SahihAlBukhari-017-001-1618 | Narrated Aisha: The commencement of the Divine Inspiration to Allah Messenger ﷺ was in the form of good righteous true dreams in his sleep. He never had a dream but that it came true like bright day light. He used to go in seclusion the cave of Hira where he used to worship Allah Alone continuously for many days nights. He used to take with him the journey food for that stay and then come back to his wife Khadija to take his food like-wise again for another period to stay; till suddenly the Truth descended upon him while he was in the cave of Hira. The angel came to him in it and asked him to read. The Prophet ﷺ replied; I do not know how to read. The Prophet ﷺ added ; The angel caught me forcefully and pressed me so hard that I could not bear it anymore. He then released me and again asked me to read; and I replied; I do not know how to read; whereupon he caught me again and pressed me a second time till I could not bear it anymore. He then released me and asked me again to read; but again I replied; I do not know how to read or; what shall I read?. Thereupon he caught me for the third time and pressed me and then released me and said; Read: In the Name of your Lord; Who has created all that exists. Has created man from a clot. Read and Your Lord is Most Generous...up to.......that which he knew not. 96.15 Then Allah Messenger ﷺ returned with the Inspiration; his neck muscles twitching with terror till he entered upon Khadija and said; Cover me! Cover me! They covered him till his fear was over and then he said; O Khadija; what is wrong with me? Then he told her everything that had happened and said; I fear that something may happen to me. Khadija said; Never! But have the glad tidings; for by Allah; Allah will never disgrace you as you keep good reactions with your Kith and kin; speak the truth; help the poor and the destitute; serve your guest generously and assist the deserving; calamityafflicted ones. Khadija then accompanied him to her cousin Waraqa Bin Nawfal Bin Asad Bin Abdul Uzza Bin Qusai. Waraqa was the son of her paternal uncle; i.e.; her father brother; who during the Pre-Islamic Period became a Christian and used to write the Arabic writing and used to write of the Gospels in Arabic as much as Allah wished him to write. He was an old man and had lost his eyesight. Khadija said to him; O my cousin! Listen to the story of your nephew. Waraqa asked; O my nephew! What have you seen? The Prophet ﷺ described whatever he had seen. Waraqa said; This is the same Namus i.e.; Gabriel; the Angel who keeps the secrets whom Allah had sent to Moses. I wish I were young and could live up to the time when your people would turn you out. Allah Messenger ﷺ asked; Will they turn me out? Waraqa replied in the affirmative and said: Never did a man come with something similar to what you have brought but was treated with hostility. If I should remain alive till the day when you will be turned out then I would support you strongly. But after a few days Waraqa died and the Divine Inspiration was also paused for a while and the Prophet ﷺ became so sad as we have heard that he intended several times to throw himself from the tops of high mountains and every time he went up the top of a mountain in order to throw himself down; Gabriel would appear before him and say; O Muhammad! You are indeed Allah Messenger ﷺ in truth whereupon his heart would become quiet and he would calm down and would return home. And whenever the period of the coming of the inspiration used to become long; he would do as before; but when he used to reach the top of a mountain; Gabriel would appear before him and say to him what he had said before. Ibn Abbas said regarding the meaning of: He it is that Cleaves the daybreak from the darkness 6.96 that AlAsbah. means the light of the sun during the day and the light of the moon at night. | The Chapter on Revelation And Angles in HodHood Indexing, Chapter on Commencement of the Divine Revelation to Allahs Messenger was in the form of good dreams in Sahih AlBukhari

