers were increasing or decreasing. You claimed that they were increasing. That is the way of true faith till it is complete. Then I asked you whether you had ever fought with him; and you claimed that you had fought with him and the battle between you and him was undecided and the victory was shared by you and him in turns; he inflicted casual ties upon you and you inflicted casualties upon them. Such is the case with the Apostles; they are out to test and the final victory is for them. Then I asked you whether he had ever betrayed; you claimed that he had never betrayed. I need; Apostles never betray. Then I asked you whether anyone had said this statement before him; and you denied that. Thereupon I thought if somebody had said that statement before him; then I would have said that he was but a man copying some sayings said before him. Abu Safyan said; Heraclius then asked me; What does he order you to do? I said; He orders us to offer prayers and to pay Zakat and to keep good relationship with the Kith and kin and to be chaste. Then Heraclius said; If whatever you have said; is true; he is really a prophet; and I knew that he i.e. the Prophet ﷺ was going to appear; but I never thought that he would be from amongst you. If I were certain that I can reach him; I would like to meet him and if I were with him; I would wash his feet; and his kingdom will expand surely to what is under my feet. Then Heraclius asked for the letter of Allah Messenger ﷺ and read it wherein was written: In the Name of Allah; the Most Beneficent; the Most Merciful. This letter is from Muhammad; Apostle of Allah; to Heraclius; the sovereign of Byzantine........ ﷺ who follows the Right Path. Now then; I call you to embrace Islam. Embrace Islam and you will be saved from Allah Punishment ; embrace Islam; and Allah will give you a double reward; but if you reject this; you will be responsible for the sins of all the people of your kingdom Allah Statement :-O the people of the Scripture Jews and Christians ! Come to a word common to you and us that we worship None but Allah....bear witness that we are Muslims. 3.64 When he finished reading the letter; voices grew louder near him and there was a great hue and cry; and we were ordered to go out. Abu Sufyan added; While coming out; I said to my companions; The situation of Ibn Abu Kabsha i.e. Muhammad has become strong; even the king of Banu Al14 Asfar is afraid of him. So I continued to believe that Allah Messenger ﷺ would be victorious; till Allah made me embrace Islam. AlZuhri said; Heraclius then invited all the chiefs of the Byzantines and had them assembled in his house and said; O group of Byzantines! Do you wish to have a permanent success and guidance and that your kingdom should remain with you? Immediately after hearing that ; they rushed towards the gate like onagers; but they found them closed. Heraclius then said; Bring them back to me. So he called them and said; I just wanted to test the strength of your adherence to your religion. Now I have observed of you that which I like. Then the people fell in prostration before him and became pleased with him. SunanAbuDawoud-017-001-26615 | Narrated Nuaym Ibn Huzzal: Yazid Ibn Nuaym Ibn Huzzal; on his father authority said: Maiz Ibn Malik was an orphan under the protection of my father. He had illegal sexual intercourse with a slave-girl belonging to a clan. My father said to him: Go to the Messenger of Allah ﷺ and inform him of what you have done; for he may perhaps ask Allah for your forgiveness. His purpose in that was simply a hope that it might be a way of escape for him. So he went to him and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. He the Prophet turned away from him; so he came back and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. He again turned away from him; so he came back and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. When he uttered it four times; the Messenger of Allah ﷺ said: You have said it four times. With whom did you commit it? He replied: With so and so. He asked: Did you lie down with her? He replied: Yes. He asked: Had your skin been in contact with hers? He replied. Yes. He asked: Did you have intercourse with her? He said: Yes. So he the Prophet gave orders that he should be stoned to death. He was then taken out to the Harrah; and while he was being stoned he felt the effect of the stones and could not bear it and fled. But Abdullah Ibn Unays encountered him when those who had been stoning him could not catch up with him. He threw the bone of a camel foreleg at him; which hit him and killed him. They then went to the Prophet ﷺ and reported it to him. He said: Why did you not leave him alone. So I came to him and he said: Have you finished inflicting punishment on her ? I said: I went to her while her blood was flowing. He said: Leave her alone till her bleeding stops; then inflict the prescribed punishment on her. And inflict the prescribed punishment on those whom your right hands possess i.e. slaves.Abu Dawud said: A similar tradition has been transmitted by Abu AlAhwas from Abd AlAla; and also by Shubah from Abd AlAla. Uthman said: He could not vomit it; unless he did not drink it. He said to Ali: Inflict the prescribed punishment on him. Ali said to AlHasan: Inflict the prescribed punishment on him. AlHasan said: He who has enjoyed its pleasure should also bear its burden. So Ali said to Abdullah Ibn Jafar: Inflict the prescribed punishment on him. He took a whip and struck him with it while Ali was counting. When he reached struck forty lashes ; he said: It is sufficient. The Prophet ﷺ gave forty lashes. MuwataMalik-017-001-34783 | Malik said; The position with us about a woman who is found to be pregnant and has no husband and she says; I was forced; or she says; I was married; is that it is not accepted from her and the hadd is inflicted on her unless she has a clear proof of what she claims about the marriage or that she was forced or she comes bleeding if she was a virgin or she calls out for help so that someone comes to her and she is in that state or what resembles it of the situation in which the violation occurred. He said; If she does not produce any of those; the hadd is inflicted on her and what she claims of that is not accepted from her. Malik said; A raped woman cannot marry until she has restored herself by three menstrual periods. He said; If she doubts her periods; she does not marry until she has freed herself of that doubt. | The Chapter on Writing Oaths And Pledges in HodHood Indexing, The Book of Sadaqa in Muwata Malik
MuwataMalik-017-001-34883 | Yahya said that Malik said; The generally agreed on way of doing things in our community is that retaliation is taken from someone who breaks someone hand or foot intentionally and not blood-money. Malik said; Retaliation is not inflicted on anyone until the wound of the injured party has healed. Then retaliation is inflicted on him. If the wound of the person on whom the retaliation has been inflicted is like the first person wound when it heals; it is retaliation. If the wound of the one on whom the retaliation has been inflicted becomes worse or he dies; there is nothing held against the one who has taken retaliation. If the wound of the person on whom the retaliation has been inflicted heals and the injured party is paralysed or his injury has healed but he has a scar; defect; or blemish; the person on whom the retaliation has been inflicted does not have his hand broken again and further retaliation is not taken for his injury. He said; But there is blood-money from him according to what he has impaired or maimed of the hand of the injured party. The bodily injury is also like that. Malik said; When a man intentionally goes to his wife and gouges out her eye or breaks her hand or cuts off her finger or such like; and does it intentionally; retaliation is inflicted on him. As for a man who strikes his wife with a rope or a whip and hits what he did not mean to hit or does what he did not intend to do; he pays blood-money for what he has struck according to this principle; and retaliation is not inflicted on him. Yahya related to me from Malik that he had heard that Abu Bakr Ibn Muhammd Ibn Amr Ibn Hazm took retaliation for the breaking of a leg. | The Chapter on Retaliation In Crimes And Felonies in HodHood Indexing, The Book of Hair in Muwata Malik |
