And if any has not (the wherewithal), he should fast for two months consecutively before they touch each other. But if any is unable to do so, he should feed sixty indigent ones, this, that ye may show your faith in Allah and His Messenger. Those are limits (set by) Allah. For those who reject (Him), there is a grievous Penalty.
The prohibited month for the prohibited month, - and so for all things prohibited, - there is the law of equality. If then any one transgresses the prohibition against you, Transgress ye likewise against him. But fear Allah, and know that Allah is with those who restrain themselves.
They ask thee concerning fighting in the Prohibited Month. Say: "Fighting therein is a grave (offence); but graver is it in the sight of Allah to prevent access to the path of Allah, to deny Him, to prevent access to the Sacred Mosque, and drive out its members." Tumult and oppression are worse than slaughter. Nor will they cease fighting you until they turn you back from your faith if they can. And if any of you Turn back from their faith and die in unbelief, their works will bear no fruit in this life and in the Hereafter; they will be companions of the Fire and will abide therein.
Verily the transposing (of a prohibited month) is an addition to Unbelief: the Unbelievers are led to wrong thereby: for they make it lawful one year, and forbidden another year, in order to adjust the number of months forbidden by Allah and make such forbidden ones lawful. The evil of their course seems pleasing to them. But Allah guideth not those who reject Faith.
Such of your women as have passed the age of monthly courses, for them the prescribed period, if ye have any doubts, is three months, and for those who have no courses (it is the same): for those who carry (life within their wombs), their period is until they deliver their burdens: and for those who fear Allah, He will make their path easy.

O ye who believe! Violate not the sanctity of the symbols of Allah, nor of the sacred month, nor of the animals brought for sacrifice, nor the garlands that mark out such animals, nor the people resorting to the sacred house, seeking of the bounty and good pleasure of their Lord. But when ye are clear of the sacred precincts and of pilgrim garb, ye may hunt and let not the hatred of some people in (once) shutting you out of the Sacred Mosque lead you to transgression (and hostility on your part). Help ye one another in righteousness and piety, but help ye not one another in sin and rancour: fear Allah: for Allah is strict in punishment.

On that he said; Fast for three days every month and recite the Quran and finish it in one month. I said; But I have power to do more than that. He said; Then fast for three days per week. I said; i have the power to do more than that. He said; Therefore; fast the most superior type of fasting; that is; the fasting of prophet David who used to fast every alternate day; and finish the recitation of the whole Quran In seven days. I wish I had accepted the permission of Allah Messenger ﷺ as I have become a weak old man. It is said that Abdullah used to recite one-seventh of the Quran during the day-time to some of his family members; for he used to check his memorization of what he would recite at night during the daytime so that it would be easier for him to read at night. And whenever he wanted to gain some strength; he used to give up fasting for some days and count those days to fast for a similar period; for he disliked to leave those things which he used to do during the lifetime of the Prophet. The Chapter on Recitation Of Ayat in HodHood Indexing, Chapter on What is the proper period for reciting the whole Quran in Sahih AlBukhari

SahihAlBukhari-017-001-376Narrated Aasi m: I asked Anas Bin Malik about the Qunut. Anas replied; Definitely it was recited. I asked; Before bowing or after it? Anas replied; Before bowing. I added; So and so has told me that you had informed him that it had been after bowing. Anas said; He told an untruth i.e. was mistaken; according to the Hijazi dialect. Allah Messenger ﷺ recited Qunut after bowing for a period of one month. Anas added; The Prophet ﷺ sent about seventy men who knew the Quran by heart towards the pagans of Najd who were less than they in number and there was a peace treaty between them and Allah Messenger ﷺ but the Pagans broke the treaty and killed the seventy men. So Allah Messenger ﷺ recited Qunut for a period of one month asking Allah to punish them. The Chapter on Recitation Of Ayat in HodHood Indexing, Chapter on To recite Qunut before and after bowing in Sahih AlBukhari
