SahihAlBukhari-017-001-3517 | Narrated Urwa Bin AlZubair: Aisha; the wife of the Prophet ﷺ told him that there were four types of marriage during Pre-Islamic period of Ignorance. One type was similar to that of the present day i.e. a man used to ask somebody else for the hand of a girl under his guardianship or for his daughter hand; and give her Mahr and then marry her. The second type was that a man would say to his wife after she had become clean from her period. Send for so-and-so and have sexual intercourse with him. Her husband would then keep awy from her and would never sleep with her till she got pregnant from the other man with whom she was sleeping. When her pregnancy became evident; he husband would sleep with her if he wished. Her husband did so i.e. let his wife sleep with some other man so that he might have a child of noble breed. Such marriage was called as AlIstibda. Another type of marriage was that a group of less than ten men would assemble and enter upon a woman; and all of them would have sexual relation with her. If she became pregnant and delivered a child and some days had passed after delivery; she would sent for all of them and none of them would refuse to come; and when they all gathered before her; she would say to them; You all know waht you have done; and now I have given birth to a child. So; it is your child so-and-so! naming whoever she liked; and her child would follow him and he could not refuse to take him. The fourth type of marriage was that many people would enter upon a lady and she would never refuse anyone who came to her. Those were the prostitutes who used to fix flags at their doors as sign; and he who would wished; could have sexual intercourse with them. If anyone of them got pregnant and delivered a child; then all those men would be gathered for her and they would call the Qaif persons skilled in recognizing the likeness of a child to his father to them and would let the child follow the man whom they recognized as his father and she would let him adhere to him and be called his son. The man would not refuse all that. SahihAlBukhari-017-001-4253 | Narrated Abu Huraira: that he heard Allah Messenger ﷺ saying; Allah willed to test three Israelis who were a Leper; a blind man and a bald-headed man. So; he sent them an angel who came to the leper and said; What thing do you like most? He replied; Good color and good skin; for the people have a strong aversion to me. The angel touched him and his illness was cured; and he was given a good color and beautiful skin. The angel asked him; What kind of property do you like best? He replied; Camels or cows. The narrator is in doubt; for either the leper or the bald-headed man demanded camels and the other demanded cows. So he i.e. the leper was given a pregnant camel; and the angel said to him ; May Allah bless you in it. The angel then went to the bald-headed man and said; What thing do you like most? He said; I like good hair and wish to be cured of this disease; for the people feel repulsion for me. The angel touched him and his illness was cured; and he was given good hair. The angel asked him ; What kind of property do you like best? He replied; Cows; The angel gave him a pregnant cow and said; May Allah bless you in it. The angel went to the blind man and asked; What thing do you like best? He said; I like that Allah may restore my eye-sight to me so that I may see the people. The angel touched his eyes and Allah gave him back his eye-sight. The angel asked him; What kind of property do you like best? He replied; Sheep. The angel gave him a pregnant sheep. Afterwards; all the three pregnant animals gave birth to young ones; and multiplied and brought forth so much that one of the three men had a herd of camels filling a valley; and one had a herd of cows filling a valley; and one had a flock of sheep filling a valley. Then the angel; disguised in the shape and appearance of a leper; went to the leper and said; I am a poor man; who has lost all means of livelihood while on a journey. So none will satisfy my need except Allah and then you. In the Name of Him Who has given you such nice color and beautiful skin; and so much property; I ask you to give me a camel so that I may reach my destination. The man replied; I have many obligations so I cannot give you. The angel said; I think I know you; were you not a leper to whom the people had a strong aversion? Werent you a poor man; and then Allah gave you all this property. He replied; This is all wrong ; I got this property through inheritance from my fore-fathers. The angel said; If you are telling a lie; then let Allah make you as you were before. Then the angel; disguised in the shape and appearance of a bald man; went to the bald man and said to him the same as he told the first one; and he too answered the same as the first one did. The angel said; If you are telling a lie; then let Allah make you as you were before. The angel; disguised in the shape of a blind man; went to the blind man and said; I am a poor man and a traveler; whose means of livelihood have been exhausted while on a journey. I have nobody to help me except Allah; and after Him; you yourself. I ask you in the Name of Him Who has given you back your eye-sight to give me a sheep; so that with its help; I may complete my journey. The man said; No doubt; I was blind and Allah gave me back my eye-sight; I was poor and Allah made me rich; so take anything you wish from my property. By Allah; I will not stop you for taking anything you need of my property which you may take for Allah sake. The angel replied; Keep your property with you. SahihAlBukhari-017-001-7221 | Narrated Abu Salama: A man came to Ibn Abbas