This day have those who reject faith given up all hope of your religion: yet fear them not but fear Me. This day have I perfected your religion for you, completed My favour upon you, and have chosen for you Islam as your religion. But if any is forced by hunger, with no inclination to transgression, Allah is indeed Oft-forgiving, Most Merciful. | |

Kill not game while in the sacred precincts or in pilgrim garb. If any of you doth so intentionally, the compensation is an offering, brought to the Ka'ba, of a domestic animal equivalent to the one he killed, as adjudged by two just men among you; or by way of atonement, the feeding of the indigent; or its equivalent in fasts: that he may taste of the penalty of his deed. Allah forgives what is past: for repetition Allah will exact from him the penalty. For Allah is Exalted, and Lord of Retribution. | |

If the deceased belonged to a people at war with you, and he was a believer, the freeing of a believing slave (Is enough). If he belonged to a people with whom ye have treaty of Mutual alliance, compensation should be paid to his family, and a believing slave be freed. For those who find this beyond their means, (is prescribed) a fast for two months running: by way of repentance to Allah: for Allah hath all knowledge and all wisdom. | |

Ubaidullah Bin Eyad told me that the daughter of AlHarith told him that when they gathered to kill Khubaib AlAnsari he asked for a razor to clean his pubic region; and when they had taken him outside the sanctuary of Mecca in order to kill him; he said in verse; I dont care if I am killed as a Muslim; on any side of my body I may be killed in Allah Cause; for that is for the sake of Allah very Self; and if He will; He will bestow His Blessings upon the torn pieces of my body. SahihAlBukhari-017-001-1065 | Narrated Abu Saeed AlKhudri: When Ali was in Yemen; he sent some gold in its ore to the Prophet. The Prophet ﷺ distributed it among AlAqra Bin HAbis AlHanzali who belonged to Bani Mujashi; Uyaina Bin Badr AlFazari; Alqama Bin Ulatha AlAmiri; who belonged to the Bani Kilab tribe and Zaid AlKhail AlTai who belonged to Bani Nabhan. So the Quraish and the Ansar became angry and said; He gives to the chiefs of Najd and leaves us! The Prophet ﷺ said; I just wanted to attract and unite their hearts make them firm in Islam. Then there came a man with sunken eyes; bulging forehead; thick beard; fat raised cheeks; and clean-shaven head; and said; O Muhammad! Be afraid of Allah! The Prophet ﷺ said; Who would obey Allah if I disobeyed Him? Allah. He trusts me over the people of the earth; but you do not trust me? A man from the people present then ; who; I think; was Khalid Bin AlWalid; asked for permission to kill him; but the Prophet ﷺ prevented him. When the man went away; the Prophet said; Out of the offspring of this man; there will be people who will recite the Quran but it will not go beyond their throats; and they will go out of Islam as an arrow goes out through the game; and they will kill the Muslims and leave the idolators. SahihAlBukhari-017-001-1269 | Narrated Abu Qatada: Allah Messenger ﷺ said on the Day of the battle of Hunain; Whoever has killed an infidel and has a proof or a witness for it; then the salb arms and belongings of that deceased will be for him. I stood up to seek a witness to testify that I had killed an infidel but I could not find any witness and then sat down. Then I thought that I should mention the case to Allah Messenger ﷺ I and when I did so a man from those who were sitting with him said; The arms of the killed person he has mentioned; are with me; so please satisfy him on my behalf. Abu Bakr said; No; he will not give the arms to a bird of Quraish and deprive one of Allah lions of it who fights for the cause of Allah and His Apostle. Allah Messenger ﷺ I stood up and gave it to me; and I bought a garden with its price; and that was my first property which I owned through the war booty. The people of Hijaz said; A judge should not pass a judgment according to his knowledge; whether he was a witness at the time he was the judge or before that And if a litigant gives a confession in favor of his opponent in the court; in the opinion of some scholars; the judge should not pass a judgment against him till the latter calls two witnesses to witness his confession. And some people of Iraq said; A judge can pass a judgement according to what he hears or witnesses the litigant confession in the court itself; but if the confession takes place outside the court; he should not pass the judgment unless two witnesses witness the confession. Some of them said; A judge can pass a judgement depending on his knowledge of the case as he is trust-worthy; and that a witness is Required just to reveal the truth. The judge knowledge is more than the witness. Some said; A judge can judge according to his knowledge only in cases involving property; but in other cases he cannot. Sabana! Khalid kept on killing some of them and taking some others as captives; and he gave a captive to everyone of us and ordered everyone of us to kill his captive. SahihAlBukhari-017-001-1289 | Narrated Abu Laila Bin Abdullah Bin Abdulrahman Bin Sahl: Sahl Bin Abi Hathma and some great men of his tribe said; Abdullah Bin Sahl and Muhaiyisa went out to Khaibar as they were struck with poverty and difficult living conditions. Then Muhaiyisa was informed that Abdullah had been killed and thrown in a pit or a spring. Muhaiyisa went to the Jews and said; By Allah; you have killed my companion. The Jews said; By Allah; we have not killed him. Muhaiyisa then came back to his people and told them the story. He; his elder brother Huwaiyisa and Abdulrahman Bin Sahl came to the Prophet and he who had been at Khaibar; proceeded to speak; but the Prophet ﷺ said to Muhaiyisa; The eldest! The eldest! meaning; Let the eldest of you speak. So Huwaiyisa spoke first and then Muhaiyisa. Allah Messenger ﷺ said; The Jews should either pay the blood money of your deceased companion or be ready for war. After that Allah Messenger ﷺ wrote a letter to the Jews in that respect; and they wrote that they had not killed him. Then Allah Messenger ﷺ said to Huwaiyisa; Muhaiyisa and Abdulrahman Can you take an oath by which you will be entitled to take the blood money? They said; No. He said to them ; Shall we ask the Jews to take an oath before you? They replied; But the Jews are not Muslims. So Allah Apostle gave them one-hundred camels as blood money from himself. SahihAlBukhari-017-001-1520 | Narrated Abu Burda: Abu Mousa said; I came to the Prophet ﷺ along with two men from the tribe of Ashariyin; one on my right and the other on my left; while Allah Messenger ﷺ was brushing his teeth with a Siwak ; and both men asked him for some employment. The Prophet ﷺ said; O Abu Mousa O Abdullah Bin Qais!. I said; By Him Who sent you with the Truth; these two men did not tell me what was in their hearts and I did not feel realize that they were seeking employment. As if I were looking now at his Siwak being drawn to a corner under his lips; and he said; We never or; we do not appoint for our affairs anyone who seeks to be employed. But O Abu Mousa! or Abdullah Bin Qais! Go to Yemen. The Prophet then sent Muadh Bin Jabal after him and when Muadh reached him; he spread out a cushion for him and requested him to get down and sit on the cushion. Behold: There was a fettered man beside Abu Muisa. Muadh asked; Who is this man ? Abu Muisa said; He was a Jew and became a Muslim and then reverted back to Judaism. Then Abu Muisa requested Muadh to sit down but Muadh said; I will not sit down till he has been killed. This is the judgment of Allah and His Apostle for such cases and repeated it thrice. SahihAlBukhari-017-001-1592 | Narrated