Grant me that I may be grateful for Thy favour which Thou has bestowed upon me, and upon both my parents, and that I may work righteousness such as Thou mayest approve; and be gracious to me in my issue. Truly have I turned to Thee and truly do I bow (to Thee) in Islam."

The person was then put to test according to these verses in the presence of the people. There came he and his wife in the presence of Allah Messenger ﷺ ; and they invoked curses in order to testify their claim. The man swore four times in the name of Allah that he was one of the truthful and then invoked curse for the fifth time saying: Let there be curse of Allah upon him if he were among the liars. Then she began to invoke curse. SahihMuslim-017-001-21546Ubaidullah Bin Abdullah Bin Utba Bin Masud reported that his father wrote to Umar Bin Abdullah b AlArqam AlZuhri that he would go to Subaiah bint AlHirith AlAslamiya Allah be pleased with her and ask her about a verdict from him which Allah Messenger ﷺ gave her when she had asked that from him in regard to the termination of Idda at the birth of a child Umar Bin Abdullah wrote to Abdullah Bin Utba informing him that Subaiah had told him that she had been married to Saad Bin Khaula and he belonged to the tribe of Amir Bin Luay; and was one of those who participated in the Battle of Badr; and he died in the Farewell Pilgrimage and she had been in the family way at that time. And much time had not elapsed that she gave birth to a child after his death and when she was free from the effects of childbirth she embellished herself for those who had to give proposals of marriage. Abd AlSunabil Bin Bakak from Banu Abd AlDar came to her and said: What is this that I see you embellished; perhaps you are inclined to marry; By Allah; you cannot marry unless four months and ten days of Idda are passed. When he said that. I dressed myself; and as it was evening I came to Allah Messenger ﷺ and asked him about it; and he gave me a religious verdict that I was allowed to marry when I had given birth to a child and asked me to marry if I so liked. She said: Two men proposed marriage to her; and she was inclined toward one of them. When they feared that she was becoming single-minded on this issue; and not consulting her family ; they said: It is not permissible for you to marry. She gave birth soon after he died; and when her Nifas ended she adorned herself to receive proposals of marriage. Abu AlSanabil Bin Bakak man from Banu Abd AlDar- went to her and said to her: Why do I see you adorned? Perhaps you want to get married; but by Allah you will not get married until four months and ten days have passed. SunanAlNasai-017-001-15019It was narrated from Yazid Bin Abi Habib that Muhammad Bin Muslim AlZuhri wrote to him mentioning that Ubaidullah Bin Abdullah told him; that Zufar Bin Aws Bin AlHadathan AlNasri told him that Abu AlSanabil Bin Bakak Bin AlSabbaq said to Subaiah AlAslamiyah: It is not permissible for you to get married until four months and ten days; the longer of the two periods; have passed. She went to the Messenger of Allah and asked him about that. She said that the Messenger of Allah ruled that she could get married when she had given birth. She was nine months pregnant when her husband died; and she was married to Saad Bin Khawlah; who died during the Farewell Pilgrimage with the Messenger of Allah. SunanAlNasai-017-001-15020It was narrated from Ubaidullah Bin Abdullah that Abdullah Bin Utbah wrote to Umar Bin Abdullah Bin AlArqam AlZuhri; telling him: Go to Subaiah bint AlHarith AlAslamiyah; and ask her about the ruling of the Messenger of Allah concerning her pregnancy. He said: So Umar Bin Abdullah went to her and asked her. She told him that she was married to Saad Bin Khawlah; who was one of the Companions of the Messenger of Allah who had been present at Badr. He died during the Farewell Pilgrimage; and she gave birth before four months and ten days had passed since her husband death. When her Nifas ended; Abu AlSanabil man from Banu Abd AlDar- went to her and saw that she had adorned herself. He said: Perhaps you want to get married before four months and ten days has passed? She said: When I heard that from Abu AlSanabil; I went to the Messenger of Allah and told him my story. SunanAbuDawoud-017-001-25093Ibn Abbas said Hilal Bin Umayah accused his wife in the presence of Prophet ﷺ of having committed adultery with Sharik Bin Sahma. The Prophet ﷺ said Produce evidence or you must receive punishment on your back. He said Apostle of Allaah ﷺ when one of us sees a man having intercourse with his wife should he go and seek evidence? But the Prophet ﷺ merely said You must produce evidence or you must receive punishment on your back. Hilal then said By Him Who sent you with the Truth; I am speaking Truly. May Allaah send down something which will free my back from punishment. Then