SahihAlBukhari-017-001-4212Narrated Abdullah Bin Amr: Allah Messenger ﷺ was informed that I have said: By Allah; I will fast all the days and pray all the nights as long as I live. On that; Allah Messenger ﷺ asked me. Are you the one who says: I will fast all the days and pray all the nights as long as I live? I said; Yes; I have said it. He said; You cannot do that. So fast sometimes and do not fast sometimes. Pray and sleep. Fast for three days a month; for the reward of a good deed is multiplied by ten time; and so the fasting of three days a month equals the fasting of a year. I said; O Allah Messenger ﷺ ! I can do fast more than this. He said; Fast on every third day. I said: I can do fast more than that; He said: Fast on alternate days and this was the fasting of David which is the most moderate sort of fasting. I said; O Allah Messenger ﷺ ! SahihAlBukhari-017-001-5115Narrated Abdullah Bin Abbas: I had been eager to ask Umar about the two ladies from among the wives of the Prophet ﷺ regarding whom Allah said in the Quran saying : If you two wives of the Prophet ﷺ namely Aisha and Hafsa turn in repentance to Allah your hearts are indeed so inclined to oppose what the Prophet ﷺ likes 66.4 ; till performed the Hajj along with Umar and on our way back from Hajj he went Aasi de to answer the call of nature and I also went Aasi de along with him carrying a tumbler of water. When he had answered the call of nature and returned. I poured water on his hands from the tumbler and he performed ablution. I said; O Chief of the believers! Who were the two ladies from among the wives of the Prophet ﷺ to whom Allah said: If you two return in repentance 66.4 ? He said; I am astonished at your question; O Ibn Abbas. They were Aisha and Hafsa. Then Umar went on relating the narration and said. I and an Ansari neighbor of mine from Bani Umaiya Bin Zaid who used to live in Awali AlMedina; used to visit the Prophet ﷺ in turns. He used to go one day; and I another day. When I went I would bring him the news of what had happened that day regarding the instructions and orders and when he went; he used to do the same for me. We; the people of Quraish; used to have authority over women; but when we came to live with the Ansar; we noticed that the Ansari women had the upper hand over their men; so our women started acquiring the habits of the Ansari women. Once I shouted at my wife and she paid me back in my coin and I disliked that she should answer me back. She said; Why do you take it ill that I retort upon you? By Allah; the wives of the Prophet ﷺ retort upon him; and some of them may not speak with him for the whole day till night. What she said scared me and I said to her; Whoever amongst them does so; will be a great loser. Then I dressed myself and went to Hafsa and asked her; Does any of you keep Allah Messenger ﷺ angry all the day long till night? She replied in the affirmative. I said; She is a ruined losing person and will never have success ! Doesnt she fear that Allah may get angry for the anger of Allah Messenger ﷺ and thus she will be ruined? Dont ask Allah Messenger ﷺ too many things; and dont retort upon him in any case; and dont desert him. Demand from me whatever you like; and dont be tempted to imitate your neighbor i.e. Aisha in her behavior towards the Prophet ; for she i.e. Aisha is more beautiful than you; and more beloved to Allah Messenger ﷺ. In those days it was rumored that Ghassan; a tribe living in Sham was getting prepared their horses to invade us. My companion went to the Prophet ﷺ on the day of his turn; went and returned to us at night and knocked at my door violently; asking whether I was sleeping. I was scared by the hard knocking and came out to him. He said that a great thing had happened. I asked him: What is it? Have Ghassan come? He replied that it was worse and more serious than that; and added that Allah Apostle had divorced all his wives. I said; Hafsa is a ruined loser! I expected that would happen some day. So I dressed myself and offered the Fajr prayer with the Prophet. Then the Prophet ﷺ entered an upper room and stayed there alone. I went to Hafsa and found her weeping. I asked her; Why are you weeping? Didnt I warn you? Have Allah Messenger ﷺ divorced you all? She replied; I dont know. He is there in the upper room. I then went out and came to the pulpit and found a group of people around it and some of them were weeping. Then I sat with them for some time; but could not endure the situation. So I went to the upper room where the Prophet ﷺ was and requested to a black slave of his: Will you get the permission of Allah Apostle for Umar to enter ? The slave went in; talked to the Prophet ﷺ about it and came out saying; I mentioned you to him but he did not reply. So; I went and sat with the people who were sitting by the pulpit; but I could not bear the situation; so I went to the slave again and said: Will you get he permission for Umar? He went in and brought the same reply as before. When I was leaving; behold; the slave called me saying; Allah Messenger ﷺ has granted you permission. So; I entered upon the Prophet and saw him lying on a mat without wedding on it; and the mat had left its mark on the body of the Prophet; and he was leaning on a leather pillow stuffed with palm fires. I greeted him and while still standing; I said: Have you