Settle his case according to Allah Book Laws. and allow me to speak; He said; My son was a laborer for this man and he committed illegal sexual intercourse with his wife. The people told me that my son should be stoned to death but I ransomed him with one-hundred sheep and a slave girl. Then I asked the religious learned people and they told me that his wife should be stoned to death and my son should receive one-hundred lashes and be sentenced to one year of exile. The Prophet ﷺ said; By Him in Whose Hands my life is; I will judge between you according to Allah Book Laws : As for the slave girl and the sheep; they are to be returned; and as for your son; he shall receive onehundred lashes and will be exiled for one year. You; O Unais! addressing a man from Bani Aslam; Go tomorrow morning to the wife of this man and if she confesses; then stone her to death. SahihAlBukhari-017-001-2014 | Narrated Abu Huraira: We witnessed along with Allah Messenger ﷺ the Khaibar campaign. Allah Messenger ﷺ told his companions about a man who claimed to be a Muslim; This man is from the people of the Fire. When the battle started; the man fought very bravely and received a great number of wounds and got crippled. On that; a man from among the companions of the Prophet ﷺ came and said; O Allah Apostle! Do you know what the man you described as of the people of the Fire has done? He has fought very bravely for Allah Cause and he has received many wounds. The Prophet ﷺ said; But he is indeed one of the people of the Fire. Some of the Muslims were about to have some doubt about that statement. So while the man was in that state; the pain caused by the wounds troubled him so much that he put his hand into his quiver and took out an arrow and committed suicide with it. Off went some men from among the Muslims to Allah Messenger ﷺ and said; O Allah Messenger ﷺ ! Allah has made your statement true. So-and-so has committed suicide. Allah Messenger ﷺ said; O Bilal! SahihAlBukhari-017-001-3724 | Narrated Ibn Abbas: When Abu Dhar received the news of the Advent of the Prophet ﷺ he said to his brother; Ride to this valley of Mecca and try to find out the truth of the person who claims to be a prophet who is informed of the news of Heaven. Listen to what he says and come back to me. So his brother set out and came to the Prophet ﷺ and listened to some of his talks; and returned to Abu Dhar and said to him. I have seen him enjoining virtuous behavior and saying something that is not poetry. Abu Dhar said; You have not satisfied me as to what I wanted. He then took his journey-food and carried a waterskin of his; containing some water till be reached Mecca. He went to the Masjid and searched for the Prophet and though he did not know him; he hated to ask anybody about him. When a part of the night had passed away; Ali saw him and knew that he was a stranger. So when Abu Dhar saw Ali; he followed him; and none of them asked his companion about anything; and when it was dawn; Abu Dhar took his journey food and his water-skin to the Masjid and stayed there all the day long without being perceived by the Prophet; and when it was evening; he came back to his retiring place. Ali passed by him and said; Has the man not known his dwelling place yet? So Ali awakened him and took him with him and none of them spoke to the other about anything. When it was the third day. Ali did the same and Abu Dhar stayed with him. Then Ali said Will you tell me what has brought you here? Abu Dhar said; If you give me a firm promise that you will guide me; then I will tell you. Ali promised him; and he informed Ali about the matter. Ali said; It is true; and he is the Messenger of Allah. Next morning when you get up; accompany me; and if I see any danger for you; I will stop as if to pass water; but if I go on; follow me and enter the place which I will enter. Abu Dhar did so; and followed Ali till he entered the place of the Prophet; and Abu Dhar went in with him; Abu Dhar listened to some of the Prophet talks and embraced Islam on the spot. The Prophet ﷺ said to him; Go back to your people and inform them about it till you receive my order. Abu Dhar said; By Him in Whose Hand my life is; I will proclaim my conversion loudly amongst them i.e. the pagans. So he went out; and when he reached the Masjid; he said as loudly as possible; I bear witness that None has the right to be worshipped except Allah; and Muhammad is the Messenger of Allah. The People got up and beat him painfully. Then AlAbbas came and knelt over him to protect him and said to the people ; Woe to you! Dont you know that this man belongs to the tribe of Ghifar and your trade to Sham is through their way? So he rescued him from them. Abu Dhar again did the same the next day. SahihAlBukhari-017-001-7064 | Narrated Aisha: The wife of the Prophet Whenever Allah Messenger ﷺ intended to