SahihAlBukhari-017-001-1927 | Narrated Urwa-bin AlZubair: Usama Bin Zaid said; The Prophet ﷺ rode over a donkey with a saddle underneath which there was a thick soft Fadakiya velvet sheet. Usama Bin Zaid was his companion rider; and he was going to pay a visit to Saad Bin Ubada who was sick at the dwelling place of Bani AlHarith Bin AlKhazraj; and this incident happened before the battle of Badr. The Prophet ﷺ passed by a gathering in which there were Muslims and pagan idolators and Jews; and among them there was Abdullah Bin Ubai Bin Salul; and there was Abdullah Bin Rawaha too. When a cloud of dust raised by the animal covered that gathering; Abdullah Bin Ubai covered his nose with his Rida sheet and said to the Prophet ; Dont cover us with dust. The Prophet ﷺ greeted them and then stopped; dismounted and invited them to Allah i.e.; to embrace Islam and also recited to them the Holy Quran. Abdullah Bin Ubai Bin Salul said; O man! There is nothing better than what you say; if what you say is the truth. So do not trouble us in our gatherings. Go back to your mount or house; and if anyone of us comes to you; tell your tales to him. On that Abdullah Bin Rawaha said; O Allah Messenger ﷺ ! Come to us and bring it what you want to say in our gatherings; for we love that. So the Muslims; the pagans and the Jews started quarreling till they were about to fight and clash with one another. The Prophet ﷺ kept on quietening them till they all became quiet. He then rode his animal; and proceeded till he entered upon Saad Bin Ubada; he said; O Sad; didnt you hear what Abu Habbab said? He meant Abdullah Bin Ubai. He said so-and-so. Saad Bin Ubada said; O Allah Messenger ﷺ ! Excuse and forgive him; for by Allah; Allah has given you what He has given you. The people of this town decided to crown him as their chief and make him their king. But when Allah prevented that with the Truth which He had given you; it choked him; and that was what made him behave in the way you saw him behaving. So the Prophet excused him. | The Chapter on Alansar And Forgiveness in HodHood Indexing, Chapter on Greeting a mixup gathering in Sahih AlBukhari
SahihAlBukhari-017-001-1953 | Narrated Sahl Bin Sad: There was no name dearer to Ali than his nickname Abu Turab the father of dust. He used to feel happy whenever he was called by this name. Once Allah Messenger ﷺ came to the house of Fatima but did not find Ali in the house. So he asked Where is your cousin? She replied; There was something a quarrel between me and him whereupon he got angry with me and went out without having a midday nap in my house. Allah Messenger ﷺ asked a person to look for him. That person came; and said; O Allah Messenger ﷺ ! He Ali is sleeping in the Masjid. So Allah Messenger ﷺ went there and found him lying. His upper body cover had fallen off to one side of his body; and so he was covered with dust. Allah Messenger ﷺ started cleaning the dust from him; saying; Get up; O Abu Turab! Get up; Abu Turab! SahihAlBukhari-017-001-2149 | Narrated Abu Wail: We paid a visit to Khabbab who was sick; and he said; We migrated with the Prophet ﷺ for Allah Sake and our wages became due on Allah. Some of us died without having received anything of the wages; and one of them was mousab Bin Umar; who was martyred on the day of the battle of Uhud; leaving only one sheet to shroud him in. If we covered his head with it; his feet became uncovered; and if we covered his feet with it; his head became uncovered. So the Prophet ﷺ ordered us to cover his head with it and put some Idhkhir a kind of grass over his feet. On the other hand; some of us have had the fruits of our good deed and are plucking them in this world. | The Chapter on Personal Hygiene The Martyr in HodHood Indexing, Chapter on The superiority of being poor in Sahih AlBukhari
SahihAlBukhari-017-001-217 | Narrated Ibrahim: Once a meal was brought to Abdulrahman Bin Auf and he was fasting. He said; Mustab Bin Umar was martyred and he was better than I and was shrouded in his Burd and when his head was covered with it; his legs became bare; and when his legs were covered his head got uncovered. SahihAlBukhari-017-001-218 | Narrated Khabbab: We emigrated with the Prophet ﷺ in Allah cause; and so our reward was then surely incumbent on Allah. Some of us died and they did not take anything from their rewards in this world; and amongst them was Mustab Bin Umar; and the others were those who got their rewards. Mustab Bin Umar was martyred on the day of the Battle of Uhud and we could get nothing except his Burd to shroud him in. And when we covered his head his feet became bare and vice versa. So the Prophet ﷺ ordered us to cover his head only and to put idhkhir a kind of shrub over his feet. | The Chapter on Personal Hygiene The Martyr in HodHood Indexing, Chapter on If sufficient cloth for the shroud is not available in Sahih AlBukhari

