When ye deal with each other, in transactions involving future obligations in a fixed period of time, reduce them to writing Let a scribe write down faithfully as between the parties: let not the scribe refuse to write: as Allah Has taught him, so let him write. Let him who incurs the liability dictate, but let him fear His Lord Allah, and not diminish aught of what he owes. If they party liable is mentally deficient, or weak, or unable Himself to dictate, Let his guardian dictate faithfully, and get two witnesses, out of your own men, and if there are not two men, then a man and two women, such as ye choose, for witnesses, so that if one of them errs, the other can remind her. The witnesses should not refuse when they are called on (For evidence). Disdain not to reduce to writing (your contract) for a future period, whether it be small or big: it is juster in the sight of Allah, More suitable as evidence, and more convenient to prevent doubts among yourselves but if it be a transaction which ye carry out on the spot among yourselves, there is no blame on you if ye reduce it not to writing. But take witness whenever ye make a commercial contract; and let neither scribe nor witness suffer harm. If ye do (such harm), it would be wickedness in you. So fear Allah; For it is Good that teaches you. And Allah is well acquainted with all things. If ye are on a journey, and cannot find a scribe, a pledge with possession (may serve the purpose). And if one of you deposits a thing on trust with another, let the trustee (faithfully) discharge his trust, and let him Fear his Lord conceal not evidence; for whoever conceals it, - his heart is tainted with sin. And Allah knoweth all that ye do.

SahihAlBukhari-017-001-1086 | Narrated Abdullah Bin Masud: Allah Messenger ﷺ the true and truly inspired; narrated to us; The creation of everyone of you starts with the process of collecting the material for his body within forty days and forty nights in the womb of his mother. Then he becomes a clot of thick blood for a similar period 40 days and then he becomes like a piece of flesh for a similar period. Then an angel is sent to him by Allah and the angel is allowed ordered to write four things; his livelihood; his date of death; his deeds; and whether he will be a wretched one or a blessed one in the Hereafter and then the soul is breathed into him. So one of you may do good deeds characteristic of the people of Paradise so much that there is nothing except a cubit between him and Paradise but then what has been written for him decides his behavior and he starts doing evil deeds characteristic of the people of Hell Fire and ultimately enters Hell Fire ; and one of you may do evil deeds characteristic of the people of Hell Fire so much so that there is nothing except a cubit between him and Hell Fire ; then what has been written for him decides his behavior and he starts doing good deeds characteristic of the people of Paradise and ultimately enters Paradise. SahihAlBukhari-017-001-1099 | Narrated Abdullah Bin Umar: I heard Allah Messenger ﷺ while he was standing on the pulpit; saying; The remaining period of your stay on the earth in comparison to the nations before you; is like the period between the Asr prayer and sunset. The people of the Torah were given the Torah and they acted upon it till midday; and then they were worn out and were given for their labor; one Qirat each. Then the people of the Gospel were given the Gospel and they acted upon it till the time of the Asr prayer; and then they were worn out and were given for their labor ; one Qirat each. Then you people were given the Quran and you acted upon it till sunset and so you were given two Qirats each double the reward of the previous nations. Then the people of the Torah said; O our Lord! These people have done a little labor much less than we but have taken a greater reward. Allah said; Have I withheld anything from your reward? They said; No. Then Allah said; That is My Favor which I bestow on whom I wish. | The Chapter on Jihad And Alhajj in HodHood Indexing, Chapter on Allahs Wish and Will in Sahih AlBukhari
SahihAlBukhari-017-001-141 | Narrated Abdullah Bin Abbas: The sun eclipsed in the lifetime of the Prophet ﷺ. Allah Messenger ﷺ offered the eclipse prayer and stood for a long period equal to the period in which one could recite Surat AlBaqara. Then he bowed for a long time and then stood up for a long period which was shorter than that of the first standing; then bowed again for a long time but for a shorter period than the first; then he prostrated twice and then stood up for a long period which was shorter than that of the first standing; then he bowed for a long time which was shorter than the previous one; and then he raised his head and stood up for a long period which was shorter than the first standing; then he bowed for a long time which was shorter than