divorced your wives? He raised his eyes to me and replied in the negative. And then while still standing; I said chatting: Will you heed what I say; O Allah Messenger ﷺ ! We; the people of Quraish used to have the upper hand over our women wives ; and when we came to the people whose women had the upper hand over them... Umar told the whole story about his wife. On that the Prophet ﷺ smiled. Umar further said; I then said; I went to Hafsa and said to her: Do not be tempted to imitate your companion Aisha for she is more beautiful than you and more beloved to the Prophet. The Prophet ﷺ smiled again. When I saw him smiling; I sat down and cast a glance at the room; and by Allah; I couldnt see anything of importance but three hides. I said to Allah Messenger ﷺ Invoke Allah to make your followers prosperous for the Persians and the Byzantines have been made prosperous and given worldly luxuries; though they do not worship Allah? The Prophet ﷺ was leaning then and on hearing my speech he sat straight and said; O Ibn AlKhattab! Do you have any doubt that the Hereafter is better than this world ? These people have been given rewards of their good deeds in this world only. I asked the Prophet ﷺ. Please ask Allah forgiveness for me. The Prophet ﷺ did not go to his wives because of the secret which Hafsa had disclosed to Aisha; and he said that he would not go to his wives for one month as he was angry with them when Allah admonished him for his oath that he would not approach Maria. When twenty-nine days had passed; the Prophet ﷺ went to Aisha first of all. She said to him; You took an oath that you would not come to us for one month; and today only twenty-nine days have passed; as I have been counting them day by day. The Prophet ﷺ said; The month is also of twenty-nine days. That month consisted of twenty-nine days. Aisha said; When the Divine revelation of Choice was revealed; the Prophet ﷺ started with me; saying to me; I am telling you something; but you need not hurry to give the reply till you can consult your parents. Aisha knew that her parents would not advise her to part with the Prophet ﷺ. The Prophet ﷺ said that Allah had said: O Prophet! Say To your wives; If you desire The life of this world And its glitter;... then come! I will make a provision for you and set you free In a handsome manner. But if you seek Allah And His Apostle; and The Home of the Hereafter; then Verily; Allah has prepared For the good-doers amongst you A great reward. 33.28 Aisha said; Am I to consult my parents about this? I indeed prefer Allah; His Apostle; and the Home of the Hereafter. SahihAlBukhari-017-001-5174Narrated Abu Saeed AlKhudri: Allah Messenger ﷺ used to practice Itikaf in the Masjid in the middle third of Ramadan and after passing the twenty nights he used to go back to his house on the 21st; and the people who were in Itikaf with him also used to go back to their houses. Once in Ramadan; in which he practiced Itikaf; he established the night prayers at the night in which he used to return home; and then he addressed the people and ordered them whatever Allah wished him to order and said; I used to practice Itikaf for these ten days i.e. the middle third but now I intend to stay in Itikaf for the last ten days of the month ; so whoever was in Itikaf with me should stay at his place of seclusion. I have verily been shown the date of this Night of Qadr but I have forgotten it. So search for it in the odd nights of the last ten days of this month. I also saw myself in the dream prostrating in mud and water. On the night of the 21st; the sky was covered with clouds and it rained; and the rainwater started leaking through the roof of the Masjid at the praying place of the Prophet ﷺ. SahihMuslim-017-001-17336Abu Bakra reported that in the Farewell Address Allah Apostle ﷺ said: Time has completed a cycle and come to the state of the day when Allah created the heavens and the earth. The year is constituted of twelve months; of which four are sacred; three of them consecutive; viz. Dh AlQada; Dhu AlHijja and Muharram; and also Rajab the month of Mudar which comes between Jumada and Shaban. He the Holy Prophet then said: which month is this? We said Allah and His Messenger know best. He the narrator said: He the Holy Prophet remained silent for some time until we thought that he would give it a name other than that by which it was known. He said: Is it not Dhal-Hijja? We said: Yes. He the Holy Prophet said: Which city is this? We said: Allah and His Messenger know best. He the Holy Prophety remained silent until we thought that he would give it another name. He the Holy Prophet said: Is it not the Balda the city of Mecca ? We said: Yes. He said: What day is this? We said: Allah and His Messenger know best. He the Holy Prophet remained silent until we thought that he would give it another name. He said: Is it not the Day of Sacrifice? We said: Allah Messenger. yes. Thereupon he said: Your blood; your property Muhammad; one of the