go on a journey; he used to draw lots among his wives and would take with him the one on whom the lot had fallen. Once he drew lots when he wanted to carry out a Ghazwa; and the lot came upon me. So I proceeded with Allah Apostle after Allah order of veiling the women had been revealed and thus I was carried in my howdah on a camel and dismounted while still in it. We carried on our journey; and when Allah Apostle had finished his Ghazwa and returned and we approached Medina; Allah Messenger ﷺ ordered to proceed at night. When the army was ordered to resume the homeward journey; I got up and walked on till I left the army camp behind. When I had answered the call of nature; I went towards my howdah; but behold ! A necklace of mine made of Jaz Azfar a kind of black bead was broken and I looked for it and my search for it detained me. The group of people who used to carry me; came and carried my howdah on to the back of my camel on which I was riding; considering that I was therein. At that time women were light in weight and were not fleshy for they used to eat little food ; so those people did not feel the lightness of the howdah while raising it up; and I was still a young lady. They drove away the camel and proceeded. Then I found my necklace after the army had gone. I came to their camp but found nobody therein so I went to the place where I used to stay; thinking that they would miss me and come back in my search. While I was sitting at my place; I felt sleepy and slept. Safwan Bin AlMuattil AlSulami AlDhakw-ani was behind the army. He had started in the last part of the night and reached my stationing place in the morning and saw the figure of a sleeping person. He came to me and recognized me on seeing me for he used to see me before veiling. I got up because of his saying: Inna Li Allahi wa inna ilaihi rajiun; which he uttered on recognizing me. I covered my face with my garment; and by Allah; he did not say to me a single word except; Inna Li Allahi wa inna ilaihi rajiun; till he made his shecamel kneel down whereupon he trod on its forelegs and I mounted it. Then Safwan set out; leading the camel that was carrying me; till we met the army while they were resting during the hot midday. Then whoever was meant for destruction; fell in destruction; and the leader of the Ifk forged statement was Abdullah Bin Ubai Bin Salul. After this we arrived at Medina and I became ill for one month while the people were spreading the forged statements of the people of the Ifk; and I was not aware of anything thereof. But what aroused my doubt while I was sick; was that I was no longer receiving from Allah Messenger ﷺ the same kindness as I used to receive when I fell sick. Allah Messenger ﷺ would enter upon me; say a greeting and add; How is that lady ? and then depart. That aroused my suspicion but I was not aware of the propagated evil till I recovered from my ailment. I went out with Um Mistah to answer the call of nature towards AlManasi; the place where we used to relieve ourselves; and used not to go out for this purpose except from night to night; and that was before we had lavatories close to our houses. And this habit of ours was similar to the habit of the old Arabs in the deserts or in the tents concerning the evacuation of the bowels; for we considered it troublesome and harmful to take lavatories in the houses. So I went out with Um Mistah who was the daughter of Abi Ruhm Bin Abd Manaf; and her mother was daughter of Sakhr Bin Amir who was the aunt of Abi Bakr AlSiddiq; and her son was Mistah Bin Uthatha. When we had finished our affair; Um Mistah and I came back towards my house. Um Mistah stumbled over her robe whereupon she said; Let Mistah be ruined ! I said to her; What a bad word you have said! Do you abuse a man who has taken part in the Battle of Badr? She said; O you there! Didnt you hear what he has said? I said; And what did he say? She then told me the statement of the people of the Ifk forged statement which added to my ailment. When I returned home; Allah Messenger ﷺ came to me; and after greeting; he said; How is that lady ? I said; Will you allow me to go to my parents? At that time I intended to be sure of the news through them. Allah Messenger ﷺ allowed me and I went to my parents and asked my mother; O my mother! What are the people talking about? My mother said; O my daughter! Take it easy; for by Allah; there is no charming lady who is loved by her husband who has other wives as well; but that those wives would find fault with her. I said; Subhan Allah! Did the people really talk about that? That night I kept on weeping the whole night till the morning. My tears never stopped; nor did I sleep; and morning broke while I was still weeping; Allah Messenger ﷺ called Ali Bin Abi Talib and Usama Bin Zaid when the Divine Inspiration delayed; in order to consult them as