SahihAlBukhari-017-001-2425 | Narrated Ibn Abbas: The Prophet ﷺ once came out to us and said; Some nations were displayed before me. A prophet would pass in front of me with one man; and another with two men; and another with a group of people. and another with nobody with him. Then I saw a great crowd covering the horizon and I wished that they were my followers; but it was said to me; This is Moses and his followers. Then it was said to me; Look I looked and saw a big gathering with a large number of people covering the horizon. It was said; Look this way and that way. So I saw a big crowd covering the horizon. Then it was said to me; These are your followers; and among them there are 70;000 who will enter Paradise without being asked about their accounts. Then the people dispersed and the Prophet ﷺ did not tell who those 70;000 were. So the companions of the Prophet ﷺ started talking about that and some of them said; As regards us; we were born in the era of heathenism; but then we believed in Allah and His Apostle. We think however; that these 70;000 are our offspring. That talk reached the Prophet ﷺ who said; These 70;000 are the people who do not draw an evil omen from birds and do not get treated by branding themselves and do not treat with Ruqya; but put their trust only in their Lord. then Ukasha Bin Muhsin got up and said; O Allah Messenger ﷺ ! Am I one of those 70;000 ? The Prophet ﷺ said; Yes. Then another person got up and said; Am I one of them? SahihAlBukhari-017-001-2475 | Narrated Usama Bin Zaid: The Prophet ﷺ rode a donkey having a saddle with a Fadakiya velvet covering. He mounted me behind him and went to visit Saad Bin Ubada; and that had been before the battle of Badr. The Prophet ﷺ proceeded till he passed by a gathering in which Abdullah Bin Ubai Bin Salul was present; and that had been before Abdullah embraced Islam. The gathering comprised of Muslims; polytheists; i.e.; isolators and Jews. Abdullah Bin Rawaha was also present in that gathering. When dust raised by the donkey covered the gathering; Abdullah Bin Ubai covered his nose with his upper garment and said; Do not trouble us with dust. The Prophet ﷺ greeted them; stopped and dismounted. Then he invited them to Allah i.e.; to embrace Islam and recited to them some verses of the Holy Quran. On that; Abdullah Bin Ubai said; O man ! There is nothing better than what you say if it is true. Do not trouble us with it in our gathering; but return to your house; and if somebody comes to you; teach him there. On that Abdullah Bin Rawaha said; Yes; O Allah Messenger ﷺ ! Bring your teachings to our gathering; for we love that. So the Muslims; the pagans and the Jews started abusing each other till they were about to fight. The Prophet ﷺ kept on quietening them till they became calm. Thereupon the Prophet mounted his animal and proceeded till he entered upon Saad Bin Ubada. He said to him O Sad! Have you not heard what Abu Hubab i.e.; Abdullah Bin Ubai said? Saad said; O Allah Apostle! Excuse and forgive him; for Allah has given you what He has given you. The people of this town Medina decided unanimously to crown him and make him their chief by placing a turban on his head; but when that was prevented by the Truth which Allah had given you he Abdullah Bin Ubai was grieved out of jealously; and that was the reason which caused him to behave in the way you have seen. | The Chapter on Alansar And Forgiveness in HodHood Indexing, Chapter on To visit a patient riding walking or sitting with another person on a donkey in Sahih AlBukhari