the first bowing; and then prostrated twice and finished the prayer. By then; the sun eclipse had cleared. The Prophet ﷺ then said; The sun and the moon are two of the signs of Allah. They eclipse neither because of the death of somebody nor because of his life i.e. birth. So when you see them; remember Allah. The people say; O Allah Messenger ﷺ ! We saw you taking something from your place and then we saw you retreating. The Prophet ﷺ replied; I saw Paradise and stretched my hands towards a bunch of its fruits and had I taken it; you would have eaten from it as long as the world remains. I also saw the Hell-fire and I had never seen such a horrible sight. I saw that most of the inhabitants were women. The people asked; O Allah Messenger ﷺ ! Why is it so? The Prophet ﷺ replied; Because of their ungratefulness. It was asked whether they are ungrateful to Allah. The Prophet said; They are ungrateful to their companions of life husbands and ungrateful to good deeds. If you are benevolent to one of them throughout the life and if she sees anything undesirable in you; she will say; I have never had any good from you. | The Chapter on Prostration And Eclipse Of The Sun in HodHood Indexing, Chapter on To offer the Eclipse Salat prayer in congregation in Sahih AlBukhari

SahihAlBukhari-017-001-1618 | Narrated Aisha: The commencement of the Divine Inspiration to Allah Messenger ﷺ was in the form of good righteous true dreams in his sleep. He never had a dream but that it came true like bright day light. He used to go in seclusion the cave of Hira where he used to worship Allah Alone continuously for many days nights. He used to take with him the journey food for that stay and then come back to his wife Khadija to take his food like-wise again for another period to stay; till suddenly the Truth descended upon him while he was in the cave of Hira. The angel came to him in it and asked him to read. The Prophet ﷺ replied; I do not know how to read. The Prophet ﷺ added ; The angel caught me forcefully and pressed me so hard that I could not bear it anymore. He then released me and again asked me to read; and I replied; I do not know how to read; whereupon he caught me again and pressed me a second time till I could not bear it anymore. He then released me and asked me again to read; but again I replied; I do not know how to read or; what shall I read?. Thereupon he caught me for the third time and pressed me and then released me and said; Read: In the Name of your Lord; Who has created all that exists. Has created man from a clot. Read and Your Lord is Most Generous...up to.......that which he knew not. 96.15 Then Allah Messenger ﷺ returned with the Inspiration; his neck muscles twitching with terror till he entered upon Khadija and said; Cover me! Cover me! They covered him till his fear was over and then he said; O Khadija; what is wrong with me? Then he told her everything that had happened and said; I fear that something may happen to me. Khadija said; Never! But have the glad tidings; for by Allah; Allah will never disgrace you as you keep good reactions with your Kith and kin; speak the truth; help the poor and the destitute; serve your guest generously and assist the deserving; calamityafflicted ones. Khadija then accompanied him to her cousin Waraqa Bin Nawfal Bin Asad Bin Abdul Uzza Bin Qusai. Waraqa was the son of her paternal uncle; i.e.; her father brother; who during the Pre-Islamic Period became a Christian and used to write the Arabic writing and used to write of the Gospels in Arabic as much as Allah wished him to write. He was an old man and had lost his eyesight. Khadija said to him; O my cousin! Listen to the story of your nephew. Waraqa asked; O my nephew! What have you seen? The Prophet ﷺ described whatever he had seen. Waraqa said; This is the same Namus i.e.; Gabriel; the Angel who keeps the secrets whom Allah had sent to Moses. I wish I were young and could live up to the time when your people would turn you out. Allah Messenger ﷺ asked; Will they turn me out? Waraqa replied in the affirmative and said: Never did a man come with something similar to what you have brought but was treated with hostility. If I should remain alive till the day when you will be turned out then I would support you strongly. But after a few days Waraqa died and the Divine Inspiration was also paused for a while and the Prophet ﷺ became so sad as we have heard that he intended several times to throw himself from the tops of high mountains and every time he went up the top of a mountain in order to throw himself down; Gabriel would appear before him and say; O Muhammad! You are indeed Allah Messenger ﷺ in truth whereupon his heart would become quiet and he would calm down and would return home. And whenever the period of the coming of the inspiration used to become long; he would do as before; but when he used to reach the top of a mountain; Gabriel would appear before him and say to him what he had said before. Ibn Abbas said regarding the meaning of: He it is that Cleaves the daybreak from the darkness 6.96 that AlAsbah. means the light of the sun during the day and the light of the moon at night. | The Chapter on Revelation And Angles in HodHood Indexing, Chapter on Commencement of the Divine Revelation to Allahs Messenger was in the form of good dreams in Sahih AlBukhari
