Ibn Umar said: The Prophet ﷺ recited the Quranic verse: O Prophet; when you divorce women; divorce them in the beginning of their waiting period.Abu Dawud said: This tradition has been narrated by Yunus Bin Jubair; Anas Bin Seereen Bin Jubair; Zaid Bin Aslam; Abu AlZubair and Mansur from Abu Wail on the authority of Ibn Umar. They all agreed on the theme that the Prophet ﷺ commanded him to take her back and keep her till she was purified. Then if he desired; he might divorce her or keep her with him if he wanted to do so. The version narrated by AlZuhri from Salim from Nafi on the authority of Ibn Umar has: The Prophet ﷺ commanded him to take her back and keep her till she is purified; and then has menstrual discharge; and then she is purified. Then if he desires; he may divorce her and if he desires he may keep her.Abu Dawud said: A version like that of Nafi and AlZuhri has also been transmitted by Ata AlKhurasani from AlHasan on the authority of Ibn Umar. SunanAbuDawoud-017-001-25447 | Aisha said : We raised our voices in talbiyah for Hajj. When we reached Sarif; I menstruated. The Messenger of Allah SWAS came upon me while I was weeping. He asked; why are your weeping; Aishah? I replied; I menstruated. Would that I had not come out for performing Hajj. He said : Glory be to Allah; this is a thing prescribed by Allah on the daughters of Adam. He said perform all the rites of Hajj but do not go round the House the Kabah. When we entered Makkah; the Messenger of Allah SWAS said he who desires to make his Hajj an Umrah may do so; except those who have sacrificial animals with them. The Messenger of Allah SWAS sacrificed a cow on behalf of his wives on the day of sacrifice. When the night of AlBatha came; and Aisha was purified she said to the Messenger of Allah SWAS my fellow female pilgrims will return after performing Hajj and Umrah and I shall return after performing only Hajj? The Messenger of Allah ﷺ then commanded us that those who had not brought sacrificial animals withthem should put off their ihram after Umrah. We asked Which acts are lawful and which not ? He replied All acts are lawful that are permissible usually. We had therefore intercourse with our wives; used perfumes; put on our clothes. There remained only four days to perform Hajj at Arafat. We then raised our voice in talbiyah wearing Ihram for Hajj on the eighth of Dhu AlHijja. The Messenger of Allah ﷺ entered upon Aisha and found her weeping. He said What is the matter with you? My problem is that I have menstruated; while the people have put on their ihram but I have not done so; nor did I go round the House the Kabah. Now the people are proceeding for Hajj. He said This is a thing destined by Allah to the daughters of Adam. Take a bath; then raise your voice in talbiyah for Hajj i.e; wear ihram for Hajj. She took a abtah and performed all the rites of the Hajj lit. she stayed at all those places where the pilgrims stay. When she was purified; she circumambulated the House the Kabah ; and ran between AlSafa and AlMarwah. He the Prophet said Now you have performed both your Hajj and your Umrah. She said Messenger of Allah; I have some misgiving in my mind that I did not go round the Kabah when I performed Hajj in the beginning. I found him in the house of my sister; Zaynab; daughter of Jahsh. I said: Messenger of Allah; I am a woman who menstruates in great quantity and it is severe; so what do you think about it? It has prevented me from praying and fasting. He said: I suggest that you should use cotton; for it absorbs the blood. She replied: It is too copious for that. He said: Then take a cloth. She replied: It is too copious for that; for my blood keeps flowing. The Messenger of Allah ﷺ said: I shall give you two commands; whichever of them you follow; that will be sufficient for you without the other; but you know best whether you are strong enough to follow both of them. He added: This is a stroke of the Devil; so observe your menses for six or seven days; Allah alone knows which it should be; then wash. And when you see that you are purified and quite clean; pray during twenty-three or twenty-four days and nights and fast; for that will be enough for you; and do so every month; just as women menstruate and are purified at the time of their menstruation and their purification. But if you are strong enough to delay the noon Zuhr prayer and advance the afternoon Asr prayer; to wash; and then combine the noon and the afternoon prayer; to delay the sunset prayer and advance the night prayer; to wash; and then combine the two prayers; do so: and to wash at dawn; do so: and fast if you are able to do so if possible. The Messenger of Allah ﷺ said: Of the two commands this is more to my liking.1Abu Dawud said: Amr Bin Thabit narrated from Ibn Aqil: Hamnah said: Of the two commands this is the one which is more to my liking.2 In this version these words were not quoted as the statement of the Prophet ﷺ ; it gives it as a statement of Hamnah.Abu Dawud said: Amr Bin Thabit was a Rafidi. MuwataMalik-017-001-35230 | Yahya related to me from Malik that he heard Rabia Ibn Abi Abdulrahman say; I heard that the wife of Abdulrahman Ibn Awuf asked him to divorce her. He said; When you have menstruated and are pure; then come to me. She did not menstruate until Abdulrahman Ibn Awuf was ill. When she was purified; she told him and he divorced her irrevocably or made a pronouncement of divorce which was all that he had left over her Abd arRahman Ibn Awuf was terminally ill at the time; so Uthman Ibn Affan made her one of the heirs after the end of her idda. | The Chapter on Menstruation And Sexual Intercourse in HodHood Indexing, The Book of Marriage in Muwata Malik