narrators; said: I think; he also said this and your honour are sacred to you like the sacredness of this day of yours; in this city of yours; and in this month of yours. You will soon meet your Lord and He will ask you about your deeds. So do not turn after me unbelievers or misguided ; some of you striking the necks of the others. Behold I let him who is present convey to him who is absent; for many a one whom a message is conveyed has a more retentive memory than one who hears. He again said: Behold! have I not delivered the message to you? SahihMuslim-017-001-17450Jabir Bin Abdullah reported: Allah Messenger may peace he upon him sent us on an expedition. We were three hundred riders and our chief leader was Ubaida Bin AlJarrah. We were on the look out for a caravan of the Quraish. So we stayed on the coast for half a month; and were so much afflicted by extreme hunger that we were obliged to eat leaves. That is why it was called the Detachment of the Leaves. The ocean cast out for us an animal which was called AlAnbar whale. We ate of that for half of the month and rubbed its fat on our bodies until our bodies became stout. Abu Ubaida caught hold of one of its ribs and fixed that up. He then cast a glance at the tallest man of the army and the highest of the camels. and then made him ride over that; and that-tnan passed beneath it the rib ; and many a man could sit in its eye-socket; and we extracted many pitchers of fat from the cavity of its eye. We had small bags containing dates with us before finding the whale. Ubaida gave every person amongst us a handful of dates and when the provision ran short ; he then gave each one of us one date. And when that stock was exhausted; we felt its loss. The Chapter on Lost And Found And Dates in HodHood Indexing, Chapter on 4 in Sahih Muslim
SahihMuslim-017-001-18043It is narrated on the authority of Urwa Bin AlZubair who narrated from Aisha that she informed him that Fatima; daughter of the Messenger of Allah ﷺ ; sent someone to Abu Bakr to demand from him her share of the legacy left by the Messenger of Allah ﷺ from what Allah had bestowed upon him at Medina and Fadak and what was left from one-filth of the income annually received from Khaibar. Abu Bakr said: The Messenger of Allah ﷺ said: We prophets do not have any heirs; what we leave behind is to be given in charity. The household of the Messenger of Allah ﷺ will live on the income from these properties; but; by Allah; I will not change the charity of the Messenger of Allah ﷺ from the condition in which it was in his own time. I will do the same with it as the Messenger of Allah may peace be upun him himself used to do. So Abu Bakr refused to hand over anything from it to Fatima who got angry with Abu Bakr for this reason. She forsook him and did not talk to him until the end of her life. She lived for six months after the death of the Messenger of Allah ﷺ. When she died; her husband. Ali Bin Abu Talib; buried her at night. He did not inform Abu Bakr about her death and offered the funeral prayer over her himself. During the lifetime of Fatima; All received special regard from the people. After she had died; he felt estrangement in the faces of the people towards him. So he sought to make peace with Abu Bakr and offer his allegiance to him. He had not yet owed allegiance to him as Caliph during these months. He sent a person to Abu Bakr requesting him to visit him unaccompanied by anyone disapproving the presence of Umar. Umar said to Abu Bakr: BY Allah; you will not visit them alone. Abu Bakr said: What will they do to me? By Allah; I will visit them. And he did pay them a visit alone. All recited Tashahhud as it is done in the beginning of a religious sermon ; then said: We recognise your moral excellence and what Allah has bestowed upon you. We do not envy the favour i. e. the Catiphate which Allah nas conferred upon you; but you have done it assumed the position of Caliph alone without consulting us ; and we thought we had a right to be consulted on account of our kinship with the Messenger of Allah ﷺ. He continued to talk to Abu Bakr in this vein until the latter eyes welled up with tears. Then Abd Bakr spoke and said: By Allah; in Whose Hand is my life; the kinship of the Messenger of Allah ﷺ is dearer to me than the kinship of my own people. As regards the dispute that has arisen between you and me about these properties; I have not deviated from the right course and I have not given up doing about them what the Messenger of Allah ﷺ used to do. So Ali said to Abu Bakr: This aftetnoon is fixed for swearing allegiance to you. So when Abu Bakr had finished his Zuhr prayer; he ascended the pulpit and recited Tashahhud; and described the status of Ali; his delay in swearing allegiance and the excuse which lie had offered to him for this delay. After this he asked for God forgiveness. Then Ali Bin Abu Talib recited the Tashahhud. extolled the merits of Abu Bakr and said that his action was nott prompted by