SahihAlBukhari-017-001-2003 | Narrated Abdullah: Allah Messenger ﷺ ; the truthful and truly-inspired; said; Each one of you collected in the womb of his mother for forty days; and then turns into a clot for an equal period of forty days and turns into a piece of flesh for a similar period of forty days and then Allah sends an angel and orders him to write four things; i.e.; his provision; his age; and whether he will be of the wretched or the blessed in the Hereafter. Then the soul is breathed into him. And by Allah; a person among you or a man may do deeds of the people of the Fire till there is only a cubit or an arm-breadth distance between him and the Fire; but then that writing which Allah has ordered the angel to write precedes; and he does the deeds of the people of Paradise and enters it; and a man may do the deeds of the people of Paradise till there is only a cubit or two between him and Paradise; and then that writing precedes and he does the deeds of the people of the Fire and enters it. | The Chapter on Angeles And Good Deeds And Day Of Hell Fire in HodHood Indexing, Chapter on Chapter in Sahih AlBukhari

Umar Bin AlKhattab asked Allah Messenger ﷺ about that. Allah Messenger ﷺ said; Order him your son to take her back and keep her till she is clean and then to wait till she gets her next period and becomes clean again; whereupon; if he wishes to keep her; he can do so; and if he wishes to divorce her he can divorce her before having sexual intercourse with her; and that is the prescribed period which Allah has fixed for the women meant to be divorced. | The Chapter on Illegal Sexual Intercourse And Alcohol in HodHood Indexing, Chapter on O Prophet When you divorce women divorce them at their Idda and count their Idda in Sahih AlBukhari

So Maaqil disagreed to remarry her to him. Then Allah revealed: When you have divorced women and they have fulfilled the term of their prescribed period; do not prevent them from marrying their former husbands. 2.232 So the Prophet ﷺ sent for Maaqil and recited to him Allah order and consequently Maaqil gave up his pride and haughtiness and yielded to Allah order. | The Chapter on Supplications And Guidance in HodHood Indexing, Chapter on And their husbands have the better right to take them back in Sahih AlBukhari

Whenever Abdullah bin Umar was asked about that; he would say to the questioner; If you divorced her thrice; she is no longer lawful for you unless she marries another man and the other man divorces her in his turn. SahihAlBukhari-017-001-3207 | Narrated Mujahid: regarding the Verse : If any of you dies and leaves wives behind; That was the period of the Iddah which the widow was obliged to spend in the house of the late husband. Then Allah revealed: And those of you who die and leave wives should bequeath for their wives a year maintenance and residence without turning them out; but if they leave; there is no blame on you for what they do of themselves; provided it is honorable i.e. lawful marriage 2.240 Mujahid said: Allah has ordered that a widow has the right to stay for seven months and twenty days with her husband relatives through her husband will and testament so that she will complete the period of one year of Iddah. But the widow has the right to stay that extra period or go out of her husband house as is indicated by the statement of Allah: But if they leave there is no blame on you;... 2.240 Ibn Abbas said: The above Verse has cancelled the order of spending the period of the Iddah at her late husband house; and so she could spend her period of the Iddah wherever she likes. And Allah says: Without turning them out. Ata said: If she would; she could spend her period of the Iddah at her husband house; and live there according to her husbands will and testament; and if she would; she could go out of her husband house as Allah says: There is no blame on you for what they do of themselves. 2.240 Ata added: Then the Verses of inheritance were revealed and the order of residence for the widow was cancelled; and she could spend her period of the Iddah wherever she would like; and she was no longer entitled to be accommodated by her husband family. | The Chapter on Marriage And Iddah in HodHood Indexing, Chapter on And those of you who die and leave behind wives in Sahih AlBukhari

