SahihAlBukhari-017-001-4031Narrated Marwan Bin AlHakim and Miswar Bin Makhrama: When the Hawazin delegation came to Allah Messenger ﷺ after they had embraced Islam and requested him to return their properties and war prisoners to them; Allah Messenger ﷺ said; To me the best talk is the truest; so you may choose either of two things; the war prisoners or the wealth; for I have delayed their distribution. Allah Messenger ﷺ had waited for them for over ten days when he returned from Taif. So; when those people came to know that Allah Messenger ﷺ was not going to return to them except one of the two things the said; We choose our war Prisoners Allah Messenger ﷺ stood up amongst the Muslims; and after glorifying Allah as He deserved; he said; Now then; these brothers of yours have come to us with repentance; and I see it logical that I should return their captives to them; so whoever of you likes to do that as a favor then he can do it; and whoever amongst you likes to stick to his share; let him give up his prisoners and we will compensate him from the very first Fai i.e. war booty received without fight which Allah will give us. On that; all the people said. O Allah Messenger ﷺ s We have agreed willingly to do so return the captives Then Allah Messenger ﷺ said to them I do not know who amongst you has agreed to this and who has not. You should return and let your leaders inform me of your agreement. SahihAlBukhari-017-001-4917Narrated Marwan and AlMiswar Bin Makhrama: When the delegates of the tribe of Hawazin came to the Prophet ﷺ and they requested him to return their properties and captives. The Prophet ﷺ stood up and said to them; I have other people with me in this matter as you see and the most beloved statement to me is the true one; you may choose either the properties or the prisoners as I have delayed their distribution. The Prophet ﷺ had waited for them for more than ten days since his arrival from Taif. So; when it became evident to them that the Prophet ﷺ was not going to return them except one of the two; they said; We choose our prisoners. The Prophet got up amongst the people and glorified and praised Allah as He deserved and said; Then after; these brethren of yours have come to us with repentance; and I see it logical to return them the captives. So; whoever amongst you likes to do that as a favor; then he can do it; and whoever of you likes to stick to his share till we recompense him from the very first war booty which Allah will give us; then he can do so i.e. give up the present captives. The people unanimously said; We do that return the captives willingly. The Prophet ﷺ said; We do not know which of you has agreed to it and which have not; so go back and let your leaders forward us your decision. So; all the people then went back and discussed the matter with their leaders who returned and informed the Prophet ﷺ that all the people had willingly given their consent to return the captives. This is what has reached us about the captives of Hawazin. So choose one of two alternatives: Either the captives or the properties. I have been waiting for you i.e. have not distributed the booty. Allah Messenger ﷺ had delayed the distribution of their booty over ten nights after his return from Taif. So when they came to know that Allah Messenger ﷺ was not going to return to them but one of the two; they said; We prefer to have our captives. So Allah Messenger ﷺ got up amongst the Muslims; and praising Allah as He deserved; said; To proceed! Your brothers have come to you with repentance and I see it logical to return their captives. So; whoever of you likes to do that as a favor then he can do it. And whoever of you likes to stick to his share till we give him from the very first booty which Allah will give us; then he can do so. The people said; We do that i.e. return the captives willingly as a favor; O Allah Messenger ﷺ ! Allah Messenger ﷺ said; We do not know which of you have agreed to it and which have not; so go back and let your chiefs forward us your decision. They went back and their chief spoke to them; and they i.e. the chiefs returned to Allah Messenger ﷺ and informed him that all of them had agreed to give up their captives with pleasure; and had given their permission i.e. that the captives be returned to their people. He said: Good tidings for you; Yajuj Majuj would be those thousands who would be the denizens of Hell and a person selected for Paradise would be amongst you. He the narrator further reported that he the Messenger of Allah again said: By Him in Whose Hand is thy life; I hope that you would constitute one-fourth of the inhabitants of Paradise. We extolled Allah and we glorified Him. He the Holy Prophet again said: BY Him in Whose Hand is my life; I wish you would constitute one-third of the inhabitants of Paradise. We extolled Allah and Glorified Him. He the Holy Prophet again said: By Him in Whose Hand is my life; I hope that you would constitute half of the inhabitants of Paradise. SahihMuslim-017-001-19421Abdullah Bin Masud reported: Evil one is he who is evil in the womb of his mother and the good one is he who takes a lesson from the fate of others. The narrator came to a person from amongst the Companions of Allah Messenger ﷺ who was called Hudhaifa Bin Usaid Ghifari and said: How can a person be an evil one without committing an evil deed? Thereupon the person said to him: You are surprised at this; whereas I have heard Allah Messenger ﷺ as saying: When forty-two nights pass after the semen gets into the womb; Allah sends the angel and gives him shape. Then he creates his sense of hearing; sense of sight; his skin; his