any jealousy of Abu Bakr on his part or his refusal to accept the high position which Allah had conferred upon him; adding: But we were of the opinion that we should have a share in the government; but the matter had been decided without taking us into confidence; and this displeased us. Hence the delay in offering allegiance. The Muslims were pleased with this explanation and they said: You have done the right thing. I said: Apostle of Allah; I am capable of doing more than this. He said: Your wife has a right upon you; your visitor has a right upon you; your body has a right upon you; so observe the fast of David; the Messenger of Allah ﷺ ; for he was the best worshipper of Allah. Abdullah said: He should not perform tayammum even if he does not find water for a month. Abdullah said: Then what about the verse in Surat Maida: If you do not find water; betake yourself to clean dust? Abdullah said: If they were granted concession on the basis of this verse; there is a possibility that they would perform tayammum with dust on finding water very cold for themselves. Abu Mousa said to Abdullah: You have not heard the words of Ammar: The Messenger of Allah ﷺ sent me on an errand and I had a seminal emission; but could find no water; and rolled myself in dust just as a beast rolls itself. When the sixth remaining night came; he did not make us get up for prayer. When the fifth remaining night came; he made us stand in prayer till a half of the night had gone. She asked for some yellow perfume containing saffron khaluq or something else. Then she applied it to a girl and touched her cheeks. She said: I have no need of perfume; but I heard the Messenger of Allah ﷺ say: It is not lawful for a woman who believes in Allah and the Last Day to observe mourning for one who has died; more than three nights; except for four months and ten days in the case of a husband. Zaynab said: I also visited Zaynab; daughter of Jahsh; when her brother died. She asked for some perfume and used it upon herself. She then said: I have no need of perfume; but I heard the Messenger of Allah ﷺ say when he was on the pulpit: It is not lawful for a woman who believes in Allah and the Last Day to observe mourning for one who has died; more than three nights; except for four months and ten days in the case of a husband. Zaynab said: I heard my mother; Umm Salamah; say: A woman came to the Messenger of Allah ﷺ and said: Messenger of Allah; the husband of my daughter has died; and she is suffering from sore eyes; may we put antimony in her eyes? The Messenger of Allah ﷺ said: No. He said this twice or thrice. Each time he said: No. The Messenger of Allah ﷺ said: The waiting period is now four months and ten days. In pre-Islamic days one of you used to throw away a piece of dung at the end of a year. Humayd said: I asked Zaynab: What do you mean by throwing away a piece of dung at the end of a year. Zaynab replied: When the husband of a woman died; she entered a small cell and put on shabby clothes; not touching perfume or any other thing until a year passed. Then an animal such as donkey or sheep or bird was provided for her. She rubbed herself with it. The animal with which she rubbed herself rarely survived. MuwataMalik-017-001-34777Malik related to me that he had heard that Uthman Ibn Affan was brought a woman who had given birth after six months and he ordered her to be stoned. Ali Ibn Abi Talib said to him; She does not deserve that. Allah; the Blessed; the Exalted; says in His Book; Their carrying and weaning is thirty months; Surat 46 ayat 15 and he said; Mothers suckle their children for two full years for whoever wishes to complete the suckling. Surat 2 ayat 233 Pregnancy can then be six months; so she does not deserve to be stoned. Uthman Ibn Affan sent for her and found that she had already been stoned. Malik related to me that he asked Ibn Shihab about someone who committed sodomy. Ibn Shihab said; He is to be stoned; whether or not he is muhsan. The Chapter on Recitation Of Ayat in HodHood Indexing, The Book of Renting Land in Muwata Malik
MuwataMalik-017-001-34875Malik said that he had heard that Said Ibn AlMusayab and Sulayman Ibn Yasar were asked; Does one deal more harshly in taking the blood-money in the sacred month? They said; No. But it is increased in it because of violating the month. It was said to Said; Does one increase for the wound as one increases for the life? He said; Yes. Malik added; I think that they meant the same as what Umar Ibn AlKhattab did with respect to the blood-money of the Mudliji when he struck his son. i.e. giving 120 camels instead of 100.The Chapter on Wounds In Crimes And Felonies in HodHood Indexing, The Book of General Subjects in Muwata Malik