SahihAlBukhari-017-001-3322 | Narrated Abdullah Bin Amr Bin AlAs: My father got me married to a lady of a noble family; and often used to ask my wife about me; and she used to reply; What a wonderful man he is! He never comes to my bed; nor has he approached me since he married me. When this state continued for a long period; my father told the story to the Prophet who said to my father; Let me meet him. Then I met him and he asked me; How do you fast? I replied; I fast daily; He asked; How long does it take you to finish the recitation of the whole Quran? I replied; I finish it every night. On that he said; Fast for three days every month and recite the Quran and finish it in one month. I said; But I have power to do more than that. He said; Then fast for three days per week. I said; i have the power to do more than that. He said; Therefore; fast the most superior type of fasting; that is; the fasting of prophet David who used to fast every alternate day; and finish the recitation of the whole Quran In seven days. I wish I had accepted the permission of Allah Messenger ﷺ as I have become a weak old man. It is said that Abdullah used to recite one-seventh of the Quran during the day-time to some of his family members; for he used to check his memorization of what he would recite at night during the daytime so that it would be easier for him to read at night. SahihAlBukhari-017-001-3517 | Narrated Urwa Bin AlZubair: Aisha; the wife of the Prophet ﷺ told him that there were four types of marriage during Pre-Islamic period of Ignorance. One type was similar to that of the present day i.e. a man used to ask somebody else for the hand of a girl under his guardianship or for his daughter hand; and give her Mahr and then marry her. The second type was that a man would say to his wife after she had become clean from her period. Send for so-and-so and have sexual intercourse with him. Her husband would then keep awy from her and would never sleep with her till she got pregnant from the other man with whom she was sleeping. When her pregnancy became evident; he husband would sleep with her if he wished. Her husband did so i.e. let his wife sleep with some other man so that he might have a child of noble breed. Such marriage was called as AlIstibda. Another type of marriage was that a group of less than ten men would assemble and enter upon a woman; and all of them would have sexual relation with her. If she became pregnant and delivered a child and some days had passed after delivery; she would sent for all of them and none of them would refuse to come; and when they all gathered before her; she would say to them; You all know waht you have done; and now I have given birth to a child. So; it is your child so-and-so! naming whoever she liked; and her child would follow him and he could not refuse to take him. The fourth type of marriage was that many people would enter upon a lady and she would never refuse anyone who came to her. Those were the prostitutes who used to fix flags at their doors as sign; and he who would wished; could have sexual intercourse with them. If anyone of them got pregnant and delivered a child; then all those men would be gathered for her and they would call the Qaif persons skilled in recognizing the likeness of a child to his father to them and would let the child follow the man whom they recognized as his father and she would let him adhere to him and be called his son. The man would not refuse all that. But when Muhammad ﷺ was sent with the Truth; he abolished all the types of marriages observed in pre-Islamic period of Ignorance except the type of marriage the people recognize today. | The Chapter on Marriage And Pregnancy in HodHood Indexing, Chapter on Whoever said A marriage is not valid except through the Wali in Sahih AlBukhari
SahihAlBukhari-017-001-3585 | Narrated Abdullah Bin Abbas: During the lifetime of Allah Messenger ﷺ ; the sun eclipsed. Allah Messenger ﷺ offered the prayer of the eclipse and so did the people along with him. He performed a long Qiyam standing posture during which Surat AlBaqara could have been recited; then he performed a pro-longed bowing; then raised his head and stood for a long time which was slightly less than that of the first Qiyam and recited Quran. Then he performed a prolonged bowing again but the period was shorter than the period of the first bowing; then he stood up and then prostrated. Again he stood up; but this time the period of standing was less than the first standing. Then he performed a prolonged bowing but of a lesser duration than the first; then he stood up again for a long time but for a lesser duration than the first. Then he performed a prolonged bowing but of lesser duration than the first; and then he again stood up; and then prostrated and then finished his prayer. By then the sun eclipse had cleared. The Prophet ﷺ then said; The sun and the moon are two signs among the signs of Allah; and they do not eclipse because of the death or birth of someone; so when you observe