Ibn Abbas: I used to teach the Quran to some people of the Muhajirln emigrants ; among whom there was Abdulrahman Bin Auf. While I was in his house at Mina; and he was with Umar Bin AlKhattab during Umar last Hajj; Abdulrahman came to me and said; Would that you had seen the man who came today to the Chief of the Believers Umar ; saying; O Chief of the Believers! What do you think about so-and-so who says; If Umar should die; I will give the pledge of allegiance to such-andsuch person; as by Allah; the pledge of allegiance to Abu Bakr was nothing but a prompt sudden action which got established afterwards. Umar became angry and then said; Allah willing; I will stand before the people tonight and warn them against those people who want to deprive the others of their rights the question of rulership. Abdulrahman said; I said; O Chief of the believers! Do not do that; for the season of Hajj gathers the riff-raff and the rubble; and it will be they who will gather around you when you stand to address the people. And I am afraid that you will get up and say something; and some people will spread your statement and may not say what you have actually said and may not understand its meaning; and may interpret it incorrectly; so you should wait till you reach Medina; as it is the place of emigration and the place of Prophet Traditions; and there you can come in touch with the learned and noble people; and tell them your ideas with confidence; and the learned people will understand your statement and put it in its proper place. On that; Umar said; By Allah! Allah willing; I will do this in the first speech I will deliver before the people in Medina. Ibn Abbas added: We reached Medina by the end of the month of Dhu AlHijja; and when it was Friday; we went quickly to the Masjid as soon as the sun had declined; and I saw Saeed Bin Zaid Bin Amr Bin Nufail sitting at the corner of the pulpit; and I too sat close to him so that my knee was touching his knee; and after a short while Umar Bin AlKhattab came out; and when I saw him coming towards us; I said to Saeed Bin Zaid Bin Amr Bin Nufail Today Umar will say such a thing as he has never said since he was chosen as Caliph. Saeed denied my statement with astonishment and said; What thing do you expect Umar to say the like of which he has never said before? In the meantime; Umar sat on the pulpit and when the callmakers for the prayer had finished their call; Umar stood up; and having glorified and praised Allah as He deserved; he said; Now then; I am going to tell you something which Allah has written for me to say. I do not know; perhaps it portends my death; so whoever understands and remembers it; must narrate it to the others wherever his mount takes him; but if somebody is afraid that he does not understand it; then it is unlawful for him to tell lies about me. Allah sent Muhammad with the Truth and revealed the Holy Book to him; and among what Allah revealed; was the Verse of the Rajam the stoning of married person male & female who commits illegal sexual intercourse; and we did recite this Verse and understood and memorized it. Allah Messenger ﷺ did carry out the punishment of stoning and so did we after him. I am afraid that after a long time has passed; somebody will say; By Allah; we do not find the Verse of the Rajam in Allah Book; and thus they will go astray by leaving an obligation which Allah has revealed. And the punishment of the Rajam is to be inflicted to any married person male & female ; who commits illegal sexual intercourse; if the required evidence is available or there is conception or confession. And then we used to recite among the Verses in Allah Book: O people! Do not claim to be the offspring of other than your fathers; as it is disbelief unthankfulness on your part that you claim to be the offspring of other than your real father. Then Allah Messenger ﷺ said; Do not praise me excessively as Jesus; son of Marry was praised; but call me Allah Slave and His Apostles. O people! I have been informed that a speaker amongst you says; By Allah; if Umar should die; I will give the pledge of allegiance to such-and-such person. One should not deceive oneself by saying that the pledge of allegiance given to Abu Bakr was given suddenly and it was successful. No doubt; it was like that; but Allah saved the people from its evil; and there is none among you who has the qualities of Abu Bakr. Remember that whoever gives the pledge of allegiance to anybody among you without consulting the other Muslims; neither that person; nor the person to whom the pledge of allegiance was given; are to be supported; lest they both should be killed. And no doubt after the death of the Prophet ﷺ we were informed that the Ansar disagreed with us and gathered in the shed of Bani Sada. Ali and AlZubair and whoever was with them; opposed us; while the emigrants gathered with Abu Bakr. I said to Abu Bakr; Let go to these Ansari brothers of ours. So we set out seeking them; and when we approached them; two pious men of theirs met us and informed us of the final decision of the Ansar; and said; O group of Muhajirin emigrants ! Where are you going? We replied; We are going to these Ansari brothers of ours. They said to us; You shouldnt go near them. Carry out whatever we have already decided. I said; By Allah; we will go to them. And so we proceeded until we reached them at the shed of Bani Sada. Behold! There was a man sitting amongst them and wrapped in something. I asked; Who is that man? They said; He is Saad Bin Ubada. I asked; What is wrong with him? They said; He is sick. After we sat for a while; the Ansar speaker said; None has the right to be worshipped but Allah; and praising Allah as He deserved; he added; To proceed; we are Allah Ansar helpers and the majority of the Muslim army; while you; the emigrants; are a small group and some people among you came with the intention of preventing us from practicing this matter of caliphate and depriving us of it. When the speaker had finished; I intended to speak as I had prepared a speech which I liked and which I wanted to deliver in the presence of Abu Bakr; and I used to avoid provoking him. So; when I wanted to speak; Abu Bakr said; Wait a while. I disliked to make him angry. So Abu Bakr himself gave a speech; and he was wiser and more patient than I. By Allah; he never missed a sentence that I liked in my own prepared speech; but he said the like of it or better than it spontaneously. After a pause he said; O Ansar! You deserve all the qualities that you have attributed to yourselves; but this question of Caliphate is only for the Quraish as they are the best of the Arabs as regards descent and home; and I am pleased to suggest that you choose either of these two men; so take the oath of allegiance to either of them as you wish. And then Abu Bakr held my hand and Abu Ubaida Bin AlJarrah hand who was sitting amongst us. I hated nothing of what he had said except that proposal; for by Allah; I would rather have my neck chopped off as expiator for a sin than become the ruler of a nation; one of whose members is Abu Bakr; unless at the time of my death my own-self suggests something I dont feel at present. And then one of the Ansar said; I am the pillar on which the camel with a skin disease eczema rubs itself to satisfy the itching i.e.; I am a noble ; and I am as a high class palm tree! O Quraish. There should be one ruler from us and one from you. Then there was a hue and cry among the gathering and their voices rose so that I was afraid there might be great disagreement; so I said; O Abu Bakr! Hold your hand out. He held his hand out and I pledged allegiance to him; and then all the emigrants gave the Pledge of allegiance and so did the Ansar afterwards. And so we became