while Abu Huraira was sitting with him and said; Give me your verdict regarding a lady who delivered a baby forty days after the death of her husband. Ibn Abbas said; This indicates the end of one of the two prescribed periods. I said For those who are pregnant; their prescribed period is until they deliver their burdens. Abu Huraira said; I agree with my cousin Abu Salama. Then Ibn Abbas sent his slave; Kuraib to Umm Salamah to ask her regarding this matter. She replied. The husband of Subaia AlAslamiya was killed while she was pregnant; and she delivered a baby forty days after his death. Then her hand was asked in marriage and Allah Messenger ﷺ married her to somebody. SahihMuslim-017-001-21528 | Ubaidullah Bin Abdullah Bin Utba reported that Amr Bin Hafs Bin AlMughira set out along with Ali Bin Abi Talib Allah be pleased with him to the Yemen and sent to his wife the one pronouncement of divorce which was still left from the irrevocable divorce; and he commanded AlHarith Bin Hisham and Ayash Bin Abu Rabia to give her maintenance allowance. They said to her: By Allah; there is no maintenance allowance for you; except in case you are pregnant. She came to Allah Apostle may peace he upon him and mentioned their opinion to him; whereupon he said: There is no maintenance allowance for you. Then she sought permission to move to another place ; and he the Holy Prophet permitted her. She said: Allah Messenger; where should I go ? He said: To the house of Ibn Umm Maktum and; as he is blind; she could put off her garmeqts in his presence and he would not see her. And when her Idda was over. Allah Apostle ﷺ married her to Usama Bin Zaid. Marwan the governor of Medina sent Qabisa Bin Dhuwaib in order to ask her about this hadith; and she narrated it to him; whereupon Marwan said: We have not heard this hadith but from a woman. We would adopt a safe path where we found the people. Fatima said that when these words of; Marwan were conveyed to her. There is between me and you the word of Allah; the Exalted and Majestic: Do not turn them out of their houses. SunanAbuDawoud-017-001-25111 | Aisha wife of the Prophet ﷺ said Marriage in pre Islamic times was of four kinds. One of them was the marriage contracted by the people today. A man asked another man to marry his relative sister or daughter to him. He fixed the dower and married her to him. Another kind of marriage was that a man asked his wife when she became pure from menstruation to send fro so and so and have sexual intercourse with him. Her husband kept himself aloof and did not have intercourse with her till It became apparent that she was pregnant from the man who had intercourse with her. When it was manifest that she was pregnant; her husband approached her if he liked. This marriage was called istibda to utilize man for intercourse for a noble birth. A third kind of marriage was that a group of people less than ten in number entered upon a woman and had intercourse with her. When she conceived gave birth to a child and a number of days passed after her delivery; she sent for them. No one of them could refuse to attend and they gathered before her. She said to them You have realized your affair. I have now given birth to a child. And this is your son. O so and so. She called the name of anyone of them she liked and the child was attributed to him. A fourth kind of marriage was that many people gathered together and entered upon a woman who did not prevent anyone who came to her. They were prostitutes. They hoisted flags at their doors which served as a sign for the one who intended to enter upon them. When she became pregnant and delivered the child ; they got together before her and called for the experts of tracing relationship from physical features. They attributed the child to whom they considered and it was given to him. The child was called his son and he could not deny. SunanAbuDawoud-017-001-25129 | Ubaid Allah said Marwan sent someone Qabisah to Fatimah and asked her about the case. She said that she was the wife of Abu Hafs. The Prophet ﷺ appointed Ali as governor in a certain part of Yemen. Her husband also proceeded with him. From there he sent a message to her pronouncing one divorce that had yet remained. He commanded Ayash Bin Abi Rabiah and AlHarith Bin Hisham to provide maintenance to her. They said By Allah there is no sustenance for her except in case she is pregnant. She came to the Prophet ﷺ who said There is no sustenance for you except in case you are pregnant. She then asked permission to shift from her house and he gave her permission. She asked Where should I shift. Apostle of Allaah ﷺ ? The Apostle of Allaah ﷺ said to Ibn Umm Maktum. He was blind. She would undress herself and he could not see her. She lived there till her waiting period passed. The Prophet ﷺ married her to Usamah. Qabisah then returned to Marwan and narrated that to him. Marwan said We did not hear this tradition except from a woman; so we shall follow the reliable practice on which we found the people. When this reached Fatimah she said between me and you is the Book of Allah. Allaah the exalted said Divorce them for their waiting period... Thou knowest not it may be that Allaah will afterward bring some new thing to pass. She said What a new thing will emerge after triple divorce.Abu Dawud said A similar tradition has been narrated by Yunus on the authority of AlZuhri. SunanAbuDawoud-017-001-25177 | Muslim Ibn Shubah said: Nafi Ibn Alqamah appointed my father as charge daffaires of his tribe; and commanded him to collect sadaqah zakat from them. My father sent me to a group of them; so I came to an aged man called Sar Ibn Disam I said: My father has sent me to you