MuwataMalik-017-001-34889Yahya said that he heard Malik say; The best of what I have heard about the testament of a pregnant woman and about what settlements she is permitted in her property is that the pregnant woman is like the sick person. When the illness is light; and one does not fear for the sick person; he does with his property what he likes. If the illness is such that his life is feared for; he can only dispose of a third of his estate. He said; It is the same with a woman who is pregnant. The beginning of pregnancy is good news and joy. It is not illness and no fear because Allah the Blessed; the Exalted; said in His Book; We gave her good news of Ishaq and after Ishaq; Yaqub. Surat ll ayat 71. And He said; She bore a light burden and passed by with it; but when she became heavy; they called upon Allah; their Lord; If you give us a good-doing son; we will be among the thankful. Surat 7 ayat 189. When a pregnant woman becomes heavy; she is only permitted to dispose of a third of her estate. The beginning of this restriction is after six months. Allah; the Blessed; the Exalted; said in His Book; Mothers suckle their children for two complete years. And He said; his bearing and weaning are thirty months. Surat 2 ayat 233. When six months have passed for the pregnant woman from the day she conceived; she is only permitted to dispose of a third of her property. Yahya said that he heard Malik say; A man who is advancing in the row for battle; can only dispose of a third of his property. He is in the same position as a pregnant woman or an ill person who is feared for; as long as he is in that situation. The Chapter on Recitation Of Ayat in HodHood Indexing, The Book of Hair in Muwata Malik
MuwataMalik-017-001-34928Malik related to me from Yazid Ibn Abdullah Ibn AlHadi from Muhammad Ibn Ibrahim Ibn AlHarith AlTaymi from Sulayman Ibn Yasar from Abdullah Ibn Abi Umaya that a woman husband died; and she did the idda of four months and ten days. Then she married when she was free to marry. She stayed with her husband for four and a half months; then gave birth to a fully developed child. Her husband went to Umar Ibn AlKhattab and mentioned that to him; so Umar called some of the old women of the Aljahiliya and asked them about that. One of the women said; I will tell you what happened with this woman. When her husband died; she was pregnant by him; but then the blood flowed from her because of his death and the child became dry in her womb. When her new husband had intercourse with her and the water reached the child; the child moved in the womb and grew. Umar Ibn AlKhattab believed her and separated them until she had completed her idda. Umar said; Only good has reached me about you two; and he connected the child to the first husband. The Chapter on Marriage And Pregnancy in HodHood Indexing, The Book of The Description of the Prophet may Allah Bless Him and Grant Him Peace in Muwata Malik
MuwataMalik-017-001-35203Yahya related to me from Malik from Nafi that Abdullah Ibn Umar said; When a man makes a vow to abstain from intercourse with his wife and four months have passed he must declare his intent and either he is divorced or he revokes his vow. Divorce does not occur until four months have passed and he continues to abstain. The Chapter on Wives And Relationship Sexual Intercourse in HodHood Indexing, The Book of Marriage in Muwata Malik
MuwataMalik-017-001-35205Yahya related to me from Malik that he had heard that Marwan Ibn AlHakam decided about a man who had made a vow to abstain from intercourse with his wife; that when four months had passed; it was a divorce and he could return to her as long as she was in her idda. Malik added; That was also the opinion of Ibn Shihab. Malik said that if a man made a vow to abstain from intercourse with his wife and at the end of four months he declared his intent to continue to abstain; he was divorced. He could go back to his wife; but if he did not have intercourse with her before the end of her idda; he had no access to her and he could not go back to her unless he had an excuse - illness; imprisonment; or a similar excuse. His return to her maintained her as his wife. If her idda passed and then he married her after that and did not have intercourse with her until four months had passed and he declared his intent to continue to abstain; divorce was applied to him by the first vow. If four months passed; and he had not returned to her; he had no idda against her nor access because he had married her and then divorced her before touching her. Malik said that a man who made a vow to abstain from intercourse with his wife and continued to abstain after four months and so divorced her; but then returned and did not touch her and four months were completed before her idda was completed; did not have to declare his intent and divorce did not befall him. If he had intercourse with her before the end of her idda; he was entitled to her. If her idda passed before he had intercourse with her; he had no access to her. This is what Malik preferred of what he had heard on the subject. Malik said that if a man made a vow to abstain from intercourse with his wife and then divorced her; and the four months of the vow were