victorious over Saad Bin Ubada whom AlAnsar wanted to make a ruler. One of the Ansar said; You have killed Saad Bin Ubada. I replied; Allah has killed Saad Bin Ubada. Umar added; By Allah; apart from the great tragedy that had happened to us i.e. the death of the Prophet ; there was no greater problem than the allegiance pledged to Abu Bakr because we were afraid that if we left the people; they might give the Pledge of allegiance after us to one of their men; in which case we would have given them our consent for something against our real wish; or would have opposed them and caused great trouble. If I meet an unbeliever and we have a fight; and he strikes my hand with the sword and cuts it off; and then takes refuge from me under a tree; and says; I have surrendered to Allah i.e. embraced Islam ; may I kill him after he has said so? SahihMuslim-017-001-17302 | Abu Laila Abdullah Bin Abdulrahman Bin Sahl reported that the elderly persons of the tribe had informed Sahl Bin Abu Hathma that Abdullah Bin Sahl and Muhayisa went out to Khaibar under some distress which had afflicted them. Muhayisa came and informed that Abdutlah Bin Sahl had been killed; and his dead body had been thrown in a well or in a ditch. He came to the Jews and said: By Allah; it is you who have killed him. They said: By Allah; we have not killed him. He then came to his people; and made mention of that to them. Then came he and his brother Huwayisa; and he was older than he; and Abdulrahman Bin Sahl. Then Muhayisa went to speak; and it was he who had accompanied Abdullah to Khaibar; whereupon Allah Messenger ﷺ said to Muhayisa: Observe greatness of the great he meant the seniority of age. Then Huwayisa spoke and then Muhayisa also spoke. Thereupon Allah Messenger ﷺ said: They should either pay blood-wit for your companion; or be prepared for war. Allah Messenger ﷺ wrote about it to them to the Jews. They wrote: Verily; by Allah; we have not killed him. Thereupon Allah Messenger ﷺ said to Huwayisa and Muhayisa and Abdulrahman Are you prepared to take oath in order to entitle yourselves for the blood-wit of your companion? SahihMuslim-017-001-17703 | It has been reported on the authority of Abu Mousa who said: I went to the Prophet ﷺ and with me were two men from the Ashari tribe. One of them was on my right hand and the other on my left. Both of them made a request for a position of authority while the Prophet ﷺ was brushing his teeth with a tooth-stick. He said to me : Abu Mousa or Abdullah Bin Qais ; what do you say about the request they have made ? I said: By God Who sent thee on thy mission with truth; they did not disclose to me what they had in their minds; and I did not know that they would ask for a position. The narrator says while recalling this hadith : I visualise as if I were looking at the miswak of the Prophet ﷺ between his lips. He the Holy Prophet said: We shall not or shall never appoint to the public offices in our State those who with to have them; but you may go; Abu Mousa or Abdullah Bin Qais to take up your assignment. He sent him to Yemen as governor. then he sent Muadh Bin jabal in his wake to help him in the discharge of duties. When Muadh reached the camp of Abu Mousa; the latter received him and said: Please get yourself down; and he spread for him a mattress; while there was a man bound hand and foot as a prisoner. Muadh said: Who is this? Abu Mousa said: He was a Jew. He embraced Islam. Then he reverted to his false religion and became a Jew. Muadh said: I wont sit until he is killed according to the decree of Allah and His Apostle ﷺ in this case. Abu Mousa said: Be seated. It will be done. He said: I wont sit unless he is killed in accordance with the decree of Allah and His Apostle ﷺ. He repeated these words thrice. Then Abu Mousa ordered him to be killed and he was kilied. I betook myself to them and sat near him. Now Abdullah said: I accompanied the Messenger of Allah ﷺ on a journey. We halted at a place. Some of us began to set right their tents; others began to compete with one another in shooting; and others began to graze their beasts; when an announcer of the Messenger of Allah ﷺ announced that the people should gather together for prayer; so we gathered around the Messenger of Allah ﷺ. He said: It was the duty of every Prophet that has gone before me to guide his followers to what he knew was good for them and warn them against what he knew was bad for them; but this Umma of yours has its days of peace and security in the beginning of its career; and in the last phase of its existence it will be afflicted with trials and with things disagreeable to you. In this phase of the Umma ; there will be tremendous trials one after the other; each making the previous one dwindle into insignificance. When they would be afflicted with a trial; the believer would say: This is going to bring about my destruction. When at the trial is over; they would be afflicted with another trial; and the believer would say: This surely is going to be my end. Whoever wishes to be delivered from the fire and enter the garden should die with faith in Allah and the Last Day and should treat the people as he wishes to be treated by them. He who swears allegiance to a Caliph should give him the piedge of his hand and the sincerity of his heart i. e. submit to him both outwardly as well as inwardly. He should obey him to the best of his capacity. It another man comes forward as a claimant to Caliphate ; disputing his authority; they the Muslims should behead the latter. The narrator says: I came close to him Abdullah Bin Amr Bin AlAs and said to him: Can you say on oath that you heard it from the Messenger of Allah ﷺ ? He pointed with his hands to his ears and his heart and said: My ears heard it and my mind retained it. I said to him: This cousin of yours; Muawiya; orders us to unjustly consume our wealth among ourselves and to kill one another; while Allah says: O ye who believe; do not consume your wealth among yourselves unjustly; unless it be trade based on mutual agreement; and do not kill yourselves. Verily; God is Merciful to you iv. 29. SahihMuslim-017-001-18031 | Abu Qatada reported: We accompanied the Messenger of Allah my ﷺ on an expedition in the year of the Battle of Hunain. When we encountered the enemy; some of the Muslims turned back in fear. I saw that a man from the polytheists overpowered one of the Muslims. I turned round and attacked him from behind giving a blow between his neck and shoulder. He turned towards me and grappled with me in such a way that I began to see death staring me in the face. Then death overtook him and left me alone. I joined Umar Bin AlKhattab who was saying: What has happened to the people that they are retreating ? I said: It is the Decree of Allah. Then the people returned. The battle ended in a victory for the Muslims and the Messenger of Allah ﷺ sat down to distribute the spoils of war. He said: One who has killed an enemy and can bring evidence to prove it will get his belongings. So I stood up and said: Who will give evidence for me? Then I sat down. Then he the Holy Prophet said like this. I stood up again and said: Who will bear witness for me? He the Holy Prophet made the same observation the third time; and I stood up once again. Now the Messenger of Allah ﷺ said: What has happened to you; O Abu Qatada? Then I related the whole story; to him. At this; one of the people said: He has told the truth. Messenger of Allah 1 The belongings of the enemy killed by him are with me. Persuade him to forgo his right in my favour. Objecting to this proposal Abu Bakr said: BY Allah; this will not happen. The Messenger of Allah ﷺ will not like to deprive one of the lions from among the lions of Allah who fight in the cause of Allah