MuwataMalik-017-001-35231 | Yahya related to me from Malik from Yahya Ibn Said that Muhammad Ibn Yahya Ibn Habban said; My grandfather Habban had two wives; one from the Hashimites and one from the Ansars. He divorced the Ansariya while she was nursing; and a year passed and he died and she had still not yet menstruated. She said; I inherit from him. I have not menstruated yet. The wives quarrelled and went to Uthman Ibn Affan. He decided that she did inherit; and the Hashimiya rebuked Uthman. He said; This is the practice of the son of your paternal uncle. He pointed this out to us. He meant Ali Ibn Abi Talib. | The Chapter on Inheritance And Killing in HodHood Indexing, The Book of Marriage in Muwata Malik
MuwataMalik-017-001-35469 | Malik was asked whether someone who went into a Masjid to do itikaf for the last ten days of Ramadan and stayed there for a day or two but then became ill and left the Masjid; had to do itikaf for the number of days that were left from the ten; or not; and if he did have to do so; then what month should he do it in; and he replied; He should make up whatever he has to do of the itikaf when he recovers; whether in Ramadan or otherwise. I have heard that the Messenger of Allah; may Allah bless him and grant him peace; once wanted to do itikaf in Ramadan; but then came back without having done so; and then when Ramadan had gone; he did itikaf for ten days in Shawal. Some one who does itikaf voluntarily in Ramadan and some one who has to do itikaf are in the same position regarding what is halal for them and what is haram. I have not heard that the Messenger of Allah; may Allah bless him and grant him peace; ever did itikaf other than voluntarily. Malik said; that if a woman did itikaf and then menstruated during her itikaf; she went back to her house; and; when she was pure again she returned to the Masjid; at whatever time it was that she became pure. She then continued her itikaf from where she left off. This was the same situation as with a woman who had to fast two consecutive months; and who menstruated and then became pure. She then continued the fast from where she had left off and did not delay doing so. | The Chapter on Ramadan And Fasting And Deeds in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35970 | Yahya related to me from Malik from Abu Rijal Muhammad Ibn Abdulrahman from Amra bint Abdulrahman that when Aisha umm Almuminin was doing hajj with women who were expecting their periods; she would hurry them to do the tawaf Alifada on the Day of Sacrifice. If they started to menstruate after the tawaf Alifada she did not stop for them but left with them while they were menstruating. | The Chapter on Menustration In Alhajj in HodHood Indexing, The Book of Fasting in Muwata Malik
MuwataMalik-017-001-35972 | Yahya related to me from Malik from Abdullah Ibn Abi Bakr from his father that Abu Salama Ibn Abdulrahman told him that Umm Sulaym bint Milhan asked the Messenger of Allah; may Allah bless him and grant him peace; for advice one time when she had begun menstruating; or had given birth to a child after she had done tawaf Alifada on the Day of Sacrifice. The Messenger of Allah; may Allah bless him and grant him peace; gave her permission to leave. Malik said; A woman menstruating at Mina stays until she has done tawaf of the House. There is no escape from that for her. If she has already done the tawaf Alifada and she starts to menstruate afterwards; she may leave for her country; since permission for the menstruating women to leave has been transmitted to us from the Messenger of Allah; may Allah bless him and grant him peace. He added; If a woman starts her period at Mina before she does the tawaf Alifada; and the period lasts longer than usual; she has to stay longer than the time that bleeding would usually detain women. | The Chapter on Menstruation And Tawaf in HodHood Indexing, The Book of Fasting in Muwata Malik
MuwataMalik-017-001-36184 | Yahya related to me from Malik from Hisham Ibn Urwa that his father said; A woman who bleeds as if menstruating only has to do one ghusl; and then after that she does Ablution for each prayer. Yahya said that Malik said; The position with us is that when a woman who bleeds as if menstruating starts to do the prayer again; her husband can have sexual intercourse with her. Similarly; if a woman who has given birth sees blood after she has reached the fullest extent that bleeding normally restrains women; her husband can have sexual intercourse with her and she is in the same position as a woman who bleeds as if menstruating. Yahya said that Malik said; The position with us concerning a woman who bleeds as if menstruating is founded on the hadith of Hisham Ibn Urwa from his father; and it is what I prefer the most of what I have heard about the matter. | The Chapter on Menstruation And Fasting in HodHood Indexing, The Book of The Quran in Muwata Malik |