completed before completion of the idda of the divorce; it counted as two pronouncements of divorce. If he declared his intention to continue to abstain and the idda of the divorce finished before the four months the vow of abstention was not a divorce. That was because the four months had passed and she was not his on that day. Malik said; If someone makes a vow not to have intercourse with his wife for a day or a month and then waits until more than four months have passed; it is not ila. Ila only applies to someone who vows more than four months. As for the one who vows not to have intercourse with his wife for four months or less than that; I do not think that it is ila because when the term enters into it at which it stops; he comes out of his oath and he does not have to declare his intention. Malik said; If someone vows to his wife not to have intercourse with her until her child has been weaned; that is not ila. I have heard that Ali Ibn Abi Talib was asked about that and he did not think that it was ila.The Chapter on Wives And Relationship Sexual Intercourse in HodHood Indexing, The Book of Marriage in Muwata Malik
MuwataMalik-017-001-35260Yahya related to me from Malik from Yahya Ibn Said and from Yazid Ibn Abdullah Ibn Qusayt AlLaythi that Said Ibn AlMusayab said; Umar Ibn AlKhattab said; If a woman is divorced and has one or two periods and then stops menstruating; she must wait nine months. If it is clear that she is pregnant; that is that. If not; she must do an idda of three months after the nine; and then she is free to marry. The Chapter on Freed And Inheritance Of Slaves in HodHood Indexing, The Book of Qirad in Muwata Malik
MuwataMalik-017-001-35262Yahya related to me from Malik from Ibn Shihab that Said Ibn AlMusayab said; The idda of the woman who bleeds constantly is a year. Malik said; What is done among us about a divorced woman whose periods stop when her husband divorces her is that she waits nine months. If she has not had a period in them; she has an idda of three months. If she has a period before the end of the three months; she accepts the period. If another nine months pass without her having a period; she does an idda of three months. If she has a second period before the end of those three months; she accepts the period. If nine months then pass without a period; she does an idda of three months. If she has a third period; the idda of the period is complete. If she does not have a period; she waits three months; and then she is free to marry. Her husband can return to her before she becomes free to marry unless he made her divorce irrevocable. Malik said; The sunna with us is that when a man divorces his wife and has the option to return to her; and she does part of her idda and then he returns to her and then parts from her before he has had intercourse with her; she does not add to what has passed of her idda. Her husband has wronged himself and erred if he returned to her and had no need of her. Malik said; What is done among us is that if a woman becomes a muslim while her husband is a kafir and then he becomes muslim; he is entitled to her as long as she is in her idda. If her idda is finished; he has no access to her. If he remarries her after the end of her idda; however; that is not counted as divorce. Islam removed her from him without divorce. The Chapter on Marriage And Entitlements in HodHood Indexing, The Book of Qirad in Muwata Malik
MuwataMalik-017-001-35289Yahya related to me the like of that from Malik from Ibn Shihab. Malik said; about a slave who divorced a slave-girl but did not make it absolute; He can return to her. If he then dies while she is still in the idda from her divorce; she does the idda of a slave- girl whose husband dies; and it is two months and five days. If she has been set free and he can return to her; and she does not choose to separate after she has been set free; and he dies while she is in the idda from the divorce; she does the idda of a free woman whose husband has died; four months and ten days. That is because the idda of widowhood befell her while she was free; so her idda is the idda of a free woman. Malik said; That is what is done among us.The Chapter on Marriage And Entitlements in HodHood Indexing, The Book of Sacrificial Animals in Muwata Malik