and His Messenger and give thee his share of the booty. So the Messenger of Allah may peace he upon him said: He Abu Bakr has told the truth; and so give the belongings to him Abu Qatada. So he gave them to me. I sold the armour which was a part of my share of the booty and bought with the sale proceeds a garden in the street of Banu Salama. This was the first property I acquired after embracing Islam. In a version of the hadith narrated by Laith; the words uttered by Abu Bakr are: No; never! He will not give it to a fox from the Quraish leaving Aasi de a lion from the lions of Allah among.... SunanAlTermithi-017-001-10339 | It was narrated from AlNawas Bin Saman; who said: The Messenger of Allah s.a.w mentioned the Dajjal one morning; he belittled him and mentioned his importance until we thought that he might be amidst a cluster of date-palms. He said: We departed from the presence of the Messenger of Allah s.a.w ; then we returned to him; and he noticed that concern in us. So he said: What is wrong with you? We said: O Messenger of Allah! You mentioned the Dajjal this morning; belittling him; and mentioning his importance until we thought that he might be amidst a cluster of the date-palms. He said: It is not the Dajjal that I fear for you. If he were to appear while I am among you; then I will be his adversary on your behalf. And if he appears and I am not among you; then each man will have to fend for himself. And Allah will take care of every Muslim after me. He is young; with curly hair; his eyes protruding; resembling someone from Abd AlUzza Bin Qatan. Whoever among you sees him; then let him recite the beginning of Surah Ashab AlKahf.He said: He will appear from what is between AlSham and AlIraq; causing devastation toward the right and toward the left. O worshippers of Allah! Hold fast! We said: O Messenger of Allah! How long will he linger on the earth? He said: Forty days; a day like a year; a day like a month; a day like a week; and the remainder of his days are like your days. We said: O Messenger of Allah! Do you think that during the day that is like a year; the Prayer of one day will be sufficient for us? He said: No. You will have to estimate it. We said: O Messenger of Allah! How fast will he move through the earth. He said: Like a rain storm driven by the wind. He will come upon a people and call them; and they will deny him; and reject his claims. Then he will leave them; and their wealth will follow him. They will awaken in the morning with nothing left. Then he will come upon a people and call them; and they will respond to him; believing in him. So he will order the Heavens to bring rain; and it shall rain; and he will order the land to sprout; and it will sprout. Their cattle will return to them with their coats the longest; their udders the fullest and their stomachs the fattest. He said: Then he will come upon some ruins; saying to it: Bring me your treasures! He will turn to leave it; and it will follow him; like drone bees. Then he will call a young man; full of youth; and he will strike him with the sword cutting him into two pieces. Then he will call him; and he will come forward with his face beaming and laughing. So while he is doing that; Eisa Bin Mariam; ﷺ ; will descend in eastern Damascus at the white minaret; between two Mahrud; with his hands on the wings of two angels. When he lowers his head; drops fall; and when raises it; gems like pearls drop from him. He said: His the Dajjals breath does not reach anyone but he dies; and his breath reaches as far as his sight. He said: So he pursues him the Dajjal and he catches up with him at the gate of Ludd where he kills him. He said: So he remains there as long as Allah wills. He said: Then Allah reveals to him: Take my slaves to AlTur; for I have sent down some creatures of Mine which no one shall be able to kill. He said: Allah dispatches Yajuj and Majuj; and they are as Allah said: They swoop down from every mount.He said: The first of them pass by the lake of Tiberias; drinking what is in it. Then the last of them pass by it saying: There was water here at one time. They travel until they reach a mountain at Bait AlMaqdis. They will say: We have killed whoever was in the earth. Come! Let us kill whoever is in the skies. They will shoot their arrows into the Heavens; so Allah will return their arrows to them red with blood. Eisa Bin Mariam and his Companions be surrounded; until the head of a bull on that day would be better to them than a hundred Dinar to one of you today. He s.a.w said: Eisa will beseech Allah; as will his companions. He said: So Allah will send AlNaghaf down upon their necks. In the morning they will find that they have all died like the death of a single soul. He said: Eisa and his companions will come down; and no spot nor hand-span can be found; except that it is filled with their stench; decay and blood. So Eisa will beseech Allah; as will his companions. So Allah will send upon them birds like the necks of Bukht milch camels. They will carry them off and cast them into an abyss. The Muslims will burn their bows; arrows and quivers for seventy years. He s.a.w said: Allah will send upon them a rain which no house of hide nor mud will bear. The earth will be washed; leaving it like a mirror. Then it will be said to the earth: bring forth your fruits and return your blessings. So on that day; a whole troop would eat a pomegranate and seek shade under its skin. Milk will be so blessed that a large group of people will be sufficed by one milking of a camel. And that a tribe will be sufficed by one milking of a cow; and that a group will be sufficed by the milking of sheep. While it is like that; Allah will send a wind which grabs the soul of every believer; leaving the remainder of the people copulating publicly like the copulation of donkeys. SunanAlNasai-017-001-12024 | It was narrated that Ibn Abbas said: The first instance of Qasamah during the Aljahiliyah involved a man from Banu Hashim who was employed by a man from Quraish; from another branch of the tribe. He went out with him; driving his camels and another man from Banu Hashim passed by them. The leather rope of that man bag broke; so he said to the hired worker : Help me by giving me a rope with which to tie the handle of my bag; lest the camels run away from me. So he gave him a rope and he tied his gab with it. When they halted; all the camels legs were hobbled except one camel. The one who had hired him said: Why is his camel; out of all of them; not hobbled? He said: There is no rope for it. He said: Where is its rope? He said: A man from Banu Hashim passed by and the leather rope of his bag had broken; and he asked me to help him; he said: Help me by giving me a rope with which to tie the handle of my bag lest the camels run away from me; so I gave him a rope. He struck him with a stick; which led to his death.Then a man from Yemen passed by him the man from Banu Hashim; the man from Banu Hashim; just before he died and he the Hashimi man said: Are you going to attend the Pilgrimage? He said: I do not think I will attend it; but perhaps I will attend it. He said: Will you convey a message from me once in your lifetime? He said: Yes. He said: If you attend the pilgrimage; then call out; O family of Quraish! If they respond; then call out; O family of Hashim! If they respond; then ask for Abu Talib; and tell him that so and so killed me for a rope. Then the hired worker died. When the one who had hired him cam; Abu Talib went to him and said: What happened to our companion? He said: He fell sick and I took good care of him; but he died; so I stopped and buried him. He said: He deserved that from you. Some time passed; then the Yemeni man who had been asked to convey the message arrived