to the idea of divorcing his wife. Usama Bin Zaid told Allah Messenger ﷺ of what he knew about the innocence of his wife and of his affection he kept for her. He said; O Allah Messenger ﷺ ! She is your wife; and we do not know anything about her except good. But Ali Bin Abi Talib said; O Allah Messenger ﷺ ! Allah does not impose restrictions on you; and there are plenty of women other than her. If you however; ask her slave girl; she will tell you the truth. Aisha added: So Allah Messenger ﷺ called for Barira and said; O Barira! Did you ever see anything which might have aroused your suspicion? as regards Aisha. Barira said; By Allah Who has sent you with the truth; I have never seen anything regarding Aisha which I would blame her for except that she is a girl of immature age who sometimes sleeps and leaves the dough of her family unprotected so that the domestic goats come and eat it. So Allah Messenger ﷺ got up and addressed the people an asked for somebody who would take revenge on Abdullah Bin Ubai Bin Salul then. Allah Messenger ﷺ ; while on the pulpit; said; O Muslims! Who will help me against a man who has hurt me by slandering my family? By Allah; I know nothing except good about my family; and people have blamed a man of whom I know nothing except good; and he never used to visit my family except with me; Saad Bin Muadh AlAnsari got up and said; O Allah Messenger ﷺ ! By Allah; I will relieve you from him. If he be from the tribe of Bani alaous then I will chop his head off; and if he be from our brethren; the Khazraj; then you give us your order and we will obey it. On that; Saad Bin Ubada got up; and he was the chief of the Khazraj; and before this incident he had been a pious man but he was incited by his zeal for his tribe. He said to Saad bin Muadh ; By Allah the Eternal; you have told a lie! You shall not kill him and you will never be able to kill him! On that; Usaid Bin Hudair; the cousin of Saad bin Muadh got up and said to Saad Bin Ubada; You are a liar! By Allah the Eternal; we will surely kill him; and you are a hypocrite defending the hypocrites! So the two tribes of alaous and AlKhazraj got excited till they were on the point of fighting with each other while Allah Messenger ﷺ was standing on the pulpit. Allah Messenger ﷺ continued quietening them till they became silent whereupon he became silent too. On that day I kept on weeping so much that neither did my tears stop; nor could I sleep. In the morning my parents were with me; and I had wept for two nights and a day without sleeping and with incessant tears till they thought that my liver would burst with weeping. While they were with me and I was weeping; an Ansari woman asked permission to see me. I admitted her and she sat and started weeping with me. While I was in that state; Allah Apostle came to us; greeted; and sat down;. He had never sat with me since the day what was said; was said. He had stayed a month without receiving any Divine Inspiration concerning my case. Allah Messenger ﷺ recited the Tashahhud after he had sat down; and then said; Thereafter; O Aisha! I have been informed such and-such a thing about you; and if you are innocent; Allah will reveal your innocence; and if you have committed a sin; then ask for Allah forgiveness and repent to Him; for when a slave confesses his sin and then repents to Allah; Allah accepts his repentance. When Allah Apostle had finished his speech; my tears ceased completely so that I no longer felt even a drop thereof. Then I said to my father; Reply to Allah Messenger ﷺ on my behalf as to what he said. He said; By Allah; I do not know what to say to Allah Messenger ﷺ. Then I said to my mother; Reply to Allah Apostle. She said; I do not know what to say to Allah Messenger ﷺ. Still a young girl as I was and though I had little knowledge of Quran; I said; By Allah; I know that you heard this story of the Ifk so much so that it has been planted in your minds and you have believed it. So now; if I tell you that I am innocent; and Allah knows that I am innocent; you will not believe me; and if I confess something; and Allah knows that I am innocent of it; you will believe me. By Allah; I cannot find of you an example except that of Joseph father: So for me patience is most fitting against that which you assert and it is Allah Alone Whose help can be sought. Then I turned away and lay on my bed; and at that time I knew that I was innocent and that Allah would reveal my innocence. But by Allah; I never thought that Allah would sent down about my affair; Divine Inspiration that would be recited forever ; as I considered myself too unworthy to be talked of by Allah with something that was to be recited: but I hoped that Allah Messenger ﷺ might have a vision in which Allah would prove my innocence. By Allah; Allah Messenger ﷺ had not left his seat and nobody had left the