flesh; his bones; and then says: My Lord; would he be male or female? And your Lord decides as He desires and the angel then puts down that also and then says: My Lord; what about his age? And your Lord decides as He likes it and the angel puts it down. Then he says: My Lord; what about his livelihood? Talha said: I narrated this hadith to Mujahid and he said: This observing of voluntary fast is like a person who sets apart Sadaqa out of his wealth. SunanAbuDawoud-017-001-26443Narrated Hamnah daughter of Jahsh: Hamnah said my menstruation was great in quantity and severe. So I came to the Messenger of Allah ﷺ for a decision and told him. I found him in the house of my sister; Zaynab; daughter of Jahsh. I said: Messenger of Allah; I am a woman who menstruates in great quantity and it is severe; so what do you think about it? It has prevented me from praying and fasting. He said: I suggest that you should use cotton; for it absorbs the blood. She replied: It is too copious for that. He said: Then take a cloth. She replied: It is too copious for that; for my blood keeps flowing. The Messenger of Allah ﷺ said: I shall give you two commands; whichever of them you follow; that will be sufficient for you without the other; but you know best whether you are strong enough to follow both of them. He added: This is a stroke of the Devil; so observe your menses for six or seven days; Allah alone knows which it should be; then wash. And when you see that you are purified and quite clean; pray during twenty-three or twenty-four days and nights and fast; for that will be enough for you; and do so every month; just as women menstruate and are purified at the time of their menstruation and their purification. But if you are strong enough to delay the noon Zuhr prayer and advance the afternoon Asr prayer; to wash; and then combine the noon and the afternoon prayer; to delay the sunset prayer and advance the night prayer; to wash; and then combine the two prayers; do so: and to wash at dawn; do so: and fast if you are able to do so if possible.The Messenger of Allah ﷺ said: Of the two commands this is more to my liking.1Abu Dawud said: Amr Bin Thabit narrated from Ibn Aqil: Hamnah said: Of the two commands this is the one which is more to my liking.2 In this version these words were not quoted as the statement of the Prophet ﷺ ; it gives it as a statement of Hamnah.Abu Dawud said: Amr Bin Thabit was a Rafidi. MuwataMalik-017-001-34806Malik said; The generally agreed-on way of doing things in our community is that any setting-free which a man makes in a bequest that he wills in health or illness can be rescinded by him when he likes and changed when he likes as long as it is not a tadbir. There is no way to rescind a tadbir once he has made it. As for every child born to him by a slave-girl who he wills to be set free but he does not make mudabbara; her children are not freed with her when she is freed. That is because her master can change his will when he likes and rescind it when he likes; and being set free is not confirmed for her. She is in the position of a slave-girl whose master says; If so- and-so remains with me until I die; she is free. i.e. he does not make a definite contract. Malik said; If she fulfils that; that is hers. If he wishes; before that; he can sell her and her child because he has not entered her child into any condition he has made for her. The bequest in setting free is different from the tadbir. The precedent of the sunna makes a distinction between them. Had a bequest been in the position of a tadbir; no testator would be able to change his will and what he mentioned in it of setting free. His property would be tied up and he would not be able to use it. Malik said about a man who made all his slaves mudabbar while he was well and they were his only property; If he made some of them mudabbar before the others; one begins with the first until the third of his property is reached. i.e. their value is matched against the third; and those whose value is covered are free. If he makes the mall mudabbar in his illness; and says in one statement; So-and-so is free. So-and-so is free. So-and-so is free if my death occurs in this illness; or he makes them all mudabbar in one statement; they are matched against the third and one does not begin with any of them before the others. It is a bequest and they have a third of his property divided between them in shares. Then the third of his property frees each of them according to the extent of his share. No single one of them is given preference when that all occurs in his illness. Malik spoke about a master who made his slave a mudabbar and then he died and the only property he had was the mudabbar slave and the slave had property. He said; A third of the mudabbar is freed and his property remains in his possession. Malik said about a mudabbar whose master gave him a kitaba and then the master died and did not leave any property other than him; A third of him is freed and a third of his kitaba is reduced; and he owes two-thirds. Malik spoke about a man who freed half of his slave while he was ill and made irrevocable his freeing half of him or all of him; and he had made another slave of his mudabbar before that. He said; One begins with the slave he made mudabbar before the one he freed while he was ill. That is because the man cannot revoke what he has made mudabbar and cannot follow it with a matter which will rescind it. When this mudabbar is freed; then what remains of the third goes to the one who had half of him freed so as to complete his setting-free entirely in the third of the property of the deceased.