the following Quranic verses were revealed And those who make charges against their spouses but have no witnesses except themselves reciting till he reached one of those who speak the truth. The Prophet ﷺ then returned and sent for them and they came to him. Hilal Bin Umayah stood up and testified and the Prophet ﷺ was saying Allaah knows that one of you is lying. Will one of you repent? Then the woman got up and testified; but when she was about to do it a fifth time saying that Allaahs anger be upon her if he was one of those who spoke the truth; they said to her this is the deciding one. Ibn Abbas said She then hesitated and drew back so that we thought the she would withdraw what she said Look and see whether she gives birth to a child with eyes looking as if they have antimony in them; wide buttocks and fat legs; if she did. Sharik Bin Sahma will be its father. She then gave birth to a child of a similar description. The Prophet ﷺ thereupon said If it were not for what has already been stated in Allaahs book I would have dealt severely with her.Abu Dawud said This tradition has been transmitted by the people of Medina alone. SunanAbuDawoud-017-001-25111Aisha wife of the Prophet ﷺ said Marriage in pre Islamic times was of four kinds. One of them was the marriage contracted by the people today. A man asked another man to marry his relative sister or daughter to him. He fixed the dower and married her to him. Another kind of marriage was that a man asked his wife when she became pure from menstruation to send fro so and so and have sexual intercourse with him. Her husband kept himself aloof and did not have intercourse with her till It became apparent that she was pregnant from the man who had intercourse with her. When it was manifest that she was pregnant; her husband approached her if he liked. This marriage was called istibda to utilize man for intercourse for a noble birth. A third kind of marriage was that a group of people less than ten in number entered upon a woman and had intercourse with her. When she conceived gave birth to a child and a number of days passed after her delivery; she sent for them. No one of them could refuse to attend and they gathered before her. She said to them You have realized your affair. I have now given birth to a child. And this is your son. O so and so. She called the name of anyone of them she liked and the child was attributed to him. A fourth kind of marriage was that many people gathered together and entered upon a woman who did not prevent anyone who came to her. They were prostitutes. They hoisted flags at their doors which served as a sign for the one who intended to enter upon them. When she became pregnant and delivered the child ; they got together before her and called for the experts of tracing relationship from physical features. They attributed the child to whom they considered and it was given to him. The child was called his son and he could not deny. SunanAbuDawoud-017-001-25114Rabah said: My people married me to a Roman slave-girl of theirs. I had intercourse with her; and she gave birth to a black male child like me. I named it Abdullah. I again had intercourse with her; and she gave birth to a black male child like me. I named it Ubaydullah. Then a Roman slave of my people; called Yuhannah; incited her; and spoke to her in his own unintelligible language. She gave birth to a son like a chameleon red. I asked her: What is this? She replied: This belongs to Yuhannah. We then brought the case to Uthman for a decision. I think Mahdi said these words. He inquired from both of them; and they acknowledged the facts. SunanAbuDawoud-017-001-25145Ubaid Allah Bin Abdullah Bin Utbah said that his father wrote a letter to Abd Allaah Bin AlArqam AlZuhri asking him to visit Subaiah daughter of AlHarith AlAslamiyah and ask her about her story and what the Apostle of Allaah ﷺ said to her when she asked his opinion about her. So; Umar Bin Abdullah wrote in reply to Abdullah Bin Utbah informing him what she told him. She told that she was under i.e.; the wife of Sad Bin Khawlah who belonged to Banu Amir Bin Luway. He was one of those who participated in the battle of Badr. He died at the Farwell Pilgrimage while she was pregnant. Soon after his death she gave birth to a child. When she was purified from her bleeding after child birth she adorned herself for seekers in marriage. Then Abu AlSanabil Bin Bakah a man from Banu Abd AlDar entered upon her and said to her What is the matter seeing you adorned; perhaps you are seeking marriage? I swear by Allah you cannot marry until four months and ten days pass away. Saubaiah said When she said this to me; I gathered my clothes on me when the evening came and I came to the Apostle of Allaah ﷺ and asked him about that. He told me that I became lawful when I had delivered a child. He suggested me to marry if I