house when the Divine Inspiration came to Allah Messenger ﷺ. So there overtook him the same hard condition which used to overtake him when he was Divinely Inspired so that the drops of his sweat were running down; like pearls; though it was a cold winter day; and that was because of the heaviness of the Statement which was revealed to him. When that state of Allah Messenger ﷺ was over; and he was smiling when he was relieved; the first word he said was; Aisha; Allah has declared your innocence. My mother said to me; Get up and go to him. I said; By Allah; I will not go to him and I will not thank anybody but Allah. So Allah revealed: Verily! They who spread the Slander are a gang among you. Think it not.... 24.11-20. When Allah revealed this to confirm my innocence; Abu Bakr AlSiddiq who used to provide for Mistah Bin Uthatha because of the latter kinship to him and his poverty; said; By Allah; I will never provide for Mistah anything after what he has said about Aisha. So Allah revealed: continued... continuing... 1 : -6.274:...... Let not those among you who are good and are wealthy swear not to give help to their kinsmen; those in need; and those who have left their homes for Allah Cause. Let them Pardon and forgive i.e. do not punish them. Do you not love that should forgive you? Verily Allah is Oft-forgiving. Most Merciful. 24.22 Abu Bakr said; Yes; by Allah; I wish that Allah should forgive me. So he resumed giving Mistah the aid he used to give him before and said; By Allah; I will never withold it from him at all. Aisha further said: Allah Messenger ﷺ also asked Zainab bint Jahsh about my case. He said; O Zainab! What have you seen? She replied; O Allah Messenger ﷺ ! I protect my hearing and my sight by refraining from telling lies. I know nothing but good about Aisha. Of all the wives of Allah Messenger ﷺ ; it was Zainab who aspired to receive from him the same favor as I used to receive; yet; Allah saved her from telling lies because of her piety. SahihMuslim-017-001-18043 | It is narrated on the authority of Urwa Bin AlZubair who narrated from Aisha that she informed him that Fatima; daughter of the Messenger of Allah ﷺ ; sent someone to Abu Bakr to demand from him her share of the legacy left by the Messenger of Allah ﷺ from what Allah had bestowed upon him at Medina and Fadak and what was left from one-filth of the income annually received from Khaibar. Abu Bakr said: The Messenger of Allah ﷺ said: We prophets do not have any heirs; what we leave behind is to be given in charity. The household of the Messenger of Allah ﷺ will live on the income from these properties; but; by Allah; I will not change the charity of the Messenger of Allah ﷺ from the condition in which it was in his own time. I will do the same with it as the Messenger of Allah may peace be upun him himself used to do. So Abu Bakr refused to hand over anything from it to Fatima who got angry with Abu Bakr for this reason. She forsook him and did not talk to him until the end of her life. She lived for six months after the death of the Messenger of Allah ﷺ. When she died; her husband. Ali Bin Abu Talib; buried her at night. He did not inform Abu Bakr about her death and offered the funeral prayer over her himself. During the lifetime of Fatima; All received special regard from the people. After she had died; he felt estrangement in the faces of the people towards him. So he sought to make peace with Abu Bakr and offer his allegiance to him. He had not yet owed allegiance to him as Caliph during these months. He sent a person to Abu Bakr requesting him to visit him unaccompanied by anyone disapproving the presence of Umar. Umar said to Abu Bakr: BY Allah; you will not visit them alone. Abu Bakr said: What will they do to me? By Allah; I will visit them. And he did pay them a visit alone. All recited Tashahhud as it is done in the beginning of a religious sermon ; then said: We recognise your moral excellence and what Allah has bestowed upon you. We do not envy the favour i. e. the Catiphate which Allah nas conferred upon you; but you have done it assumed the position of Caliph alone without consulting us ; and we thought we had a right to be consulted on account of our kinship with the Messenger of Allah ﷺ. He continued to talk to Abu Bakr in this vein until the latter eyes welled up with tears. Then Abd Bakr spoke and said: By Allah; in Whose Hand is my life; the kinship of the Messenger of Allah ﷺ is dearer to me than the kinship of my own people. As regards the dispute that has arisen between you and me about these properties; I have not deviated from the right course and I have not given up doing about them what the Messenger of Allah ﷺ used to do. So Ali said to Abu Bakr: This aftetnoon is fixed for swearing allegiance to you. So when Abu Bakr had finished his Zuhr prayer; he ascended the pulpit and recited