SahihAlBukhari-017-001-2698 | Narrated Anas Bin Malik: That he and Abu Talha were coming in the company of the Prophet towards Medina ; while Safiya the Prophet wife was riding behind him on his camel. After they had covered a portion of the way suddenly the foot of the camel slipped and both the Prophet ﷺ and the woman i.e.; his wife; Safiya fell down. Abu Talha jumped quickly off his camel and came to the Prophet saying. O Allah Messenger ﷺ ! Let Allah sacrifice me for you! Have you received any injury? The Prophet ﷺ said; No; but take care of the woman my wife. Abu Talha covered his face with his garment and went towards her and threw his garment over her. Then the woman got up and Abu Talha prepared their camel by tightening its saddle; etc. and both of them the Prophet ﷺ and Safiya mounted it. Then all of them proceeded and when they approached near Medina; or saw Medina; the Prophet ﷺ said; Ayibun; taibun; abidun; liRabbina hamidun We are coming back to Medina with repentance; worshiping our Lord and celebrating His our Lords praises. The Prophet ﷺ continued repeating these words till he entered the city of Medina. | The Chapter on Almadinah And Animal Sacrifice in HodHood Indexing, Chapter on Saying May Allah sacrifice me for you in Sahih AlBukhari
SahihAlBukhari-017-001-2720 | Narrated Usama Bin Zaid: That Allah Messenger ﷺ rode over a donkey covered with a Fadakiya velvet sheet and Usama was riding behind him. He was visiting Saad Bin Ubada who was sick in the dwelling place of Bani AlHarith Bin AlKhazraj and this incident happened before the battle of Badr. They proceeded till they passed by a gathering in which Abdullah Bin Ubai Bin Salul was present.; and that was before Abdullah Bin Ubat embraced Islam. In that gathering there were Muslims; pagan idolators and Jews; and among the Muslims there was Abdullah Bin Rawaha. When a cloud of dust raised by the movement of the animal covered that gathering; Abdullah Bin Ubai covered his nose with his garment and said; Do not cover us with dust. Allah Messenger ﷺ greeted them; stopped; dismounted and invited them to Allah i.e. to embrace Islam and recited to them the Holy Quran. On that Abdullah Bin Ubai Bin Salul said to him; O man! There is nothing better than what you say; if it is the truth. So do not trouble us with it in our gatherings; but if somebody comes to you; you can preach to him. On that Abdullah Bin Rawaha said Yes; O Allah Messenger ﷺ ! Call on us in our gathering; for we love that. So the Muslims; the pagans and the Jews started abusing one another till they were about to fight with one another. Allah Messenger ﷺ kept on quietening them till all of them became quiet; and then Allah Messenger ﷺ rode his animal and proceeded till he entered upon Saad Bin Ubada. Allah Messenger ﷺ said; O Sad! Didnt you hear what Abu Habab said? meaning Abdullah Bin Unbar. He said so-and-so. Saad Bin Ubada said; O Allah Messenger ﷺ ! Let my father be sacrificed for you ! Excuse and forgive him for; by Him Who revealed to you the Book; Allah sent the Truth which was revealed to you at the time when the people of this town had decided to crown him Abdullah Bin Ubai as their ruler. So when Allah had prevented that with the Truth He had given you; he was choked by that; and that caused him to behave in such an impolite manner which you had noticed. So Allah Messenger ﷺ excused him. It was the custom of Allah Messenger ﷺ and his companions to excuse the pagans and the people of the scripture Christians and Jews as Allah ordered them; and they used to be patient when annoyed by them. Allah said: You shall certainly hear much that will grieve you from those who received the Scripture before you.....and from the pagans 3.186 He also said: Many of the people of the scripture wish that if they could turn you away as disbelievers after you have believed..... 2.109 So Allah Messenger ﷺ used to apply what Allah had ordered him by excusing them till he was allowed to fight against them. When Allah Messenger ﷺ had fought the battle of Badr and Allah killed whomever He killed among the chiefs of the infidels and the nobles of Quraish; and Allah Messenger ﷺ and his companions had returned with victory and booty; bringing with them some of the chiefs of the infidels and the nobles of the Quraish as captives. Abdullah Bin Ubai Bin Salul and the pagan idolators who were with him; said; This matter Islam has now brought out its face triumphed ; so give Allah Messenger ﷺ the pledge of allegiance for embracing Islam.. SahihAlBukhari-017-001-2875 | Narrated Abu Saeed AlKhudri: Allah Messenger ﷺ forbade two ways of wearing clothes and two kinds of dealings. A He forbade the dealings of the Mulamasa and the Munabadha. In the Mulamasa transaction the buyer just touches the garment he wants to buy at night or by daytime; and that touch would oblige him to buy it. In the Munabadha; one man throws his garment at another and the latter throws his at the former and the barter is complete and valid without examining the two objects or being satisfied with them B The two ways of wearing clothes were Ishtimal AlSamma; i e.; to cover one shoulder with one garment and leave the other bare: and the other way was to wrap oneself with a garment while one was sitting in such a way that nothing of that garment would cover one private part. | The Chapter on Garments Forbidden Dress in HodHood Indexing, Chapter on Ishtimal AlSamma in Sahih AlBukhari