at the time of the pilgrimage. He said: O family of Quraish! And they said: Here is Quraish. He said: O family of Banu Hashim! They said: Here is Banu Hashim. He said Where is Abu Talib? He said: Here is Abu Talib. He said: so and so asked me to convey a message to you; that so and so killed him for a camel rope. Abu Talib went to him and said Choose one of three alternatives that we are offering you. If you wish; you may give us one hundred camels; because you killed our companion by mistake: or if you wish; fifty of your men may swear an oath that you did not kill him; or if you wish; we will kill you in retaliation. He went to his people and told them about that; and they said: We will swear the oath. Then a woman from Banu Hashim; who was married to one of their men and had born him a child; came to Abu Talib and said: O Abu Talib; I wish that my son; who is one of these fifty men; should be excused from having to take the oath.; So the excused him. Then one of the men came to him and said: O Abu Talib; you want fifty men to take the oath in lieu of one hundred camels; which means that each man may give two camels instead; so here are two camels; take them from me; and do not make me take the oath. So he accepted them; and did not make him take the oath. Then forty-eight men came and took the oath. Someone came to Muhaysah and he told him that Abdullah Bin Sahl had been Killed and thrown into a pit; or a well. He came to the Jews and said: By Allah; you killed him. They said: By Allah; we did not kill him.Then he went back to the Messenger of Allah and told him about that. Then he and Huwaysah - his brother who was older than him - and Abdulrahman Bin Sahl; came to the Prophet. Muhaysah; who was the one who had been at Khaibar; began to speak; but the messenger of Allah said: Let the elder speak first; So Huwaysah elder speaks first. So Huwaysah spoke; then Muhaysah spoke. Then they found one of their numbers slain. They said to those in whose land they found him: You killed our companion! They said: We did not kill him and we do not know who killed him. They went to the prophet of Allah and said: O Prophet of Allah; we went to Khaibar and we found one of our number slain. The Messenger of Allah said: Let the elders speak first. The Apostle of Allaah ﷺ disliked the question that I asked him. Thereupon Uwaimir said I swear by Allaah; I shall not leave until I ask him about it. So; Uwaimir came to the Apostle of Allaah ﷺ while he was sitting in the midst of the people. He said Apostle of Allaah ﷺ tell me about a man who finds a man along with his wife. SunanAbuDawoud-017-001-25092 | Abdullah bin Masud said We were in the Masjid on the night of a Friday; suddenly a man from the Ansar entered the Masjid. And said If a man finds a man along with wife and declares about her adultery you will flog him. Or if he kills you; you will kill him or if keeps silence he will keep silence in anger. I swear by Allaah; I shall ask the Apostle of Allaah ﷺ about it. On the next day he came to the Apostle of Allaah ﷺ and said If a man finds a man along with wife and declares about her adultery you will flog him. The man bore witness before Allaah four times that the thing he said was indeed true. He then invoked curse of Allaah on him for the fifth time if he was a liar. He who entered it heard the speech of those who were in the Bilat. Uthman then entered it. He came out to us; looking pale. He said: They are threatening to kill me now. We said: Allah will be sufficient for you against them; Commander of the Faithful! He asked: Why kill me? I heard the Messenger of Allah ﷺ say: It is not lawful to kill a man who is a Muslim except for one of the three reasons: Kufr disbelief after accepting Islam; fornication after marriage; or wrongfully killing someone; for which he may be killed. SunanAbuDawoud-017-001-25720 | Narrated Ziyad Ibn Saad Ibn Dumayrah AlSulami: On the authority of his father Sad and his grandfather Dumayrah according to Mousa version who were present in the battle of Hunayn with the Messenger of Allah ﷺ : After the advent of Islam; Muhallam Ibn Jaththamah AlLaythi killed a man of Ashja. That was the first blood-money decided by the Messenger of Allah ﷺ for payment. Uyaynah spoke about the killing of AlAshjai; for he belonged to Ghatafan; and AlAqra Ibn Habis spoke on behalf of Muhallam; for he belonged to Khunduf. The voices rose high; and the dispute and noise grew. So the Messenger of Allah ﷺ said: Do you not accept blood-money; Uyaynah? Uyaynah then said: No; I swear by Allah; until I cause his women to suffer the same fighting and grief as he caused my women to suffer. Again the voices rose high; and the dispute and noise grew. The Messenger of Allah ﷺ said: Do you not accept the blood-money Uyaynah? Uyaynah gave the same reply as before; and a man of Banu Layth called Mukaytil stood up. He had a weapon and a skin shield in his hand. He said: I do not find in the beginning of Islam any illustration for what he has done except the one that some sheep came on; and those in the front were shot; hence those in the rear ran away. Muhayasah came and told the Abdullah Bin Sahl had been killed and thrown in a well or stream. He hen came to the Jews and said: I swear by Allah; you have killed him. MuwataMalik-017-001-34741 | Yahya related to me from Malik from Abu Layla Ibn Abdullah Ibn Abdulrahman Ibn Sahl from Sahl Ibn Abi Hathma that some of the great men of his people informed him that Abdullah Ibn Sahl and Muhayisa went out to Khaybar because extreme poverty had overtaken them. Muhayisa returned and said that Abdullah Ibn Sahl had been killed and thrown in a shallow well or spring. The jews came and he said; By Allah! You have killed him. They said; By Allah! We have not killed him! Then he made for his people and mentioned that to them. Then he; his brother Huwayisa; who was older than him; and Abdulrahman set out. Muhayisa began to speak; as he had been at Khaybar. The Messenger of Allah; may Allah bless him and grant him peace; said to him; The greater first; the greater first; meaning in age. So Huwayisa spoke and then Muhayisa spoke. The Messenger of Allah; may Allah bless him and grant him peace; said; Either they pay your companion blood-money or we will declare war against them. MuwataMalik-017-001-34742 | Yahya said from Malik from Yahya Ibn Said that Bushayr Ibn Yasar informed him that Abdullah Ibn Sahl AlAnsari and Muhayisa Ibn Masud went out to Khaybar; and they separated on their various businesses and Abdullah Ibn Sahl was killed. Muhayisa; and his brother Huwayisa and Abdulrahman Ibn Sahl went to the Prophet; may Allah bless him and grant him peace; and Abdulrahman began to speak before his brother. The Messenger of Allah; may Allah bless him and grant him peace; said; The older first; the older first. Therefore Huwayisa and then Muhayisa spoke and mentioned the affair of Abdullah Ibn Sahl. The Messenger of Allah; may Allah bless him and grant him peace; said to them; Do you swear with fifty oaths and claim the blood-money of your companion or the life of the murderer? They said; Messenger of Allah; we did not see it and we were not present. The Messenger of Allah; may Allah bless him and grant him peace; said; Will you acquit the jews for fifty oaths? They said; Messenger of Allah; how can we accept the oaths of a people who are kafirun? Yahya Ibn Said said; Bushayr Ibn Yasar claimed that the Messenger of Allah; may Allah bless him and grant him peace; paid the blood-money from his own property. Malik said; The generally agreed on way of doing things in our community and that which I heard from whoever I am content with; concerning the oath of qasama; and upon which the past and present imams agree; is that those who claim revenge begin