to collect zakat from you. He asked: What kind of animals will you take; my nephew? I replied: We shall select the sheep and examine their udders. He said: My nephew; I shall narrate a tradition to you. I lived on one of these steppes during the time of the Messenger of Allah ﷺ along with my sheep. Two people riding a camel came to me. They said to me: We are messengers of the Messenger of Allah ﷺ ; sent to you so that you may pay the sadaqah zakat on your sheep. I asked: What is due from me for them? They said: One goat. I went to a goat which I knew was full of milk and fat; and I brought it to them. They said: This is a pregnant goat. The Messenger of Allah ﷺ prohibited us to accept a pregnant goat. I asked: What will you take then? They said: A goat in its second year or a goat in its third year. I then went to a goat which had not given birth to any kid; but it was going to do so. MuwataMalik-017-001-34804 | Yahya related to me that Malik said; What is done in our community in the case of a man who makes his slave-girl a mudabbara and she gives birth to children after that; and then the slave-girl dies before the one who gave her a tadbir is that her children are in her position. The conditions which were confirmed for her are confirmed for them. The death of their mother does not harm them. If the one who made her mudabbara dies; they are free if their value is less than one third of his total property. Malik said; For every mother by birth as opposed to mother by suckling; her children are in her position. If she is free and she gives birth after she is free; her children are free. If she is a mudabbara or mukataba; or freed after a number of years in service; or part of her is free or pledged or she is an umm walad; each of her children are in the same position as their mother. They are set free when she is set free and they are slaves when she is a slave. Malik said about the mudabbara given a tadbir while she was pregnant; Her children are in her position. That is also the position of a man who frees his slave- girl while she is pregnant and does not know that she is pregnant. Malik said; The sunna about such women is that their children follow them and are set free by their being set free. Malik said; It is the same as if a man had bought a slave-girl while she was pregnant. The slave-girl and what is in her womb belong to the one who bought her whether or not the buyer stipulates that. Malik continued; It is not halal for the seller to make an exception about what is in her womb because that is an uncertain transaction. It reduces her price and he does not know if that will reach him or not. That is as if one sold the foetus in the womb of the mother. That is not halal because it is an uncertain transaction. Malik said about the mukatab or mudabbar who bought a slave- girl and had intercourse with her and she became pregnant by him and gives birth; The children of both of them by a slave-girl are in his position. They are set free when he is set free and they are slaves when he is a slave. MuwataMalik-017-001-34889 | Yahya said that he heard Malik say; The best of what I have heard about the testament of a pregnant woman and about what settlements she is permitted in her property is that the pregnant woman is like the sick person. When the illness is light; and one does not fear for the sick person; he does with his property what he likes. If the illness is such that his life is feared for; he can only dispose of a third of his estate. He said; It is the same with a woman who is pregnant. The beginning of pregnancy is good news and joy. It is not illness and no fear because Allah the Blessed; the Exalted; said in His Book; We gave her good news of Ishaq and after Ishaq; Yaqub. Surat ll ayat 71. And He said; She bore a light burden and passed by with it; but when she became heavy; they called upon Allah; their Lord; If you give us a good-doing son; we will be among the thankful. Surat 7 ayat 189. When a pregnant woman becomes heavy; she is only permitted to dispose of a third of her estate. The beginning of this restriction is after six months. Allah; the Blessed; the Exalted; said in His Book; Mothers suckle their children for two complete years. And He said; his bearing and weaning are thirty months. Surat 2 ayat 233. When six months have passed for the pregnant woman from the day she conceived; she is only permitted to dispose of a third of her property. Yahya said that he heard Malik say; A man who is advancing in the row for battle; can only dispose of a third of his property. MuwataMalik-017-001-34915 | Yahya said; I heard Malik say that if a man pledges his garden for a stated period and the fruits of that garden are ready before the end of that period; the fruits are not included in the pledge with the real estate; unless it is stipulated by the pledger in his pledge. However; if a man receives a slave-girl as a pledge and she is pregnant or she becomes pregnant after his taking her as a pledge; her child is included with her. A distinction is made between the fruit and the child of the slave-girl. The Messenger of Allah; may Allah bless him and grant him peace; said; If someone sells a palm which has been pollinated; the fruit belongs to the seller unless the buyer stipulates its inclusion. The undisputed way of doing things in our community is that if a man sells a slave-girl or an animal with a foetus in its womb; the foetus belongs to the buyer; whether or not the buyer stipulates it. The palm is not like the animal. Fruit is not like the foetus in its mother womb. Part of what clarifies that is also that it is the usage of people to have a man pawn the fruit of the palm apart from the palm.