SahihAlBukhari-017-001-4199 | Narrated Abu Huraira: Allah Messenger ﷺ said; The Prophet Moses was a shy person and used to cover his body completely because of his extensive shyness. One of the children of Israel hurt him by saying; He covers his body in this way only because of some defect in his skin; either leprosy or scrotal hernia; or he has some other defect. Allah wished to clear Moses of what they said about him; so one day while Moses was in seclusion; he took off his clothes and put them on a stone and started taking a bath. When he had finished the bath; he moved towards his clothes so as to take them; but the stone took his clothes and fled; Moses picked up his stick and ran after the stone saying; O stone! Give me my garment! Till he reached a group of Bani Israel who saw him naked then; and found him the best of what Allah had created; and Allah cleared him of what they had accused him of. The stone stopped there and Moses took and put his garment on and started hitting the stone with his stick. By Allah; the stone still has some traces of the hitting; three; four or five marks. This was what Allah refers to in His Saying:- O you who believe! SahihMuslim-017-001-21927 | Abu Huraira reported Allah Messenger way ﷺ as saying: If any owner of gold or silver does not pay what is due on him; when the Day of Resurrection would come; plates of fire would be beaten out for him; these would then be heated in the fire of Hell and his sides; his forehead and his back would be cauterized with them. Whenever these cool down; the process is repeated during a day the extent of which would be fifty thousand years; until judgment is pronounced among servants; and he sees whether his path is to take him to Paradise or to Hell. It was said: Messenger of Allah; what about the camel? He the Holy Prophet said: If any owner of the camel does not pay what is due on him; and of his due in that camel is also to milk it on the day when it comes down to water. When the Day of Resurrection comes a soft sandy plain would be set for him; as extensive as possible; he will find that not a single young one is missing; and they will trample him with their hoofs and bite him with their mouths. As often as the first of them passes him; the last of them would be made to return during a day the extent of which would be fifty thousand years; until judgment is pronounced among servants and he sees whether his path is to take him to Paradise or to Hell. It was again said: Messenger of Allah; what about cows cattle and sheep? He said: It any owner of the cattle and sheep does not pay what is due on them; when the Day of Resurrection comes a soft sandy plain would be spread for them; he will find none of them missing; with twisted horns; without horns or with a broken horn; and they will gore him with their horns and trample him with their hoofs. As often as the first of them passes him the last of them would be made to return to him during a day the extent of which would be fifty thousand years; until judgment would be pronounced among the servants. And he would be shown his path-path leading him to Paradise or to Hell. It was said: Messenger of Allah; what about the horse? Upon this he said: The horses are of three types. To one than these are a burden; and to another man these are a covering; and still to another man these are a source of reward. The one for whom these are a burden is the person who rears them in order to show off; for vainglory and for opposing the Muslims; so they are a burden for him. The one for whom these are a covering is the person who rears them for the sake of Allah but does not forget the right of Allah concerning their backs and their necks; and so they are a covering for him. As for those which bring reward these refer to the person who rears them