the eclipse; remember Allah offer the eclipse prayer. They the people said; O Allah Messenger ﷺ ! We saw you stretching your hand to take something at this place of yours; then we saw you stepping backward. He said; I saw Paradise or Paradise was shown to me ; and I stretched my hand to pluck a bunch of grapes ; and had I plucked it; you would have eaten of it as long as this world exists. Then I saw the Hell Fire; and I have never before; seen such a horrible sight as that; and I saw that the majority of its dwellers were women. The people asked; O Allah Messenger ﷺ ! What is the reason for that? He replied; Because of their ungratefulness. It was said. Do they disbelieve in Allah are they ungrateful to Allah ? She said; How long shall we enjoy this good order i.e. Islamic religion which Allah has brought after the period of ignorance? He said; You will enjoy it as long as your Imams keep on abiding by its rules and regulations. She asked; What are the Imams? Call the man to me. When the man was called to him; he told him of his thought. The man said; I have never seen such a day on which a Muslim is faced with such an accusation. Umar said; I am determined that you should tell me the truth. He said; I was a foreteller in the pre-lslamic period of ignorance. Then Umar said; Tell me the most astonishing thing your female Jinn has told you of. He said; One-day while I was in the market; she came to me scared and said; Havent you seen the Jinns and their despair and they were overthrown after their defeat and prevented from listening to the news of the heaven so that they stopped going to the sky and kept following camel-riders i.e. Arabs ? Umar said; He is right. and added; One day while I was near their idols; there came a man with a calf and slaughtered it as a sacrifice for the idols. An unseen creature shouted at him; and I have never heard harsher than his voice. He was crying; O you bold evil-doer! A matter of success! An eloquent man is saying: None has the right to be worshipped except you O Allah. On that the people fled; but I said; I shall not go away till I know what is behind this. SunanAlTermithi-017-001-8523 | Narrated Ibn Umar: that the Messenger of Allah ﷺ said: Your period in comparison to the periods of the previous nations; is like the period between Prayer AlAsr until sunset. And you are in comparison to the Jews and Christians; like a man who employeed some workers and he said: Who will work for me until Midday for a Qirat each? So the Jews worked for half a day for a Qirat each. Then he said: Who will work for me from the middle of the day until Prayer AlAsr for a Qirat each? So the Christians worked for a Qirat each. Then it is you who are doing the work from Prayer AlAsr until the setting of the sun for two Qirats each. So the Jews and the Christians got angry and said: We did more work but were given less? So He Allah says: Have I wronged you in any of your rights? The Prophet ﷺ commanded that when he menstruation was finished; she should take bath and pray.1Said Bin Jubair reported from Ali and Ibn Abbas : A woman suffering from a prolonged flow of blood should refrain from prayers during her menstrual period.1Ammar; the freed slave of Banu Hashim and Talq Bin Habib narrated in a similar way.1Similarly; it was reported by Maaqil AlKhathami from Ali4; AlShabi also transmitted it in a similar manner from Qumair; the wife of Masruq; on the authority of Aishah.1Abu Dawud said: AlHasan; Saeed Bin AlMusayab; Ata; Makhul; Ibrahim; Salim and AlQasim also hold that a woman suffering from a prolonged flow of blood should abandon prayer during her menstrual period.Abu Dawud said: Qatadah did not hear anything from Urwah. | The Chapter on Prolonged Menstruation in HodHood Indexing, Chapter on Concerning The Woman Who Has Istihadah And Those Scholars Who Stated That She Should Leave The Prayer For The Number Of Days Which She Used To Menstruate in Sunan Abu Dawoud
SunanAbuDawoud-017-001-26440 | Narrated Aisha; Ummul Muminin: Bahiyah said: I heard a woman asking Aisha about the woman whose menses became abnormal and she had an issue of blood. The Messenger of Allah ﷺ asked me to advise her that she should consider the period during which she used to menstruate every month; when her menstruation was normal. Then she should count the days equal to the length of time of her normal menses ; then she should abandon prayer during those days or equal to that period. She should then take a bath; tie a cloth on her private parts a pray. | The Chapter on Menstruation And Idda In Marriage in HodHood Indexing, Chapter on When The Menstruation Starts She Should Leave The Prayer in Sunan Abu Dawoud