MuwataMalik-017-001-35352Malik related to me from Ibn Shihab that he had heard that in the time of the Messenger of Allah; may Allah bless him and grant him peace; women were becoming muslim in their own lands and they did not do hijra while their husbands were still kafirun although they themselves had become muslim. Among them was the daughter of AlWalid Ibn AlMughira and she was the wife of Safwan Ibn Umaya. She became muslim on the day of the conquest of Makka ; and her husband; Safwan Ibn Umaya fled from Islam. The Messenger of Allah; may Allah bless him and grant him peace; sent Safwan paternal cousin; Wahb Ibn Umayr with the cloak of the Messenger of Allah; may Allah bless him and grant him peace; as a safe-conduct for Safwan Ibn Umaya; and the Messenger of Allah; may Allah bless him and grant him peace; called him to Islam and asked for him to come to him and if he was pleased with the matter to accept it. If not he would have a respite for two months. When Safwan came to the Messenger of Allah; may Allah bless him and grant him peace; with his cloak; he called out to him over the heads of the people; Muhammad! Wahb Ibn Umayr brought me your cloak and claimed that you had summoned me to come to you and if I was pleased with the matter; I should accept it and if not; you would give me a respite for two months. The Messenger of Allah; may Allah bless him and grant him peace; said; Come down; Abu Wahb. He said; No; by Allah! I will not come down until you make it clear to me. The Messenger of Allah; may Allah bless him and grant him peace; said; You have a respite of four months. The Messenger of Allah; may Allah bless him and grant him peace; went out toward Hawazin at Hunayn. He sent to Safwan Ibn Umaya to borrow some equipment and arms that he had. Safwan said; Willingly or unwillingly? He said; Willingly. Therefore he lent him the equipment and arms which he had. Then Safwan went out with the Messenger of Allah; may Allah bless him and grant him peace; while he was still a kafir. He was present at the battles of Hunayn and AlTaif while he was still a kafir and his wife was a muslim. The Messenger of Allah; may Allah bless him and grant him peace; did not separate Safwan and his wife until he had become muslim; and his wife was settled with him by that marriage. The Chapter on Peace And Makkah in HodHood Indexing, The Book of Vows and Oaths in Muwata Malik
MuwataMalik-017-001-35469Malik was asked whether someone who went into a Masjid to do itikaf for the last ten days of Ramadan and stayed there for a day or two but then became ill and left the Masjid; had to do itikaf for the number of days that were left from the ten; or not; and if he did have to do so; then what month should he do it in; and he replied; He should make up whatever he has to do of the itikaf when he recovers; whether in Ramadan or otherwise. I have heard that the Messenger of Allah; may Allah bless him and grant him peace; once wanted to do itikaf in Ramadan; but then came back without having done so; and then when Ramadan had gone; he did itikaf for ten days in Shawal. Some one who does itikaf voluntarily in Ramadan and some one who has to do itikaf are in the same position regarding what is halal for them and what is haram. I have not heard that the Messenger of Allah; may Allah bless him and grant him peace; ever did itikaf other than voluntarily. Malik said; that if a woman did itikaf and then menstruated during her itikaf; she went back to her house; and; when she was pure again she returned to the Masjid; at whatever time it was that she became pure. She then continued her itikaf from where she left off. This was the same situation as with a woman who had to fast two consecutive months; and who menstruated and then became pure. She then continued the fast from where she had left off and did not delay doing so.The Chapter on Ramadan And Fasting And Deeds in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35522Yahya related to me; and I myself heard Malik say; The best that I have heard about some one who has to fast for two consecutive months because of having killed someone by mistake or having pronounced the dhihar form of divorce; becoming very ill and having to break his fast; is that if he recovers from his illness and is strong enough to fast; he must not delay doing so. He continues his fast from where he left off. Similarly; a woman who has to fast because of having killed some one by mistake should not delay resuming her fast when she has become pure after her period. She continues her fast from where she left off. No one who; by the Book of Allah; has to fast for two consecutive months may break his fast except for a reason - illness or menstruation. He must not travel and break his fast. Malik said; This is the best that I have heard about the matter. The Chapter on Menstruation And Fasting in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-36181Yahya related to me from Malik from Nafi from Sulayman Ibn Yasarfrom Umm Salamah; the wife of the Prophet; may Allah bless him and grant him peace; that a certain woman in the time of the Messenger of Allah; may Allah bless him and grant him peace; used to bleed profusely; so Umm Salamah consulted the Messenger of Allah; may Allah bless him and grant him peace; for her; and he said; She should calculate the number of nights and days a month that she used to menstruate before it started happening; and she should leave off from prayerfor that much of the month. When she has completed that she should do ghusl; bind her private parts with a cloth; and then pray. The Chapter on Granting Peace in HodHood Indexing, The Book of The Quran in Muwata Malik