for the sake of Allah to be used for Muslims and he puts them in meadow and field. And whatever thing do these eat from that meadow and field would be recorded on his behalf as good deeds; as would also the amount of their dung and urine. And these would not break their halter and prance a course or two without having got recorded the amount of their hoof marks and their dung as a good deed on his behalf on behalf of their owner. And their master does not bring them past a river from which they drink; though he did not intend to quench their thirst; but Allah would record for him the amount of what they drink on his behalf as deeds. It was said: Messenger of Allah; what about the asses?; Upon this he said: Nothing has been revealed to me in regard to the asses in particular except this one verse of a comprehensive nature: He who does an atom weight of good will see it; and he who does an atom weight of evil will see it xcix. 7 | The Chapter on Blowing The Horn In The Day Of Judgment in HodHood Indexing, Chapter on 6 in Sahih Muslim
SahihMuslim-017-001-21929 | Abu Huraira reported Allah Messenger ﷺ as saying: No owner of the treasure who does not pay Zakat would be spared but his hoards would be heated in the Fire of Hell and these would be made into plates and with these his sides; his forehead would be cauterised till Allah would pronounce judgment among His servants during a day; the extent of which would be fifty thousand years. He would then see his path; leading either to Paradise or to Hell. And no owner of the camels who does not pay Zakat would be spared but a soft sandy plain would be set for him and they the camels would be made to pass over him till the last of them would be made to return till Allah would pronounce judgment among His servants during a day the extent of which would be fifty thousand years. He would then see his path leading him to Paradise or leading him to Hell. And no owner of the cattle and goats who does not pay Zakat would be spared but a soft sandy plain would be set for him; he would find none of them missing; with twisted horns; without horns; or with broken horns; and they will gore him with their horns and trample him with their hoofs and they would be made to pass over him till the last of them would be made to return till Allah would pronounce judgment among His servants; during a day the extent of which would be fifty thousand years; and he would see the paths leading to Paradise or to Hell. Suhail said: I do not know whether he made mention of the cows. They said: Messenger of Allah ﷺ ; what about the horses? He said: The horses have goodness in their foreheads or he said or goodness is ingrained in the foreheads of the horses Suhail said: I am in doubt as to what was actually said up till the Day Of Judgment. The horses are of three kinds. They are a source of reward to a person; they are a covering to a person; and they are a burden to a person. As for those which bring reward is that a person would get reward who rears them for the sake of Allah and trains them for Him; and nothing disappears in their stomachs but Allah would record for him a good deed. And if they were to graze in the meadow; they would eat nothing but Allah would record for him a reward. And if they were to drink water from the canal; with every drop that; would disappear in their stomachs there would be reward for the owner. He went on describing till a reward was mentioned for their urine and dung. And if they pranced a course or two; there would be recorded a reward for every pace that they covered. As for one for whom they are a covering; he is the man who rears them for honour and dignity but does not forget the right of their backs and their stomachs; in plenty and adversity; As regards one for whom they are a burden; he is that who rears them for vainglory and showing off to the people; for him they are; the burden. I said: No. He said: I heard him say: The Messenger of Allah SAWSYMOBOL forbade ten things: Filing the teeth ; tattoos; plucking hair ; for two men to lie under one cover with no barrier between them; for two women to lie under one cover with no barrier between them; for a man to add more than four fingers width of silk to the bottom of his garment like the foreigners Persians ; and he forbade plundering; riding while sitting on leopard skins and wearing rings- except for rulers. | The Chapter on Standing For Prayers Of The Companions in HodHood Indexing, Chapter on Plucking Hairs in Sunan AlNasai