SunanAbuDawoud-017-001-26442 | Narrated Fatimah daughter of Abu Hubaysh: Urwah Ibn AlZubair reported from Fatimah daughter of Abu Hubaysh that her blood kept flowing; so the Prophet ﷺ said to her: When the blood of the menses comes; it is black blood which can be recognised; so when that comes; refrain from prayer; but when a different type of blood comes; perform ablution and pray; for it is due only to a vein.Abu Dawud said: Ibn AlMuthanna narrates this tradition from his book on the authority of Ibn Adi in a similar way. Later on he transmitted it to us from his memory: Muhammad Bin Amr reported to us from AlZuhri from Urwah on the authority of Aisha who said: Fatimah used to have her blood flowing. He then reported the tradition conveying the same meaning.Abu Dawud said: Anas Bin Seereen reported from Ibn Abbas about the woman who has a prolonged flow of blood. He said: If she sees thick blood; she should not pray; if she finds herself purified even for a moment; she should was an pray.Makhul said: Menses are not hidden from women. Their blood is black and thick. When it blackness and thickness goes away and there appears yellowness and liquidness; that is the flow of blood from vein. She should wash and pray.Abu Dawud said: This tradition has been transmitted by Saeed Bin AlMusayab through a different chain of narrators; saying: The woman who has a prolonged flow of blood should abandon prayer when the menstruation begins; when it is finished; she should wash and pray.Sumay and others have also reported it from Saeed Bin AlMusayab. This version adds: She should refrain from prayer during her menstrual period.Hammad Bin Salamah has reported it similarly from Yahya Bin Saeed on the authority of Saeed Bin AlMusayab.Abu Dawud said: Yunus has reported from AlHasan: When the bleeding of a menstruating woman extends beyond the normal period ; she should refrain from prayer ; after her menses are over; for one or two days. Now she becomes the woman who has a prolonged flow of blood AlTaimi reported from Qatadah: If her menstrual period is prolonged by five days; she should pray. AlTaimi said: I kept on reducing the number of days until I reached two days. He said: If the period extends by two days; they will be counted from the menstrual period. When Ibn Seereen was questioned about it; he said: Women have better knowledge of that. | The Chapter on Prolonged Menstruation in HodHood Indexing, Chapter on When The Menstruation Starts She Should Leave The Prayer in Sunan Abu Dawoud

Mussah; said: I performed Hajj and came to Umm Salamah and said to her : Mother of the believers; Samurah Bin Jundub commands women to complete the prayers abandoned during their menstrual period. She said: They should not do so. The wives of the Prophet ﷺ would refrain from prayer for forty nights i.e. days during the course of bleeding after child birth. The Prophet ﷺ would not command them to complete the prayers abandoned during the period of bleeding.Muhammad Bin Hatim said: The name of AlAzdiyah is Mussah and her patronymic name is Umm Busrah.Abu Dawud said: The patronymic names of Kathir Bin Ziyad s Abu Sahl. | The Chapter on Menstruation And Sexual Intercourse in HodHood Indexing, Chapter on What Has Been Narrated Regarding The Time Limit Of PostPartum Bleeding in Sunan Abu Dawoud

MuwataMalik-017-001-34783 | Malik said; The position with us about a woman who is found to be pregnant and has no husband and she says; I was forced; or she says; I was married; is that it is not accepted from her and the hadd is inflicted on her unless she has a clear proof of what she claims about the marriage or that she was forced or she comes bleeding if she was a virgin or she calls out for help so that someone comes to her and she is in that state or what resembles it of the situation in which the violation occurred. He said; If she does not produce any of those; the hadd is inflicted on her and what she claims of that is not accepted from her. Malik said; A raped woman cannot marry until she has restored herself by three menstrual periods. He said; If she doubts her periods; she does not marry until she has freed herself of that doubt. | The Chapter on Writing Oaths And Pledges in HodHood Indexing, The Book of Sadaqa in Muwata Malik
MuwataMalik-017-001-34915 | Yahya said; I heard Malik say that if a man pledges his garden for a stated period and the fruits of that garden are ready before the end of that period; the fruits are not included in the pledge with the real estate; unless it is stipulated by the pledger in his pledge. However; if a man receives a slave-girl as a pledge and she is pregnant or she becomes pregnant after his taking her as a pledge; her child is included with her. A distinction is made between the fruit and the child of the slave-girl. The Messenger of Allah; may Allah bless him and grant him peace; said; If someone sells a palm which has been pollinated; the fruit belongs to the seller unless the buyer stipulates its inclusion. The undisputed way of doing things in our community is that if a man sells a slave-girl or an animal with a foetus in its womb; the foetus belongs to the buyer; whether or not the buyer stipulates it. The palm is not like the animal. Fruit is not like the foetus in its mother womb. Part of what clarifies that is also that it is the usage of people to have a man pawn the fruit of the palm apart from the palm. No one pawns the foetus in its mother womb whether of slaves or animals. | The Chapter on Agriculture And Selling Of Fruits in HodHood Indexing, The Book of The Evil Eye in Muwata Malik