with the oaths and swear. The oath for revenge is only obligatory in two situations. Either the slain person says; My blood is against so-and-so; or the relatives entitled to the blood bring a partial proof of it that is not irrefutable against the one who is the object of the blood-claim. This obliges taking an oath on the part of those who claim the blood against those who are the object of the blood-claim. With us; swearing is only obliged in these two situations. Malik said; That is the sunna in which there is no dispute with us and which is still the behaviour of the people. The people who claim blood begin the swearings; whether it is an intentional killing or an accident. Malik said; The Messenger of Allah; may Allah bless him and grant him peace; began with Banu Harith in the case of the killing of their kinsman murdered at Khaybar. Malik said; If those who make the claim swear; they deserve the blood of their kinsman and whoever they swear against is slain. Only one man can be killed in the qasama. Two cannot be killed in it. Fifty men from the blood-relatives must swear fifty oaths. If their number is less or some of them draw back; they can repeat their oaths; unless one of the relatives of the murdered man who deserves blood and who is permitted to pardon it; draws back. If one of these draws back; there is no way to revenge. Yahya said that Malik said; The oaths can be made by those of them who remain if one of them draws back who is not permitted to pardon. If one of the blood-relatives draws back who is permitted to pardon; even if he is only one; more oaths can not be made after that by the blood- relatives. If that occurs; the oaths can be on behalf of the one against whom the claim is made. So fifty of the men of his people swear fifty oaths. If there are not fifty men; more oaths can be made by those of them who already swore. If there is only the defendant; he swears fifty oaths and is acquitted. Yahya said that Malik said; One distinguishes between swearing for blood and oaths for one rights. When a man has a money-claim against another man; he seeks to verify his due. When a man wants to kill another man; he does not kill him in the midst of people. He keeps to a place away from people. Had there only been swearing in cases where there is a clear proof and had one acted in it as one acts about one rights i.e. needing witnesses ; the right of blood retribution would have been lost and people would have been swift to take advantage of it when they learned of the decision on it. However; the relatives of the murdered man were allowed to initiate swearing so that people might restrain themselves from blood and the murderer might beware lest he was put into a situation like that i.e. qasama by the statement of the murdered man. Yahya said; Malik said about a people of whom a certain number are suspected of murder and the relatives of the murdered man ask them to take oaths and they are numerous; so they ask that each man swears fifty oaths on his own behalf. The oaths are not divided out between them according to their number and they are not acquitted unless each man among them swears fifty oaths on his own behalf. Malik said; This is the best I have heard about the matter. He said; Swearing goes to the paternal relatives of the slain. MuwataMalik-017-001-34743 | Yahya said that Malik said; The way of doing things in our community about which there is no dispute is that women do not swear in the swearing for the intentional act. If the murdered man only has female relatives; the women have no right to swear for blood and no pardon in murder. Yahya said that Malik said about a man who is murdered; If the paternal relatives of the murdered man or his mawali say; We swear and we demand our companion blood; that is their right. Malik said; If the women want to pardon him; they cannot do that. The paternal relatives and mawali are entitled to do that more than them because they are the ones who demand blood and swear for it. Malik said; If the paternal relatives or mawali pardon after they demand blood and the women refuse and say; We will not abandon our right against the murderer of our companion; the women are more entitled to that because whoever takes retaliation is more entitled than the one who leaves it among the women and paternal relatives when the murder is established and killing obliged. Malik said; At least two claimants must swear in murder. The oaths are repeated by them until they swear fifty oaths; then they have the right to blood. That is how things are done in our community. Malik said; When people beat a man and he dies in their hands; they are all slain for him. If he dies after their beating; there is swearing. If there is swearing; it is only against one man and only he is slain. We have never known the swearing to be against more than one man. Malik spoke about a slave who had his hand or foot broken and then the break mended. He said; The one who injured him is not obliged to pay anything. If that break causes him loss or scar; the one who injured him must pay according to what he diminished of the value of the slave. Malik said; What is done in our community about retaliation between slaves is that it is like retaliation between freemen. The life of the slave-girl for the life of the slave; and her injury for his injury. When a slave intentionally kills a slave; the master of the murdered slave has a choice. If he wishes; he kills him; and if he wishes; he takes the blood-money. If he takes the blood-money; he takes the value of his slave. If the owner of the slave who killed wishes to give the value of the murdered slave; he does it. If he wishes; he surrenders his slave. If he surrenders him; he is not obliged to do anything other than that. When the owner of the murdered slave takes the slave who murdered and is satisifed with him; he must not kill him. All retaliations between slaves for cutting off of the hand and foot and such things are dealt with in the same way as in the murder. Malik said about a muslim slave who injures a jew or christian; If the master of the slave wishes to pay blood-money for him according to the injury; he does it. Or else he surrenders him and he is sold; and the jew or christian is given the blood-money of the injury or all the price of the slave if the blood-money is greater than his price. Malik said; The generally agreed on way with us is that there is no retaliation against children. Their intention is accidental. The hudud are not obliged for them if they have not yet reached puberty. If a child kills someone it is only accidentally. Had a child and an adult killed a free man accidentally; each of them pays half the full blood-money. Malik said; A person who kills someone accidentally pays blood-money with his property and there is no retaliation against him. That money is like anything else from the dead man property and his debt is paid with it and he is allowed to make a bequest from it. If he has a total property of which the blood-money is a third and then the blood-money is relinquished; that is permitted to him. MuwataMalik-017-001-34852 | Yahya related to me from Malik that Rabia Ibn Abi Abdulrahman said; The slave of fair complexion and excellence is estimated at fifty dinars or six hundred dirhams. The blood-money of a free muslim woman is five hundred dinars or six thousand dirhams. Malik said; The blood-money of the foetus of a free woman is a tenth of her blood-money. The tenth is fifty dinars or six hundred dirhams. Malik said; I have not heard anyone dispute that there is no slave in compensation for the foetus until it leaves its mother womb and falls still-born from her womb. Malik said; I heard that if the foetus comes out of its mother womb alive and