He said: Kill them; even if you find them clinging to the covers of Kabah. They were Ikrimah Bin Abi Jahl; Abdullah Bin Khatal; Miqyas Bin Subabah and Abdullah Bin Saad Bin Abi AlSarh. Abdullah Bin Khatl was caught while he was clinging to the covers of Kabah. Saeed Bin Huraith and Ammar Bin Yasir both rushed toward him; but Saeed; who was the younger of the two; got there before Ammar; and he killed him. Miqyas Bin Subabah was caught by the people in the marketplace; and they killed him. Ikrimah traveled by sea; and he was caught in a storm. The crew of the ship said: Turn sincerely toward Allah; for your false gods cannot help you at all in this situation. Ikrimah said: By Allah; if nothing came to save me at sea except sincerity toward Allah then nothing else will save me on land. O Allah; I promise You that if You save me from this predicament I will go to Muhammad SAWSYMOBOL and put my hand in his; and I am sure that I will find him generous and forgiving. So he came; and accepted Islam. Abdullah bin Sad Bin Abi Sarh hid in the house of Uthman Bin Affan; and when the Messenger of Allah SAWSYMOBOL called the people to give their Oath of Allegiance; he brought him; and made him stand before the Prophet SAWSYMOBOL. He Uthman said: O Messenger of Allah! Accept the allegiance of Abdullah. He raised his head and looked at him three times; refusing his allegiance each time; then he accepted his allegiance after three times. Then he turned to his Companions and said: Was there not any sensible man among you who would get up when he saw me refusing to give him my hand and kill him? MuwataMalik-017-001-34805 | Malik spoke about a mudabbar who said to his master; Free me immediately and I will give fifty dinars which I will have to pay in instalments. His master said; Yes. You are free and you must pay fifty dinars; and you will pay me ten dinars every year. The slave was satisfied with this. Then the master dies one; two or three days after that. He said; The freeing is confirmed and the fifty dinars become a debt against him. His testimony is permitted; his inviolability as a free man is confirmed; as are his inheritance and his liability to the full hudud punishments. The death of his master; however; does not reduce the debt for him at all. Malik said that if a man who made his slave a mudabbar died and he had some property at hand and some absent property; and in the property at hand there was not enough in the third he was allowed to bequeath to cover the value of the mudabbar; the mudabbar was kept there together with this property; and his tax kharaj was gathered until the master absent property was clear. Then if a third of what his master left would cover his value; he was freed with his property and what had gathered of his tax. If there was not enough to cover his value in what his master had left; as much of him was freed as the third would allow; and his property was left in his hands. | The Chapter on Slave As A Property in HodHood Indexing, The Book of Speech in Muwata Malik
MuwataMalik-017-001-35034 | Yahya related to me from Malik from Abdullah Ibn Abi Bakr Ibn Muhammad Ibn Amr Ibn Hazm that Aban Ibn Uthman and Hisham Ibn Ismail used to mention in their khutbas built-in liability agreements in the sale of slaves; to cover both a three day period and a similar clause covering a year. Malik explained; The defects a lave or slave-girl are found to have from the time they are bought until the end of the three days are the responsibility of the seller. The year agreement is to cover insanity; leprosy; and loss of limbs due to disease. After a year; the seller is free from any liability. Malik said;An inheritor or someone else who sells a slave or slave-girl without any such built-in guarantee is not responsible for any fault in the slave and there is no liability agreement held against him unless he was aware of a fault and concealed it. If he was aware of a fault; the lack of guarantee does not protect him. The purchase is returned. In our view; built-in liability agreements only apply to the purchase of slaves. | The Chapter on Slaves And Praise And Worship in HodHood Indexing, The Book of Setting Free and Wala in Muwata Malik |