MuwataMalik-017-001-35239 | Yahya related to me from Malik from Nafi that Abdullah Ibn Umar said; When the slave divorces his wife twice; she is haram for him until she has married another husband; whether she is free or a slave. The idda of a free woman is three menstrual periods; and the idda of a slave-girl is two periods. | The Chapter on Slave Girls And Sexual Intercourse in HodHood Indexing, The Book of The Mudabbar in Muwata Malik
MuwataMalik-017-001-35246 | Yahya related to me from Malik from Nafi and Zayd Ibn Aslam from Sulayman Ibn Yasar that AlAhwas died in Syria when his wife had begun her third menstrual period after he had divorced her. Muawiya Ibn Abi Sufyan wrote and asked Zayd Ibn Thabit about that. Zayd wrote to him; When she began her third period; she was free from him and he was free from her; and he does not inherit from her nor she from him. | The Chapter on Slave As A Property in HodHood Indexing, The Book of Wills and Testaments in Muwata Malik
MuwataMalik-017-001-35252 | Yahya related to me from Malik from Yahya Ibn Said from a man of the Ansar that his wife asked him for a divorce; and he said to her; When you have had your period; then tell me. When she had her period; she told him. He said; When you are purified then tell me. When she was purified; she told him and he divorced her. Malik said; This is the best of what I have heard about it. | The Book of Wills and Testaments in Muwata Malik
MuwataMalik-017-001-35259 | Malik said; What is done among us when a slave divorces a slave- girl when she is a slave and then she is set free; is that her idda is the idda of a slave-girl; and her being set free does not change her idda whether or not he can still return to her. Her idda is not altered. Malik added; The hadd-punishment which a slave incurs is the same as this. When he is freed after he has incurred but before the punishment has been executed; his hadd is the hadd of the slave. Malik said; When a free man divorces a slave-girl three times; her idda is two periods. When a slave divorces a free woman twice; her idda is three periods. Malik said about a man who had a slave-girl as a wife; and he bought her and set her free; Her idda is the idda of a slave-girl; i.e. two periods; as long as he has not had intercourse with her. If he has had intercourse with her after buying her and before he set her free; she only has to wait until one period has passed. | The Chapter on Slave Girls And Sexual Intercourse in HodHood Indexing, The Book of Qirad in Muwata Malik
MuwataMalik-017-001-35262 | Yahya related to me from Malik from Ibn Shihab that Said Ibn AlMusayab said; The idda of the woman who bleeds constantly is a year. Malik said; What is done among us about a divorced woman whose periods stop when her husband divorces her is that she waits nine months. If she has not had a period in them; she has an idda of three months. If she has a period before the end of the three months; she accepts the period. If another nine months pass without her having a period; she does an idda of three months. If she has a second period before the end of those three months; she accepts the period. If nine months then pass without a period; she does an idda of three months. If she has a third period; the idda of the period is complete. If she does not have a period; she waits three months; and then she is free to marry. Her husband can return to her before she becomes free to marry unless he made her divorce irrevocable. Malik said; The sunna with us is that when a man divorces his wife and has the option to return to her; and she does part of her idda and then he returns to her and then parts from her before he has had intercourse with her; she does not add to what has passed of her idda. Her husband has wronged himself and erred if he returned to her and had no need of her. Malik said; What is done among us is that if a woman becomes a muslim while her husband is a kafir and then he becomes muslim; he is entitled to her as long as she is in her idda. If her idda is finished; he has no access to her. If he remarries her after the end of her idda; however; that is not counted as divorce. Islam removed her from him without divorce. | The Chapter on Marriage And Entitlements in HodHood Indexing, The Book of Qirad in Muwata Malik