then dies; the full blood-money is due for it. Malik said; The foetus is not alive unless it cries at birth. If it comes out of its mother womb and cries out and then dies; the complete blood-money is due for it. We think that the slave- girl foetus has a tenth of the price of the slave-girl. Malik said; When a woman murders a man or woman; and the murderess is pregnant; retaliation is not taken against her until she has given birth. If a woman who is pregnant is killed intentionally or unintentionally; the one who killed her is not obliged to pay anything for her foetus. If she is murdered; then the one who killed her is killed and there is no blood-money for her foetus. If she is killed accidentally; the tribe obliged to pay on behalf of her killer pays her blood-money; and there is no blood-money for the foetus. Yahya related to me; Malik was asked about the foetus of the christian or jewish woman which was aborted. MuwataMalik-017-001-34876 | 11 Malik related to me from Yahya Ibn Said from Urwa Ibn AlZubair that a man of the Ansar called Uhayha Ibn AlJulah had a young paternal uncle who was younger than him and who was living with his maternal uncles. Uhayha took him and killed him. His maternal uncles said; We brought him up from a baby to a youth till he stood firm on his feet; and we have had the right of a man taken from us by his paternal uncle. Urwa said; For that reason a killer does not inherit from the one he killed. Malik said; The way of doing things about which there is no dispute is that the intentional murderer does not inherit anything of the blood-money of the person he has murdered or any of his property. He does not stop anyone who has a share of inheritance from inheriting. The one who kills accidentally does not inherit anything of the blood-money and there is dispute as to whether or not he inherits from the dead person property because there is no suspicion that he killed him for his inheritance and in order to take his property. MuwataMalik-017-001-34877 | Yahya related to me from Malik from Ibn Shihab from Said Ibn AlMusayab and Abu Salama Ibn Abdulrahman from Abu Huraira that the Messenger of Allah; may Allah bless him and grant him peace; said; The wound of an animal is of no account and no compensation is due for it. The well is of no account and no compensation is due for it. The mine is of no account and no compensation is due for it and a fifth is due for buried treasures. Alkanz: see Book 17. Malik said; Everyone leading an animal by the halter; driving it; and riding it is responsible for what the animal strikes unless the animal kicks out without anything being done to it to make it kick out. Umar Ibn AlKhattab imposed the blood-money on a person who was exercising his horse. Malik said; It is more fitting that a person leading an animal by the halter; driving it; or riding it incur a loss than a person who is exercising his horse. See hadith 4 of this book. Malik said; What is done in our community about a person who digs a well on a road or ties up an animal or does the like of that on a road used by muslims; is that since what he has done is included in that which he is not permitted to do in such a place; he is liable for whatever injury or other thing arises from that action. The blood-money of that which is less than a third of the full blood- money is owed from his own personal property. Whatever reaches a third or more; is owed by his tribe. Any such things that he does which he is permitted to do on the muslims road are something for which he has no liability or loss. Part of that is a hole which a man digs to collect rain; and the beast from which the man alights for some need and leaves standing on the road. There is no penalty against anyone for this. Malik spoke about a man who went down a well; and another man followed behind him; and the lower one pulled the higher one and they fell into the well and both died He said; The tribe of the one who pulled him in is responsible for the blood-money. Malik spoke about a child whom a man ordered to go down into a well or to climb a palm tree and he died as a result. He said; The one who ordered him is liable for whatever befalls him; be it death or something else. Malik said; The way of doing things in our community about which there is no dispute is that women and children are not obliged to pay blood-money together with the tribe in the blood-moneys which the tribe must pay. The blood-money is only obligatory for a man who has reached puberty. Malik said that the tribe could bind themselves to the blood-money of mawali if they wished. If they refused; they were people of the diwan or were cut off from their people. In the time of the Messenger of Allah; may Allah bless him and grant him peace; people paid the blood-money to each other as well as in the time of Abu Bakr AlSiddiq before there was a diwan. The diwan was in the time of Umar Ibn AlKhattab. No one other than one people and the ones holding the wala paid blood- money for one because the wala was not transferable and because the Prophet; may Allah bless him and grant him peace; said; The wala belongs to the one who sets free. Malik said; The wala is an established relationship. Malik said; What is done in our community about animals that are injured is that the person who causes the injury pays whatever of their value has been diminished. Malik said about a man condemned to death and one of the other hudud befell him; He is not punished for it. That is because the killing overrides all of that; except for slander. The slander remains hanging over the one to whom it was said because it will be said to him; Why do you not flog the one who slandered you? I think that the condemned man is flogged with the hadd before he is killed; and then he is killed. I do not think that any retaliation is inflicted on him for any injury except killing because killing overrides all of that. Malik said; What is done in our community is that when a murdered person is found among the main body of a people in a village or other place; the house or place of the nearest people to him is not responsible. That is because the murdered person can be slain and then cast at the door of some people to shame them by it. No one is responsible for the like of that. Malik said about a group of people who fight with each other and when the fight is broken up; a man is found dead or wounded; and it is not known who did it; The best of what is heard about that is that there is blood-money for him; and the blood-money is against the people who argued with him. She was a mudabbara. Hafsa gave the order; and she was killed. Malik said; The sorcerer is the one who uses sorcery for himself and no one else uses that for him. It is like the one about whom Allah; the Blessed; the Exalted; said in His Book; They know the one who devotes himself to it will have no share in the Next World. Malik said; The generally agreed on way of doing things in our community about which there is no dispute is that when a man strikes another man with a stick or hits him with a rock or intentionally strikes him causing his death; that is an intentional injury and there is retaliation for it. Malik said; Intentional murder with us is that a man intentionally goes to a man and strikes him until his life goes. Part of intentional injury also is that a man strikes a man in a quarrel between them. He leaves him while he is alive; and he bleeds to death and so dies. There is retaliation for that. MuwataMalik-017-001-34881 | Yahya related to me from Malik that he had heard that Marwan Ibn AlHakam wrote to Muawiya Ibn Abi Sufyan to mention to him that a drunkard was brought to him who had killed a man. Muawiya wrote to him to kill him in retaliation for the dead man. Yahya