Tashahhud; and described the status of Ali; his delay in swearing allegiance and the excuse which lie had offered to him for this delay. After this he asked for God forgiveness. Then Ali Bin Abu Talib recited the Tashahhud. extolled the merits of Abu Bakr and said that his action was nott prompted by any jealousy of Abu Bakr on his part or his refusal to accept the high position which Allah had conferred upon him; adding: But we were of the opinion that we should have a share in the government; but the matter had been decided without taking us into confidence; and this displeased us. Hence the delay in offering allegiance. The Muslims were pleased with this explanation and they said: You have done the right thing. So when the revelation began to descend upon him Umar wrapped him the Holy Prophet with cloth I came to him and projected my head with him into the cloth; and saw him the Holy Prophet receiving the revelation. When he the Holy Prophet was relieved of its burden ; he said: Where is the inquirer who was just inquiring about Umra? That man came to him. When his Companions heard that; they hastened to catch up with him; since they knew that he had something to say. He ﷺ said: Do you know what Day this is? That is the Day when Adam will be called. His Lord will call him and say: O Adam; send forth those who are to be sent to the Fire. He will say: O Lord! How many are to be sent to the Fire? He said: So some of the people grief went away; and he ﷺ said: Strive hard and receive the good news. By the One in Whose Hand is the soul of Muhammad! Ibn Abbas wrote to him: You wrote to me asking me if the Messenger of Allah ﷺ would fight along with women. He did fight along with them; as they would treat the wounded. They received something from the spoils of war; but as for their share; then he did not fix a share for them.There is something on this topic from Anas and Umm Atiyah.This Hadith isHassan Sahih. This is acted upon according to most of the people of knowledge. It is the view of Sufyan AlThawri and AlShafii. Some of them said that a share is given to the woman and the boy; and this is the view of AlAwzai AlAwzai said: The Prophet ﷺ gave a portion to the boys at Khaibar; and the Aimmah of the Muslims gave a portion to every child born in the land of war. SunanAbuDawoud-017-001-25093 | Ibn Abbas said Hilal Bin Umayah accused his wife in the presence of Prophet ﷺ of having committed adultery with Sharik Bin Sahma. The Prophet ﷺ said Produce evidence or you must receive punishment on your back. He said Apostle of Allaah ﷺ when one of us sees a man having intercourse with his wife should he go and seek evidence? But the Prophet ﷺ merely said You must produce evidence or you must receive punishment on your back. Hilal then said By Him Who sent you with the Truth; I am speaking Truly. May Allaah send down something which will free my back from punishment. Then the following Quranic verses were revealed And those who make charges against their spouses but have no witnesses except themselves reciting till he reached one of those who speak the truth. The Prophet ﷺ then returned and sent for them and they came to him. Hilal Bin Umayah stood up and testified and the Prophet ﷺ was saying Allaah knows that one of you is lying. Will one of you repent? Then the woman got up and testified; but when she was about to do it a fifth time saying that Allaahs anger be upon her if he was one of those who spoke the truth; they said to her this is the deciding one. Ibn Abbas said She then hesitated and drew back so that we thought the she would withdraw what she said Look and see whether she gives birth to a child with eyes looking as if they have antimony in them; wide buttocks and fat legs; if she did. Sharik Bin Sahma will be its father. She then gave birth to a child of a similar description. A man came from the Yemen; and said: Three men from the people of the Yemen came to Ali; quarrelling about a child; asking him to give a decision. They had had sexual intercourse with a woman during a single state of purity. He said to two of them: Give this child to this man the third person with pleasure. But they refused and cried loudly. Again he said to two of them: Give the child to the man the third person willingly. But they refused and cried loudly. He then said: You are quarrelsome partners. I shall cast lots among you; he who receives the lot; will acquire the child; and he shall pay two-thirds of the blood-money to both his companions. SunanAbuDawoud-017-001-28029 | Narrated Ali Ibn Abu Talib: Ali said on the pulpit in the Masjid of Kufah: When Friday comes; the devils go to the markets with their flags; and involve people in their needs and prevent them from the Friday prayer. The angels come early in the morning; sit at the door of the Masjid; and record that so-and-so came at the first hour; and so-and-so