MuwataMalik-017-001-35303 | 108 Yahya related to me from Malik that he had heard that the Messenger of Allah; may Allah bless him and grant him peace; visited Umm Salamah while she was in mourning for Abu Salama and she had put aloes on her eyes. He said; What is this; Umm Salama? She said; It is only aloes; Messenger of Allah. He said; Put it on at night and wipe it off in the daytime. Malik said; The mourning of a young girl who has not yet had a menstrual period takes the same form as the mourning of one who has had a period. She avoids what a mature woman avoids if her husband dies. Malik said; A slave-girl mourns her husband when he dies for two months and five nights like her idda. Malik said; An umm walad does not have to mourn when her master dies; and a slave-girl does not have to mourn when her master dies. Mourning is for those with husbands. | The Chapter on Slaves And Praise And Worship in HodHood Indexing, The Book of Slaughtering Animals in Muwata Malik
MuwataMalik-017-001-35533 | Yahya related to me from Malik that Humayd Ibn Oays AlMakki told him; I was with Mujahid while he was performing tawaf around the Kaba; and a man came to him and asked whether the days of fasting for kaffara had to be fasted consecutively; or could they be split up. I said to him; Yes; they can be split up; if the person so wishes. Mujahid said; He should not split them up; because in Ubay Ibn Kaab recitation they are referred to as three consecutive days. Malik said; What I like most is what Allah has specified in the Quran; that is; that they are fasted consecutively. Malik was asked about a woman who began the day fasting in Ramadan and though it was outside of the time of her period; fresh blood i.e. not menstrual blood flowed from her. She then waited until evening to see the same; but did not see anything. Then; on the next day in the morning she had anotherflow; though less than the first. Then; some days before her period; the flow stopped completely. Malik was asked what she should do about her fasting and prayer; and he said; This blood is like menstrual blood. When she sees it she should break her fast; and then make up the days she has missed. Then; when the blood has completely stopped; she should do ghusl and fast. Malik was asked whether someone who became muslim on the last day of Ramadan had to make up all of Ramadan or whether he just had to make up the day when he became muslim; and he said; He does not have to make up any of the days that have passed. He begins fasting from that day onwards. What I like most is that he makes up the day on which he became muslim. | The Chapter on Ramadan And Fasting And Deeds in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35967 | Yahya related to me from Malik from Abdulrahman Ibn AlQasim from his father that Aisha said; I came to Makka at the time of my period so I did not do tawaf of the House or go between Safa and Marwa. I complained to the Messenger of Allah; may Allah bless him and grant him peace; and he said; Do what the people doing hajj do except do not do tawaf of the House and go between Safa and Marwa until you are pure. Malik said; concerning a woman who entered ihram for umra at the time of hajj; and she arrived in Makka during her period and so could not do tawaf of the House; When she fears that the time for hajj is getting close; she gets into ihram for the hajj and sacrifices an animal. She is like someone who combines the hajj and the umra. One tawaf is enough for her. If a women starts her period after she has already done tawaf of the House and prayed; she does say between Safa and Marwa and stops at Arafa and Muzdalifa and stones the jamras but she does not do the tawaf Alifada until she is pure and has finished her menses. | The Chapter on Makkah And Alhajj in HodHood Indexing, The Book of Fasting in Muwata Malik
MuwataMalik-017-001-35972 | Yahya related to me from Malik from Abdullah Ibn Abi Bakr from his father that Abu Salama Ibn Abdulrahman told him that Umm Sulaym bint Milhan asked the Messenger of Allah; may Allah bless him and grant him peace; for advice one time when she had begun menstruating; or had given birth to a child after she had done tawaf Alifada on the Day of Sacrifice. The Messenger of Allah; may Allah bless him and grant him peace; gave her permission to leave. Malik said; A woman menstruating at Mina stays until she has done tawaf of the House. There is no escape from that for her. If she has already done the tawaf Alifada and she starts to menstruate afterwards; she may leave for her country; since permission for the menstruating women to leave has been transmitted to us from the Messenger of Allah; may Allah bless him and grant him peace. He added; If a woman starts her period at Mina before she does the tawaf Alifada; and the period lasts longer than usual; she has to stay longer than the time that bleeding would usually detain women. | The Chapter on Menstruation And Tawaf in HodHood Indexing, The Book of Fasting in Muwata Malik |