said that Malik said; The best of what I have heard on the interpretation of this ayat; the word of Allah; the Blessed; the Exalted; The free man for the free man and the slave for the slave - these are men and the woman for the woman; Surat 2 ayat 178 is that retaliation is between women as it is between men. The free woman is killed for the free woman as the free man is killed for the free man. The slave-girl is slain for the slave-girl as the slave is slain for the slave. Retaliation is between women as it is between men. That is because Allah; the Blessed; the Exalted; said in His Book; We have written for them in it that it is a life for a life and an eye for an eye; a nose for a nose; and an ear for an ear; and a tooth for a tooth; and for wounds there is retaliation. Surat 5 ayat 48 Allah; the Blessed; the Exalted; mentioned that it is a life for a life. It is the life of a free woman for the life of a free man; and her injury for his injury. Malik said about a man who held a man fast for another man to hit; and he died on the spot; If he held him and he thought that he meant to kill him; the two of them are both killed for him. If he held him and he thought that he meant to beat him as people sometimes do; and he did not think that he meant to kill him; the murderer is slain and the one who held him is punished with a very severe punishment and jailed for a year. There is no killing against him. Malik said about a man who murdered a man intentionally or gouged out his eye intentionally; and then was slain or had his eye gouged out himself before retaliation was inflicted on him; There is no blood-money nor retaliation against him. The right of the one who was killed or had his eye gouged out goes when the thing which he is claiming as retaliation goes. It is the same with a man who murders another man intentionally and then the murderer dies. When the murderer dies; the one seeking blood-revenge has nothing of blood- money or anything else. That is by the word of Allah; the Blessed the Exalted; Retaliation is written for you in killing. The free man for the free man and the slave for the slave. Malik said; He only has retaliation against the one who killed him. If the man who murdered him dies; he has no retaliation or blood-money. Malik said; There is no retaliation held against a free man by a slave for any injury. The slave is killed for the free man when he intentionally murders him. The free man is not slain for the slave; even if he murders him intentionally. The ex-slave then killed a man from the Banu Aidh tribe. An Aidhi; the father of the slain man came to Umar Ibn AlKhattab seeking the blood-money of his son. Umar said; He has no blood-money. The Aidhi said; What would you think if it had been my son who killed him? Umar said; Then you would pay his blood-money. He said; He is then like the black and white Arqam snake. The meaning of the statement of the Prophet; may Allah bless him and grant him peace; in our opinion and Allah knows best; is that if someone changes his deen; strike his neck! refers to those who leave Islam for other than it - like the heretics and their like; about whom it is known. They are killed without being called to tawba because their tawba is not recognised. They were hiding their kufr and publishing their Islam; so I do not think that one calls such people to tawba; and one does not accept their word. As for the one who goes out of Islam to something else and divulges it; one calls him to tawba. If he does not turn in tawba; he is killed. If there are people in that situation; I think that one should call them to Islam and call them to tawba. If they turn in tawba; that is accepted from them. If they do not turn in tawba; they are killed. That does not refer as we see it; and Allah knows best; to those who come out of Judaism to Christianity or from Christianity to Judaism; nor to someone who changes his deen from the various forms of deen except for Islam. Muawiya Ibn Abi Sufyan found it difficult to make a decision and he wrote to Abu Mousa AlAshari to ask Ali Ibn Abi Talib for him about that. So Abu Mousa asked Ali Ibn Abi Talib and AIi said to him; Is this thing in my land? I adjure you; you must tell me. Abu Mousa explained to him how Muawiya Ibn Abi Sufyan had written him to ask Ali about it. MuwataMalik-017-001-35157 | Yahya related to me from Malik from Rabia Ibn Abi Abdulrahman from more than one of the people of knowledge of that time; that those who were killed on the Day of the Camel; the Day of Siffin; the Day of AlHarra; and the Day of Qudayd did not inherit from each other. None of them inherited anything from his companion unless it was known that he had been killed before his companion. Malik said; That is the way of doing things about which there is no dispute; and which none of the people of knowledge in our city doubt. The procedure with two mutual heirs who are drowned; or killed in another way; when it is not known which of them died first is the same - neither of them inherits anything from his companion. Their inheritance goes to whoever remains of their heirs. They are inherited from by the living. Malik said; No one should inherit from anyone else when there is doubt; and one should only inherit from the other when there is certainty of knowledge and witnesses. That is because a man and his mawla whom his father has freed might die at the same time. The sons of the free man could say; Our father inherited from the mawla. They should not inherit from the mawla without knowledge or testimony that he died first. The living people most entitled to his wala inherit from him. Malik said; Another example is two full brothers who die. One of them has children and the other does not. They have a half-brother by their father. It is not known which of them died first; so the inheritance of the childless one goes to his half-brother by the father. The children of the full-brother get nothing. Malik said; Another example is when a paternal aunt and the son of her brother die; or else the daughter of the brother and her paternal uncle. It is not known which of them died first. MuwataMalik-017-001-35173 | Yahya related to me from Malik that he had heard some of the people of knowledge say that when falcons; eagles; and hawks and their like; understood as trained dogs understood; there was no harm in eating what they had killed in the course of hunting; if the name of Allah had been mentioned when they were sent out. Malik said; The best of what I have heard about retrieving game from the falcon talons or from the dog fangs and then waiting until it dies; is that it is not halal to eat it. Malik said; The same applies to anything which could have been slaughtered by the hunter when it was in the talons of the falcon or the fangs of the dog. If the hunter leaves it until the falcon or dog has killed it; it is not halal to eat it either. He continued; The same thing applies to any game hit by a hunter and caught while still alive; which he neglects to slaughter before it dies. Malik said; It is generally agreed among us that it is halal to eat the game that a hunting-dog belonging to magians hunts or kills; if it is sent out by a muslim and the animal is trained. There is no harm in it even if the muslim does not actually slaughter it. It is the same as a muslim using a magian knife to slaughter with or using his bow and arrows to shoot and kill with. The game he shot and the animal he slaughters are halal. There is no harm in eating them. If a magian sends out a muslim hunting dog for game; and it catches it; the game is not to be eaten unless it is slaughtered by a muslim. That is like a magian using a muslim bow and arrow to hunt game with; or like his using a muslim knife to slaughter with.