wished. SunanAbuDawoud-017-001-26638Buraidah said: A woman of Ghamid came to the Prophet ﷺ and said: I have committed fornication. He said: Go back. She returned; and on the next day she came to him again; and said: Perhaps you want to send me back as you did to Maiz Bin Malik. I swear by Allah; I am pregnant. He said to her: Go back. She then returned and came to him the next day. He said to her: Go back until you give birth to a child. She then returned. When she gave birth to a child; she brought the child to him; and said: Here it is! I have given birth to it. He said: Go back; and suckle him until you wean him. When she had weaned him; she brought him the boy to him with something in his hand which he was eating. The boy was then given to a certain man of the Muslims and he the Prophet commanded regarding her. So a pit was dug for her; and he gave orders about her and she was stoned to death. Khalid was one of those who were throwing stones at her. He threw a stone at her. When a drop blood fell on his cheeks; he abused her. The Prophet ﷺ said to him: Gently; Khalid. By Him in whose hand my soul is; she has reported to such an extent that if one who wrongfully takes extra tax were to repent to a like extent; he would be forgiven. The Messenger of Allah; may Allah bless him and grant him peace; said to her; Go away until you give birth. When she had given birth; she came to him. The Messenger of Allah; may Allah bless him and grant him peace; said to her; Go away until you have suckled and weaned the baby. When she had weaned the baby; she came to him. He said; Go and entrust the baby to someone. She entrusted the baby to someone and then came to him. MuwataMalik-017-001-34804Yahya related to me that Malik said; What is done in our community in the case of a man who makes his slave-girl a mudabbara and she gives birth to children after that; and then the slave-girl dies before the one who gave her a tadbir is that her children are in her position. The conditions which were confirmed for her are confirmed for them. The death of their mother does not harm them. If the one who made her mudabbara dies; they are free if their value is less than one third of his total property. Malik said; For every mother by birth as opposed to mother by suckling; her children are in her position. If she is free and she gives birth after she is free; her children are free. If she is a mudabbara or mukataba; or freed after a number of years in service; or part of her is free or pledged or she is an umm walad; each of her children are in the same position as their mother. They are set free when she is set free and they are slaves when she is a slave. Malik said about the mudabbara given a tadbir while she was pregnant; Her children are in her position. That is also the position of a man who frees his slave- girl while she is pregnant and does not know that she is pregnant. Malik said; The sunna about such women is that their children follow them and are set free by their being set free. Malik said; It is the same as if a man had bought a slave-girl while she was pregnant. The slave-girl and what is in her womb belong to the one who bought her whether or not the buyer stipulates that. Malik continued; It is not halal for the seller to make an exception about what is in her womb because that is an uncertain transaction. It reduces her price and he does not know if that will reach him or not. That is as if one sold the foetus in the womb of the mother. That is not halal because it is an uncertain transaction. Malik said about the mukatab or mudabbar who bought a slave- girl and had intercourse with her and she became pregnant by him and gives birth; The children of both of them by a slave-girl are in his position. They are set free when he is set free and they are slaves when he is a slave. Abu Salama Ibn Abdulrahman visited Umm Salamah; the wife of the Prophet; may Allah bless him and grant him peace; and asked her about it Umm Salamah said; Subaya AlAslamiya gave birth half a month after the death of her husband; and two men asked to marry her. One was young and the other was old. She preferred the young man and so the older man said; You are not free to marry yet. Her family were away and he hoped that when her family came; they would give her to him. Abu Salama said; When she gives birth to the child she is carrying; she is free to marry. Ibn Abbas said; At the end of two periods. They sent Kurayb; a mawla of Abdullah Ibn Abbas to Umm Salamah; the wife of the Prophet; may Allah bless him and grant him peace; to ask her about it. He came back and told them that she had said that Subaya AlAslamiya had given birth a few nights after the death of her husband; and she had brought the matter to the Messenger of Allah; may Allah bless him and grant him peace; and he had said; You are free to marry; so marry whomever you wish.