came at the second hour until the imam comes out for preaching. When a man sits in a place where he can listen to the sermon and look at the imam ; where he remains silent and does not interrupt; he will receive a double reward. If he stays away; sits in a place where he cannot listen to the sermon ; silent; and does not interrupt; he will receive the reward only once. If he sits in a place where he can listen to the sermon and look at the imam ; and he does not remain silent; he will have the burden of it. If anyone says to his companion sitting besides him to be silent while the imam is preaching ; he is guilty of idle talk. Anyone who interrupts during the sermon will receive nothing no reward on that Friday. SunanAbuDawoud-017-001-29095 | Nafi Abu Ghalib said: I was in the Sikkat AlMirbad. A bier passed and a large number of people were accompanying it. They said: Bier of Abdullah Ibn Umayr. So I followed it. Suddenly I saw a man; who had a thin garment on riding his small mule. He had a piece of cloth on his head to protect himself from the sun. I asked: Who is this important man? People said: This is Anas Ibn Malik. When the bier was placed; Anas stood and led the funeral prayer over him while I was just behind him; and there was no obstruction between me and him. He stood near his head; and uttered four takbirs Allah is Most Great. He neither lengthened the prayer nor hurried it. He then went to sit down. They said: Abu Hamzah; here is the bier of an Ansari woman. They brought her near him and there was a green cupola-shaped structure over her bier. He stood opposite her hips and led the funeral prayer over her as he had led it over the man. He then sat down. AlAla Ibn Ziyad asked: Abu Hamzah; did the Messenger of Allah ﷺ say the funeral prayer over the dead as you have done; uttering four takbirs Allah is Most Great over her; and standing opposite the head of a man and the hips of a woman? He replied: Yes. He asked: Abu Hamzah; did you fight with the Messenger of Allah? He replied: Yes. I fought with him in the battle of Hunayn. The polytheists came out and invaded us so severely that we saw our horses behind our backs. Among the people i.e. the unbelievers there was a man who was attacking us; and striking and wounding us with his sword. Allah then defeated them. They were then brought and began to take the oath of allegiance to him for Islam. A man from among the companions of the Prophet ﷺ said: I make a vow to myself that if Allah brings the man who was striking us with his sword that day; I shall behead him. The Messenger of Allah ﷺ kept silent and the man was brought as a captive. When he saw the Messenger of Allah ﷺ ; he said: Messenger of Allah; I have repented to Allah. The Messenger of Allah ﷺ stopped for a while receiving his oath of allegiance; so that the other man might fulfil his vow. But the man began to wait for the order of the Messenger of Allah ﷺ for his murder. He was afraid of the Messenger of Allah ﷺ to kill him. When the Messenger of Allah ﷺ saw that he did not do anything; he received his oath of allegiance. The man said: Messenger of Allah; what about my vow? He said: I stopped receiving his oath of allegiance today so that you might fulfil your vow. He said: Messenger of Allah; why did you not give any signal to me? The Prophet ﷺ said: It is not worthy of a Prophet to give a signal. Abu Ghalib said: I asked the people about Anas standing opposite the hips of a woman. They told me that this practice was due to the fact that in the days of the Prophet there were no cupola-shaped structures over the biers of women. MuwataMalik-017-001-34954 | Yahya said that he heard Malik say; What is done in our community about some one who gives a gift not intending a reward is that he calls witnesses to it. It is affirmed for the one to whom it has been given unless the giver dies before the one to whom it was given receives the gift. He said; If the giver wants to keep the gift after he has had it witnessed; he cannot. If the recipient claims it from him; he takes it. Malik said; If some one gives a gift and then withdraws it and the recipient brings a witness to testify for him that he was given the gift; be it goods; gold; silver or animals; the recipient is made to take an oath. If he refuses; the giver is made to take an oath. If he also refuses to take an oath; he gives to the recipient what he claims from him if he has at least one witness. If he does not have a witness; he has nothing. Malik said; If someone gives a gift not expecting anything in return and then the recipient dies; the heirs are in his place. If the giver dies before the recipient has received his gift; the recipient has nothing. That is because he was given a gift which he did not take possession of. If the giver wants to keep it; and he has called witnesses to the gift; he cannot do that.
